Here the philosopher and physicist David Z Albert argues, among other things, that the difference between past and future can be understood as a mechanical phenomenon of nature and that quantum mechanics makes it impossible to present the entirety of what can be said about the world as a narrative of “befores” and “afters.”.

This book is an attempt to get to the bottom of an acute and perennial tension between our best scientific pictures of the fundamental physical structure of the world and our everyday empirical experience of it. The trouble is about the direction of time. The situation (very briefly) is that it is a consequence of almost every one of those fundamental scientific pictures--and that it is at the same time radically at odds with our common sense--that whatever can happen can (...) just as naturally happen backwards. Albert provides an unprecedentedly clear, lively, and systematic new account--in the context of a Newtonian-Mechanical picture of the world--of the ultimate origins of the statistical regularities we see around us, of the temporal irreversibility of the Second Law of Thermodynamics, of the asymmetries in our epistemic access to the past and the future, and of our conviction that by acting now we can affect the future but not the past. Then, in the final section of the book, he generalizes the Newtonian picture to the quantum-mechanical case and (most interestingly) suggests a very deep potential connection between the problem of the direction of time and the quantum-mechanical measurement problem. Once upon a time, the twentieth-century investigations of the behaviors of sub-atomic particles were thought to have established that there can be no such thing as an objective, observer-independent, scientifically realist, empirically adequate picture of the physical world.

In medical ethics, business ethics, and some branches of political philosophy (multi-culturalism, issues of just allocation, and equitable distribution) the literature increasingly combines insights from ethics and the social sciences. Some authors in medical ethics even speak of a new phase in the history of ethics, hailing "empirical ethics" as a logical next step in the development of practical ethics after the turn to "applied ethics." The name empirical ethics is ill-chosen because of its associations with "descriptive ethics." Unlike descriptive (...) ethics, however, empirical ethics aims to be both descriptive and normative. The first question on which I focus is what kind of empirical research is used by empirical ethics and for which purposes. I argue that the ultimate aim of all empirical ethics is to improve the context-sensitivity of ethics. The second question is whether empirical ethics is essentially connected with specific positions in meta-ethics. I show that in some kinds of meta-ethical theories, which I categorize as broad contextualist theories, there is an intrinsic need for connecting normative ethics with empirical social research. But context-sensitivity is a goal that can be aimed for from any meta-ethical position. (shrink)

Albert and De Ruiter provide an introduction to the Conversation Analytic approach to ‘repair’: the ways in which people detect and deal with troubles in speaking, hearing and understanding in conversation. They explain the basic turn‐taking structures involved, provide examples, explain recent developments in the field and highlight some important points of contact and contrast with work in the Cognitive Sciences.

This paper challenges the traditional assumption that descriptive and prescriptive sciences are essentially distinct by presenting a study on the implicit normativity of the production and presentation of biomedical scientific facts within evidence-based medicine. This interdisciplinary study serves as an illustration of the potential worth of the concept of implicit normativity for bioethics in general and for integrated empirical ethics research in particular. It demonstrates how both the production and presentation of scientific information in an evidence-based decision-support contain implicit presuppositions (...) and values, which pre-structure the moral environment of the clinical process of decision-making. As a consequence, the evidence-based decision support did not only support the clinical decision-making process; it also transformed it in a morally significant way. This phenomenon undermines the assumption within much of the literature on patient autonomy that information disclosure is a conditional requirement before patient autonomy even starts; patient autonomy is already influenced during the production and presentation of information. These results imply an increased responsibility of those who produce and present evidence-based facts(i.e. scientists in general and physicians in particular). The insights of this study not only involve a different focus on both theory and practice of patient autonomy and informed consent, but they also call for a broader scope of morality than does traditional empirical research in bioethics. The concept of implicit normativity within integrated empirical ethics research calls for a strong cooperation between bioethicists and descriptive scientists, i.e., a cooperation that goes beyond the discipline-specific epistemic values and that takes place during all phases of the research process. In the recent literature on concepts, two extreme positions concerning animal minds are predominant: the one that animals possess neither concepts nor beliefs, and the one that some animals possess concepts as well as beliefs. A characteristic feature of this controversy is the lack of consensus on the criteria for possessing a concept or having a belief. Addressing this deficit, we propose a new theory of concepts which takes recent case studies of complex animal behavior into account. The main aim (...) of the paper is to present an epistemic theory of concepts and to defend a detailed theory of criteria for having concepts. The distinction between nonconceptual, conceptual, and propositional representations is inherent to this theory. Accordingly, it can be reasonably argued that some animals, e.g., grey parrots and apes, operate on conceptual representations. (shrink)

