This article is one in a series that develops the concept of logomachy. Logomachy is a philosophy of semantics or sense that takes into consideration the thermodynamic status of things in the world (their quamity). In particular, this article, looks at Gilbert Simondon’s claim that the laws of thought (Identity, Contradiction and the Excluded Middle) do not hold once certain thermodynamic states such as metastability (in between stability and instability) are taken into account. This article formulates, through a method I (...) term transduction (the mutual development of concepts between domains), novel logical laws that fit more adequately the way things thermodynamically are in the world. To do this, the article turns to the presocratic philosopher Heraclitus to rethink the logos as a conflictual site of meaning where things, and their capacity to make-sense, is conditioned by energetic investment, where difference is the condition of sameness. This article argues that Walter Benjamin’s aesthetico-political philosophy cannot be understood without reconsidering Hamlet. It elucidates Benjamin’s Hamlet via his theory of Baroque “mourning” and its counter-measure, the “Saturnine Dialectic.” It likewise offers an analysis of the 1877 Herman Ulrici edition of Hamlet, the German edition Benjamin cites exclusively. This analysis reconciles the differences in the secondary literature regarding Benjamin’s Hamlet, expounding upon the edition’s singular use of the word “foreordination”. Finally, by rereading Benjamin’s Hamlet through Carl Schmitt’s Hamlet or (...) Hecuba, it argues that Fortinbras’s succession, effectuated by Hamlet’s dying voice, conditions the repetition of sovereignty in Hamlet, betraying the emergence of the new. Despite this betrayal, the revolutionary potential that is sunken into the content of Hamlet is disjunctively brought to the surface by examining the “dialectical image” of Laertes’s rebellion, rescuing what I term the revolutionary-new from the jaws of defeat. The conceptual gambit of this article is to propose that the notion of anti-entropy should be complemented by that of exergy investment or destruction, a term first proposed by Zoran Rant in 1956. It argues that one of Bernard Stiegler’s most important interventions into deconstruction is the thermodynamic reformulation of Derridean différance. I argue that we should view the idea of anti-entropy as likewise the displacement of entropy to an external system. With the notion of exergy, it becomes possible to (...) outline an economics of exergy expenditure and investment that considers this displacement. Having argued for the necessity of exergy as a concept that may complement anti-entropy, I demonstrate that this economy of exergy expenditure, through transductive analogy, can be applied to signification. An economics of exergy may give crucial insight into the transcendental problem of signification; that which Derrida’s notion of différance first responded to. I ask the question: can a trace-like logic of sense be understood energetically if trace itself is understood to be materially inscribed into the world? Having explored this question, I then outline how education might be understood as both the means through with traditional significations are energetically maintained as well as the means through which metastable significations can be disrupted. I use the recent banning of anti-capitalist literature in the UK as an example of what I call logomachics, a conflict of significative exergetic investment and disinvestment. (shrink)

This article begins by arguing that the ‘madness’ of Antonin Artaud is either fetishised or resisted, depending on the disciplinary angle from which one works. It proposes an alternative approach to the study of Artaud, which might avoid such pitfalls by reading Artaud’s work as performative philosophy or a philosophy of performance. The approach is defined by the principle of ‘working with’, rather than working on, a literary or philosophical figure. The second part of the article works, or philosophises, with (...) Artaud, reading his work on the ‘Theatre of Cruelty’ alongside Immanuel Kant’s work on judgment from the third Critique. It explores the Kantian distinction between determining and reflective judgment, extending reflective judgment into what I call anarchic reflection. To do so, the article elucidates the conceptual relation between actuality, entropy, an-archy, cruelty and sublimity, defining anarchic reflection as an unintentional and/or intentional crisis of the judgment or krisis of Form that opens the possibility of its transformation. This article asks what an adequate philosophical response to the certainty of heat death would be: the moment in the timeline of the universe when all possible energy transformations have been actualized and life, thought, and action cease to be possible. Through a reading of Hans Jonas’s existential work on Gnosticism, the article begins by defining what is meant by the notions cosmotheoretical and cosmoethical as well as offering a description of what Jonas calls “cosmic nihilism.” After this, the article (...) looks at two extreme philosophical responses to heat death. The first response examined is by Friedrich Nietzsche, whose eternal return is shown to be a reactive philosophical response to the linear entropic finitude that heat death implies. The second response is by Ray Brassier. Different from Nietzsche, Brassier is shown to affirm the extinction that heat death promises. However, his insistence that heat death partakes of the transcendental and the real, but not the ideal, is demonstrated to be amphibolous. In the final part of the article, I offer what could be called a thermodynamic architectonic response to the heat death of the universe, arguing that heat death should be understood as a guiding transcendental Idea in the Kantian sense of the term. In a recent critique of informed consent, Robert Veatch argues that the practice is in principle unable to attain the goals for which it was developed. We argue that Veatch's focus on the theoretical impossibility of determining patients' best interests is misapplied to the practical discipline of medicine, and that he wrongly assumes that the patient-physician communication fails to provide the knowledge needed to insure the patient's best interests. We further argue that Veatch's suggested alternative, value-based patient-professional pairing, is, on (...) his own terms, impossible to implement. Finally, we reexamine the philosophical and practical justifications for informed consent and conclude that the practice should be retained. (shrink)

