For years, the number of opaque algorithmic decision-making systems (ADM systems) with a large impact on society has been increasing: e.g., systems that compute decisions about future recidivism of criminals, credit worthiness, or the many small decision computing systems within social networks that create rankings, provide recommendations, or filter content. Concerns that such a system makes biased decisions can be difficult to investigate: be it by people affected, NGOs, stakeholders, governmental testing and auditing authorities, or other external parties. Scientific testing (...) and auditing literature rarely focuses on the specific needs for such investigations and suffers from ambiguous terminologies. With this paper, we aim to support this investigation process by collecting, explaining, and categorizing methods of testing for bias, which are applicable to black-box systems, given that inputs and respective outputs can be observed. For this purpose, we provide a taxonomy that can be used to select suitable test methods adapted to the respective situation. This taxonomy takes multiple aspects into account, for example the effort to implement a given test method, its technical requirement (such as the need of ground truth) and social constraints of the investigation, e.g., the protection of business secrets. Furthermore, we analyze which test method can be used in the context of which black box audit concept. It turns out that various factors, such as the type of black box audit or the lack of an oracle, may limit the selection of applicable tests. With the help of this paper, people or organizations who want to test an ADM system for bias can identify which test methods and auditing concepts are applicable and what implications they entail. We have considered a simple word game called the word-morph. After making our participants play a stipulated number of word-morph games, we have analyzed the experimental data. We have given a detailed analysis of the learning involved in solving this word game. We propose that people are inclined to learn landmarks when they are asked to navigate from a source to a destination. We note that these landmarks are nodes that have high closeness-centrality ranking.

Algorithmic systems are increasingly used by state agencies to inform decisions about humans. They produce scores on risks of recidivism in criminal justice, indicate the probability for a job seeker to find a job in the labor market, or calculate whether an applicant should get access to a certain university program. In this contribution, we take an interdisciplinary perspective, provide a bird’s eye view of the different key decisions that are to be taken when state actors decide to use an (...) algorithmic system, and illustrate these decisions with empirical examples from case studies. Building on these insights, we discuss the main pitfalls and promises of the use of algorithmic system by the state and focus on four levels: The most basic question whether an algorithmic system should be used at all, the regulation and governance of the system, issues of algorithm design, and, finally, questions related to the implementation of the system on the ground and the human–machine-interaction that comes with it. Based on our assessment of the advantages and challenges that arise at each of these levels, we propose a set of crucial questions to be asked when such intricate matters are addressed. (shrink)

In his appendix to Soemmerring’s On the organ of the soul, Kant famously rejects the idea of a local presence or seat of the soul in the brain as fundamentally misguided. „By contrast, a virtual presence“ of the soul, considered as a conceptual construct, is said to make it possible to treat „the question regarding the sensorium commune as a merely physiological task“. Where Kant’s German original reads „möglich“, Arnulf Zweig in The Cambridge Edition of the Works of Immanuel (...) Kant translates surprisingly as „impossible“. This cardinal error shall be communicated to readers who do not habitually consult the German original. Against this background, I illuminate the Kantian position with in-depth material from Kant’s respective drafts and in contrast to the syncretistic–materialistic approach of Johann Jacob Wilhelm Heinse. A realist view of numbers often rests on the following thesis: statements like ‘The number of moons of Jupiter is four’ are identity statements in which the copula is flanked by singular terms whose semantic function consists in referring to a number (henceforth: Identity). On the basis of Identity the realists argue that the assertive use of such statements commits us to numbers. Recently, some anti-realists have disputed this argument. According to them, Identity is false, and, thus, we may deny (...) that the relevant statements commit us to numbers. The present paper argues that the correct linguistic analysis of the relevant number statements supports the anti-realist view that Identity is false. However, as will further be shown, pace the anti-realist, this analysis does not establish that such statements do not commit us to numbers after all. (shrink)

