This chapter poses the quiestions: how do Muslims solve their ethical problems in biomedicine? Are there any distinctive theories or principles in Islamic ethics that Muslims apply in deriving moral judgments in bioethics? Is the sacred law, the Shari'a, which is regarded as an integral part of Islamic ethics, the only recognized source of ethical judgments in Islam? What is the role of human experience/intuitive reasoning in moral justification? This chapter explores these questions and their answers.

The principle of majority, which is an indispensable tool of election and decision-making in today's democracies, is one of the main indicators of its legitimacy, as well as having a superior position in the establishment and maintenance of political power. The aim of this research is to determine the relationship of the condition of “the caliph’s Quraysh” with this principle by revealing the analysis of the Islamic scholars on the importance of the majority principle in (...) terms of establishing political power and using the authority to order and prohibit. In the grounding of this aim, firstly, the dominant role of the majority in determining the political power was emphasized and the organic relationship between them was tried to be revealed, and the nature of the support provided by the majority to the administration in the use of political power authority and its effect on the possession of the means of coercion that sustain the state apparatus were examined in the light of the views of Fiqh and Kalam scholars. Then, the condition that the caliph should be from the Quraysh lineage, which has been the subject of debate since the 9th century, when the influence of non-Arab elements on the political administration became evident, was examined within the framework of the majority principle, and the evaluations of Islamic scholars about the widespread rumor that formed the basis of this were briefly examined. At the end of the study, it was concluded that Islamic scholars adopted the principle of “majority” in the establishment and maintenance of political power, and that they accepted the requirement that the caliph be Quraysh as a qualification condition, and that the narration, which is the basis of this, shows a historical and socio-political reality brought about by the conditions that emerged in a certain time period. Botswana’s history is one of an unwavering exercise of self-determination and quest for self-rule. Post-independence, self-government prioritized an overarching philosophy of Kagisano or social harmony within which the aims of education were framed, in conjunction with a political commitment to Botho through democracy. For economic and social reasons the current educational policy of Botswana is driven by outcome-based education (OBE), with its metrics of quantifiable outcomes. This article argues that Olúfemi Táíwò’s analysis of decolonization provides a philosophical lens through which (...) to interpret Botswana’s current educational pathway within the prevailing decolonization discourse. OBE clearly exhibits features of neocolonialism, as it pertains to the national value principles. We draw on Ndlovu-Gatsheni’s decolonial epistemic perspective to frame the discussions. Insofar as OBE can be integrated with Botswana’s ethnically inclusive, community-based view of democracy and associated virtues, this is a worthy goal for education, and it could lead to a particular form of indigenized democracy. Substantive distinctions among the concepts of decolonization, neocolonialism, and decoloniality underwrite this thesis. We see the project of envisaging a future of education in Botswana as having to do with disentangling colonialist–imperialist cultural reproduction from indigenous aspirations. (shrink)

This article investigates the relationship among the weak Pareto principle, the strong Pareto principle, and positive responsiveness in the context of voting. First, it is shown that under a mild domain condition, if an anonymous and neutral collective choice rule (CCR) is complete and transitive, then the weak Pareto principle and the strong Pareto principle are equivalent. Next, it is shown that under another mild domain condition, if a neutral CCR is transitive, then the strong Pareto (...) principle and positive responsiveness are equivalent. By applying these results, we obtain a new characterization of the method of majority decision. (shrink)

