In the face of challenging circumstances, many teachers turn to spirituality for sustenance and strength. Yet spirituality’s place in education and in educators’ lives has long been a matter of confusion and contention, not least because of the ambiguity of the term in its common usage. What is its relationship to religion? And what defines it? In this article, I submit that the later work of Michel Foucault offers a helpful approach to spirituality that displaces those questions—drawing attention away from (...) beliefs and/or attitudes professed, and towards the process of practical self-transformation that subjects undertake for the sake of a truth that is actualised in the body. To be spiritual in this sense is more a matter of what one does than what one believes or who one is. To offer a sense of why it matters in the lives of educators, I draw on the experiences of a San Diego high school teacher confronting interlocking personal, professional, and political challenges as a detailed example. Consumer-based datasets are the products of data brokerage firms that agglomerate millions of personal records on the adult US population. This big data commodity is purchased by both companies and individual clients for purposes such as marketing, risk prevention, and identity searches. The sheer magnitude and population coverage of available consumer-based datasets and the opacity of the business practices that create these datasets pose emergent ethical challenges within the computational social sciences that have begun to incorporate consumer-based datasets into empirical (...) research. To directly engage with the core ethical debates around the use of consumer-based datasets within social science research, I first consider two case study applications of consumer-based dataset-based scholarship. I then focus on three primary ethical dilemmas within consumer-based datasets regarding human subject research, participant privacy, and informed consent in conversation with the principles of the seminal Belmont Report. Rémi Tison Dans cet article, je traite de la nature des processus cognitifs sous-tendant nos attributions d’états mentaux aux animaux non humains. Selon la conception traditionnelle, nous n’avons qu’un accès indirect aux états mentaux d’autrui, qui doivent être inférés sur la base du comportement. Cette conception traditionnelle influence autant les débats conceptuels concernant l’esprit des animaux que les recherches empiriques sur la cognition animale. Or de récents travaux sur la cognition sociale humaine avancent plutôt une conception « interactionniste », (...) selon laquelle les états mentaux peuvent parfois être directement perçus dans le comportement. J’applique dans cet article la conception interactionniste à l’attribution d’états mentaux aux animaux. Je conclus que celle-ci rend mieux compte des attitudes du sens commun à l’égard des états mentaux des animaux et est plus féconde pour la recherche empirique sur la cognition animale que la conception traditionnelle. The prominent Russian philosopher Nikolai Lossky and his ex-student Nicolai Hartmann shared many metaphysical and epistemological views, and Lossky is likely to have influenced Hartmann in adopting several of them. But, in the case of axiological issues, it appears that Lossky also borrowed from the axiologies of Hartmann and the latter's Cologne colleague, Max Scheler. The links between the theories of values of Scheler and Hartmann have been studied abundantly, but never in relation to Lossky. In this paper, I examine (...) the manifold relationships – similarities, differences, borrowings, criticisms, and possible influences – between Lossky's axiology and those of Scheler and Hartmann on four key interweaving issues: (1) their ontological realism with regards to the objectivity of values, (2) their epistemological theories of the intuition of values, (3) their ontological definitions of "value", i.e., whether values are relations, qualities, essences, powers, meanings, etc., and (4) their theories of the stratification of values. This paper assesses James M. Buchanan's claim of following a positive approach in stark contrast to the normative approach to public finance of Richard A. Musgrave. The goal of this paper is to shed light on the foundations of modern American public finance by analysing one aspect of the methodology of its two most prominent fathers. I show (1) that it is difficult to distinguish Musgrave's and Buchanan's theories of public goods along the positive/normative dividing line and (2) that Buchanan's (...) theory can also be considered normative. In the first three parts, I follow the Weberian methodological tradition in looking for value judgements in the theories, and by reflecting on the nature of ideal types. In the last part, I propose a broader interpretation of Buchanan's methodological stance within the academic context of the 1960s. (shrink)