As the pre-eminent Enlightenment philosopher, Kant famously calls on all humans to make up their own minds, independently from the constraints imposed on them by others. Kant's focus, however, is on universal human reason, and he tells us little about what makes us individual persons. In this book, Katharina T. Kraus explores Kant's distinctive account of psychological personhood by unfolding how, according to Kant, we come to know ourselves as such persons. Drawing on Kant's Critical works and on his (...) Lectures and Reflections, Kraus develops the first textually comprehensive and systematically coherent account of our capacity for what Kant calls 'inner experience'. The novel view of self-knowledge and self-formation in Kant that she offers addresses present-day issues in philosophy of mind and will be relevant for contemporary philosophical debates. It will be of interest to scholars of the history of philosophy, as well as of philosophy of mind and psychology. (shrink)

Testimony of oppression is testimony that something constitutes or contributes to a form of oppression, such as, for example, “The stranger’s comment was sexist.” Testimony of oppression that is given by members of the relevant oppressed group has the potential to play an important role in fostering a shared understanding of oppression. Yet, it is frequently dismissed out of hand. Against the background of a recent debate on moral testimony, this paper discusses the following question: How should privileged hearers approach (...) testimony of oppression if they aim to do so in an ethically and epistemically sound way? Should they defer or try to understand? Both strategies constitute ways of learning from testimony of oppression. However, they differ in important respects and exclude each other. Because testimony of oppression is often based on personal experience, empathizing with the speaker can play an important role in trying to understand testimony of oppression. While the fact that empathy can change your mind and the advantages of understanding over knowledge support trying to understand as the right approach to testimony of oppression, considerations of the “limits of empathy” and the value of deference support deferring. I argue that, on balance, these contrasting arguments allow for a limited defense of the role of empathy in learning from testimony of oppression. We should try to understand testimony of oppression by empathizing with the speaker, but not treat our ability to understand as a condition on accepting a speaker’s claim. (shrink)

While writing this thesis, there were many things I wanted to get right. I wanted to get the data right. I wanted to get my analysis of the data right. I certainly wanted to get all my citations right, which can get pretty tricky when one is trying to finish a chapter at 2am. But if an error did creep in somewhere in the body of the thesis, that is not a disaster. Sooner or later, I will get a chance (...) to correct it in a future publication. However, this part of the thesis, which sits right at the beginning but was among the last to be written, is different. I only have one opportunity to express, in print, how thankful I am to the people whose assistance was so important to me over the past years. Which is unfortunate, since if I were to truly elaborate all I am thankful for, these acknowledgements would be the lengthiest chapter of the thesis. Although moral relativists often appeal to cases of apparent moral disagreement between members of different communities to motivate their view, accounting for these exchanges as evincing genuine disagreements constitutes a challenge to the coherence of moral relativism. While many moral relativists acknowledge this problem, attempts to solve it so far have been wanting. In response, moral relativists either give up the claim that there can be moral disagreement between members of different communities or end up with a view on which (...) these disagreements have no “epistemic significance” because they are always faultless. This paper introduces an alternative strategy: accounting for disagreement in terms of “metalinguistic negotiation”. It argues that this strategy constitutes a better solution to the challenge disagreement poses for moral relativists because it leads to a nuanced understanding of the epistemic significance of moral disagreement between members of different communities. The upshot is a novel account of disagreement for moral relativists that has consequences for how moral relativism should be understood. (shrink)

Gaslighting is a form of manipulation that undermines a target’s confidence in their own cognitive faculties. Different forms of gaslighting can be distinguished according to whether they undermine a target’s confidence in their emotional reactions, perceptions, memory, or reasoning abilities. I focus on ‘emotional gaslighting’, which undermines a target’s confidence in their emotional reactions and corresponding evaluative judgments. While emotional gaslighting rarely occurs in isolation, it is often an important part of an overall gaslighting strategy. This is because emotions can (...) help us to understand the evaluative aspects of our situation and thus put us in a position to protest wrongs, which is a context in which gaslighting frequently occurs. I argue that affective empathy constitutes an important antidote to emotional gaslighting. Affective empathy can lead to endorsement of a target’s emotional reaction as appropriate to their situation and agreement with the corresponding evaluative judgment. When it leads to endorsement, affective empathy can counteract the effects of emotional gaslighting because it reassures a target in their ability to make evaluative judgments based on their emotional reactions. Because of its opposing effects, affective empathy with the victim thus constitutes an important intervention to emotional gaslighting on the part of third parties. (shrink)

