Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

What is the nature of law and what is the best way to discover it? This book argues that law is best understood in terms of the social functions it performs wherever it is found in human society. In order to support this claim, law is explained as a kind of institution and as a kind of artefact. To say that it is an institution is to say that it is designed for creating and conferring special statuses to people so (...) as to alter their rights and responsibilities toward each other. To say that it is an artefact is to say that it is a tool of human creation that is designed to signal its usability to people who interact with it. This picture of law's nature is marshalled to critique theories of law that see it mainly as a product of reason or morality, understanding those theories via their conceptions of law's function. It is also used to argue against those legal positivists who see law's functions as relatively minor aspects of its nature. -/- This method of conceptualizing law's nature helps us to explain how the law, understood as social facts, can make normative demands upon us. It also recommends a methodology for understanding law that combines elements of conceptual analysis with empirical research for uncovering the purposes to which diverse peoples put their legal activities. This study investigated relationships between inter-class variations in paranormal experience and executive functions. A sample of 516 adults completed self-report measures assessing personal encounter-based paranormal occurrences, executive functions together with Emotion Regulation and Belief in the Paranormal. Paranormal belief served as a measure of convergent validity for experience-based phenomena. Latent profile analysis combined experience-based indices into four classes based on sample subpopulation scores. Multivariate analysis of variance then examined interclass differences. Results revealed that breadth of paranormal experience was associated with (...) higher levels of executive functioning difficulties for General Executive Function, Working Memory, Decision Making, and Belief in the Paranormal. On the Everyday Memory Questionnaire, scores differed on Attention Tracking and Factor 3, but not Retrieval. In the case of the Emotion Regulation Scale, class scores varied on Expressive Suppression, however, no difference was evident on Cognitive Reappraisal. Overall, inter-class comparisons identified subtle differences in executive functions related to experience. Since the present study was exploratory, sampled only a limited subset of executive functions, and used subjective, self-report measures, further research is necessary to confirm these outcomes. This should employ objective tests and include a broader range of executive functions. (shrink)

This book is a comparative study of Kant, Rawls, and Habermas and a critical survey of recent theories of justice. It defends the thesis that the normative ground or basis of social criticism is found in a concept of the person as a free and equal moral being.

Human rights have become a wider and more visible feature of our political discourse, yet many have also noted the great discrepancy between the human rights invoked in this discourse and traditional philosophical accounts that conceive of human rights as natural rights. This article explores an alternative approach in which human rights are conceived primarily as international norms aimed at securing the basic conditions of membership or inclusion in a political society. Central to this `political conception' of human rights is (...) the idea of human rights as special (in contrast to general) rights that individuals possess in virtue of specific associative relations they stand in to one another. This view is explored and defended through a critical review of four recent political conceptions — Michael Ignatieff, John Rawls, Thomas Pogge and Joshua Cohen. (shrink)

I have not attempted to provide here an analysis of the methodology of molecular biology or molecular genetics which would demonstrate at what specific points a more reductionist aim would make sense as a research strategy. This, I believe, would require a much deeper analysis of scientific growth than philosophy of science has been able to provide thus far. What I have tried to show is that a straightforward reductionist strategy cannot be said to be follwed in important cases of (...) theory development in molecular biology, and that in at least one important case, the Jacob-Monod operon theory, the methodology followed was more biological than chemical. It should be noted in closing, however, that since biological systems are thought by molecular biologists to be nothing but chemical systems, in the long run detailed investigations of such systems will be in full accord with the dictates suggested by the general reduction model. Murray Hunt’s suggestion, living things deserve moral consideration and inanimate objects do not precisely because living things can intelligibly be said to have interests (and inanimate objects cannot intelligibly said to have interests). Interests are crucial because the concept of morality is noncontingently related to beneficence or nonmaleficence, notions which misfire completely in theabsence of entities capable of being benefited or harmed.

