This article interprets critiques of secularity and the related concept of history as progress in the work of Dipesh Chakrabarty and Judith Butler. At the same time, it defends their approach against the criticism voiced by Gregor McLennan. It shows that the postsecular conception of the politics of both authors is not just an attempt to open public space to a wider range of religious and cultural voices. Rather, it is a critique of the way in which political secularism and (...) the ideology of progress are used by the modern state to legitimize the exercise of its own power. Butler and Chakrabarty's postsecular policy is thus based primarily on coalition building against these legitimization frameworks, which opens up the possibility of forming new postsecular political subjects. It illustrates the theoretical approach of both authors with an example of the church sanctuary movement in Germany. (shrink)

“Is every definition persuasive?” If essentialist views on definition are rejected and a pragmatic account adopted, where defining is a speech act which fixes the meaning of a term, then a problem arises: if meanings are not fixed by the essence of being itself, is not every definition persuasive? To address the problem, we refer to Douglas Walton’s impressive intellectual heritage—specifically on the argumentative potential of definition. In finding some non-persuasive definitions, we show not every definition is persuasive. The persuasiveness (...) lies not in syntactic or semantic properties, but the context. We present this pragmatic account and provide rules for analysing and evaluating persuasive definition—a promising direction for further research. (shrink)

We examine the verification of simple quantifiers in natural language from a computational model perspective. We refer to previous neuropsychological investigations of the same problem and suggest extending their experimental setting. Moreover, we give some direct empirical evidence linking computational complexity predictions with cognitive reality.<br>In the empirical study we compare time needed for understanding different types of quantifiers. We show that the computational distinction between quantifiers recognized by finite-automata and push-down automata is psychologically relevant. Whether firms can be said to be moral agents and to have the capacity for moral responsibility has significant practical consequences. In most legal systems in the world, business firms are recognized as persons with the ability to own property, to maintain and defend lawsuits, and to self-organize governance structures. To recognize that these business persons can also act morally or immorally as organizations, however, would justify the imposition of other legal constraints and normative expectations on organizations. In the criminal (...) law, for example, the idea that an organized firm may itself have criminal culpability is accepted in many countries (such as the United States) but rejected in others (such as Germany). Social norms can be understood as the grammar of social interaction. Like grammar in speech, they specify what is acceptable in a given context. But what are the specific rules that direct human compliance with the norm? This paper presents a quantitative model of self- and the other-perspective interaction based on a ‘quantum model of decision-making’, which can explain some of the ‘fallacies’ of the classical model of strategic choice. By connecting two fields of social science research—norms compliance, and strategic (...) decision-making—we aim to show how the novel quantum approach to the later can advance our understanding of the former. From the cacophony of different quantum models, we distill the minimal structure necessary to account for the known dynamics between the expectations and decisions of an actor. This model was designed for the strategic interaction of two players and successfully tested in the case of the one-shot Prisoners’ Dilemma game. Quantum models offer a new conceptual framework for examining the interaction between self- and other-perspective in the process of social interaction which enables us to specify how social norms influence individual behavior. When does art history begin? Art historiographers typically point to the Renaissance (Vasari) or, alternatively, to Hellenism (Pliny the Elder). But such origin stories become increasingly disconnected from contemporary disciplinary practices, especially as the latter try to rise to the challenge of conducting art history in a more diversified and global way. This essay provides an alternative account of art history’s origin, one that does not try to alleviate the sense of disconnect, but rather develops a global, non-Eurocentric account. The (...) account focuses less on genealogy and more on what necessitates something like an art-historical awareness or attention in the first place. Relying on examples from ancient Mesopotamia, it argues that art-historical thought can be identified whenever and wherever material objects are attended to or produced for their potential to manifest visibly and over time their meaning. The article’s aim is to clear the ground for the idea of aesthetic archaeology as an aesthetic analysis of remote artifacts divorced from aesthetic criticism. On the example of controversies surrounding the early Cycladic figures, it discusses an anxiety motivating the rejection of aesthetic inquiry in archaeology, namely, the anxiety about the heuristic reliability of one’s aesthetic instincts vis-à-vis remote artifacts. It introduces the claim that establishing an aesthetic mandate of a remote artifact should in the first place be part (...) of a quest after the norms of engagement an artifact’s kind signaled to the intended audience by its appearance. Rather than advocating for a new subdiscipline, the concept of aesthetic archaeology serves to bring into theoretical focus an aesthetic engagement with an artifact’s appearance under circumstances that rule out any acquired competence in distinguishing its aesthetic mandate perceptually—and thus rule out any aesthetic expertise. The article presents the first comprehensive interpretation of the ergon argument in Aristotle’s Protrepticus. It further argues that Aristotle in this argument distinguishes the ergon of an entity from the ergon of its virtue thus presenting a complicated argumentative structure which is explicitly simplified in the Eudemian Ethics. Based on the latest attempts to reconstruct the Protrepticus, the article shows the relation of the ergon argument to its other versions in both Ethics. This account not only clarifies the relation of (...) the Protrepticus to Aristotle’s other ethical writings, it shows that Aristotle intends the argument as a transition between describing what human being does and what a good human being does well, namely a natural transition from the descriptive to the normative. In four major parts, this study investigates the phenomenon of scrolling. Its first task is to argue in favor of a specific quality of the experience of scrolling, distinguishing it from other forms of distraction, notably from the flow experience. Scrolling takes the shape of aimless drifting. Secondly, it investigates the phenomenon of scrolling against its relevant historical, economic, social, and cultural backdrop, with the intention of understanding scrolling as a typical phenomenon of today, rather than subscribing to a biased (...) and superficial critique of its wastefulness or outright pathological character. The third part presents a comprehensive analysis of the temporal makeup of scrolling. Its temporality is expressed in the specific impatience of scrolling. Furthermore, scrolling amounts to a temporal reduction in the sense of favoring the present moment (and suppressing the temporal dimensions of the past and the future). The reductiveness of scrolling pertains to the semantic content as well. I argue that scrolling does not allow for certain experiences (such as, e.g., profound sadness). The temporality of scrolling is one of experiencing lived time as the permanence of passing. In the last section, I connect scrolling to boredom, and argue that scrolling accomplishes the task of allowing for an existential distractedness. In conclusion, I propose a nuanced evaluation of scrolling: in a Pascalian sense, scrolling responds to a profoundly human need of distraction. Yet I find scrolling dangerous in how easily available such distraction becomes, and in how it accustoms the users to a reductive existential experience. Scrolling, unlike art (but also, in principle, photography, movies, books), shields the user from challenging and enriching experiences. (shrink)

