Sir Joshua Reynolds RA FRS FRSA (1723-1792) was an important and influential 18th century English painter, specialising in portraits and promoting the "Grand Style" in painting which depended on idealisation of the imperfect. Showing an early interest in art, Reynolds was apprenticed in 1740 to the fashionable portrait painter Thomas Hudson, with whom he remained until 1743. From 1749 to 1752, he spent over two years in Italy, where he studied the Old Masters and acquired a taste for the (...) "Grand Style." Unfortunately, whilst in Rome, Reynolds suffered a severe cold which left him partially deaf and, as a result, he began to carry a small ear trumpet with which he is often pictured. From 1753 until the end of his life he lived in London, his talents gaining recognition soon after his arrival in France. He was one of the founders and first President of the Royal Academy. George III appreciated his merits and knighted him in 1769. He was one of the earliest members of the Royal Society of Arts, helped found the Society of Artists, and, with Gainsborough, established the Royal Academy of Arts as a spin-off organisation. In the summer of 2016, the University of Dallas and the Instituto Tecnológico Autónomo de México organized a conference to discuss the topic of the middle class and its continued decline—recognizing that, despite some historical, political and cultural differences, healthy democracies throughout the hemisphere depend upon a strong and prosperous middle class. This volume brings together contributions by nine scholars from both institutions. The chapters reflect diverse disciplinary perspectives that are historical, political, economic, anthropological, and philosophical. Despite this diversity, the (...) volume possesses a conceptual unity that stems from its foundation in Aristotle’s approach to the middle class. On this basis, the topic is given a rigorous study that is both theoretical and data-driven. Female genital cutting (FGC) is generally understood as a gendered harm, abusive cultural practice and human rights violation. By contrast, male genital cutting (MGC) is held to be minimally invasive, an expression of religious identity and a legitimate parental choice. Yet scholars increasingly problematize this dichotomy, arguing that male and female genital cutting can occasion comparable levels of harm. In 2015 this academic critique received judicial endorsement, with Sir James Munby's acknowledgement that all genital cutting can cause ‘significant harm’. This (...) article investigates the harm occasioned by MGC. It is informed by a Freedom of Information (FoI) study which provides some empirical evidence of the nature and frequency of physical harm caused by MGC in U.K. hospitals. While acknowledging the challenges and limitations of FoI research, we outline important lessons that this preliminary study contains for medical ethics, law and policy. It provides some empirical evidence to support claims regarding the risks which accompany the procedure and the obligation of health professionals to disclose them, and reveals the paucity of measures in place to ensure that harms are recorded, disclosed and monitored. I can well imagine all of those listed above, among many others, united in an imaginary painting similar to the School of Athens—in other words, a vision that reconciles their various views of the world in a harmony analogous to the unity of philosophers in Raphael’s great fresco. Raphael is a towering figure in the history of European culture. The year 2020 was the 500th anniversary of the death of the great painter in Rome at the age of thirty-seven. In the wake of recent exhibitions that commemorated the artist’s achievement, I propose to touch briefly and lightly on a few aspects arion 28.2 fall 2020 100 reflections on raphael of Raphael’s life and works. Please think of these remarks as a series of suggestions, not attempts at definitive interpretation. I think of this essay as a rather experimental piece. THE SCHOOL OF ATHENS i should like to begin with a few brief remarks on what must be Raphael’s most famous work of art. I mean his School of Athens (fig. 1), which is, like Leonardo’s Mona Lisa and Last Supper or like Michelangelo’s David and Creation of Adam, an image widely known and admired. What more is there to say about The School Of Athens, one of the central images in the Stanza della Segnatura? You might spend the rest of your life reading about this great work and never understand it fully. Nevertheless, I want to focus for a moment on a central detail of the work and, on the basis of my description, point to a significant aspect of the fresco that has been universally overlooked. Paul Barolsky 101 At the center of the School of Athens we behold the two great philosophers of classical antiquity: Plato and Aristotle. Plato holds a copy of his Timaeus, a dialogue that concerns the harmony of the heavens; Aristotle holds a copy of his Ethics, a work that pertains to human relations in this world. It was the goal of Renaissance thinkers to create a harmony or concord of the thought of these philosophers: a Concordia Platonis et Aristotelis. Raphael’s fresco, as is well known, presents the visual ideal of such harmony. Whereas Aristotle gestures downward, alluding to this world, in which