Background: Mental health professionals working in correctional contexts engage a double role to care and control. This dual loyalty conflict has repeatedly been criticized to impede the development of a high-quality alliance. As therapeutic alliance is a robust predictor of outcome measures of psychotherapy, it is essential to investigate the effects of this ethical dilemma. Methods: This qualitative interview study investigates patients’ perceptions of their therapists’ dual role conflict in court-mandated treatment settings. We interviewed 41 older incarcerated persons using a (...) semi-structured interview guide, the interviews were subsequently analyzed following thematic analysis. Results: We first present the patients’ perceptions of their treating psychotherapist’s dual loyalty conflict, which was linked to their overall treatment experience. In a second step, we outline the study participants’ reasons for this judgment, which were most commonly linked to feelings of trust or betrayal. More specifically, they named certain therapist characteristics and activities that enabled them to develop a trustful therapeutic alliance, which we grouped into four topics: respecting the patient’s pace and perceived coercion; patient health needs to be first priority; clarity in roles and responsibilities; and the art of communication – between transparency and unchecked information sharing. Discussion: Developing a high quality alliance in mandatory offender treatment is central due to its relationship with recovery and desistance. Our findings show that some therapists’ characteristics and activities attenuate the negative impact of their double role on the development and maintenance of the alliance. To increase the effectiveness of court-mandated treatments, we need to support clinicians in dealing with their dual role to allow the formation of a high quality therapeutic alliance. Our qualitative interview study contributed to this much-needed empirical research on therapist’ characteristics promoting a trustful relationship in correctional settings. (shrink)

Our findings indicate that this positioning was influenced by situational factors, drawing the MHPs at times closer to the caring or controlling poles. Second, our results illustrate how participating MHPs solve their dual loyalty conflict. Participants considered central to motivate the patient, to see the benefits of treatment and its goals. Further, transparent communication with patients and representatives of the justice system was highlighted as key to develop a trustful relationship with the patient and to manage the influences from the different players involved. ConclusionsEven though individual positioning and opinions towards dealing with the influences of the justice system varied, the results of our research show that, in spite of varying positions, the underlying practice is not very different across participating MHPs. Several techniques that allow developing a high-quality therapeutic alliance with the patient are key elements of general psychotherapy. Transparency appears as the crucial factor when communicating with the patient and with representatives of the justice system. More specifically, patients need to be informed since the beginning of therapy about the limits of medical confidentiality. This paper takes stock of a recent but growing movement within the field of deliberative democracy, which normatively argues for the epistemic dimension of democratic authority and positively defends the truth-tracking properties of democratic procedures. Authors within that movement call themselves epistemic democrats, hence the recognition by many of an ‘epistemic turn’ in democratic theory. The paper argues that this turn is a desirable direction in which the field ought to evolve, taking it beyond the ‘fact of disagreement’ that had (...) previously blocked the conceptual road to acknowledging more than intrinsic properties to democratic decision procedures. The paper shows how two authors in particular – Joshua Cohen and David Estlund – have successfully lifted the Rawlsian requirement of epistemic abstinence and defends epistemic democrats and the implications of the epistemic turn in democratic theory against various misconceptions. This paper argues in favor of the epistemic properties of inclusiveness in the context of democratic deliberative assemblies and derives the implications of this argument in terms of the epistemically superior mode of selection of representatives. The paper makes the general case that, all other things being equal and under some reasonable assumptions, more is smarter. When applied to deliberative assemblies of representatives, where there is an upper limit to the number of people that can be included in the group, (...) the argument translates into a defense of a specific selection mode of participants: random selection. This article aims to develop new conceptions of the psychosocial dynamics that drive the re-romanticization of domestic femininity in current financialized capitalism. Feminist scholars have described this heightened cultivation of mothering