The tradition of natural law is one of the foundations of Western civilization. At its heart is the conviction that there is an objective and universal justice which transcends humanity’s particular expressions of justice. It asserts that there are certain ways of behaving which are appropriate to humanity simply by virtue of the fact that we are all human beings. Recent political debates indicate that it is not a tradition that has gone unchallenged: in fact, the opposition is as old (...) as the tradition itself. By distinguishing between philosophy and ideology, by recalling the historical adventures of natural law, and by reviewing the theoretical problems involved in the doctrine, Simon clarifies much of the confusion surrounding this perennial debate. Yves R. Simon (1903-1961) was one of this century’s greatest students of the virtue of practical wisdom. Simon’s interest in this virtue ranged from ultimate theoretical and foundational concerns, such as the relationship between practical knowledge and science, to the most concrete and immediate questions regarding the role of practical wisdom in personal and social decision-making. These concerns occupied Simon from his earliest published writing to the final notes and correspondence he was working on at the moment (...) of his untimely death. Throughout his life, practical wisdom and its related philosophical ramifications emerge time and again at critical junctures, throwing into bold relief some of the deeper dimensions of questions as diverse as the nature of democracy, the concept of law, and the theory of work. Practical knowledge constitutes a unifying motif of Simon’s entire encyclopedic effort. This volume reconstructs what would have been Simon’s final sustained writing on practical knowledge. It includes reworking of some previously published material, especially the landmark 1961 essay, "Introduction to the Study of Practical Wisdom," possibly the best treatment of the concept of "command" in recent philosophical writing. But it also reproduces, in a form closely corresponding to Simon’s intention, material drawn from notes and schemata, concerning issues such as the relationship between moral science and wisdom, the nature of practical judgment, and the relationship between practical knowledge and Christian moral philosophy. Also included are previously unpublished letters to Jacques Maritain on the controversy surrounding the theoretical-practical and practico-practical syllogisms, as well as Maritain’s responses. The volume concludes with applications of Simon’s general theory to a critique of the concept of a social science and to the notion of Christian humanism. The present study examined the distinct configurations, or profiles, taken by work fatigue dimensions among samples of military and civilian employees. We also tested profile similarity across these two samples of employees. In addition, this research documented the relations between the identified work fatigue profiles, one predictor variable, and a series of attitudinal outcomes among military employees. Six profiles of employees characterized by different levels of global and specific work fatigue were identified using latent profile analyses: Low Fatigue, Physically and (...) Emotionally Depleted, Emotionally Depleted, Globally and Mentally Depleted, Globally and Emotionally Depleted, and Balanced. In both samples, employees corresponding to the Balanced profile displayed average levels of global and specific work fatigue. However, this profile slightly differed across sample, as indicated by the observation of work fatigue levels that were slightly higher among the military than among civilians. Militaries’ perceptions of psychological empowerment were significantly related to their likelihood of belonging to all profiles. In turn, militaries’ career satisfaction, job satisfaction, and turnover intentions were also found to differ as a function of profile membership. (shrink)

The rapid and dynamic nature of digital transformation challenges companies that wish to develop and deploy novel digital technologies. Like other actors faced with this transformation, companies need to find robust ways to ethically guide their innovations and business decisions. Digital ethics has recently featured in a plethora of both practical corporate guidelines and compilations of high-level principles, but there remains a gap concerning the development of sound ethical guidance in specific business contexts. As a multinational science and technology company (...) faced with a broad range of digital ventures and associated ethical challenges, Merck KGaA has laid the foundations for bridging this gap by developing a Code of Digital Ethics (CoDE) tailored for this context. Following a comprehensive analysis of existing digital ethics guidelines, we used a reconstructive social research approach to identify 20 relevant principles and derive a code designed as a multi-purpose tool. Versatility was prioritised by defining non-prescriptive guidelines