This is a lucid and comprehensive introduction to, and critical assessment of, Ronald Dworkin's seminal contributions to legal and political philosophy. His theories have a complexity, originality, and moral power that have excited a wide range of academic and political thinkers, and even those who disagree with him acknowledge that his ideas must be confronted and given serious consideration. His enormous output of books and papers and his formidable profusion of lectures and seminars throughout the world, in addition to his (...) teaching duties at Oxford and New York University, have made him a giant figure in contemporary thought. In short, Dworkin's theory of law is that the nature of legal argument lies in the best moral interpretation of existing social practices. His theory of Justice is that all political judgements ought to rest ultimately upon the injunction that people are equal as human beings, irrespective of the circumstances in which they are born. Dworkin does not fit into an orthodox category. his theory of law is radical in that it sees legal argument primarily about rights yet conservative in seeing it as constrained by history. He is libertarian both in valuing ambition and in asserting a right to pornography, yet socialist in believing that no person has a right to a greater share of resources than anyone else. in particular, he advocates a system that would tax people on the resources they accumulate solely through their talent alone. Because Dworkin writes for a number of audiences - sometimes the general public, sometimes academic lawyers, sometimes philosophers and economists - it is often difficult to identify the different strands of his thought. The book aims to make his theories clear and accessible and to give an overall picture of his thinking that is sympathetic yet rigorously argued. (shrink)

In "Justice for Hedgehogs," Ronald Dworkin boldly affirms the independence of arguments of value, arguments that remain securely within their own domain. Mostly, but not at all exclusively, he is concerned with moral value.

These excellent volumes show both the strengths and weaknesses of contemporary and serious Dworkin scholarship . Mostly the articles are new, although Susan Hurley's paper in the Hershowitz volume was first published in 1990. As to be expected with work on Dworkin, the division between political and legal theory is not distinct because – as is well-known – he integrates moral problems of politics both into the choice of legal theory and legal argument itself. But, some issues may be separated (...) and since there are excellent essays on both equality of resources and the relevance of ‘intrinsic’ values, I have separated my discussion into the two heads of ‘legal theory’ and ‘political theory’. Work on his political theory is not as advanced as it is on his legal theory and so I have largely directed my attention to the latter. I conclude that the most profitable work with Dworkin's legal theory lies in exploring the idea of the ‘interpretive concept’ and its connection with moral ideals, and in assessing the moral weight of integrity, particularly against the ideals of justice and fairness. Almost all the essays on legal theory show awareness of difficulties concerning these two issues although no one takes on interpretivism directly . However, Stephen Perry and Dale Smith in the Hershowitz volume and Sanford Levinson in the Ripstein volume push the boundaries some way with integrity. (shrink)

The past decade has seen a vigorous discussion of human rights both within China and between China and other nations. It is easy to think of China as a latecomer to human rights discourse, in part because during most of the post-1949 period, rights and human rights were taboo subjects in the People's Republic. In fact, however, there was a rich and contested debate on rights throughout the first half of this century. By translating the most important pre-1949 essays on (...) rights and human rights, we aim to reintroduce themes from this forgotten discourse into contemporary debates. These essays show that the discussion of rights in China has long been motivated by indigenous concerns, rather than imposed from without, and it has been interpretive and critical, rather than passive and imitative. Parapsychologists have never been entirely satisfied with their technical vo- cabulary, and occasionally their discontent leads to attempts at terminological reform.1 Recently, a number of prominent parapsychologists, led by Ed May, have regularly abandoned some of parapsychology’s traditional and central categories in favor of some novel alternatives (see, e.g., May, Utts, and Spot- tiswoode, 1995a, 1995b; May, Spottiswood, Utts, and James, 1995). They rec- ommend replacing the term ª ESPº with ª anomalous cognitionº (or AC) and ª psychokinesis (PK)º with (...) ª anomalous perturbationº (or AP). Advocates of these new terms also propose replacing the term ª psiº or ª psi phenomenaº with ª anomalous mental phenomena.º Superf icially at least, these proposals seem merely to be modest extensions of parapsychology’s increasingly fre- quent use of the term ª anomalousº as a substitute for ª paranormal,º a practice which (although controversial) is not without merit, and which Palmer has vigorously defended (1986, 1987, 1992). But in my view, the proposed new terminology creates more problems than it solves. (shrink)

