In a series of powerful and challenging articles emerging since the mid-1990s, Brian Leiter has argued that certain theoretical strains in contemporary legal philosophy are ‘epistemologically bankrupt’, in virtue of their reliance on misguided argumentative devices: analysing concepts, such as the concepts of law and of authority; and doing so by appealing to intuitions regarding the correct way to understand the concepts in question. In response to this state of affairs, Leiter advocates that jurisprudence ought to attempt to catch-up with (...) ‘naturalistic’ developments which have influenced the direction of other branches of philosophy – such as epistemology, philosophy of mind, and moral philosophy – in the last few decades. This article offers a critical analysis of some of Leiter’s proposals for what Jurisprudence should become, in light of his views on the relevance of naturalism for this discipline. (shrink)

Three experiments test the theory that verb meanings are more malleable than noun meanings in different semantic contexts, making a previously seen verb difficult to remember when it appears in a new semantic context. Experiment 1 revealed that changing the direct object noun in a transitive sentence reduced recognition of a previously seen verb, whereas changing the verb had little impact on noun recognition. Experiment 2 revealed that verbs exhibited context effects more similar to those shown by superordinate nouns rather (...) than basic-level nouns. Experiment 3 demonstrated that the degree of meaning change in a target word resulting from changes in semantic context influenced the magnitude of context effects, but context effects remained larger for verbs than for nouns even when the degree of meaning change was similar for nouns and verbs. These results are discussed with respect to the imageability and grammatical roles played by nouns and verbs in a sentence. (shrink)

This paper explores the development of Honneth’s thought on work. It considers how his initial concerns with the embodied experience of labour and the absence of a contemporary and compelling class-specific lexicon with which to explore suffering at work have been surpassed and subordinated by his analysis of the social relations of recognition in civil society, which is distributed according to a contested and contestable achievement principle. I argue that despite the purchase of the criticisms offered by recent rejoinders, they (...) fail to engage with the strength of his analysis: that modern economics contains a normative (recognition) order which works to justify the extant division of labour and income, even if its current formulation supports inequity, exclusion and exploitation. Feminist political economy is an ally in this analysis. The paper explores the points of intersection between these projects, but argues that incorporating feminist insights will require a fundamental revision to Honneth’s account of social rationalization in modernity. The present research aimed to provide a more holistic analysis of stressful experiences in sport by examining how stress appraisal, coping and emotion are dynamically inter-related constructs and the extent to which their dynamic relationship is associated with objective performance. Based on process-oriented methods, two studies were conducted with elite athletes in order to investigate the dynamic relationship between these constructs and performance in highly demanding sport situations (Study 1: simulated competitive fencing matches during a training session; Study 2: real-life (...) competitive fencing matches during an international competition). The results of the random coefficient regression models emphasise the dynamic nature of the relationship between stress appraisal, coping behaviour, emotion and objective performance over the course of fencing matches. They allowed identification of additional mediating effects of coping and emotion within dynamic relationships between stress appraisal and performance. These studies contribute to a deeper understanding of psychological adaptation in performance environments. The implications of the findings are discussed in relation to the design of effective coping interventions to support the learning of performance-related coping skills and the attainment of performance goals among individuals in highly demanding environments. Summary The National Curriculum was introduced into British primary schools in 1989 to raise standards of attainment, especially in the basic skills of English and mathematics. Has this expensive innovation succeeded? This paper analyses the mathematics standards of eight cohorts of Year 6 children from five randomly selected primary schools within one Local Education Authority (n=1503) who had all done Mathematics 11 from 1989 to 1996. Examination of the means of the standardised mathematics scores for each cohort reveals no evidence (...) of rising standards in attainment over the eight years. There are fewer over? and underachievers than one would expect with a tendency for compression of scores around the mean. This paper questions the efficacy of the National Curriculum, assessment procedures and the publication of school performance tables in raising standards in mathematics at Key Stage 2. The need for an effective system of monitoring educational standards throughout the UK is reiterated. (shrink)