Human self-consciousness operates at different levels of complexity and at least comprises five different levels of representational processes. These five levels are nonconceptual representation, conceptual representation, sentential representation, meta-representation, and iterative meta-representation. These different levels of representation can be operationalized by taking a first-person-perspective that is involved in representational processes on different levels of complexity. We refer to experiments that operationalize a first-person-perspective on the level of conceptual and meta-representational self-consciousness. Interestingly, these experiments show converging evidence for a recruitment of (...) medial cortical and parietal regions during taking a first-person-perspective, even when operating on different degrees of complexity. These data lend support for the speculative hypothesis, that there exist a neural signature for human self-consciousness that is recruited independent from the degree of representational complexity to be performed. In this article I examine the consequences of the dominance of intuitive thinking in moral judging and deciding for the role of moral reasoning in moral education. I argue that evidence for the reliability of moral intuitions is lacking. We cannot determine when we can trust our intuitive moral judgements. Deliberate and critical reasoning is needed, but it cannot replace intuitive thinking. Following Robin Hogarth, I argue that intuitive judgements can be improved. The expertise model for moral development, proposed by (...) Hubert and Stuart Dreyfus, not only teaches us how we acquire intuitive moral judgements, it also shows the interconnectedness of intuitive thinking and deliberate reasoning. Analysing the expertise model in more detail, I show that it cannot do justice to the importance of reasoning skills. Reasoning skills are needed because we expect people to be able to argue for their standpoints. I conclude that moral education should not only aim at improving intuitive moral judgements, but also at acquiring reasoning skills. (shrink)

How can we solve the paradox of false-belief understanding: if infants pass the implicit false belief task by nonverbal behavioural responses why do they nonetheless typically fail the explicit FBT till they are 4 years old? Starting with the divide between situational and cognitive accounts of the development of false-belief understanding, we argue that we need to consider both situational and internal cognitive factors together and describe their interaction to adequately explain the development of children’s Theory of Mind ability. We (...) then argue that a further challenge is raised for existing accounts by helping behaviour versions of the FBT. We argue that the common two-stage accounts are inadequate: we need to allow for three central stages in a continuous development. Furthermore, drawing on Perner et al.’s and Perner and Leahy’s : 491–508, 2016) recent mental files account, we provide a new account of the development of these three stages of ToM ability by describing the changes of the structure and organisation of mental files including the systematic triggering role of types of situations. Thereby we aim to establish a situational mental file account as a new and adequate solution to the paradox of false-belief understanding. (shrink)

The literature on ethical decision-making is rooted in a cognitive perspective that emphasizes the role of moral judgment. Recent research in interpersonal dynamics, however, has suggested that ethics revolves around an individual’s perceptions and views of others. We draw from both literatures to propose and empirically examine a contingent model. We theorize that whether the individual relies on cognitions about the ethical issue or perceptions of others depends on the level of social consensus surrounding the issue. We test our hypotheses (...) in three studies. Results suggest that not only does social consensus determine whether an individual relies on ethical cognitions about the issue or perceptions of others, but also that an individual’s view of self is an important moderator in these relationships. Focusing democratic theory on the pressing issue of punishment, Punishment, Participatory Democracy, and the Jury argues for participatory institutional designs as antidotes to the American penal state. Citizen action in institutions like the jury and restorative justice programs can foster the attunement, reflectiveness, and full-bodied communication needed as foundations for widespread civic responsibility for criminal justice.

