Can researchers, interested in novel ways to assess HIV seroprevalence among populations which are otherwise hidden, collect condoms that have been discarded on the ground in a public sex environment and test them for HIV? Does the Code of Federal Regulations address this question, and if not, what areas of research ethics might provide guidance to an IRB considering such a study? These questions arose as part of a preliminary study to test the feasibility of collecting discarded condoms from a (...) public sex environment in Massachusetts, and testing contained semen for HIV. Although the methodology of this study is somewhat unusual, the questions raised are not. Researchers, who wish to use other types of abandoned samples such as discarded syringes, hair or saliva samples, or even excess biological samples, commonly confront similar issues, and the analysis utilized here could guide design and review of other studies. This review evaluates whether such abandoned tissues can be studied based on U.S. Code of Federal Regulations and literature on related issues including: (...) research involving banked tissues, blinded seroprevalence studies, and property claims that individuals might make on the samples.It also addresses broader questions of potential for stigma and risk to individuals and communities. The article concludes that the research should be permitted legally because either it does not involve human subjects, or it satisfies the requirements for waiver of consent; and that the research should also be permitted because the ethical principal of avoiding harm to individuals is fully satisfied based on a careful reading of the lessons of the tissue bank, biological property rights, and blinded seroprevalence study debates, as well as a consideration of other potential harms that might be involved. We describe and analyze 13 cases handled by our ethics consultation service (ECS) in which families requested continuation of physiological support for loved ones after death by neurological criteria (DNC) had been declared. These ethics consultations took place between 2005 and 2013. Patients’ ages ranged from 14 to 85. Continued mechanical ventilation was the focal intervention sought by all families. The ECS’s advice and recommendations generally promoted “reasonable accommodation” of the requests, balancing compassion for grieving families with other ethical and (...) moral concerns such as stewardship of resources, professional integrity, and moral distress. In cases we characterized as finitegoal accommodation, a “reasonable accommodation” strategy proved effective in balancing stakeholders’ interests and goals, enabling steady progress toward resolution. When a family objected outright to a declaration of DNC and asked for an indefinite accommodation, the “reasonable accommodation” approach offered clinicians little practical direction, and resolution required definitive action by either the family or the clinical team. Based on our analysis and reflections on these 13 cases, we propose ethically justified and practical guidelines to assist healthcare professionals, administrators, and ECSs faced with similar cases. Abstract:This essay suggests that the word decolonial offers analytic power for feminist historians of women. As a category, it creates interpretive space for female experience beyond the elite/subaltern binary, where arguably most women live and work in the modern period. As a reading practice, the decolonial fosters intellectual awareness of social and intellectual practices that neither address the state, as in “anti-imperialism,” nor proffer counter nationalism or counter racialization as responses to coloniality. Offering examples from the archive, the media, and (...) teaching, this essay describes the decolonial as a productive site of women's agency in domains all too easily overlooked when historians focus on the conventional categories of state and nation. We examined the attitudes of 600 students in large introductory algebra and psychology classes toward an actual or hypothetical cheating incident and the subsequent retake procedure. Overall, 57% of students in one class and 49Y0 in the other reported that they either cheated or would have cheated if given the opportunity. More men (59%) than women (53%) reported cheating or potential cheating. Students who had actually experienced a retake procedure to handle cheating were more satisfied with such a procedure than (...) others were about a hypothetical situation. Despite having a retake, cheaters were significantly more likely than noncheaters to predict that they would cheat again. Results suggest that instructors who require a retake following extensive cheating should devote class time to a discussion of the issue and all possible alternatives. (shrink)