This article explores the evolution of Principles of Biomedical Ethics by Tom Beauchamp and James Childress over its seven editions. Many changes have occurred in the text over the last thirty-five years, including the expansion of the section on virtue ethics, the modification of the authors’ position on physician-assisted suicide, and the addition of many other ethical theories to the original two found in the first editions. The basis for these changes and others seems to be their development of the (...) theme of the “common morality.” The author suggests that Beauchamp and Childress develop the connection between their common morality and metaphysics, as it would serve to strengthen their theory and make it less susceptible to changes in society’s opinions and traditions. The Principle of Sufficient Reason says that all contingent facts must have explanation. In this 2006 volume, which was the first on the topic in the English language in nearly half a century, Alexander Pruss examines the substantive philosophical issues raised by the Principle Reason. Discussing various forms of the PSR and selected historical episodes, from Parmenides, Leibnez, and Hume, Pruss defends the claim that every true contingent proposition must have an explanation against major objections, including Hume's imaginability (...) argument and Peter van Inwagen's argument that the PSR entails modal fatalism. Pruss also provides a number of positive arguments for the PSR, based on considerations as different as the metaphysics of existence, counterfactuals and modality, negative explanations, and the everyday applicability of the PSR. The present paper introduces a belief merging procedure by majority using the standard format of Adaptive Logics. The core structure of the logic ADM c (Adaptive Doxastic Merging by Counting) consists in the formulation of the conflicts arising from the belief bases of the agents involved in the procedure. A strategy is then defined both semantically and proof-theoretically which selects the consistent contents answering to a majority principle. This book is devoted to the problems of the growth of science. These prob lems, neglected for a long time by the philosophers of science, have become in the 60's and 70's a subject of vivid discussion. There are philosophers who stress only the dependence of science upon various sociological, psycho logical and other factors and deny any internal laws of the development of knowledge, like approaching the truth. The majority rejects such nihilism and searches for the laws of (...) the growth of science. However, they often overlook the role of the Correspondence Principle which connects the suc cessive scientific theories. On the other hand, some authors, while stressing the role of this principle, overlook logical difficulties connected with it, e. g. the problem of the incompatibility of successive theories, of the falsity of some of their assumptions, etc. I believe the Correspondence Principle to be a basic principle of the pro gress of contemporary physics and, probably, of every advanced science. How ever, this principle must be properly interpreted and the above-mentioned logical difficulties must be solved. Their solution requires, as it seems, revealing the idealizational nature of the basic laws of science, in any case of the quantitative laws of advanced sciences. This point has been recently emphasized by some Polish philosophers, especially in Poznan. (shrink)

Majority rule is often regarded as an important democratic principle. But modern democracies divide voters into districts. So if the majority should rule, which majority should rule? Should it be the popular majority, or an electoral majority (i.e., either the majority of voters in the majority of districts, or the majority of voters in districts that contain the majority of the population)? I argue that majority rule requires rule by (...) the popular majority. This view is not novel and may seem obvious. But it is rarely defended, and often rejected. I defend it by arguing that this view about which majority should rule is best supported by the arguments for why the majority should rule, and best avoids the arbitrary and perverse verdicts of rule by electoral majorities. I close by considering the significant practical implications of the view. The Electoral College is often criticized on the basis that the winner of the popular vote doesn’t always win the election. But all district-based democracies have this feature, so all district-based democracies must be reformed if they are to satisfy the principle of majority rule. (shrink)

We characterize the positional social preference correspondences (spc) satisfying the qualified majority property for any given majority threshold. We also characterize the positional spcs satisfying the minimal majority property. We next evaluate the probability that the Borda, the plurality and the antiplurality spcs fulfil the two aforementioned properties under the Impartial and Anonymous Culture assumption in the presence of three and four alternatives for various sizes of the society. Our results show that the Borda spc is the (...) positional spc which better behaves in relation with the qualified majority principle and the minimal majority principle. (shrink)

