The proliferation of news and information sources has motivated a need to identify those providing legitimate journalism. One temptation is to go the route of such fields as medicine and law, namely to formally professionalize. This gives a clear method for determining who is a member, with an array of associated responsibilities and rewards. We argue that making such a formal move in journalism is a mistake: Journalism does not meet the traditional criteria, and its core ethos is in conflict (...) with the professional mindset. We thus shift the focus from whether the person is journalist to whether the work satisfies the conditions that characterize legitimate journalism. In explaining those conditions we also look at mechanisms for enhancing the power of persons doing journalism, drawing upon lessons from the labor movement. We also consider a self-declaration model while urging increased literacy from all participants in the news gathering and consuming enterprise. (shrink)

Like all human activities, scientific research is infused with values. Scientific discovery can, for example, be valued as an end in itself. The phrase ethical values is an umbrella term for much of what people care about aside from knowledge for its own sake. Ethical values encompass reasons for caring about the harms caused by climate impacts or the injustice of how those harms are distributed. The closer that research gets to informing real-world actions, the more the design of that (...) research can be examined from the perspective of ethical values. Which societal challenges does the research aim to inform? From whose perspective does a policy analysis view potential outcomes? In this chapter we use a series of examples to illustrate how researchers’ choices regarding the treatment of uncertainties can have important consequences from the perspective of ethical values. Our aims in this chapter are: to familiarize readers with the key concept of coupled ethical–epistemic choices; to build capacity for recognizing such choices within the treatment of uncertainties; to encourage engagement with ethical values as a part of climate change research; and to offer some guidance on how to start doing so. Surgery is an important part of contemporary health care, but currently much of surgery lacks a strong evidence base. Uptake of evidence-based medicine (EBM) methods within surgical research and among practitioners has been slow compared with other areas of medicine. Although this is often viewed as arising from practical and cultural barriers, it also reflects a lack of epistemic fit between EBM research methods and surgical practice. In this paper we discuss some epistemic challenges in surgery relating to this lack (...) of fit, and investigate how resources from feminist epistemology can help to characterize them. We point to ways in which these epistemic challenges may be addressed by gathering and disseminating evidence about what works in surgery using methods that are contextual, pluralistic, and sensitive to hierarchies. Clinical trials play a crucial role in generating evidence about healthcare interventions and improving outcomes for current and future patients. For individual trial participants, however, there are inevitably trade‐offs involved in clinical trial participation, given that trials have traditionally been designed to benefit future patient populations rather than to offer personalised care. Failure to understand the distinction between research and clinical care and the likelihood of benefit from participation in clinical trials has been termed the ‘therapeutic misconception’. The evolution of (...) the clinical trials landscape, including greater integration of clinical trials into healthcare and development of novel trial methodologies, may reinforce the significance of the therapeutic misconception and other forms of misunderstanding while at the same time (paradoxically) challenging its salience. Using cancer clinical trials as an exemplar, we describe how methodological changes in early‐ and late‐phase clinical trial designs, as well as changes in the design and delivery of healthcare, impact upon the therapeutic misconception. We suggest that this provides an impetus to re‐examine the ethics of clinical research, particularly in relation to trial access, participant selection, communication and consent, and role delineation. The problem that this essay will address is that of devising a viable use for psychological and intentional terms, in short, discourse concerning what-it-is-to-be-a-subject or "subjecthood" in light of, first, Derrida's deconstruction of the transcendental subject and, second, the materialist claim that recent advances in science effectively antiquate any viable role in empirical psychology for the use of terms traditionally associated with mind. I will argue that Wittgenstein's remarks concerning, among other things, the use of psychological terms, private mental objects (...) and the application of psychological terms to non-humans not only provides a clear and important connection between Derrida and contemporary materialism but that, supplemented by Daniel Dennett's intentional stance, offers an alternative model for the use of such terms in empirical psychological investigation. I will call this model a 'grammar of subjecthood'. ;Central to my argument is the claim that, as opposed to being conceived as names for mental objects or states, psychological terms are best understood as descriptive metaphors for the relationship between an organism and its bio/socio/historical context. That is, the Wittgensteinian notion of subjecthood describes a heuristic that, applied to behavior, provides information to empirical psychologists unavailable on a materialist model of explanation. A grammar of subjecthood, then, is both openly anthropomorphic, yet consistently naturalist, enlisting Dennett's intentional stance as an expansion of Wittgenstein's basic strategy. ;The success of such a strategy cannot be measured by showing in what way human beings are to be essentially distinguished from other organisms, but by how much more sense can be made out of something's behavior by speaking of it in terms of, for example, beliefs and intentions. Anything could be treated as a subject; the issue here is to what it is useful to apply such attributes. (shrink)