that are open to different perspectives and thus well-suited for operationalisation for varied business purposes. We also chose a clear nested structure that highlights the relationships between five core and fifteen subsidiary principles as well as the different levels of reference—data and algorithmic systems—to which they apply. The CoDE will serve Merck KGaA and its new Digital Ethics Advisory Panel to guide ethical reflection, evaluation and decision-making across the full spectrum of digital developments encountered and undertaken by the company whilst also offering an opportunity to increase transparency for external partners, and thus trust. Gauge symmetries play a central role, both in the mathematical foundations as well as the conceptual construction of modern (particle) physics theories. However, it is yet unclear whether they form a necessary component of theories, or whether they can be eliminated. It is also unclear whether they are merely an auxiliary tool to simplify (and possibly localize) calculations or whether they contain independent information. Therefore their status, both in physics and philosophy of physics, remains to be fully clarified. In this (...) overview we review the current state of affairs on both the philosophy and the physics side. In particular, we focus on the circumstances in which the restriction of gauge theories to gauge invariant information on an observable level is warranted, using the Brout-Englert-Higgs theory as an example of particular current importance. Within continental philosophy of biology the work of Michel Serres has not received a lot of attention. Nonetheless, this chapter wants to argue that Serres was part of a group of thinkers – together with Jacques Monod and Henri Atlan – that started to think about biology in terms of second-order cybernetics and information theory. Therefore, this chapter aims to do four things. First of all, it maps the relation between Serres and Canguilhem, one that was mediated by authors such (...) as Louis Althusser or Jacques Monod. Secondly, it fleshes out Serres’s own ‘biophilosophy’. I label this alternative tradition as a ‘biophilosophy without a subject’. Finally, this chapter explores the consequences of this alternative biophilosophy through a brief examination of two authors whose work lies in the line of this tradition: René Girard and Bruno Latour. Though at first sight different, they both draw inspiration from this biophilosophy to develop a framework that, paradoxically, ‘jumps over’ the subject. Hence, the reason why biology is neither a prominent theme in Girard’s nor in Latour’s work. This is not because of a lack of biophilosophy, but because of an implicit one: a biophilosophy without a subject. (shrink)

Pragmatists have traditionally been enemies of representationalism but friends of naturalism, when naturalism is understood to pertain to human subjects, in the sense of Hume and Nietzsche. Taylor (bio)One of the most striking things about the work of René Girard is that it is an overarching critique of what it is to be saved. The paradox that Girard presents us with is that "salvation" is something from which we must be saved. This combination of salvation as something that must be avoided and something we desperately need appears (...) to have the characteristic of a "double bind," about which Girard has written so much.1 Are we then, even within Girard's own thesis, bound to the mimetic doubling of need and revulsion that can end only in the expulsion or death of a common victim? It is this question that I hope to explore in this article.Girard's Critique Of SalvationTo set out Girard's critique of salvation, it is first necessary to see that what he has come to call the victimage mechanism ("mécanisme victimaire") is, in fact, salvation. Girard's thesis states that desire is mimetic, based on the imitation of another's desire. "Desire is always an imitation of another desire, desire for the same object, and therefore, an inexhaustible source of conflicts and rivalries" (Girard 1978, 39). As the rivalry produced by this desire intensifies, it spreads and produces conflict and violence on a large scale. On an unlimited scale, Girard identifies this with the Hobbesian "war of all against all."2 And it is at this point that the victimage mechanism kicks in. It is at this point that the identification of a scapegoat and the expulsion or killing of the scapegoat produce unity and restore peace. It is this, in Girard's originary scene, that leads to the simultaneous origins of society and religion. In restoring unity to the group, and hence founding the community, the victim becomes sacred, a god. This in itself is an indicator of the salvific power that the scapegoat effects in the community. In order that the violence, once diverted, should not break out again, two things are necessary: ritual, specifically sacrifice, and myth. Ritual reenacts the founding murder upon which society is based, enabling the [End Page 21] participants to transfer