Matters of scale and the politics of the Food Safety Modernization Act.Neva Hassanein - 2011 - Agriculture and Human Values 28 (4):577-581.
Signed into law in early 2011, the Food Safety Modernization Act (FSMA) marked the first major overhaul of the United States’ regulatory system for food safety since the 1930s. This presidential address explores how the social movement for local and regional food systems influenced the debates around the FSMA and, in particular, how issues of scale became pivotal in those debates. Specifically, a key question revolved around whether or not the proposed regulations should apply to small farms and processors who (...)

On the Discursive Construction of Corporate Social Responsibility in Advertising Agencies.Neva Štumberger & Urša Golob - 2016 - Journal of Business Ethics 137 (3):521-536.
As the interest in corporate social responsibility within advertising industry is growing, this paper explores the discourse on CSR among employees in advertising agencies. Different sensemaking dimensions are taken into account to examine how employees, as one of the key stakeholders involved in the joint meaning construction, make sense of CSR. In addition, this paper studies the legitimation approaches that employees use to address CSR of advertising agencies. The empirical evidence of discursive examples also indicates that there is a linkage (...)

  6. Defending a Functional Kinds Approach to Law.Jan Mihal - 2017 - Australian Journal of Legal Philosophy 42:121-144.
In this paper, I defend the possibility that law is a functional kind by replying to objections from Leslie Green and Brian Tamanaha. I also show how Kenneth Ehrenberg’s approach to law’s functions in his latest book concedes too much to these objections. A functional kinds approach to law is possible and, for someone interested in showing the importance of law’s functions, preferable. I first explore Tamanaha’s objection and show that the possibility of functional equivalents does not pose a problem (...)

It's legal but it ain't right: harmful social consequences of legal industries.Nikos Passas & Neva R. Goodwin (eds.) - 2004 - Ann Arbor: University of Michigan Press.
Many U.S. corporations and the goods they produce negatively impact our society without breaking any laws. We are all too familiar with the tobacco industry's effect on public health and health care costs for smokers and nonsmokers, as well as the role of profit in the pharmaceutical industry's research priorities. It's Legal but It Ain't Right tackles these issues, plus the ethical ambiguities of legalized gambling, the firearms trade, the fast food industry, the pesticide industry, private security companies, and more. Confronting coexistence in the United States: organic agriculture, genetic engineering, and the case of Roundup Ready® alfalfa. [REVIEW]Kristina Hubbard & Neva Hassanein - 2013 - Agriculture and Human Values 30 (3):325-335.
In agriculture, the principle of coexistence refers to a condition where different primary production systems can exist in the vicinity of each other, and can be managed in such a way that they affect each other as little as possible. Coexistence policies aim to ensure that farmers are able to freely grow the crops they choose—be they genetically engineered (GE), non-GE conventional, or organic. In the United States (US), the issue of coexistence has very recently come into sharp relief with (...)

Biological evolution is a complex blend of ever changing structural stability, variability and emergence of new phe- notypes, niches, ecosystems. We wish to argue that the evo- lution of life marks the end of a physics world view of law entailed dynamics. Our considerations depend upon dis- cussing the variability of the very ”contexts of life”: the in- teractions between organisms, biological niches and ecosys- tems. These are ever changing, intrinsically indeterminate and even unprestatable: we do not know ahead of (...)

Throughout his career, Schelling assigns knowledge of the absolute first principle of philosophy to intellectual intuition. Schelling's doctrine of intellectual intuition raises two important questions for interpreters. First, given that his doctrine undergoes several changes before and after his identity philosophy, to what extent can he be said to “hold onto” the same “sense” of it by the 1830s, as he claims? Second, given that his doctrine of intellectual intuition restricts absolute idealism to what he calls a “science of reason”, (...)

The COVID-19 pandemic revealed numerous weaknesses in pandemic preparedness and response, including underfunding, inadequate surveillance, and inequitable distribution of countermeasures. To overcome these weaknesses for future pandemics, WHO released a zero draft of a pandemic treaty in February, 2023, and subsequently a revised bureau's text in May, 2023. COVID-19 made clear that pandemic prevention, preparedness, and response reflect choices and value judgements. These decisions are therefore not a purely scientific or technical exercise, but are fundamentally grounded in ethics. The latest (...)