We present and contrast two accounts of cooperative communication, both based on Active Inference, a framework that unifies biological and cognitive processes. The mental alignment account, defended in Vasil et al., takes the function of cooperative communication to be the alignment of the interlocutor's mental states, and cooperative communicative behavior to be driven by an evolutionarily selected adaptive prior belief favoring the selection of action policies that promote such an alignment. We argue that the mental alignment account should be rejected (...) because it neglects the action-oriented nature of cooperative communication, which skews its view of the dynamics of communicative interaction. We introduce our own conception of cooperative communication, inspired by a more radical ecological interpretation of the active inference framework. Cooperative communication, on our ecological conception, serves to guide and constrain the dynamics of the cooperative interaction via the construction and restructuring of shared fields of affordances, in order to reach the local goals of the joint actions in which episodes of cooperative communication are embedded. We argue that our ecological conception provides a better theoretical standpoint to account for the action-oriented nature of cooperative communication in the active inference framework. (shrink)

Considering the urgency of addressing grand challenges that affect human health and achieving the ambitious health targets set by the United Nations’ Sustainable Development Goals, the role of business in improving health has become critical. Yet, our systematic review of the business–health literature reveals that business research focuses primarily on occupational health and safety, health care organizations, and health regulations. To embrace the health externalities generated by business activities, we propose that future research should investigate the conditions under which business (...) articulates and participates in health challenges, engages in multilevel actions toward tackling health challenges, and improves health outcomes and its impact on the health of external stakeholders, including customers and local communities. This paper aims to deflate the idea that democracy would be in essence a privileged locus of civic trust. Three claims are defended: (1) there is nothing specific to democracy regarding the affirmation that trust is required for social cooperation; (2) democracy, when conceived discursively, depends on guarded epistemic trust and; (3) popular control may require, in some contexts, institutions that express and foster distrust towards a specific section of the population. The conclusion to be drawn is that the appropriateness (...) of trust for the achievement of popular control over government depends on a contextual and realist assessment. (shrink)

We show that MRP + MA implies that ITP(λ, ω 2 ) holds for all cardinal λ ≥ ω 2 . This generalizes a result by Weiß who showed that PFA implies that ITP(λ, ω 2 ) holds for all cardinal λ ≥ ω 2 . Consequently any of the known methods to prove MRP + MA consistent relative to some large cardinal hypothesis requires the existence of a strongly compact cardinal. Moreover if one wants to force MRP + MA (...) with a proper forcing, it requires at least a supercompact cardinal. We also study the relationship between MRP and some weak versions of square. We show that MRP implies the failure of □(λ, ω) for all λ ≥ ω 2 and we give a direct proof that MRP + MA implies the failure of □(λ, ω 1 ) for all λ ≥ ω 2. (shrink)