his Ethics matter, Plato points heavenward, evoking the order of the cosmic realm described in Timaeus. Raphael makes visible the ideal of concordia when he movingly pictures the way in which the two philosophers gaze into each other’s eyes, as if to suggest this harmony. Borrowing from the language of Raphael ’s friend, Baldassare Castiglione, Raphael renders “the joining” of their souls. The monumental architecture of the scene, which echoes Bramante and has taproots in Piero della Francesca and Perugino, consists of three barrel-vaults beyond which we see patches of blue sky and puffs of cloud (fig. 2). The grandiose architecture of the image magnifies Raphael’s philosophers. Within this architectural framework, Plato’s gesture is deeply meaningful, since it prompts the viewer to look up and thus ascend toward the perfection of the celestial realm, beyond the imperfections of the physical world. Above the first barrel vault in the fresco we behold a section of the drum of a dome which is open to the sky. Within this section of drum there are two columns that are lined up directly... In every chapter of this dissertation---chapters which consider work by John Locke, Lord Shaftesbury, David Hume, Adam Smith, Samuel Richardson, Jane Austen and Sir Joshua Reynolds---I show that the appeal each of these authors makes to the "common sense" of the reader mounts a deeply persuasive appeal to a collective vision of how things ought to be. Within empiricist epistemology, moral philosophy, fiction, and the discourse of art and aesthetics, I find that by assuming a moral consensus that unites (...) that community of readers he or she addresses, each of these writers initiates the reader into such a consensus. A double moment underlies the ideal and description of a common sense: what enables the claim that one's judgment is commonsensical is the assumption that such a judgment would find general assent, general agreement. At the same time, judgments that make these claims model for the community the kind of judgments that ought to find agreement. The idea of community rests on the possibility that each and every agent is capable of an objective assent to its terms and conditions, and that, given this ability, each would arrive at the consensus which supports the community. ;One of the paradoxes of eighteenth-century British empiricist epistemology is that it suggests the clearest views are those offered through the arts. That is, the frame provided by the arts creates a space which abstracts from a common-sense view of things to things "as they really are"---which is, really, as they ought to be. I explain the much noted intensity of the interest in developing a discourse of the aesthetic in the eighteenth century, or the emphasis placed on the idea of a single "standard of taste," as a consequence of the impasse in Locke's empiricist epistemology on the matter of objective judgments. The ability of perceivers to share a clear view of facts and objects, the view of reason and common sense, predicates Locke's project, yet the very possibility of such a view becomes more and more remote as his Essay proceeds. The model of aesthetic judgment which developed in the wake of Locke's Essay prioritized detachment and disinterest, and therefore offered the possibility of a distanced, and therefore objective, point of view, the point of view invoked in the appeal to common sense. Since the early nineteenth century it has been known that Frances Reynolds, the sister of Sir Joshua, was the author of an essay on taste, which she had printed but did not publish. Yet persistent search failed to turn up a single copy. It remained one of those lost pieces which every research scholar hoped someday to discover. In 1935 it appeared that the search was over. Among some manuscripts of Mrs. Thrale-Piozzi, long hidden in Wales, was found a (...) printed copy of an anonymous _Enquiry Concerning the Principles of Taste, and of the Origin of Our Ideas of Beauty, which seemed to be the lost essay. A magisterial exploration of poetry’s place in the fine arts by one of the twentieth century's leading poets In this book, eminent poet Anthony Hecht explores the art of poetry and its relationship to the other fine arts. While the problems he treats entail both philosophic and theoretical discussion, he never allows abstract speculation to overshadow his delight in the written texts that he introduces, or in the specific examples of painting and music to which he refers. After discussing literature’s (...) links with painting and music, Hecht investigates the theme of paradise and wilderness, especially in Shakespeare’s The Tempest. He then turns to the question of public and private art, exploring the ways in which all the arts participate in balances between private and public modes of discourse, and between an exclusive or elitist role and the openly political. Beginning with a discussion of architecture as an illustration of a more general theme of discord and balance, the penultimate lecture probes the inner contradictions of works of art and our reactions to them, while the final piece concerns art and morality. This book provides an analytical and critical appraisal of Rousseau's political thought that, while frank about its limits, also explains its enduring power.

