This paper is a response to particularist critics of the normative force of moral principles. The particularist critique, as I understand it, is a rejection not only of principle‐based accounts of moral deliberation and justification, but also of accounts of character in which principles play a central role. I focus on the latter challenge and counter it with a view I call character‐principlism. I begin by discussing in a general way what motivates the particularity objection to principles and then contrast (...) two views – both of which insist on the importance of attentiveness to particularity – about the relative normative status of principles and particular cases. I present some reasons for believing that we need a more normatively robust conception of the role of moral principles than the particularists provide. In the main portion of the paper, I discuss how character‐principlism sees principles functioning in our lives and the lives we lead with others. I contrast this with some other accounts of desirable character that particularists can embrace, and argue that these are seriously flawed because, unlike character‐principlism, they cannot satisfactorily explain how a person could possess the constancy of character that moral integrity requires. The pluralism that democratic regimes foster creates the following serious problem in societies: When people disagree so fundamentally about the good life, where are the grounds of social unity to be found? This is a quite general problem for liberal political theory, but in this chapter I want to focus on a related but narrower set of issues having to do with what justice requires with respect to the provision of health care in modern democratic societies.

Social contract theory has been criticized as a “theory in search of application.” We argue that incorporating the nano- or individual level of analysis into social contract inquiry will yield more descriptive theory. We draw upon the psychological contract perspective to address two critiques of social contract theory: its rigid macro orientation and inattention to the process of contract formation. We demonstrate how a psychological contract approach offers practical insight into the impact of social contracting on day-today human interaction.

People who defend “pragmatic encroachment” about knowledge generally advocate two ideas: you can rationally act according to what you know; knowledge is harder to achieve when more is at stake. In their chapter in this volume, Charity Anderson and John Hawthorne argue that these two ideas may not fit together so well. This chapter extends Anderson and Hawthorne’s argument. By applying some standard decision theory, we can calculate a precise quantity of “how much is at stake” that does fit together (...) with knowledge and action. One of the unique insights provided by the growing number of fully sequenced genomes is the pervasiveness of gene duplication and gene loss. Indeed, several metrics now suggest that rates of gene birth and death per gene are only 10–40% lower than nucleotide substitutions per site, and that per nucleotide, the consequent lineage‐specific expansion and contraction of gene families may play at least as large a role in adaptation as changes in orthologous sequences. While gene family evolution is pervasive, it (...) may be especially important in our own evolution since it appears that the “revolving door” of gene duplication and loss has undergone multiple accelerations in the lineage leading to humans. In this paper, we review current understanding of gene family evolution including: methods for inferring copy number change, evidence for adaptive expansion and adaptive contraction of gene families, the origins of new families and deaths of previously established ones, and finally we conclude with a perspective on challenges and promising directions for future research. This is the first volume compiling English translations of Leibniz's journal articles on natural philosophy, presenting a selection of 26 articles, only three of which have appeared before in English translation. It also includes in full Leibniz's public controversies with De Catelan, Papin, and Hartsoeker. The articles include work in optics, on the fracture strength of materials, and on motion in a resisting medium, and Leibniz's pioneering applications of his calculus to these issues by construing them as mini-max and inverse (...) tangent problems. In this book, Jeffrey Blustein provides a systematic and philosophically rigorous account of a morality of memory. McNeil (bio)René Girard's (1923–2015) mimetic theory and Georges Bataille's (1897–1962) theory of the sacred both describe an unwitting pull to violence fueled by an aspect of desire. This violence cannot be denied but may be channeled through ritual, resulting in social cohesion or utter catastrophe. Their theories also illustrate the contagious flow of affective violence between individuals, quickly infecting the whole. (...) Girard describes a violent contagion that threatens physical annihilation, while Bataille's more vital contagion illustrates the dissolution of self into other. Both come to the same result—collective cohesion. However, for all the similarities, the essential mechanisms "end up with profoundly different visions of the dynamics sustaining the social bond and, indeed, of society's whole affective economy."1 For Girard, the operative community requires distinct individuals specific in their identities. A lack of distinctions between individuals—a state he calls undifferentiation—leads to a struggle