Our goal here is to help identify the contextualist’s most worthy competitor to relativism. Recently, some philosophers of language and linguists have argued that, while there are contextualist-friendly semantic theories of deontic modals that fit with the relativist’s challenge data, the best such theories are not Lewis-Kratzer-style semantic theories. If correct, this would be important: It would show that the theory that has for many years enjoyed the status of the default view of modals in English and other languages is (...) in need of revision. Here we defend the default view by showing how a Kratzer-style semantics is able to make available readings of the relevant utterances that fit with the pretheoretical judgments opponents purport it cannot fully capture. Having established this, we turn to considering the more theoretical grounds proponents have offered for preferring their rival contextualist views. Here the question is to what extent such grounds favor semantic over what Korta and Perry call “near-side pragmatic” explanations of our judgments. In particular, we argue that our favored readings figure in near-side pragmatic explanations of those judgments that possess the methodological and theoretical advantages of systematicity and unity at least as well as, if not to a greater extent than, those of opponents who argue for their revised semantic theories on the basis of these advantages. This collection offers the first comprehensive and definitive account of Martin Heidegger’s philosophy of technology. It does so through a detailed analysis of canonical texts and recently published primary sources on two crucial concepts in Heidegger’s later thought: _Gelassenheit _and _Gestell_. _Gelassenheit_, translated as ‘releasement’, and _Gestell_, often translated as ‘enframing’ or ‘positionality’, stand as opposing ideas in Heidegger’s work whereby the meditative thinking of _Gelassenheit _counters the dangers of our technological framing of the world in _Gestell_. After opening with (...) a scholarly overview of Heidegger’s philosophy of technology as a whole, this volume focuses on important Heideggerian critiques of science, technology, and modern industrialized society as well as Heidegger’s belief that transformations in our thought processes enable us to resist the restrictive domain of modern techno-scientific practice. Recent philosophical discussions of self-knowledge have focused on basic cases: our knowledge of our own thoughts, beliefs, sensations, experiences, preferences, and intentions. Empiricists argue that we acquire this sort of self-knowledge through inner perception; rationalists assign basic self-knowledge an even more secure source in reason and conceptual understanding. I try to split the difference. Although our knowledge of our own beliefs and thoughts is conceptually insured, our knowledge of our experiences is relevantly like our perceptual knowledge of the external world.

Jordi Fernandez has recently offered an interesting account of introspective justification according to which the very states that (subjectively) justify one's first-order belief that p justify one's second order belief that one believes that p. I provide two objections to Fernandez's account.

Locke characterizes sensitive knowledge as knowledge of the existence of external objects present to the senses, and in terms of an ‘assurance’ that falls short of the certainty of intuition and demonstration. But it is unclear how this fits with his general definition of knowledge, as the perception of the agreement or disagreement of ideas, and it is unclear how that assurance can amount to knowledge, rather than amounting to mere probability (which he contrasts with knowledge). Some contend that Locke (...) does not regard sensitive knowledge as genuine knowledge, but only honourifically calls it knowledge. In contrast, I argue that Locke holds that sensitive knowledge is knowledge, though he takes the conditions for it to be very different from the conditions for intuitive and demonstrative knowledge. It is not the assurance alone which Locke thinks qualifies sensitive knowledge as such: it is also the fact that the assurance arises from the actual employment of the senses upon external objects, and the fact that the senses do not generally deceive us, which he thinks qualifies sensitive knowledge as genuine knowledge. That there is a (tacit) form of externalism in Locke's account of sensitive knowledge is the main thesis of this paper. (shrink)

Counter-terrorism officials in the USA and the UK responded to the events of 11 September 2001 and 7 July 2005 with an increasing resort to the use of ?intelligence-led policing? methods such as racial and religious profiling. Reliance on intelligence, to the effect that most people who commit a certain crime have a certain ethnicity, can lead to less favourable treatment of an individual with that ethnicity because of his membership in that group, not because of any act he is (...) suspected or known to have committed. This paper explains the context in which intelligence-led policing flourishes, and how this discussion contributes to the profiling debate in both the USA and the UK, and then sets out two key contentions. First, we argue that Article 14 ECHR as applied under the UK Human Rights Act has a more protective, and less ?prosecutorial?, conception of discrimination than has the US Equal Protection Clause, meaning that judges need not find a discriminatory motive to find that discrimination has occurred. Second, we contend that Article 14 provides the judiciary with the key tool of proportionality, which, when properly applied, makes it harder for discrimination to stand up to scrutiny. (shrink)