In this paper, we address reports of “selfless” experiences from the perspective of active inference and predictive processing. Our argument builds upon grounding self-modelling in active inference as action planning and precision control within deep generative models – thus establishing a link between computational mechanisms and phenomenal selfhood. We propose that “selfless” experiences can be interpreted as cases in which normally congruent processes of computational and phenomenal self-modelling diverge in an otherwise conscious system. We discuss two potential mechanisms – within (...) the Bayesian mechanics of active inference – that could lead to such a divergence by attenuating the experience of selfhood: “self-flattening” via reduction in the depth of active inference and “self-attenuation” via reduction of the expected precision of self-evidence. Motivated by an attempt to construct a new example of a non-G-compact theory, we consider the following example. Assume G is a group definable in a structure M. We define a structure M′ consisting of M and X as two sorts, where X is an (...) affine copy of G and in M′ we have the structure of M and the action of G on X. We prove that the Lascar group of M′ is a semi-direct product of the Lascar group of M and G/G L . We discuss the relationship between G-compactness of M and M′. The present paper concerns the Wittgenstein ontology project: an attempt to create a Semantic Web representation of Ludwig Wittgenstein’s philosophy. The project has been in development since 2006, and its current state enables users to search for information about Wittgenstein-related documents and the documents themselves. However, the developers have much more ambitious goals: they attempt to provide a philosophical subject matter knowledge base that would comprise the claims and concepts formulated by the philosopher. The current knowledge representation technology is not (...) well-suited for this task, and a non-standard approach is required. The creators of the Wittgenstein ontology project are aware of this fact; recently, they have been discussing conceptual devices adjusting the technology to their needs. The main goal of this paper is to present examples of a representation of philosophical content that make use of both the devices already proposed and some new inventions. The represented content comes from the Tractatus Logico-Philosophicus; more specifically, its theses concerning the problems in philosophy of mathematics. (shrink)