This is a translation of the obituary that Nicolai Hartmann wrote for his colleague and friend, Max Scheler, after the latter's premature death in 1928. In this eulogy, after emphasizing the unfortunate incompleteness of Scheler's lifework, his keeping abreast with the development of the various sciences, his power of intuition, and the fact that he was a philosopher of life without for that matter having a Lebensphilosophie, Hartmann chronologically recapitulates Scheler's life achievements, beginning with his career in Jena, his interest (...) for ethical principles, his relation to the phenomenological movement in Munich, his theory of values, wartime in Berlin, his work on the sociology of knowledge, he gives us glimpses into Scheler's unwritten and still fluctuating metaphysical views, his ever-growing interest in ontological questions, which was guided by his continued interest in the problem of man, his power of relearning, and the apparent contradictions in his thought, which, Hartmann says, was primarily the thought of a "problemthinker." In such contexts, the concept of dignity typically signifies something like the fundamental moral status belonging to all humans. Remarkably, however, it is only in the last century that this meaning of the term has become standardized. Before this, dignity was instead a concept associated with social status. Unfortunately, this transformation remains something of a mystery in existing (...) scholarship. Exactly when and why did "dignity" change its meaning? And before this change, was it truly the case that we lacked a conception of human worth akin to the one that "dignity" now represents? In this volume, leading scholars across a range of disciplines attempt to answer such questions by clarifying the presently murky history of "dignity," from classical Greek thought through the Middle Ages and Enlightenment to the present day. Nous nous concentrerons plus particulièrement ici sur la fonction constructive (...) de la démocratie, c’est-à-dire sur cette capacité qu’a la démocratie délibérative d’identifier et de formuler, de manière épistémiquement instructive, les problèmes de justice auxquels doit faire face le corps politique. Il faudra donc d’abord expliquer comment la démocratie permet de colliger l’information et de la mettre à disposition de chacun, afin d’expliquer ensuite comment la délibération peut permettre l’émergence d’accords entre les individus. The aims of this paper are to discuss the mechanisms which allow an open, free and inclusive forum of deliberation to achieve correct decisions and to discuss the impact of deliberation on disagreement. I concentrate on the constructive function of democracy which designates the capacity of deliberative democracy to identify and frame the problems of justice faced by a polity in epistemically positive ways. I first explain how democracy can pool information. This is then used to explain how deliberation can enable agreement to emerge. This is followed by a discussion of the limits of deliberation and how it is unable to resolve some disagreements. The final element of my discussion is an explanation of the role of deliberation in framing political disagreements. I argue that deliberation helps in avoiding unsustainable political disagreements which could bring about political decay. (shrink)

This paper examines the question of why consumers engage in ethical consumption. The authors draw on self-affirmation theory to propose that the choice of an ethical product serves a self-restorative function. Four experiments provide support for this assertion: a self-threat increases consumers’ choice of an ethical option, even when the alternative choice is objectively superior in quantity (Study 1) and product quality (Study 2). Further, restoring self-esteem through positive feedback eliminates this increase in ethical choice (Studies 2 and 3). As (...) an additional test of the robustness of our results, a final study examined the effect of self-threat on choice in a field setting (Study 4). The findings indicate that ethical purchases are not just altruistic. They hold purposeful individual value and can help in the self-restorative process. Implications for managers making decisions regarding investment in ethical product features are discussed. (shrink)

On doit à l’économiste américain d’origine allemande, Richard A. Musgrave, la formulation des critères d’Équité Horizontale (ÉH) et d’Équité Verticale (ÉV). Étant donnée une base fiscale, l’ÉH veut que les égaux soient traités également, alors que l’ÉV exige que les inégaux soient traités inégalement (par exemple que les plus riches payent proportionnellement plus d’impôts). Musgrave opère en 1959 une redescription créative de considérations d’équité qui ont une longue histoire de Hobbes à Buchanan, en passant notamment par la fameuse maxime de (...) Adam Smith. La reconstruction généalogique montre que l’ÉV et l’ÉH relèvent de la justice distributive au sens aristotélicien du terme. Un critère purement formel, l’équité en matière d’impôt signifie l’égalité proportionnelle dans la répartition des charges communes à tous les individus membres d’une communauté politique. À défaut d’un consensus théorique sur la manière de conceptualiser les contribuables, l’ÉH conserve tout de même une valeur de principe régulateur dans le cadre non idéal de débats de réforme fiscale.Codes JEL : H20, B11, B12, B20, B40, D63. In this paper, we propose an argumentation formalism that allows for both deductive and abductive argumentation, where ‘deduction’ is used as an umbrella term for both defeasible and strict ‘forward’ inference. Our formalism is based on an extended version of our previously proposed information graph formalism, which provides a precise account of the interplay between deductive and abductive inference and causal and evidential information. In the current version, we consider additional types of information such as abstractions which allow domain experts (...) to be more expressive in stating their knowledge, where we identify and impose constraints on the types of inferences that may be performed with the different types of information. A new notion of attack is defined that captures a crucial aspect of abductive reasoning, namely that of competition between abductively inferred alternative explanations. Our argumentation formalism generates an abstract argumentation framework and thus allows arguments to be formally evaluated. We prove that instantiations of our argumentation formalism satisfy key rationality postulates. (shrink)

