The law of patents has long struggled with the status of intent in determining liability for infringement. This struggle has recently been given a sharper edge by the emergence of biotechnological products with the inherent ability of auto-dispersal and regeneration. The question thus is whether a person on whose backyard a patented genetic organism has grown without the active intervention of that person is liable in infringement to the patentee of that organism. This article examines the ramifications of the legal (...) conundrum and argues that on a proper construction of the theories of liability in patent law intent to infringe is necessarily crucial if the nature of the subject matter of the patent makes it unjust and absurd to argue otherwise. Overall, the deregulation of genetically engineered (GE) crops for commercial cultivation in North America has been a success story. In several cases, however, GE crops have sparked concerns and disagreements among the stakeholders and there are incidences of court lawsuits, including a recent one on glyphosate resistant (GR) alfalfa (Medicago sativa, L.). While GE crops can provide operational benefits to farmers, challenges are looming from commercialization of perennial GE crops. The unique ecology and biology of these crops and GE alfalfa (...) in particular can facilitate adventitious presence (AP) of GE traits and it makes more visible that economic risks for conventional growers and food/feed producers have not been adequately addressed by the GE regulatory system in the United States (US). Asynchronous market approvals and the existence of a number of GE sensitive export markets create uncertainties among the exporters. Policy development in these fields may be helpful for ensuring a broader acceptance and market success of GE agriculture in general. The analysis is focusing on the US, although many diagnosed problems are also relevant to other jurisdictions—in particular if no co-existence policy is in place. (shrink)

The subject “rule”, which is one of the most fundamental issues of the Islamic legal theory (usūl al-fiqh), has been in the center of methodological debates. There is one important term in this regard, which should be studied very carefully: Khiṭāb(speech) of the God. It is because that, especially since the first period of Islam, it has been taken with some significant terms in the field of Kalāmsuch as Husn (pretty; good), Qubh (ugly; evil), and the quality of God’s talk. Yet, adopting this term in the description of the “rule” shows that Fiqh is based on divine inspiration, and it also emphasizes that even though there are some differences in details, wisdom of human being is not ignored when adjudicating. Moreover, it suggests that the validity or methodological accuracy of the “rule” which is adjudicated with ruling case is related to the connection through the term speech or divine inspiration. In this regard, Kalāmdimension of the term and its affect to legal theoretical discussions are very important in terms of historical process of the definition of the “rule” in Islamic law. In this study, I tried to examine whether or not the term “khiṭābof the God” which is used in the definition of the “rule” formed a limitation for consideration of legal evidence in Islamic law and if there is any limitation for the legal evidence regarding being only in the Qur’ān and the Sunnah due to this definition.SummaryThe “hukm (rule, arbritation, judgment, God’s will)”-as the backbone notion in usūl al-fiqhis one of the significant key notions discussed in the legal theory. After al-Ghazālī, al-Rādī and al-Baydāwī added to al-Ghazālī’s definition the words “iqtidā and takhyīr” and Ibn Hājib added “wad‘an”. Whereas in the Mutakallimun(theologians) tradition, Ibn Hacib's definition was preferred, Fuqaha(jurists) tradition chose two definitions-resembling each other: “Those coming to exist with the khitāb” and “the effect of God’s khitāb”.Along with al-Ghazālī’s definition, the concept of khitābcarved out a niche for itself in it and became the main element of the definition. It is understood that some discussions in the field of theology, such as husn-qubhand God’s attribute of speech have been effective on the interpretation of the concept of khitāb. The Ash‘arilegal theorists argue that the good and evil are not attributes of the self / the acts, whereas the Maturidi legal theorists argue that the exploration and determination of these attributes is rational and thus, the verdict reached via this rationale is lawful. The Maturidi legal theorists initiated the concept of being subject of law with the concept Sharī‘ah and in the line with this opinion; they defined hukmon the basis of khitāb. On the other hand, the Mutazilites’ claiming the attribute of good and evil are inherent feature of the act, did not define hukmon the basis of the khitābaccording to their theological understanding. The word of khitābassessed with God’s eternal speech (al-kalām al-azalī) has been approached from various aspects: for instance, whether the presence of the addressee is mandatory. The early Asharites scholars (mutaqaddimun), in particular Imam Asharī, did not entitle the eternal speech as khitāb. They consider that the presence of the interlocutor is necessary in the conversion of Kalāminto khitāb. The mutaakhirunAsharites (successors of the early Asharites scholars) did not consider the presence of the interlocutor necessary, thus they viewed the eternal speech as khitāb. The former identification of the hukmwith khitābby the early Ashari legal theorists caused to the problem of whether hukmis adventitious or not. Therefore, this approach was criticised by the Mutazilites. On the other hand, the Maturidi and Mutezilite legal theorists accept that hukmis adventitious; hence they do not consider as a problem naming the eternal speech of God as khitāb.When the historical course is examined, it can be said that one of the important aspects of the development of hukm’s definition is the use of khitāb. Khitābin some cases is used without possessive construction, in other cases it is used with possessive construction with God, or in possessive construction with shar’ or Shāri’. The most important one within these possessive constructions is the notion “khitaballah”. Therefore, it is necessary for khitaballahto be approached from the angle of the legal theory. In comparison to other terms, this notion narrowed the scope of the rule down. In the meanwhile, it raised the question: how the rule deduced via legal evidences can be incorporated in khitāb? As a consequence of this question, some