Public reason liberalism holds that laws and policies must be justifiable to all reasonable citizens. Recently, David Enoch has offered an impressive and influential argument against the epistemological commitments of public reason liberalism on the grounds that they are ‘highly controversial’. After setting out this argument (Sections I and II), I show how its central claim is ambiguous between two senses of ‘controversial’. This gives rise to a dilemma: either Enoch's claim is that the relevant epistemological commitments are controversial in (...) the sense of being subject to controversy amongst actual people, in which case this is true but not troubling for public reason theorists; or the claim is that the relevant commitments are controversial in the sense of being subject to controversy amongst reasonable people, in which case this simply begs the question against public reason theorists (Section III). I then defend each horn of the dilemma against objections (Sections IV and V). I conclude by generalizing this dilemma, showing how it defuses not just Enoch's argument but also a number of other arguments frequently made in the literature on public reason liberalism (Section VI). This paper considers whether the promotion of an environmental ethic in schools is compatible with the political liberal's commitment to ‘neutrality’. A new account of the implications of John Rawls's political liberalism for the ‘basic structure’ of education is developed. The prima facie incompatibility of political liberalism and the promotion of an environmental ethic is misleading. Rawls's political liberalism requires—as a matter of intergenerational justice—the promotion of the ‘sustainability virtues’. Moreover, it permits the promotion of ‘greener’ ideals.

Public reason liberalism demands that political decisions be publicly justified to the citizens who are subjected to them. Much recent literature emphasises the differences between the two main interpretations of this requirement, justificatory and political liberalism. In this paper, I show that both views share structural democratic deficits. They fail to guarantee political autonomy, the expressive quality of law, and the justification to citizens, because they allow collective decisions made by incompletely theorised agreements. I argue that the result can only (...) be avoided by changing public reason’s role in collective decision-making. Instead of incompletely theorised agreements, we should demand agreement both on the public reasons themselves and on the other premises that justify political decisions. In this way, it is always possible to point to a procedure-independent reason that justifies democratic decisions, and the reasoning of the state is public and contestable. Finally, I explain how this, in turn, implies that only political liberalism can be rescued—by accepting what I will call strong political liberalism. Modifying justificatory liberalism in the necessary way will inevitably open the door to an objectionable form of perfectionism. (shrink)

Richard Rorty, with his tendency to shock, to provoke, and to seize on Continental fashions, might be thought an unlikely liberal. Nevertheless, Rorty illustrates very well some of the characteristic weaknesses of contemporary liberalism. To the extent that he draws upon postmodern and deconstructionist sources, he highlights, and radicalizes, the liberal urge to break out of frozen identities and to destabilize static roles and fixed stations in life. His distinctive version of pragmatism yields a way of drawing liberal boundaries between (...) private and public, culture and justice. And his antifoundationalism helps to legitimize a typical liberal reluctance to engage in any very ambitious social criticism. What distinguishes Rorty's liberalism is its higher degree of candor, which at least acknowledges that a liberal vision of things, far from being “neutral” toward rival ideas of the good, is implicated in the defense of a particular way of life. Justifications for intellectual property rights are typically made in terms of utility or natural property rights. In this article, I justify limited regimes of copyright and patent grounded in no more than the rights to use our ideas and to contract, conjoined at times with a weak right to hold property in tangibles. I describe the Contracting Situation plausibly arising from vesting rational agents with these rights. I go on to consider whether in order to provide the best protection for (...) the voluntary activities and consensual interactions occurring within the Contracting Situation, it might be appropriate or even necessary to move to institutions qualitatively similar to copyright and patent. I conclude that in at least some circumstances limited regimes of copyright and patent may be defendable solely on the basis of these very basic rights. (shrink)

Communitarian thinkers have argued that liberalism devalues community in modern societies. This essay assesses the three main strands of the contemporary debate betweeen communitarianism and liberalism: (1) the communitarian critique of the liberal universalism, (2) the communitarian critique of liberal individualism, and (3) the communitarian critique of liberal politics. In each case, it is argued that the debate has moved from fairly abstract philosophical controversies to more concrete engagement with political disputes in Western as well as East Asian societies.

One central objection to philosophical defences of liberal neutrality is that many neutrally justified laws and policies are nonetheless discriminatory as they unilaterally impose costs or confer unearned privileges on the bearers of a particular conception of the good. Call this the false neutrality objection. While liberal neutralists seldom consider this objection to be a serious allegation, and often claim that it rests on a misunderstanding, I argue that it is a serious challenge for proponents of justificatory neutrality. Indeed, a (...) careful examination of recent French and Canadian laws which impede the members of cultural minorities from freely practising their religion reveals that the state can hide its discriminatory aims by cloaking the policies it enacts in neutral language. In order to avoid the problem of false neutrality, I contend, liberal neutralists should defend a combination of neutrality of justification and neutrality of aim and operationalize neutrality of aim through a practical test that has been a defining feature of American jurisprudence on religious freedom in the last thirty years: the general applicability requirement. In 1978 and 1979, the concept of governmentality was introduced by Foucault in his lectures at the Collège de France. Foucault finds the genealogical origin of this concept in the Christian figure of the shepherd. From this starting-point, he then embarks on a eulogy of liberalism, in stark contrast to the Marxist critique of political economy. These two grand narratives of modern liberalism differ markedly in their political and philosophical presuppositions. The latter, rooted in the tradition of natural law, is (...) directed towards revolution. The former, rooted in the tradition of English radicalism, is directed towards resistance.
