Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

En tant qu’acteur important dans la gouvernance rurale, les organisations économiques collectives jouent un rôle primordial dans le processus d’urbanisation rurale et constituent un point de vue important pour comprendre l’évolution des relations entre zones urbaines et zones rurales en Chine. En même temps, ces organisations constituent le noyau de la communauté locale, qui représente les individus sur la base d’une même appartenance ethnique, par proximité locale ou par proximité de valeurs communes, voire par proximité économique. Ainsi, les individus partagent (...) une forme de cohésion solidaire, fondée affectivement. Toutefois, au fur et à mesure du développement économique et social, le système, la notion et la nature de l’économique s’évoluent et les valeurs des individus changent, tandis que ces organisations s’adaptent mal au changement économique et social, ce qui provoque la controverse de la société chinoise rurale au cours de la modernisation de la Chine. S’appuyant sur une recherche de terrain et l’analyse des données du village de Liede à Guangzhou, cet article porte sur le processus d’intégration urbaine-rurale du village urbain et explore l’intégration du village urbain dans la ville à travers l’organisation économique collective de Liede, notamment Liede Economic Development Co., Ltd. Dans ce processus, il existe des contradictions entre le rôle du village et le rôle des organisations économiques collectives. Les organisations collectives ont des fonctions économiques, mais elles assument toujours aussi des coûts importants concernant des fonctions publiques telles que la sécurité sociale. On verra que la réforme de la « séparation politique et économique » après la période de l’économie planifiée des années 1980 n’a pas eu d’effet au niveau local. L’évolution du rôle des organisations économiques reflète la mutation de l’économie chinoise, c’est-à-dire, le passage de l’économie communiste à l’économie de marché. Toutefois, l’engagement solidaire existe toujours dans l’économie collective et celle-ci essaie de limiter la cupidité et soutenir l’intérêt commun au lieu de le marginaliser, ce qui constitue un caractère spécifique de l’économie collective en Chine. Drawing on work of the past decade, this volume brings together articles from the philosophy, history, and sociology of science, and many other branches of the biological sciences. The volume delves into the latest theoretical controversies as well as burning questions of contemporary social importance. The issues considered include the nature of evolutionary theory, biology and ethics, the challenge from religion, and the social implications of biology today (in particular the Human Genome Project).

Our interpretive resources enable us to make sense of, navigate, and communicate about our shared world. These resources not only carve the world up into categories, but also guide how we, individually and collectively, are oriented towards it. In this thesis, I examine how these resources, and the dispositions they guide, may be harmful. A vital kind of interpretive resources are frames, which equip us with unified perspectives on the world. Perspectives are suites of open-ended interpretive (inquisitive, attentional, inferential, evaluative, (...) and affective) dispositions. Frames thereby guide how we interpret, respond to, and navigate the world. I show that these perspectives are epistemically powerful and indispensable. I argue that flawed perspectives, and the distorting frames that produce them, are deeply pernicious and I examine their relationship to oppression. (shrink)

When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration. Pacifists and their opponents disagree not only about moral questions, but rather often about factual questions as well—as seen when looking at the controversy surrounding the crisis in Kosovo. According to my reconstruction of pacifism, this is not surprising since the pacifist,legitimately, looks at the facts in the light of her system of value. Her opponent, in turn, looks at the facts in the light of an alternative value system, and the quarrel between the two parties about supposedly descriptive matters (...) never ceases, as there is no objective reality about the war in question that could settle the issue.In my view, the pacifist's value-laden way of looking at reality implicitly obeys three epistemic imperatives. First, the Epistemic Imperative concerning Human Nature ("Resist demonizing the other side; always try to understand the case from the other point of view"). Second, the Epistemic Imperative concerning Non-Violent Alternatives ("Always search for non-violent alternatives to military action"). Third, the Epistemic Imperative concerning Uncontrolled Escalation ("Hone your senses to the uncontrolled, irreversible side effects of military action, particularly to the danger of military escalation leading to another world war"). Objective reality has no way of telling us how far we should go in following these imperatives. Rather, we have to make the decision about how far we are going to take them ourselves. In this way, the pacifist's epistemic imperatives are comparable to Kant's regulative principles. (shrink)

