This article suggests that Tagore’s conception of cosmopolitan education can provide the basis for advancing matters of global social justice, when considering the problem posed by Nancy Fraser in her essay ‘Reframing Justice in a Globalizing World’: ‘How can we integrate struggles against maldistribution, misrecognition and misrepresentation within a post-Westphalian frame?’. To this end, the article briefly reflects on the perspective of cosmopolitanism, setting the scene for an exploration of Tagore’s distinctive cosmopolitan educational philosophy. The article develops the argument (...) that framing pedagogy centred on Tagore’s principles of cosmopolitan education to produce cosmopolitan-minded citizens can help bring about social, political, and economic change at local, national, and international level, in order to integrate the three-dimensional struggle for social justice outlined by Fraser. As societal demands to become more human, not less, are growing globally, the case to understand the relevance of humanistic leadership approaches such as values-based leadership (VBL) becomes urgent. While multiple leadership theories offer useful perspectives to inform VBL practice, empirical works - especially those focusing on studying its relevance from a cross-national perspective are significantly lacking. Additionally, little is known about the application of VBL in different work domains. This international study addresses these gaps by reporting on (...) survey research from four different countries and six work domains. Specifically, this paper discusses a multi-country study about the relevance of VBL to the political, non-profit, public, private, religious, and community work domains. In general, our findings suggest that VBL is seen as relevant to highly relevant across the focal countries and six work domains. We also discuss some of the key similarities and differences in how respondents rated the relevance of VBL in different contexts. We conclude that VBL potentially offers a timely and robust vehicle to address some of the urgent aspirations that employees and practitioners are expressing globally. (shrink)

Este artigo tem como objetivo central analisar a necessidade de repensar o Direito e, em particular, o Constitucionalismo, devido às constantes transformações sociais e à crescente complexidade das relações interconectadas na sociedade global. Inicialmente, aborda-se o Direito Constitucional como uma teoria do conhecimento, explorando as três matrizes epistemológicas que permitem analisar o Constitucionalismo em diferentes contextos históricos. O problema central envolve a busca por uma teoria adequada para analisar e propor soluções para questões jurídicas globais, destacando a abordagem pragmática-sistêmica (...) baseada na Teoria dos Sistemas Sociais Autopoiéticos de Niklas Luhmann. Com ênfase nessa matriz epistemológica, o artigo explora a Teoria dos Sistemas Sociais de Luhmann, bem como diferentes abordagens para a Autopoiese e a terceira fase do constitucionalismo, o Constitucionalismo Social, com foco nos Fragmentos Constitucionais, teoria desenvolvida por Gunther Teubner. A justificativa para essa análise baseia-se na adequação da Teoria dos Sistemas Sociais em um contexto pós-moderno, onde problemas e respostas jurídicas transcendem fronteiras nacionais. O artigo adota uma metodologia sistêmico-construtivista com base nos pressupostos da sociologia de Luhmann e utiliza abordagens monográficas e técnicas bibliográficas para explorar abordagens contemporâneas em Direito Constitucional. Conclui-se que, diante dos desafios jurídicos globais, o Constitucionalismo tradicional limitado aos Estados Nacionais é insuficiente, e a Teoria dos Sistemas Sociais Autopoiéticos de Niklas Luhmann oferece uma abordagem adequada para lidar com a crescente complexidade. Moral foundations theory (MFT) proposes the existence of innate psychological systems, which would have been subjected to selective forces over the course of evolution. One approach for evaluating MFT, therefore, is to consider the proposed psychological foundations in relation to the reconstructed Environment of Evolutionary Adaptedness. This study draws upon ethnographic data on nomadic forager societies to evaluate MFT. Moral foundations theory receives support only regarding the Caring/harm and Fairness/cheating foundations but not regarding the proposed Loyalty/betrayal and Authority/subversion foundations. These (...) latter two proposed foundations would seem to reflect the historical classic assumptions of modernity, involving self-interest, competition, individualism, hierarchy, authority and so forth. Studying the ethical dimensions of nomadic forager societies can highlight our biases about the foundations of morality, some of which may be steeped in particularist Western political and social traditions. Some recent developments from cosmopolitanism are discussed as an alternative evolving worldview that parallels nomadic forager ethos. (shrink)

Jacques Ellul’s book, The Meaning of the City, widely recognized as one of the most important twentieth century theological reflections on the city, was also one of his most controversial scholarly contributions. Many urbanists interpreted the book as demeaning the city and diminishing the importance of urban policy, planning, design, architecture, and activism at a time when cities around the world had experience profound crises. This article reexamines The Meaning of the City and its relevance to twenty-first century urbanism.