Ocean biology helps regulate global climate by fixing atmospheric CO2 and exporting it to deep waters as sinking detrital particles. New observations demonstrate that particle fragmentation is the principal factor controlling the depth to which these particles penetrate the ocean's interior, and hence how long the constituent carbon is sequestered from the atmosphere. The underlying cause is, however, poorly understood. We speculate that small, particle‐associated copepods, which intercept and inadvertently break up sinking particles as they search for attached protistan prey, (...) are the principle agents of fragmentation in the ocean. We explore this idea using a new marine ecosystem model. Results indicate that explicitly representing particle fragmentation by copepods in biogeochemical models offers a step change in our ability to understand the future evolution of biologically‐mediated ocean carbon storage. Our findings highlight the need for improved understanding of the distribution, abundance, ecology and physiology of particle‐associated copepods. (shrink)

Nursing faces an uncertain future as technological developments, structural changes within health systems and rapidly evolving health needs create new and challenging possibilities. This article draws on the results of a qualitative study undertaken with a range of Queensland nurse leaders to explore their perceptions of these changes. The study re‐surfaced, and allows for a re‐examination of, four issues that have long created tension within nursing and which continue to have a negative impact on the profession as a whole. These (...) are as follows: professionalisation; preparation of graduates; myths and narratives of nursing; and leadership. We provide a metaphor that imagines all of these tensions operating in dynamic interplay. The image is that of a Newton's Cradle – a model for energy and momentum. The metaphor allows one to see the wide context of changes affecting nursing and the significance of the interconnections. If tensions within nursing maintain their own integrity through containment, understanding and development, they remain in alignment, and energy is conserved rather than wasted or misdirected. It suggests that with increased awareness and attention paid to internal challenges, and by taking a broad‐based approach to systemic improvements, nursing could become more effective, progressive and proactive in shaping its own future. While earlier research considered Simone de Beauvoir in the perspectives of Existentialism or Feminism, this work is the first to emphasize her reflective and descriptive approach and the full range of issues she addresses. There are valuable chapters and sections that are historical and/or comparative, but most of the contents of this work critically examine Beauvoir's views on old age (whereon she is the first phenomenologist to work), biology, gender, ethics, ethnicity (where she is among the first), and politics (again (...) among the first). Besides their systematic as well as historical significance, these chapters show her philosophy as on a par with those of Merleau-Ponty and Jean-Paul Sartre in quality, richness and distinctiveness of problematics, and the penetration of her insight into collective as well as individual human life within the socio-historical world. On the twelfth anniversary of the name of Mexican Gastronomy as intangible cultural heritage of humanity, its safeguarding continues in different contexts. Nayarit stands out for its natural and cultural wealth which is reflected in the local gastronomy, whose recognition attracts locals and foreigners to taste the delicious dishes. This text contains research results whose purpose is to document the cultural and natural elements that make up the gastronomic heritage of Nayarit with potential for the development of tourism products. Through (...) a qualitative, applied, descriptive research, historical sources were consulted and contrasted with the information collected through interviews, for the integration of a non-exhaustive inventory of the north coast region of Nayarit, which serves as a basis for the tourist product design. In this paper, we derive a four-stage process model of how hybrid organizations respond to specific challenges that arise under conditions of value pluralism and institutional complexity. Engaging in exploratory qualitative research of six Australian hybrid organizations, we identify institutional and organizational responses to pluralism, particularly as organizations strive to uphold multiple value commitments, such as social, environmental and/or financial outcomes. We find that by employing a process of separating, negotiating, aggregating, and subjectively assessing the value that is created, our (...) cases demonstrate how they move between logics in a dynamic fashion and address specific challenges of cognitive dissonance, incommensurability, interdependence and aggregation. Our model contributes to the literature by reframing the notion of ‘tensions’ that arise in conditions of hybridity and characterize specific challenges and sequential responses that may go some way to addressing why some hybrids employ particular responses to pluralism and why some succeed. Women in the business school are beginning to assume characteristics that will prove both ineffective and detrimental in the workplace. This paper seeks to present a framework for understanding these changes as well as their implications. Lloyd (2009) contends that climate models are confirmed by various instances of fit between their output and observational data. The present paper argues that what these instances of fit might confirm are not climate models themselves, but rather hypotheses about the adequacy of climate models for particular purposes. This required shift in thinking—from confirming climate models to confirming their adequacy-for-purpose—may sound trivial, but it is shown to complicate the evaluation of climate models considerably, both in principle and in practice.

