Jeutner argues that the reasonable person is, at heart, an empathetic perspective-taking device, by tracing the standard of the reasonable person across time, legal fields and countries. Beginning with a review of imaginary legal figures in the legal systems of ancient Egypt, Greece, and Rome, the book explains why the common law's reasonable person emerged amidst the British industrialisation under the influence of Scottish Enlightenment thinking. Following the figure into colonial courts, onto battlefields and into self-driving cars, the book contends (...) that the reasonable person invites judges, jury-members, and lawyers to take another person's perspective when assessing their own or another person's conduct. The perspective of another is taken by means of empathy, by feeling what others might feel in a particular situation. Crosslinguistically, the same modal words can be used to express a wide range of interpretations. This crosslinguistic trend supports a Kratzerian analysis, where each modal has a core lexical entry and where the difference between an epistemic and a root interpretation is contextually determined. A long-standing problem for such a unified account is the equally robust crosslinguistic correlation between a modal’s interpretation and its syntactic behavior: epistemics scope high (in particular higher than tense and aspect) and roots low, a fact (...) which has led to proposals that hardwire different syntactic positions for epistemics and roots (cf. Cinque’s hierarchy). This paper argues that the range of interpretations a modal receives is even more restricted: a modal must be keyed to certain time-individual pairs, but not others. I show that this can be captured straightforwardly by minimally modifying the Kratzerian account: modals are relative to an event—rather than a world—of evaluation, which readily provides a time (the event’s running time) and (an) individual(s) (the event’s participants). I propose that this event relativity of modals can in turn explain the correlation between type of interpretation and syntactic position, without stipulation of an interpretation-specific height for modals. The author examines the nature of Herzen's relationship with Slavophilism in its conflict with Westernism and discusses his incipient religiosity.

We argue that artificial networks are explainable and offer a novel theory of interpretability. Two sets of conceptual questions are prominent in theoretical engagements with artificial neural networks, especially in the context of medical artificial intelligence: Are networks explainable, and if so, what does it mean to explain the output of a network? And what does it mean for a network to be interpretable? We argue that accounts of “explanation” tailored specifically to neural networks have ineffectively reinvented the wheel. In (...) response to, we show how four familiar accounts of explanation apply to neural networks as they would to any scientific phenomenon. We diagnose the confusion about explaining neural networks within the machine learning literature as an equivocation on “explainability,” “understandability” and “interpretability.” To remedy this, we distinguish between these notions, and answer by offering a theory and typology of interpretation in machine learning. Interpretation is something one does to an explanation with the aim of producing another, more understandable, explanation. As with explanation, there are various concepts and methods involved in interpretation: Total or Partial, Global or Local, and Approximative or Isomorphic. Our account of “interpretability” is consistent with uses in the machine learning literature, in keeping with the philosophy of explanation and understanding, and pays special attention to medical artificial intelligence systems. This paper discusses the interaction of aspect and modality, and focuses on the puzzling implicative effect that arises when perfective aspect appears on certain modals: perfective somehow seems to force the proposition expressed by the complement of the modal to hold in the actual world, and not merely in some possible world. I show that this puzzling behavior, originally discussed in Bhatt (1999, Covert modality in non-finite contexts) for the ability modal, extends to all modal auxiliaries with a circumstantial modal (...) base (i.e., root modals ), while epistemic interpretations of the same modals are immune to the effect. I propose that implicative readings are contingent on the relative position of the modal w.r.t. aspect: when aspect scopes over the modal (as I argue is the case for root modals), it forces an actual event, thereby yielding an implicative reading. When a modal element scopes over aspect, no actual event is forced. This happens (i) with epistemics, which structurally appear above tense and aspect; (ii) with imperfective on a root modal: imperfective brings in an additional layer of modality, itself responsible for removing the necessity for an actual event. This proposal enables us to solve the puzzle while maintaining a standardized semantics for aspects and modals. (shrink)

How do children learn the meanings of propositional attitude verbs? We argue that children use information contained in both syntactic distribution and pragmatic function to zero in on the appropriate meanings. Specifically, we identify a potentially universal link between semantic subclasses of attitude verbs, their syntactic distribution and the kinds of indirect speech acts they can be used to perform. As a result, children can use the syntax as evidence about the meaning, which in turn constrains the kinds of pragmatic (...) enrichments they do and do not make in understanding these verbs in conversation. Trait Selective Abortions (TSA) have come under critique as a medical practice that presents potential disabled infants as burdens and lacking the potential for meaningful lives. This paper, using the author’s background as a disabled person, contends that the philosophy underpinning TSAs reflects liberal society’s lack of a theory of needs. The author argues for a care ethics based approach informed by disability analyses to engage with TSAs.

