The lectures on American pragmatism given by the French sociologist Emile Durkheim in 1913 in Paris were first published in French in 1955 and finally translated into English and published in 1983 as Pragmatism and Sociology. For obvious reasons they have attracted considerable attention from philosophers and sociologists, especially the latter, in both continental Europe and the English speaking world. Durkheim's motives in giving the lectures have been scrutinized, his interpretations of the pragmatists widely discussed and his criticisms of William (...) James, John Dewey, and F. S. C. Schiller have met with mixed receptions. However, after years of scholarly discourse on his motives, interpretations and criticisms, there is no common agreement on the significance and meaning of Pragmatism and Sociology. We briefly address the disagreement over Durkheim's motives in the introductory section before turning to our interpretation in the body of the article. There we focus on his criticisms of the pragmatists’ views on the aims and nature of knowledge, which is a classic confrontation between French rationalism à la Durkheim and American pragmatism of the James/dewey variant. Abstract The concept of culture was originally an expression of German nationalism, which reacted to the French Enlightenment by asserting the uniqueness and incomparability of all cultures as historical creations. This understanding of cultural diversity, which prevailed in American anthropology, is widely understood to imply the moral equality of all cultures. Yet its relativism originally applied to different individuals socialized in the values of their culture, rather than to different cultures. The debate over multiculturalism, which presupposes cultural relativism, ignores this (...) distinction. The vogue of multiculturalism reflects the decline of the Left, quests for community and identity, and an actual reduction in diversity more than a genuine appreciation of different cultures. This book represents a considerable revision and expansion of Public Choice II. Six new chapters have been added, and several chapters from the previous edition have been extensively revised. The discussion of empirical work in public choice has been greatly expanded. As in the previous editions, all of the major topics of public choice are covered. These include: why the state exists, voting rules, federalism, the theory of clubs, two-party and multiparty electoral systems, rent seeking, bureaucracy, interest groups, dictatorship, the (...) size of government, voter participation, and political business cycles. Normative issues in public choice are also examined including a normative analysis of the simple majority rule, Bergson–Samuelson social welfare functions, the Arrow and Sen impossibility theorems, Rawls's social contract theory and the constitutional political economy of Buchanan and Tullock. The significance of A. N. Whitehead’s contribution to 20th century metaphysics has become widely recognized. The focus on the novelty of his process ontology, however, has led to a view that isolates him from the mainstream of the tradition of Western philosophy. Hence, it is often overlooked that on the methodological level Whitehead is a pragmatist, whose much quoted indebtedness to William James is reflected in the project of his speculative metaphysics. A detailed analysis of the respective theories of truth (...) and knowledge in James and Whitehead illustrates their common methodological approach and allows us to assess the role of Whiteheadian thinking within the pragmatist tradition. James advances a form of epistemic conservatism that supplements the pragmatic idea of a concept’s cash-value with the demand for internal consistency. New beliefs have to fit in the totality of all previously accepted convictions in order to become accepted as true. James argues his case on three levels – a psychological, an epistemological and a pragmatic one – and develops a theory of truth that comprises an empirical and a rational dimension. Whitehead takes up this two-sided approach, but modifies the idea of genetic consistency into that of systematic coherence. The fundamental concepts of an ontological theory must not be isolated from each other to allow for a cosmology which is both rational and satisfies the pragmatic test of applicability. With the close relation of James and Whitehead in mind, the latter can be identified as the ‘missing link’ that bridges the gap between the so-called classical pragmatism and its more analytic versions as advanced by Quine, Lewis and Rescher. Abstract:Recent developments in personality research point to an alchemy of character composed of five elements: extroversion, agreeableness, conscientiousness, neuroticism, and openness to experience. This paper surveys this research for its implications to the study of the virtues in organizational ethics. After subjecting each of these five character traits to several tests as to what constitutes a virtue, the empirical evidence supports an organizational virtue of agreeableness and an organizational virtue of conscientiousness. Are propositions of law true or false? If so, what does it mean to say that propositions of law are true and false? This book takes up these questions in the context of the wider philosophical debate over realism and anti-realism. Despite surface differences, Patterson argues that the leading contemporary jurisprudential theories all embrace a flawed conception of the nature of truth in law. Instead of locating that in virtue of which propositions of law are true, Patterson argues that lawyers (...) use forms of argument to show the truth of propositions of law. Additionally, Patterson argues that the realism/anti-realism debate in jurisprudence is part of a larger argument over the role of postmodernism in jurisprudence. For this, Patterson offers an analytic account of postmodernism and charts its implications for legal theory. Robert Nozick has suggested that risky actions are a problem for a moral view based on rights. We ordinarily think that some actions are too dangerous to be permissible, taking into account both the harm risked and the degree of the risk. Other actions, although they run some risk of serious harm, are thought permissible. The problem is to draw this distinction in a principled way by looking to rights.I think that Nozick's argument about risk can be answered but a (...) different argument has convinced me that the rights view cannot handle risk in a satisfactory way. The inability is a function of the basic nature of the view. (shrink)