One can use imagination to represent possibilities other than the actual, to represent times other than the present, and to represent perspectives other than one’s own. Unlike perceiving and believing, imagining something does not require one to consider that something to be the case. Unlike desiring or anticipating, imagining something does not require one to wish or expect that something (...) to be the case. // -/- Imagination is involved in a wide variety of human activities, and has been explored from a wide range of philosophical perspectives. Philosophers of mind have examined imagination’s role in mindreading and in pretense. Philosophical aestheticians have examined imagination’s role in creating and in engaging with different types of artworks. Epistemologists have examined imagination’s role in theoretical thought experiments and in practical decision-making. Philosophers of language have examined imagination’s role in irony and metaphor. // -/- Because of the breadth of the topic, this entry focuses exclusively on contemporary discussions of imagination in the Anglo-American philosophical tradition. Background Various authorities recommend the participation of patients in promoting patient safety, but little is known about health care professionals' (HCPs') attitudes towards patients' involvement in safety-related behaviours. Objective To investigate how HCPs evaluate patients' behaviours and HCP responses to patient involvement in the behaviour, relative to different aspects of the patient, the involved HCP and the potential error. Design Cross-sectional fractional factorial survey with seven factors embedded in two error scenarios (missed hand hygiene, medication error). Each survey included two (...) randomized vignettes that described the potential error, a patient's reaction to that error and the HCP response to the patient. Setting Twelve hospitals in Switzerland. Participants A total of 1141 HCPs (response rate 45%). Measurements Approval of patients' behaviour, HCP response to the patient, anticipated effects on the patient–HCP relationship, HCPs' support for being asked the question, affective response to the vignettes. Outcomes were measured on 7-point scales. Results Approval of patients' safety-related interventions was generally high and largely affected by patients' behaviour and correct identification of error. Anticipated effects on the patient–HCP relationship were much less positive, little correlated with approval of patients' behaviour and were mainly determined by the HCP response to intervening patients. HCPs expressed more favourable attitudes towards patients intervening about a medication error than about hand sanitation. Conclusions This study provides the first insights into predictors of HCPs' attitudes towards patient engagement in safety. Future research is however required to assess the generalizability of the findings into practice before training can be designed to address critical issues. (shrink)

Imaginative immersion refers to a phenomenon in which one loses oneself in make-believe. Susanna Schellenberg says that the best explanation of imaginative immersion involves a radical revision to cognitive architecture. Instead of there being an attitude of belief and a distinct attitude of imagination, there should only be one attitude that represents a continuum between belief and imagination. -/- We argue otherwise. Although imaginative immersion is a crucial data point for theorizing about the imagination, positing a continuum between belief and (...) imagination is neither necessary nor sufficient for explaining the phenomenon. In addition, arguing against Schellenberg’s account reveals important but underappreciated lessons for theorizing about the imagination and for interpreting boxological representations of the mind. This research aimed to show the political stance of the Muslim majority represented by the Ministry of Religious Affairs of the Republic of Indonesia (MoRA RI) towards non-Muslim leadership through the translation of the Qur’an. It examined the differences in the translation of the Qur’an based on the theory of translation as a political act. A total of 19 phrases or collocated words ittahaza awliya were found in the corpus of the Qur’an. The researchers approached the study with a critical (...) discourse analysis approach, and conducted contrastive analysis on translations of these collocated words in four editions of translations of the Qur’an published officially by MoRA RI from 1965 to 2019. The results proved that interference in translation of the collocation ittaḥaẓa awliya is caused by the influence of the source text, and that the political situation and ideology influenced the translation of the Qur’an in Indonesia. The political direction of the Indonesian government, especially MoRA RI, tended to provide more opportunities for non-Muslims to become leaders today, as seen in the 2019 edition. While the translation edition published before tended to close the possibility of non-Muslims becoming leaders. This finding shows the government’s stance on democracy for non-Muslims, which according to previous research findings has declined with the rise of Islamic populism in Indonesia.Contribution: This article provides an explanation of one side of the difficulty of translating collocation [ittaḥaẓa awliya] in the Qur’an and at the same time shows the political direction of the government of the Republic of Indonesia regarding the politics of non-Muslim leadership. Nach Morton White können wir die holistische Quine/Duhem-These auf ethische Sätze genauso anwenden wie auf wissenschaftliche. Demzufolge mögen sich die meisten ethische Sätze zwar nicht einzeln testen lassen, wohl aber im Zusammenhang einer kompletten Theorie, die sowohl deskriptive als auch normative Sätze enthält. Ich diskutiere zwei Vorschläge dafür, wie dieser Vergleich durchbuchstabiert werden könnte. Laut Whites eigenem Vorschlag lassen sich einige normative Konsequenzen des Gesamtsystems durch Konfrontation mit den emotionalen Reaktionen des Sprechers testen. Laut meinem Vorschlag sind einige normative Konsequenzen (...) des Systems bereits Beobachtungssätze in Quines Sinn und können genauso getestet werden wie naturwissenschaftliche Beobachtungssätze, nämlich durch Sinneserfahrung. Kurzum, es gibt moralische Beobachtungssätze. Quine bezeichnet diejenigen Sätze als Beobachtungssätze, die alle anwesenden Sprecher einer Gemeinschaft stets gleich beurteilen und die der einzelne Sprecher ausschließlich aufgrund momentaner Sinnesreizung bejaht oder verneint (also unabhängig von Hintergrund-Informationen). In Quines Argument gegen moralische Beobachtungssätze steckt folgender Fehler: Quine glaubt, dass sich moralische Fragen immer nur angesichts von Hintergrund-Informationen beurteilen lassen. Bei vielen moralischen Sätzen mag das so sein; aber es gibt Gegenbeispiele, in denen Hintergrund-Informationen ausgeschaltet sind, z.B. "Dies ist sichtbares Unrecht". (shrink)