Extracellular nucleic acids are found in different biological fluids in the organism and in the environment: DNA is a ubiquitous component of the organic matter pool in the soil and in all marine and freshwater habitats. Data from recent studies strongly suggest that extracellular DNA and RNA play important biological roles in microbial communities and in higher organisms. DNA is an important component of bacterial biofilms and is involved in horizontal gene transfer. In recent years, the circulating extracellular nucleic acids (...) were shown to be associated with some diseases. Attempts are being made to develop noninvasive methods of early tumor diagnostics based on analysis of circulating DNA and RNA. Recent observations demonstrated the possibility of nucleic acids exchange between eukaryotic cells and extracellular space suggesting their participation in so far unidentified biological processes. In this article, I critically reassess Iris Marion Young's late works, which centre on the distinction between liability and social connection responsibility. I concur with Young's diagnosis that structural injustices call for a new conception of responsibility, but I reject several core assumptions that underpin her distinction between two models and argue for a different way of conceptualising responsibility to address structural injustices. I show that Young's categorical separation of guilt and responsibility is not supported by the writings of Hannah (...) Arendt, which Young draws on, and that it is also untenable on independent systematic grounds. Furthermore, I argue that several of Young's other criteria fail to clearly demarcate two distinct phenomena. I therefore propose to transcend Young's distinction between two models in favour of a related, but conceptually different distinction between two forms of responsibility: interactional and structural. Embracing this terminology facilitates the conceptualisation of the general features of responsibility that are shared by both forms, including their retrospective and prospective time-direction and their applicability to individual, joint and group agency. The distinction between interactional and structural responsibility also yields a more compelling general account of the role of background structures, and of blame within ascriptions of political responsibility. Each time, something rises from the dead: meaning emerges from significance, the world from the unworldly aspects of globalization, Christianity from the decline of religion, the body from its Western devaluation in favor of the spirit, and community from the failure of state-controlled communism and rampant individualism. In the 19th century, the history of philosophy becomes the history of a particular science. Modern philosophical historiography is an ambivalent project. On the one hand, we find an affirmative concept of Bildung through tradition and historical insight; on the other, there arises a critical reflection on historical education in the light of an emerging critique of modern culture. The book offers a comprehensive overview of the debate.

A distinctive characteristic of Laclau and Mouffe’s theory of hegemony is its insistence on the denial of an essence or ground of the subject. This element of their theory is derived from their notion of antagonism, in which a relation with a ground is brought into question by revealing its contingency. This article argues that the political dimension of this argument makes sense only in the context of Laclau and Mouffe’s notion of modernity. However, the universalizing of modernity as the (...) form of hegemony reduces the ontological notion of antagonism to a dialectical or empirical notion of contradiction. This article examines two key moves in this process: first, the reduction of the subject to Lacan’s account of the subject; and second, the reduction of modernity to an ontotheologicalpolitical structure derived from Lefort as the support of the hegemonic subject. From this the article examines Laclau’s response to the exhaustion of political modernity in the figure of complexity, from which antagonism is evacuated through the hegemony of the category of myth. Finally, the article discusses a nonhegemonic approach to antagonism derived from the work of Foucault, Wolin and Rancière. (shrink)

Postpositivist epistemology treats science as merely a matter of consensus. The main reason for that is the lack of objectivity. We argue that objectivity is not an essential claim for a scientific methodology. Science as an institutional enterprise is characterized mainly by progressive discourse and not by objectivity. In turn, progressiveness depends on a set of norms and regulative principles. This view of science as progressive discourse provides a more adequate basis for dealing with opinion conflicts, scientific methodology, and questions (...) of authority in science than does the consensus view. In this article, I set out Suárez's conception of the demon's obstinacy. For Suárez, the demons’ obstinacy is a divine punishment. It is the result of the free and awful choice to turn away from God that the demons have decided to make, the main consequence of which is the loss of the freedom to will and to do the good. Taking up Aquinas’s conception, Suárez considers that the demonic nature is irredeemably corrupt and obstinate in evil. Demons are provided (...) only with a miserable freedom, consisting of the possibility to choose between different evils. Perpetually sinful and eternally constrained to remain so, they are condemned to wretchedness, to complacency in evil, and to the unremitting torments of hell. (shrink)