Work on global ethics looks at ethical connections on a global scale. It should link closely to environmental ethics, recognizing that we live in unified social-ecological systems, and to development ethics, attending systematically to the lives and interests of contemporary and future poor, marginal and vulnerable persons and groups within these systems and to the effects on them of forces around the globe. Fulfilling these tasks requires awareness of work outside academic ethics alone, in other disciplines and across (...) disciplines, in public debates and private agendas. A relevant ethics enterprise must engage in systematic description and understanding of the ethical stances that are expressed or hidden in the work of influential stakeholders and analysts, and seek to influence and participate, indeed embed itself, in the expressed and hidden choice-making involved in designing and conducting scientific research and in policy analysis and preparation; it will contribute in value-critical and interpretive policy analysis. It will explore how the allocation of attention and of concern in research and policy depend on perceptions of identity and of degrees of interconnection, and are influenced by the choice or avoidance of humanistic interpretive methodologies. The global method safety account of knowledge states that an agent’s true belief that p is safe and qualifies as knowledge if and only if it is formed by method M, such that her beliefs in p and her beliefs in relevantly similar propositions formed by M in all nearby worlds are true. This paper argues that global method safety is too restrictive. First, the agent may not know relevantly similar propositions via M because the belief that p (...) is the only possible outcome of M. Second, there are cases where there is a fine-grained belief that is unsafe and a relevantly similar coarse-grained belief that is safe and where both beliefs are based on the same method M. Third, the reliability of conditional reasoning, a basic belief-forming method, seems to be sensitive to fine-grained contents, as suggested by the wide variation in success rates for thematic versions of the Wason selection task. In this article I argue the relevance of natural law for framing and addressing ethical issues raised by the practice of business in a global context. There are historical, as well as systematic reasons for this. On the historical side, it can be argued that the origin of modern economics is linked to a cultural context, still influenced by modern natural law theories. Thus, even if Hume’s moral theory is everything but a natural law theory, either in the (...) traditional or the modern sense, his “laws of nature” (fixation of property, rules for its transference, and promises) represent a systematization of the rules of justice necessary to preserve the space of economic freedom required for development of a commercial society. This systematization is in line with the classical approach to natural law, which nevertheless presents further advantages for developing an ethical approach to economic activity, since it brings with itself a conception of economic agency richer than that of Hume: a conception that is not necessarily linked to pursuit self-interest, but rather is inspired by ethical motives right from the start. Indeed, on the systematic side, the classical natural law is seen as the law of practical reason: a set of principles in charge of inspiring both virtuous action and legal practice, so that we can realize the human good. Assuming the embodied and social nature of human beings, as well as the various cultural realizations of humanity, a natural law approach to ethics is in a position to stimulate a dynamic and bottomup articulation of the personal and common good, concern for progress and sustainable development, universal principles and cultural variations. Traditional Chinese philosophy, if engaged at all, is often regarded as an object of antiquated curiosity and dismissed as unimportant in the current age of globalization. Why does trust collapse in times of crisis? And when, instead, does it become a driver of growth, generating value? This book offers an analysis of the dynamics of trust through a sociological interpretation of the thought of John Maynard Keynes, the first economist to understand the full extent of the confidence-lever. This article takes the critique by Sethi and Schepers as a starting point for discussing the United Nations Global Compact. While acknowledging the relevance of some of their arguments, we emphasize that a number of their claims remain arguable and are partly misleading. We start by discussing the limits of their proposed framework to classify voluntary initiatives for corporate sustainability and responsibility. Next, we show how a greater appreciation of the historical and political context of the UN (...) class='Hi'>Global Compact puts several of their claims into perspective. Finally, we demonstrate that the alleged promise–performance gap rests on a selected and one-sided reading of the initiative. Abstract: In this essay a set of principles is defended that yields a determinate allocation of sovereign competences across a global system of territorially nested jurisdictions. All local sovereign competences are constrained by