To construct their first lexicon, infants must determine the relationship between native phonological variation and the meanings of words. This process is arguably more complex for bilingual learners who are often confronted with phonological conflict: phonological variation that is lexically relevant in one language may be lexically irrelevant in the other. In a series of four experiments, the present study investigated English–Mandarin bilingual infants’ abilities to negotiate phonological conflict introduced by learning both a tone and a non-tone language. In a (...) novel word learning task, bilingual children were tested on their sensitivity to tone variation in English and Mandarin contexts. Their abilities to interpret tone variation in a language-dependent manner were compared to those of monolingual Mandarin learning infants. Results demonstrated that at 12–13 months, bilingual infants demonstrated the ability to bind tone to word meanings in Mandarin, but to disregard tone variation when learning new words in English. In contrast, monolingual learners of Mandarin did not show evidence of integrating tones into word meanings in Mandarin at the same age even though they were learning a tone language. However, a tone discrimination paradigm confirmed that monolingual Mandarin learning infants were able to tell these tones apart at 12–13 months under a different set of conditions. Later, at 17–18 months, monolingual Mandarin learners were able to bind tone variation to word meanings when learning new words. Our findings are discussed in terms of cognitive adaptations associated with bilingualism that may ease the negotiation of phonological conflict and facilitate precocious uptake of certain properties of each language. Current sociological theories appear to have lost their general persuasiveness in part because, unlike the theories of the ‘classical era’, they fail to maintain an integrated stance toward society, and the practical role that sociology plays in society. The authors explore various facets of this failure and possibilities for reconstructing sociological theories as integrated wholes capable of conveying a moral and political immediacy. They discuss the evolution of several concepts (for example, the social, structure, and self) and address the significant (...) disputes (for example, structuralism versus humanism, and individual versus society) that have dominated twentieth-century sociological thought. Their ideas and analyses are directed towards an audience of students and theorists who are coming to terms with the project of sociological theory, and its relationship with moral discourses and political practice. The authors of these essays are sociological theorists from the United States, the United Kingdom and Canada. They are all established, but not ‘establishment’ authors. The book contains no orthodoxies, and no answers. However, the essays do contribute to identifying the range of issues that will constitute the agenda for the next generation of sociological theorists. (shrink)