We generalize and extend the class of Sahlqvist formulae in arbitrary polyadic modal languages, to the class of so called inductive formulae. To introduce them we use a representation of modal polyadic languages in a combinatorial style and thus, in particular, develop what we believe to be a better syntactic approach to elementary canonical formulae altogether. By generalizing the method of minimal valuations à la Sahlqvist–van Benthem and the topological approach of Sambin and Vaccaro we prove that all inductive formulae (...) are elementary canonical and thus extend Sahlqvist’s theorem over them. In particular, we give a simple example of an inductive formula which is not frame-equivalent to any Sahlqvist formula. Then, after a deeper analysis of the inductive formulae as set-theoretic operators in descriptive and Kripke frames, we establish a somewhat stronger model-theoretic characterization of these formulae in terms of a suitable equivalence to syntactically simpler formulae in the extension of the language with reversive modalities. Lastly, we study and characterize the elementary canonical formulae in reversive languages with nominals, where the relevant notion of persistence is with respect to discrete frames. (shrink)

Ethics training is commonly cited as a primary method for increasing employees ethical decision making and conduct. However, little is known about how the presence of ethics training can enhance other components of an organization's ethical environment such as employees perception of company ethical values. Using a national sample of 313 business professionals employed in the United States, the relationship between ethics training and perceived organizational ethics was explored. The results of the analysis provide significant statistical support for the notion (...) that businesspersons employed in organizations that have formalized ethics training programs have more positive perceptions of their companies ethical context than do individuals employed in organizations that do not. The analysis also indicated that job satisfaction was related to employees attitudes about their ethical context. The managerial implications of the results are outlined, along with the limitations of the study and recommendations for future research. (shrink)

‘Institution’ as a concept has a particular resonance in the collaborative work of Deleuze and Guattari. Looking at institutional psychotherapy and the way in which it traverses the works of Deleuze and Guattari, this article will attempt to offer some ways that the concept of institution can be put to work. To do so, it will begin with two statements about institutional psychotherapy made by the psychiatrist Jean Oury: ‘Institutional psychotherapy is perhaps the putting in place of all kinds of (...) means to struggle, each day, against all that might make the whole of the “collective” topple over towards a segregative or concentrationary structure’, and ‘The establishment is a building and a contract agreed with the State, a price per day. The institution, when it exists, is a labour, a strategy to avoid a whole load of people fermenting, like a jar of jam with a poorly closed lid.’ These statements will open the door to a deeper exploration of what an institution can do and how it was activated in Guattari’s clinical practice and in the collaborative philosophy developed with Deleuze. Complete deductive systems are constructed for the non-valid (refutable) formulae and sequents of some propositional modal logics. Thus, complete syntactic characterizations in the sense of Lukasiewicz are established for these logics and, in particular, purely syntactic decision procedures for them are obtained. The paper also contains some historical remarks and a general discussion on refutation systems.

The international #MeToo campaign against sexual harassment constitutes the most prominent contemporary campaign against sexual harassment worldwide. It exposed the issue by undermining the ‘culture of silence’ prevailing in several contexts, including political institutions. This article analyses one specific variant of #MeToo, the campaign MeTooEP that emerged in the European Parliament. MeTooEP is unique in many ways: it was the first collective action against sexual harassment in parliaments emerging in the #MeToo aftermath and it was the first collective action within (...) the EP led by members of the staff, which eventually drove some internal policy changes. Using a unique, large interview dataset, the analysis shows how the actors behind MeTooEP were crucial in shaping the campaign. Their knowledge of institutional rules, practices and daily presence in the EP facilitated their advocacy and transformed the Parliament into an enabling platform for their actions. With the help of Feminist Institutionalism, the analysis demonstrates how the formal and informal institutional EP bodies with their rules and regulations shaped MeTooEP in ways that constrained and empowered it. In my presentation I understand anger as an emotion that, in addition to its relationship to time, is also subject to cultural rules and is therefore related to probability and predictability. With the use of selected references from the theory of emotions (ranging from antiquity to the present day) I identify several consistent fundamental assumptions about this emotion and reconstruct a discourse of “just” anger. Viewed from the perspective of such extra-literary concepts of anger (particularly Thomas Aquinas' ‘De passionibus animae’) (...) Willehalm's outbursts of anger at the French court can be seen not only as an “illegitimate”, universally condemned act, through which the margrave unnecessarily puts at risk his legitimate claim to the king's support; equally, the very forbearance and expressions of solidarity which he is successively shown after his intemperate behaviour in Munleun can also be reinterpreted in light of the Aristotelian-Thomistic model of anger.