their violence to another victim. Myth is the story told by the persecutors about the events that led to the creation of their community, that is, the founding murder. Thus, religion "dehumanizes violence; it protects man from his own violence by taking it out of his hands, transforming it into a transcendent and ever-present danger to be kept in check by the appropriate rites appropriately observed and by a modest and prudent demeanor.... religion protects man as long as its ultimate foundations are not revealed" (Girard 1978, 134–35). Salvation has happened, and a cult arises to disburse the effects of this salvation.It is important that we take this account of religion with full seriousness and do not regard it simply as the prologue to Girard's later promotion, even rehabilitation, of the Judaeo-Christian tradition. This is salvific: religion protects us from our own violence; it has mechanisms for bringing to an end outbreaks of that violence. Elsewhere Girard can speak of "the negative usefulness of religion as a social prop against anarchy and chaos" (Girard 1997, 162–63). This is salvation: violence is dealt with and human society can dwell in relative peace. Religion, on this account, is not "pie-in-the-sky," a transcendent deferral of gratification. It has real benefits to society today; it is attractive, elegant, and simple. What more could we want from religion?But Girard will not allow us to rest content with this account of religion. He is blunt when he declares that "most religions are based on a lie, which is the supposed guilt of the victim" (Girard 1993c, 32). Nietzsche wrote that "The sacrificial animal does not share the spectators' ideas about sacrifice, but one has never let it have its say,"3 and this is precisely the origin of Girard's critique of the salvation offered by religions based on scapegoating. In this paper, I aim to address a specific issue underpinning Cartesian metaphysics since its first public appearance in the Discourse right up until the Meditations, but which definitely came to the surface in the Second and Fifth Replies. It involves the possibility that to be thinking and to be extended do not actually contrast as two entirely different properties; hence, these two essences cannot serve as the basis for a disjunctive, real distinction between two corresponding substances, the mind and (...) the body. I dub this problem the ‘thinking matter issue.’ I suggest that Descartes’s concerns about the ‘thinking matter issue’ characterizes and structures the entirety of Meditation Two and its connection with Meditation Six, especially in the attempt to covertly implement what I refer to as Descartes’s ‘prejudice strategy.’ The core of the ‘prejudice strategy’ lies in the idea that the ‘thinking matter issue’ is just a false problem, one raised by the inadequate notions of the mind and the body that we apply to this problem. In section 1, I set out the way in which the ‘thinking matter issue’ emerged in Descartes’s philosophy after the first exposition of his metaphysics in the Discourse. Section 2 deals with the new argumentative path Descartes draws for the Meditations and with the new role that he assigns to the inference about the mind’s non-physical nature after the cogito. In section 3, I contend that the ‘prejudice strategy’ structures Meditation Two and, partially, Six. Section 4 shows that Descartes himself reveals this in his Replies to the Second and the Fifth Set of Objections. In section 5, I delve into Descartes’s foundational theory of the ‘prejudice strategy,’ i.e. his theory of infancy as set out especially in the Replies to the Sixth Set of Objections. -/- . (shrink)

This article addresses some Late Scholastic accounts (Suárez, Abra de Raçonis, Gamaches, Ysambert, Arriaga), of the “problem of transduction” in angels, as a possible source for the genesis of early modern occasionalism, particularly La Forge’s and Cordemoy’s. Indeed, if the “problem of transduction” is a structural issue of all the Aristotelian gnoseology, the impossibility of interaction between immaterial and material substance concerns, more generally, all spiritual substances, posing the issue about the principle of "transduction" already at the level of angels, (...) entirely immaterial creatures, unable to any relationship with the bodies. In order to answer to this peculiar version of the 'problem of transduction' Late Scholastic elaborate doctrines that are direct antecedents of occasionalist ones, and which likely directly influenced early modern occasionalism. To follow this investigative path, I will intersect three complementary argumentative lines. First, I will focus on Late Scholastic angelology, to point out how the need to solve the 'problem of transduction' in this peculiar context pushes the sixteenth and seventeenth-century Schools to a proto-occasionalist conception of angelic innatism. Secondly, I will identify in the debate on the angelic locutio of the key places for the elaboration of a model that sees God as the