In this chapter we explore the ethical justifications for criminal detentions prior to adjudication. Because defending pretrial detentions cannot be justified on purely forward-looking grounds, any plausible justification for pre-conviction detention must be partly backward-looking. Reflecting on the aims of the criminal law more broadly suggests that pretrial detentions, like post-conviction detentions, may be justified on “hybrid” grounds—but only if certain backward-looking retributive criteria and forward-looking instrumental criteria are met. We conclude that while it is possible in principle to justify (...) pretrial detention, there is reason to think that much of the pretrial detention in the U.S. is not, in fact, justified. We then argue that as a result, current pretrial detention practices in the U.S. unjustifiably diminish a special sort of moral agency that is necessary for holding persons responsible in the first place. This article offers a critical reflection of Lizal’isidinga laKho (hymn 116) and Wazidala iinto zonke (hymn 16) written by Tiyo Soga and recorded in the Methodist Church of Southern Africa (MCSA) hymnal book. From the perspective of black theology of liberation (BTL), I historicise and contextualise hymn 116 and hymn 16 to debunk the argument that Tiyo Soga was alien to the lives, experiences of suffering and pain of his people. The article posits that hymn 116 and hymn 16 are (...) black spirituals that articulate the contexts Soga found himself as a black person during the times of the frontier wars. Therefore, utilising blackness as a heuristic approach, I argue that the songs do not just historicise the experiences of black people in the times of the frontier wars, but they are prayers and/or laments from Soga that ask God to spare the lives, the culture, and value systems of black people in a world that seeks the destruction of their being, history, and culture. The songs emphasise the black struggle for justice and liberation encouraging black people never to succumb to the definitions given to them by those who seek the destruction of black personhood. The article locates Soga within the frontier wars to illustrate his own experiences as black person, then examines and presents Lizal’isidinga laKho, Wazidala iinto zonke as black spirituals born in a time of war to give hope to those who have been conquered and subjugated in the unjust wars of colonisation. Hymns 116 and 16 contribute to the decolonial turn discourse –unthinking of the west – because they emphasise the black struggle for liberation and justice.Contribution: The contribution of this article is its focus on the way in which the intersection of religious studies, social sciences, and humanities generates an interdisciplinary contested discourse. This book presents three of the works of Abdu'l-Bahá, son of the founder of the Bahá'i Faith, dealing with social and political issues.00In 'The Secret of Divine Civilization' (1875) Abdu'l-Bahá supports the administrative and broader social reforms of Mirzá Hosayn Khán, but looks mainly for organic reform through the efforts of Iranian intellectuals to waken and educate the masses. In this work, Abdu'l-Bahá gives virtuous and progressive Islamic clerics a leading role among these intellectuals, indeed most of his appeals are (...) directed specifically to them. 'A Traveller's Narrative' (1889/90) is an authoritative statement of the broad lines of Bahá'i social and political thinking. 'The Art of Governance' (1892/93) was written as Iran entered a pre-revolutionary phase, and ideas that we recognise today as the precursors of political Islam were spreading. It sets out the principles underlying the ideal relationship between religion and politics and between the government and the people.00In addition to presenting the first parallel text translations of these works, the Persian texts incorporate notes on variants in the early published sources. Christopher Grau argues that the genetic basis for moral agency account of rightholding is problematic because it fails to grant all human beings the moral status of rightholding; it grants the status of rightholding to entities that do not intuitively deserve such status; and it assumes that the genetic basis for moral agency has intrinsic/final value, but the genetic basis for moral agency only has instrumental value. Grau also argues that those who are inclined to hold that all human beings (...) are rightholders should reconsider speciesism. In this paper, I argue that Grau's objections do not undermine the genetic basis for moral agency account of rightholding, and I also offer criticisms of Grau's defense of speciesism. (shrink)

Executive dysfunctions, psychopathologies arising from problems in the control and regulation of behavior, can occur as a result of the faulty execution of formal information processing models or as a result of malfunctioning neural mechanisms. The models correspond to the formal descriptions of how signals in the environment must be transformed in order to behave adaptively, and the mechanisms correspond to the signal transformations that nervous systems implement in order to execute those cognitive functions. Mechanisms in the form of repeated (...) patterns of neural dynamics execute information processing models. Two distinct modes of malfunction can occur when neural dynamics execute models of information processing. The processing models describing behavior may fail to be executed correctly by neural mechanisms. Or, the neural mechanisms may malfunction, failing to implement the right computation. As an example of malfunctioning models in executive cognition, purported failures of rule following can be understood as failures to appropriately execute a suite of processing models. As an example of malfunctioning mechanisms of executive cognition, maladaptive behavior resulting from dysfunction in the medial prefrontal cortex (mPFC) can be understood as failures in the signal transformations carried out therein. The purpose of these examples is to illustrate the potential benefits of considering models and mechanisms in the diagnosis and etiology of neuropsychological illness and dysfunction, especially disorders of executive cognition. In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950.
