The purpose of the present study is the understanding of Gentili's position on the law of the sea as expressed in his classic De iure belli . The key constitutive elements turn out to be: 1) the idea of the sea as 'res communis' to all mankind, which amounts to the concept of 'freedom of the sea'; 2) 'jurisdiction' of the coastal state on the adjacent sea, even on the high seas, in order to police crime and prevent/punish piracy. As (...) such these two key elements, if taken in isolation, are rooted in the civil law tradition, but their true meaning can only be captured by placing them in the intellectual framework of which they constitute an integral part. Firstly, the epistemic structure of discourse hinges on the new science of natural jurisprudence, as applied to the subject of 'ius gentium bellicum'; secondly, the constituent theoretical languages emanate from a distinctive combination of civil law, scholastic-theological and humanist traditions. This procedure enables us to highlight the strikingly original and distinctly modern traits of Gentili's perspective on the law of the sea, which emerges as a corollary of his project of international/global order. A project that is based on the crucial notion of 'respublica magna' of mankind, a notion encompassing the two notions of 'freedom' and 'jurisdiction' that constitute and define the legal regime of the sea.The Stoic humanist notion of universal human society as 'corpus unum' implies, first of all, 'freedom of intercourse', or 'ius communicationis', to start from 'free passage' and 'freedom of commerce'. It is in the context of his argument about these basic freedoms that Gentili is finally led to discuss the subject of the 'law of the sea'. But, not only the concept of 'res communis', or 'freedom of use', but also the concept of 'jurisdiction', or 'protection', are strictly related to the same foundational concept of 'respublica magna'. This is a crucial characteristic of Gentili's approach to world order that is proved by reference to two cardinal points of his new 'cosmopolitan justice': 1) the 'international right to punish', as exemplified by the legitimacy of the wars of 'humanitarian intervention' and of the wars in support of the 'common law of mankind'; 2) the 'occupation of vacant land', which again underlines the relevance of the principle of 'jurisdiction' by striking a balance between the principle of 'free use' of nature and the 'jurisdiction' of the local ruler.Such a reconstruction definitely rejects the traditional image of Gentili as a supporter of 'maritime protectionism', on the ground of his Advocatio Hispanica published posthumously in 1613 and containing his pleadings as Spanish advocate before the Court of Admiralty. The guiding assumption here is that the book is strictly of a forensic character and as such devoid of any coherent theoretical substance. To the contrary, in his De iure belli, far from anticipating the English position in favour of 'mare clausum', Gentili tends to anticipate the essentials of Grotius' position, especially at the level of the ethic of the 'modern cosmopolis' and the related theme of colonial empire. On this very plane of discourse, Gentili's thinking transcends the so-called battle of the books and emerges as especially significant in illuminating the wider and deeper intellectual currents that contributed to the development of what were to become basic standard positions of modern international theory. Putnam and others have argued that semantic externalism extends to artifactual kind words such as “pencil” or “doorstop”. I first show that, even with natural kinds, externalism applies to words for ground level kinds. The issue then arises of which categories of artifacts should be identified as kinds in the relevant, restricted sense. I argue that, though there are natural taxonomies of artifactual categories at least some of which have well-defined ground levels, even words for such kinds do not appear (...) to have externalist semantics, as they do not support ignorance or error arguments. Some think that membership to any kind is determined by objective features. Against this, I argue that the makers’ productive intentions are often crucial in selecting which pattern of features counts as constitutive of a kind. Though externalists may insist that membership to a kind is ultimately determined by sharing objective features, the resulting version of externalism can hardly be distinguished from internalism. Different notions of analysis have been both theorized and put to use in early analytic philosophy. Two of them stand out: connective analysis and analysis as paraphrase. The latter played a central role in the development of analytic philosophy from Frege to Quine and beyond. With the advent of formal semantics of natural language in the 1970s, paraphrase came to be characterizable as translation into a formal “target language”. While I claim that the method cannot achieve its original philosophical aims, (...) I insist that, in spite of them, it is far from being a theoretically empty operation and that it lives on in some contemporary philosophical enterprises. (shrink)