Hospital ethics, familiar enough in practice but surprisingly neglected in the literature, deals with the ethical problems that arise distinctively or typically in hospitals. More precisely, it consists of the ethical principles that shouldgovern 1) the conduct of healthcare professionals and other staff in their capacities as members of the hospital as an institution, and 2) the conduct of the hospital itself as an institution. In a recent comment on H.L.A. Hart’s ‘Postscript’ to The Concept of Law, Ronald Dworkin claims that the meaning of legal and political concepts may be understood by analogy to the meaning of natural kind concepts like ‘tiger’, ‘gold’ and ‘water’. This article questions the efficacy of Dworkin’s claims by challenging the use of natural kinds as the basis for a semantic theory of legal and political concepts. Additionally, in matters of value there is no methodological equivalent to the scientific (...) method. Thus, there is little hope of finding hidden essences to explain the meaning of legal and political concepts. Finally, even if there are natural kinds, Dworkin’s arguments for their efficacy in jurisprudence are problematic and unpersuasive. The problem for Dworkin is that his embrace of natural kinds undermines the ‘fit’ side of the fit/justification model of adjudication that lies at the heart of his theory of law. (shrink)

Clinical success with human hematopoietic stem cell (HSC) transplantation establishes a paradigm for regenerative therapies with other types of stem cells. However, it remains generally challenging to therapeutically treat tissues after engineering of stem cells in vitro. Recent studies suggest that stem and progenitor cells sense physical features of their niches. Here, we review biophysical contributions to lineage decisions, maturation, and trafficking of blood and immune cells. Polarized cellular contractility and nuclear rheology are separately shown to be functional markers of (...) a hematopoietic hierarchy that predict the ability of a lineage to traffic in and out of the bone marrow niche. These biophysical determinants are regulated by a set of structural molecules, including cytoplasmic myosin‐II and nuclear lamins, which themselves are modulated by a diverse range of transcriptional and post‐translational mechanisms. Small molecules that target these mechanobiological circuits, along with novel bioengineering methods, could prove broadly useful in programming blood and immune cells for therapies ranging from blood transfusions to immune attack of tumors. Ethical analyses of the relations between managers and subordinates have traditionally focused on the employment contract. The inequality and requisite mutual trust between managers and subordinates makes the sub-disciplines of professional ethics and feminist ethics more applicable than the contractarian perspective. When professional ethics is applied to hierarchic relationships, specific obligations emerge for managers and subordinates alike. The application of feminist ethics results in the identification of an entirely different, though not contradictory, set of obligations. In toto, the analysis improves (...) on the conventional wisdom governing hierarchic relationships while at the same time remaining consistent with our moral intuitions. (shrink)

In this paper, I want to zero in on the Kantian idea that,whilst things in themselves must logically be presupposed as the ground underlying appearances and things are not reducible to their representations, (1) objects as appearances are not properties of things in themselves, and (2) things in themselves or the thing in itself cannot properly be represented or even thought. To do this, I turn to one of the earliest defenders and champions of the Kantian philosophy, Karl Leonhard Reinhold, (...) and specifically to his first major work Versuch einer neuen Theorie des menschlichen Vorstellungsvermögens, published in 1789. I am here interested neither in the extent to which Reinhold’s interpretation of Kant is correct or even adequately represents Kant’s thought in all of its aspects, nor whether Reinhold’s attempt to present a systematic philosophy based on a rigorous deduction from a single principle (his strong foundationalism) stands up to scrutiny. I am here solely interested in some of Reinhold’s positive insights, in the Versuch, concerning elements of his representationalism that may shed light on Kant’s idealism, specifically, the relation between appearances (as objects of knowledge) and things in themselves, i. e., points (1) and (2) described above. I read the early Reinhold of the Versuch as confirming the Kantian view that objects as appearances are not properties of things in themselves and that we are radically ignorant of things in themselves, in the sense that we can neither know things in themselves (through the senses) nor even intellectually grasp things in themselves through the understanding alone. One major theme in Pope Benedict XVI’s encyclical Caritas in Veritate is the “Principle of Gratuitousness.” The point of this essay is to begin a reflection on what it actually means and its possible relevance. By comparing the “Principle of Gratuitousness” and its normative assumptions about “the logic of gift” with anthropological studies focused on the same phenomenon, I hope to show, not only the relevance of the encyclical’s normative vision but also where and how it needs further clarification. The (...) findings of empirical anthropology provide qualified support for the encyclical’s focus on generating and replenishing “social capital” in order to sustain both markets and politics in an effort to “civilize the economy.” In order to put the “Principle of Gratuitousness” into more effective practice, the encyclical highlights the creative role of “civil society” and calls for the creation social enterprises whose goals are broader and deeper than maximizing profits. Assessing the realism of Benedict’s proposal will require further research and reflection on innovative entrepreneurial ventures designed to address social problems on a commercial basis, for example, Muhammad Yunus’ concept of a “social business” and its development in a series of joint business ventures involving the Grameen Bank and related organizations. Sometimes we make decisions which affect our lives at times when we will hold values that are different from our values at the time the decision is made. What is the reasonable way to make such a choice? Some think we should accept a requirement of temporal neutrality and take both sets of values into account, others think we should decide on the strength of our present values, yet others think that in evaluating what will happen at that other time (...) we should use the values that we will endorse at that time instead of our present values. These views see the problem as one about finding some attitude towards time itself that is distinctively rational. This article argues that these views are subject to serious objections. It suggests that instead we should think in terms of well-being. If a person approves of, or positively responds to, the way their life is going they will experience more well-being than if there is no positive response. The article explores the implications of a positive response condition on well-being for deciding what it is rational to do in cases involving changing goals. (shrink)