According to Thomas Reid, every act of mind is accompanied by a conception of its object. For instance, he holds that the thing one conceives in an act of perception is always an individual thing that exists, and that the thing one conceives in an act of judgment is the thing expressed by the proposition judged. However, Reid never is clear about what kind of thing is expressed by a proposition; neither is it clear from the existing literature on Reid. (...) What he says about judgments, propositions, and general conceptions together suggests four distinct candidates. But I will argue that each of these candidates either fails to have sufficient textual support, or leads to absurd conclusions (such as that we conceive semi-existent things). In conclusion, I argue that while Reid does not offer an account of the kind of conception accompanying judgments, his writings leave the matter open. (shrink)

A trailblazing exploration of the political stakes of curiosity. Perry Zurn explores the political philosophy of curiosity—the heartbeat of political resistance and a critical factor in social justice. Drawing on philosophy and political theory as well as feminist theory, race theory, disability studies, and trans studies, he tracks curiosity in the structures of political marginalization and resistance.

Is the procreation asymmetry intuitively supported? According to a recent article in this journal, an experimental study suggests the opposite. Dean Spears (2020) claims that nearly three-quarters of participants report that there is a reason to create a person just because that person’s life would be happy. In reply, I argue that various confounding factors render the study internally invalid. More generally, I show how one might come to adopt the procreation asymmetry for the wrong reasons by misinterpreting one’s intuitions.

Investments in mitigating climate change have their greatest environmental impact over the long term. As a consequence the incentives to invest in cutting greenhouse gas emissions today appear to be weak. In response to this challenge, there has been increasing attention given to the idea that current generations can be motivated to start financing mitigation at much higher levels today by shifting these costs to the future through national debt. Shifting costs to the future in this way benefits future generations (...) by break- ing existing patterns of delaying large-scale investment in low-carbon energy and efficiency. As we will see in this chapter, it does appear to be technically feasible to transfer the costs of investments made today to the future in such a way that people alive today do not incur any net cost. the aim of this chapter is to take seriously the possibility that climate change has produced an extremely intractable political problem and that we must now consider strong measures that can break existing patterns of delaying mitigation. I defend the claim that if climate change involves a stark conflict of interests between current and future generations, then borrowing from the future would be both strategically and normatively much better than the status quo. Nevertheless, I challenge the borrowing from the future proposal on the grounds that it is not in fact the powerful tool for motivating existing agents that its proponents imagine it to be. The purpose of developing this critical argument is not, however, simply to throw doubt onto the idea of borrowing from the future. If we really do find ourselves in a political context where the prospects for effective action are very poor then strategic forms of buck-passing may make an important positive contribution to avoiding dangerous global cli- mate change. Consequently, if debt financing is not as powerful of a motivational tool as imagined we still have strong reasons, I will argue, to identify other strategies that will change agents’ incentive structures. To this end, I propose an alternative form of passing on the costs of mitigation to the future that warrants consideration. (shrink)

In their target article, McKay & Dennett (M&D) conclude that only “positive illusions” are adaptive misbeliefs. Relying on overly strict conceptual schisms (deficit vs. motivational, functional vs. organic, perception vs. belief), they prematurely discount delusions asbiologicallyadaptive. In contrast to their view that “motivation” plays a psychological but not a biological function in a two-factor model of the forming and maintenance of delusions, we propose asingleimpairment in prediction-error–driven (i.e., motivational) learning in three stages in which delusions play a biologically adaptive role.