a universal, justiciable human rights regime that also incorporates a conception of cross-border distributive justice and regulates the competence to control immigration for a given territory. Subject to human rights constraints, sovereign competences are allocated according to a conception of global democracy. The proposed allocation scheme (...) can accommodate substantial local autonomy while at the same time ensuring that everyone has a voice in the political decisions that affect his or her interests. The relevant class of affected interests is fully specified. Relevant affects are of two kinds: those that impose norms of governance on individuals, and those that impose external costs on them. While methodological and metatheoretical questions pertaining to feasibility have been intensively discussed in the philosophical literature on feasibility and justice in recent years, these discussions have not permeated the debate on global democracy. The overall aim in this paper is to demonstrate the fruitfulness of importing some of the advancements made in this literature into the debate on global democracy as well as to develop aspects that are relevant for explaining the role of feasibility in normative political theory. First, to advance the work on the role of feasibility, we suggest two metatheoretical constraints on normative political theorizing as intuitively plausible – the ‘fitness constraint’ and the ‘functional constraint’ – which elucidate a number of aspects relevant for determining proper feasibility constraints of an account in political theory. Second, to illustrate the usefulness of this feasibility framework, we sketch an account of global democracy consisting of normative principles which respond differently to these aspects and thus are tied to different feasibility constraints as well as exemplify how it may be applied in practice. In his prophetic book Amythia, Loyal Rue calls for the construction of bold new myths. Responding to his call in light of scientific arguments for global population equilibrium, this article proposes a model that may function as a surrogate form of myth, one that can motivate our age and future ages. Fortunately, the model is not only powerful but achievable, because policy makers have finally begun to realize how thoroughly the human population impacts on other world dynamics. Above all, an effort is made to show how global equilibrium can support Rue's twin requirements for the myth he commissions: namely, a foundation in plausible descriptions of reality, and a compelling normative status. The existence and importance of supervenience principles for identity across times and worlds have been noted, but insufficient attention has been paid to their precise nature. Such attention is repaid with philosophical dividends. The issues in the formulation of the supervenience principles are two. The first involves the relevant variety of supervenience: that variety is global, but there are in fact two versions of global supervenience that must be distinguished. The second involves the subject matter: the names “identity (...) over time” and “identity across worlds” are misnomers, for in neither case is identity at issue. The philosophical dividends then follow. Nathan Salmon’s argument that identity over time needs no “grounds” in matters of qualitative fact can be answered, as can an argument offered by many, that coincident objects would require objectionably ungrounded differences in identities across times and worlds. The prospect of climate change due to human activities has put the question of inter- and intragenerational justice or equity in matters of common concern on the global agenda. This article will focus on the question of intragenerational justice in relation to these issues. This involves three basic questions. Firstly, the question of which distributive criteria may be relevant in the distribution of the goods and bads related to the increasing greenhouse effect. A series of criteria are discussed in (...) relation to different understandings of the problem. The second question is which kind of relationship the global partnership is or should be considered to be in issues of common concern. It is argued that various understandings of the global partnership can be expected to result in the use of different criteria. This diversity leads us to the third question concerning the possibility of identifying an overall social ideal which can be used in cases where several different criteria may be useful. I shall discuss one such ideal in particular, namely the ideal of complex equality. In the concluding remarks it is argued that a distribution of emission quotas to countries in accordance with population size is a reasonable starting point for an equitable solution, although it involves various problems of application. Development economists have suggested that the hopes of the poor are a relevant factor in overcoming poverty. I argue that Kant’s approach to hope provides an important complement to the economists’ perspective. A Kantian account of hope emphasizes the need for the rationality of hope and thereby guards against problematic aspects of the economists’ discourse on hope. Section 1 introduces recent work on hope in development economics. Section 2 clarifies Kant’s question “What may I hope?” and presents the outlines of (...) his answer. Crucially, hope is rational if it is rational to trust in the structures of reality on which the realization of one’s hope depends. Section 3 argues that central tenets of Kant’s account of what makes hope rational can be applied to the context of poverty. It becomes apparent that the poor often have good reason to be hopeless since they may not trust fundamental structures that are necessary for realizing their hope. Thus, the insight that the poor need more hope must go hand in hand with a commitment to establishing trustworthy political structures, such that their hope can be rational. Section 4 highlights the relevance of the secular highest good for a better understanding of the justification and scope of our duties to the poor in a Kantian framework. (shrink)

Analysing the demands of global justice for the distribution of resources is a complex task and requires consideration of a broad range of issues. Of particular relevance is the effect that different distributions will have on global population growth and individual welfare. Since changes in the consumption and distribution of resources can have major effects on the welfare of the global population, and the rate at which it increases, it is important to establish meaningful principles to (...) ensure a just distribution of resources. In order to establish such principles we must consider the scope of any reproductive rights, and rights to other goods, such as food and health care, as well as examine the extent of duties correlating to those rights. Kleinberg (1999) describes a novel procedure for efficient search in a dense hyper-linked environment, such as the world wide web. The procedure exploits information implicit in the links between pages so as to identify patterns of connectivity indicative of “authorative sources”. At a more general level, the trick is to use this second-order link-structure information to rapidly and cheaply identify the knowledge- structures most likely to be relevant given a specific input. I shall argue that Kleinberg’s procedure is suggestive of (...) a new, viable, and neuroscientifically plausible solution to at least (one incarnation of) the so-called “Frame Problem” in cognitive science viz the problem of explaining global abductive inference. Since at least the late nineteenth century, a world-level moral culture has developed, providing a space for certain persons to be presented as global moral icons. This global moral space was already pointed to by Kant as an emergent form, and was later theorized by Durkheim. This article shows that an important institutionalization of global moral culture involved the founding of the Nobel Prizes, the subsequent mutations of which were also important in the constitution of that culture. These, and other awards which imitated them, are performative in a profound sense: they simultaneously reflect and help bring into being a planet-spanning culture which demands moral icons which both exemplify and partly constitute it. How the Nobel Prizes and their imitators work to create moral iconicity that is globally relevant is explored. The case of Gandhi is taken as an example of how, despite not being awarded a Nobel Prize, some moral icons are also brought into being through symbolic contact with other such icons, including Nobel Prize winners. The article considers the lingering, powerful, but generally invisible, influence today on world moral culture of the innovations pursued by the early Nobel Prize committees. (shrink)

This paper investigates how and when pairs of terms such as “local–global” and “im Kleinen–im Grossen” began to be used by mathematicians as explicit reflexive categories. A first phase of automatic search led to the delineation of the relevant corpus, and to the identification of the period from 1898 to 1918 as that of emergence. The emergence appears to have been, from the very start, both transdisciplinary (function theory, calculus of variations, differential geometry) and international, although the AMS-Göttingen connection (...) played a specific part. First used as an expository and didactic tool (e.g. by Osgood), it soon played a crucial part in the creation of new mathematical concepts (e.g. in Hahn’s work), in the shaping of research agendas (e.g. Blaschke’s global differential geometry), and in Weyl’s axiomatic foundation of the manifold concept. We finally turn to France, where in the 1910s, in the wake of Poincaré’s work, Hadamard began to promote a research agenda in terms of “passage du local au general.”. (shrink)