as a reparative move in response to irreconcilable tensions between cultural ideals of the ‘balancing mother’ and ‘lean-in femininity’. This article adds a materialist-psychosocial lens to these conceptions, to enhance understanding of what drives this craving for domestic femininity. Drawing on a free-association narrative interview study with couples in the (...) financial elite in the comparatively gender-egalitarian Norwegian context, I describe a specific emotional mechanism that resists democratization of gender in this specific group. The interviews reveal a felt need to cultivate ‘the human side of things’ at safe distance from the competitiveness of ‘hard-core finance’. The Nordic earner–carer model with its entwinement of care and professional pursuits, cultivated by the more self-fulfilment-oriented parts of the professional middle-class appears not only unwanted but threatening. In my analysis, I retrieve and develop a psychoanalytically inspired historical-materialist feminism, one that perceives of the gendered division of work as a split in modes of focusing human energy. I suggest that the resurgent cultivation of domestic femininity is nurtured by a self-energizing antagonism between competitive and relational practices. I further argue that the cultivation of domestic femininity in these financial couples points to a potential antagonism between the democratization of love and the specific anxiety-driven competitiveness to which this financial-elite group may be particularly susceptible. In the burgeoning debate about neuroscience’s role in contemporary society, the issue of brain optimization, or the application of neuroscientific knowledge and technologies to augment neurocognitive function, has taken center stage. Previous research has characterized media discourse on brain optimization as individualistic in ethos, pressuring individuals to expend calculated effort in cultivating culturally desirable forms of selves and bodies. However, little research has investigated whether the themes that characterize media dialogue are shared by lay populations. This article considers the relationship (...) between the representations of brain optimization that surfaced in a study of British press coverage between 2000 and 2012 and interviews with forty-eight London residents. Both data sets represented the brain as a resource that could be manipulated by the individual, with optimal brain function contingent on applying self-control in one’s lifestyle choices. However, these ideas emerged more sharply in the media than in the interviews: while most interviewees were aware of brain optimization practices, few were committed to carrying them out. The two data sets diverged in several ways: the media’s intense preoccupation with optimizing children’s brains was not apparent in lay dialogue, while interviewees elaborated beliefs about the underuse of brain tissue that showed no presence in the media. This article considers these continuities and discontinuities in light of their wider cultural significance and their implications for the media–mind relationship in public engagement with neuroscience. The attitude is claimed to be characteristic of someone who is positive to a facility but who wants someone else to be its host. Since siting cannot be provided if everyone has this attitude, society ends up in a worse situation. The attitude is claimed to be egoistic and irrational. The longing for aerial flight has been one of mankind's most consuming preoccupations. A burning desire for lightness, verticality, and flight is opposed to the fatality of universal gravity. Jules Michelet, in his study of the subject, entitled L'Oiseau (The Bird), which he wrote toward the end of his life, deems this aspiration for upward motion to be characteristic of all nature. He writes: “It is the cry of all the earth, of the world and of all life… : ‘Wings! (...) We want wings, we want flight and movement.’” From ancient times, this basic element of physical experience has nourished human imagination and been a source of motivation for the pursuit of scientific knowledge. Mesopotamian civilization had its winged divinities and spirits; indeed the Western tradition of depicting winged persons has been linked to the influence of Mesopotamian art. As Jules Duhem has pointed out, four centuries before Jesus Christ, Aristotle himself was already exploring certain notions that have become part of the history of ideas of aeronautics and astronomy. Among these are the ideas of void, weight, the resistance of air, and the movement of birds and other flying creatures. Duhem has also demonstrated that Aristotle proposed an explanation, as imperfect as it was, for what causes projectiles to fall from the sky. Throughout the ages, humanity has continually expressed its desire to fly: “Man is proud of being free and of leaning on nothing,” Elias Canetti has written in regard to man's upright position. Striking examples of the impulse to fly are to be found not only in scientific discourse but in myths, literature, and works of art. (shrink)