Recent theorists suggest that our capacity to respond affectively to fictions depends on our ability to engage in simulation: either simulating a character in the fiction, or simulating someone reading or watching the fiction as though it were fact. We argue that such accounts are quite successful at accounting for many of the basic explananda of our affective engagements in fiction. Nonetheless, we argue further that simulationist accounts ultimately fail, for simulation involves an ineliminably ego-centred element that is atypical of (...) our experience of fiction. We then draw on recent work in philosophical psychology to articulate a more psychologically plausible account of our emotional engagement with fiction. (shrink)

In this paper I argue that, according to Peirce’s mature account of perception, we directly perceive generals, or "Thirds," in external reality which should be described as physical and not as mental. I argue against three other interpretations of the role of Thirdness in Peirce’s account: (I) we do not directly perceive Thirds, although they are involved in the interpretive and judgmental part of perception; (II) we directly perceive Thirds, but they are imposed on external objects by our minds; and (...) (III) we directly perceive Thirds in external objects, but external reality is comprised of the representations of an objective mind. I address questions about the role of the percept and the percipuum in his account, in what exact sense he thought that perception is interpretive, and how he thought it is even possible to directly perceive generals in the external world. Jordi Fernández has recently responded to my objection that his 'extrospectionist' account of self-knowledge posits necessary and sufficient conditions for introspective justification which are neither necessary nor sufficient. I show that my criticisms survive his response unscathed.

In this paper we present a reconstruction of Hegel's critique of Kant. We try to show the congruence of that critique in both theoretical and practical philosophy. We argue that this congruence is to be found in Hegel's criticism of Kant's hylemorphism in his theoretical and practical philosophy. Hegel is much more sympathetic to Kant's response to the distinction between matter and form in his theoretical philosophy and he credits Kant with ‘discovering’ here that thinking is an activity that always (...) takes place within a greater whole. He, however, argues that the consequences of this are much more significant than Kant suspects and that, most importantly, the model of cognition in which thought (form) confronts something non-thought (matter) is unsustainable. This leads to Hegel's appropriation of Kantian reflective judgements, arguing that the greater whole in which thinking takes place is a socially shared set of meanings, something resembling what Kant calls a sensus communis. From here, it is not far to Hegel's Geist, which eventually gains self-consciousness in Sittlichkeit, a whole of social practices of mutual recognition. In practical philosophy, Hegel argues for the importance of situating oneself within such a whole in order to attain the self-knowledge required for autonomous, or ethically required, action. For this to happen, he claims, it is necessary to recognise the status of Kantian Moralität as a form of Sittlichkeit or social practice. This would justify our practices without an appeal to a ‘fact of reason’ and also allow a wider range of actions that could count as autonomous. (shrink)

The work of Hussefl and Freud had common sources in the philosophy, psychology and physiology of the nineteenth century. Herbart, Brentano, Helmholtz, Fechner, Wundt and Mach were among the towering figures in their common background who had influence on their respective work. 1 Although contemporaries who had little concern for the other's professional interest, Husserl and Freud nevertheless struggled with some common problems. One of these is the relationship of sensation to memory and to the experience of time. Financial ties between physicians and pharmaceutical companies are pervasive and controversial. However, little is known about how patients perceive such ties. This paper describes an experiment examining how a national sample of U.S. adults perceived a variety of financial relationships between physicians and drug companies. Each respondent read a single scenario about a hypothetical physician and his financial ties to the pharmaceutical industry; scenarios varied in terms of payment type of and amount. Respondents then evaluated the physician on several dimensions (...) . Findings revealed that perceptions of the physician were more strongly influenced by payment type than by payment amount. Specifically, respondents were quite critical of doctors who owned drug company stock or received industry payments for meals and lodging, but were more forgiving of physicians who received free drug samples or consulting fees . Interestingly, physicians who received no payments, while seen as honest, were also viewed by some respondents as inexperienced or uninformed about new treatments. Implications for public policy and future research are discussed. (shrink)