Recently, organizational identity is being given more attention than ever before in the business world. This notion has grown substantially in importance in the hospitality industry. Facing increased competition, hospitality companies are driven to project a positive image to their stakeholders. Therefore, these organizations have begun to develop new organizational identity programs as part of their strategies to achieve their desired identities. This study analyzes the role of corporate social responsibility in the definition of the Organizational Identity of these organizations, (...) employing a qualitative research methodology based on an illustrative case study. Particularly, the authors analyze the case of Meliá Hotels International, a leading hotel company in Spain with a presence in 27 countries. The findings indicate that the company has formally integrated CSR into its strategy to align its actual identity with its desired and conceived identity in view of the critics in its local community. Moreover, the interest of the firm toward its stakeholders suggests that the company understands its conceived identity as an important link in understanding its organizational identity. This paper demonstrates that firm’s organizational identity is a set of several elements. When analyzing Meliá Hotels International’s identity, we see that the firm defines this concept as that which is most central, enduring, and distinctive about the organization. In this sense, the company appears to follow the vision-driven approach by referring to the organizational mission and vision statements, organizational philosophy, and core values as the basis of organizational identity. The Céli Dé monks as we see them in the texts associated with their monasteries had a reputation for extreme asceticism. Following their leader, MáelRúain, who had an especially stern reputation for rigorous observance, they believed heaven had to be earned by saying many prayers, by penitential practices and by intense personal effort and striving on the part of each individual monk. To this end, they engaged in such practices as rigorous fasting, long vigils, confession of sins, strict Sabbath observance (...) and devotional practices involving many prayers. Their view of humanity and of creation generally was negative and they saw God as a stern judge. However, there was another aspect to Céli Dé monasticism which we see in the Félire Óengusso, the metrical martyrology compiled by Óengus the Culdee, a monk of Tallaght. We see from his Félire that he understood holiness as a gift of God’s grace, both for the saints in heaven, whom he describes as ‘radiant’ and ‘shining like the sun’, and for those still on earth, through the mercy and graciousness of God himself. His Félire was compiled as an act of devotion to Jesus and the saints, whom he addresses in terms of great warmth, tenderness and intimacy, in expressions which prefigure the language of the medieval mystics. So by studying the lives of these two monks, MáelRúain and Óengus, his protégée, as case studies, we can see that for the Céli Dé, holiness was less a matter of ‘either asceticism or mysticism’, but rather ‘both and’. This Element offers an overview of some of the most important debates in philosophy and physics around the topics of emergence and reduction and proposes a compatibilist view of emergence and reduction. In particular, it suggests that specific notions of emergence, which the author calls 'few-many emergence' and 'coarse-grained emergence', are compatible with 'intertheoretic reduction'. Some further issues that will be addressed concern the comparison between parts-whole emergence and few-many emergence, the emergence of effective theories, the use of infinite limits, (...) the notion of intertheoretic reduction and the explanation of universal and cooperative behavior. Although the focus will be principally on classical phase transitions and other examples from condensed matter physics, the main aim is to draw some general conclusions on the topics of emergence and reduction that can help us understand a variety of case-studies ranging from high-energy physics to astrophysics. The rich body of understudied imagery constituting the culture of satire in pre-World War I Paris represents the work of scores of contributing artists, ranging from mockery of manners to biting critique of government policy. While František Kupka is recognized as a major Parisian contributor to the development of modernism and abstraction, his career as a satirist has been sidelined. In 1900, Kupka wrote to his friend the Czech poet Josef S. Machar that he would devote himself in future mainly (...) to lithography and graphics as these media are more "democratic". In this paper, I compare the use of the thermodynamic limit in the theory of phase transitions with the infinite-time limit in the explanation of equilibrium statistical mechanics. In the case of phase transitions, I will argue that the thermodynamic limit can be justified pragmatically since the limit behavior also arises before we get to the limit and for values of N that are physically significant. However, I will contend that the justification of the infinite-time limit is less straightforward. (...) In fact, I will point out that even in cases where one can recover the limit behavior for finite t, i.e. before we get to the limit, one cannot recover this behavior for realistic time scales. I will claim that this leads us to reconsider the role that the rate of convergence plays in the justification of infinite limits and calls for a revision of the so-called Butterfield’s principle. Moral diversity is a fundamental reality of today’s world, but moral theorists have difficulty responding to it. Some take it as evidence for skepticism – the view that there are no moral truths. Others, associating moral reasoning with the search for overarching principles and unifying values, see it as the result of error. In the former case, moral reasoning is useless, since values express individual preferences; in the latter, our reasoning process is dramatically at odds with our lived experience. (...) Moral Reasoning in a Pluralistic World takes a different approach, proposing an alternative way of thinking about moral reasoning and progress by showing how diversity and disagreement are compatible with theorizing and justification. Patricia Marino demonstrates that, instead of being evidence for skepticism and error, moral disagreements often arise because we value things pluralistically. This means that although people share multiple values such as fairness, honesty, loyalty, and benevolence, we interpret and prioritize those values in various ways. Given this pluralistic evaluation process, preferences for unified single-principle theories are not justified. Focusing on finding moral compromises, prioritizing conflicting values, and judging consistently from one case to another, Marino elaborates her ideas in terms of real-life dilemmas, arguing that the moral complexity and conflict we so often encounter can be part of fruitful and logical moral reflection. Aiming to draw new connections and bridge the gap between theoretical ethics and applied ethics, Moral Reasoning in a Pluralistic World offers a sophisticated set of philosophical arguments on moral reasoning and pluralism with real world applications. Sarah Moss’ thesis that we have probabilistic knowledge is from some perspectives unsurprising and from other perspectives hard to make sense of. The thesis is potentially transformative, but not yet elaborated in sufficient detail for epistemologists. This paper interprets Mossean probabilistic knowledge in a suitably-modified Kripke framework, thus filling in key details. It argues that probabilistic knowledge looks natural and plausible when so interpreted, and shows how the most pressing challenges to the thesis can be overcome. Most importantly, probabilistic knowledge (...) can satisfy factivity in the framework, though we are not forced to accept a specific account of probabilistic “facts”. The framework also reflects Moss’ claim that old-fashioned propositional knowledge is just a limiting case of probabilistic knowledge, and all knowledge is fundamentally probabilistic. Finally, Moss endorses a failure of contraposition: for example, p implies probably p, but not probably p does not imply not p. The framework makes clear the sense in which the valid inferences regarding probably p are as Moss claims. (shrink)