There are two prevalent accounts of semantic normativity: the prescriptive account, which can be found in some of Wittgenstein’s remarks, and the regularity account, which may have been Sellars’s view and is nowadays defended by some antinormativists. On the former account, meanings are norms that govern the use of words; on the latter, they are regularities of use which, in themselves, do not engender any prescriptions. I argue that only the prescriptive view can account for certain platitudes about meaning, which (...) motivate the very idea of semantic normativity. After some preliminary clarifications about the form that alleged semantic norms should take in order to be prima facie plausible, I argue—against some antinormativists—that whatever normativity is involved in the meaning of words cannot be brought back to a general norm of truth as distinct from specifically semantic norms, for semantic norms already involve a norm of truth. Next, I examine what I take to be the strongest objection to semantic normativity, namely the identification of meaning with use: as use is just a bunch of facts, it cannot be attributed any normative import. Nowadays, this view has been defended by Paul Horwich. After criticizing Horwich’s claim that meaning, though not normative in itself, has unmediated normative implications, I propose a different view of the relation between use and meaning, on which meaning is not quite identical with use but is grounded on use. I propose as a model the idea of a hyperconformist social system: a system in which customs, and only customs, generate norms. I suggest that language is such a system, and describe two reasons why it is plausible for language to work like that. Finally, I analyze statements of meaning on the model of Ruth Millikan “pushmi-pullyu” representations, i.e. as having both descriptive and normative import. I point out that, however, there are exceptions to meaning’s being grounded on use, as there are cases in which semantic norms are dictated by authorities of several kinds. Lastly, I briefly discuss the suggestion that meaning supervenes on use, showing that, aside from its inherent difficulties, it does not explain why meaning would supervene on use. (shrink)

Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

In this 2017 conversation, Gianni Vattimo discusses with Paolo Diego Bubbio the core themes of his own philosophical journey. Vattimo first comments on the legacy of his mentor Luigi Pareyson and on the differences between Pareyson’s conception of the relation between truth and interpretation and his own. Vattimo and Bubbio then elaborate on the return to Hegel and the possibility of a “hermeneuticized” Hegelianism. The participants also discuss Vattimo’s view of religion and the role that the Christian notion of (...) caritas plays in his “weak hermeneutics.” Finally, Vattimo comments on his recent political writings and on his view of a “hermeneutic communism,” arguing that revolution is possible only as a collective inner transformation. Vattimo concludes by mentioning his recent essays, collected under the title Being and Its Surroundings, in which he presents the radical thesis of Heidegger’s philosophy as a new form of theology. Understanding evolution beyond a gene-centered vision is a fertile ground for new questions and approaches. However, in this systemic perspective, we take issue with the necessity of the concept of information. Through the example of brain and language evolution, we propose the autonomous systems theory as a more biologically relevant framework for the evolutionary perspective offered by Jablonka & Lamb (J&L).

Rerum Novarum is a unique case of an encyclical, for we know in great detail how it was drafted and written. If we connect this knowledge to the fact that Matteo Liberatore - the main thinker who collaborated to its writing - wrote a treatise on the Principles of Political Economy, we can analyse how economic thought and moral theology are intertwined in the work of Liberatore. Similarly, the study of the economic thought of Liberatore can help us understand two (...) important questions of Rerum Novarum, namely, private property and the question of a just wage. (shrink)