Patent landscaping is the process of finding patents related to a particular topic. It is important for companies, investors, governments, and academics seeking to gauge innovation and assess risk. However, there is no broadly recognized best approach to landscaping. Frequently, patent landscaping is a bespoke human-driven process that relies heavily on complex queries over bibliographic patent databases. In this paper, we present Automated Patent Landscaping, an approach that jointly leverages human domain expertise, heuristics based on patent metadata, and machine learning (...) to generate high-quality patent landscapes with minimal effort. In particular, this paper describes a flexible automated methodology to construct a patent landscape for a topic based on an initial seed set of patents. This approach takes human-selected seed patents that are representative of a topic, such as operating systems, and uses structure inherent in patent data such as references and class codes to “expand” the seed set to a set of “probably-related” patents and anti-seed “probably-unrelated” patents. The expanded set of patents is then pruned with a semi-supervised machine learning model trained on seed and anti-seed patents. This removes patents from the expanded set that are unrelated to the topic and ensures a comprehensive and accurate landscape. (shrink)

Too often the study of philosophical texts is carried out in ways that do not pay significant attention to how the ideas contained within them are presented, articulated, and developed. This was not always the case. The contributors to this collected work consider Jewish philosophy in the medieval period, when new genres and forms of written expression were flourishing in the wake of renewed interest in ancient philosophy. Many medieval Jewish philosophers were highly accomplished poets, for example, and made conscious (...) efforts to write in a poetic style. This volume turns attention to the connections that medieval Jewish thinkers made between the literary, the exegetical, the philosophical, and the mystical to shed light on the creativity and diversity of medieval thought. As they broaden the scope of what counts as medieval Jewish philosophy, the essays collected here consider questions about how an argument is formed, how text is put into the service of philosophy, and the social and intellectual environment in which philosophical texts were produced. A peculiar feature of Hutcheson’s system is his claim that there exist no original pains in the imagination, and hence no real displeasures concerning form or beauty. This position, when set against a clear emphasis upon the pains of the moral sense in apprehending evil, seems to render tenuous his frequent analogies between the experiences of beauty and goodness. In light of this apparent discrepancy in Hutcheson’s argument, the repeated use of the term “moral beauty” presents interpretive difficulties, particularly on (...) the matter of whether, and in what way, goodness is itself a species of beauty. These problems can be surmounted by way of close attention to Hutcheson’s connection and ordering of the various “senses.” On the present interpretation, Hutcheson denies formal displeasure aspart of a broader theological argument concerning the moral function of the imagination. On this view, “moral beauty” is a special type of imaginative pleasure. (shrink)