In Human Presence Erickson offers a thoughtful study of some fundamental features of human nature central to a theoretical and therapeutic understanding of human existence. Though the language employed is largely philosophical, interfaces with psychoanalysis and religion are made in order to stimulate dialogue that reaches beyond the traditional boundaries of discipline. It is toward more such dialogue that Human Presence serves as preparation. The author provides a probing contrast between traditional psychoanalysis and existential conceptions of time consciousness and he (...) articulates the issues involved in experience or lived time in their centrality to human self-understanding. The author suggests how both conceptions, the existential and the psychoanalytic, enlarge yet limit awareness and insight. In a revealing way, Human Presence raises deep and unavoidable issues regarding the human in us all. Stephen A. It's probably no secret to readers of this Journal that working in areas of frontier science can very easily test one's character and bring out the best and worst of human behavior. I mention this now because a few months ago the journal Studies in History and Philosophy of the Biological and Biomedical Sciences published a significant new issue (Volume 48, Part A). It contains a lengthy special section on psychical research, guest-edited by Andreas Sommer. I'll probably comment again (...) about this journal issue in later Editorials, but this time I want to focus on the first paper to catch my attention. Not surprisingly, I suppose, it was written by a philosopher, Ian James Kidd from Durham University, and it boasted the intriguing title, "Was Sir William Crookes epistemically virtuous?" We wish to describe and acknowledge the exceptional contributions to medical ethics, both in the UK and internationally, made by Edward Shotter1 who died at home on 3 July 2019. He was founder of the London Medical Group2 3 and instigator of similar student-led medical ethics groups throughout the UK; founder of the Institute of Medical Ethics4 and founder of the Journal of Medical Ethics. Ted Shotter transformed the study of medical ethics in the UK in the interests of patients (...) and professionals alike. In 1963, he established the pioneering ‘Medical Group’ model, an innovative bottom-up method whereby students in the health professions could gain a grounding in ethics that had previously been denied to the profession.5 It was with these Medical Groups that many of the leading figures in contemporary UK medical ethics and law began their careers in the subject including Sir Kenneth Calman, Sir Ian Kennedy, Professor Margaret Brazier OBE, Professor John Harris and Professor Sir Jonathan Montgomery to name but …. Aboutness has been studied from any number of angles. Brentano made it the defining feature of the mental. Phenomenologists try to pin down the aboutness-features of particular mental states. Materialists sometimes claim to have grounded aboutness in natural regularities. Attempts have even been made, in library science and information theory, to operationalize the notion. But it has played no real role in philosophical semantics. This is surprising; sentences have aboutness-properties if anything does. Aboutness is the first book to examine through (...) a philosophical lens the role of subject matter in meaning. A long-standing tradition sees meaning as truth-conditions, to be specified by listing the scenarios in which a sentence is true. Nothing is said about the principle of selection--about what in a scenario gets it onto the list. Subject matter is the missing link here. A sentence is true because of how matters stand where its subject matter is concerned. Stephen Yablo maintains that this is not just a feature of subject matter, but its essence. One indicates what a sentence is about by mapping out logical space according to its changing ways of being true or false. The notion of content that results--directed content--is brought to bear on a range of philosophical topics, including ontology, verisimilitude, knowledge, loose talk, assertive content, and philosophical methodology. Written by one of today's leading philosophers, Aboutness represents a major advance in semantics and the philosophy of language. (shrink)

Stephen Toulmin argues that the potential for reason to improve our lives has been hampered by a serious imbalance in our pursuit of knowledge. The centuries-old dominance of rationality has diminished the value of reasonableness. Toulmin issues a powerful call to redress the balance between rationality and reasonableness.

A central theme throughout the impressive series of philosophical books and articles Stephen Toulmin has published since 1948 is the way in which assertions and opinions concerning all sorts of topics, brought up in everyday life or in academic research, can be rationally justified. Is there one universal system of norms, by which all sorts of arguments in all sorts of fields must be judged, or must each sort of argument be judged according to its own norms? In The (...) Uses of Argument Toulmin sets out his views on these questions for the first time. In spite of initial criticisms from logicians and fellow philosophers, The Uses of Argument has been an enduring source of inspiration and discussion to students of argumentation from all kinds of disciplinary background for more than forty years. The norms of simplicity, convenience, unfussiness, and self-control guide Diogenes the Cynic, Zeno of Citium, Chrysippus, Seneca, Musonius Rufus, Epictetus, and Marcus Aurelius in approaching food. These norms generate the precept that meat and dainties are luxuries, so Stoics should eschew them. Considerations of justice, environmental harm, anthropogenic global climate change, sustainability, food security, feminism, harm to animals, personal health, and public health lead contemporary Stoics to condemn the meat industrial complex, debunk carnism, and select low input, plant-based foods.

In trying to enhance, improve or perfect ourselves through technological intervention, we can risk the very idea of a practical identity and self-possession. In thinking of the enhancement, improvement or perfection of the body through technological interventions, we ought to acknowledge limits in our outlook at least as seriously as we enjoy the considerable advances offered by technology in general. In postulating the chance of enhancement, improvement and perfection it is important to think about the distinction between what we can (...) and what we ought to do. In terms of scientific advance, this is not necessarily reflected clearly – it is often the case that scientific advance per se is taken to be ‘‘progress.’’ Progress in scientific research isn’t an easy notion in itself. Human progress, in being highly open to nuance and value, draws upon evaluation across a range of validity spheres. In tying a too-uncomplicated notion of scientific progress to the issue of human progress, there is a risk that we evaluate too narrowly our chances and our options. (shrink)
