The most qualified applicant is the one who has the propensity to maximally satisfy the employer’s preferences. An applicant’s propensity is a function of her willingness to work hard together with the relevant capacity or potentiality to do the tasks constituting a job. Given this account of the most qualified applicant, there is only a weak duty, if any, to hire persons based on their being the most qualified. Such a duty is not justified by reference to (...) rights, desert, fairness, or the maximization of welfare. However, such a duty may come about via promises made by the employer or the employee who does the hiring. These results suggest that anti-discrimination laws cannot be justified based on merit, although other justifications might still be available. (shrink)

Evidence‐based medicine has become both the mantra of clinical practice and the dominant contemporary approach to patient care. Gordon Guyatt et al. first proposed applying the concept to medical education in the early 1990s, arguing for training that “de‐emphasizes intuition, unsystematic clinical experience, and pathophysiologic rationale” in favor of “examination of evidence from clinical research”; over the following twenty‐five years, nearly every medical school and residency program in the United States incorporated these methods into its training. During this same period, (...) admissions requirements and protocols have continued to rely on subjective, non‐evidence‐based ideals largely developed a century earlier. In light of the continued underrepresentation of certain demographic groups among matriculants, as well as the national controversy surrounding admissions standards at undergraduate institutions—most notably embodied in the lawsuit by Students for Fair Admissions against Harvard University—the moment may be ripe for a radical reexamination of those requirements. Recent perspectives on corporate social responsibility have called for increased research on how CSR affects individuals. Research is needed to examine whether individual differences affect the relationship between CSR and individual reactions to CSR. In response, this experimental study examined how perceptions of corporate citizenship influence job applicant attraction and work role definitions. Personal values and education concerning CSR are considered as interactive factors affecting the influence of perceptions of corporate citizenship. Results indicate that perceived corporate citizenship had a (...) greater impact on job applicant attraction for those individuals who received prior education regarding CSR and for those who were higher in other-regarding value orientation. Furthermore, perceived corporate citizenship had a positive impact on the extent to which participants defined CSR as a personal work role responsibility. In recent years, a consensus has developed among both affirmative action's advocates and opponents that in relation to the typical white applicant, the effects of minority preferencing are minimal. In this essay, the aim is to clarify the mathematics of affirmative action's impact on majority applicants, and to flag the distinction between that question and affirmative action's opportunity cost. First, the essay establishes the level of agreement among judges and academics on the triviality of affirmative action's effect on the (...) regular white applicant's prospects of success. Second, it demonstrates how the prevailing position on the impact of minority preferencing on the white applicant is flawed - as regards both the calculation of relative admission likelihood and the application of the matriculant yield variable. Making use of a number of case studies reviewed in the literature, it shows how those studies, properly understood, convey a rather different picture of the arithmetic of minority preferencing. The essay concludes by challenging the tendency to take the effects of affirmative action (on both preferred and non-preferred applicants) as exclusively indicative of its costs. (shrink)

The desire to use established corporate law skill sets in the pro bono context has lead some lawyers to extend pro bono services to charitable and non-profit organisations. But does the provision of free legal services to well-funded organisations constitute pro bono work, and how can providers of pro bono legal services best prioritise among competing organisations? The author surveys various sources of formal and informal regulation in Singapore and selected Asian and other common law jurisdictions and suggests that when (...) distinguishing between non-profit organisations with different levels of funding, a coherent guideline would evaluate whether the payment of legal fees would deplete economic resources to the extent of significantly impairing organisation programmes. In this paper I sketch a liberal studies course designed to explore our fundamental problem of thought and life: How can our human world exist and best flourish embedded as it is in the physical universe? The fundamental character of this problem provides one with the opportunity to explore a wide range of issues. What does physics tell us about the universe and ourselves? How do we account for everything physics leaves out? How can living brains be conscious? If everything (...) occurs in accordance with physical law, what becomes of free will? How does Darwin's theory of evolution contribute to the solution to the fundamental problem? What is the history of thought about this problem? What is of most value associated with human life? What kind of civilized world should we seek to help create? Why is the fundamental problem not a part of standard education in schools and universities? What are the most serious global problems confronting humanity? Can humanity learn to make progress towards as good a world as possible? These are some of the questions that can be tackled as an integral part of exploring the fundamental problem. But the course does not merely wander at random from one issue to another. Taking the fundamental problem as central provides the course with a coherent structure. The course would be conducted as a seminar, and it would respond to queries and suggestions from students. "Everything is a pretext for a good dinner.".