It is widely known that Black people are significantly more likely to be killed by the police in the United States of America than white people. What is less widely known is that nearly half of all people killed by the police are disabled people. The aim of this paper is to better understand the intersection of racism and ableism in the USA. Contributing to the growing literature at the intersection of philosophy of disability and critical philosophy of race, (...) I argue that theories concerning white supremacy should take more seriously the ways in which it functions as a process and apparatus of making abled and disabled. I conclude by discussing how understanding white supremacy in this manner is a valuable coalitional tool in fights for social justice more generally. (shrink)

The central question of this dissertation is how to expand popular participation in politics in a society that has been historically marked by racial discrimination. Challenging the common assumption that racial discrimination contradicts American democratic ideals, it argues that democracy and racism are actually intimately connected in American history. This connection is sealed through citizenship. American citizenship is valuable not only for the rights it grants but the standing it confers. Given the dialectical relationship between citizenship and slavery in the (...) United States, such standing is racialized. White citizenship, then, is a position of racial standing in a democratic polity. It is simultaneously a category of equality and privilege: equal to all citizens, superior to everyone else. The democratic problem of the white citizen is that the tension between the desire for equality and the desire to maintain one's racial status results in a narrow political imagination that exhibits little incentive to expand democratic participation because it construes citizenship as an identity to possess rather than a power to employ. This problem continues even after the civil rights movement, as whiteness becomes less a form of standing and more a norm that sediments accrued white advantages into the ordinary operations of society. The expansion of democratic participation, then, implies subverting the connection between racial standing and citizenship. Since whiteness is not a biological or cultural category but a form of power, this amounts to the abolition of the white citizen as a social category, much like capitalism abolished the aristocracy and the Civil War abolished the slaveholders. Just as these events paved the way for new political regimes such as representative democracy and Radical Reconstruction, abolishing the white citizen through policies and programs that eradicate whites' social, political, and economic advantages paves the way for new democratic possibilities and new forms of self-identity. An "abolitionist-democratic" politics, the dissertation concludes, holds greater potential for expanding democratic participation than colorblindness or multiculturalism. (shrink)

Black farmers are still Black farmers, yet now are considered a part of minority or small or limited resource farmers/ranchers (SLRF/R) by the Department of Agriculture. Except for a few Southern states, their numbers have fallen from a remnant to a fragment in recent years. They continue to leave agriculture at a faster rate than whites. What few programs the Department has for this category of producers (SLRF/R) show genuine promise, provided they are pursued diligently by the Congress and the (...) Department. In this paper, we discuss three probabilistic arguments for the existence of multiple universes. First, we provide an analysis of total evidence and use that analysis to defend Roger White's "this universe" objection to a standard fine-tuning argument for multiple universes. Second, we explain why Rodney Holder's recent cosmological argument for multiple universes is unconvincing. Third, we develop a "Cartesian argument" for multiple universes. While this argument is not open to the objections previously noted, we show that, given certain (...) highly plausible assumptions about evidence and epistemic probability, the proposition which it treats as evidence cannot coherently be regarded as evidence for anything. This raises the question of whether to reject the assumptions or accept that such a proposition cannot be evidence. (shrink)

Because anticipated and retrospective regret play important roles in practical deliberation and motivation, better understanding them can illuminate the contours of human agency. However, the possibility of self-ignorance and the fact that we change over time can make regret—especially anticipatory regret—not only a poor predictor of where the agent will be in the future but also an unreliable indicator of where the agent stands. Granting these, this paper examines the way in which prospective and, particularly, retrospective regret can nevertheless yield (...) important insight into the sorts of creatures we are, both generally and individually. The experience of retrospective regret can show a person she values something in a way she did not know or that she is (or was) a different person than she had thought, insights which can factor into forward-looking, or prospective, deliberation. Such instances of revelatory regret reveal something to the agent about herself as agent. I examine two cases of agential self-ignorance. In the first, the experience of regret reveals what the agent values, not only to others but even to the agent himself. In the second, the agent anticipates experiencing regret for an action but does not experience the regret, suggesting that the agent did not value the rejected alternative in the way she thought. Anticipatory regret is forward-looking and can play an important role in practical deliberation. But insofar as anticipatory regret flows from one’s imperfect judgment and prospection about oneself, retrospective regret can be an important corrective in helping the agent understand her own standpoint. On September 1, 2023, Texas made important revisions to it its decades‐old statute granting legal safe harbor immunity to physicians who withhold or withdraw life‐sustaining treatment over the objection of critically ill patients’ surrogate decision‐makers. However, lawmakers left untouched glaring flaws in a key safeguard for patients—the transfer option. The transfer option is ethically important because, when no hospital is willing to accept the patient in transfer, that fact is taken as strong evidence that the surrogates’ treatment requests fall outside (...) accepted medical practice. But there are serious shortcomings in how the transfer option is carried out in Texas and many other states, which undermines the ethical usefulness of the process. We identify these shortcomings and recommend revisions to state statutes and professional guidelines to overcome them. (shrink)

