BackgroundVulnerability is a key concept in traditional and contemporary bioethics. In the philosophical literature, vulnerability is understood not only to be an ontological condition of humanity, but also to be a consequence of contingent factors. Within bioethics debates, vulnerable populations are defined in relation to compromised capacity to consent, increased susceptibility to harm, and/or exploitation. Although vulnerability has historically been associated with older adults, to date, no comprehensive or systematic work exists on the meaning of their vulnerability. To fill this (...) gap, we analysed the literature on aged care for the meaning, foundations, and uses of vulnerability as an ethical concept.MethodsUsing PRISMA guidelines, we conducted a systematic review of argument-based ethics literature in four major databases: PubMed, Embase®, Web of Science™, and Philosopher’s Index. These covered biomedical, philosophy, bioethical, and anthropological literature. Titles, abstracts, and full texts of identified papers were screened for relevance. The snowball technique and citation tracking were used to identify relevant publications. Data analysis and synthesis followed the preparatory steps of the coding process detailed in the QUAGOL methodology.ResultsThirty-eight publications met our criteria and were included. Publication dates ranged from 1984 to 2020, with 17 publications appearing between 2015 and 2020. Publications originated from all five major continents, as indicated by the affiliation of the first author. Our analyses revealed that the concept of vulnerability could be distinguished in terms of basic human and situational vulnerability. Six dimensions of older adults’ vulnerability were identified: physical; psychological; relational/interpersonal; moral; sociocultural, political, and economic; and existential/spiritual. This analysis suggested three ways to relate to older adults’ vulnerability: understanding older adults’ vulnerability, taking care of vulnerable older adults, and intervening through socio-political-economic measures.ConclusionsThe way in which vulnerability was conceptualised in the included publications overlaps with distinctions used within contemporary bioethics literature. Dimensions of aged care vulnerability map onto defining features of humans, giving weight to the claim that vulnerability represents an inherent characteristic of humans. Vulnerability is mostly a value-laden concept, endowed with positive and negative connotations. Most publications focused on and promoted aged care, strengthening the idea that care is a defining practice of being human. (shrink)

There are differences among forms of impression management that are relevant to its ethical evaluation. Sometimes, moral appraisal is to do with impression management as a tactic of influence, but not about deception. In other cases, an audience is given a true or a false impression, and ethical questions of deception arise, but they are made more complex by the need to consider the responsibility of an audience in reaching its conclusions. Cases where that is an issue blend into a (...) third category in which impression management is joint social performance. Such cases raise additional possibilities of the problematic influence of one agent by another, but also begin to move ethical concerns from the behaviour of an individual agent to the social practices that sustain their expectations. Such social practices invite ethical appraisal because they may impose constraints. But they may also provide opportunities for achievement and pursuit of excellence. (shrink)

The paper aim draws together two ideas that have figured in different strands of discussion in business ethics: the ideas of intuition and of reflection. They are considered in company with the third, complementary, idea of analysis. It is argued that the interplay amongst these is very important in business ethics. The relationship amongst the three ideas can be understood by reference to parts of modern cognitive psychology, including dual-process theory and the Social Intuitionist Model. Intuition can be misleading when (...) based on fast and frugal heuristics, and reasoning needs social exchange if it is to support moral judgment effectively, but in the complex institutional environment of business, reflection and analysis can underpin social communication and feedback to develop sound intuition. Reflection and analysis are both more deliberate, systematic judgment processes than intuition, but are distinguished by the fact that reflection embraces hypothetical thinking and imagination, while analysis is careful, step-by-step reasoning. Examples of business ethics problems illustrate the need for both of these processes, and also suggest how they themselves can be enhanced in the same social exchange process that underpins the development of good intuition. Recent scientific research into the therapeutic potential and mechanisms of psychedelic drugs raises intriguing and hitherto largely unexplored philosophical questions. A brief overview of the relevant science is given before addressing these questions. It is argued that psychedelic transformation is a distinctive psycho- pharmacological intervention because its mechanism of action ineliminably involves conscious mental representations, and thus is more transparent to the subject than the mechanisms of other drug therapies. This argument connects with issues in the philosophy of (cognitive) scientific (...) explanation. It is also argued that transformative psychedelic experiences may well confer three distinct kinds of epistemic benefits: knowledge by acquaintance of the subject's psychological potential, knowledge by acquaintance of the meta-physical nature of the (sense of) self, and revitalized capacities for the acquisition of modal knowledge. Non-naturalistic metaphysical and epistemological claims abound in psychedelic circles; thus, it is important to realize that psychedelics may yield naturalistically acceptable epistemic benefits. Any attempt to construct a realist interpretation of quantum theory founders on the Kochen-Specker theorem, which asserts the impossibility of assigning values to quantum quantities in a way that preserves functional relations between them. We construct a new type of valuation which is defined on all operators, and which respects an appropriate version of the functional composition principle. The truth-values assigned to propositions are (i) contextual; and (ii) multi-valued, where the space of contexts and the multi-valued logic for each context (...) come naturally from the topos theory of presheaves. The first step in our theory is to demonstrate that the Kochen-Specker theorem is equivalent to the statement that a certain presheaf defined on the category of self-adjoint operators has no global elements. We then show how the use of ideas drawn from the theory of presheaves leads to the definition of a generalised valuation in quantum theory whose values are sieves of operators. In particular, we show how each quantum state leads to such a generalised valuation. A key ingredient throughout is the idea that, in a situation where no normal truth-value can be given to a proposition asserting that the value of a physical quantity A lies in a set D of real numbers , it is nevertheless possible to ascribe a partial truth-value which is determined by the set of all coarse-grained propositions that assert that some function f(A) lies in f(D), and that are true in a normal sense. The set of all such coarse-grainings forms a sieve on the category of self-adjoint operators, and is hence fundamentally related to the theory of presheave. (shrink)