Elle fait l’objet de nombreuses mises en scène dans des genres musicaux aussi variés que l’opéra, l’opéra-comique, le ballet, la mélodie, la pantomime ou le théâtre (...) en musique. La question centrale qui se pose pour chaque compositeur est la suivante : comment représenter Jeanne d’Arc, cette « figure sublime »? Comment donner voix à une héroïne que l’on a vue sous tous les jours, tour à tour grandiloquente, simple et pieuse, puis égérie nationale avant de devenir sainte en 1920? Au travers d’une étude sur la voix donnée à Jeanne, dans deux œuvres majeures du répertoire qui lui a été consacré, Giovanna d’Arco de Verdi, créée à la Scala de Milan en 1845, et Jeanne d’Arc au Bûcher de Paul Claudel et Arthur Honegger, créée à Bâle en 1938, nous essaierons de déceler l’esprit d’une époque, et par là de mieux distinguer quelques-unes des facettes données à la Pucelle d’Orléans. In particular, I consider whether there is an EU legal system distinct from and in addition to the national legal systems of EU Member States, or whether it is better to conceive of EU law merely as an aspect of Member States’ legal systems, or indeed whether we should think of there being but a single EU legal system (...) of which Member States’ “national legal systems” are in some sense sub-systems.Resumen:Este artículo discute varios modos posibles de comprender el carácter de los sistemas jurídicos de la Unión Europea y sus relaciones. Since the emergence of ̳new left‘, bottom up approach to history in the 1960s and 1970s, women‘s and gender history has become a rich field for historians. Ethnic and immigrant women‘s history, as part of this larger movement, has seen its own fair share of growth. This paper examines the emergence of racialized women‘s history in Canada and analyzes the increasingly inclusive and complex integration of this field through the works of notable authors in recent decades.

This paper examines the rise and fall of voluptuousness as a beauty ideal in mid- nineteenth century America. It argues that the rise and fall of the fuller figured woman can be traced to shifting economic, social, and medical beliefs that in turn, affected perceptions about fatness‟ relationship to class, morality, health, and beauty.

Historically, recordkeeping has been an essential task for health professionals. Today, this mandatory task increasingly takes place as digital documentation. This study critically examines problem constructions in practical documents on digital documentation strategies in Danish municipal healthcare and how these problem constructions imply particular solutions. A document analysis based on the approach presented in Bacchi's “What's the problem represented to be?” was applied. Forty practical documents in the form of guidelines, strategies, and quality control documents were included. The analysis uncovered (...) three problem representations: lack of coherence between health services in a complex healthcare system, lack of assessable data for management and political prioritization, and inefficiency in the healthcare system. The proposed solution is a digitalized and standardized practice that transforms recordkeeping in the municipalities. However, municipal healthcare is at risk of being fragmented due to digital documentation's focus on the organizational management of health with task‐oriented practices supplied by an anonymous health professional. We find that digital documentation functions as an organizational micromanagement approach that assigns the health professional a subject position as an employee acting according to the organization's framework rather than the profession's normative framework. People struggle with religion and spirituality in several ways, including challenges in trusting God, confronting supernatural evil, tolerating other perspectives on religion, maintaining moral propriety, finding existential meaning, and managing religious doubt. These religious and spiritual struggles relate to both physical and mental health independently of other religious and distress factors. Causality in this connection needs further study, but evidence supports many potential causes and moderators of the link between R/S struggle and health. These include personality, social, and environmental influences, (...) including traumatic experiences and subcultural differences. Many theoretical questions remain unresolved, including how change in R/S struggle can predict or be predicted by change in health and other connected constructs, and how one might intervene to aid those who struggle with religious or spiritual challenges. Nonetheless, research momentum has grown, having already produced a wealth of information that underscores the need for greater attention to this domain. R/S struggle poses an important exception to generally positive overall associations between religion and well-being, though even R/S struggle may promote growth. This review offers a brief introduction to emerging psychological theory and research on R/S struggle with an emphasis on its relevance to wellness and illness. (shrink)

This work is the transcript of a theological dialogue I had with ChatGPT that spanned a couple of days. I began it merely out of curiosity over how ChatGPT might respond to questions and challenges I posed. As it progressed, I became increasingly impressed with the nuance, depth, and relevance of its responses. The dialogue became, for me, something of a contemplative exercise. I still don’t know quite how to understand the ability of generative A.I. to respond with such (apparent) (...) understanding and even insight. -/- I’ve decided to post this dialogue, not only because of the puzzle it poses concerning A.I, but even more, because I believe that the theological conclusions ‘we’ arrived at have real merit. -/- In the end, the theological views expressed here echo those that I’ve expressed in other works of mine, but the expression of these views are enhanced by the way ChatGPT picks up on them, rephrases them, elaborates upon them, and often places them in the context of the classical theological tradition. -/- I might add that I have been an A.I. skeptic for some time now, concerned over the potential dangers of A.I. in general. Locke’s work sharply distinguishes between the natural right to property in the ‘state of nature’ and the societal right to property as established in a socio-economic political system. Whereas the former does not depend on (...) the consent of others, it is qualified by strict limits on the amount of property that may be rightly acquired. The societal right to property lifts these limits but is justified only under the principle of universal consent. This principle, I argue, implies the Rawlsian difference principle; i.e., that the regulation and distribution of property must be such as would elicit the freely proffered consent of society’s least advantaged members. On what basis should we embrace a religious belief? In this article I argue that religious faith should be viewed, not as a conclusion we arrive at after reviewing the evidence, but as an existential decision we make through which we define ourselves.