legal theorists, such as Tūfī, proposed another definition by adducing this question.Although it is commonly accepted that the rules deduced via other evidences are within the context of the khitāb, there are also different descriptions about the concept of khitaballah. The rule is not limited to khitaballahin the conception of traditional interpretation accepting the khitābas eternal speech or literal speech (al-kalām al-lafzī). Because either all evidences are within the context of the khitāb,which is the eternal speech or other evidences are within the context of the khitāb,which is the literal speech. Thus, each result coming to exist with the other evidences is part of the Islamic law. But not all of these rules are considered equal to each other. Because each rule which is deduced from indisputable origin (qatii al-thubut) and is deduced from completely explicit sources (qatii al-dalala) are accepted as the word of God or the Prophet. On the other hand, other rules deduced via jurisprudence- in other words by jurist’s own value of judgment is viewed as the virtual rule (al-hukm al-zāhir). Such rules do not express absolute certainty. It is unacceptable for these rules to be described as the word of God or the Prophet. In this way, it is clearly understood that the concept of khitaballahmentioned in the description do not introduce restriction to the evidences ofSharī‘ah.We do not see a contradiction when the indefinite rules of Islamic law included in the context of khitāb. Because ijtihāddoes not aim to produce a new rule, on the contrary it functions in order to find out the already existing rules. The legitimacy of the rule obtained through ijtihādemerges from the way that this rule is deduced from the khitāb,which directly or indirectly represents the divine will. In addition, according to us, this legitimacy is not merely limited to versification and conception of the khitāb, but it also includes the function of the reason in (reasonable of the) khitāb. As a matter of fact, trying to solve unlimited cases with limited texts is difficult- in fact this is impossible. The majority of the legal theorists also share this opinion. Then, there is no obstacle in accepting that each rule obtained by authentic source and methodology can be considered part of Islamic law by implicating the rule in the context of khitāb(which represents the divine will) - although it may contain error and presumption. This paper argues that Calvin provides an account of the radical unmaking of the human moral subject at the hands of sin and its even more radical remaking at the hands of divine grace. The moral significance of human continuity during this soteriological transit, including such things as reason and will as such, is shown to be overreached by that of what becomes of the human creature in its history at the hands of both sin and God’s grace. Calvin’s treatment (...) of the first and third uses of the law confirms and illumines this claim decisively. Insight into this matter is aided by consideration of J. Louis Martyn’s discussion of the status of the moral subject in Pauline paraenesis A Reformed theological ethic that takes its cues from Calvin’s teaching in this regard will thus regard the adventitious realities of sin and grace, and their serial consequences for the constitution of the human moral agent, to represent the most important meta-ethical realities to be considered. Philosophers frequently comment on the intimate connection there is between something’s being present in perceptual experience and that thing’s being, or at least appearing to be, temporally present. Yet, there is relatively little existing work that goes beyond asserting such a connection and instead examines its specific nature. In this paper, I suggest that we can make progress on the latter by looking at two more specific debates that have hitherto been conducted largely isolation from each other: one about the (...) nature of conscious experience and one about the nature of time itself. The first concerns the extent to which the temporal properties of experience form an exception to the transparency of experience, meaning that introspection can provide support for one particular view of how experience itself is structured temporally; the second concerns the question as to whether there is something about experience that gives us grounds for thinking that the present is somehow metaphysically special. As I argue, the idea of a connection between experiential presence and temporal presence plays a key background role in each of these debates. Yet it can also, in each of them, be seen to draw one side towards making claims that are supposed to express an important truth but are at the same time, on the face of it, self-contradictory. In each case, resolving what it actually is that these claims are trying to get at turns on recognizing a distinctive feature of perceptual experience, which I refer to as its lack of temporal viewpointedness. Recognising this feature also helps in making sense of what the issues at stake actually are in the intuition of an intimate connection between experiential presence and temporal presence. (shrink)

Epistemological disjunctivists make two strong claims about perceptual experience's epistemic value: experience guarantees the knowledgeable character of perceptual beliefs; experience's epistemic value is “reflectively accessible”. In this paper I develop a form of disjunctivism grounded in a presentational view of experience, on which the epistemic benefits of experience consist in the way perception presents the subject with aspects of her environment. I show that presentational disjunctivism has both dialectical and philosophically fundamental advantages over more traditional expositions. Dialectically, presentational disjunctivism resolves (...) a puzzle disjunctivists face in their posture vis-à-vis skeptical scenarios. More systematically, presentational disjunctivism provides an especially compelling view of disjunctivism as an internalist view of perceptual consciousness by explaining the way perceptual presence manifests the subject's rationality in a distinct way. This paper relates to a formal statement of the mechanisms that are thought minimally necessary to underpin consciousness. This is expressed in the form of axioms. We deem this to be useful if there is ever to be clarity in answering questions about whether this or the other organism is or is not conscious. As usual, axioms are ways of making formal statements of intuitive beliefs and looking, again formally, at the consequences of such beliefs. The