According to monists, happiness is contemplative activity, which does not include ethically virtuous activities as parts. The comparison in these lines is then between life in accordance with intellect and life in accordance with the virtues of character. The first life is proper to us, because we are above all our intellect. The life in accordance with moral virtue reflects our complex nature, and it is proper to us due to this complexity of our human nature.How could Aristotle claim that it is human to live in accordance with the intellect? According to Aristotle, the gods contemplate, and so contemplation cannot be proper to human beings. Reece calls this statement "the divinity thesis" and deals with it in chapter 5. Reece's argument for the difference in type between divine and human contemplation is based on the fact that human contemplation is manifestation of theoretical wisdom. Theoretical wisdom includes intellect (nous) and knowledge (epistēmē). Reece then goes through possible contemplating divine beings and shows why their formal cause of contemplation cannot be theoretical wisdom. Formal differences between activities mark type distinctions. Therefore, divine and human contemplation are of different types.Chapters 2 through 4 paved the way for Reece's own conclusion: "[H]appiness belongs to all and only those to whom contemplation and ethically virtuous activities belong, and contemplation is proper to happiness in a primary way, whereas ethically virtuous activities are proper to that same kind of happiness in a secondary way." The paper deals primarily with the standard question in what exactly, according to Husserl, consists the crisis of the European sciences. In the literature so far, there have been two tendencies on this question, one focusing on the loss of the sciences’ meaningfulness for life, the other emphasizing the inadequacy of their scientificity. Instead of arguing for one of these two options or for some sort of combination of both, another interpretation of this topic will be suggested. The focus will (...) be on Husserl’s notion of historicity and its connection with the concept of life-world. It will be argued that it is the historical detachment of sciences from ideas and consequently the sphere of meaning altogether which lies at the core of their ill state. On this basis, it will show that Husserl’s approach to science in Crisis is actually double. For one, it is an attempt to supplement science with a philosophical justification. The other is a historical de-construction of scientific objectivism as a misleading metaphysical claim concerning the lived world. This second, historical approach is developed exclusively in the Crisis. However, it does bring out questions leading to rethinking the meaning and goals of transcendental phenomenology itself. Social robots are expected to take over a significant number of jobs in the coming decades. The present research provides the first systematic evaluation of occupation suitability of existing social robots based on user perception derived classification of them. The study was conducted in the Middle East since the views of this region are rarely considered in human–robot interaction research, although the region is poised to increasingly adopt the use of robots. Laboratory-based experimental data revealed that a robot’s appearance plays (...) an important role in the perception of its capabilities and preference for it to perform a particular job. Participants showed a preference for machine-like robots to perform dull and dirty occupations and humanoids, but not androids, to perform jobs requiring extensive social interaction with humans. However, other aspects of appearance than morphology determine whether a robot is preferred for a job irrespective of its perceived capability to do it. (shrink)

Celem artykułu jest pokazanie konsekwencji przyjęcia longtermizmu w wersji skrajnej dla postrzegania obowiązku likwidacji skrajnej biedy w świetle zasady równego rozważania interesów. W artykule argumentuję na rzecz hipotezy, że konsekwentny zwolennik myśli etycznej Petera Singera skorygowanej o postulaty long- termizmu musi przyjąć, iż obowiązki wobec przyszłych ludzi uchylają obowiązki wobec obecnie żyjących ludzi, nawet znajdujących się w tak niekorzystnym położeniu jak skrajna bieda. W pierwszej części artykułu szkicuję argumenty Singera na rzecz moralnego obowiązku likwidacji skrajnej biedy za pomocą efektywnych metod (...) aż do znacznego obniżenia własnego poziomu życia. Przybliżenie tych szeroko znanych poglądów stanowi ramy argumentacji na rzecz hipotezy badawczej. Następnie krótko charakteryzuję efektywny altruizm, na gruncie któ- rego wyrosło nowe podejście w ramach konsekwencjalizmu: longtermizm. Postulaty i założenia longtermizmu w ujęciu W. MacAskilla i T. Orda zestawiam z myślą Singera, aby doprowadzić ich argumentację do logicznych wniosków, które wspierają hipotezę badawczą artykułu -/- Moral duties towards the poor and longtermism The aim of the article is to show the consequences of adopting strong longtermism for the perception of the obligation to eliminate extreme poverty in the light of the principle of equal consideration of interests. In the article, I argue in favor of the hypothesis that a consistent supporter of Peter Singer’s ethical thought adjusted to the postulates of longtermism must assume that obligations towards future people abrogate duties towards current people, even those in such an unfavorable situation as extreme poverty. In the first part of the article, I sketch Singer’s arguments for the moral obligation to eliminate extreme poverty using effective methods, up to significant decrease in one’s level of life. An outline of these widely known views constitutes the framework of arguments in favor of the research hypothesis. Then I briefly characterize effective altruism, which is the basis for a new approach within consequentialism: longtermism. I compare the postulates and assumptions of longtermism as presented by W. MacAskill and T. Ord with Singer’s thought in order to bring their argumen- tation to logical conclusions that support the research hypothesis of this article. (shrink)