This paper explicates some aspects of Hans Kelsen’s defence of democracy. Kelsen’s aim was to formulate a realistic normative alternative to the democratic ideal derived from Rousseau. He provided two, independent arguments for majoritarian democracy. First, the validity of majority principle could be derived from epistemological relativism. Second, majority principle maximized individual liberty. The latter argument is based on Kelsen’s own definition of liberty as a correspondence between an individual will and the ruling norms. This argument (...) could be interpreted as reasoning based on a hypothetical contract. The most important critiques of majoritarian proceduralism are based on the problem of the possibility of democratic self-destruction, the problem of the democratic origins of democracy and the problem of the possibility of permanent majorities. Kelsen had a convincing answer to problems, and. The problem of permanent majorities is more difficult to solve. Ultimately, Kelsen is forced to abandon his purely proceduralistic starting point. John Harris is one of the prominent philosophers and bioethicists of our time. He has published tens of books and hundreds of papers throughout his professional life. This paper aims to take a ‘deep-look’ at Harris' works to argue that it is possible to find some principles of Islamic ethics in Harrisian philosophy, namely in his major works, as well as in his personal life. This may be surprising, or thought of as a ‘big’ and ‘groundless’ claim, since John Harris (...) has nothing to do with any religion in his intellectual works. The major features of Harrisian philosophy could be defined as consequentialism or utilitarianism with liberal overtones. Despite some significant and fundamental differences in the application of principles (ie, abortion, euthanasia), the similarities between the major principles in Harrisian philosophy and Islamic ethics are greater at some points than the similarities between Islamic ethics and some other religious ethics (ie, Christian, Judaism). In this study I compare Harrisian teachings with major Islamic principles on ‘Responsibility’, ‘Side-effects and Double-effects’, ‘Equality’, ‘Vicious choice, guilt and innocence’, ‘Organ transplantation and property rights’ and ‘Advance directives’. One major theme in Pope Benedict XVI’s encyclical Caritas in Veritate is the “Principle of Gratuitousness.” The point of this essay is to begin a reflection on what it actually means and its possible relevance. By comparing the “Principle of Gratuitousness” and its normative assumptions about “the logic of gift” with anthropological studies focused on the same phenomenon, I hope to show, not only the relevance of the encyclical’s normative vision but also where and how it needs further (...) clarification. The findings of empirical anthropology provide qualified support for the encyclical’s focus on generating and replenishing “social capital” in order to sustain both markets and politics in an effort to “civilize the economy.” In order to put the “Principle of Gratuitousness” into more effective practice, the encyclical highlights the creative role of “civil society” and calls for the creation social enterprises whose goals are broader and deeper than maximizing profits. Assessing the realism of Benedict’s proposal will require further research and reflection on innovative entrepreneurial ventures designed to address social problems on a commercial basis, for example, Muhammad Yunus’ concept of a “social business” and its development in a series of joint business ventures involving the Grameen Bank and related organizations. Preparatory Principles is not a linear text in the conventional sense, but consists of a series of short passages on a variety of topics, whose themes are summarised in marginal headings. The material constitutes a philosophical commonplace book, compiled by Bentham in the mid-1770s, in which he worked out the foundational ideas for his new science of legislation. He then drew on this material when composing such works as A Fragment on Government and An Introduction to the Principles of Morals (...) and Legislation. Inspired by such figures as John Locke and Claude Adrien Helvetius, Bentham developed an original ontological and epistemological basis for legal terminology, with the aim of replacing the traditional terminology of English law with that of universal jurisprudence. The work that dominates the text, in that Bentham returns to it time and time again in order to offer criticism of it, is William Blackstone's Commentaries on the Laws of England. While unorganized and fragmentary, the material in Preparatory Principles constitutes a remarkable record of the evolving ideas of a major legal philosopher at a formative stage of his career. Some of the traditional terminology of moral theology has been discarded; much has been retained, either because it seemed the best medium for expressing (...) what had to be expressed, or because it would have been impossible otherwise to indicate the development and formulation of Christian thought on the subject. Maitland looked forward a century ago still awaits its author; but some important hints can be derived from an examination of, especially, medieval and early-modern sources. These show how difficult it was foRA 'simple' or numerical majority principle to gain acceptance, whether in the theology and canon-law of the medieval church or in the emergent theory and practice of the modern state. Neo-Fregean logicism attempts to base mathematics on abstraction principles. Since not all abstraction principles are acceptable, the neo-Fregeans need an account of which ones are. One of the most promising accounts is in terms of the notion of stability; roughly, that an abstraction principle is acceptable just in case it is satisfiable in all domains of sufficiently large cardinality. We present two counterexamples to stability as a sufficient condition for acceptability and argue that these counterexamples can be avoided only (...) by major departures from the existing neo-Fregean programme. ABSTRACT The Dutch case of Brongersma presents novel challenges to the definition and evaluation of voluntary euthanasia since it involved a doctor assisting the suicide of an individual who was (merely?) ‘tired of life’. Legal officials had called on the courts to ‘set a principled boundary’, excluding such cases from the scope of permissible voluntary euthanasia, but they arguably failed. This failure is explicable, however, since the case seems justifiable by reference to the two major principles in favour of that (...) practice, respect for autonomy and beneficence. Ultimately, it will be argued that those proponents of voluntary euthanasia who are wary of its use in such circumstances may need to draw upon ‘practical’ objections, in order to erect an otherwise arbitrary perimeter. Furthermore, it will be suggested that the issues raised by the case are not peculiarly Dutch in nature and that, therefore, there are lessons here for other jurisdictions too. (shrink)

