The central purpose of this paper is to address the tension between legal and medical discourses within the coronial system. Medical expertise, based largely upon internal autopsy, becomes positioned as providing the more important information, rather than the legal model which focuses on evidence gathering at the scene. This paper will examine the aspects of the history, philosophy and consequences of the processes by which the medical model gained its current dominance and will conclude that, while autopsies are necessary, they (...) are also over-used in the coronial system. In their book, Equal Is Unfair, Watkins and Brook argue that equality of income and wealth is not needed in order to engage in the creative work required for human flourishing. One can live a successful life even though others have more resources and opportunities. It is contended here that this argument is convincing, but contrary to Watkins and Brook, it does not suffice to rule out all justifications for redistribution.

Levels of organization are structures in nature, usually defined by part-whole relationships, with things at higher levels being composed of things at the next lower level. Typical levels of organization that one finds in the literature include the atomic, molecular, cellular, tissue, organ, organismal, group, population, community, ecosystem, landscape, and biosphere levels. References to levels of organization and related hierarchical depictions of nature are prominent in the life sciences and their philosophical study, and appear not only in introductory textbooks and (...) lectures, but also in cutting-edge research articles and reviews. In philosophy, perennial debates such as reduction, emergence, mechanistic explanation, interdisciplinary relations, natural selection, and many other topics, also rely substantially on the notion. -/- Yet, in spite of the ubiquity of the notion, levels of organization have received little explicit attention in biology or its philosophy. Usually they appear in the background as an implicit conceptual framework that is associated with vague intuitions. Attempts at providing general and broadly applicable definitions of levels of organization have not met wide acceptance. In recent years, several authors have put forward localized and minimalistic accounts of levels, and others have raised doubts about the usefulness of the notion as a whole. -/- There are many kinds of ‘levels’ that one may find in philosophy, science, and everyday life—the term is notoriously ambiguous. Besides levels of organization, there are levels of abstraction, realization, being, analysis, processing, theory, science, complexity, and many others. Medically unexplained symptoms (MUS) are common and costly in both primary and secondary health care. It is gradually being acknowledged that there needs to be a variety of interventions for patients with medically unexplained symptoms to meet the needs of different groups of patients with such chronic long-term symptoms. The proposed intervention described herewith is called The BodyMind Approach (TBMA) and promotes learning for self-management through establishing a dynamic and continuous process of emotional self-regulation. The problem is the mismatch between (...) the patient’s mind-set and profile and current interventions. This theoretical article, based on practice-based evidence, takes forward the idea that different approaches (other than cognitive behaviour therapy) are required for people with MUS. The mind-set and characteristics of patents with MUS are reflected upon to shape the rationale and design of this novel approach. Improving services for this population in primary care is crucial to prevent the iterative spiralling downwards of frequent GP visits, hospital appointments, and Accident and Emergency attendance, all of which are common for these patients. The approach derives from embodied psychotherapy (authentic movement in dance movement psychotherapy) and adult models of learning for self-management. It has been developed from research and practice-based evidence. In this article the problem of MUS in primary care is introduced and the importance of the reluctance of patients to accept a psychological/mental health referral in the first instance is drawn out. A description of the theoretical underpinnings and philosophy of the proposed alternative to current interventions is then presented related to the design, delivery, facilitation and educational content of the programme. The causal exclusion argument suggests that mental causes are excluded in favour of the underlying physical causes that do all the causal work. Recently, a debate has emerged concerning the possibility of avoiding this conclusion by adopting Woodward's interventionist theory of causation. Both proponents and opponents of the interventionist solution crucially rely on the notion of supervenience when formulating their positions. In this article, we consider the relation between interventionism and supervenience in detail and argue that importing supervenience relations into (...) the interventionist framework is deeply problematic. However, rather than reject interventionist solutions to exclusion wholesale, we wish to propose that the problem lies with the concept of supervenience. This would open the door for a moderate defence of the interventionist solution to the exclusion argument. (shrink)

A study of 612 CPAs employed in four separate regions of the People’s Republic of China shows that they exhibit ethical orientations that are not significantly different from one another and that they do not, as a group identify with the Subjectivist description provided in the Forsyth et al. (Journal of Business Ethics 8(83):813–833, 2008) meta-analytic international study involving the Ethical Position Questionnaire. Confirmatory factor analysis did however establish the validity of the instrument as a measure of idealistic and relativistic (...) tendencies. It was established that the ethical tone within local accounting firms plays a significant role in forming ethical positions and that these variables together work to influence ethical judgement making with respect to issues involving independence and objectivity. The constructs of relativism and idealism act as reliable predictors of moral choice, but need to be carefully interpreted in the context of field research. The study highlights concerns about the ethicality of a fledgling group of professionals having to cope with the exigencies associated with the world’s fastest developing economy. (shrink)