In this chapter, I defend a pluralistic approach to intertheoretic reduction, in which reduction is not understood in terms of a single philosophical “generalized model”, but rather as a family of models that can help achieve certain epistemic and ontological goals. I will argue then that the reductive model (or combination of models) that best suits to a particular case study depends on the specific goals that motivate the reduction in the intended case study.

Ruth Marcus has offered an account of moral dilemmas in which the presence of dilemmas acts as a motivating force, pushing us to try to minimize predicaments of moral conflict. In this paper, I defend a Marcus-style account of dilemmas against two objections: first, that if dilemmas are real, we are forced to blame those who have done their best, and second, that in some cases, even a stripped down version of blame seems inappropriate. My account highlights the importance of (...) collective responsibility in understanding dilemmas, and I suggest that it sheds light on understanding moral progress. (shrink)

With the recent rash of mergers and friendly and unfriendly takeovers, two important issues have not received sufficient attention as questionable ethical practices. One has to do with the rights of employees affected in mergers and acquisitions and the second concerns the responsibilities of shareholders during these activities. Although employees are drastically affected by a merger or an acquisition because in almost every case a number of jobs are shifted or even eliminated, employees at all levels are usually the (...) last to find out about a merger transaction and have no part in the takeover decision. Second, if shareholders are the fiduciary beneficiaries of mergers and acquisitions, then it would appear that they have some responsibilities or obligations attached to these benefits, but little is said about such responsibilities. In this essay I shall analyze these two ethical issues, and at the end of the paper I shall suggest how they are related. (shrink)

Studies on informed consent to medical research conducted in low or middle-income settings have increased, including empirical investigations of consent to genetic research. We investigated voluntary participation and comprehension of informed consent among women involved in a genetic epidemiological study on breast cancer in an urban setting of Nigeria comparing women in the case and control groups.