Recent research on genetic and biological diversity suggests that they underlie, and are the source of renewable resources--which are themselves more fundamental than non-renewable resources. If this is the case, then our understandings of the "limits to growth" debate will need modification and current approaches to development--in both the industrial countries and in the Third World--will need reconceptualization. A major part of this will involve a reversal of roles and priorities for agricultural and industrial development. Also, more sustainable/regenerative types of (...) agriculture and food systems will need to be developed. Current explorations along these lines are briefly reviewed. Finally, the links between this and the wider need to develop more sustainable societies are examined. (shrink)

Despite widespread interest in the topic of moral repair in the business ethics literature and in the workplace, little is currently known about moral repair with regard to the self—i.e., how and why individuals repair themselves in the aftermath of harming others within workplace contexts and what factors may influence the success of self-repair. We conducted a qualitative study in the context of health care organizations to develop an inductive model of self-repair in the workplace. Our findings reveal a set (...) of factors, including reactions to the harm incident, motivating factors, and methods of self-repair that involve intrapersonal (e.g., self-compassion) and interpersonal (e.g., seeking feedback and support from co-workers and managers) actions. We discovered that self-repair, or what we characterize as “moral self-repair” is a complex process characterized by important ethical, emotional, and social dimensions and that the effectiveness of self-repair actions is moderated by the actions of those within the organization (e.g., co-workers, managers) and outside the organization (e.g., families, friends, counselors). These social actors can promote self-repair by offering encouragement and support, or undermine self-repair by communicating a lack of trust and respect that reinforces self-blame. This model of self-repair is intended to guide future ethics research on the topic of moral self-repair and offers insight to practicing managers. (shrink)

I have argued that law is a genre of institutionalized abstract artifact, meaning that laws are purposive products of human creation designed to signal norms of behavior with respect to them. Its institutional nature is seen in the fact that it is a system of artificial statuses that convey deontic powers to status holders understood in their institutional roles. Following Searle in explaining institutions, however, is also to see the institution as the 'continuing possibility of a practice.' Hence there is (...) no tension in seeing law as both a practice and a genre of artifact. (shrink)

In his dispute with Malebranche about the nature of ideas, Arnauld endorses a form of direct realism. This appears to conflict with views put forward by Arnauld and his collaborators in the Port-Royal Grammar and Logic where ideas are treated as objects in the mind. This tension can be resolved by a careful examination of Arnauld's remarks on the semantics of ‘perception’ and ‘idea’ in light of the Port-Royal theory of language. This examination leads to the conclusion that Arnauld's ideas (...) really are objects in the mind, and not perceptual acts as many commentators hold. What Arnauld denies is that these mental objects are really distinct from the external objects they represent. Instead, Arnauld holds that, by the act of conception, the external objects themselves—not copies—come to be present in the mind and are therefore called ‘ideas’. (shrink)

Rejection of the philosophical relevance of history of philosophy remains pronounced within contemporary analytic philosophy. The two main reasons for this rejection presuppose that strict deduction is both necessary and sufficient for rational justification. However, this justificatory ideal of scientia holds only within strictly formal domains. This is confirmed by a neglected non-sequitur in van Fraassen’s original defence of ‘Constructive Empiricism’. Conversely, strict deduction is insufficient for rational justification in non-formal, substantive domains of inquiry. In non-formal, substantive domains, rational justification (...) is also, in part, ineliminably social and historical, for sound reasons Hegel was the first to articulate. Demonstrating this involves considering closely two key reasons many analytic philosophers (still) reject the philosophical relevance of historical philosophy (§2). As specific example of presumed, though fallacious, deductivism about justification in the non-formal domain of empirical knowledge is found in van Fraassen’s (1980) defence of ‘Constructive Empiricism’ (§3). These first two sections contend that philosophical consideration of historical philosophy is required to properly formulate key issues in non-formal domains. I next consider the further issues involved rational justification in non-formal domains, issues quintessentially posed by the Pyrrhonian Dilemma of the Criterion (§4). Finally I consider what kind of history of philosophy is required for cogent philosophy in non-formal domains (§5). (shrink)