for identity, conflict, and violence. Unity comes from the catharsis of collectively thwarting violence before conflict can destroy the community. For Bataille, unity comes from collectively communicating through ritual. A [End Page 103] primal urge to slip out of the hierarchical mastery of discontinuous being and join with the other in a step closer to continuous being unites through mutual affect generated through shared experience. Girard asserts that cohesion occurs by maintaining separation, while Bataille describes cohesion generated in its destruction.Despite their similar concerns and many agreements, Girard and Bataille have rarely been compared. Among those few studies, Tiina Arppe argues that the divergence in both thinkers' theories can be found in their sources, namely, Emile Durkheim's theory of the sacred and Alexandre Kojève's reading of Hegel.2 Antony D. Traylor argues in answering the question of the purpose of sacrifice that Bataille's understanding may add to or replace Girard's scapegoat mechanism.3 Traylor dissects both theories focusing on Girard's critique of metaphysical desire and Bataille's notion of sovereignty. Nidesh Lawtoo mobilizes both thinkers and others to unmask the mimetic forces entwined in ego creation.4 First, similar to Arppe, I argue that apparent contradictions between Girard and Bataille arise from critical influences of each thinker and offer an analysis paving the way, like Traylor, toward compatibility. However, I focus on the influence (or denial) of Sigmund Freud and Marcel Mauss—whom I argue are the most crucial influences for untangling these theories. By examining Girard's interpretation of Freud's theory of cultural origin and Bataille's use of Mauss's notion of the gift and potlatch, I trace a short anthropological genealogy of the sacred that proves critical to both theories.5 In that regard, I eschew wrestling with metaphysical concerns and instead take an anthropological approach to the sacred that moves beyond compatibility. Second, we perform a synthetization, illuminating a shared mimetic force lurking within both theories and how Bataille offers an expansion to Girard's already acute observations—for which Lawtoo's notions of the mimetic unconscious and mimetic communication are essential.My primary source for Girard's theory is Violence and the Sacred, with secondary support from The Scapegoat and Things Hidden since the Foundation of the World. Although consumers are increasingly engaged with ethical factors when forming opinions about products and making purchase decisions, recent studies have highlighted significant differences between consumers' intentions to consume ethically, and their actual purchase behaviour. This article contributes to an understanding of this 'Ethical Purchasing Gap' through a review of existing literature, and the inductive analysis of focus group discussions. A model is suggested which includes exogenous variables such as moral maturity and age which have been well covered in the literature, (...) together with further impeding factors identified from the focus group discussions. For some consumers, inertia in purchasing behaviour was such that the decision-making process was devoid of ethical considerations. Several consumers manifested their ethical views through post-purchase dissonance and retrospective feelings of guilt. Others displayed a reluctance to consume ethically due to personal constraints, a perceived negative impact on image or quality, or an outright negation of responsibility. Those who expressed a desire to consume ethically often seemed deterred by cynicism, which caused them to question the impact they, as an individual, could achieve. These findings enhance the understanding of ethical consumption decisions and provide a platform for future research in this area. (shrink)

In Wittgenstein On Rules and Private Language, Kripke notes Wittgenstein’s puzzling ambivalence toward introspection. On the one hand Wittgenstein repudiates introspection and on the other he uses it in his own philosophical investigations. To resolve the paradox, this paper distinguishes between introspective methodology in psychological and philosophical investigations. Wittgenstein’s arguments against introspection are specifically directed at introspective methodology (...) in psychology. He argues that the use of introspection to discover “inner causes” commits one to a conception of “direct inner awareness”. On that conception, psychological self-ascriptions are considered highly reliable due to the superiority of the subjective vantage point in ascertaining one’s own mental contents. As an alternative, Wittgenstein maintains that this reliability stems from the grammar of the ascription. One common justification for the pursuit of profit by business firms within a market economy is that profit is not an end in itself but a means to more efficiently produce and allocate resources. Profit, in short, is a mechanism that serves the market’s purpose of producing Pareto superior outcomes for society. This discussion examines whether such a justification, if correct, requires business managers to remain attentive to how their firm’s operation impacts the market’s purpose. In particular, it is argued (...) that the value of efficiency, despite views to the contrary, cannot be fully separated from the planning and intentions of business managers as long as those managers direct their firms in an ethically responsible fashion. This position is inspired by, and serves as a supportive clarification of Joseph Heath’s so-called “market failures approach” to business ethics. (shrink)

