Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

An archive is a repository - that is, a place or space in which materials of historic interest or social significance are stored and ordered. A national archive is the storing and ordering place of the collective memory of that nation or people(s). This article provides a brief his torical/theoretical introduction to the politics of the archive in late capi talist societies and discusses this politics of memory via the performance of ordinary daily activities of librarians and archivists. Some relevant (...) political/discursive questions include: who controls, establishes and maintains the archive, and how do they do so? Which materials are preserved in the archive and which are excluded? As the documents and artifacts selected for the archive are ordered and classi fied, how do the schemas and structures applied include, exclude, fore ground or marginalize those materials? Finally, to what extent do the logical hierarchies for classification and arrangement reflect social or political hierarchies? The authors give real-life examples of choices made as archivists struggle to balance ideological goals made contradictory by practical constraints. For example, is it more appro priate to acquire as many materials as possible but be unable to describe, preserve and present them adequately, or is it preferable to describe, preserve and make fully available a more limited range of records and documents? Because of such practical concerns in modern technicist cultures, the explicitly political who often is reduced to the technically instrumental how - that is, political-moral questions are displaced to nonmoral and nonpolitical technical discourse, thereby establishing a 'meta-politics' that is understood only by the initiated. Conversely, archival activities such as acquisition, classification and preservation are 'technical' activi ties that may become explicitly 'political'. The article concludes that technical activities always are political, at least latently or potentially, even when they are not contested and made explicitly political. (shrink)

In a recent article Ian Hacking argues that there can be cases where no probabilities may correctly be ascribed to individual members of a population, while probabilities are correctly ascribable to the population as a whole. In this paper a simple artificial coin-flipping model for such probabilities, not 'grounded from below' is constructed. The inferences licensed by this model and a consequence of the model for the theory of statistical tests is explored.

The eight pieces constituting this Meeting Report are summaries of presentations made during a panel session at the 2011 Association for Practical and Professional Ethics (APPE) annual meeting held between March 3rd and 6th in Cincinnati. Lisa Newton organized the session and served as chair. The panel of eight consisted both of pioneers in the field and more recent arrivals. In this paper we explore the idea that Pentecostalism is best supported by conjoining it to a postmodern, narrative epistemology in which everything is a text requiring interpretation. On this view, truth doesn’t consist in a set of uninterpreted facts that make the claims of Christianity true; rather, as James K. A. Smith says, truth emerges when there is a “fit” or proportionality between the Christian story and one’s affective and emotional life. We argue that Pentecostals should reject this account (...) of truth, since it leads to either a self-refuting story-relativism or the equally problematic fallacy of story-ism: favoring one’s own story over others without legitimate reason. In either case, we contend, the gospel itself is placed at risk. (shrink)

Background: Despite procedural innovations and increasing numbers of uterus transplant attempts worldwide, the perspectives of uterus transplant (UTx) trial participants are lacking. Methods: We conducted a mixed-methods study with women with absolute uterine factor infertility (AUFI). Participants included women who had previously contacted the Cleveland Clinic regarding the Uterine Transplant Trial and met the initial eligibility criteria for participation. In-depth interviews were conducted in conjunction with FertiQoL, a validated and widely used tool to measure the impact of infertility on the (...) quality of life of infertility patients. Results: All (n = 19) rated their overall health as good; some experienced grief and social isolation. AUFI is a life-framing experience that influences acceptance by family, partners, peers, and one’s self. UTx is a means to gain control of reproductive autonomy. UTx allows family-building and the ability to play an active role in prenatal health and well-being. Establishing and maintaining a supportive relationship is a key issue of AUFI and when considering UTx. Risks of UTx are perceived relative to risks to self/child/family posed by adoption/surrogacy. Participants had no overall preference regarding living or deceased donor. Conclusions: The ways in which women with AUFI conceptualize this condition in their lives and choices around UTx and participating in a study of the procedure are multifaceted and textured. These perspectives are critical to understanding its ethical, legal, and social implications. (shrink)

Libertarian paternalism is a concept derived from cognitive psychology and behavioural science. It is behind policies that frame information in such a way as to encourage individuals to make choices which are in their best interests, while maintaining their freedom of choice. Clinicians may view their clinical consultations as far removed from the realms of cognitive psychology but on closer examination there are a number of striking similarities.