only efficient cause and the only guarantor of the mind's communications and contents. Thirdly, I will stress how the Late Scholastic angelological debates could be an important source for early modern dualism and the seventeenth-century occasionalism, notably for La Forge and Cordemoy. -/- . Twenty years before Suárez’s Metaphysicae disputationes, Pedro da Fonseca offered one of the most impressive modern attempts to reorder Aristotle’s Metaphysics. In the present chapter, I will endeavour to show how insightful Fonseca’s effort truly was, by dealing with his ousiology. I will focus especially on the Jesuit’s account of three pivotal concepts in the scholastic theory of substance, i.e. Divine Substance, created substance and prime substance, or supposit. These notions are primarily metaphysical, but — according to a long-standing scholastic (...) framework — are also deeply indebted to Patristic Trinitarianism. As I shall argue, this is especially true for Fonseca, who welcomes and defends the idea of a conceptual unity between ontology, ousiology and Trinitarism he received from a centuries-long tradition. Can the difference between the two be described in terms of an opposition between a reciprocal and an exploitative relationship? What difference does the Judeo-Christian tradition make in (...) shaping the modern relationship with nature?To answer these questions I will give brief descriptions of the way in which three cultural traditions have structured the relationship between man and nature: societies that are ruled by sacred kings, societies where power over nature is attributed to divinities, and the Old Testament tradition. As cases of sacred kinship, I present ethnographic material taken from my anthropological fieldwork among the Lulubo, Lokoya, and Lotuho peoples from the East Bank of the Nile in Southern Sudan. I will use the term "Eastern Nilotic" as shorthand for this complex of peoples. For the societies where divinities play the central role, I take the Western Nilotic Dinka, Nuer, and Atuot living in the flood plains of the Nile north of the kingship societies.In comparing these three traditions my point of departure is René Girard's analysis of culture as a mechanism to resolve conflict by directing the aggression of the members of society onto a victim and so achieving a new consensus. We shall see that in the kingship societies what we call natural phenomena play an integral part in culturally staging the scapegoat mechanism. They are the stage of human rivalries and their resolution. Among the polytheistic Western Nilotes they are the instrument through which the gods make their power felt and demand attention from humans. In the Old Testament, natural phenomena remain the domain of God's power. Humans should not try to interfere. Their mission is to combat human evil as defined in Mosaic law. [End Page 31]2. Kings as Ecological AgentsThe survival of the communities of the Lokoya and Lulubo on the East Bank of the Nile who traditionally live in well-fortified village-polities, counting in the precolonial period between 1500 and 2500 inhabitants, is dependent on forces that are unpredictable (Simonse 1992). As agriculturists they are dependent on regular rains. However, the rains in their area are erratic and localized. As a result there is always a risk that the harvest may fail. The soil is of varying quality, giving varying yields in different places. The birth rate is another major concern. It determines the security of the community in its relationship to neighboring, frequently hostile, communities. There is the concern for epidemics, crop-eating insects and birds, and root-eating worms. Violent winds may destroy the crop, and lions and leopards may kill humans and cattle. A concern of a different order is the extent of the effectiveness of weapons, spears, and bows and arrows, in assuring security.When adversity affects the community, the first question asked by those affected is that regarding its cause. Frequently the cause is a breach of the social rules: an act of violence and a failure to perform or properly perform a ritual of purification necessitated by the violence. It may also be unconscious resentment on the part of a person or group that feels excluded from benefits enjoyed by others. It may be the cry of a neglected relative. It may be incest. It may be an attack by outsiders.Among the Lulubo and Lokoya, responsibility for the various aspects of the natural environment that can be critical for community survival is allocated to the different clans. In the case of a crisis (drought, infertility) the clan associated with the problem is the target of investigations. The main investigation strategy is to check, one by one, the quarrels in which members of that clan have been involved. Since the early 1970s, Marcel Mauss’s Essai sur le Don, translated into English as The Gift in 1954, has been a standard reference in the social science and bioethical literature on the use of human body parts and substances for medical and