Fraud and misconduct in scientific research appears to be increasing since 1980 when several cases were disclosed. Earlier instances were handled awkwardly, but the scientific community has since mobilized and issued guidelines about responding to allegations of misconduct and about the responsible conduct of research. Scientists, editors and the institutions of science are slowly learning how to cope with this problem.

In this longitudinal study, we explore the co-evolution of the cognitive complexity of the CEO of Puma, Jochen Zeitz, and his view and initiatives on sustainability. Our purpose was to explore how the changes in a leader’s mindset relate to his/her views and actions on sustainability. In contrast to previous studies, we adopt an in-depth longitudinal case study approach to capture the role of leaders’ cognitive complexity in the context of corporate sustainability. By understanding the cognitive development of Zeitz (...) as leader of Puma, we provide an important step toward understanding the co-evolution of leaders’ cognitive complexity and proactive corporate sustainability initiatives over time. Our findings show that as he developed a more complex mindset that also included non-business lenses, Zeitz developed a more inclusive understanding of sustainability and adopted proactive initiatives that went beyond business-as-usual. Our study also demonstrates that a longitudinal perspective can offer valuable insights for a better understanding of how individuals and their interactions affect and are affected by an organization’s strategies and performance, in corporate sustainability and beyond. The first issue of Business Ethics Quarterly was launched in 1991. At that time there were few general principles that could serve as guidelines for global business. However, since 1991 a plethora of such principles have been developed to serve as guidelines and evaluative mechanisms for global corporate responsibilities. But operationalizing these principles in practice has been a challenge for most transnational corporations and even for smaller, more local enterprises. This is because, in some cases, the principles ask too much (...) of companies. In other cases, the principles are ambiguous. And in still other cases,the principles, written by and large from a Western, rights-based perspective, cannot be operationalized in some cultural or religious settings. In this paper I will outline a series of dilemmas multinational enterprises face in the global market place, even when they sincerely sign on to one or another set of principles. These problems are not insurmountable, but in the imperfect world of commerce, require that our expectations of corporate responsibilities be satisficing rather than absolutist. (shrink)

Current treatments of practical rationality understand reasons as considerations counting in favor of or against some practical option, treating the positive and the negative case as symmetrical. Typically the focus is on examples of positive reasons. However, I want to shift the spotlight to negative reasons, as making a tighter or more direct link to rationality — and ultimately to morality, which is what much of the current interest in reasons is meant to clarify. Recognizing a positive/negative asymmetry in (...) normative force will let us reconcile the view of moral or other requirements as based on reasons with the denial that reasons as such, even all-thingsconsidered reasons, yield requirements — or as I like to put it, rationally compel. Although I begin with a brief look at the idea that as a faculty of mind, apperception must be grounded in some power of the soul, my focus is on claims about the alleged noumenal import of some of Kant’s particular theses about the faculty of apperception: it is inexplicable, immaterial, and can provide evidence that humans are members of the intelligible world. I argue that when the claim of inexplicability is placed in the context of Kant’s standards for transcendental (...) psychological explanation, it has no noumenal implications. Similarly, when understood in the context of his views about scientific explanations, Kant’s claim that the faculty of apperception cannot be understood in materialist terms has no important metaphysical payoff. The case of freedom is different, because for a long time, Kant believed that he could establish the freedom required for morality by appealing to the freedom required for thought. In the end, however, he abandoned this hoped for noumenal implication of the faculty of apperception. (shrink)

Psychopaths are agents who lack the normal capacity to feel moral emotions (e.g. guilt based on empathy with the victims of their actions). Evidence for attributing psychopathy at least in some cases to genetic or early childhood causes suggests that psychopaths lack free will. However, the paper defends a sense in which psychopaths still may be construed as responsible for their actions, even if their degree of responsibility is less than that of normal agents. Responsibility is understood in Strawsonian terms, (...) as a question of our appropriate reactive attitudes toward an agent for what she does, and as distinct from the question of the agent's own motivating attitudes, which lead him to do what he does. The latter is the question more directly relevant to free will, though moral motivation normally depends on the capacity in early childhood to pick up motivating attitudes from others' reactive attitudes. Reactive attitudes based on hatred rather than anger (e.g. disgust or contempt) count as alternative forms of blame that may be appropriately directed toward agents manifesting bad qualities of will, even as a matter of motivational impairment. So psychopaths may still be said to deserve blame, even if they are incapable of modifying their behavior in response to blame. (shrink)