What exactly do we do when we try to make sense of other people e.g. by ascribing mental states like beliefs and desires to them? After a short criticism of Theory-Theory, Interaction Theory and the Narrative Theory of understanding others as well as an extended criticism of the Simulation Theory in Goldman's recent version (2006), we suggest an alternative approach: the Person Model Theory . Person models are the basis for our ability to register and evaluate persons having mental as (...) well as physical properties. We argue that there are two kinds of person models, nonconceptual person schemata and conceptual person images , and both types of models can be developed for individuals as well as for groups. Hans Albert is the leading critical rationalist in the German-speaking world and the main critic of the hermeneutic tradition. He is well-known for applying the idea of critical reason to various kinds of human practice, including economics, politics, and law. But he has also improved on Popper's methodology by introducing the idea of rational heuristics. This collection of essays presents the core of his work on epistemology, philosophy of the social sciences, philosophy of religion, and philosophy of law. Most (...) of Albert's works have not been available in English. It is enormously useful to have these articles collected in a single volume. (shrink)

This essay seeks to show that military strategists have not only been acute philosophers of space but also philosophers of world history. The works of Albert Speer, Friedrich Ratzel, A. T. Mahan, Halford Mackinder, Carl Schmitt, Guilio Duohet, and Harlan K. Ullman are considered in terms of the ways in which space has been militarized, or rather how war spatializes world history. The geography of world history has been the topos of war.