I wish to consider the possibility that a good part of the opposition to the main lines of American foreign policy is based on deep-seated objections to the political and economic systems of the United States. This is not to say that existing policy is necessarily wise or that there may not be good and sufficient reasons for wishing to change it. Indeed, at any time and place, the United States might well be overestimating the threat from the Soviet Union (...) or using too much force. What I wish to suggest is that across-the-board criticism of American policy as inherently aggressive and repressive, regardless of circumstance – a litany of criticism so constant that it does not alert us to the need for explanation – has a structural basis in the rise of a political culture that is opposed to existing authority. To the extent that this criticism is structural, that is, inherent in domestic politics, the problem of fashioning foreign policies that can obtain widespread support is much more difficult than it is commonly perceived to be. For if the objection is to American ways of life and, therefore, “to the government for which it stands,” only a transformation of power relationships at home, together with a vast redistribution of economic resources, would satisfy these critics. If the objection is not only to what we do but, more fundamentally, to who we are, looking to changes in foreign policy to shore up domestic support is radically to confuse the causal connections and, therefore, the order of priorities. Cambridge UP, 2018.Robert Lane's Peirce on Realism and Idealism is the ultimate secondary source for those who wish to engage the forms of realism and idealism that Peirce develops over the course of his writings. Lane could not have given his monograph a more concise and descriptive title. He never strays from (...) the topics of realism and idealism, and it is remarkably complete. It includes extensive discussion on Peirce's basic realism (Lane's term) as well as his extreme scholastic realism (Peirce's term), his basic idealism (Lane's term), and his objective idealism (Peirce's term). It might not be the best resource for those interested in the historical influences on Peirce's forms of realism and idealism. For instance, if one is interested mainly in Peirce's extreme scholastic realism and its roots in scholastic philosophy, Mayorga (2007)1 might still be a more useful resource. Also, Lane leaves much to be said about the epistemological underpinnings of Peirce's forms of realism and idealism. Peirce's theory of perception and his critical common-sensism do not get much attention. Also, there is much in Peirce's later semeiotic writings that could have been brought to bear on the issues.However, I do not see any of these omissions as failures of Lane's work. As I read it, the book's central aims are to determine the following: (1) what metaphysical views did Peirce hold, (2) when did he hold them, (3) are they consistent with one another, and (4) what is the textual evidence that he held them as such. With respect to these aims, Peirce on Realism and Idealism exhibits the gold standard of Peirce scholarship: it is remarkably sensitive to dates, different writings, and contexts of writings, and the reader gets a strong impression that Lane has not left any stone unturned—that he had at least skimmed every word in every lecture, published writing, letter, and unpublished manuscript that Peirce produced.Although the book contains some interpretations about which I have some reservations, which I describe further on, I agree with most of its central claims. This includes the claim that, despite various developments, Peirce had always subscribed to "basic realism": the thesis that there are things independent of what anyone thinks about them. A whole chapter is dedicated to showing that Peirce's 1868–1869 "anti-Cartesian" papers are consistent with basic realism, and I found that chapter very helpful. Another thesis that Lane defends, and that I strongly agree with, is that Peirce held a representationalist view of truth. Truth as "correspondence" with reality is one of two [End Page 107] key aspects of Peirce's account of truth (the other being, as Lane calls it, an "investigative aspect"). After works by Christopher Hookway, Cheryl Misak, and others that attempt to de-emphasize or obscure Peirce's representationalism, perhaps to make him more appealing to contemporary analytic "neopragmatists," it is absolutely refreshing to read a book that embraces Peirce's representationalism without apology.However, in the remainder of this review, I will focus on parts that I found troubling. Some of this trouble is probably due more to Peirce himself than to Lane's interpretation of Peirce. But some of it directly concerns Lane's interpretation. In particular, the parts of chapter 6 concerning Peirce's modal realism, while stimulating and enlightening, are also problematic. Further, I do not think that Lane's account of Peirce's idealism appropriately recognizes its similarity to Hegelian or Absolute idealism.To begin with Peirce's modal realism, Lane's discussion of it sets out by addressing the fact that, as Peirce recognizes, the conditionals comprising "pragmatic clarifications," or what result from applying the "pragmatic maxim" to a concept, must be in the hypothetical or subjunctive mood. This is in order to make sense of the truth of even indicative non-conditional propositions such as, to use Peirce's and Lane's example, "the diamond is hard." Many cognitive and evolutionary theories of religion argue that supernatural explanations are byproducts of our cognitive adaptations. An influential argument states that our supernatural explanations result from a tendency to generate anthropomorphic explanations, and that this tendency is a byproduct of an error management strategy because agents tend to be associated with especially high fitness costs. We propose instead that anthropomorphic and other supernatural explanations result as features of a broader toolkit of well-designed cognitive adaptations, which are designed for explaining (...) the abstract and causal structure of complex, unobservable, and uncertain phenomena that have substantial impacts on fitness. Specifically, we argue that (1) mental representations about the abstract vs. the supernatural are largely overlapping, if not identical, and (2) when the data-generating processes for scarce and ambiguous observations are complex and opaque, a naive observer can improve a bias-variance trade-off by starting with a simple, underspecified explanation that Western observers readily interpret as “supernatural.” We then argue that (3) in many cases, knowledge specialists across cultures offer pragmatic services that involve apparently supernatural explanations, and their clients are frequently willing to pay them in a market for useful and effective services. We propose that at least some ethnographic descriptions of religion might actually reflect ordinary and adaptive responses to novel problems such as illnesses and natural disasters, where knowledge specialists possess and apply the best available explanations about phenomena that would otherwise be completely mysterious and unpredictable. This essay examines the relationship between academic and public philosophy through the