Social scientists have observed a sharp rise in affective polar­ization in many societies, particularly the United States. Since it is widely agreed that this poses a threat to democracy, finding solutions to this predicament is essential. One prominent proposal to depolarize the electorate holds that citizens need to exercise their capacities for empathy with the political opposition. However, defenders of the empathy response to affective polarization have yet to fully specify the range of mechanisms through which empathy can counteract polarization. (...) Recent proposals focus on empathy’s role in finding common ground and humanizing others. Drawing on the wider empathy literature, we identify several additional ways empathy might counter affective polarization. We show that the resultant account has important implications for the sorts of empathetic engagement with cross-partisans that is likely to reduce polarization. Our aim is to contribute to a deeper understanding of the potential of different kinds of empathetic engagement to counter polarization as well as the limits of empathy as a response to polarization. During gestation, fetomaternal exchange occurs in the villous tree (labyrinth) of the placenta. Development of this structure depends on tightly coordinated cellular processes of branching morphogenesis and differentiation of specialized trophoblast cells. The basal chorionic trophoblast (BCT) cell layer that localizes next to the chorioallantoic interface is of critical importance for labyrinth morphogenesis in rodents. Gcm1‐positive cell clusters within this layer initiate branching morphogenesis thereby guiding allantoic fetal blood vessels towards maternal blood sinuses. Later these cells differentiate and contribute to (...) the syncytiotrophoblast of the fetomaternal barrier. Additional cells within the BCT layer sustain continued morphogenesis, possibly through a repopulating progenitor population. Several mouse mutants highlight the importance of a structurally intact BCT epithelium, and a growing number of studies addresses its patterning and epithelial architecture. Here, we review and discuss emerging concepts in labyrinth development focussing on the biology of the BCT cell layer. (shrink)

Actions are of interest both as samples of what an animal can do and as symptoms of underlying structures, either psychic or physical. Doubtless, actions as symptoms of underlying structures are, in the long run, of greater importance in social science than actions (...) as samples of capacities, for to be able to predict an organism’s further performance on the basis of knowledge of capacities is not necessarily to understand the organism. Understanding actions, if it is indeed the desideratum of social science—as I take it to be—involves more, however, than the viewing of actions as symptomatic of underlying structures. Actions are obviously bearers of meaning in and for a given social context, and this meaning is for both the agent and actual or imagined spectators. Spectators can be said to do their viewing both at the time the action takes place and also, in a sense, at later times when recalling or reading reports of a now past action. (shrink)

If circumstances were always simple and all arguers were always exclusively concerned with cognitive improvement, arguments would probably always be cooperative. However, we have other goals and there are other arguers, so in practice the default seems to be adversarial argumentation. We naturally inhabit the heuristically helpful but cooperation-inhibiting roles of proponents and opponents. We can, however, opt for more cooperative roles. The resources of virtue argumentation theory are used to explain when proactive cooperation is permissible, advisable, and even mandatory (...) – and also when it is not. (shrink)

Meta-emotions are emotions about emotions, such as, for example, shame about anger. An important subset of meta-emotions constitutes a special case of co-experienced emotions, in which one emotion is directed at another emotion experienced by a subject at the same time. By making us reflectively aware of our own first-order emotions and suggesting an evaluation of them, meta-emotions enable reflection on our own emotional sensibility. In this paper, I explore the roles of meta-emotions in the context of affective empathy. I (...) show that, whereas meta-emotions on the side of the target person increase the complexity of empathy’s success conditions, meta-emotions on the side of the empathiser expand the role of meta-emotions for self-reflection and give rise to parallel phenomena of other-directed reflection. Exploring the roles of meta-emotions in the context of affective empathy allows us to better understand the significance of meta-emotions, as well as the functions of affective empathy. (shrink)