use of this style (...) of exposition does not entail a claim to provide a mathematically rigorous formal deductive system. Conventional mathematical notation is used to achieve clarity, although this is elaborated with natural language in an attempt to reduce terseness. In our view, making the approach axiomatic is synonymous with building clear usable tests for consciousness and is therefore a central feature of the paper. The extended scope of this approach is to lay down some essential properties that should be considered when designing machines that could be said to be conscious. In the broader discussion about the nature of consciousness and its neurological mechanisms, it may seem to some that axiomatisation is premature and continues to beg many questions. However, the approach is meant to be open- ended so that others can build further axiomatic clarifications that address the very large number of questions which, in the search for a formal basis for consciousness, still remain to be answered. Of course, in discussions about consciousness many will also argue that the subject is not one that may ever be formally addressed by means of axioms. I shall focus on the Samaniyya's view on epistemology, the Barāhima's rejection of prophecy, and the origins of Islamic Atomism. These seemingly separate topics were all treated by Shlomo Pines throughout his academic career spanning half a century. The light metaphor is a perpetual favorite for philosophers, both East and West. I seek to revaluate its opposite, darkness. I claim that there are good reasons to favor darkness over light, or at least to not see them as mutually incompatible or in hierarchical fashion. In recent Western philosophy, both Heidegger and Derrida argue that what the light metaphor represents, the promise of clarity and objectivity, is exactly what makes Western metaphysics problematic. In Chinese philosophy, classical Daoism offers a (...) thinking that does not favor the light metaphor over its opposite. Daoists have the good sense to acknowledge darkness as a positive contribution to human life, at the very least on par with light. I argue that both the Western criticism of the light metaphor, and the Daoist approach to light and darkness, can be read as challenging the metaphysics of presence and providing an alternative way of thought. This paper considers whether, and if so how, the modelling of joint action in social philosophy – principally in the work of Margaret Gilbert and Michael Bratman – might assist in understanding and applying the concept of concerted practices in European competition law. More specifically, the paper focuses on a well-known difficulty in the application of that concept, namely, distinguishing between concerted practice and rational or intelligent adaptation in oligopolistic markets. The paper argues that although Bratman's model of joint action (...) is more psychologically plausible and phenomenologically resonant, its less demanding character also makes it less useful than Gilbert's in our understanding of the legal concept of concerted practice and in dealing with the above difficulty. The paper proceeds in two parts: first, a discussion of the concept of concerted practices in European competition law; and second, a discussion of Gilbert and' Bratman's models of joint action, including a comparative assessment of their ability to provide an evidentiary target and an evidentiary platform for conceited practices. We experience our encounters with the world and others in different degrees of intensity – the presence of things and others is gradual. I introduce this kind of presence as a ubiquitous feature of every phenomenally conscious experience, as well as a key ingredient of our ‘feeling of being alive’, and distinguish explanatory agendas that might be relevant with regard to this phenomenon (1 – 3). My focus will be the role of the body-brain nexus in realizing these (...) experiences and its treatment in recent accounts of the bodily constitution of experience. Specifically, I compare a sensorimotor approach to perceptual presence that focuses on properties of the moving body (O’Regan 2011; Noë 2012) with a more general enactivism that focuses on properties of the living body (Thompson 2007). First, I develop and discuss a theory of access derived from sensorimotor theory that might be suited to explain the phenomenon of gradual presence. This is a theory that sees the mastery of sensorimotor, bodily engagements with the world as key elements in setting up a phenomenal experience space. I object that in current versions of sensorimotor theory the correlation posited between presence and changes in the subject’s physical relation to the environment is too rigid. Nevertheless I defend the claim that gradual presence is constituted by our temporally extended engagement with the environment (4 – 7). Second, I consider some objections stemming from enactivism with regard to self-regulatory properties of the living body and the phenomenological claim that the organism’s value-laden relations with its environment have to be included in the theory. This paper studies the theories defended by John Buridan and Nicole Oresme on the presence of the soul in the body, with a special focus on the interpretation of the Augustinian principle – or ‘holenmeric’ principle – according to which the soul is in the whole body and is wholly present in every part of it. The first part of the paper introduces the different types of composition involved in the medieval discussions over the soul and its parts and (...) shows how different psychological theories prior to 1350 employed this typology of part/whole relations to clarify the soul’s presence in the body. The next part of the paper presents how the theories designed by John Buridan and Nicole Oresme were motivated by problems raised by these earlier accounts of the soul’s presence and undertook to solve them from the perspective of a reductionist conception of parthood. It is argued that, despite their common commitment to a reductionist stance, the solutions endorsed by Buridan and Oresme represent two opposite ways of applying a nominalist metaphysics of parts to psychological matters. We present an exact solution of the one-dimensional modified Klein Gordon and Duffin Kemmer Petiau equations with a step potential in the presence of minimal length in the uncertainty relation, where the expressions of the new transmission and reflection coefficients are determined for all cases. As an application, the Klein paradox in the presence of minimal length is discussed for all equations.

