Recent years have seen fresh impetus brought to debates about the proper role of statistical evidence in the law. Recent work largely centres on a set of puzzles known as the ‘proof paradox’. While these puzzles may initially seem academic, they have important ramifications for the law: raising key conceptual questions about legal proof, and practical questions about DNA evidence. This article introduces the proof paradox, why we should care about it, and new work attempting to resolve it.

This volume offers an updated analysis of the use, meaning, and scope of the classical notion of aitía. It clarifies philosophical and philological questions about aitia and offers bold and innovative interpretations of this key concept of ancient philosophy. The numerous meanings and nuances of aitia remain difficult to grasp. Ancient philosophers use aitia to explain the existence and activity of substances, bodies, souls, or gods, Paradoxically, its own definition remains difficult to establish. This book reconstructs some of the most (...) important uses, variants, and scopes of the term aitia within different philosophical perspectives in antiquity, including early Greek philosophy, Plato, Aristotle, Stoicism, and Islamic philosophy. The chapters analyze metaphysical aspects, epistemological issues, and logical implications of aitia. They engage with the most relevant critical literature generated in several modern languages. In doing so, they offer an inclusive and overarching re-evaluation of our assumptions about causation and explanation in ancient philosophy. Cause and Explanation in Ancient Philosophy will be of interest to scholars and advanced students working on pre-Socratic philosophy, Plato, Aristotle, Hellenistic philosophy, late antiquity, and medieval philosophy. A fundamental goal of research in neuroscience is to uncover the causal structure of the brain. This focus on causation makes sense, because causal information can provide explanations of brain function and identify reliable targets with which to understand cognitive function and prevent or change neurological conditions and psychiatric disorders. In this research, one of the most frequently used causal concepts is ‘mechanism’ — this is seen in the literature and language of the field, in grant and funding inquiries that (...) specify what research is supported, and in journal guidelines on which contributions are considered for publication. In these contexts, mechanisms are commonly tied to expressions of the main aims of the field and cited as the ‘fundamental’, ‘foundational’ and/or ‘basic’ unit for understanding the brain. Despite its common usage and perceived importance, mechanism is used in different ways that are rarely distinguished. Given that this concept is defined in different ways throughout the field — and that there is often no clarification of which definition is intended — there remains a marked ambiguity about the fundamental goals, orientation and principles of the field. Here we provide an overview of causation and mechanism from the perspectives of neuroscience and philosophy of science, in order to address these challenges. (shrink)

Causal selection has to do with the distinction we make between background conditions and “the” true cause or causes of some outcome of interest. A longstanding consensus in philosophy views causal selection as lacking any objective rationale and as guided, instead, by arbitrary, pragmatic, and non-scientific considerations. I argue against this position in the context of causal selection for disease traits. In this domain, causes are selected on the basis of the type of causal control they exhibit over a disease (...) of interest. My analysis clarifies the principled rationale that guides this selection and how it involves both pragmatic and objective considerations, which have been overlooked in the extant literature. Is authoritarian power ever legitimate? The contemporary political theory literature—which largely conceptualizes legitimacy in terms of democracy or basic rights—would seem to suggest not. I argue, however, that there exists another, overlooked aspect of legitimacy concerning a government’s ability to ensure safety and security. While, under normal conditions, maintaining democracy and rights is typically compatible with guaranteeing safety, in emergency situations, conflicts between these two aspects of legitimacy can and often do arise. A salient example of this is the COVID-19 (...) pandemic, during which severe limitations on free movement and association have become legitimate techniques of government. Climate change poses an even graver threat to public safety. Consequently, I argue, legitimacy may require a similarly authoritarian approach. While unsettling, this suggests the political importance of climate action. For if we wish to avoid legitimating authoritarian power, we must act to prevent crises from arising that can only be resolved by such means. (shrink)