I distinguish between two conceptually different kinds of physical space: a space of ordinary material bodies, which is the space of points at which I could imaginably place the tip of my finger, or the center of a billiard-ball, and a space of elementary physical determinables, which is the smallest space of points such that stipulating what is happening at each one of those points, at every time, amounts to an exhaustive physical history of the universe. In all classical physical (...) theories, these two spaces happen to coincide – and what we mean by calling a theory “classical”, and all we mean by calling a theory “classical”, is precisely that these two spaces coincide. But once the distinction between these two spaces in on the table, it becomes clear that there is no logical or conceptual reason why they must coincide – and it turns out that a very simple way of pulling them apart from one another gives us quantum mechanics. According to some proponents of an empirical medical ethics, medical ethics should take the experience, insights, and arguments of doctors and other medical practitioners as their point of departure. Medical practitioners are supposed to have ‘moral wisdom.’ In this view, the moral beliefs of medical practitioners have a special status. In sections I-IV, I discuss two possible defences of such a status. The first defence is based on the special status of the moral beliefs of the health professional as an (...) expert in medical ethics, and the second defence on the special status of the health professional’s moral beliefs as a practitioner. The first defence is built up around the opposition between experts and laypersons, while the second defence rests on the opposition between practitioners and theorists. In sections V and VI, I examine the interrelations between empirical ethics and anti-theory in ethics. Some regard empirical ethics as a laudable alternative to theory-driven normative ethics. I explore their objections against ethical theory and ethical theorising, and conclude that they are not valid. In the last section, VII, I discuss the role of ethicists in medical practice. There is an ongoing debate in animalethics on the meaning and scope of animalwelfare. In certain broader views, leading anatural life through the development of naturalcapabilities is also headed under the conceptof animal welfare. I argue that a concern forthe development of natural capabilities of ananimal such as expressed when living freelyshould be distinguished from the preservationof the naturalness of its behavior andappearance. However, it is not always clearwhere a plea for natural living changes overinto a plea for the preservation (...) of theirnaturalness or wildness. In the first part ofthis article, I examine to what extent theconcerns for natural living meet ``theexperience requirement.'' I conclude that someof these concerns go beyond welfare. In thesecond part of the article. I ask whether wehave moral reasons to respect concernsfor the naturalness of an animal's living thattranscend its welfare. I argue that the moralrelevance of such considerations can be graspedwhen we see animals as entities bearingnon-moral intrinsic values. In my view the``natural'' appearance and behavior of an animalmay embody intrinsic values. Caring for ananimal's naturalness should then be understoodas caring for such intrinsic values. Intrinsicvalues provide moral reasons for action iffthey are seen as constitutive of the good lifefor humans. I conclude by reinterpreting,within the framework of a perfectionist ethicaltheory, the notion of indirect dutiesregarding animals, which go beyond andsupplement the direct duties towardsanimals. This paper compares the ethical standards reported by consumers and managers with different attachment styles (secure, preoccupied, fearful, or dismissing). We conducted two studies of consumer ethical beliefs and a third managerial survey. In Study 1, we used a questionnaire that we constructed, and in Study 2, we used the Muncy–Vitell Consumer Ethics Scale. The results in both the studies were consistent and showed that men reported a greater indifference to ethical transgressions than women. Based on the two studies, the (...) results indicate that␣among male consumers, the dismissing participants reported the greatest overall indifference to ethical transgressions and the secure participants expressed the most ethical beliefs. The two intermediate groups did not differ significantly from each other. In Study 1, none of the women consumers reported a dismissing attachment style. Women with a secure style reported more ethical beliefs than those in the other two groups. However, the sample in Study 2 included dismissing women. The dismissing women reported the greatest overall indifference to ethical transgressions and the secure women expressed the most ethical beliefs. The illegal profit subscale described the most severe ethical transgressions, and for both men and women, the secure participants were less apt than the other participants to report a willingness to transgress. In Study 3, the Newstrom and Ruch (1975, MSU Business Topics, Winter, 31) Questionnaire was administered to 227 managers. All four attachment patterns were represented among the participants of both genders. In all cases, the participants with a dismissing attachment style showed the greatest readiness to transgress. In the Netherlands, the policy of supporting the efforts of ethnic-cultural minorities to express and preserve their cultural distinctiveness, is nowadays considered as problematic because it might interfere with their integration into the wider society. The primary aim is now to reduce these groups' unemployment rate and to stimulate their participation in the wider society. In this article I consider how the notion of the intrinsic value of cultures, if sensible, might affect the policy regarding ethnic-cultural minorities. I develop a (...) theory of intrinsic value of culture, as an analogy of the theory of intrinsic value of non-human natural entities. My conclusion is that the dominant cultural group in the Netherlands should preserve clearly deviant minority cultures which have considerable intrinsic value. (shrink)

: As the fifth national bioethics commission has concluded its work and a sixth is currently underway, it is time to step back and consider appropriate measures of success. This paper argues that standard measures of commissions' influence fail to fully assess their role as public forums. From the perspective of democratic theory, a critical dimension of this role is public engagement: the ability of a commission to address the concerns of the general public, to learn how average citizens resolve (...) moral issues in healthcare, and to monitor public opinion on the topics addressed in the commission. Such a public forum role is supported by the critical literature within bioethics, which has deemed some commissions successful, supported more generally by the history of bioethics as a reform discourse that has brought socially important values into the medical domain, and supported more generally still by the example of the great social issues commissions of the 1960s. Kant contends that necessity is a criterion of the a priori—that is, that all knowledge of necessary propositions is a priori. This contention, together with two others that Kant took to be evident—we know some mathematical propositions and such propositions are necessary—leads directly to the conclusion that some knowledge is a priori. Although many contemporary philosophers endorse Kant’s criterion, supporting arguments are hard to come by. Gordon Barnes provides one of the few examples. My purpose in this chapter is to (...) articulate and examine his argument. I have two goals in doing so. The first is to uncover several significant gaps in the argument. The second is to show that it suffers from a common defect in rationalist arguments. If the argument were successful against empiricist accounts of modal knowledge, it would apply with equal force to extant rationalist accounts of such knowledge. Hence, the cost of refuting modal empiricism is modal scepticism. (shrink)

This essay asks if there is a role for an active public in ratcheting down the harsh politics of crime control in the United States and the United Kingdom that has led to increased use of the criminal law and greater severity in punishment. It considers two opposing answers offered by political and legal theorists and then begins to develop a participatory democratic framework for institutional reform.