Increasingly widespread adoption of health information technology tools in clinical care increases interest in ethical and legal issues related to the use of these tools for public health and the effects of these uses on the clinician-patient relationship. It is argued that patients, clinicians, and society have generally uncontroversial duties to support civil society's public health mission, information technology supports this mission, and the effects of automated and computerized public health surveillance are likely to have little if any effect on (...) the clinician-patient relationship. It is also suggested, nevertheless, that electronic public health surveillance raises interesting and important ethical issues, some of which can be addressed if not resolved by empirical research, especially regarding patient preferences about secondary use of health data and their moral obligation to contribute to population- based health. Can I be free to perform an action if God has decided to ensure that I do not choose that action? I show that Molinists and simple foreknowledge theorists are committed to answering in the affirmative. This is problematic for their status as theological incompatibilists. I suggest that strategies for preserving their theological incompatibilism in light of this result should be based on sourcehood. However, the path is not easy here either, since Leibniz has shown how theological determinists can offer (...) an extremely robust form of sourcehood. Proponents of these views must identify a valuable form of sourcehood their theories allow that Leibniz’s theory doesn’t. (shrink)

The buddhist approach to the concepts of time and temporality is necessarily based on the correct understanding of the ordinary but dynamically oriented experiential process. in such a process, the concept of time takes on conventional, arbitrary and abstract natures, and subsequently gives way to the concept of temporality which is part and parcel of the experiential process and directly opens up other buddhist doctrines such as relational origination and voidness of being. temporality is non-conventional 'lived time'.

The most influential theory of law in current analytic legal philosophy is legal positivism, which generally understands law to be a kind of institution. The most influential theory of institutions in current analytic social philosophy is that of John Searle. One would hope that the two theories are compatible, and in many ways they certainly are. But one incompatibility that still needs ironing out involves the relation of the social rule that undergirds the validity of any legal system (H.L.A. Hart's (...) rule of recognition) to Searle's notion of codification: the idea that institutions need official declarations of their constitutive rules in order to enjoy the full benefits of institutions. The incompatibility arises from the fact that, in order to do its institutional work, the basic validity rule must be codified in Searle's sense—yet, given the particular role it has in legal positivism, it may be impossible to codify in the Searlean sense. In this paper I develop the incompatibility in detail, consider and reject consigning the basic validity rule to Searle's “Background” capacities that support institutional facts, and conclude that the best route to eliminating it while doing a minimum of damage to the two theories is to make a slight emendation to Searle's theory of institutions. It explains that a social constructionist approach to the self is critical insofar as it targets many of the traditional conceptions of self under discussion in this volume. It analyses the primary use of the term self in psychological and mental discourse, suggesting many ways in which the sources of knowledge about the realm of the mental are open to question. It cites the work of Michel Foucault and others (...) who develop a sustained critique of what may be the dark side of the construction of the self as an autonomous, alienated entity differentiated from the other. Business students have long been noted for their differential proclivity to engage in academic misconduct. Unfortunately, the potential for misconduct has been exacerbated in recent years by rapid advances in technology, easy access to information, competitive pressures, and the proliferation of websites that provide students access to information that allows them to directly circumvent the learning process. Using a convenience sample of 631 students matriculating in various business majors at four U.S. universities and structural equations modeling procedures, this study assesses (...) the effects of psychological factors on business students’ propensities to utilize the services of homework assistance websites. Specifically, we examine how “Dark Triad” personality traits (i.e., narcissism, Machiavellianism, and psychopathy) interact with Fraud Diamond elements to influence student decisions to engage the services of these websites. We find that each Dark Triad trait exerts a significant influence on at least one of the Fraud Diamond elements, which in turn have a significant direct or indirect positive association with students’ reported intentions to utilize, and reported utilization of, these websites. In response to the changing global climate and the growing recognition of the professional associations in the teacher education community, universities around the country are beginning to recognize the need to add a global dimension to their education programs. One way to prepare teachers to address the challenges associated with teaching children in a global age is through carefully structured, international and intercultural field experiences where candidates are immersed in another culture. Intercultural Student Teaching demonstrates examples of such successful programs.
