Vincent Descombes brings together an astonishingly large body of philosophical and anthropological thought to present a thoroughgoing critique of contemporary cognitivism and to develop a powerful new philosophy of the mind. Beginning with a critical examination of American cognitivism and French structuralism, Descombes launches a more general critique of all philosophies that view the mind in strictly causal terms and suppose that the brain--and not the person--thinks. Providing a broad historical perspective, Descombes draws surprising links between cognitivism and earlier (...) anthropological projects, such as Lévi-Strauss's work on the symbolic status of myths. He identifies as incoherent both the belief that mental states are detached from the world and the idea that states of mind are brain states; these assumptions beg the question of the relation between mind and brain. In place of cognitivism, Descombes offers an anthropologically based theory of mind that emphasizes the mind's collective nature. Drawing on Wittgenstein, he maintains that mental acts are properly attributed to the person, not the brain, and that states of mind, far from being detached from the world, require a historical and cultural context for their very intelligibility. Available in English for the first time, this is the most outstanding work of one of France's finest contemporary philosophers. It provides a much-needed link between the continental and Anglo-American traditions, and its impact will extend beyond philosophy to anthropology, psychology, critical theory, and French studies. This paper offers a twofold ontological conceptualization of technology in the Anthropocene. On the one hand, we aim to show how the Anthropocene occasions an experience of our inescapable inclusion in the technological structuring of reality that Martin Heidegger associates with cybernetics. On the other hand, by confronting Heidegger’s thought on technology with Georges Bataille’s consideration of technological existence as economic and averted existence, we will criticize Heidegger’s account by arguing that notwithstanding its inescapable inclusion in cybernetics, technology in the (...) Anthropocene itself fosters an experience of what remains excluded. We conclude by indicating how such an experience is relevant for contemporary philosophical investigation of technology. (shrink)

In this paper I build a case for considering the pioneering behaviourist philosopher Grace de Laguna as one of the grandmothers of analytic philosophy. I argue against the ‘Great Men’ narrative of analytic philosophy as composed of Moore, Russell, Wittgenstein and their followers, and in favour of a more inclusive ‘movement’ narrative of analytic philosophy as a broad and varied movement with an anti-idealist and naturalistic orientation aimed at fitting around novel development in the sciences, including Einsteinian physics and psychology. I compare de Laguna’s prescient early views to Whitehead’s; both share an anti-idealist but also anti-atomist solution to the problem of perception, and both oppose the bifurcation of nature, with de Laguna expressing these views before Whitehead did. Containing three previously unpublished papers by W.V. Quine as well as historical, exegetical, and critical papers by several leading Quine scholars including Hylton, Ebbs, and Ben-Menahem, this volume aims to remedy the comparative lack of historical investigation of Quine and his philosophical context.

In ordinary language, in the medical sciences, and in the overlap between them, we frequently make claims which imply that we might have had different gametic origins from the ones we actually have. Such statements seem intuitively true and coherent. But they counterfactually ascribe different DNA to their referents and therefore contradict material-origin essentialism, which Kripke and his followers argue is intuitively obvious. In this paper I argue, using examples from ordinary language and from philosophy of medicine and bioethics, that (...) statements which attribute alternative material origins to their referents are useful, common in political and medical reasoning, and in many cases best interpreted literally. So we must replace the doctrine of material-origin essentialism with one that can make sense of ordinary discourse and the language of the medical sciences. I propose an anti-essentialist account of such counterfactuals according to which individuals’ modal properties are relative to a given inquiry. (shrink)

This is a discussion of the reaction to the recent research article publication in the journal Protein & Cell by a group of scientists at Sun Yat-sen University using the CRISPR/Cas9 technique on editing non-viable human zygotes. Many commentators condemned the Chinese scientists for overstepping ethical boundaries long accepted in Western countries and accused China of having lax regulations on genomic research in general. We argue that not only did this research follow strict ethical standards and fully comply with current (...) regulations, but China also has a well-developed regulatory framework governing such research comparable to many developed countries. We see the reactions among Western commentators as a misunderstanding of the current situation and an expression of a lack of willingness to acknowledge China as an equal partner in the international debate about proper limits to the development of new biotechnologies. In 1901 Russell had envisaged the new analytic philosophy as uniquely systematic, borrowing the methods of science and mathematics. A century later, have Russell’s hopes become reality? David Lewis is often celebrated as a great systematic metaphysician, his influence proof that we live in a heyday of systematic philosophy. But, we argue, this common belief is misguided: Lewis was not a systematic philosopher, and he didn’t want to be. Although some aspects of his philosophy are systematic, mainly his pluriverse of (...) possible worlds and its many applications, that systematicity was due to the influence of his teacher Quine, who really was an heir to Russell. Drawing upon Lewis’s posthumous papers and his correspondence as well as the published record, we show that Lewis’s non- Quinean influences, including G.E. Moore and D.M. Armstrong, led Lewis to an anti- systematic methodology which leaves each philosopher’s views and starting points to his or her own personal conscience. (shrink)