En general, la tradición ha interpretado la filosofía platónica como una filosofía dualista a propósito de la existencia de dos mundos. Parto de aceptar esta interpretación de la filosofía platónica con especto a los diálogos de madurez, resaltando algunas caracte rísticas del dualismo, el cual resulta de la teoría de las Formas. Posteriormente, pongo en tela de juicio dicha teoría a partir de los argumentos encontrados en el Parménides. Estos sugieren un rechazo por parte de Platón a la teoría de (...) las Formas y al dualismo que esta supone, lo cual podría desembocar un monismo en los diálogos tardíos. Por último, me enfocaré en algunas secciones del Timeo, argumentando que en este, a partir de una reformulación de su filosofía, Platón logra superar las críticas propuestas en el arménidessin dejar de lado una postura dualista. Expondré cómo el dualismo del Timeorechaza dos de las características esenciales de la teoría de las Formas de los diálogos de madurez: la multiplicidad de Formas y el concepto de ‘participación’. Esto introduciendo a un ser viviente, inteligible y unitario; y la relación, a través de la χώρα, de dicho ser con un universo sensible generado. (shrink)

El artículo pretender mostrar y analizar las formas de acción colectiva de la Asociación de Trabajadores Campesinos del Carare (ATCC), en cuanto actor social y político de la región del Magdalena Medio colombiano. Las lógicas de acción desarrolladas nos conducen a señalar a la organización campesina como una forma de potenciar la dimensión política de los colectivos al ser constructores de procesos de democratización de la territorialidad regional. La dinámica campesina propuesta incluye a los distintos actores armados del conflicto, los (...) cuales han impuesto históricamente lógicas de exclusión y muerte sobre la población civil. Y esta inclusión se basa en la necesidad de la convivencia con todos los constituyentes sociales en un proyecto político de largo aliento. (shrink)

Se pretende reconstruir los argumentos de la exposición metafísica de la Crítica de la razón pura, según los cuales nuestras representaciones de espacio y tiempo deben ser consideradas como intuiciones y no como conceptos. Para cumplir con este objetivo, en primer lugar, se determina un criterio de la intuición (singularidad e inmediatez) y, en segundo lugar, se demuestra que las representaciones de espacio y de tiempo cumplen con ese criterio.

Se pretende reconstruir los argumentos de la exposición metafísica de la Crítica de la razón pura, según los cuales nuestras representaciones de espacio y tiempo deben ser consideradas como intuiciones y no como conceptos. Para cumplir con este objetivo, en primer lugar, se determina un criterio de la intuición y, en segundo lugar, se demuestra que las representaciones de espacio y de tiempo cumplen con ese criterio. The paper reconstructs the arguments of the metaphysical presentation of the Critique of Pure (...) Reason, according to which our representations of space and time should be considered as intuitions and not as concepts. To this effect, a criterion for intuition is established in the first place, and then it is demonstrated that the representations of space and time do in fact fulfill that criterion. (shrink)

An important yet often unacknowledged aspect of moral discourse is the phenomenon of moral impossibility, which challenges more widely accepted models of moral discussion and deliberation as a choice among possible options. Starting from observations of the new possibilities of anti immigrant attitudes and hate crimes which have been described by the press as something being “unleashed,” the paper asks what it means for something to enter or not the sphere of possibility in the moral sense, and whether it is (...) ever desirable for something to remain or be pushed back outside the realm of the morally possible. Three forms of moral impossibility are identified: the unconceived, the unthinkable, and moral incapacity. Through the discussion of a stark fictional example of moral impossibility, the paper concludes that while the category of moral impossibility cannot settle disagreement, it sheds light on some of the most fundamental aspects of moral life. When involved in a disagreement, a common reaction is to tell oneself that, given that the information about one’s own epistemic standing is clearly superior in both amount and quality to the information about one’s opponent’s epistemic standing, one is justified in one’s confidence that one’s view is correct. In line with this natural reaction to disagreement, some contributors to the debate on its epistemic significance have claimed that one can stick to one’s guns by relying in part on information (...) about one’s first-order evidence and the functioning of one’s cognitive capacities. In this article, I argue that such a manoeuvre to settle controversies encounters the problem that both disputants can make use of it, the problem that one may be wrong about one’s current conscious experience, and the problem that it is a live possibility that many of one’s beliefs are the product of epistemically distorting factors. I also argue that, even if we grant that personal information is reliable, when it comes to real-life rather than idealized disagreements, the extent of the unpossessed information about one’s opponent’s epistemic standing provides a reason for doubting that personal information can function as a symmetry breaker. How do we see the world aright? This question is central to Iris Murdoch’s philosophy as well as to that of her great source of inspiration, Simone Weil. For both of them, not only our action, but the very quality of our being depends on the ability to see things as they are, where vision is both a metaphor for immediate understanding and a literal expression of the requirement to train our perception so as to get rid of illusions. For (...) both, too, the method to achieve this goal is attention. For both, finally, attention requires a dethronement of the self, considered as the source of illusion. In this paper I investigate what moral perception means for each of these philosophers and how it operates through attention and its relationship with the self. I will show that, despite many striking similarities, Murdoch’s project does not equal ‘Weil minus God’, but offers a different concept of the self, a different understanding of its removal, and therefore a different picture of attention and moral perception. In evaluating both views, I will gesture towards a third way represented by Zen Buddhism, which both philosophers variously consider but do not embrace. (shrink)