This paper has two aims. First, I seek to show that Kendall Walton's analysis of the participatory character of our imaginative engagement in games of make-believe provides a powerful explanatory framework that can be used to address some of the central problems that still remain unresolved in contemporary accounts of living-presence response, including those put forward by David Freedberg and Alfred Gell. Second, I argue that Walton's focus on the activities of ‘appreciators’ prevents him from considering the possible application (...) of his theory to other kinds of activity, even where this would permit a genuine enrichment or extension of his position. Once we open up the field of enquiry to include the various ceremonial, civic, religious, and other functions that works of art fulfil, the analogy to the participatory character of games of make-believe becomes stronger rather than weaker. The present investigation aims to elucidate the presence of myth in the work of Eduardo Nicol. This inquiry of course, is something not thought about, since the author in question from the beginning of his philosophy has recognized that the path of thought is beyond myth, that is, it is nuanced by reason and by conceptual rigor. In other words, for him philosophy is about what is phenomenologically accessible and about what is rationally intelligible. Precisely for this reason, one (...) of the names with which Nicol's philosophy is known is under the name of "Metaphysics of expression" by virtue of the fact that what is given is commonly acquired through an expressive or communicative act. However, and despite this conceptual position, the fact is that the presence of myth can be found at the very heart of this philosopher’s philosophy. It should be noted that there is a particular myth that prevails in the clearing of his work, namely the myth of the androgyne. Identifying the determinants of reproductive success in small-scale societies is critical for understanding how natural selection has shaped human evolution and behavior. The available evidence suggests that status-accruing behaviors such as hunting and prosociality are pathways to reproductive success, but social egalitarianism may diminish this pathway. Here we introduce a mixed longitudinal/cross-sectional dataset based on 45 years of research with the Batek, a population of egalitarian rain forest hunter-gatherers in Peninsular Malaysia, and use it to test the effects of four (...) predictors of lifetime reproductive success: foraging return rate, sharing proclivity, cooperative foraging tendency, and kin presence. We found that none of these factors can explain variation in lifetime reproduction among males or females. We suggest that social egalitarianism, combined with strikingly low infant and juvenile mortality rates, can mediate the pathway between foraging, status-accruing behavior, and reproductive success. Our approach advocates for greater theoretical and empirical attention to quantitative social network measures, female foraging, and fitness outcomes. (shrink)

In the Physics, Aristotle says that there is no change associated with the category of relatives. In this paper, I examine a widespread but neglected strategy that medieval thinkers use to understand Aristotle’s claim. According to this strategy, which I label initial presence, if there is no change in the category of relatives, it is because the relation-properties are already present in their subject as soon as the properties on which relation-properties are founded exist. Appreciating the importance of this (...) strategy is crucial not only for understanding medieval theories of relation but also for assessing the credibility of arguments used in the secondary literature to interpret medieval texts, in particular a well-known passage from Thomas Aquinas’s commentary on the Physics. The advantage of employing Mahāyāna philosophy (...) in the doing of Christian theology is that this philosophical tradition developed with the dual purpose of supporting and encouraging faith and practice while eliminating absolutist claims for metaphysically fixed and unalterable ideas.Mahāyāna is deconstructive without any of the aloofness that modern French philosophers apparently feel they must adopt vis-à-vis theology and the Church. Just as Plato did for the Fathers of the early church and Aristotle did for Aquinas, Mahāyāna opens avenues of thought and questioning for contemporary theologians that will gift our cultures with the grace of new theological insight into the meaning of Christ's presence to and among human beings.And so I would like to do some theology here, demonstrating how a Mahāyāna thinker like myself might envisage the real presence of Jesus in the Eucharist.The Real Presence of ChristThe theology of the real presence of Jesus in the Eucharist has had a long and fascinating development. For the first eight centuries, the issue did not arise with any doctrinal insistence.1 Christians were content to see Christ's presence in the performance of the Eucharistic rite as a medicine of immortality that would heal their souls and embody for them the reality of the risen Christ. It was only later, in the condemnation of the theologian Ratramnus2 and the development of the doctrine of transubstantiation, that the classical formulation took shape.3 That doctrine was expressed in philosophic terms that were then current, concepts that were accepted as clear and valid frameworks for thinking.Medieval theologians, especially the great St. Thomas Aquinas in the thirteenth [End Page 89] century, had just rediscovered Aristotle and gloried in the subtle intricacies and vast overviews that this "new" learning provided them.4 They philosophized