The paper presents Suárez’s view on the individuation of beings, which he developed in his Disputatio V, De unitate individuali eiusque principio. The aim, apart from simply presenting Doctor Eximius’s thought, is also to compare his views with his scholastic predecessors. When considering the question of individuation, Suárez remained under a considerable influence of the medieval tradition, which, however, he transformed in his writings according to his own convictions. He used the language of Duns Scotus when speaking of individuation and (...) determining it in terms of indivisibility, but rejected the idea of individuation by matter, classically attributed to the Thomistic School. Postulating the individuation principle, identified with the entity, and not with the act of existence nor the being of haecceitas, Suárez departed from non-classical interpretations of the thought of Thomas Aquinas as well as from the Scotistic solutions, and postulated a view that to some extent resembled that of Ockham and Bonaventure, although Suárez does not explicitly refer to the latter. International Mindedness (IM) has become an underpinning philosophy of the International Baccalaureate and schools which adopt its programmes. However, the concept of IM is relevant to any school that offers international education given its potential and importance to drive the school’s mindset and mission. The international school market has grown significantly in terms of the number of schools and their diversity. Increasing in popularity are schools that follow the British-based International General Certificate of Secondary Education (IGCSE) and A-level programmes. Moreover, (...) the dgreatest expansion of international schools is now occurring in local markets, in which students are no longer predominantly expatriates but come from the host countries. This study explores the concept of international mindedness in six international schools in Cyprus. Based on data collected from headteachers and teachers, we argue that international mindedness is applicable in various contexts of international schooling and that factors other than the curriculum can affect its development within a school. IntroductionSwitzerland lacks specific legal regulation of assistance in suicide. The practice has, however, developed since the 1980s as a consequence of a gap in the Swiss Criminal Code and is performed by private right-to-die organisations. Traditionally, assistance in suicide is considered contrary to the philosophy of palliative care. Nonetheless, Swiss palliative care physicians regularly receive patient requests for suicide assistance. Their attitudes towards the legal regulations of this practice and their experience in this context remain unclear.ObjectivesOur study aimed to explore (...) and describe the attitudes and experiences of Swiss palliative care physicians concerning the legal situation of suicide assistance.MethodsIn 2019, we performed an exploratory interview study with 12 Swiss palliative care physicians on palliative sedation as an alternative to assisted suicide. In this paper, we present the results that emerged from a thematic subanalysis of the data.ResultsParticipants stated that assistance in suicide and palliative care are based on opposing philosophies, but they admitted a shift in paradigm over the last years in the sense that one practice does not necessarily exclude the other. They reported various roles in suicide assistance and considered that the current activities of Swiss right-to-die organisations were problematic and needed to be regulated by law.Discussion and conclusionThese results could enrich national and international reflection on suicide assistance in the context of palliative care by reducing confusion between the two practices and strengthening the confidence of patients and their relatives. The main topic of this article is to show similarities between framing and cognitive metaphor. At the beginning I will show definition of cognitive metaphor and examples of using this metaphor. Then I will do the same with definition of framing, in the end I will try to show that this two things have a lot of common. Main reason of this article is to show that framing is not only present in media, but that framing is present in our (...) language too, which can have influence on recipients, for example when we are watching news or politicians. The aim of our study was to examine the familial risk of dyslexia in Year 1 school beginners, whose parents had been diagnosed as dyslexic or exhibited symptoms of the specific difficulties in reading and writing without a formal opinion issued by a counselling centre. We found that both a dyslexia report and specific reading and writing difficulties with no formal diagnosis manifested by a family member, and parents’ reading preferences, predicted the