Social scientists appeal to various “structures” in their explanations including public policies, economic systems, and social hierarchies. Significant debate surrounds the explanatory relevance of these factors for various outcomes such as health, behavioral, and economic patterns. This paper provides a causal account of social structural explanation that is motivated by Haslanger (2016). This account suggests that social structure can be explanatory in virtue of operating as a causal constraint, which is a causal factor with unique characteristics. A novel causal framework (...) is provided for understanding these explanations–this framework addresses puzzles regarding the mysterious causal influence of social structure, how to understand its relation to individual choice, and what makes it the main explanatory (and causally responsible) factor for various outcomes. Jury science is fraught with difficulty. Since legal and institutional hurdles render it all but impossible to study live criminal jury deliberation, researchers make use of various indirect methods to evaluate jury performance. But each of these methods are open to methodological criticism and, strikingly, some of the highest-profile jury research programmes in recent years have reached opposing conclusions. Uncertainty about jury performance is an obstacle for legal reform—ongoing debates about the ‘justice gap’ for complainants of sexual offences has rendered (...) these problems stark. Academic integrity policies at 200 institutions of higher education were examined for the presence of academic prohibitions against the nonmedical use of prescription stimulants or any other cognitive enhancing drug. Researchers used online search tools to locate policy handbooks in a stratified random sample of IHE’s drawn from the Integrated Postsecondary Education Data System database, searching for NMUPS/CED use as violations of either academic integrity or alcohol and other drug policies. Of 191 academic integrity policies found online, NMUPS/CED prohibitions were (...) present in only one. However, NMUPS was addressed in all but two of the 200 IHE AOD policies, often with language referencing IHE adherence to federal or state law. NMUPS/CED prohibitions are predominantly absent in IHE academic integrity policies, raising questions about whether colleges and universities are concerned about the use of enhancement drugs as a form of cheating. Implications for fairness, health promotion, and future research are discussed. (shrink)

We argue that Koch’s postulates are best understood within an interventionist account of causation, in the sense described in Woodward. We show how this treatment helps to resolve interpretive puzzles associated with Koch’s work and how it clarifies the different roles the postulates play in providing useful, yet not universal criteria for disease causation. Our paper is an effort at rational reconstruction; we attempt to show how Koch’s postulates and reasoning make sense and are normatively justified within an interventionist framework (...) and more difficult to understand within alternative frameworks for thinking about causation. I investigate the extent to which there might be, now or in the future, non-human animals that partake in the kind of fully human-style consciousness that has been taken by many philosophers to be the basis of normative personhood. I first sketch a conceptual framework for considering the question, based on a range of philosophical literature on relationships between consciousness, language and personhood. I then review the standard basis for largely a priori skepticism about the possibility that any non-human animal (...) could experience FHSC and be a person to any extent, and indicate empirically motivated grounds for rejecting such skepticism, at least with respect to a select group of hypersocial candidate species with communication systems we do not currently know are not languages: corvids, parrots, elephants, and toothed whales. Relevant facts about elephants are reviewed in some detail, as a mini case study. While it is suggested that elephants might partake in the sort of consciousness characteristic of personhood to some extent, grounds are given for expecting that this extent is sharply limited by comparison with normal humans. As these grounds are mainly aspects of elephants’ external niche, however, rather than known limitations in their inboard cognitive or representational capacities, the surprising conclusion emerges that elephants might acquire FHSC, and thereby become persons, if they can be brought into conversation with humans, a possibility opened by considerations canvassed in the paper. Recently, philosophers have developed an extensive literature on social ontology that applies methods and concepts from analytic metaphysics. Much of this is entirely abstracted from, and unconcerned with, social science. However, Epstein (2015) argues explicitly that analytic social metaphysics, provided its account of ontological ‘grounding’ is repaired in specific ways, can rescue social science from explanatory impasses into which he thinks it has fallen. This version of analytic social ontology thus directly competes with radically naturalistic alternatives, in a way that (...) helps to clarify what makes some metaphysics genuinely scientific (that is, part of the scientific enterprise and worldview). I consider this competition, marshal considerations against the value to social science of analytic metaphysics, and sketch a contrasting scientific metaphysics for understanding the implications of revisionist social ontology in unified scientific ontology. The advanced donation program was proposed in 2014 to allow an individual to donate a kidney in order to provide a voucher for a kidney in the future for a particular loved one. In this article, we explore the logistical and ethical issues that such a program raises. We argue that such a program is ethical in principle but there are many logistical issues that need to be addressed to ensure that the actual program is fair to both those who (...) do and do not participate in this program. This article begins by examining the concept of the pharmakon that is developed in Derrida’s essay ‘Plato’s Pharmacy’, as it is here that the idea of a medium that is simultaneously poisonous and therapeutic is developed in relation to the discursive effects of writing. The author then goes on to look at Stiegler’s attempt to reconfigure the ‘orthographic economy’ of deconstruction, particularly his account of how the ‘tertiary supports’ of virtual and information technologies have transformed the experience of the real (...) in the regime of global capitalisation. Finally, he argues that the appearance of the pharmakon as a matrix idea in his work, sharpens his account of the aporia of technological society: for the impossibility of human culture being reduced to either the disorientated life industrial populism, or to idealist notions of reflexivity, is what, for Stiegler, offers the chance of a new politics of spirit. During the past two decades, philosophers of biology have increasingly turned their attention to mechanisms of biological phenomena. Through analyses of mechanistic proposals advanced by biologists, the goal of these philosophers is to understand what a mechanism is and how mechanisms explain. These analyses have generally focused on mechanistic proposals for phenomenon that occur at the cellular or sub-cellular level, such as synapse firing, protein synthesis, or metabolic pathway operation. Little is said about the mechanisms of the macromolecular reactions that (...) underpin these phenomena. These reactions comprise a diverse family of reaction types, and include protein folding, macromolecular complex formation, receptor-ligand interactions, and enzyme catalysis. In this paper, I develop an account of mechanism that focuses exclusively on macromolecular reactions. I begin by reviewing how mechanism is understood in enzymology, and how mechanistic concepts of enzymology apply to macromolecular reactions in general. We will see that the mechanism of a macromolecular reaction is most accurately described as a progression of reaction intermediates, where the evolution of intermediates, from one to the next, is characterized by an energetic coupling between chemistry and protein dynamics. I then make the case that this description necessitates a grounding in a process ontology. To describe the mechanism by which a macromolecular reaction occurs is to describe a process. (shrink)