lens of Heidegger studies. Specifically, this essay: shows how Heidegger uses technical terminology within the context of the academy to break new philosophical ground; explains how suitably clarified technical terminology can be used to introduce people to Heidegger’s philosophy and to apply Heidegger’s ideas to current affairs; and illustrates how the application of Heidegger’s ideas to contemporary issues results in new forms of academic research. Ultimately, this essay argues (...) that there is a dialectical relationship between academic and public philosophy: i.e., public philosophy translates esoteric ideas developed in the academy into publicly accessible prose and then applies those ideas to daily life; but in doing so, public philosophy inspires new lines of academic inquiry. Зокрема, у статті показано, що раціоналізм у політиці передбачає переконання, що розум є непохибним провідником у політичній діяльності і що раціоналіст прагне визначеності та досконалості в політичних справах. Далі (...) у статті висвітлено раціоналістичні тенденції в «Теорії справедливості» Роулза, а також проаналізовано Оукшоттову критику раціоналізму, яку застосовано й до Роулза. Якщо стисло, Оукшотт розрізняє технічне та практичне знання і стверджує, що принципи, з яких складаються технічні керівництва на кшталт «Теорії справедливості», є спрощенням і не замінюють розуміння, яке ми отримуємо через власний практичний досвід та участь у певній політичній традиції. Пояснюючи Оукшоттову критику раціоналізму та позиції Роулза, автор статті демонструє наявність елементів релятивізму у ставленні першого до політичних практик і традицій, а через це – формулює заперечення проти Оукшотта, які міг би висунути прихильник Роулза. In Heidegger on Concepts, Freedom, and Normativity, Sacha Golob criticizes and offers an alternative to the standard interpretation of intentionality in Being and Time. According to Golob, the dominant reading’s derivation of propositional intentionality from practical intentionality fails on textual and philosophical grounds, so he develops a different approach that involves deriving propositional intentionality from prototype intentionality. In this essay, I offer an overview of dominant reading of intentionality in Being and Time and Golob’s alternative account, and then I criticize (...) them both for attempting to derive propositional intentionality for some form of non-propositional intentionality. Finally, I offer my own ontological interpretation of intentionality by arguing that Heidegger’s aim in Being and Time is not to derive one form of intentionality from another but to describe the basic aspects of human existence that make any and all forms of intentionality possible. In The Apocalypse of Wisdom: Louis Bouyer's Theological Recovery of the Cosmos, he offers the English-speaking world for the first time a monograph (...) on the thought of the Oratorian Louis Bouyer. Bouyer is undoubtedly one of the theological giants of the twentieth century. Born in Paris in 1913, he was ordained a Lutheran pastor in 1936. After only three years as a Lutheran clergyman, he was received into the Catholic Church at the Benedictine Abbey of Saint Wandrille. Then ordained as an Oratorian priest in 1944, he taught from 1946 to 1962 at the Institut Catholique de Paris and abroad for the three decades following.1 He is most well-known for his work on the liturgy both before and after the Second Vatican Council. With fifty books to his name, including a nine-part synthesis on Christian doctrine, the breadth of his theological vision and work is astounding. In France he is considered one of the four preeminent theologians of the post-World War II era, and his theological contemporaries in Europe, such as Hans Urs von Balthasar and Joseph Ratzinger / Benedict XVI, always held the Oratorian in high regard.2 Yet, in the English-speaking world, much of his work has gone without comment.3 Thankfully, into the void steps this excellent work by Lemna. [End Page 1353]Anyone familiar with the Bouyerian corpus knows the challenge of approaching it. With its vast array of subject matter, ranging from biblical to liturgical to historical to spiritual to speculative theology, one wonders whether there is any one thread woven throughout the varied strands, a single theme around which the whole sprawling corpus can be understood. In fact, there is, and Lemna has deftly identified it. For Bouyer, the fundamental question of theology is the world's relation to God.4 The structure of the first six books of his nine-part treatise on systematic theology attest to the priority of the question with the first three works addressing the question of the world, or the economy of creation and salvation, and the latter three works addressing the question of God, or theology properly speaking: the doctrine of the Trinitarian God. Interestingly, though Bouyer's work on theological cosmology, Cosmos, is the third book in the series, it was, in fact, the last of the six to be written. In this sense, as Lemna points out, "Cosmos is a capstone monograph... summarizing in important ways the decisive first six volumes" (xiv). Theological cosmology fully illuminates the God–world relation as Bouyer sees it, and since this relation sits at the heart of his thought, Cosmos is for Bouyer both his "most personal, as well as most speculative work" and indeed, "opens up the meaning of his other writings" beyond the dogmatic sphere (25). One could, then, scarcely choose a better entry point into the wide theological world of this "mind with a very special character," as Joseph Ratzinger saw him.5The Apocalypse of Wisdom is an expansive commentary on Bouyer's cosmology at the heart of which is a liturgical, even nuptial, vision of the whole of creation known and loved in the mind of God from all eternity, as the uncreated Wisdom of God. In creation God freely gives existence to the world ex nihilo, so that it might return to him in a liturgical song of praise and thanksgiving, as the Bride of his eternal Son, the eschatological and cosmic Church, created wisdom now made glorious and radiant through the indwelling of the Holy Spirit. As Lemna puts it, "Bouyer shows that cosmology should be a pursuit of wisdom, but that Wisdom is ultimately a gift revealed or uncovered by means of apokalypsis in the re-creative interventions of the divine Word and Holy Spirit in history" (xvii). Berys Gaut has recently articulated and defended a putatively anti-definitional ‘cluster’ theory of art. In the first part of this paper, I argue that Gaut's version of the cluster account is flawed. The key notion of ‘counting toward the application of a concept’ is formulated in such a way that a range of apparently irrelevant properties will count as criterial for the concept of art. Moreover, there does not appear to be any quick fix to this problem. I then turn (...) to an exploration of the relationship between the cluster theory and the possibility of defining art. Gaut has claimed that the truth of the cluster account would provide an independent basis for rejecting the possibility of an adequate definition of art. I argue that this is not the case. But while the truth of the cluster account is consistent with definition, I also argue that it would not entail the definability of art in any ordinary sense. (shrink)