by seeking insight into and defining the very act of existence itself, discussing the "essences," or "substances" of things as the underlying realities that we encounter in our life and in our faith. In this view, Christ "subsists"—that is, he really exists—as the substance of the bread and wine in the Eucharist. This is the philosophic view that is stressed even today in the Roman Catholic Church. Modern Catholic theologian Bernard Cooke explains the real presence of Christ in the Eucharist as follows:Christ bespeaks in the action of the Mass the presence of his own risen body beneath the appearance of food and drink. He effects this by changing the inner reality (the "substance") of the bread and wine into his risen humanity. This is the unique change that the Church has for centuries called transubstantiation—the change of the substance of the bread into the substance of Christ's risen body. Before the transubstantiation in the Mass, the inner reality (the substance) of the bread and wine is what sustains the external appearances in existence. These appearances tell us of the presence of the inner reality of bread and wine (which itself is not visible). After the transubstantiation, the risen humanity of Christ is what sustains these external appearances in existence. Consequently, they now tell us of the presence of Christ.5The disputes about the real presence of Christ in the Eucharist hinged precisely on this issue—what is the inner reality of the sacrament? ABSTRACT Present-day fixations on “embodied minds,” and “enactive” assessments of life fail to recognize alive, moving bodies, precisely as James Joyce implicitly shows in his experience-anchored descriptions of the ineluctable modality of the visual and of the audible. Joyce's experience-anchored descriptions accord with Edmund Husserl's renditions of “the kinestheses” and their integral relationship to perception and to the development of agency. They furthermore accord with John Dewey's writing on aesthetics that describe the immediacy of motion into sense and sense into (...) motion in both nonhuman animal life and aesthetic experience. William James's connection of the stream of thinking with the stream of breathing is in further accord. Such accords show that animate forms of life are essentially mindful bodies sensuously and affectively attuned to their surrounding world. Cave art, both its creation and appreciation, is further testimony to mindful bodies as is internationally known musician Roger Sessions eloquent descriptions documenting the integrality of movement to all the arts. Humans are by nature social beings tuned to communicate and interact from the very beginning of their lives. The sense of touch represents the most direct and intimate channel of communication and a powerful means of connection between the self and the others. In our digital age, the development and diffusion of internet-based technologies and virtual environments offer new opportunities of communication overcoming physical distance. It however, happens that social interactions are often mediated, and the tactile aspects of communication are (...) overlooked, thus diminishing the feeling of social presence, which may contribute to an increased sense of social disconnection and loneliness. The current manuscript aims to review the extant literature about the socio-affective dimension of touch and current advancements in interactive virtual environments in order to provide a new perspective on multisensory virtual communication. Specifically, we suggest that interpersonal affective touch might critically impact virtual social exchanges, promoting a sense of co-presence and social connection between individuals, possibly overcoming feelings of sensory loneliness. This topic of investigation will be of crucial relevance from a theoretical perspective aiming to understand how we integrate multisensory signals in processing and making sense of interpersonal exchanges, this is important in both typical and atypical populations. Moreover, it will pave the way to promising applications by exploring the possibility to use technical innovations to communicate more interactively in the case of people who suffer from social isolation and disconnection from others. Internet-enabled mobile devices expand the virtual spaces of Internet users. Mobile Internet users encounter continuous connectivity where they are not only always on but also always with the device. Users are presented with situations of continuous connected presence requiring them to deal with the overwhelming volume of virtual interaction. This study reports from a longitudinal study of 35 university students in Australia conducted in 2011/2012. Mobile tablet devices were given to participants who had never owned one before, to be (...) observed over a period of 1 year. By qualitatively exploring how users experience and negotiate with the added virtual space, this study found that while users benefit from continuous connectivity, they also adopt strategies to disconnect from the ubiquitous access especially when engaging in tasks that require undivided attention. New users go through adjustment by developing their own involvement shield strategies while experimenting with online colocation and copresence. (shrink)