We introduce and study the model-theoretic notions of absolute connectedness and type-absolute connectedness for groups. We prove that groups of rational points of split semisimple linear groups (that is, Chevalley groups) over arbitrary infinite fields are absolutely connected and characterize connected Lie groups which are type-absolutely connected. We prove that the class of type-absolutely connected group is exactly the class of discretely topologized groups with the trivial Bohr compactification, that is, the class of minimally almost periodic groups.

While there is a general consensus around the role of religion in the abolition of the Slave Trade, historians continue to give little to no detail on exactly how Christian theology influenced the abolitionist movement. This article seeks to interrogate one major theological factor inherent in the spirituality that underpinned the activism of the British abolitionists, namely their notion of Divine Providence, and particularly its moral-emotive correlate: the fear of God’s wrath. These theological notions are discussed based mainly on the (...) analysis of the primary sources and within the theoretical framework of judicial providentialism, aptly captured by John Coffey among others. The following article provides an interpretation of the structure of courage in Plato’s Laches, Meno and Protagoras. I argue that these dialogues present courage (ἀνδρεία) in the soul according to the same scheme: that there is a normatively neutral psychic state which is informed by the knowledge of good and evil. The knowledge (ἐπιστήμη) which informs this normatively neutral psychic state is called practical wisdom (which Plato refers to as φρόνησις or sometimes σοφία). This interpretation seems to negate the claim (...) that virtue is knowledge. I will show, however, that this is not a contradiction and that virtue is in fact knowledge, despite the complex moral psychology of courage. Finally, I will argue that the conception of courage in the Republic addresses some of the problems posed by the discussion of courage in the above-mentioned dialogues. (shrink)

The text is an attempt to approach the problem of desire from three sides: dialectical-political, psychoanalytic and deconstructive. In each of these paradigms of reflection, subjects become effective when they act within the framework of practical self-knowledge, which takes various forms: intentional alienation, elaboration of contradictions inherent in living environments, knowledge arising from the immanent unconscious and from the body exposed to touch.

The Operator Argument against eternalism holds that having non-vacuous tense operators in the language is incompatible with the claim that every proposition has its truth-value eternally. Assuming that (1) there are non-vacuous tense operators, (2) tense operators operate on propositions and (3) tense operators which operate on eternal entities are vacuous, it may be argued that eternalism is false. In this paper, I examine the Operator Argument. The goal is threefold. First, I want to present some aspects of the debate (...) in a more elaborate way, especially those concerning formal matters. Secondly, I will argue that eternalism can escape the Operator Argument. There are two main strategies for handling the Operator Argument. The first one is based on replacing temporal operators with object-language quantifiers. The second rejects the identification of compositional semantic value with assertoric content. My third goal is to show that none of them is as good as the strategy that adopts Timestamp Semantics (Fritz in Philosl Stud 176:2933–2959, 2019). I am going to argue that the quantificational treatment of tenses is compatible with temporalism and that the arguments for rejecting the identification of compositional semantic value with assertoric content provide, in fact, a motivation for the temporalist position. At the end, I will develop Timestamp Semantics by providing a novel formalization of it, and defend it against three potential counter-arguments. (shrink)

In their Anachronic Renaissance, Alexander Nagel and Christopher Wood identify two principles upon which, in fifteenth-century Europe, a work of art might establish its validity or authority: substitution and performance. It has become established wisdom that the dual schema of substitution and performance follows Hans Belting's dualism of the medieval cult of the image and the modern aesthetic system of art. This, I submit, is not just a mistake, but also prevents from evaluating one of the book's most ambitious contributions (...) to art-historical theory on its own merits. An analysis of the structure of the claims made by Nagel and Wood brings to light that the two concepts—substitution and performance—do not play the same role as the conceptual pair of Bild and Kunst in Belting's influential work. According to panqualityism, a form of Russellian monism defended by Sam Coleman and others, consciousness is grounded in fundamental qualities, i.e. unexperienced qualia. Despite panqualityism’s significant promise, according to David Chalmers panqualityism fails as a theory of consciousness since the reductive approach to awareness of qualities it proposes fails to account for the specific phenomenology associated with awareness. I investigate Coleman’s reasoning against this kind of phenomenology and conclude that he successfully shows that its existence is controversial, and so Chalmers’s (...) critique is inconclusive. I then present a critique of panqualityism that avoids this controversial posit, arguing that the panqualityist treatment of awareness faces an explanatory gap, failing to account for the intimate cognitive access to qualities which we are afforded, i.e. for our ‘strong awareness’ of qualities. The real worry for panqualityists is thus not the contested phenomenology of awareness, which Chalmers relies on, but rather the special way in which we are aware of qualities. (shrink)