This paper calls into question the idea that moral disgust is usefully regarded as a form of genuine disgust. This hypothesis is questionable even if, as some have argued, the spread of moral norms through a community makes use of signaling mechanisms that are central to core disgust. The signaling system is just one part of disgust, and may well be completely separable from it. Moreover, there is plausibly a significant difference between the cognitive scientist’s concept of an emotion and (...) the everyday notion of that emotion. Finally, even if, as this paper contests, some form of disgust were directly elicited by the moral wrongness of certain kinds of behavior, research on the socio-moral elicitors of the disgust mechanism would still be unlikely to shed much direct light on the nature or content of morality. Since the publication of John Rawls'sA Theory of Justice, normative democratic theory has focused principally on three tasks: refining principles of justice, clarifying the nature of political justification, and exploring the public policies required to ensure a just distribution of education, health care, and other basic resources. Much less attention has been devoted to examining the political institutions and social arrangements that might plausibly implement reasonable political principles. Moreover, the amount of attention paid to issues of organizational and institutional implementation (...) has varied sharply across the different species of normative theory. Neoliberal theorists, concerned chiefly with protecting liberty by taming power, and essentially hostile to the affirmative state, have been far more sensitive to such issues than egalitarian-democratic theorists, who simultaneously embrace classically liberal concerns with choice, egalitarian concerns with the distribution of resources, and a republican emphasis on the values of citizen participation and public debate. Neglect of how such values might be implemented has deepened the vulnerability of egalitarian-democratic views to the charge of being unrealistic: “good in theory but not so good in practice.”. In this volume, Joshua Eckhardt examines the religious texts and books that surrounded the poems, sermons, and inscriptions of the early modern poet and preacher John Donne. Focusing on the material realities legible in manuscripts and Sammelbände, bookshops and private libraries, Eckhardt uncovers the myriad ways in which Donne’s writings were received and presented, first by his contemporaries, and later by subsequent readers of his work. Eckhardt sheds light on the religious writings with which Donne’s work was linked during (...) its circulation, using a bibliographic approach that also informs our understanding of his work’s reception during the early modern period. He analyzes the religious implications of the placement of Donne’s poem “A Litany” in a library full of Roman Catholic and English prayer books, the relationship and physical proximity of Donne’s writings to figures such as Sir Thomas Egerton and Izaak Walton, and the movements in later centuries of Donne’s work from private owners to the major libraries that have made this study possible. Eckhardt’s detailed research reveals how Donne’s writings have circulated throughout history—and how religious readers, communities, and movements affected the distribution and reception of his body of work. Centered on a place in time when distinct methods of reproduction, preservation, and circulation were used to negotiate a complex and sometimes dangerous world of confessional division, Religion Around John Donne makes an original contribution to Donne studies, religious history, book history, and reception studies. Derek Parfit, Joseph Raz, and T. M. S canlon, among others, all hold that reasons for action are provided by facts about those actions. They also hold that the fact that an action would promote or achieve the object of an agent's desire is not one of the relevant facts, and does not provide a reason. Rather, the facts that provide reasons are typically facts about valuable states of affairs that the action is likely to bring about, or valuable properties (...) that the action itself will instantiate. For this reason it is appropriate to call Parfit, Raz, and Scanlon "value-based" theorists about reasons for action. In contrast to value-based theorists, there is a strong current of contemporary theorizing, starting with Bernard Williams, that can be called "desire-based." Desire-based theorists argue that practical reasons should be understood in terms of the desires of the agents who are said to have those reasons. (shrink)