Human linguistic phenomenon is at one and the same time an individual, social, and political fact. As such, its study should bear in mind these complex interrelations, which are produced inside the framework of the sociocultural and historical ecosystem of each human community. Understanding this phenomenon is often no easy task, due to the range of elements involved and their interrelations. The absence of valid, clearly developed paradigms adds to the problem and means that the theoretical conclusions that emerge may (...) be unclear on certain points. It is true that in the last fifty years sociolinguistic studies have advanced considerably, and today we have access to an impressive set of data and a wide variety of theoretical reflections. But as a discipline sociolinguistics does not yet have unified, powerful theoretical models able to account rigorously and clearly for the phenomena it studies. Sociolinguistic studies are today a diverse set of contributions in which certain and theoretical schools and lines of research emerged; but as is to be expected in a relatively new field, there is not enough communication between the various schools and they cannot yet be said to be integrated in terms of their conceptual and theoretical postulates. Against this background, our work aims to contribute to the overall, integrated understanding of the processes of language contact. Via an interdisciplinary, eclectic approach, it also aims to aid the theoretical grounding and integration of a unified, common sociolinguistic paradigm. Our strategy will not be merely to combine the contributions from ongoing research lines, but to address the question from a more global viewpoint which, together with the more innovative contemporary scientific disciplines, permits a harmonious integration of the various sociolinguistic perspectives in a broad, deep and unitary approach to the reality. The materials used to construct this unified approach are taken from many sources: Theoretical physics, ecology, the philosophy of science and mind, anthropology, phenomenological and process sociology, cognitive sciences, political science, pragmatics, history, systems theory, approaches to complexity and obviously sociolinguistics, are all involved in a dialogue in this desire for integration. This book aims to contribute to the overall, integrated understanding of the processes of language contact and their evolution, be they the result of political or economic (dis)integrations or migrations or for technological reasons. Via an interdisciplinary, holistic approach, it also aims to aid the theoretical grounding of a unified, common sociolinguistic paradigm, based on an ecological and complexical perspective. This perspective is based on the fact that linguistic structures do not live in isolation from their social functions and must (...) be situated in relation to the sub- and supra-systems that determine their existence if we are to understand their fortunes. It is a contribution in understanding and promoting the processes of linguistic revitalization in the world, combining at the same time the maintenance and development of diversity while ensuring the intercommunication of human species. Medium-sized language communities face competition between local and global languages such as Spanish, Russian, French and, above all, English. The various regions of Spain where Catalan is spoken, Denmark, the Czech Republic, and Lithuania show how their medium-sized languages (a term used to distinguish them as much from minority codes as from more widely-spoken codes) coexist alongside or struggle with their big brothers in multilingual families. This comparative analysis offers unique insight into language contact in present-day Europe.

In recent years the term ‘family language policy’ has begun to circulate in the international sociolinguistics literature (cf. Spolsky 2004, 2007, 2012, King et al. 2008; Caldas 2012; Schwartz & Verschik 2013)1. From a conceptual standpoint, however, the creation and/or use of this syntagma, applied directly to the language decisions taken by family members to speak to one another, can raise questions about whether one should apply what appears rather to be a framework that pertains to actions arising out of (...) institutionalisation, public debate, and formal decisions to a phenomenon produced ‘spontaneously’. ‘Language policy’, which is also commonly associated with the term ‘planning’, has traditionally evoked the study of actions taken by public authorities at the level of the institutional and social use of languages and of their process of decision-making, implementation and any effects on social language behaviours that may ensue. The expansion of this concept to the level of interpersonal uses in families, which corresponds to another sphere involving elements that are distinct from those of the political level or of a formally constituted organisation, can be misleading and conceal phenomena specific to this level of social reality.