Anthropomorphism is a phenomenon that describes the human tendency to see human-like shapes in the environment. It has considerable consequences for people’s choices and beliefs. With the increased presence of robots, it is important to investigate the optimal design for this tech- nology. In this paper we discuss the potential benefits and challenges of building anthropomorphic robots, from both a philosophical perspective and from the viewpoint of empir- ical research in the fields of human–robot interaction and social psychology. We believe (...) that this broad investigation of anthropomorphism will not only help us to understand the phenomenon better, but can also indicate solutions for facil- itating the integration of human-like machines in the real world. The study focuses on the relationship between K. Jaspers and S. Kierkegaard. First, it evaluates the current scholarship regarding Jaspers’ reception of Kierkegaard’s thought; second, it offers an independent analysis of Jaspers’ early work (especially the 1909 Heimweh und Verbrechen, and then the Psychologie der Weltanschauungen). It is demonstrated that Jaspers’ early work on nostalgia presents the first case study of limit situations (Grenzsituationen). The paper traces the link between Kierkegaard’s conception of aesthetic existence and Jaspers’ concept of limit situations. (...) It is shown that Jaspers’ study of nostalgia can be considered the original inspiration for the idea of limit situations, and that, at the same time, it was arguably Kierkegaard who had helped Jaspers to develop this germinal idea into a broader notion of limit situations. According to some interpreters, Foucault's encounter with the Greek and Roman ethics led him to reconsider his earlier work and to turn away from politics. Drawing mostly from Foucault's last and hitherto unpublished lecture course, this paper argues that Foucault's turn to ethics should not be interpreted as a turn away from his previous work, but rather as its logical continuation and an attempt to resolve some of the outstanding questions. I argue that the 1984 lectures on parrhesia should be (...) interpreted as Foucault's philosophical apology, as an attempt to defend himself against the charges of moral and epistemological nihilism, which were raised in response to his earlier work. In his last lectures, the Nietzschean Foucault somewhat surprisingly describes his earlier work as authentic Socratic philosophy and as ethical practice of freedom. In the conclusion, I assess the plausibility of Foucault's apology and speculate in which direction his work might have developed, had it not been cut off by his death. (shrink)