According to David Lewis, we all believe there are countless ways in which things might have been different from the way they are in fact. Surely, for example, the world could have existed even if, say, Quine had been a politician, or if there had been one less page in Word and Object, or indeed if there had been no such person as Quine at all. All these things, we are inclined to think, might have been the case. And thus (...) we find ourselves saying, “There are many ways things could have been.” However, as Lewis notes, this sentence involves an existential quantification over objects of a peculiar sort: “ways things could have been”—”possible worlds,” if you like. At face value, then, our modal discourse commits us to belief in possible worlds—as peculiar as that may seem. Those who feel squeamish at this prospect can perhaps console themselves with the fact that failure to believe in real, live alternate possibilities ends in Spinozism: the view that (in Samuel Clarke’s words) “nothing which is not, could possibly have been; and nothing which is, could possibly not have been; and that no mode or circumstance of the existence of anything could possibly have been in any respect otherwise than it now actually is.” For most of us, I dare say, this is a difficult pill to swallow. When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

In this article I examine an as yet unexplored aspect of J.P. Moreland’s defense of so-called bare particularism — the ontological theory according to which ordinary concrete particulars (e.g., Socrates) contain bare particulars as individuating constituents and property ‘hubs.’ I begin with the observation that if there is a constituency relation obtaining between Socrates and his bare particular, it must be an internal relation, in which case the natures of the relata will necessitate the relation. I then distinguish various ways (...) in which a bare particular might be thought to have a nature and show that on none of these is it possible for a bare particular to be a constituent of a complex particular. Thus, Moreland’s attempt to resurrect bare particulars as ontologically indispensable entities is not wholly without difficulties. (shrink)

Clouser and Gert’s 'A Critique of Principlism’ (1990) has ignited debate over the adequacy of substituting principlism for moral theory as a means for dealing with biomedical dilemmas. Clouser and Gert argue that this sort of substitution is not adequate to the task. I examine their argument in light of recent defences of principlism on this score, those of B. Andrew Lustig (1992), David Degrazia (1992), and Beauchamp and Childress (1994). I argue that both sides in the debate have assumed (...) differing conceptions of a moral theory that virtually guarantee their respective conclusions. These differing conceptions are motivated by antecedent epistemological commitments. The present debate over principlism is therefore inconclusive. Future discussion should focus on the underlying epistemological issues. (shrink)

I argue that Graham Oppy’s attempt to redefend his charge that all modal theistic arguments “must be question-begging” is unsuccessful. Oppy’s attempt to show that theism and modal concretism are compatible is not only tangential for his purposes, it is marred by a misunderstanding of theism, and vulnerable to a counterexample that actually demonstrates incompatibility. Moreover, the notion of begging the question employed by Oppy against the theist is seen to be far too permissive.

In this paper I shall argue two things. First, it is plausible to think that Conceptualism holds with respect to propositions; in any event, it does a much better job than its closest competitors (Platonism and Nominalism) in accounting for the truthbearing nature of propositions. Secondly, it is wholly implausible (so I say) to take the added step and equate properties and relations with divine concepts. Here I offer additional reasons, beyond “divine bootstrapping,” for theists to resist this tempting reduction. (...) Thus, a limited Conceptualism emerges as the most natural and defensible way for a theist to think about God’s relation to abstract objects. (shrink)

Descartes is often regarded as the founder of modern philosophy, and is credited with placing at centre stage the question of what we know and how we know it. Descartes: Belief, Scepticism and Virtue seeks to reinsert his work and thought in its contemporary ethical and theological context. Richard Davies explores the much neglected notion of intellectual virtue as it applies to Descartes' inquiry as a whole. He examines the textual dynamics of Descartes' most famous writings in relation to (...) background debates about human endeavour from Plato down to Descartes' own contemporaries. Bringing these materials together in a novel format, Davies argues for a new approach to Descartes' ideas of scepticism and the sciences. In a recent series of articles, J. P. Moreland has attempted to revive the idea that bare particulars are indispensable for individuating concrete particulars. The success of the project turns on Moreland's proposal that while bare particulars are indeed 'partially clad'--that is, exemplify at least some properties--they are nevertheless 'bare' in that they lack internal constituents. I argue that 'partially clad' bare particulars (PCBPs) are impervious not only to traditional objections, but also those recently urged in this journal by D. (...) W. Mertz. The real problem with Moreland's view, I contend, is that together with his containment model of predication, it leads to the unwanted conclusion that PCBPs actually contain themselves as constituents, thereby ensnaring them in a vicious (individuative) circularity. There remains a concern in philosophy of education circles to assert that teaching is a social practice. Its initiation occurs in a conversation between Alasdair MacIntyre and Joe Dunne which inspired a Special Issue of the Journal of Philosophy of Education. This has been recently utilised in a further Special Issue by Chris Higgins. In this article I consider two points of conflict between MacIntyre and Dunne and seek to resolve both with a more nuanced understanding of the implications of (...) applying the concept ‘social practice’ to teaching. I critique both Dunne's and Higgins' focus on schools and school teaching. It is their focus on school teaching, rather than a broader account of teaching, that leads them astray. The result is that Dunne and Higgins have not shown that teaching is a social practice. School teaching is not a complex activity, but a complex set of different activities co-located in one place and engaged in by the same agents. In a final section I offer an account of ‘school teaching’ as a multi-practice activity which is consistent with MacIntyre's approach, and argue that schoolteachers have both an institutional and an educative role. Initially introduced to the philosophical world as elusive, we-know-notwhats—substrata underlying the properties had or exemplified by things, but themselves bereft of properties—bare particulars have been dismissed as undetectable, unnecessary, and even incoherent. Hardly a warm welcome. It appears, however, that times are changing. In a recent series of articles, for example, J. P. Moreland has argued that “bare particulars are crucial entities in any adequate overall theory of individuation”;’ that is, concrete particulars cannot be individuated without them. In the same (...) vein, Oaklander and Rothstein,2 drawing upon elements of Moreland’s new theory, have defended bare particulars against Loux’s grounding objection’—that if the theory is correct, bare particulars are qualitatively indiscernible; in which case we either have no basis for saying that they arc numerically diverse, or we must introduce lower-level substrata to ground that diversity, thereby raising the spectre of an infinite regress of individuators. A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. In a recent article in this journal, J. P. Moreland extends his theory of individuation to include universals. In this note, I show how Moreland’s novel proposal leads to the unwanted conclusion that every concrete particular exists of necessity and has but a single essential property.