The impact of neoliberal reforms of education systems on the work of teachers and school leaders, particularly in relation to high-stakes accountability frameworks, has been extensively studied in recent decades. One significant aspect of neoliberal schooling is the emergence of quasi-autonomous public schools (such as Academies in England, Charter Schools in the USA and Independent Public Schools in Australia), characterised by heterarchical governance models, the promotion of entrepreneurial leadership cultures, and the promotion of a discourse of pursuing educational equity by (...) means of ‘achievement for all’. This paper explores the emergence of a mode of teacher professionalism characteristic of these quasi-autonomous schools, and conceptualises this as being ‘neo-performative’. The neo-performative profession is shaped by the shift in the focus of the regulation and management of schools from ‘governing to governance’, and the consequential rise of the ‘responsibilised profession’, and marked by the emergence of an entrepreneurial model of school leadership. The paper argues that this new conceptualisation of teacher professionalism requires further, more focused, empirical study in order to explore how neoperformative teachers and school leaders articulate their vision of educational equity and social justice, and how they enact this vision in an increasingly intensified high-stakes accountability culture. Much of Stephen Jay Gould’s legacy is dominated by his views on the contingency of evolutionary history expressed in his classic Wonderful Life. However, Gould also campaigned relentlessly for a “nomothetic” paleontology. How do these commitments hang together? I argue that Gould’s conception of science and natural law combined with his commitment to contingency to produce an evolutionary science centered around the formulation of higher-level evolutionary laws.

Alienation theory has acted as the stimulus for a great deal of research and writing in the history of sociology. It has formed the basis of many sociological ‘classics’ focused on the workplace and the experiences of workers, and has also been mobilized to chart wider social malaise and individual troubles. Alienation theory usage has, however, declined significantly since its heyday of the 1960s and 1970s. Here, the reasons why alienation theory was ‘forgotten’ and what can be gained by ‘remembering’ (...) alienation theory are explored. To realize this ambition this article proceeds by (1) briefly visiting differing definitions of alienation theory, before charting its high point, and the various debates and tensions of the time, during the 1960s and 1970s; (2) analysing the reasons why alienation theory fell from grace from the 1980s onwards; (3) elaborating how and why alienation theory is still relevant for sociology and the wider social sciences today. In previous work, I defend the following disparity between moral and epistemic facts: whereas moral facts are irreducibly normative, epistemic facts – facts such as that some subject is epistemically justified in believing something – are reducible to facts from some other domain (such as facts about probabilities). This moral-epistemic disparity is significant because it undercuts an important kind of argument for robust moral realism. My defense of epistemic reductionism and of the moral-epistemic disparity has been criticized by Richard Rowland (...) (2013) and by Terence Cuneo and Christos Kyriacou (forthcoming). This paper aims to rebut these criticisms and, more generally, to clarify and strengthen the case for epistemic reductionism and the moral-epistemic disparity. (shrink)

John Searle’s “thesis of the Background” is an attempt to articulate the role of nonintentional capacities---know-how, skills, and abilities---in constituting intentional phenomena. This essay applies Searle’s notion of the Background to shed light on the Daoist notion of w’u-w’ei---“non-action” or non-intentional action---and to help clarify the sort of activity that might originally have inspired the w’u-w’ei ideal. I draw on Searle’s work and the original Chinese sources to develop a defensible conception of a w’u-w’ei-like state that may play an intrinsically (...) and instrumentally valuable role in the exercise of agency. At the same time, however, I argue that Searle’s view that “Intentionality rises to the level of the Background abilities” convincingly explains why the conception of w’u-w’ei presented in ancient texts is untenable. W’u-w’ei-like states can generally occur only as components of an intentional flow of activity, and thus they are not fundamentally nonintentional. (shrink)