The central thesis of Schizotypy: Implications for Illness and Health is both challenging and controversial: that the features of psychotic disorders actually lie on a continuum with, and form part of, normal behaviour and experience. The dispositional or 'schizotypal' traits associated with psychotic disorders certainly predispose an individual to mental illness, but they may also lead to positive outcomes such as enhanced creativity or spiritual experience. Discussion of each aspect of this theme is supported by extensive experimental and clinical evidence, (...) questioning the received medical wisdom which treats psychotic illness in the narrow context of neurological disease. Many naive realists endorse a negative disjunctivist strategy in order to deal with the challenge presented by the possibility of phenomenologically indistinguishable halucination. In the first part of this paper I argue that this approach is methodologically inconsistent because it undercuts the phenomenological motivation that underlies the the appeal of naive realism. In the second part of the paper I develop an alternative to the negative disjunctivist account along broadly Meinongian lines. Much of children's early syntactic development can be seen as the acquisition of sentence-level constructions that correspond to relatively complex events and states of affairs. The current study was an attempt to determine the relative concreteness (verb-specificity) or abstractness (verb-generality) of such constructions for children just beginning to produce large numbers of multi-word utterances. Sixteen children at 2.0 years of age and sixteen children at 2,5 years of age participated (all English speaking). Each child was taught two novel verbs for (...) a highly transitive action: one in a transitive construction (Ernie is tamming the car) and one in an intransitive construction (with patient äs subject: The ball is meeking). They were then given opportunities to use their newly learned verbs, in many cases in discourse situations that encouraged use of the "opposite" construction (i.e., agent and patient-focused questions). Results showed that 2.0-year-old children almost never produced an utterance using a novel verb in anything other than the construction in which it had been modeled. Children at 2.5 years of age were somewhat more productive, but still the large majority of these children avoided using the experimental verbs in nonmodeled constructions. These results suggest that when English-speaking children produce simple transitive and intransitive utterances in their spontaneous speech, they are doing so on a verb-specific basis (verb Island constructions), schematizing more abstract constructions only later äs they discover patterns that apply across many such lexically specific constructions. This paper explores a case example of qualitative research that applied productive hermeneutics and the central concept, fusion of horizons. Interpretation of meaning is a fusing of the researchers’ and subjects’ perspectives and serves to expand understanding. The purpose is to illustrate an exemplar of qualitative research without establishing a rigid recipe of methodology. The illustration is based on in-depth observational and textual data from an applied anthropological study conducted in western Alaska with Yup’ik hunters and fishers and government agency (...) employees as they worked towards collaborative management. The metaphor of the hermeneutical circle is showcased to help the reader understand the philosophical underpinnings and the analytical processes used to realize a meaningful interpretation. A series of organizing systems for the interpretation is described, culminating in a final organizing system to communicate a fully realized understanding of collaborative management at the time. The classical view of the relationship between necessity and apriority, defended by Leibniz and Kant, is that all necessary truths are known a priori. The classical view is now almost universally rejected, ever since Saul Kripke and Hilary Putnam discovered that there are necessary truths that are known only a posteriori. However, in recent years a new debate has emerged over the epistemology of these necessary a posteriori truths. According to one view – call it the neo-classical view – knowledge (...) of a necessary truth always depends on at least one item of a priori knowledge. According to the rival view – call it the neoempiricist view – our knowledge of necessity is sometimes broadly empirical. In this paper I present and defend an argument against the neo-empiricist view. I argue that knowledge of the necessity of a necessary truth could not be broadly empirical. (shrink)

For example, the substantial form of an oak tree somehow explains how and why an oak tree can do everything that it does. So the substantial form of an oak tree could not be something as simple or crude as its shape. Nevertheless, the example of the bronze statue does (...) have the virtue of illustrating one of the chief advantages of hylomorphism as a philosophy of the human person. Although we can talk about the bronze and the shape of the statue, respectively, it still seems correct to say that the statue is exactly one thing, not two things. Likewise, although we can talk about the matter and the form of a human being, the hylomorphist insists that a human being is exactly one thing, not two things accidentally conjoined. (shrink)

