Recently two distinct forms of rule-utilitarianism have been introduced that differ on how to measure the consequences of rules. Brad Hooker advocates fixed-rate rule-utilitarianism, while Michael Ridge advocates variable-rate rule-utilitarianism. I argue that both of these are inferior to a new proposal, optimum-rate rule-utilitarianism. According to optimum-rate rule-utilitarianism, an ideal code is the code whose optimum acceptance level is no lower than that of any alternative code. I then argue that all three forms of rule-utilitarianism fall prey to two fatal (...) problems that leave us without any viable form of rule-utilitarianism. (shrink)

Twentieth century philosophers introduced the distinction between “objective rightness” and “subjective rightness” to achieve two primary goals. The first goal is to reduce the paradoxical tension between our judgments of (i) what is best for an agent to do in light of the actual circumstances in which she acts and (ii) what is wisest for her to do in light of her mistaken or uncertain beliefs about her circumstances. The second goal is to provide moral guidance to an agent who (...) may be uncertain about the circumstances in which she acts, and hence is unable to use her standard moral principle directly in deciding what to do. This paper distinguishes two important senses of “moral guidance”; proposes criteria of adequacy for accounts of subjective rightness; canvasses existing definitions for “subjective rightness”; finds them all deficient; and proposes a new and more successful account. It argues that each comprehensive moral theory must include multiple principles of subjective rightness to address the epistemic situations of the full range of moral decision-makers, and shows that accounts of subjective rightness formulated in terms of what it would reasonable for the agent to believe cannot provide that guidance. -/- . What should we do if we cannot figure what morality requires of us? Holly M. Smith argues that the best moral codes solve this problem by offering two tiers, one of which tells us what makes acts right and wrong, and the other of which provides user-friendly decision guides. She opens a path towards resolving a deep problem of moral life.

The requirement that moral theories be usable for making decisions runs afoul of the fact that decision makers often lack sufficient information about their options to derive any accurate prescriptions from the standard theories. Many theorists attempt to solve this problem by adopting subjective moral theories—ones that ground obligations on the agent’s beliefs about the features of her options, rather than on the options’ actual features. Sensationalized representations of autistic families in film and other media frequently feature violent encounters between mothers and sons. This essay analyzes two media stories and three films that suggest how limited—and therefore misleading—popular representations of the autism family are. Except for one of the films, these representations blame the problem of adult autistic dependency on either monstrous autism or bad mothering. Doing so elides collective social responsibility for autism care and denies the reality that autistic adults continue to have complex (...) dependency needs that families cannot always meet. Narratives that sensationalize youth and adults with autism or scapegoat their maternal caregivers also diminish opportunities for social inclusion and for autistic people to live fully and dependently. Pushing back on policies favored by dying patients is a challenging endeavor, requiring tact, engagement, openness to bidirectional learning, and willingness to offer alternative solutions. It's easy to make missteps, especially in the age of social media. :To what extent, if any, should minors have a say about whether they participate in research that offers them no prospect of direct benefit? This article addresses this question as it pertains to minors who cannot understand enough about what their participation would involve to make an autonomous choice, but can comprehend enough to have and express opinions about participating. The first aim is to defend David Wendler and Seema Shah’s claim that minors who meet this description should not be (...) offered a choice about whether they participate. The second aim is to show, contra Wendler and Shah, that the principle of nonmaleficence requires more with respect to giving these minors a say than merely respecting their dissent. Additionally, it requires that investigators obtain affirmation of their non-dissent. This addresses intuitive concerns about denying children a choice, while steering clear of the problems that arise with allowing them one. (shrink)