Family therapists face a number of challenges in their work. When children are present in family therapy they can and do make fleeting contributions. We draw upon naturally occurring family therapy sessions to explore the ‘pseudo-presence’ and ‘pseudo-absence’ of children and the institutional ‘gossiping’ quality these interactions have. Our findings illustrate that a core characteristic of gossiping is its functional role in building alignments’ which in this institutional context is utilized as a way of managing accountability. Understanding the neuromechanical responses to perturbations in humans may help to explain the reported improvements in stability performance and muscle strength after perturbation-based training. In this study, we investigated the effects of perturbations, induced by unstable surfaces, on the mechanical loading and the modular organization of motor control in the lower limb muscles during lunging forward and backward. Fifteen healthy adults performed 50 forward and 50 backward lunges on stable and unstable ground. Ground reaction forces, joint kinematics, and the electromyogram (...) of 13 lower limb muscles were recorded. We calculated the resultant joint moments and extracted muscle synergies from the stepping limb. We found sparse alterations in the resultant joint moments and EMG activity, indicating a little if any effect of perturbations on muscle mechanical loading. The time-dependent structure of the muscle synergy responsible for the stabilization of the body was modified in the perturbed lunges by a shift in the center of activity and a widening. Moreover, in the perturbed backward lunge, the synergy related to the body weight acceptance was not present. The found modulation of the modular organization of motor control in the unstable condition and related minor alteration in joint kinetics indicates increased control robustness that allowed the participants to maintain functionality in postural challenging settings. Triggering specific modulations in motor control to regulate robustness in the presence of perturbations may be associated with the reported benefits of perturbation-based training. (shrink)

Prior research suggests that the presence of high-quality auditors constrains accrual-based earnings management, but it inadvertently leads to higher real activities manipulation. We investigate whether such trade-off exists between accrual-based and real earnings management activities in the presence of female or male auditors. We use a sample of UK firms for the period 2009 to 2016 and find that firms audited by female auditors do not resort to a higher-level real activities manipulation when their ability to engage in (...) accruals management is constrained. The origins of this notion are traced to 17th century Puritan settlers, who used the metaphor of being "a city upon a hill" to highlight their position as a moral example to the rest of the world. This element (...) from a sacral religion was transformed during the founding of the United States into an element of civil religion, and as such the metaphor and concept of American exceptionalism received a political connotation. The rise of America's political power coincided with a more active role in world politics, which was backed with a rhetoric emphasising unity and America's unique role. The clash between the passive and the more active reading of the exceptionalist metaphor and the struggles between sacral and civil religion coincide during the presidency of George W. Bush. The presence of these elements of political rhetoric is surveyed in a corpus of speeches by President Bush. (shrink)

Smart lighting systems utilize advanced data, control, and communication technologies and allow users to control lights in new ways. However, achieving user comfort, which should be the focus of smart lighting research, is challenging. One cause is the passive infrared sensor that inaccurately detects human presence to control artificial lighting. We propose a novel classification-integrated moving average model method to solve the problem. The moving average increases the Pearson correlation coefficient of motion sensor features to human presence. The (...) classification model is for a smart lighting intelligent control based on these features. Several classification models are proposed and compared, namely, k-nearest neighbor, support vector machine, decision tree, näive Bayes, and ensemble voting. We build an Internet of things system to collect movement data. It consists of a PIR sensor, a NodeMCU microcontroller, a Raspberry Pi-based platform, a relay, and LED lighting. With a sampling rate of 10 seconds and a collection period of 7 days, the system achieved 56852 data records. In the PC test, movement data from the PIR sensor has a correlation coefficient of 0.36 to attendance, while the MA correlation to attendance can reach 0.56. In an exhaustive search of an optimum classification model, KNN has the best and the most robust performance, with an accuracy of 99.8%. It is more accurate than direct light control decisions based on motion sensors, which are 67.6%. Our proposed method can increase the correlation value of movement features on attendance. At the same time, an accurate and robust KNN classification model is applicable for human presence-based smart lighting control. (shrink)