In recent decades, economists have played an active role in shaping public policy by publicly recommending the adoption of certain policies. These recommendations are often based on normative assumptions that are not the product of economic analysis; nor are they shared by the laypeople to whom these recommendations are made. Inducing people to adopt public policies for reasons that are neither the product of expertise, nor shared by the people, is a form of manipulation that violates the ideals of a (...) liberal democratic society. Thus, the economists’ recommendations constitute an abuse of their expertise. (shrink)

The central claim of this book is that, early and late, Wittgenstein modelled his approach to existential meaning on his account of linguistic meaning. A reading of Nietzsche’s The Birth of Tragedy sets up Bearn’s reading of the existential point of Wittgenstein’s Tractatus. Bearn argues that both books try to resolve our anxiety about the meaning of life by appeal to the deep, unutterable essence of the world. Bearn argues that as Wittgenstein’s and Nietzsche’s thought matured, they both separately came (...) to believe that the answer to our existential anxiety does not lie beneath the surfaces of our lives, but in our acceptance—Nietzsche’s “Yes”—of the groundless details of those surfaces themselves: the wonder of the ordinary. Many naive realists are inclined to accept a negative disjunctivist strategy in order to deal with the challenge presented by the possibility of phenomenologically indistinguishable hallucination. In the first part of this paper I argue that this approach is methodologically inconsistent because it undercuts the phenomenological motivation that underlies the appeal of naive realism. In the second part of the paper I develop an alternative to the negative disjunctivist account along broadly Meinongian lines. In the last section of this paper (...) Integrating the concept of place meanings into protected area management has been difficult. Across a diverse body of social science literature, challenges in the conceptualization and application of place meanings continue to exist. However, focusing on relationships in the context of participatory planning and management allows protected area managers to bring place meanings into professional judgment and practice. This paper builds on work that has outlined objectives and recommendations for bringing place meanings, relationships, and lived experiences to the forefront of (...) land-use planning and management. It proposes the next steps in accounting for people’s relationships with protected areas and their relationships with protected area managers. Our goals are to 1) conceptualize this relationship framework; 2) present a structure for application of the framework; and 3) demonstrate the application in a specific protected area context, using an example from Alaska. We identify three key target areas of information and knowledge that managers will need to sustain quality relationship outcomes at protected areas. These targets are recording stories or narratives, monitoring public trust in management, and identifying and prioritizing threats to relationships. The structure needed to apply this relationship-focused approach requires documenting and following individual relationships with protected areas in multiple ways. The goal of this application is not to predict relationships, but instead to gain a deeper understanding of how and why relationships develop and change over time. By documenting narratives of individuals, managers can understand how relationships evolve over time and the role they play in individual’s lives. By understanding public trust, the shared values and goals of individuals and managers can be observed. By identifying and prioritizing threats, managers can pursue efforts that steward relationships while allowing for the protection of experiences and meanings. The collection and interpretation of these three information targets can then be integrated and implemented within planning and management strategies to achieve outcomes that are beneficial for resource protection, visitor experiences, and stakeholder engagement. By investing in this approach, agencies will gain greater understanding and usable knowledge towards the achievement of quality relationships. It represents an investment in both place relationships and public relations. During 2012 students enrolled in a Master’s management accounting unit were invited to complete a compulsory class quiz, which was arranged to include a mild form of deception allowing them an opportunity to cheat. Prior to the test students were coached concerning the importance of the ICMA code of ethical conduct, which formed the basis of the quiz. Following the test, students were made aware of the deception and asked to judge the propriety of their actions using a research instrument (...) based on moral intensity theory (Jones in The Academy of Management Review, 16(2), 366–395, 1991). Academic dishonesty, in its many forms is endemic in universities and in this study a significant number of students take advantage of an opportunity to maximise test scores and earn an advertised reward by cheating. Others adopted a virtuous position and opted not to use the information. As reported from an earlier investigation, Woodbine and Amirthalingam (2013) again demonstrate the effect of cognitive dissonance (Festinger 1957) although previously the research instrument did not clearly differentiate between respondent types. A logistic regression of subsequent data establishes that high achievers (in terms of their test scores) are more likely to take advantage of the disclosed information to maximise scores and that this is somewhat offset by aspects of their moral character. Immediately following the field experiment, students met to reflect on their actions. A summary of their responses is provided, which tends to support prior evidence that many are somewhat blasé in their attitude to this form of opportunistic behaviour. These findings have ramifications in terms of the way tertiary institutions emphasise academic excellence before moral development, while acting to manage the incidence of misbehaviour. (shrink)