Over the past three decades the ethnographic-based human sciences (anthropology, social linguistics, ethnomusicology, sociology, etc.) have come under heavy scrutiny for the perpetuation of injustice and inequality, and a lack of sensitivity to indigenous epistemologies and material needs. Among the nefarious epistemological issues is that of “transcendental knowledge,” information that is presented as “fact” or through impervious narrative in the mode of so-called empirical sciences. The model of transcendental knowledge still pervades the human sciences despite critiques from postcolonial and poststructural (...) scholars. Through a simultaneous re-evaluation of the Dialectic of Enlightenment 's critique and an analysis of the pressures and perils of the academic market, we can see how Horkheimer and Adorno's cautionary analysis can be applied to contemporary ethnography in an effort to philosophize and practice writing that does not submit to the reifying pressures of grand and grave theories and represents human life with the deserved dignity and distress. The theme of the dissertation is that we should not be too cautious about engaging in metaphysics of modality; what may appear to be a refusal to engage in metaphysical speculation may instead involve a commitment to epistemic consequences that we should not accept. In Part I, I argue that David Lewis's modal realism implies that scepticism towards induction is rationally unavoidable. I conclude that his theory must be rejected. ;While not endorsing Lewis's account of the nature of possible worlds, (...) I argue that the recombination principle is what is causing the problems, and that this principle will cause problems when combined with any theory of modality according to which there are objective matters of fact as to what is possible or necessary. ;I conclude that we must reject the recombination principle, and that any principle we accept in its place must be one which will not lead to inductive scepticism. This suggests that we cannot countenance any objective possibilities that contravene actual natural laws. ;In Part II, I argue that one sort of explanation is closely connected with objective possibility: A fundamental explanation for some state of affairs involves saying something about its nature that has implications for what is objectively possible. I defend a weak form of the principle of sufficient reason, according to which every state of affairs has a fundamental explanation ;I go on to recast and defend a version of the Cosmological Argument for the existence of God. This argument, on my view, is plausible only when taken as an inductive argument, and indeed, as an inference to the best explanation. I argue that the theistic hypothesis deserves to be taken seriously on its merits as an explanation; more generally, I claim that it is not sufficient grounds for rejecting any hypothesis simply to say that it involves commitments as to what is possible or necessary. A willingness to accept some such commitments is an unavoidable consequence of what we normally take to be rational ways of forming beliefs. (shrink)

We use the U.S. Supreme Court’s decision in Citizens United v. Federal Election Commission to assess the reputational risks created by political investment opportunities that allow managers to spend unlimited and potentially undisclosed firm resources on independent political expenditures. This new opportunity raises important ethical questions, as it is difficult, and perhaps impossible, under current law for shareholders to hold managers accountable for this investment choice and the reputational risks it entails. Using firms’ known political activity as a proxy for (...) managers’ likely future use of independent political expenditures, we examine how market participants reacted to Citizens United, conditional on this prior activity and corporate governance attributes related to the concentration of decision rights in senior management and blockholders. The results of our analyses document that firms with both a high level of known political activity and CEO-chairperson of the board duality experienced negative abnormal returns in reaction to Citizens United. In contrast, firms with concentrated ownership experienced positive abnormal returns; however, as known political activity increased, investors discounted the benefits of concentrated ownership. These findings suggest that investors expect this expansion of firms’ political investment opportunities to amplify principal-agent problems inherent in corporate political activity. Additionally, our findings provide evidence for those deliberating the mandatory disclosure of firms’ investments in politics as a means of increasing managerial accountability to both shareholders and the public. This article uses the methods that Locke advocated in his Essay Concerning Human Understanding to evaluate manuscript evidence from five different schemes and two drafts of the Fundamental Constitutions of Carolina, to thereby determine what role, if any, John Locke had in writing it, and in advocating for slavery and absolutism. It focuses on the influential claims put forward by David Armitage 20 years ago, that Locke was responsible for actively promoting slavery in Carolina’s Fundamental Constitutions. It enables the reader (...) to view, and judge, the relevant evidence. The author concludes, and invites the reader to conclude, that Armitage’s main claims lack foundation in the manuscript evidence. That evidence instead points towards the legal power of those who owned Carolina, the Lords Proprietors, and to the crown, which granted Carolina’s charter, and to the logic of a different theory of government, patriarchalism, for the rationale behind both slavery and absolutism. The central ideas behind slavery and colonization were epitomized, as Locke understood, by Sir Robert Filmer, who wrote the book to which Locke responded in his Two Treatises of Government. Filmer’s ally, Sir Henry Spelman, like Filmer a deeply committed royalist who believed in the king’s unlimited prerogatives, composed the original 1629 Carolina charter that shaped the Fundamental Constitutions. Misattributing the authorship of particular clauses to Locke is a symptom of a larger failure to distinguish the impact of momentous debates over authority and race in the seventeenth century. Locke’s theories did, in practice as well as principle, reject the theory of domination put forward by Filmer, and argued instead for human rights and democracy that were inclusive and capacious. The manuscript evidence has the potential to reshape how modern democratic theory is understood in the present. (shrink)