research purposes. At that time, three social scientists—political scientist Richard Titmuss in the United Kingdom and sociologist Renée C. Fox working with historian Judith Swazey in the United States—had the idea of using this concept to highlight the fundamental (...) structure of the biomedical practices they were studying, respectively, blood donation, and hemodialysis and organ transplantation. The fact that these first applications of Mauss’s essay should emerge in English- rather than in French-speaking countries raises the question of what the translation of the essay, and notably of the word don as gift, may have to do with this fact. Reading Mauss in translation undoubtedly inspired a seminal approach to interpreting medical and research practices based on bodily giving. This article posits that something may have also been lost: a much broader concept of giving with unquestionable links to the Durkheimian concept of solidarity, which Mauss conceptualizes not only as an obligation but also as a liberty to give. In this article, I deal with the role of hypothesis in the scientific methodology of Isaac Newton, Francis Bacon and René Descartes. The first paragraph is about hypothesis in Newton's lexicon, especially trying to understand the meaning of his famous hypotheses non fingo. The second paragraph deals with Bacon's methodology, arguing especially that his epis-temology was the first to propose an artificial way for inductive inferences, also giving up all hypothesis in science. The third paragraph shows how Descartes, following Bacon's (...) traces and reading his methodology in the light of the idea of a Mathesis Universalis based on mental evidence, structures a full hypothetical-deductive methodology, charging metaphysics with the analytical phase and depriving experiments of any role in it. The fourth paragraph, on Newton again, tries to understand Newton's specific account of hypothesis as an auxiliary phase in the scientific discovery, and what really differentiates Newton from his contemporaries, Boyle and Hooke. A widespread historiographical portrayal represented Descartes' dualism as constituted in direct contrast with Aquinas' concept of soul-form. In the wake of the many studies that have opposed this prejudice in recent decades, this book reconstructs the fifteenth and seventeenth-century debate on psychology, focusing primarily on the Jesuit context and on the intersection between Aristotelianism, Platonism, and Augustinianism in early modern France. Beginning with a rigorous investigation of the theories of the separated soul, particular attention is then given to the indirect (...) derivation of the Cartesian cogito and innatism from angelological themes of the time. Indeed, in the years in which Descartes elaborates his metaphysics, the immediate proximity between souls and angels is somehow a matter of fact, in the light of which many of the argumentative choices of the Meditations, and even the relationship that closely joins the "thinking substance" with the body-machine, appear clear. -/- . The present paper deals with the diachronic evolution of the Cartesian concept of intuitus, focusing particularly on the reasons for its (at least lexical) dismissal in Descartes's mature elaborations of his metaphysics. In section 1, I address the notion of intuitus presented in the Rules, showing that this concept is pivotal in Descartes' early epistemology of evidence. In section 2, I argue that such a concept can be traced back to certain distinctive elements of the Late Scholastic debate on angels (...) and human knowledge, from which Descartes could have drawn some of his early ideas. In section 3, I analyze the reasons behind Descartes' dismissal of the notion of intuitus, arguing for a deliberate choice, due both to epistemologico-metaphysical and theological reasons, on which I dwell focusing especially on Descartes' letters. -/- . As of the early seventeenth century, the collapse of the hylomorphic conception of nature offers the opportunity for an association - which was unthinkable in the Aristotelo-scholastic context - between the notions of 'body' and matter. In this paper, I endeavor to show that Descartes is among the emblematic cases of this conceptual switch, dwelling on his sources, as well as on the metaphysical and physical correlates of this option.

This article examines the epistemological role of the fable as used by Descartes in his Monde to present the idea of an entirely mechanical world. Rather than merely a dissimulative-literary device, putting the world into fable form actually turns out to be a real scientific instrument, making it possible for Descartes to re-create the world from a metaphysical and wholly geometrical point of view, based on the changelessness of the divine essence and creation. In this sense his fable du monde (...) goes hand in hand with the ability of the human imagination to think up scientific models, that, by being plausible, can be applied to the interpretation of phenomena.