This note examines the theory of optimal insurance purchasing in the presence of a nonpecuniary background risk. The occurrence of the qualitative uninsurable background loss can increase, decrease or can leave the marginal utility of wealth unchanged, whereas a financial background loss (as in Doherty and Schlesinger, 1883a) always increases it. Existing theorems on the optimal level of insurance and the optimal form of insurance contracts are shown to hold only under restrictive assumptions on the correlation level between risks. (...) It has been found in many cases that consumers are prone to exhibit impulsive buying behavior that is manifested as being immediate, emotional, and irresponsible especially under short video scenario. Supported by the customer inspiration theory, this study explores the psychological mechanism underlying impulse purchase in short videos that differentiates the traditional web shopping by the strong sense of presence in short video marketing. On the basis of a questionnaire survey and three laboratory experiments, this study examines the relationship (...) among presence, customer inspiration, and impulse purchase intention. The empirical results point to the fact that social presence, co-presence, and physical presence have significant positive effects on impulse purchase intention, and customer inspiration mediates the effect of social presence, physical presence, and co-presence on impulse purchase intention. Furthermore, it is indicated that social and co-presence have stronger influences on impulse purchase intention than physical presence, thus proving a stronger effect of social factors on impulse purchase intention than physical factors in short video environment. The research results testify the impact of presence on consumer behavior in the upgrading short video marketing and provide valuable reference for marketing strategies to shorten consumers' decision-making time in short video purchase. Résumé La notion de Mythe du Donné, due initialement à Wilfrid Sellars, a été conçue comme un repoussoir pour une théorie adéquate de la perception et de son rapport au jugement (ou à la croyance). Dans cet essai, j’examine la reformulation du Mythe du Donné proposée récemment par John McDowell. La seule manière d’échapper au Mythe, selon McDowell, est de considérer le contenu de l’expérience perceptive comme étant à la fois conceptuel et intuitionnel, alors que le contenu du jugement est (...) conceptuel et propositionnel. Je critique l’approche de McDowell, en désamorçant l’une des motivations en faveur de l’existence du contenu intuitionnel, à savoir la prise en compte de la phénoménologie de la présence perceptive. Je défends la thèse selon laquelle la présence perceptive est un sentiment ou ressenti extérieur au contenu perceptif, voire à l’expérience perceptive elle-même. Cette thèse présente l’avantage de nous ramener aux raisons principales de différencier le contenu perçu du contenu jugé, qui sont d’ordre épistémologique. Like many readers, I sympathize with Charles Altieri's attempt in "Presence and Reference in a Literary Text"1 to correct Derrida's assimilation of poetry to linguistic "freeplay without origin." But Altieri's "middle ground" solution is at best a stopgap measure, delaying the deconstructionist project but not finally answering it. Altieri agrees with Derrida that "language is not primarily a set of pictures ideally mirroring a world" . But he resists the conclusion that for Derrida follows from this premise, namely, that (...) poems are consequently self-referential and antimimetic. Instead Altieri adopts a position between these two extremes, seeing in art the representation not of reality but of the "stances" we take toward our world. Poems reveal "the qualities of human actions" . Medical trainees should learn from the actions of Nazi physicians to inform a more just contemporary practice by examining the subtle assumptions, or moral orientations, that led to such heinous actions. One important moral orientation that still informs contemporary medical practice is the moral orientation of elimination in response to suffering patients. We propose that the moral orientation of presence, described by theologian Stanley Hauerwas, provides a more fitting response to suffering patients, in spite of the significant barriers to (...) enacting such a moral orientation for contemporary trainees. This paper develops an adaptive fixed-time trajectory tracking controller of an underactuated hovercraft with a prescribed performance in the presence of model uncertainties and unknown time-varying environment disturbances. It is the first time that the proposed method is applied to the motion control of the hovercraft. To begin with, based on the hovercraft's four degrees of freedom model, the virtual control laws are designed using an error transforming function and the fixed-time stability theory to guarantee that the position tracking (...) errors are constrained within the prescribed convergence rates and minimum overshoot. In addition, by combining the Lyapunov direct method and the adaptive radial basis function neural network, the actual control laws are designed to ensure that the velocity tracking errors converge to a small region containing zero while handling model uncertainties and external disturbances effectively. Finally, all tracking errors of the closed-loop system are uniformly ultimately bounded and fixed-time convergent. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 63.1 (2002) 63-82 [Access article in PDF] Faith, Philosophy, and the Nominalist Background to Luther's Defense of the Real Presence Thomas Osborne Recent scholarship has brought into question the traditional interpretation of Luther as being hostile towards philosophy. 1 Graham White claims that Luther holds a place in the history of logic as a member of the Nominalist tradition. 2 Bruce D. (...) Marshall argues that Luther and Thomas Aquinas fundamentally agree on the relationship between faith and reason. 3 Both scholars recognize that Luther himself stressed the importance of logic and used late medieval philosophical techniques. Although I agree with this scholarship that Luther's thought must not be understood in isolation from late medieval thought, I will argue that Luther uses philosophical ideas in a way which conflicts with that of the scholastic tradition. The focus here is on Luther's understanding of the relationship between faith and reason in the context of Luther's controversy over the Eucharist with the Swiss sacramentarians, among whom Zwingli and Oecolampadius were the most prominent. 