The law has taken a long-standing interest in the mind. Cognitive neuroscience, the study of the mind through the brain, has gained prominence in part as a result of the advent of functional neuroimaging as a widely used tool for psychological research. Existing legal principles make virtually no assumptions about the neural bases of criminal behavior, and as a result they can comfortably assimilate new neuroscience without much in the way of conceptual upheaval: new details, new sources of evidence, but (...) nothing for which the law is fundamentally unprepared. Neuroscience challenges ultimately reshape our intuitive sense of justice. It draws a familiar distinction between the consequentialist justification for state punishment, according to which punishment is merely an instrument for promoting future social welfare, and the retributivist justification for punishment, according to which the principal aim of punishment is to give people what they deserve based on their past actions. Søren Kierkegaard’s claim that having faith requires being contemporary with Christ is one of the most important, yet difficult to interpret claims across his entire authorship. How can one be contemporary with a figure who existed more than two millennia ago? A prominent answer to this question is that contemporaneity with Christ is achieved through a kind of imaginative co-presence made possible by reading Scripture. However, I argue, this ignores what Kierkegaard thinks about Christ as a living agent, and not (...) a merely historical agent. By drawing on Kierkegaard’s discussion of Christ’s true presence in the sacrament of Communion, I argue that contemporaneity with Christ should be understood in the same way as any other intersubjective relation. That is, I argue, that just as relating to any living person as contemporary requires a kind of two-way attention-sharing, relating to Christ as contemporary, on Kierkegaard’s account, requires a kind of two-way attention-sharing with Christ. One strategy for providing an analysis of practical rationality is to start with the notion of a practical reason as primitive. Then it will be quite tempting to think that the rationality of an action can be defined rather simply in terms of ‘the balance of reasons’. But just as, for many philosophical purposes, it is extremely useful to identify the meaning of a word in terms of the systematic contribution the word makes to the meanings of whole sentences, this (...) paper argues that it is extremely useful to explain the nature of practical reasons in terms of the systematic contributions that such reasons make to the wholesale rational statuses of actions. This strategy gives us a clear view of two logically distinct normative roles for practical reasons – justifying and requiring – that are often conflated, and it allows us to give clear definitions of what ‘the strength of a reason’ means within each of these roles. The final section of the paper explores some implications of the resulting view for the internalism/externalism debate about practical reasons, and for the practical significance of moral theory. Social constructionists about race frequently hold that race does not travel, that race is socially constructed, and that racial passing is possible. Ron Mallon has argued that these three principles cannot be consistently held at once. This article argues otherwise.

Moral phenomenology has enjoyed a resurgence lately, and within the field, a trend has emerged: uniform rejection of the idea that the experience of making ‘direct’ moral judgments has any phenomenal essence, that is, any phenomenal property or properties that are always present and that distinguish these experiences from experiences of making non-direct- moral judgments. This article examines existing arguments for this anti-essentialism and finds them wanting. While acknowledging that phenomenological reflection is an unstable pursuit, it is maintained here that (...) phenomenological essentialism about a certain domain of direct moral judgment, namely direct judgment of obligation and prohibition, is more credible than has been recognized. The positive proposal is to rehabilitate something close to Maurice Mandelbaum’s essentialism, specifically to maintain that direct moral judgment ’s phenomenal essence is arguably its felt categorical demand. The key to making this argument is to assume a ‘rich view’ of moral consciousness, the view that phenomenal features of moral judgment might be present even when they are not attended to. This assumption is controversial, but it is warranted by two considerations. First, though controversial, the rich view is intuitively plausible. Second, it reveals that the existing arguments against the kind of essentialism defended here appear to tacitly presuppose an equally controversial – and arguably less intuitive – rejection of the rich view. Recently the idea that race is biologically real has gained more traction. One argument against this claim is that the populations identified by science do not sufficiently map onto the concept of race as deployed in the relevant racial discourse, namely folk racial discourse. Call that concept the concept of race-f. Robin Andreasen (2005) argues that this "mismatch" criticism fails, on a variety of grounds including: ordinary folk semantically defer to