risk of dyslexia in Year 1 children. Moreover, (...) the children at familiar risk of dyslexia, as compared with their peers at no risk, later began to babble, were less apt at self-help and liked drawing less at the age of 2-3 years, and experienced more problems with drawing a circle at the age of 3. Additionally, during Year 1 of education, they performed poorer in fine motor skills, linguistic perception and sound deletion, visual functions and attention. Such symptoms can be observed by parents and teachers during the child’s play and educational activities. Early intervention can enhance the child’s readiness to school entry, and facilitate effective and satisfactory learning, increasing their further educational opportunities and the quality of life. This paper discusses the potential contribution of Henri Bergson’s philosophy to the theory and practice of service quality measurement. First, it summarises some of the theoretical developments within the field of service quality measurement and points to areas of controversy found within the extant publications. Then, it proposes that a greater appreciation of philosophy, in particular the writings of Henri Bergson, can help address the apparent inconsistencies and gaps observed in the literature. Finally, the paper offers suggestions regarding the potential (...) implications of Bergson’s philosophy for the measurement of service quality in contemporary organisations. (shrink)

Whether in characterizing Catharine MacKinnon's theory of gender as itself pornographic or in identifying liberalism as unable to make good on its promises, Wendy Brown pursues a central question: how does a sense of woundedness become the basis for a sense of identity? Brown argues that efforts to outlaw hate speech and pornography powerfully legitimize the state: such apparently well-intentioned attempts harm victims further by portraying them as so helpless as to be in continuing need of governmental protection. "Whether (...) one is dealing with the state, the Mafia, parents, pimps, police, or husbands," writes Brown, "the heavy price of institutionalized protection is always a measure of dependence and agreement to abide by the protector's rules." True democracy, she insists, requires sharing power, not regulation by it; freedom, not protection.Refusing any facile identification with one political position or another, Brown applies her argument to a panoply of topics, from the basis of litigiousness in political life to the appearance on the academic Left of themes of revenge and a thwarted will to power. These and other provocations in contemporary political thought and political life provide an occasion for rethinking the value of several of the last two centuries' most compelling theoretical critiques of modern political life, including the positions of Nietzsche, Marx, Weber, and Foucault. Celem artykułu jest przedstawienie i analiza kształtowania się pojęcia woli w starożytnej filozofii pogańskiej. W kontekście poglądów Sokratesa, Platona i Arystotelesa autor przedstawia wiele greckich intuicji dotyczących psychologii aktów moralnych i ludzkiego działania. Po pierwsze artykuł przedstawia doktrynę intelektualizmu etycznego, przypisywaną Sokratesowi, według której kognitywne elementy są głównym motywem naszych działań. Z tego powodu trudno znaleźć pojęcie wolnej woli w sokratejskiej antropologii. Po drugie artykuł prezentuje interpretację platońskiej antropologii, według której sferę thymos można nazwać proto-wolą. Ostatecznie autor ukazuje, jak trudno (...) jest znaleźć pojęcie woli w arystotelesowskiej etyce i antropologii, pomimo że Arystoteles bardzo szczegółowo wyjaśniał relacje między przekonaniami, pragnieniami i działaniem. Ani pro- airesis, ani boulesis nie mogą pełnić funkcji woli, szczególnie gdy wola ma być władzą, która pragnie, może wybierać ijest samodeterminującą się władzą. (shrink)

On the 24th June 2015, Feminist Legal Studies and the London School of Economics Law Department hosted an afternoon event with Professor Wendy Brown, Class of 1936 First Professor of Political Science, University of California. Professor Brown kindly agreed to discuss her scholarship on feminist theory, and its relationship to both the law and neoliberalism. The event included an interview by Dr Katie Cruz and a Q&A session, which are presented here in an edited version of the transcript. Sumi (...) Madhock, Professor of Gender Studies, LSE chaired the interview and discussion and introduced Professor Brown’s work. Katie Cruz asked Wendy Brown to reflect upon topics that span her scholarship and activism, including the state of critical, feminist, and Left approaches to rights, neoliberalism, despair and utopianism, and the future of feminist theory and practice in the context of neoliberalism and current debates about intersectionality. Participants in the