A powerful objection against moral conventionalism says that it gives the wrong reasons for individual rights and duties. The reason why I must not break my promise to you, for example, should lie in the damage to you—rather than to the practice of promising or to all other participants in that practice. Common targets of this objection include the theories of Hobbes, Gauthier, Hooker, Binmore, and Rawls. I argue that the conventionalism of these theories is superficial; genuinely conventionalist theories are (...) not vulnerable to the objection; and genuine moral conventionalism is independently plausible. This paper investigates the process of reasoning through which a judge determines whether a precedent-case gives her a binding reason to follow in her present-case. I review the objections that have been raised against the two main accounts of reasoning by precedent: the rule-account and the analogy-account. I argue that both accounts can be made viable by amending them to meet the objections. Nonetheless, I believe that there is an argument for preferring accounts that integrate analogical reasoning: any account of (...) reasoning by precedent that is descriptively minimally adequate will leave some room for judicial discretion. Discretion should be used under consideration of the best legally relevant arguments for and against a decision. Integrating analogical reasoning helps the judge to bring to her own attention the strongest case for following. Analogical reasoning also eases the recognition of possible reasons for distinguishing. Thereby, it facilitates a more balanced decision-making process. (shrink)

When we learn about a severe moral transgression that has been committed, we are often not only horrified but also puzzled. We are inclined to raise questions such as ‘Why did they do this?’ or exclaim: ‘I cannot understand why anyone would do such a thing!’. This suggests that there is something difficult to understand about severe moral wrongs. In this paper, I offer an explanation of the phenomenon that severe moral transgressions are often difficult to understand. I begin by (...) arguing that the relevant sense in which we try but often fail to understand morally bad action is that we try but fail to empathize with the agent at the time of the action. Then, I introduce a distinction between two broad kinds of morally bad action. Finally, I show that each of these kinds of morally bad action gives rise to obstacles to empathizing with the agent at the time of the action. Based on this explanation, I consider whether we should try to overcome this limitation to our understanding. (shrink)