Stephen Nathanson's clear-sighted abridgment of Principles of Political Economy, Mill's first major work in moral and political philosophy, provides a challenging, sometimes surprising account of Mill's views on many important topics: socialism, population, the status of women, the cultural bases of economic productivity, the causes and possible cures of poverty, the nature of property rights, taxation, and the legitimate functions of government. Nathanson cuts through the dated and less relevant sections of this large work and includes significant material omitted in (...) other editions, making it possible to see the connections between the views Mill expressed in Principles of Political Economy and the ideas he defended in his later works, particularly On Liberty. Indeed, studying Principles of Political Economy, Nathanson argues in his general Introduction, can help to resolve the apparent contradiction between Mill's views in On Liberty and those in Utilitarianism, making it a key text for understanding Mill’s philosophy as a whole. The principle of indifference has fallen from grace in contemporary philosophy, yet some papers have recently sought to vindicate its plausibility. This paper follows suit. In it, I articulate a version of the principle and provide what appears to be a novel argument in favour of it. The argument relies on a thought experiment where, intuitively, an agent’s confidence in any particular outcome being true should decrease with the addition of outcomes to the relevant space of possible outcomes. (...) Put simply: the greater the number of outcomes, the weaker your confidence should be in any one of those outcomes. The argument holds that this intuition favours the principle of indifference. I point out that, in contrast, the intuition is also incompatible with a major alternative to the principle which prescribes imprecise credences: the so-called wide interval view. Consequently, the argument may also be seen as an argument against the wide interval view. (shrink)

Sensitivity is a modal epistemic principle. Modal knowledge accounts are externalist in nature and claim that the knowledge yielding connection between a true belief and the truthmaker must be spelled out in modal terms. The sensitivity condition was introduced by Robert Nozick. He suggests that if S knows that p, then S’s belief that p tracks truth. Nozick argues that this truth-tracking relation can be captured by subjunctive conditionals. As a first approximation, he provides the following modal analysis of (...) knowledge: S knows that p iff (1) p is true; (2) S believes that p; (3) if p were false, S wouldn’t believe that p and (4) if p were true, S would believe that p. The dominant terminology in the literature, also adopted here, is to call condition (3) the sensitivity condition and condition (4) the adherence condition. The sensitivity condition is intuitively appealing since it states that a subject does not know that p if she would believe that p even if p were false. Nozick used the sensitivity condition to accomplish two major tasks. First, he provided a solution to the Gettier problem by arguing that in Gettier cases subjects do not know since the sensitivity condition is violated. Second, he presented a controversial solution to the skeptical problem according to which we have external world knowledge but do not know that the skeptical hypothesis is false. This solution is available because sensitivity is not closed under known entailment. Quickly, criticism of the sensitivity condition emerged. First, most epistemologists regarded the price of abandoning knowledge closure as a price too high to pay. Second, it was noted that sensitivity leads to the counterintuitive consequence of precluding us from inductive knowledge since induction typically yields insensitive beliefs. The most dominant reaction to these problems was to replace sensitivity by the modal principle of safety, nowadays the most popular modal principle. However, sensitivity is not only important as a starting point of modal epistemology. Because of its intuitive attractiveness, many authors aimed at refining the original sensitivity account in order to avoid well-known problems. This has led to a second wave of sensitivity accounts. As of today, various sensitivity-based theories are on the market, including accounts that avoid closure failure, probabilistic interpretations of sensitivity and adherence, and contextualist approaches. The attempt to employ quantum principles for modeling cognition has enabled the introduction of several new concepts in psychology, such as the uncertainty principle, incompatibility, entanglement, and superposition. For many commentators, this is an exciting opportunity to question existing formal frameworks (notably classical probability theory) and explore what is to be gained by employing these novel conceptual tools. This is not to say that major empirical challenges are not there. For example, can we definitely prove the necessity for quantum, (...) as opposed to classical, models? Can the distinction between compatibility and incompatibility inform our understanding of differences between human and nonhuman cognition? Are quantum models less constrained than classical ones? Does incompatibility arise as a limitation, to avoid the requirements from the principle of unicity, or is it an inherent (or essential?) characteristic of intelligent thought? For everyday judgments, do quantum principles allow more accurate prediction than classical ones? Some questions can be confidently addressed within existing quantum models. A definitive resolution of others will have to anticipate further work. What is clear is that the consideration of quantum cognitive models has enabled a new focus on a range of debates about fundamental aspects of cognition. (shrink)