discussion asked questions on a wide range of issues, including the limits of feminist engagement with law as a tool for social change, the dominance of neoliberalism, imperialist feminism, Islamophobia, secularism, and our attachment to the figure of homo politicus. The escalating global ecological degradation underlines the continued importance of the need of effective nature protection. In recent years a new concept– “environmental personhood” was developed. The article analyses the concept and asks the question if it can help with the efficiency of protecting the nature. It is the attempt to transfer the essence of human rights to animals and ecosystem, so they will no longer be right’-less. This concept has some of its beginning in the idea of “common heritage (...) of mankind”, which means that some places belong to the whole of humanity and that the resources of these places should be available to all. This article outlines the roots, the development and traces current trends in the legal personification of non-human persons. It asks legal-theoretical questions about the limits and possibilities of opening up the concept of legal personhood for non-human legal persons in order to protect the nature and discusses the possibility of creating new institutions that could protect it. The article also shows the importance of creating a new society sensitive to nature’s needs. (shrink)

Both in Polish and international literature Duns Scotus’ ethical thought has had a number of conflicting interpretations. The article presents the main elements of Duns Scotus’ ethical thought. The quaestions it tries to answer are the following: a) is Scotus’ ethics voluntaristic; b) if so, what type of voluntarism can one attribute to Scotus. Finding Scotus’ ethics moderately voluntaristic I distinguish and characterize three types of voluntarism that could be attributed to Scotus: psychological voluntarism (Duns finds the will more perfect (...) than the intellect as its acts are more perfect); theological voluntarism (Duns takes the Commandments of the first table to be obligatory in a stronger way than the Commandments of the second table), causal voluntarism (the will is taken to be the primary cause of free action, non determined even by the most perfect good). FRANCIS SUÁREZ’S VIEWS ON THE RELATION BETWEEN THE ABSOLUTE POWER OF GOD AND THE NATURAL LAW The article presents Francis Suárez’s views concerning the problem of the possibility of granting dispensation from the natural law by the absolute power of God. Suárez’s opinions on this matter were shown in his comprehensive work on the philosophy of law: De legibus ac Deo legislatore, in Book II De lege aeterna, naturali, et jure gentium, chapter XV entitled Utrum Deus dispensare possit in lege (...) naturali etiam de absoluta potestate. Analyzing the notion of natural law Suárez accepts the Thomistic formula, according to which, the created world is a collection of things with invariable natures. These natures require us to fulfil certain moral obligations and to act in a proper manner. And for this reason, natural law, included in the Decalogue, is invariable and even God is not able to grant its dispensation. The commandments involve an intrinsic principle of justice and obligation and for this reason they are not liable to dispensation. God cannot act contrary to His own nature and His being just, so He would not order people to do something intrinsically unjust. Doctor Eximius justifies moral norms expressed in the Decalogue axiologically, not in a voluntaristic way, by referring to God’s will alone. Suárez criticises both strong theological voluntarism, attributed to Ockham, as well as weak theological voluntarism, attributed to John Duns Scotus. God’s Knowledge of Future Contingents. John Duns Scotus’ Explanation The article concerns John Duns Scotus’ views on the problem of God’s knowledge of future contingents, presented by Scotus in his Lectura in librum primum Sententiarumd. 39, n. 1-93. He begins his analysis of the notion of God’s knowledge concerning the future events by criticizing two theories: first, the claim that the content of the idea of a thing, possessed by God, can include contingency of this thing; second, the claim that (...) eternity of God is simultaneous with the flowing time as a whole, and therefore His knowledge of future contingents is the knowledge of present contingents. Duns Scotus presents his own conception in the form of the following claims: (1) there is contingency in the reality, however, we are not able to prove it; (2) the proximate second causes are not the causes of contingency in things; (3) the main cause of contingency in reality is God, precisely His will. Thus, contingency is not an imperfection because it is produced immediately by God. The article also presents Scotus’ theory of synchronic contingency.