Because it is often argued that surrogacy should not be treated as contractual, the question arises in which terms this practice might then be couched. In this article, I argue that a phenomenology of surrogacy centering on the notion of trust provides a description that is illuminating from the moral point of view. My thesis is that surrogacy establishes a complex and extended reproductive unit––the “surrogacy triad” consisting of the surrogate mother, the child, and the intending parents––whose constituents are bound (...) together by mutual trustful commitments. Even though a trust-based approach does not provide an ultimate answer to whether surrogacy should be sanctioned or prohibited, it allows for at least some practical suggestions. In particular, I will argue that, under certain conditions, surrogacy is tenable within familial or other significant relationships, and I will stress the necessity of acknowledging the new relationships and moral commitments that result from this practice. This paper examines whether Kant’s Critical philosophy offers resources for a conception of empirical psychology as a theoretical science in its own right, rather than as a part of applied moral philosophy or of pragmatic anthropology. In contrast to current interpretations, this paper argues that Kant’s conception of inner experience provides relevant resources for the theoretical foundation of scientific psychology, in particular with respect to its subject matter and its methodological presuppositions. Central to this interpretation is the regulative idea of (...) the soul, which supplies principles of systematicity at different levels. Firstly, the idea defines the way in which we must reflect on mental beings, i.e., those beings that fall in the domain of psychology. Secondly, it provides a principle for the unification of a systematic body of psychological laws. In consequence, by approaching the object of psychology from the perspective of the self-conscious subject, who––in virtue of being capable of inner experience––first constitutes a psychological reality, Kant’s theory offers an attractive alternative to reductionist conceptions of psychology. This paper concerns Yablo’s theory of asserted content as it is developed in his new book Aboutness. Yablo’s central idea is that in order to specify the asserted content of a sentence, we have to subtract those parts of its full semantic content that concern irrelevant subject matters. The paper argues that it is doubtful whether Yablo’s account successfully deals with its most basic envisaged application: to account for a difference of apparent truth value in cases of ordinary presupposition failure. In addition, some doubts are raised concerning the success of the extension of Yablo’s account to fictional talk, the informativeness of identity statements, and ontological commitments of number talk. This paper draws some bold conclusions from modest premises. My topic is an old one, the Neohumean view of practical rationality. First, I show that this view consists of two independent claims, instrumentalism and subjectivism. Most critics run these together. Instrumentalism is entailed by many theories beyond Neohumeanism, viz. by any theory that says rational actions maximize something. Second, I give a new argument against instrumentalism, using simple counterexamples. This argument systematically undermines consequentialism and rational choice theory, I show, using (...) detailed examples of their many social science applications. There is no obvious fix. Bare plurals (dogs) behave in ways that quantified plurals (some dogs) do not. For instance, while the sentence John owns dogs implies that John owns more than one dog, its negation John does not own dogs does not mean “John does not own more than one dog”, but rather “John does not own a dog”. A second puzzling behavior is known as the dependent plural reading; when in the scope of another plural, the ‘more than one’ meaning of the plural (...) is not distributed over, but the existential force of the plural is. For example, My friends attend good schools requires that each of my friends attend one good school, not more, while at the same time being inappropriate if all my friends attend the same school. This paper shows that both these phenomena, and others, arise from the same cause. Namely, the plural noun itself does not assert ‘more than one’, but rather the plural denotes a predicate that is number neutral (unspecified for cardinality). The ‘more than one’ meaning arises as an scalar implicature, relying on the scalar relationship between the bare plural and its singular alternative, and calculated in a sub-sentential domain; namely, before existential closure of the event variable. Finally, implications of this analysis will be discussed for the analysis of the quantified noun phrases that interact with bare plurals, such as indefinite numeral DPs (three boys), and singular universals (every boy). When facing a choice between saving one person and saving many, some people have argued that fairness requires us to decide without aggregating numbers; rather we should decide by coin toss or some form of lottery, or alternatively we should straightforwardly save the greater number but justify this in a non-aggregating contractualist way. This paper expands the debate beyond well-known number cases to previously under-considered probability cases, in which not (only) the numbers of people, but (also) the probabilities of success (...) for saving people vary. It is shown that, in these latter cases, both the coin toss and the lottery lead to what is called an awkward conclusion, which makes probabilities count in a problematic way. Attempts to avoid this conclusion are shown to lead into difficulties as well. Finally, it is shown that while the greater number method cannot be justified on contractualist grounds for probability cases, it may be replaced by another decision method which is so justified. This decision method is extensionally equivalent to maximising expected value and seems to be the least problematic way of dealing with probability cases in a non-aggregating manner. (shrink)

ABSTRACTAccording to Yablo, in uttering sentences that imply the existence of abstract objects, we do not assert their literal content. Instead, we only make a weaker conditional claim that does not have the controversial implication. In this commentary I argue that the conditional claims Yablo suggests we are making are true only if abstract objects exist and, thus, also carry the controversial implication.

Much has been written about the value of law, mostly in ideational terms. In this article, I draw attention to law’s pecuniary value. Law, I argue, is the very stuff from which many wealth generating, or capital, assets are made, foremost among them intangible assets that account for most of the private wealth today. For law to serve as a fountain of wealth, it must be backed by state power, and indeed, sovereign states have been more than willing to offer (...) a helping hand. They have found intellectual support in neoclassical economics and in its off-spring, law and economics, theoretical approaches that have sought to ground law in the scientific analysis of the economy, in efficiency rather than in justice. In doing so, they have averted their eyes from the fact that the most critical source for wealth, that is law, is itself of the state and should be subject to social norms enshrined in our constitutions, not abstract welfarism. Anscombe is usually seen as a critic of “Modern Moral Philosophy.” I attempt a systematic reconstruction and a defense of Anscombe’s positive theory. Anscombe’s metaethics is a hybrid of social constructivism and Aristotelian naturalism. Her three main claims are the following: (1) We cannot trace all duties back to one moral principle; there is more than one source of normativity. (2) Whether I have a certain duty will often be determined by the social practices of my community. For instance, duties (...) imposed by other people’s rights are socially constructed. (3) Whether something constitutes a good, however, will often be determined by human nature—which is not socially constructed. (shrink)