Based on quantitative indicators for fifteen advanced countries between 1974 and 2005, and case studies of France, the United Kingdom, Germany, Italy, Sweden, and Ireland, this article analyzes the trajectory of institutional change in the industrial relations systems of advanced capitalist societies, with a focus on Western Europe. In contrast to current comparative political economy scholarship, which emphasizes the resilience of national institutions to common challenges and trends, it argues that despite a surface resilience of distinct national sets, all countries (...) have been transformed in a neoliberal direction. Neoliberal transformation manifests itself not just as institutional deregulation but also as institutional conversion, as the functions associated with existing institutional forms change in a convergent direction. A key example is the institution of centralized bargaining, once the linchpin of an alternative, redistributive and egalitarian, model of negotiated capitalism, which has been reshaped in the past twenty years to fit the common imperative of liberalization. This paper proposes a framework for formalising intuitions about the behaviour of imperative commands. It seeks to capture notions of satisfaction and coherence. Rules are proposed to express key aspects of the general logical behaviour of imperative constructions. A key objective is for the framework to allow patterns of behaviour to be described while avoiding making any commitments about how commands, and their satisfaction criteria, are to be interpreted. This article returns to the debate about the relative importance of the productive forces and the relations of production in the feudal mode of production. It argues, using western medieval evidence, that this relation is an empirical one and varies between modes, maybe also inside modes; and that, in the specific case of feudalism, not only were the relations of production the driving force, but developments in the productive forces actually depended upon them.

This paper uses the language of formal dialectics to explore how argumentation schemes and their critical questions can be characterized as an extension to traditional dialectical systems. The aim is to construct a dialectical system in which the set of locutions is extended to include scheme-based moves the set of structural rules describes the roles that critical questioning can play; and the set of commitment rules distinguishes between exceptions and assumptions.

The Toulmin diagram layout is very familiar and widely used, particularly in the teaching of critical thinking skills. The conventional box-and-arrow diagram is equally familiar and widespread. Translation between the two throws up a number of interesting challenges. Some of these challenges (such as the relationship between Toulmin warrants and their counterparts in traditional diagrams) represent slightly different ways of looking at old and deep theoretical questions. Others (such as how to allow Toulmin diagrams to be recursive) are diagrammatic versions (...) of questions that have already been addressed in artificial intelligence models of argument. But there are further questions (such as the relationships between refutations, rebuttals and undercutters, and the roles of multiple warrants) that are posed as a specific result of examining the diagram inter-translation problem. These three classes of problems are discussed. To the first class are addressed solutions based on engineering pragmatism; to the second class, are addressed solutions drawn from the appropriate literature; and to the third class, fuller exploration is offered justifying the approaches taken in developing solutions that offer both pragmatic utility and theoretical interest. Finally, these solutions are explored briefly in the context of the Araucaria system, showing the ways in which analysts can tackle arguments either using one diagrammatic style or another, or even a combination of the two. The “School of Names” ming jia ) is the traditional Chinese label for a diverse group of Warring States (479-221 B.C.) thinkers who shared an interest in language, disputation, and metaphysics. They were notorious for logic-chopping, purportedly idle conceptual puzzles, and paradoxes such as “Today go to Yue but arrive yesterday” and “A white horse is not a horse.” Because reflection on language in ancient China centered on “names”.

Expertise, authority, and testimony refer to aspects of one of the most important elements of communication and cognition. Argumentation theory recognises various forms of what we call the argumentum ad alia pattern, in which speakers appeal to what others have said, including Position to Know scheme, Witness Testimony scheme, Expert Opinion scheme and the classical ad verecundiam. In this paper we show that ad alia involves more than merely an inferential step from what others (a person in position to know, (...) a witness, an expert) have said, and that studying this type of argumentation requires going beyond the argument structure of propositional contents to account for different speech activities. We also demonstrate that using the words of others, attacking what has been said, and reasoning from how others reason constitute a rich repertoire of communication strategies which we need to model in order to be able to analyse them manually and to process them computationally. Music’s sanctioned role in the day-to-day running of the ‘late-modern’ prison is to ensure wellbeing and compliance of prisoners, with most regimes facilitating access to music through the form of radios, cd’s, and cassette players. As a result, music often comes tied to judgements by the regime about prisoners’ conduct, with incentive systems allowing the regime to confiscate earned possessions under certain conditions. In this way, the role of music in prison is often continuous with the mechanisms of carceral control, (...) with its ‘humanising’ or ‘therapeutic’ effects being defined as a luxury to be earned through good behaviour and critical engagement with one’s moral and psychological treatment. By tracing the history of music during the birth of the modern prison in the nineteenth century, this paper asks how music became incorporated into the discourse and technology of the emerging carceral state. Drawing principally on the work of Michel Foucault, this paper seeks to explore the relationship between music and ‘the self’ as it is applied to carceral subjects. Foucault shows how the expansion of the carceral state at the end of the nineteenth century relied on the production of knowledge about the subject through the application of disciplinary techniques. By exploring the construction of the self through the discourse of music at the end of the eighteenth century and in the published works of carceral reformers at the end of the nineteenth century, this paper seeks to explore the role that music played within this period of carceral expansion. The discussion will focus on the ways in which music acts as a conduit for forms of carceral power through its relationship with the self. (shrink)