In this paper, we introduce an ecological account of communication according to which acts of communication are active inferences achieved by affecting the behavior of a target organism via the modification of its field of affordances. Constraining a target organism’s behavior constitutes a mechanism of socially extended active inference, allowing organisms to proactively regulate their inner states through the behavior of other organisms. In this general conception of communication, the type of cooperative communication characteristic of human communicative interaction is a (...) way of constraining interaction dynamics toward the goals of a given joint action by constructing and altering shared fields of affordances. This account embraces a pragmatist view according to which communication is a form of action aiming to influence the behavior of a target, and stands against the traditional transmission view according to which communication fundamentally serves to convey information. Understanding acts of communication as active inference under an ecological interpretation allows us to link communicative and ultimately linguistic behavior to the biological imperative of minimizing free energy and to emphasize the action-oriented nature of communicative interaction. A new method of observation is currently emerging in psychiatry, based on data collection and behavioral profiling of smartphone users. Numerical phenotyping is a paradigmatic example. This behavioral investigation method uses computerized measurement tools in order to collect characteristics of different psychiatric disorders. First, it is necessary to contextualize the emergence of these new methods and to question their promises and expectations. The international mental health research framework invites us to reflect on methodological issues and to draw conclusions from certain (...) impasses related to the clinical complexity of this field. From this contextualization, the investigation method relating to digital phenotyping can be questioned in order to identify some of its potentials. These new methods are also an opportunity to test psychoanalysis. It is then necessary to identify the elements of fruitful analysis that clinical experience and research in psychoanalysis have been able to deploy regarding the challenges of digital technology. An analysis of this theme's litterature shows that psychoanalysis facilitates a reflection on the psychological effects related to digital methods. It also shows how it can profit from the research potential offered by new technical tools, considering the progress that has been made over the past fifty years. This cross-fertilization of the potential and limitations of digital methods in mental health intervention in the context of theoretical issues at the international level invites us to take a resolutely non-reductionist position. In the field of research, psychoanalysis offers a specific perspective that can well be articulated to an epistemology of networks. Rather than aiming at a numerical phenotyping of patients according to the geneticists' model, the case formulation method appears to be a serious prerequisite to give a limited and specific place to the integration of smartphones in clinical investigation. Cassirer and Panofsky: A Philosophical Misunderstanding This paper argues that German art historian and iconologist Erwin Panofsky unintentionally misused the concept of "symbolic form" coined by his friend and colleague, philosopher Ernst Cassirer. Although both shared the same neo-Kantian background, I contend that Panofsky clung to Kant’s dualistic theory of knowledge, while Cassirer explicitly adopted a non-dualistic way of thinking largely inspired by Goethean morphology. That is why Panofsky could distinguish between the "natural" space of perception and the cultural space (...) of artistic representation, when Cassirer refused such a possibility. In so doing, Panofsky proved that he totally missed Cassirer’s point: according to the philosopher of symbolic forms, there is no such thing as a "nature," unless this "nature" is grasped as inherently cultural and historical. To celebrate forty years of publication, we asked people new to bioethics to tell us what should be next on the docket. We received 195 essays. Here are four we especially like. Bioethics has, until now, focused mainly on those who directly influence human health. It worked to establish guidelines for doctors to follow when treating their patients, and it provided a backbone for ethical human research. Bioethics has done a lot of good, but it is time for the field (...) to branch out to things that affect human health in less obvious ways. This paper presents a conception of corruption informed by epistemic democratic theory. I first explain the view of corruption as a disease of the political body. Following this view, we have to consider the type of actions that debase a political entity of its constitutive principal in order to assess corruption. Accordingly, we need to consider what the constitutive principle of democracy is. This is the task I undertake in the second section where I explicate democratic legitimacy. I present democracy (...) as a procedure of social inquiry about what ought to be done that includes epistemic and practical considerations. In the third section, I argue that the problem of corruption for a procedural conception of democracy is that the epistemic value of the procedure is diminished by corrupted agents’ lack of concern for truth. Corruption, according to this view, consists in two deformities of truth: lying and bullshit. These deformities corrupt since they conceal private interests under the guise of a concern for truth. In the fourth section, I discuss the difficulties a procedural account may face in formulating solutions to the problem of corruption. (shrink)