Many African American children make use of African American English in their everyday lives, and face academic barriers when introduced to Standard American English in the classroom. Research has shown that students who can adapt and use SAE for academic purposes demonstrate significantly better test scores than their less adaptable peers. Accordingly, AAE use and its confirmed inverse relationship to reading achievement have been implicated in the Black-White Test Score Gap, thus becoming the focus of intense research and practical interest. (...) This volume discusses dialectal code-switching from AAE to SAE and stresses the benefits and importance of African American students becoming bi-dialectal. It provides background theory and science supporting the most promising educational approach to date, Contrastive Analysis, a set of longstanding methods drawn from Second Language research and used effectively with students ranging from kindergarten through college. It offers a deeper knowledge of AAE use by students, the critical features of Contrastive Analysis, and detailed information about successful applications which teachers can apply in their own pedagogy. I never set out to prove anyone wrong. What I am about to describe started just over a decade ago when I simply wanted to learn more about what fascinates me most, which is human evolution. Previous studies have shown cognitive task performance to be affected by tinnitus severity, but also that the literature is conflicted. This study sought to identify neuroticism as a possible confound, since severe tinnitus distress is associated with higher levels of neuroticism. A total of 78 participants undertook two cognitive tasks. It was found that when undertaking a Stroop paradigm, controlling for neuroticism rendered previously significant results not significant. It was also found that neuroticism was not a significant covariate for a (...) change blindness task. Gender, age, anxiety, and depression were all controlled for, and future implications for the literature discussed. (shrink)

Recent writers on negligence and culpable ignorance have argued that there are two kinds of culpable ignorance: tracing cases, in which the agent’s ignorance traces back to some culpable act or omission of hers in the past that led to the current act, which therefore arguably inherits the culpability of that earlier failure; and non-tracing cases, in which there is no such earlier failure, so the agent’s current state of ignorance must be culpable in its own right. An unusual but (...) intriguing justification for blaming agents in non-tracing cases is provided by Attributionism, which holds that we are as blameworthy for our non-voluntary emotional reactions, spontaneous attitudes, and the ensuing patterns of awareness as we are for our voluntary actions. The Attributionist explanation for why some non-tracing cases involve culpability is an appealing one, even though it has limited scope. After providing a deeper account of why we should take the Attributionist position seriously, I use recent psychological research to argue for a new account of the conditions under which agents are culpable for straightforward instances of blameworthy acts. That account is extended to blameworthiness for non-voluntary responses. I conclude that even when the agent’s failure to notice arises from a nonvoluntary objectionable attitude, very few such cases are ones in which Attributionism implies that the agent is blameworthy for her act. It's commonly understood within the academy that the terms "man," "woman," and "other" are socially constructed, and that their meanings are maintained by the current political order. But few thinkers have attempted to reconcile that knowledge - which is rooted in Marxism - with queer theory. The few who have, meanwhile, usually attempt to do so through issues of libidinal desire and sexual expression. In the Politics of Everybody, Holly Lewis argues powerfully that the emphasis on desire, though seemingly (...) innocuous, is actually symptomatic of neoliberal habits of thought, and consequently, is responsible for a continued focus on the limited politics of identity. Two Greek myths attest to the power of music to blur distinctions between humans and nonhumans: Orpheus made music that inspired human-like attention in animals, trees, and stones, while the Sirens reduced passing sailors to the level of animals incapable of resisting their song. Recast in terms employed by Lacan, these myths portray music as calling forth a response in creatures thought merely able to react and, contrariwise, stripping away the capacity for response in humans, leaving nothing but reaction in (...) its place. Critiquing Lacan’s dogmatic distinction between human and animal behavior, Derrida questioned the “purity and indivisibility” of reaction and response and recommended that critics explore the involvement of both in “the whole differentiated field of experience and of a world of life-forms.” In this essay, I take up Derrida’s challenge with regard to music as it has been understood in the European aesthetic tradition. While music has long been considered capable of provoking highly refined cognitive and emotional responses, it also acts upon the body in a wide variety of ways, many of them involuntary – a fact that has struck music’s advocates as alternately promising and disturbing. Revisiting eighteenth- and nineteenth-century commentaries by the philosophers and critics Johann Georg Sulzer, Johann Gottfried Herder, and Eduard Hanslick, I first illuminate persistent anxieties over the admixture of reaction and response in musical listening. I then turn to recent ethological studies in order to argue against any decisive separation of the human from the nonhuman in the arena of musical aesthetics. (shrink)