Based on a 2013 doctoral thesis, Ophélie Siméon's volume in a series edited by Gregory Claeys represents an attempt to write a different kind of study of Robert Owen—"an intellectual biography through a sense of place" —that connects New Lanark more umbilically to his later endeavors. Her avowed intent is to approach this history "from below," utilizing newly available material from the New Lanark Trust archives as well as New Lanark records held at Glasgow University. In this research, the use of narrative accounts is investigated as the catalyst for the evolution of one coach's identity. Unable to sustain a coaching identity that was deemed to be appropriate by my coaching mentors, I disengaged from the swimming culture. This was due in part to the expression of power within the mentor–mentee relationship embedded in the coach development pathway, as well as within the wider sporting culture. By utilizing a narrative approach; writing and deconstructing my own narratives (...) in relation to coach identity development within the mentor–mentee relationship, I developed an alternative approach. I established a sustainable coaching identity that demonstrated evidence-based judgement and reflective consideration of actions rather than the obtuse reproduction of mentor coach practice. This research suggests that the use of narrative as an integral element in coach education can be powerful in terms of deconstructing cultural ideologies and in the construction of a sustainable coaching identity. The combination of these two components is powerful in terms of enabling a coaching identity to evolve. It is therefore suggested that the development of a sustainable mentor–mentee relationship is inextricably linked with the expression of narrative and the critical reflection on the same. (shrink)

We explore the science of mass extinction, link it to industrial civilization, use the concept of the banality of evil to explain the ethical situation, and then explain the various ways in which mass extinction poses further ethical problems within that situation, especially of environmental justice and the loss of value. Overall, humankind risks a profound failure of autonomy, perhaps our greatest achievement. For those who want to take action, we recommend the project of anthroponomy and large-unit/deep-branching conservation.

This note responds to an interpretation of Mohist Canon and Explanation B 671 published by John Makeham some years ago. Makeham’s interpretation makes significant contributions to our understanding of this passage, especially in calling attention to problems with two influential previous interpretations, those of A. C. Graham and Chad Hansen.3 Yet his reading presents difficulties of its own, which I will attempt to rectify here.

The aim of this article is to clarify the role of self-interest in Moist thought and by doing so to refute the Self-Interest Thesis. Toward these ends, I will examine passages from the Mozi bearing on the role of self-interest in Moist ethics and psychology and show that, in each case, an alternative interpretation explains them better than the Self-Interest Thesis does. I will argue that the Moists recognize the obvious truth that self-interest figures among people’s basic motives, but they (...) believe people also have other important sources of motivation. Morality, as Immanuel Kant understands it, depends on the capacity of a person to be the agent and owner of his own actions, not merely a conduit for social and psychological forces and influences over which he has little or no control. As a result, Kant’s moral philosophy focuses primarily on the topic of individual freedom and the necessary preconditions of the possibility of that freedom. In the Groundwork and second Critique, Kant’s discussion of the connection between morality and freedom (...) centers on autonomy of the will. He identifies autonomy as the supreme principle of morality and defines it as “choos[ing] only in such a way that the maxims of your choice are also included as universal law in the same volition” (Gr 4:440). In this paper I argue that according to Kant the possibility of autonomous action requires that certain preconditions be met. Satisfying these preconditions requires an individual to be a member of civil society (status civilis), and, specifically, a civil society maintained by a strong, sovereign power. This connection between freedom and civil society exists on two levels. First, one precondition of autonomy (i.e., internal freedom) is liberty (i.e., external freedom), and an individual can secure his liberty only once he is a member of civil society. Second, an individual is free only when others recognize him as a being with the capacity for autonomous action, and joining civil society is the process by which this recognition takes place. One of the most important problems faced by the United States is addressing its broken criminal justice system. This collection of essays offers a thorough examination of incarceration as a form of punishment. In addition to focusing on the philosophical aspects related to punishment, the volume's diverse group of contributors provides additional background in criminology, economics, law, and sociology to help contextualize the philosophical issues.