The following text is a translation of Semyon Frank’s “L’intuition fondamentale de Bergson” published in Henri Bergson: Essais et témoignages inédits, edited by Albert Béguin and Pierre Thévenaz, Neuchâtel: Éditions de la Baconnière, 1941. In this article, Frank addresses Bergson’s notion of intuition, his anti-intellectualism, his mysticism, his closeness to Lebensphilosophie, the notion of lived experience, the distinction between intuition as pure contemplation and intuition as living knowledge, the distinction between cognition of the atemporal essence of reality and cognition of (...) the world of becoming, pragmatism, the disinterested and open intuitive spiritual attitude vs the utilitarian attitude of social groups closed in on themselves, the transrational vs the irrational, spiritual life, psychic life, the Absolute, and the temporal flux. The article contains criticisms of Bergson on the issues of time and intuition: the durée, the intuitive time, is incomprehensible without an atemporal foundation. Therefore, according to Frank, Plato was correct—contra Bergson—to define time as the moving image of eternity. And, if there is such an atemporal foundation, then, contrary to what Bergson seems to think, intuition as living knowledge cannot be the sole mode of intuition. Moreover, unlike what Bergson appears to think, an intuition of the Absolute would be an intuition of the transrational rather than of the irrational. The translation is preceded by an introduction tracing the genesis of the article, which was commissioned by the Swiss philosopher Pierre Thévenaz. (shrink)

The overall aim of this thesis is to assess the legitimacy of constitutional laws and bills of rights within the framework of procedural epistemic democracy. The thesis is divided into three sections. In the first section, I discuss the relevance of an epistemic argument for democracy under the circumstances of politics: I provide an account of reasonable disagreement and explain how usual approaches to the authority of decision-making procedures fail to take it seriously. In the second part of the thesis, (...) I provide an account of the epistemic features of democracy and of the requirements of democratic legitimacy. I develop a revised pragmatist argument for democracy which relies on three presumptive aims of decision-making: justice, sustainability and concord. In the third and last section, I first argue for the desirability of constitutionalism. I then explain why constitutionalism, as it is usually understood, is incompatible with my procedural epistemic account of democratic legitimacy. In the last chapter, I offer a two-pronged solution to the apparent incompatibility of constitutionalism and epistemic democracy. I first argue for the appropriateness of political constitutionalism, as opposed to legal constitutionalism, in understanding the relationship between rights and democracy. I then provide an account of rights protection and judicial review compatible with epistemic democratic legitimacy. Finally, I use the notion of pragmatic encroachment to explain how constitutional laws can achieve normative supremacy through the increased epistemic credentials of the procedure. (shrink)