Pregnancy-based employment discrimination has long been a topic of interest for gender inequality scholars and civil rights agencies. Prior work suggests that employer stereotypes and financial interests leave pregnant women vulnerable to being fired. We still know little, however, about women’s interpretations of their terminations and how employers justify such decisions in the face of arguably protective laws. This article provides much needed, in-depth analyses of such dynamics and a relational account of pregnancy-based employment discrimination claims. Elaborating on theoretical expositions (...) of power and research surrounding the patriarchal character of organizational life, we draw on unique quantitative and qualitative data from verified cases of pregnancy-based firing discrimination. Our analyses reveal a two-pronged legitimation process where employers symbolically vilified pregnant workers while simultaneously amplifying ostensibly meritocratic organizational procedures and concerns. Pregnancy discrimination plaintiffs attempted to counter employer arguments. Yet, their limited power within the organizational hierarchy along with the culturally resonant nature of employer logics—logics that seem gender-neutral but that reify gendered assumptions and prioritize business profit—place pregnant women at a considerable disadvantage. Without attending to such cultural and structural power imbalances and the relational processes that undergird them, pregnancy discrimination will remain a significant problem. (shrink)

A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

Strand S.J.Is the political future of the West a postliberal one? For the past decade, numerous prominent thinkers in America and Europe have been debating this question. Matters that not long ago were merely of historical interest, such as Pope Gelasius I's understanding of the relation between sacral authority and royal power, Thomas Aquinas's thought on monarchy (...) and Robert Bellarmine's theory of the pope's indirect authority in temporal matters are now increasingly studied for their potential answers to contemporary political questions. This development, which would have been nearly unimaginable just a decade earlier, unsurprisingly has been led by Catholics. We say "unsurprisingly" in view of the long pre-modern tradition of Catholic political thought, as well as the Church's long struggle against liberalism during the nineteenth and early twentieth centuries. Some of the current postliberal writers explicitly connect themselves to both of these aspects by using the term "integralist" to describe their position.1 [End Page 889]This "new integralism" represents a radical departure from the mainstream of Catholic political discourse of the last half century, which has largely sought rapprochement with Western liberalism. A group of writers, led by John Courtney Murray, George Weigel, Michael Novak, and Robert George, have held that the American constitutional order is rooted in the natural law tradition, and therefore is basically friendly to Catholic political thought. The Church's role in American life, they say, is upholding the natural law as a public moral philosophy, while embracing the non-establishment clause of the First Amendment as a matter of principle, in accordance with the teachings of the Second Vatican Council. This "Whig Thomism," which for decades represented the predominant outlook of conservative American Catholics, must now face the challenge of a different sort of Thomism represented by the integralists.2While the engagement between Whig Thomists and integralists has received most of the attention from scholars and journalists alike, another postliberal option has emerged in recent years. Its source is a group of Catholic thinkers associated with the Communio theological movement. Their political vision, which has no single name or label, has a complex and subtle relationship with the thought of earlier Communio writers, most of whom shared the Whig Thomist desire for reconciliation with Western liberalism. [End Page 890] The appearance of a Communio postliberalism therefore represents a significant development within this intellectual tradition. The most important representative of the earlier Communio perspective on political questions is Joseph Ratzinger / Pope Benedict XVI, who has recently been lauded as the "most important Catholic thinker of the twentieth century" on matters at the intersection of theology and politics.3In an article titled "Ratzinger's Republic" that appeared in these pages in 2020, we identified a significant tension in his thought about the Church's contribution to political life.4 Exploring Ratzinger's writings on natural law, we demonstrated that two currents are present. In accord with his fundamental theological commitments about nature and grace and about faith and reason, Ratzinger often questioned the effectiveness of arguments from natural law. He claimed that, since reason is historically conditioned, and therefore in the current order marked by sin, reason needs grace and faith to function properly. Yet, on other occasions, Ratzinger strongly endorsed arguments from natural law, highlighting its role as the foundation of a just democratic political order. We traced this ambivalence about natural law back to a dilemma at the heart of Ratzinger's political thought. On the one hand, in accord with his thinking about the relations of nature and grace and faith and reason, Ratzinger argued that the state needs the Church to supply moral values that the state cannot furnish on its own. On the other hand, he