Researchers face perennial difficulties in studying live jury deliberation. As a result, the academic community struggles to reach a consensus on key matters of legal reform concerning jury trials. The hurdles faced by empirical jury researchers are often legal or institutional. This note argues that the legal and institutional barriers preventing live deliberation research should be removed and discusses two forms that live deliberation research could take.

Current research suggests consumers trade off price, quality, and sustainability attributes when making choices. Prior studies have typically focused on product attribute dyads, rather than multiattribute decision-making in the sustainability context. For scholars and practitioners, understanding which attributes are more important to consumers in tradeoff contexts has been a challenge. Self-other orientation may play a significant role in predicting consumers’ sustainable choices. We use prior research on equity sensitivity to demonstrate that segmenting consumers by their disposition to self-other tradeoffs helps (...) predict price–quality–sustainability tradeoffs. We hypothesize and test how members of these equity sensitivity segments tradeoff price, quality, and sustainability attributes in consumption decisions. Through four conjoint studies featuring diverse product assortments and sustainability issues, we find that price provides high utility for Entitled consumers, while sustainability provides high utility for Benevolent consumers. When product attributes are combined, Benevolents are more likely than Entitleds to purchase sustainable products. We also demonstrate that, in the absence of product choices, Equity Sensitives are more willing to choose a sustainable option over a conventional option, even when prices are high. In light of these findings, we discuss the implications for scholars looking to broadly predict consumers’ sustainable choices and for firms looking to target consumers with consumer-centric sustainability strategy. This essay argues for the philosophical standing of Walter Benjamin’s early work and posits a deeper continuity between this early work as a philosopher and the subsequent development of his work as a writer. When these fragments are read in proper relation to each other, they reveal for the first time many of the key innovations of Benjamin as a philosopher, as well as his points of influence on Horkheimer and Adorno. His early ‘Program’ critiques the Enlightenment conception of experience (...) as a means for gaining empirical knowledge, and announces the need for a new concept of experience. Benjamin follows through on this program with a method of philosophical enquiry that is by turns fragmentary and constellational, developing a series of provisional notions of experience, which form a constellation with one another: perception, mimesis, language as a medium of experience, observation and memory. A collection of 22 interviews and one personal essay, _Julia Kristeva Interviews_ presents an intimate and accessible portrait of one of France's most important critical thinkers and intellectual personalities.