This paper offers a revised political conception of human rights informed by legal pluralism and epistemic considerations. In the first part, I present the political conception of human rights. I then argue for four desiderata that such a conception should meet to be functionally applicable. In the rest of the first section and in the second section, I explain how abstract human rights norms and the practice of specification prevent the political conception from meeting these four desiderata. In the last (...) part of the paper, I argue that full-fledged tolerance in the international order – that is tolerance-as-non-intervention and tolerance-as-respect – should be attached to (1) compliance with jus cogens norms and to; (2a) a political community recognizably organized as a community of inquiry that is; (2b) committed to the specification and incorporation or expression of the idea of human rights within its local legal system. This article provides an exploration of the relationships between a procedural account of epistemic democracy, illegitimate laws and judicial review. I first explain how there can be illegitimate laws within a procedural account of democracy. I argue that even if democratic legitimacy is conceived procedurally, it does not imply that democracy could legitimately undermine itself or adopt grossly unjust laws. I then turn to the legitimacy of judicial review with regard to these illegitimate laws. I maintain that courts do not (...) have a moral privilege on the overthrow of illegitimate laws; in this respect the refusal of royal assent has the same status. I also explain how the rule of the clear mistake fails to restrict the action of courts to only illegitimate laws. Finally, I argue for the positive epistemic inputs of weak judicial review. In this paper, I develop an account of linguistic content based on the active inference framework. While ecological and enactive theorists have rightly rejected the notion of content as a basis for cognitive processes, they must recognize the important role that it plays in the social regulation of linguistic interaction. According to an influential theory in philosophy of language, normative inferentialism, an utterance has the content that it has in virtue of its normative status, that is, in virtue of the (...) set of commitments and entitlements that the speaker undertakes by producing this utterance. This normative status is determined by the normative attitudes shared by members of the utterer’s linguistic community. I propose here an account of such normative attitudes based on the ecological interpretation of the active inference framework. I explain how social normativity can be understood in that framework as the way in which members of a group shape their social niche to make it more predictable. Finally, I apply this account of social normativity to basic communicative practices, thereby explaining how social normative expectations can emerge to regulate these communicative practices, eventually leading to the institution of the sort of normative statuses constitutive of linguistic content. Un carottage effectué dans le marais de Malia a permis de reconstituer les grandes étapes de l'évolution de l'environnement du site archéologique entre 6500 av. J.-C. et aujourd'hui. L'étude ne prend en compte, pour l'instant, que les données sédimentaires et des datations au carbone 14. Plusieurs séquences ont été identifiées. La première (6400-4700 av. J.-C.) correspond au remplissage de la dépression, la deuxième (4700-1500 av. J.-C.) voit se former et évoluer le marais lui-même, la troisième (non datée) révèle un événement (...) marin bref, la quatrième (190 av. J.-C.-414 ap. J.-C.) traduit la réinstallation brutale du marais, la cinquième (de 414 ap. J.-C. à nos jours) montre que la surface du marais évolue en fonction du tracé plus ou moins interne du cordon littoral. Il se peut que la séquence 3 corresponde au tsunami engendré par l'explosion du volcan de Santorin mais il est également possible qu'il corresponde au tremblement de terre de 365 ap. J.-C. qui a provoqué un mouvement de bascule important de la Crète, le coin Sud-Ouest se soulevant de 8 à 10 m, le secteur Nord-oriental s'enfonçant simultanément. (shrink)

Cet article analyse les évolutions des positions de Marx à propos de la colonisation. Il souligne tout d’abord l’invariant de ces réflexions : la dénonciation de la violence coloniale. Au départ, on trouve une interprétation de la colonisation comme processus de modernisation, puis comme dynamique de destruction-régénération, liée à l’« unification du monde ». L’auteur identifie spécialement les inflexions successives de la pensée de Marx – résolument critique –, au sujet des questions coloniale et nationale, du caractère non linéaire de (...) l’histoire, mais aussi de la différenciation des formations sociales. This paper argues that Epictetus’ ethics involves three features which are also present in Aristotle’s discussion of akrasia in the Nicomachean Ethics: 1) A major problem for agents is when they fail to render a universal premise effective at motivating a particular action in accordance with that premise. 2) There are two reasons this occurs: Precipitancy and Weakness. 3) Precipitancy and Weakness can be prevented by gaining a fuller understanding of our beliefs and commitments. This comparison should make clear that (...) akrasia is certainly not absent from Epictetus. Rather a very Aristotelian understanding of why we fail to act in accordance with what we take to be in our own best interests remains at the center of his ethics. (shrink)