believed it belongs to the very nature of the Church to be separate from the state, and he endorsed nonconfessional, religiously pluralistic states.5 In light of these two commitments, Ratzinger argued that the contribution Christians are to make to the state is to supply moral values that were discerned under the influence of grace and divine revelation but... In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. Russell’s use of incomplete symbols constituted progress in philosophy. They allowed Russell to make true negative existential claims, like ‘the present King of France does not exist’, and to analyse away logical constructs like tables. Russell’s view rested on the availability of complete symbols, logically proper names, which single out objects which we know by acquaintance, which we are committed to, and to whose existence discourse about apparent complexes can be reduced. Susan Stebbing enthusiastically embraced incomplete symbols for use in (...) negative existentials and in her innovative theory of metaphysical analysis. Yet she also raised trenchant objections to Russell’s assumption that complete symbols are purely referring expressions, equivalent to mere demonstration or pointing. Stebbing thought it could not be assumed that analysis terminates in objects of acquaintance. In this chapter I lay out Stebbing’s arguments and argue that they bear a striking similarity to those made by Stebbing’s former college’s Mistress, Constance Jones, whose influence on Russell is now largely forgotten but worth recovering. Jones defended a sense-reference (signification-denotation) distinction before Frege. Russell’s objections to that distinction in ‘On Denoting’ appear to borrow from Jones’s presentation of it. In Russell and Jones’s 1911 exchange at the Aristotelian Society, Jones’s arguments that names have signification and are more than mere noises or shapes, and that unless both signification and denotation are taken into account, all identity statements reduce to the trivial ‘a=a’ form, foreshadow Stebbing’s later arguments against complete symbols. Elisabeth was the first of Descartes' interlocutors to press concerns about mind-body union and interaction, and the only one to receive a detailed reply, unsatisfactory though she found it. Descartes took her tentative proposal `to concede matter and extension to the soul' for a confused version of his own view: `that is nothing but to conceive it united to the body. Contemporary commentators take Elisabeth for a materialist or at least a critic of dualism. I read her instead as a (...) dualist of a different variety from Descartes: a forerunner of twenty-first century naturalistic dualism which calls for empirical investigation of the psychological and its posits to be taken just as seriously as physics and its posits. -/- I argue that Elisabeth, a keen scholar of mechanistic physics, objected not to substance dualism per se but to the residual Scholasticism of Descartes' account of mind-body causality and his dogmatism about principal attributes. She queried Descartes' categorisation of the `action' of thought as mind's principal attribute, and his identification of it with the merely negative property of immateriality, holding instead that further philosophical and empirical investigation into the nature of the mind is necessary. I problematise the materialist interpretation of Elisabeth with reference to later letters where she dismissed the materialist Objections of Hobbes and Gassendi and continued to urge further clarifications to Cartesian dualism. I explore Elisabeth's contrasting of statements of mechanistic physics with statements about thought, and her call for further investigation into the properties of the mind, and argue they mark her out as a forerunner of contemporary naturalistic dualism which proposes substance dualism as a best interpretation of recent psychology and of the difference in logical form between current physics and current psychology. For Thomas Aquinas, the creator of natural law is a personal, substantial, and relational God. For Laozi, it is an impersonal, non-substantial, self-manifesting dao. There are similarities, and this article will consider several of them. For Thomas, the act of creation comes from God, and for Laozi the giving birth of the universe is from the dao’s unconditional generosity. Thus it is possible to compare the way in which the world-originating generosity of God generates the moral law and the way (...) in which the self-manifesting dao generates the moral law. In Thomas’s view the natural law is the rational participation of the human being in God’s eternal law. Laozi’s heavenly dao governs all things in the universe, and for this reason human beings and their techniques should comply with dao. Thomas emphasizes human freedom of will and the responsibility to pursue what is good and to avoid what is evil. Laozi emphasizes the objectivity of heavenly dao without any reference to human freedom of will or individual responsibility. With religious Daoism there develops the idea of collective responsibility and the divinization of dao, a point that invites further comparative study of Thomism and Daoism. (shrink)

A parieto-frontal integration theory (P-FIT) model of human intelligence has been proposed based on a review of neuroimaging literature and lesion studies. The P-FIT model provides an important basis for future research. Future studies involving connectivity analyses and an integrative approach of imaging modalities using the P-FIT model should provide vastly increased understanding of the biological bases of intelligence.