When talking about personal identity in the context of medical ethics, ethicists tend to borrow haphazardly from different philosophical notions of personal identity, or to abjure these abstract metaphysical concerns as having nothing to do with practical questions in medical ethics. In fact, however, part of the moral authority for respecting a patient’s self-regarding decisions can only be made sense of if we make certain assumptions that are central to a particular, psychological picture of personal identity, namely, that patients will (...) remain psychologically connected to a certain degree with their future selves. I draw this out, show problems with approaches in medical ethics based on alternate theories of personal identity that do not recognise this, and explore some important implications. Namely, I show how this recognition can better explain the circumstances under which we should respect advance directives and why, and how it can better make sense of patient fears that they will not "survive" personality-altering deep brain stimulation procedures, and provide guidance on approaching patient decisions concerning this type of procedure in a manner that captures and addresses such concerns. Theories of phenomenal intentionality have been claimed to resolve certain worries about the indeterminacy of mental content that rival, externalist theories face. Thus far, however, such claims have been largely programmatic. This paper aims to improve on prior arguments in favor of phenomenal intentionality by using attention and Gestalt principles as specific examples of factors that influence the phenomenal character of perceptual experience in ways that thereby help determine perceptual content. Direct neurological and especially imaging-driven investigations into the structures essential to naturally occurring cognitive systems in their development and operation have motivated broadening interest in the potential for artificial consciousness modeled on these systems. This first paper in a series of three begins with a brief review of Boltuc’s (2009) “brain-based” thesis on the prospect of artificial consciousness, focusing on his formulation of h-consciousness. We then explore some of the implications of brain research on the structure of consciousness, finding limitations (...) in biological approaches to the study of consciousness. Looking past these limitations, we introduce research in artificial consciousness designed to test for the emergence of consciousness, a phenomenon beyond the purview of the study of existing biological systems. The authors present a case study involving truth telling responsibilities in the setting of nonepileptic seizures. Specifically, over the course of several suspected nonepileptic seizures, a patient’s seizures stopped after he received a saline flush meant to precede the administration of anti-seizure medication. The patient and his surrogate believed he had received the medication each time, and the team wondered whether they should disclose the truth. Some worried that disclosure would reinforce the suspected psychogenic behavior, exacerbating the patient’s condition. In (...) this way, the case study presents a twist on the traditional truth telling archetype. While most truth telling cases center on navigating cultural differences or worries about emotional harm, this case presented concerns about medical harm in the form of exacerbating the patient’s condition. The authors describe the complex patient-family-team dynamic that preceded this ethical dilemma, describe the case, analyze the ethical issue, and describe the outcome. (shrink)

This article argues that standard causal and functionalist definitions of realization fail to account for the realization of entities that cannot be individuated in causal or functional terms. By modifying such definitions to require that realizers also logically suffice for any historical properties of the entities they realize, one can provide for the realization of entities whose resistance to causal/functional individuation stems from their possession of individuative historical properties. But if qualia cannot be causally or functionally individuated, then qualia can (...) be physically realized only if the thesis that all things are physical or physically realized is insufficient for physicalism. Ryan Tonkens has issued a seemingly impossible challenge, to articulate a comprehensive ethical framework within which artificial moral agents satisfy a Kantian inspired recipe—"rational" and "free"—while also satisfying perceived prerogatives of machine ethicists to facilitate the creation of AMAs that are perfectly and not merely reliably ethical. This series of papers meets this challenge by landscaping traditional moral theory in resolution of a comprehensive account of moral agency. The first paper established the challenge and set out autonomy in Aristotelian terms. (...) The present paper interprets Kantian moral theory on the basis of the preceding introduction, argues contra Tonkens that an engineer does not violate the categorical imperative in creating Kantian AMAs, and proposes that a Kantian AMA is not only a possible goal for Machine ethics research, but a necessary one.