ABSTRACT:Does effective moral judgment in business ethics rely upon the identification of a suitable set of moral principles? We address this question by examining a number of criticisms of the role that principles can play in moral judgment. Critics claim that reliance on principles requires moral agents to abstract themselves from actual circumstances, relationships and personal commitments in answering moral questions. This is said to enforce an artificial uniformity in moral judgment. We challenge these critics by developing an account of (...) principle-based moral judgment that has been widely discussed by contemporary Kantian scholars. In so doing we respond to some basic problems raised by so-called “moral particularists” who voice theoretical objections to the role of principles as well as to contemporary business ethicists who have criticized principle-based moral judgment along similar lines. ABSTRACT:In this address I argue that different perspectives on the normative foundations of corporate responsibility reflect underlying disagreements about the ideal arrangement of tasks between market and state. I initially recommend that scholars look back to the “division of moral labor” inspired by John Rawls’ seminal work on distributive justice in order to rethink why, and to what extent, corporations take on responsibilities normally within the purview of government. I then examine how this notion is related to recent theoretical work (...) in the field of business ethics. I thereafter turn to provide a brief outline of an alternative view that sees corporations as having responsibilities in so far as markets are sites of delegated oversight over the production of social goods that might otherwise be administered by the state. I was there because a missionary asked me to come, told me stories of conditions in Sudan and convinced me that I could save lives. He was right.Her twin brother was born eight hours earlier, sometime around midnight. The birth attendants managed the delivery as well as anyone could in the same situation. The last time I had attempted to manage such a problem delivery was almost twenty years earlier when I had been a Navy Lieutenant fresh out of my surgical internship on temporary assignment to a Marine Corps battle group in the Philippines. On that deployment, a corpsman brought me to a grass hut where a woman who looked barely more than a child herself labored against a breach delivery. I spent the day examining her while her family brought me things to eat that I do not believe should be eaten. After six hours of no progress, I radioed for a helicopter to take her to Clark Air Force base where they had operating rooms and obstetricians. In South Sudan, we had no such resources.My oldest daughter, a premed student at the time who had worked with me in Sudan on other occasions, sat in the corner with her classmates and watched as I put my hand inside the mother. She was of the Dinka ethnic group and was a large, robust woman who sweated profusely and occasionally caught her breath, but otherwise seemed unmoved by her contractions. Fluids gushed over my gloved hand and the students gasped. I felt the baby's leg retract slightly as if she resented my intrusion.I could not get past the baby's hip—she was wedged tightly in the uterus. I had some medicines that were used to hasten delivery and, not really knowing if it was the right thing to do, I gave the mother some through her IV. Still I could not dislodge the child. I told the students and birth attendants that we would give her one hour while I rounded on the other patients in our remote and poorly equipped clinic. If she did not deliver by that time we would take her to a facility run by a Catholic relief agency several hours drive from us—a drive that due to war, weather, or mechanical problems we could not always complete.I saw the rest of the patients in a hurry while browsing through all of the medical texts and the few books we kept at the clinic. This child's only hope of surviving was for her mother to have a cesarean section, and as quickly as possible. After determining that none of our other patients were in imminent danger, we loaded the mother, the first-born twin, and the grandmother into our vehicle for the long ride. One of the medical students, who at the time of this writing was completing her residency in obstetrics and gynecology, asked me if I shouldn't pray for the woman while we drove. I felt guilty for not praying out loud without being prompted, so I reached back and placed my hand on the mother's abdomen and prayed while I drove. I felt a slight movement. As medical technology becomes more sophisticate the ability to manipulate nature and manage disease forces the dilemma of when can becomes ought. Indeed, most bioethical discourse is framed in terms of balancing the values and interests and the benefits and burdens that inform principled decisions about how, when, and whether interventions should occur. Yet, despite advances in science and technology, one caregiver mandate remains as constant and compelling as it was for the earliest shaman—the relief of pain. Even when cure (...) is impossible, the physician's duty of care includes palliation. Moreover, the centrality of this obligation is both unquestioned and universal, transcending time and cultural boundaries.Although universally acknowledged, pain is a complex phenomenon for both the patient and the caregiver, influenced as much by personal values and cultural traditions as by physiological injury and disease.