Religion, especially Western religion, calls upon us to 'believe' on the basis of 'faith.' But in what way can faith serve as a justification for belief? In this essay, I distinguish between 'belief in' and 'belief that' and argue that faith, properly understood, entails the former, not the latter.

In this paper I present, in summary form, some of my central thoughts about spirituality and religion.

This article examines the flaw in the libertarian conception of the right to property. It argues that libertarians fail to recognize that, in a settled society, the right to amass property must be qualified and limited by the right of all people - including those without property - to have access to sufficient property for a satisfactory life.

In this essay I argue that the ethical and political position known as libertarianism is logically incoherent and, as such, cannot serve as a sound basis for either political theory or public policy. Given that the libertarian position is frequently used to provide the rationale for many of the economic (if not the social) policies of the right, a recognition of this incoherence is especially relevant to us today.

This is the first chapter of a projected book to be entitled, The Ego and the Spirit. This book will endeavor to examine what lies at the heart of human spiritual aspiration from a psychological, philosophical, and religious perspective. In this first chapter, I discuss the predicament of the human ego, charged with a task that it cannot fulfill: To establish itself securely within being. The ego's efforts to fulfill this task through its dealings with the things and people of (...) the material world lead to distortions in its self-experience, its relations with others, and its involvement in life in general. The world's spiritual traditions have long recognized the predicament of the ego and present themselves as a means to its resolution. In this first chapter, though, the focus is on the ego and its predicament. (shrink)

This work explores questions of God and faith in the context of Martin Heidegger's phenomenological ontology, as developed in Being and Time . One problem with traditional philosophical approaches to the question of God is their tendency to regard God's existence as an objective datum, which might be proven or disproven through logical argumentation. Since Kant, such arguments have largely been dismissed as predicated on a priori assumptions whose legitimacy cannot be substantiated. This dismissal has led to a widening divorce (...) between 'faith' and 'reason,' as the rational grounds for faith have come under increasing, and radical, attack. ;Heidegger provides a new reason to question the legitimacy of traditional philosophical approaches to the question of God. His phenomenological ontology reveals that concernful relations lie at the foundation of our apprehension of Being, hence any attempt to 'prove' the existence of God as a purely 'objective' datum must miss the significance of the very phenomenon it seeks to apprehend. Dasein, as Being-in-the-world, is primordially related to and concerned with the world revealed to it. Any attempt to understand the meaning of Being, then, must take its stance from an examination of the concernfulness of Dasein. This, however, affords us a new possibility for approaching the question of God; one which pursues this question, not in terms of metaphysical categories, but in terms of its significance for the concernful human being. ;At the same time that Heidegger's thought allows us this new approach, however, his existential analyses seem to deny any legitimacy to religious faith at all. For Heidegger, the human being is 'Being-towards-death,' i.e., essentially enclosed in finitude, whereas for religion the human being has an essential relation to the infinity of God. Our work, then, has a twofold purpose. We seek, first, to explore the meaning of God and faith as these may be understood in terms provided by Heidegger's phenomenological ontology. We seek, second, to examine the way in which that ontology is itself challenged by a religious conception of human Being. (shrink)

Sut Jhally begins his essay “Advertising at the Edge of the Apocalypse” with the following provocative claim: “Advertising is the most powerful and sustained system of propaganda in human history and its cumulative effects, unless quickly checked, will be responsible for destroying the world as we know it.” Jhally argues that the advertising industry, in fostering an association between human aspiration and desire for consumable goods, creates an artificial demand for such goods that is, at once, far in excess of (...) what is needed for human flourishing and catastrophic to the global environment. Jhally sees capitalism as the ultimate culprit. In a system in which wealth is defined as a “vast collection of commodities” (Marx, Capital), those who produce such commodities have no other choice but to promote excess consumption. Hence the advertising industry emerges as the propaganda arm of capitalism. My paper argues that, though Jhally’s analysis of the problem is both compelling and alarming, his diagnosis fails to reach its heart. Indeed, it is not Marx but Plato who provides us with the terms needed both to understand and respond to the problem Jhally cites. My paper provides a Platonic analysis of these issues and concludes with some suggestions as to how to address them. (shrink)