Empirically minded philosophers have raised questions about judgments and theories based on moral intuitions such as Rawls’s method of reflective equilibrium. But they work from the notion of intuitions assumed in empirical work, according to which intuitions are immediate assessments, as in psychologist Jonathan Haidt’s definition. Haidt himself regards such intuitions as an appropriate basis for moral judgment, arguing that normal agents do not reason prior to forming a judgment and afterwards just “confabulate” reasons in its defense. I argue, first, (...) that the notion of “considered intuitive judgment” that Rawls spells out when he first presents his method is pre-theoretical, but not at all pre-reflective, in the way Haidt’s definition supposes; it may rest on various forms of reasoning short of systematic derivation from theoretical principles. I go on to take issue with Haidt’s dismissal of ex post facto moral reasoning, arguing that it can play both a causal role in an individual’s later intuitions or judgments and a legitimate normative role, as required by moral competence in judging non-taboo cases. I suggest that the move from intuition to judgment and thence to ex post facto reasoning makes sense as a justificatory version of Peircean abduction, or what is now mainly called “inference to the best explanation.”. Kant's discussion of the relations between cognition and self-consciousness lie at the heart of the Critique of Pure Reason, in the celebrated transcendental deduction. Although this section of Kant's masterpiece is widely believed to contain important insights into cognition and self-consciousness, it has long been viewed as unusually obscure. Many philosophers have tried to avoid the transcendental psychology that Kant employed. By contrast, Patricia Kitcher follows Kant's careful delineation of the necessary conditions for knowledge and his intricate argument that (...) knowledge requires self-consciousness. She argues that far from being an exercise in armchair psychology, the thesis that thinkers must be aware of the connections among their mental states offers an astute analysis of the requirements of rational thought.The book opens by situating Kant's theories in the then contemporary debates about "apperception," personal identity and the relations between object cognition and self-consciousness. After laying out Kant's argument that the distinctive kind of knowledge that humans have requires a unified self- consciousness, Kitcher considers the implications of his theory for current problems in the philosophy of mind. If Kant is right that rational cognition requires acts of thought that are at least implicitly conscious, then theories of consciousness face a second "hard problem" beyond the familiar difficulties with the qualities of sensations. How is conscious reasoning to be understood? Kitcher shows that current accounts of the self-ascription of belief have great trouble in explaining the case where subjects know their reasons for the belief. She presents a "new" Kantian approach to handling this problem. In this way, the book reveals Kant as a thinker of great relevance to contemporary philosophy, one whose allegedly obscure achievements provide solutions to problems that are still with us. (shrink)

I use a version of the case in "sophie's choice" as an example of the strongest sort of dilemma, With all options seriously wrong, And no permissible way of choosing one of them. This is worse, I argue, Than a choice between conflicting obligations, Where the agent has an overriding obligation "to choose", And does nothing wrong, Once the choice is made, By ignoring one of his prior obligations. Here, "contra" marcus, Guilt seems inappropriate.

This paper updates, modifies, and extends an account of psychopaths’ responsibility and blameworthiness that depends on behavioral control rather than moral knowledge. Philosophers mainly focus on whether psychopaths can be said to grasp moral rules as such, whereas it seems to be important to their blameworthiness that typical psychopaths are hampered by impulsivity and other barriers to exercising self-control. I begin by discussing an atypical case, for contrast, of a young man who was diagnosed as a psychopath at one (...) point but who lacks the element of impulsivity. He exhibits the usual deficits of empathy and related moral emotions, but by now he has developed effective alternative means of conforming to moral rules, essentially on the basis of self-interest. I think it does seem reasonable to hold him morally responsible if he should violate a rule, despite his refusal to acknowledge any specifically moral reasons. I then turn to more typical cases, arguing that blameworthiness is mitigated by the difficulty of learning alternative means of self-control. In a departure from my earlier work, I do not take responsibility to have degrees. But since both blameworthiness and freedom to do otherwise have degrees that depend on the same factors, I go on to explain how it can be reasonable to blame a typical psychopath for an act he may not have been free to avoid. More generally, my suggestion is that notions commonly conflated in philosophers’ treatments of responsibility should be prized apart. (shrink)