The study of social norms sprawls across all of the social sciences but the the concept lacks a unified conception and formal theory. We synthesize an account that can be applied generally, at the social scale of analysis, and can be applied to empirical evidence generated in field and lab experiments. More specifically, we provide new analysis on representing norms for application in empirical political science, and in parts of economics that do not follow the recent trend among some behavioral (...) economists to build models of the cognitive and motivational states of individuals taken “one at a time”. Foundational sources for our project are Bicchieri (2006, 2017), Kuran (1995), and Stirling (2012, 2016). From Bicchieri take that a norm exists in a social structure when a significant networked subset of individuals share descriptive and injunctive expectations that it regulates their interactions. From Kuran we take the insight that prevailing norms may come to be widely disliked by participants in networks but survive because norm suppress public displays of disenchantment. From Stirling we apply conditional game theory (CGT) to provide the technical resources for building our model of a norm-regulated social interaction. Should we use the same standard of proof to adjudicate guilt for murder and petty theft? Why not tailor the standard of proof to the crime? These relatively neglected questions cut to the heart of central issues in the philosophy of law. This paper scrutinises whether we ought to use the same standard for all criminal cases, in contrast with a flexible approach that uses different standards for different crimes. I reject consequentialist arguments for a radically flexible standard of proof, (...) instead defending a modestly flexible approach on non-consequentialist grounds. The system I defend is one on which we should impose a higher standard of proof for crimes that attract more severe punishments. This proposal, although apparently revisionary, accords with a plausible theory concerning the epistemology of legal judgments and the role they play in society. (shrink)

The problem with remembering Auschwitz is that the neoliberal paradigm of economic utility, demotic happiness, and programmed consumption has tended to erase its facticity from public consciousness. Technoscientific capitalism functions as a regime of amnesic performance that prevents a ‘working through’ of the Nazi genocide. I argue that Agamben’s work on the implicit violence of the biopolitical paradigm gives a crucial insight into the fate of humanity in the time of global capitalism. However, I contend that the idea of testimony (...) he presents in Remnants of Auschwitz recapitulates a Heideggerian ontology of experience that is enacted outside of the technological dynamics of trauma and memory. I employ Stiegler’s concept of epiphylogenetic memory, first, to explore the economy of fascisms that has emerged within the networks of global capitalism and, second, to examine the material affects through which Auschwitz returns to the scene of this economy. The idea of the Anthropocene postulates that, epistemically and ontologically, we must consider the climatic, geological, and biological systems of the Earth as essentially bound up with the technological systems that have been developed by human beings. This idea has been aesthetically configured through images of ‘Spaceship Earth’ and in the orbital pictures of light patterns emitted by human settlements across the globe. I will argue that this shift towards the idea of the Anthropocene is complicit with a certain kind (...) of technological messianism, which assumes that the most serious problems of global warming and environmental despoliation will be solved by future technologies. Furthermore the impact of this futural orientation, which includes the idea of transhumanist adaptations to the consequences of climate change, has been to intensify the nexus between technological innovation, neoliberal economics, and entrepreneurial heroism that has come to shape the collective imagination of the future. This, I will argue, has profound consequences for the way human beings orientate themselves to their ethical and political responsibilities in respect of climate change, human suffering, and cosmopolitan democracy. So-called cognitive enhancing drugs are relatively common in higher education, especially among students who are white, male, and attend highly selective institutions. Using qualitative data from a diverse sample of 32 students at an elite university, the present study aims to examine whether students perceive CED use to be advantageous, equitable, and fair. Participants were either medical or nonmedical users of CEDs—primarily ADHD stimulant medications such as Adderall. Data were first coded openly, then axially into themes, and finally arranged to (...) respond to research aims around social and ethical concerns. Ethical perceptions and behavioral justifications varied by participants’ personal use frequency, class standing, and perceived social norms surrounding CEDs. Among the salient themes to emerge was the belief that CED use is a lesser or more tenable form of cheating, that the vagueness and prevalence of ADHD justifies nonmedical use, and that above all, CEDs are advantageous. Some participants expressed concern about the advantageousness of CEDs when coupled with a perceived imbalance of their use among students from traditionally underrepresented backgrounds, with one calling it “the white version of cheating.” Implications for cheating and drug use prevention are discussed, situating cognitive enhancement as an emerging ethical and social equity concern in higher education.