Robert Alexy has built his original theory of law upon pervasive claims for “necessary” features of law. In this article, I show that Alexy's claims suffer from two difficulties. First, Alexy is never clear about what he means by “necessity.” Second, Alexy writes as if there have been no challenges to claims of conceptual necessity. There have been such challenges and Alexy needs to answer them if his project is to succeed.

Timothy Williamson has a marvelously precise account of epistemic justification in terms of knowledge and probability. I argue that the account runs aground on certain cases involving the probability values 0 and 1.

Aristotle is often credited with views about practical reasoning, desire, and action collectively referred to as the theory of the practical syllogism.Some commentators are skeptical about the existence of any such general theory, but most would agree that a theory of some sort is outlined in the De Motu Animalium and that it influences Aristotle’s account of akrasia in the icomachean Ethics.This paper will begin by describing the most important ideas in the De Motu Animalium discussion of the practical syllogism. (...) The ideas are simple but I think that their implications and philosophical importance have not been appreciated. I will suggest that the practical syllogism is Aristotle’s model for the rational explanation of action. Other commentators have made this claim, but I think that it can be given a very precise sense. Aristotle thinks that an action can be rationally explained if the agent acts in response to the strength of the reasons that he sees for acting. The practical syllogism is an argument that expresses the reasons in favor of the action, so if the agent acts for those reasons the action is explained by the practical syllogism. The second part of the paper considers the work that the practical syllogism does in Aristotle’s account of akrasia. I will argue that in akrasia—at least in the most extreme kind of akrasia—the agent acts intentionally to satisfy a desire but the action cannot be explained by a practical syllogism. Aristotle distinguishes between explanation by the motivational strength of desires and explanation by a practical syllogism. The last part of this paper comments on David Charles’s interpretation of Aristotle’s views about desire, practical reason, and akrasia. Charles discusses the traditionally disputed questions in a provocative way, and more importantly his suggestions fit together into a complex and philosophically sophisticated reading of Aristotle. I disagree with his most important claims, but I can best explain and defend my own interpretation by contrasting it with his. (shrink)

As interpreted by Pattee, von Neumann’s Theory of Self-Reproducing Automata has proved to be a useful tool for understanding some of the difficulties and paradoxes of molecular biosemiotics. But is its utility limited to molecular systems or is it more generally applicable within biosemiotics? One way of answering that question is to look at the Theory as a model for one particular high-level biosemiotic activity, human language. If the model is not useful for language, then it certainly cannot be generally (...) useful to biosemiotics. Beginning with the Universal Turing Machine and continuing with von Neumann’s Theory and Pattee’s interpretation, the properties of universality, programmability, underspecification, complementarity of description/construction, and open-ended evolutionary potential are shown to be usefully applicable to language, thus opening a new line of inquiry in biosemiotics. This Perspective traces the evolution of certain central notions in the theory of Generative Grammar (GG). The founding documents of the field suggested a relation between the grammar, construed as recursively enumerating an infinite set of sentences, and the idealized native speaker that was essentially equivalent to the relation between a formal language (a set of well-formed formulas) and an automaton that recognizes strings as belonging to the language or not. But this early view was later abandoned, when the focus (...) of the field shifted to the grammar's strong generative capacity as recursive generation of hierarchically structured objects as opposed to strings. The grammar is now no longer seen as specifying a set of well-formed expressions and in fact necessarily constructs expressions of any degree of intuitive “acceptability.” The field of GG, however, has not sufficiently acknowledged the significance of this shift in perspective, as evidenced by the fact that (informal and experimentally-controlled) observations about string acceptability continue to be treated as bona fide data and generalizations for the theory of GG. The focus on strong generative capacity, it is argued, requires a new discussion of what constitutes valid empirical evidence for GG beyond observations pertaining to weak generation. (shrink)