The left ventricular assist device was originally designed to be surgically implanted as a bridge to transplantation for patients with chronic end-stage heart failure. On the basis of the REMATCH trial, the US Food and Drug Administration and the US Centers for Medicare & Medicaid Services approved permanent implantation of the left ventricular assist device as a destination therapy in Medicare beneficiaries who are not candidates for heart transplantation. The use of the left ventricular assist device as a destination therapy (...) raises certain ethical challenges. Left ventricular assist devices can prolong the survival of average recipients compared with optimal medical management of chronic end-stage heart failure. However, the overall quality of life can be adversely affected in some recipients because of serious infections, neurologic complications, and device malfunction. Left ventricular assist devices alter end-of-life trajectories. The caregivers of recipients may experience significant burden (e.g., poor physical health, depression, anxiety, and posttraumatic stress disorder) from destination therapy with left ventricular assist devices. There are also social and financial ramifications for recipients and their families. We advocate early utilization of a palliative care approach and outline prerequisite conditions so that consenting for the use of a left ventricular assist device as a destination therapy is a well informed process. These conditions include: (1) direct participation of a multidisciplinary care team, including palliative care specialists, (2) a concise plan of care for anticipated device-related complications, (3) careful surveillance and counseling for caregiver burden, (4) advance-care planning for anticipated end-of-life trajectories and timing of device deactivation, and (5) a plan to address the long-term financial burden on patients, families, and caregivers. Short-term mechanical circulatory devices (e.g. percutaneous cardiopulmonary bypass, percutaneous ventricular assist devices, etc.) can be initiated in emergency situations as a bridge to permanent implantation of ventricular assist devices in chronic end-stage heart failure. In the absence of first-person (patient) consent, presumed consent or surrogate consent should be used cautiously for the initiation of short-term mechanical circulatory devices in emergency situations as a bridge to permanent implantation of left ventricular assist devices. Future clinical studies of destination therapy with left ventricular assist devices should include measures of recipients' quality of end-of-life care and caregivers' burden. (shrink)