This article furnishes a philosophical background for the current debate about responsibility and culpability for war crimes by referring to ideas from three important just war thinkers: Augustine, Francisco de Vitoria, and Michael Walzer. It combines lessons from these three thinkers with perspectives on current problems in the ethics of war, distinguishes between legal culpability, moral culpability, and moral responsibility, and stresses that even lower-ranking soldiers must in many cases assume moral responsibility for their acts, even though they are part (...) of a military hierarchy and act under orders. The questions addressed in this article are arguably among the hardest and most muddled in military ethics and deserve close philosophical analysis and scrutiny. (shrink)

Disclosure is a common response to conflicts of interest; it is intended to expose the conflict to scrutiny and enable it to be appropriately managed. For disclosure to be effective the receiver of the disclosure needs to be able to use the information to assess how the conflict may impact on their interests and then implement a suitable response. The act of disclosure also creates an expectation of self-regulation, as the person with the conflicting interests will be mindful of their (...) own potential biases and aware that their decisions may be monitored. This article discusses some of the problems of relying on disclosure as a solution to address conflicts of interest in research, including the added complexities around institutional conflicts of interest. At the same time, Insister is an extraordinarily poetic meditation, a work of literature and of mourning for Jacques Derrida the person, who was a close friend and accomplice of Cixous's from the beginning of their careers.

ABSTRACTThe idea that the crowd could ever be intelligent is a counterintuitive one. Our modern, Western faith in experts and bureaucracies is rooted in the notion that political competence is the purview of the select few. Here, as in my book Democratic Reason, I defend the opposite view: that the diverse many are often smarter than a group of select elites because of the different cognitive tools, perspectives, heuristics, and knowledge they bring to political problem solving and prediction. In this (...) essay I defend my epistemic argument against proceduralist democrats; the value of model thinking against empiricists; the bracketing of fundamental value diversity against critics who see such diversity as an essential feature of politics; the intelligence of the masses in the face of voter ignorance and systematic biases; and the normative priority of democracy over market mechanisms. I also consider challenges to my use of Hong and Page's formal results, the epistemically proper selection method for representatives, and the role of deliberation in problem solving. Consensus plays an ambiguous role in deliberative democracy. While it formed the horizon of early deliberative theories, many now denounce it as an empirically unachievable outcome, a logically impossible stopping rule, and a normatively undesirable ideal. Deliberative disagreement, by contrast, is celebrated not just as an empirically unavoidable outcome but also as a democratically sound and normatively desirable goal of deliberation. Majority rule has generally displaced unanimity as the ideal way of bringing deliberation to a close. This article offers an (...) epistemic perspective on this question of consensus versus disagreement. For ensuring the production of better decisions, we argue, the normative appeal of consensus varies depending on the deliberative task – whether it entails problem solving or prediction. We argue that in pure problem-solving contexts, consensus retains a strong normative appeal and forms the ideal deliberative outcome of deliberation. In contrast, on predictive tasks, consensus should generally not be used as a stopping rule noris it likely to be epistemically desirable as an outcome. Instead deliberators may be better served by ending the deliberation with a form of deliberative disagreement we call ‘positive dissensus’, which paves the way for more accurate aggregate predictions. Despite the growing body of work exploring the weaknesses of police performance systems and the displacement of their goals, less attention has been given to why police officers resist and circumvent by false reporting. Whether police report honestly on their activities is a matter of considerable significance given the role that police have in a broadly democratic society, and the overall question is whether the false reporting undermines the integrity of the police or if it is a collective coping strategy (...) that safeguards the police ethos? This survey reveals that 25% of respondents (n = 2248) had manipulated the numbers at least once in the previous year. To identify why they did so, the variables selected for analysis are those determining their view of the Management by Objective (MBO) system, how far they have participated in the MBO process and how often they are unable to assist a member of the public. Our results show that men are more likely to manipulate the numbers than women and non-leaders are more likely to do so than leaders. Respondents were more likely to submit false reports if they had not participated in the MBO process, were not motivated by MBO goals, believed the MBO indicators misdirected their focus and frequently felt that they were forced to reject members of the public they would like to help. Our findings further show that public servants can be corrupted, though they do not “bring” vices to work with them, but rather acquire vices through what is required of them. (shrink)