In this paper we respond to three objections raised by Joshua Harris to our article, “Against a Postmodern Pentecostal Epistemology,” in which we express misgivings about the conjunction of Pentecostalism with James K. A. Smith’s postmodern, story-based epistemolo- gy. According to Harris, our critique: 1) problematically assumes a correspondence theory of truth, 2) invalidly concludes that “Derrida’s Axiom” conflicts with “Peter’s Axiom,” and 3) fails to consider an alternative account of the universality of Christian truth claims. We argue that Harris’s (...) objections either demonstrate a deficient interpretation of the relevant biblical pas- sages or are not directed at us at all. (shrink)

This anthology translates eighteen papers by Italian philosopher and experimental psychologist Paolo Bozzi, bringing his distinctive and influential ideas to an English-speaking audience for the first time. The papers cover a range of methodological and experimental questions concerning the phenomenology of perception and their theoretical implications, with each one followed by commentary from leading international experts. In his laboratory work, Bozzi investigated visual and auditory perception, such as our responses to pendular motion and bodies in freefall, afterimages, transparency effects, and (...) grouping effects in dot lattices and among sounds. Reflecting on the results of his enquiries against the background of traditional approaches to experimentation in these fields, Bozzi took a unique realist stance that challenges accepted approaches to perception, arguing that experimental phenomenology is neither a science of the perceptual process nor a science of the appearances; it is a science of how things are. In light of recent developments in argumentation theory, we begin by considering the account that Aristotle gives of what he calls sophistical refutations and of the usefulness of being able to recognise various species of them. His diagnosis of one of his examples of the grouping that he labels epomenon is then compared with a very recent account of the matter, which, like Aristotle, calls on us to attribute a mistake or confusion to anyone who uses this kind of argument. From examination of three other examples that Aristotle himself supplies of epomenon, it appears that there are cases of inferences of this kind that we need not, and perhaps cannot, avoid making. The suggestion is made that this is because the whole family of what Peirce calls abductions have important characteristics in common with epomenon. (shrink)

Youth work is deemed to require a distinctive commitment to ethical behaviour from the adults involved. This is expressed in the requirements for the initial education of workers, in the subject benchmarks and national expectations for youth workers. A significant influence in this debate is Howard Sercombe. Sercombe seeks a substantive framework for youth work ethics. The project offers clear potential benefits alongside equally great dangers. His platform is an integration of two foundations: a particular definition of youth work and (...) a particular account of what it means to be ‘a profession’. I argue that both foundations are flawed, and potentially harmful to practice and policy. At the heart of Sercombe’s account, however, is a focus on youth work as based on a ‘covenantal relation of trust between youth workers and young people’. This insight, submerged and marginalised, does offer a substantive foundation for youth work ethics. (shrink)

In this paper, we attempt to show that if Plantinga’s free will defence succeeds, his O Felix Culpa theodicy fails. For if every creaturely essence suffers from transworld depravity, then given that Jesus has a creaturely essence (as we attempt to show), it follows that Incarnation and Atonement worlds cannot be actualized by God, in which case we have anything but a felix culpa.

C. Stephen Layman contends that an argument supporting theism over naturalism can be constructed based on three defensible, non–question-begging premises about the moral order. Previous critics of Layman’s argument have challenged the truth of these premises. We stipulate them arguendo but go on to show that there is a deeper problem: a fourth premise introduced to complete the argument—the “completion premise,” as we call it—is true only if we assume that God exists or we concede that there is no afterlife.