Both Hegel and the later Wittgenstein were concerned with the problem of how to begin speculation, or the problem of beginning. I argue that despite many differences, there are surprising similarities between their thinking about the beginning. They both consider different kinds of beginnings and combine them into complex analogies. The beginning has a subjective and an objective moment. The philosophizing subject has to begin with something, with an object. For Hegel, the objective moment is pure being. For Wittgenstein, the (...) objective moment is something that cannot be doubted. As regards the subjective moment, the philosophizing subject has to decide, without any reason, to conclude her quest for the presuppositionless beginning and finally begin at the beginning. The topic of exemplarity has attracted considerable interest in philosophy, legal theory, literary studies and art recently. There is broad consensus that exemplary cases mediate between singular instances and general concepts or norms. The aim of this article is to provide an additional perspective on the logic of exemplarity. First, inspired by Jacques Derrida’s discussion of exemplarity, I shall argue that there is a kind of différance between (singular) examples and (general) exemplars. What an example exemplifies, the exemplarity of the (...) example, eludes any fixed identity and follows a logic of supplement. Second, I shall present the so-called logic of exemplarity. The received paraconsistent view has it that the exemplar of X is an X and, at the same time, is not an X. Inspired by Ludwig Wittgenstein’s discussion of the standard metre, I would like to present an alternative paracomplete view whereby we can say of an exemplar of X neither that it is an X nor that it is not an X. Diffusion of responsibility is a well-known effect widely studied in a real-life setting. It can occur in a situation in which the more people observe a crisis event, the less likely it is that someone will react and provide real assistance. These days of a galloping digital revolution a question is to be raised as to whether the same effect can be observed in the online space of communication. In order to investigate this phenomenon we designed a study aimed at (...) testing whether people exposed to a situation of cyberbullying will decide to take action against it depending on how many other Internet users are also aware of that crisis. Results obtained by us confirmed the existence of the diffusion of responsibility in the Internet similar to that observed in our daily lives. We also confirmed that a well-known influence technique “Even a penny will help” (in our study “every reaction will help”) can be effectively used to model behaviour online. In our times of digital revolution, those outcomes can be a step both toward understanding human behaviour in the online setting, showing us that it is not that different from the one presented in real live face-to-face communication and toward helping deal with antisocial behaviour people face online on a daily basis. Recent theories of art that subscribe to the view that art objects are agents enchanting their target audience, have tended to explain the operation of art objects as an agent–patient dynamic, a causal nexus of agency. They face a challenge, however, when they also aspire to embrace the idea – dominant in modernist and contemporary art theory – that the function of art is to unsettle its spectators’ habitual ways of perceiving and understanding, that is, to disenchant them: If artworks (...) are to be understood as agents enchanting their recipients, how can they be forces of disenchantment at the same time? I argue that the shift in perspective from perceiving art objects as enchanting agents to approaching them as possible means of gaining cognitive distance is inadequately addressed by these theories. Robert Saudek, a Czech graphologist, journalist, diplomat, playwright, and novelist, was heavily influenced in his youth by Fritz Mauthner’s critique of language. Saudek later became a pioneer in the field of psychological graphology. In this article, I examine the impact of Mauthner’s critique on Saudek’s work and evaluate whether Saudek’s approach to graphology aligns with Mauthner’s ideas. I argue that, although Saudek’s graphology is rooted in Mauthner’s critique of experimental psychology, there remains room for further development in the field of (...) psychological graphology, centering on the analysis of language. With this in mind, I compare Saudek’s method and contemporary conceptual metaphor theory. I further suggest that Saudek’s extensive use of the autographs of well-known figures follows a method of working from examples, or specimens, which is not uncommon in the philosophy of science. Based on these findings, I propose a way of understanding Saudek’s graphology that challenges its characterization as a pseudoscience. (shrink)

Mezi jednáním a důvodem existuje zásadní vztah: není činu bez důvodu. Lze z toho však vyvodit, že je-li dán důvod, je dán i čin? Může mít čin dostatečný důvod? Studie zkoumá dvě podoby dostatečného důvodu : příčinu a premisu. Fenomenologická teorie motivace se staví jak proti myšlence, podle níž důvody jsou příčiny, tak proti přesvědčení, podle něhož důvody jsou premisy. Přínos fenomenologického výkladu motivace netkví především v představě, již rozpracoval Paul Ricoeur, že důvody jsou přítomné vědomí, nýbrž v originální paralele, (...) již rozvinul Merleau-Ponty mezi perceptivní a praktickou motivací. There seems to be a fundamental relation between action and reason: no action without a reason. But does this mean that the reason, once it is given, brings about the action? Can an action have a sufficient reason? The article distinguishes two forms of the sufficient reason: the cause and the premise. The phenomenological theory of motivation argues against the idea “reasons are causes” as well as against the idea “reasons are premises”. The novelty of the phenomenological account of motivation consists not in the assumption, developed by Paul Ricoeur, “reasons are present to a consciousness”, but in the more original analogy developed by Merleau-Ponty between the perceptual motivation on the one side and the practical motivation on the other. The present work examines the role of persuasive lexicon in legal discourse through the analysis of emotional devices at a lexical and rhetorical level. Our preliminary premise is that emotion is deployed by experts to convey the sentiment of shared values and epistemic trust: the need to rely on the tenets of the law as fair and conducive to the common good. The corpus of our study is constituted by the conclusions in their original Spanish, and their translation into English, (...) by the Advocate General Manuel Campos on the challenge by Hungary and Poland of the regulation establishing a “conditionality regime” in the event of a rule-of-law breach in a EU Member State. To this end, we undertake a two-pronged analysis of legal persuasion to find out what emotional devices are deployed to convey the rule-of-law principles of justice, non-discrimination, equality and solidarity. At a first stage, we concentrate upon the polarity and intensity of emotion words and their categories. Emotional implicatures in the shape of legal technolects and metaphorical ontologies and the way they are deployed in each text constitutes the second part of our study. Among our conclusions are that both the original and target texts have a strong persuasive character, mainly grounded in the negative emotion of fear and the positive emotion of trust, and that there are variances in the emotional language deployed in either version due to the different mechanics of each law system and to functional differences between English and Spanish.