Parmi les différentes approches possibles de la matière historique, on observe souvent, dans la littérature, une tension entre les deux options suivantes : faire d’un auteur le précurseur d'une révolution dont notre modernité serait l'héritière directe, ou au contraire, et par réaction, se livrer à un travail de remise en contexte détaillé qui prend parfois le risque de gommer l'originalité possible de ce même auteur. Le Traité sur les signes de Jean Poinsot (appelé également Jean de Saint Thomas), dominicain du (...) début du XVIIe siècle, a ainsi d’abord été édité comme un texte annonciateur de la sémiotique de Peirce, la thèse de cette originalité révolutionnaire étant fondée sur le traitement de la catégorie de la relation. Le travail critique qui s’est effectué en réaction tempère, parfois de façon excessive, la nouveauté de cet auteur du point de vue de sa contribution à la pensée des signes. Cet article s’inscrit dans cette démarche de remise en contexte en proposant une comparaison entre le texte de Poinsot et les Quaestiones sur les signes, que l'on doit à Sebastião do Couto, commentateur de l'université de Coimbra. Optant pour une contextualisation qui vise à mesurer l’originalité relative de Poinsot, cette étude porte sur les variations de la description du rapport du signe à l'intention. Nous montrerons ainsi que même si les contenus du discours sur les signes ne comportent que de maigres différences, on peut cependant constater une certaine originalité de Poinsot dans son traitement de la relation, qui l’amène à reconfigurer l’ordonnancement de la question des signes. The purpose of this paper is to draw attention to a similarity between an ancient and a modern theory of living nature. There is no need to present the Aristotelian doctrine in full detail. I must rather apologize for repeating much that is well known. My endeavour is to offer it for comparison, and, incidentally, to clear it from misrepresentation. Uexküll's theory, on the other hand, is little known, and what is given here is an insufficient outline of it. I (...) do not maintain that either doctrine is right. I am fully aware that the problem of the essence of living nature by no means admits of an éasy solution. In offering for consideration the comparison contained in this paper I would go no farther than owning my belief that the two authors here discussed, both thinkers who combine an intensely philosophical outlook with a wide biological experience, are worth the attention not only of the historian of science and philosophy, but also of the student of philosophical biology. Ideomotor actions are behaviours that are unconsciously initiated and express a thought rather than a response to a sensory stimulus. The question examined here is whether ideomotor actions can also express nonconscious knowledge. We investigated this via the use of implicit long-term semantic memory, which is not available to conscious recall. We compared accuracy of answers to yes/no questions using both volitional report and ideomotor response . Results show that when participants believed they knew the answer, responses in the two (...) modalities were similar. But when they believed they were guessing, accuracy was at chance for volitional report , but significantly higher for Ouija response . These results indicate that implicit semantic memory can be expressed through ideomotor actions. They also suggest that this approach can provide an interesting new methodology for studying implicit processes in cognition. (shrink)

ABSTRACT Mutz argues that there is an inverse correlation between deliberation and participation. However, the validity of this conclusion partly depends on how one defines deliberation and participation. Mutz's definition of deliberation as ?hearing the other side? or ?cross-cutting exposure? is narrower than a minimal conception of deliberation with which deliberative democrats could agree. First, a minimal conception of deliberation would have to revolve around the principle of a reasoned exchange of arguments, as opposed to mere exposure to dissenting views. (...) Second, Mutz's almost exclusive focus on participation as partisan activism gives the impression of an essential tension between participation and deliberation. But another form of civic participation, which I call ?critical-deliberative involvement,? is perfectly compatible with the incentives for reasoned exchange of arguments with others. We should thus encourage people to participate in politics in ways that engage their reasoning faculty, not just their party loyalty.