According to various accounts, intervention in pediatric decisions is justified either by the best interests standard or by the harm principle. While these principles have various nuances that distinguish them from each other, they are similar in the sense that both focus primarily on the features of parental decisions that justify intervention, rather than on the competency or authority of the parties that intervene. Accounts of these principles effectively suggest that intervention in pediatric decision making is warranted for both (...) physicians and the state under precisely the same circumstances. This essay argues that there are substantial differences in the competencies and authorities of physicians and the state, and that the principles that guide their interventions should also be conceived differently. While both the best interests standard and the harm principle effectively incorporate important aspects of physicians’ ethical obligations, neither adequately reflects the state’s ethical obligations. In contrast to physicians, the state has major obligations of distributive justice and neutrality that should form an integral part of any proposed ethical principles guiding state intervention in pediatric decision making. The differences are illustrated by examining recent cases involving parental refusal of chemotherapy in aboriginal Canadian communities and parental refusal of blood transfusions by Jehovah’s Witnesses. The ‘Major Transitions in Evolution’ framework has emerged as the dominant paradigm for understanding the origins of life's hierarchical organization, but it has been criticized on the grounds that it lacks theoretical unity, that is, that the events included in the framework do not constitute a coherent category. I agree with this criticism, and I argue that the best response is to modify the framework so that the events it includes do comprise a coherent category, one whose members share fundamental (...) similarities. Specifically, I recommend defining major transitions as all those, and only those, events and processes that result in the emergence of a new population of evolutionary individuals. Two sorts of change will be required to achieve this. First, events and processes that do not meet this criterion, such as the origins of the genetic code and of human language, should be excluded. Second, events and processes that do meet the criterion, but which have generally been neglected, should be included. These changes would have the dual benefits of making MTEs a philosophically coherent category and of increasing the sample size on which we may infer trends and general principles that may apply to all MTEs. ABSTRACT The Dutch case of Brongersma presents novel challenges to the definition and evaluation of voluntary euthanasia since it involved a doctor assisting the suicide of an individual who was (merely?) ‘tired of life’. Legal officials had called on the courts to ‘set a principled boundary’, excluding such cases from the scope of permissible voluntary euthanasia, but they arguably failed. This failure is explicable, however, since the case seems justifiable by reference to the two major principles in favour of that (...) practice, respect for autonomy and beneficence. Ultimately, it will be argued that those proponents of voluntary euthanasia who are wary of its use in such circumstances may need to draw upon ‘practical’ objections, in order to erect an otherwise arbitrary perimeter. Furthermore, it will be suggested that the issues raised by the case are not peculiarly Dutch in nature and that, therefore, there are lessons here for other jurisdictions too. (shrink)

After briefly sketching common-morality principlism, as presented in Principles of Biomedical Ethics, this paper responds to two recent sets of challenges to this framework. The first challenge claims that medical ethics is autonomous and unique and thus not a form of, or justified or guided by, a common morality or by any external morality or moral theory. The second challenge denies that there is a common morality and insists that futile efforts to develop common-morality approaches to bioethics limit diversity and (...) prevent needed moral change. This paper argues that these two critiques fundamentally fail because they significantly misunderstand their target and because their proposed alternatives have major deficiencies and encounter insurmountable problems. George Berkeley's two major works, A Treatise Concerning the Principles of Human Knowledge and Three Dialogues Between Hylas and Philonous, are presented here, together with perhaps the most searching examination his ideas received during his lifetime, that of the American Samuel Johnson, who corresponded with Berkeley during his stay in the country.