scientists; scientists can disagree about facts; historians disagree about the (...) origins of the term 'race'; 'race' has had a diversity of meanings; some of those meanings privileges geography over visible traits; and that the scientific definition of 'race' is autonomous from the folk definition of 'race.' It is argued here that all of these responses to the mismatch criticism do not succeed, and that the last in fact vindicates it. Similar arguments to the last, autonomy argument, are also examined. Stephen Evans, Robert Adams, and Philip Quinn. John Hare's book God's Command joins this [End Page 197] discussion and advances it by attending not only to the Christian tradition but also (...) to Judaism and Islam, and by engaging with evolutionary psychology. Central to Hare's account of divine command theory is the claim that human nature is a "mixture," characterized by the dual affections for advantage and for justice. Against theories that assume a single-source account of motivation (e.g., eudaimonism), Hare contends that human beings experience the pull of competing motivations, toward morality and self-interest. Any adequate moral theory will account for both motivations and indicate how they can be reconciled. Hare contends that his version of divine command theory is up to this task.It is on this point that Hare most clearly adheres to his claim at the beginning and the end of God's Command that the book "defends the thesis that what makes something morally obligatory is that God commands it, and what makes something morally wrong is that God commands us not to do it" (1). Elsewhere in the book, this kind of philosophical defense recedes. After an initial chapter describing divine command theory in general, and two chapters on eudaimonism and naturalistic deductivism, Hare provides three chapters illustrating how divine command theory is worked out by representative thinkers in the traditions of Christianity, Islam, and Judaism, followed by a chapter on how divine command theory can accommodate the findings of evolutionary psychology. The book ends with a summary, showing how the various pieces of the book, which at times read like a series of independent essays, constitute a single picture. In these latter chapters, Hare seems to leave behind the philosophical defense of divine command theory, turning instead toward a discussion of what kind of divine command theory theists should adopt, given their predetermined commitment to theism and divine command theory in general.In one sense, this shift can be understood in terms of audience. Initially, Hare addresses anyone interested in ethics. By the second half of the book, Hare has shifted to convincing theistic ethicists that the best way to hold together their various commitments is to adopt a divine command theory, as opposed to other options such as Eudaimonism. This shift arises as an attempt to fend off a potential criticism of divine command theory—the possibility that people will do terrible things in the name of God's command. Hare suggests that Kant provides one solution to this problem, which is that if we think God is commanding us to do something that is at odds with practical reason, we ought to doubt that God is really commanding us to do this thing. Hare is sympathetic to Kant here, but he also seems to think that Kant's solution would undermine his own project, insofar as it makes God's command appear superfluous. Hare's alternative approach involves acknowledging that religious traditions possess safeguards to protect against the possibility that appeal to a divine command is used to justify horrendous evils. For Hare, the Abrahamic traditions provide historical evidence that the benefits of divine command ethics can be enjoyed without accepting the apparently bad aspects. One of the most pressing ethical challenges facing phase I cancer research centres is the process of informed consent. Historically, most scholarship has been devoted to redressing therapeutic misconception, that is, the conflation of the nature and goals of research with those of therapy. While therapeutic misconception continues to be a major ethical concern, recent scholarship has begun to recognise that the informed consent process is more complex than merely a transfer of information and therefore cannot be evaluated only according (...) to how well an individual understands such information. Other components of decision-making operate independently of understanding and yet still may compromise the quality of informed consent. Notable among these components is unrealistic optimism, an event-specific belief that one has a better chance of receiving benefit than others similarly situated. In this article, we consider responses to interviews with parents who had recently completed an informed consent conference for enrolling their child in a phase I cancer clinical trial to examine how this influence manifests and how investigators might address it during informed consent.