Physicalistic theories of psychology are a classic case of scientific imperialism: the explanatory capacity of physics, both with respect to its methods and to its domain, is taken to extend beyond the traditional realm of physics, and into that of psychology. I argue in this paper that this particular imperialistic venture has failed. Contemporary psychology uses methods not modelled on those of physics, embracing first-personal methodology where physics is strictly impersonal. I make the case that whether or not scientific imperialism (...) is in general harmful, in this instance naturalists who reject first philosophy should give up physicalist imperialism. Using only general principles from the philosophy of logic plus accepted physicalist criteria of identity, I show that first-personal psychology embodies a minor but fruitful increase in expressive strength compared to impersonal psychology: the ability to distinguish descriptively indiscriminable posits. Reports of research fraud have raised concerns about research integrity similar to concerns raised about financial accounting fraud. We propose a departure from self-regulation in that researchers adopt the financial accounting approach in establishing trust through an external validation process, in addition to the reporting entities and the regulatory agencies. The general conceptual framework for reviewing financial reports, utilizes external auditors who are certified and objective in using established standards to provide an opinion on the financial reports. These standards have (...) become both broader in scope and increasingly specific as to what information is reported and the methodologies to be employed. We believe that the financial reporting overhaul encompassed in the US Sarbanes–Oxley Act of 2002, which aims at preventing accounting fraud, can be applied to scientific research in 4 ways. First, Sarbanes–Oxley requires corporations to have a complete set of internal accounting controls. Research organizations should use appropriate sampling techniques and audit research projects for conformity with the initial research protocols. Second, corporations are required to have the chief financial officer certify the accuracy of their financial statements. In a similar way, each research organization should have their vice-president of research (or equivalent) certify the research integrity of their research activities. In contrast, the primary responsibility of the existing Research Integrity Officers is to handle allegations of research misconduct, an after-the-fact activity. Third, generally accepted auditing standards specify the appropriate procedures for external review of a corporation’s financial statements. For similar reasons, the research review process would also require corresponding external auditing standards. Finally, these new requirements would be implemented in stages, with the largest 14 research organizations that receive 25% of the total National Institutes of Health funding, adopting these research oversight enhancements first. Background Generally, there is unanimity about the value of community engagement in health-related research. There is also a growing tendency to view genetics and genomics research (GGR) as a special category of research, the conduct of which including community engagement (CE) as needing additional caution. One of the motivations of this study was to establish how differently if at all, we should think about CE in GGR. Aim To assess the perspectives of genetics and genomics researchers in Uganda on CE (...) in GGR. Method A cross-sectional qualitative study was conducted at Makerere University and Uganda Virus Research Institute. Twenty-five individuals participated, the majority being male (sixteen). Participants included nineteen genetics and genomics researchers (researchers and research coordinators), two CE officers, three nurses and one nursing counsellor. Data were collected using in-depth interviews and analyzed in a thematic manner using NVivo version 12 Plus. Study findings Thirteen of the respondents had conducted CE in their GGR in either a geographical and disease-specific community. Some respondents said CE principles are the same and there is no need for special consideration for CE in GGR. Others gave ethical issues in GGR that require special consideration for CE in such research and these were categorized into six themes: GGR is new to communities, Difficulty in communicating GGR by the researchers, Genes are shared in communities, Cultural sensitivities against GGR, Community attitude toward GGR, Some GGR studies take long to end, and Negotiation of research benefits. Special considerations for CE when conducting GGR were suggested and categorized into seven themes: creating awareness of GGR in communities, obtaining both community acceptance and individual consent, CE team composition, involve communities in solving GGR challenges, prolong CE in some GGR, develop guidelines for CE in GGR, and legal considerations on GGR. Conclusion GGR was characterized by special issues that require special CE considerations for such research. (shrink)

Many apps request access to users’ contacts or photos and many consumers agree to these requests. However, agreeing is ethically questionable as it also gives apps access to others’ data. People thus regularly infringe each other’s information privacy. This behavior is at odds with offline practices and still poorly understood. Introducing a novel application of the theory of neutralization, we explore how people justify the giving away of others’ data and the emerging norms surrounding this behavior. To obtain a deeper (...) understanding of the potentially ambiguous norms surrounding the behavior, we investigate how people justify, i.e., neutralize, the behavior from both offender and victim perspectives. Across four studies, offenders appear more likely to admit to moral wrongdoing than victims assume. This suggests moral disagreement between offenders and victims. The discrepancy appears to be reasonably robust across different samples, apps and whether the other is identified, but diminishes when people learn how easily others’ data could be protected. These insights offer suggestions for businesses, consumers and public policy. (shrink)