Clinical legal education is playing an increasingly important role in educating lawyers worldwide. In The Global Clinical Movement: Educating Lawyers for Social Justice, editor Frank S. Bloch and contributors describe the central concepts, goals, and methods of clinical legal education from a global perspective, with a particular emphasis on its social justice mission. With chapters written by leading clinical legal educators from every region of the world, The Global Clinical Movement demonstrates how the emerging global clinical (...) movement can advance social justice through legal education. Professor Bloch and the contributors also examine the influence of clinical legal education on the legal academy and the legal profession and chart the global clinical movement's future role in educating lawyers for social justice. The Global Clinical Movement consists of three parts. Part I describes clinical legal education programs from every region of the world and discusses those qualities that are unique to a particular country or region. Part II discusses the various ways that clinical programs and the clinical methodology advance the cause of social justice around the world. Sometimes we must choose between competing claims to aid or assistance, and sometimes those competing claims differ in strength and quantity. In such cases, we must decide whether the claims on each opposing side can be aggregated. Relevance views argue that a set of claims can be aggregated only if they are sufficiently strong (compared to the claims with which they compete) to be morally relevant to the decision. Relevance views come in two flavours: Local Relevance and (...) Global Relevance. This paper presents a trilemma for both. Namely, that neither view can capture our intuition in tie-break cases, without forfeiting our intuitions in other important cases. The paper then presents a way to salvage relevance views and capture all our intuitions using a Hybrid view. By distinguishing between two types of relevance we can combine the strengths of Local and Global Relevance views such that we can hold all our intuitions, consistently and in a non-ad-hoc manner. Building on this, the paper demonstrates how we might amend the strongest formulation of a Relevance view, into a Hybrid account. The main focus of this paper is to develop a relevance view that can capture all the intuitions we have; however deeper justifications will still be needed for a full account of any relevance view. Thus, the end of the paper briefly considers what deeper justification might support the Hybrid view, indicating the direction such literature might go. This paper offers a brand storytelling, that is a narratological account of Covid-19 pandemic’s emergence phase. By adopting a fictional ontological standpoint, the virus’ deploying media story-world is identified with a process of narrative spacing. Subsequently, the brand’s personality is analyzed as a narrative place brand. The narrative model that is put forward aims at outlining the main episodes that make up the virus’ brand personality as process and structural components (actors, settings, actions, relationships). A series of deep or ontological (...) metaphors are singled out as the core DNA of this place brand, by applying metaphorical modeling to the tropical articulation of Covid-19’s narrative. The virus’ kernel is identified with terror, as a menacing force that wipes out existing regimes of signification due to its uncertain motives, origins and operational mode. In this context, familiar urban spaces, cultural practices and intersubjective communications are redefined, repurposed and reprogrammed. This process is called terrorealization, as the desertification and metaphorical sublation of all prior territorial significations. This study contributes to the narrative sub-stream of place branding by approaching a globally relevant sociocultural phenomenon from a brand storytelling perspective. (shrink)

The Database on Ethics Related Legislation and Guidelines was launched in March 2007 as the fourth database of the UNESCO Global Ethics Observatory system of databases in ethics of science and technology. The database offers a collection of legal instruments searchable by region, country, bioethical themes, legal categories and applicability to specific articles of the UNESCO Universal Declaration on Bioethics and Human Rights and International Declaration on Human Genetic Data. This paper discusses the background and rationale for the database (...) and its role as a consultative and comparative resource hub for the study of ethics related legal instruments across the world, with the purpose of informing and inspiring relevant stakeholders on the implementation of the principles contained within the UNESCO declarations on bioethics. The legal regime regulating cross-border investment gives key rights to foreign investors and places significant duties on states hosting that investment. It also raises distinctive moral questions due to its potential to constrain a state’s ability to manage its economy and protect its people. Yet international investment law remains virtually untouched as a subject of philosophical inquiry. The questions of international political morality surrounding investment rules can be mapped through the lens of two critiques of the law – that it (...) systemically takes advantage of the global South and that it constrains the policy choices of states hosting investment. Each critique contains certain moral and empirical assumptions that deserve further attention. The distributive justice implications of international investment rules are also relevant to scholars of global distributive justice. The aim of the analysis is to develop an interdisciplinary agenda – among law, philosophy, and social science – for inquiry into the justice of investment law and reform of its unjust elements. Sovereign Wealth Funds have attracted significant attention over the past few years, as a result of