The book considers foundational thinking in quantum theory, focusing on the role the fundamental principles and principle thinking there, including thinking that leads to the invention of new principles, which is, the book contends, one of the ultimate achievements of theoretical thinking in physics and beyond. The focus on principles, prominent during the rise and in the immediate aftermath of quantum theory, has been uncommon in more recent discussions and debates concerning it. The book argues, however, that exploring the (...) fundamental principles and principle thinking is exceptionally helpful in addressing the key issues at stake in quantum foundations and the seemingly interminable debates concerning them. Principle thinking led to major breakthroughs throughout the history of quantum theory, beginning with the old quantum theory and quantum mechanics, the first definitive quantum theory, which it remains within its proper (nonrelativistic) scope. It has, the book also argues, been equally important in quantum field theory, which has been the frontier of quantum theory for quite a while now, and more recently, in quantum information theory, where principle thinking was given new prominence. The approach allows the book to develop a new understanding of both the history and philosophy of quantum theory, from Planck's quantum to the Higgs boson, and beyond, and of the thinking the key founding figures, such as Einstein, Bohr, Heisenberg, Schrödinger, and Dirac, as well as some among more recent theorists. Many theorists claim that justice is a question-begging concept that has no inherent substantive content. They point to disagreements among justice theorists themselves about basic aspects of the justice theory, such as the nature of corrective justice and the distinction between it and distributive justice, as even further reason to dismiss the concept of justice or to fill it with their preferred theoretical content. Yet most persons perceive that the concept of justice is not an empty shell. Since ancient times (...) it has been thought to encompass not merely a formal equality (treating like cases alike), but also a substantive equality grounded in the equal dignity of each human being which requires giving each person his or her "due" - what is his or hers as a matter of right - a requirement that is usually understood to be in direct conflict with the basic principles of aggregate social welfare theories such as utilitarianism or its modern variant, economic efficiency. The elaboration of this substantive equality and its implications for morality, justice, and law form the core of the natural-law or natural-right theories of law. In this article I build upon a summary and critique of John Finnis's natural law theory (1) to delineate the basic assumptions and principles of the natural law theory regarding the foundations of and relationships among morality, justice, and law; (2) to demonstrate the agreement of major natural law theorists, from Aristotle through Aquinas and Kant to Finnis, on these basic assumptions and principles; (3) to distinguish these basic assumptions and principles from those of the competing theories of utilitarianism and economic efficiency; and (4) to clarify the nature of and distinctions between the two basic divisions of substantive justice: distributive justice and interactive justice. I use the term "interactive justice" instead of the usual term, "corrective justice," since the former term is much more informative and precise in conveying the distinct nature and domain of this type of justice, whereas the latter term almost always misleads people into one or both of two related misconceptions: (1) that "corrective" justice is concerned solely with the correction of wrongful injuries and has nothing to say about the nature of the underlying wrongs or the prevention of their occurrence, and (2) that it is merely a remedial corollary of distributive justice which corrects deviations from the distributively just distribution. Distributive justice and interactive justice separately address the two fundamental problems of human existence, and they employ quite different criteria of equality to resolve those problems. Together, they seek to assure the attainment of the common good (the full realization, to the extent practicable, of each person's humanity) by providing each person with her fair share of the social stock of instrumental goods (positive freedom via distributive justice) and by securing her person and her existing stock of instrumental goods from interactions with others that are inconsistent with her status as a rational being with equal, absolute moral worth (negative freedom via interactive justice). Stephen Nathanson's clear-sighted abridgment of _Principles of Political Economy_, Mill's first major work in moral and political philosophy, provides a challenging, sometimes surprising account of Mill's views on many important topics: socialism, population, the status of women, the cultural bases of economic productivity, the causes and possible cures of poverty, the nature of property rights, taxation, and the legitimate functions of government. Nathanson cuts through the dated and less relevant sections of this large work and includes significant material omitted in (...) other editions, making it possible to see the connections between the views Mill expressed in _Principles of Political Economy_ and the ideas he defended in his later works, particularly _On Liberty_. Indeed, studying _Principles of Political Economy_, Nathanson argues in his general Introduction, can help to resolve the apparent contradiction between Mill's views in On Liberty and those in _Utilitarianism_, making it a key text for understanding Mill’s philosophy as a whole.