The phenomenon of moral transformation, though important, has received little attention in virtue ethics. In this paper we propose a virtue-ethical model of moral transformation as character transformation by tracking the development of new identity-defining (‘core’) character traits, their expressions, and their priority structure, through the change in what appears as possible or impossible to the moral agent. We propose that character transformation culminates when what previously appeared as morally possible to the agent now appears impossible, i.e. unconceived and unthinkable, (...) moving through stages of transformation where some possibilities gradually disappear while others open up. While we show an example of moral transformation towards virtue, we allow that such transformation can occur in the opposite direction, hence we make claims about ‘character traits’ rather than virtues of vices. Through the example of former slave-trader Rodrigo’s transformation in the film The Mission, we follow the parallel development of new objects of value and ways of valuing (with respect to a group of indigenous people of South America) with the closing down of the possibility of disrespecting and harming them, to the end-point of transformation, where allowing their capture is for Rodrigo both unconceived and, when conceived, unthinkable. The claim that truth is mind dependent has some initial plausibility only if truth bearers are taken to be mind dependent entities such as beliefs or statements. Even on that assumption, however, the claim is not uncontroversial. If it is spelled out as the thesis that “in a world devoid of mind nothing would be true”, then everything depends on how the phrase ‘true in world w’ is interpreted. If ‘A is true in w’ is interpreted as ‘A is true (...) of w’ (i.e. ‘w satisfies A’s truth conditions’, the claim need not be true. If on the other hand it is interpreted as ‘A is true of w and exists in w’ then the claim is trivially true, though devoid of any antirealistic efficacy. Philosophers like Heidegger and Rorty, who hold that truth is mind dependent but reality is not, must regard such principles as “A if and only if it is true that A” as only contingently true, which may be a good reason to reject the mind dependence of truth anyway. If Annette Baier is right that ‘some degree of trust is … the very basis of morality” (Baier 2004, 180) , it is surprising that a philosopher so interested in moral psychology and interpersonal relationships such as Iris Murdoch does not explicitly discuss trust in her work. However, on closer inspection, Murdoch’s proposal of an ethics focused on realism, unselfing and attention crucially depends upon the possibility of trust – trust in reality, and in one’s own capacity for moral vision. (...) Connecting Murdoch's project with feminist philosophy and especially feminist epistemology, and drawing on the philosophy of trust developed by C. Thi Nguyen and Karen Jones, this chapter argues for a vision of 'trust in the world' implicit in Murdoch's work, where trust emerges not in the domain of personal relationships, but in our attitude towards reality, including moral reality, that is not perceived by us as merely something inert. Drawing upon the notion of the uncanny, this article examines my documentary photography concerning the ‘everyday’ indeterminate and potentially ominous spaces around the London transport system following the bombing incidents on the 7th July, 2005. The photographs consist of reframing images found which draw attention to the lingering reminders of terrorism within the cityscape. This paper examines also how issues of representation, race, suspects, victims, protest,defiance and accusations can be evoked in the ficto-critical use of urban documentary photography.