their increasing role in the global economy and their controversial minority investments in distressed financial and infrastructure companies in Western economies. Although SWFs provide important benefits to home, host and global markets, they have been perceived by the Western mind as a growing threat to economic supremacy and national security. While the current legal scholarship provides an incomplete policy response, by either selectively (...) referring to specific legal instruments within the international law framework or proposing an entirely new legal regime, this Article attempts to address this crucial lacuna by providing an original and comprehensive legal analysis of the SWF phenomenon and its interaction with the preexisting framework of international law. The various abovementioned concerns have prompted various Western attempts to block SWF cross-border investments through legislative reforms or ad hoc protectionism of the executive branch. These governmental policies frequently violate international commitments in the international economic law arena and call for a closer look at the nature of such commitments and their respective implementation in the SWF environment. The Article looks at recent practices in Western countries aimed at blocking SWF investments, especially in the context of iconic brands and national champions. It then reviews various relevant provisions in international legal instruments, which are applicable to these potential investments, and examines the question of their violation by capital-importing countries. A proposed innovative adaptation to this new reality is provided. I argue that the existing framework of international investment law can provide adequate solutions to investment protectionism against SWFs. Regarding regulation of SWFs’ investments, since recent experience has underlined that SWFs function largely like any other commercial entities, there is a need to shift the discussion and terminology towards regulation of sovereign activity rather than sovereign funds. Finally, the Article explores the broad consequences of investment law and corporate governance reforms following the debate around SWF investments on maintaining healthy and productive cross-border economic relations in a globalized world. The article discusses the role of the UN Global Compact in the emerging global corporate social responsibility infrastructure. It evaluates the debate around the effectiveness and legitimacy of the UNGC alongside the arguments of its supporters and critics and thereby introduces the Thematic Symposium contributions. The article further identifies three theoretical perspectives that are used by scholars to discuss the performance of the UNGC: economic, socio-historical, and normative. It proposes that these perspectives can serve as generic distinctions with (...) direct relevance for the evaluation of the UNGC. Once the perspective is chosen, it drives towards a certain purpose which implies assumptions and design features with regard to the UNGC. Finally, the article offers a future research agenda, emphasising the research needed on the UNGC in four areas: the identification of processes and influence mechanisms; legitimacy and effectiveness; local networks and regional development; and the interface of the UNGC and responsible leadership. The science underlying global warming, climate change, and the connections between these phenomena are reviewed. Projected future climate changes under various plausible scenarios of future human behavior are explored, as are the potential impacts of projected climate changes on society, ecosystems, and our environment. The economic, security, and ethical considerations relevant to determining the threat posed by climate change are subsequently assessed. The article then discusses the various means available for climate change mitigation, focusing on the relative strengths and (...) weaknesses of various societal alternatives including ‘geoengineering’ and transitioning to less carbon intensive energy sources. The article concludes with the author's views as to what steps might most profitably be taken to avert dangerous anthropogenic interference with Earth's climate, and the ramifications if such steps are not taken. ABSTRACT:This article assesses the proliferation of international accountability standards (IAS) in the recent past. We provide a comprehensive overview about the different types of standards and discuss their role as part of a new institutional infrastructure for corporate responsibility. Based on this, it is argued that IAS can advance corporate responsibility on a global level because they contribute to the closure of some omnipresent governance gaps. IAS also improve the preparedness of an organization to give an explanation and a (...) justification to relevant stakeholders for its judgments, intentions, acts and omissions when appropriately called upon to do so. However, IAS also face a variety of problems impeding their potential to help address social and environmental issues. The contribution of the four articles in this special section is discussed in the context of standards’ problems and opportunities. The article closes by outlining a research agenda to further develop and extend the scholarly debate around IAS. (shrink)