Safety-critical systems manufacturers have the duty of care, i.e., they should take correct steps while performing acts that could foreseeably harm others. Commonly, industry standards prescribe reasonable steps in their process requirements, which regulatory bodies trust. Manufacturers perform careful documentation of compliance with each requirement to show that they act under acceptable criteria. To facilitate this task, a safety-centered planning-time framework, called ACCEPT, has been proposed. Based on compliance-by-design, ACCEPT capabilities permit to design Compliance-aware Engineering Process Plans, which are able (...) to show the planning-time allocation of standard demands, i.e., if the elements set down by the standard requirements are present at given points in the engineering process plan. In this paper, we perform a case study to understand if the ACCEPT produced models could support the planning of space software engineering processes. Space software is safety and mission-critical, and it is often the result of industrial cooperation. Such cooperation is coordinated through compliance with relevant standards. In the European context, ECSS-E-ST-40C is the de-facto standard for space software production. The planning of processes in compliance with project-specific ECSS-E-ST-40C applicable requirements is mandatory during contractual agreements. Our analysis is based on qualitative criteria targeting the effort dictated by task demands required to create a CaEPP for software development with ACCEPT. Initial observations show that the effort required to model compliance and processes artifacts is significant. However, such an effort pays off in the long term since models are, to some extend, reusable and flexible. The coverage level of the models is also analyzed based on design decisions. In our opinion, such a level is adequate since it responds to the information needs required by the ECSS-E-ST-40C framework. (shrink)

Hegel introduced the Phenomenology of Mind as a work on the problem of knowledge. In the first chapter, entitled “Sense Certainty, or the This and Meaning,” he concluded that knowledge cannot consist of an immediate awareness of particulars ). The tradition discusses sense certainty in terms of this failure of immediate knowledge without, however, specifically addressing the problem of reference. Yet reference is distinct from knowledge in the sense that while there can be no knowledge of objects without reference, there (...) may be reference without knowledge. If that is the case, then the failure of immediate knowledge does not entitle us to conclude anything about the success or failure of reference. It is not surprising, then, that a few scholars have begun to examine sense certainty primarily as a thesis about reference. (shrink)

This paper argues the case for a renewed interest in Schutz's work by extending his theory of the conscious subject to the feminist concern with the issue of domination. We present a theoretical analysis of the subjective and intersubjective experiences of individuals relating to each other as dominant and subordinate; as our theoretical point of departure we use Schutz's concepts of the we-relation, the assumption of reciprocity of perspectives, typification, working, taken-for-grantedness, and relevance. Schutz's sociology of the conscious subject (...) is striking in its lack of any extended consideration of power, perhaps one reason why support for his work has diminished since the mid-1970s. Our overlayering of feminist sociological theory's interest in domination with Schutz's concerns about subjectivity and intersubjectivity produces an elaboration and a critique of Schutz and expands feminist understanding of relationships of domination. _Inclusion in the City_ explores inclusion and exclusion in the context of policy and practice in one English city - Birmingham. Here, a commitment to redressing the inequalities experienced by many learners has been inhibited by difficulty in securing agreement to a definite policy for inclusion and, consequently, in sustaining initiatives for strengthening participation in community comprehensive education. Grounded in an understanding of inclusion as a political and moral project, the book presents a range of perspectives from policymakers and practitioners. (...) Detailed case studies, based on research specially undertaken for this book, relate inclusion to key issues in contemporary education such as; the effects of selection by attainment; faith schools and their communities; single sex education and inclusive schools; participation in further education; and social mobility.