4 Although Luther uses philosophical [End Page 63] distinctions to argue against what he thinks are misinterpretations of the Bible, he does not in any explicit and systematic way use philosophy to arrive at a theological understanding of the Eucharist. But D'Ailly and the Nominalists argue that we know from Church authority that the real presence occurs through transubstantiation. On this issue the Nominalists differ from Thomas Aquinas, who gives philosophically-based arguments against consubstantiation. 7 When Luther attacks Thomas, he attacks not so much the use of philosophy in theology as Thomas's philosophy: "But this opinion of Thomas hangs so completely in the air without support of Scripture or reason that it seems to me he knows neither his philosophy nor his dialectic." 8Since the Nominalist belief in transubstantiation rather than consubstantiation rests on an acceptance of Church authority, the rejection of such authority would seem to lead to a rejection of transubstantiation. ABSTRACTSolving a conflict between two response options in an interference task has been found to increase control in a subsequent conflict situation. The present research examined whether such conflict adaptation persists in the presence of distractors that have motivational relevance and are therefore competing for attentional resources. In an adjusted flanker task, motivational distractors were presented together with the current trial while the previous trial never included any distractor. Accumulated evidence across three studies showed that motivational distractors reduced the (...) conflict adaptation effect. A new form of visual representation of divine others is emerging: photography. I examine here a set of photos of deities related to an apparition claim. The goal I pursue is to analyze the self-constitutive features of these pictures – how they produce what they claim to be. I argue that the “presence' of the deities in the photos is achieved through “incarnation practices.' But these pictures are not just a factual representation of alleged mystical events. They constitute an (...) update and a variation on the “Grand Christian Narrative' wherein the factual poses the moral problem of belief. This Article offers an integrated analysis of the combined effect of the presence of migration bans and the absence of BLAs in domestic work in the emigration regime of Nepal. It identifies, acknowledges, critiques, and contributes to the critical literature highlighting entrapment processes in labor relations and immigration regimes by demonstrating the presence of such in the emigration regime. Drawing on the empirical findings of a participatory action research project conducted in Nepal, the Article demonstrates how restrictive emigration (...) policies and practices entail entrapment processes constitutive of the existing historical, cultural, gendered, racialized, and classed constraints impacting the lives of Nepalese citizens. The Article contributes to the critical literature that seeks to advance migrants’ rights, arguing that experiencing, encountering and escaping entrapment processes in the emigration regime impacts their agency when navigating immigration regimes and labor relations. Taking my cue from Hannah's Child: A Theologian's Memoir, I discuss the struggles Stanley Hauerwas experiences in trying to identify a place he can call home. The memoir suggests that his academic endeavours have taken Hauerwas far from his hometown, Pleasant Grove, Texas. The book shows, however, that places such as Pleasant Grove function for Hauerwas as anticipations of the heavenly eschaton. To suggest that Christians have no home here on earth does not take into account sufficiently the “real (...) class='Hi'>presence” of the heavenly future in everyday realities, such as Stanley's love of Paula Gilbert and a person's appropriate affection of his country. The aim of this paper is to discuss the presence of psychoanalysis in Adorno’s ’Philosophy of the new music’. He draws on the Benjaminian scheme of understanding Baudelaire’s poetry (understood as an elaboration of the shock experiences in life in post-industrial Revolution capitalism), but uses it in music criticism. The works of Schönberg and Stravinsky, the mostimportant composers of two schools of the so-called “new or modern music”, deals with different compositional subjects and their ways of dealing with the (...) shocks of modern life. Both Benjamin and Adorno draw on Freudian theory for the understanding of this notion of shock, in particular his theory of anxiety and trauma. The works of these composers, understood as models of trauma elaboration, offer different ways of reacting to trauma: the identification with the aggressor and resistance. Therein lie elements that help to defend the hypothesis of the centrality of the notion of suffering in Adorno’swork. (shrink)

The falsifiability of theistic assertions no longer appears to be the burning issue it once was, and perhaps this is all to the good. For one thing, it was never entirely clear just what demand was being made of the theist. In this paper I shall not discuss the nature or legitimacy of the falsification requirement as applied to theistic assertions. Instead I shall argue that some of the reasons which have been offered to show that these assertions are not (...) falsifiable are by no means conclusive. Since the most plausible bit of anti-theistic evidence is the existence of evil, it would seem to be legitimate for us to devote our attention to arguments which are designed to show that the theist does not allow the presence of evil to count against his claims.