Kripke defines a rigid designator as one that designates the same object in every possible world in which that object exists. He argues that proper names are rigid. So also, he claims, are various natural kind terms. But we wonder how they could be. These terms are general and it is not obvious that they designate at all. It has been proposed that these kind terms rigidly designate abstract objects. This proposal has been criticized because all terms then seem to (...) come out rigid, thus trivializing rigidity. The paper starts with further criticisms of this proposal aimed particularly at a recent version given by LaPorte. The paper goes on to develop and defend an alternative proposal presented briefly in Devitt and Sterelny (1999): instead of taking those natural kind terms to rigidly designate an object we take them to rigidly apply to the members of their extensions. Schwartz has rightly insisted that a notion of rigidity must do some theoretical work if it is to be interesting. The paper argues that rigid application for kind terms does the same primary work as rigid designation for singular terms, the work of refuting description theories of some terms; and it does the same secondary work, of explaining certain modal phenomena (with one exception). This paper develops a compositional, type-driven constraint semantic theory for a fragment of the language of subjective uncertainty. In the particular application explored here, the interpretation function of constraint semantics yields not propositions but constraints on credal states as the semantic values of declarative sentences. Constraints are richer than propositions in that constraints can straightforwardly represent assessments of the probability that the world is one way rather than another. The richness of constraints helps us model communicative acts in essentially the (...) same way that we model agents’ credences. Moreover, supplementing familiar truth-conditional theories of epistemic modals with constraint semantics helps capture contrasts between strong necessity and possibility modals, on the one hand, and weak necessity modals, on the other. This paper argues that scientific realism commits us to a metaphysical determination relation between the mathematical entities that are indispensible to scientific explanation and the modal structure of the empirical phenomena those entities explain. The argument presupposes that scientific realism commits us to the indispensability argument. The viewpresented here is that the indispensability of mathematics commits us not only to the existence of mathematical structures and entities but to a metaphysical determination relation between those entities and the modal structure of (...) the physical world. The no-miracles argument is the primary motivation for scientific realism. It is a presupposition of this argument that unobservable entities are explanatory only when they determine the empirical phenomena they explain. I argue that mathematical entities should also be seen as explanatory only when they determine the empirical facts they explain, namely, the modal structure of the physical world. Thus, scientific realism commits us to a metaphysical determination relation between mathematics and physical modality that has not been previously recognized. The requirement to account for the metaphysical dependence of modal physical structure on mathematics limits the class of acceptable solutions to the applicability problem that are available to the scientific realist. Integrity is a critical determinant of the effectiveness of research organizations in terms of producing high quality research and educating the new generation of scientists. A number of responsible conduct of research (RCR) training programs have been developed to address this growing organizational concern. However, in spite of a significant body of research in ethics training, it is still unknown which approach has the highest potential to enhance researchers’ integrity. One of the approaches showing some promise in improving researchers’ integrity (...) has focused on the development of ethical decision-making skills. The current effort proposes a novel curriculum that focuses on broad metacognitive reasoning strategies researchers use when making sense of day-to-day social and professional practices that have ethical implications for the physical sciences and engineering. This sensemaking training has been implemented in a professional sample of scientists conducting research in electrical engineering, atmospheric and computer sciences at a large multi-cultural, multi-disciplinary, and multi-university research center. A pre-post design was used to assess training effectiveness using scenario-based ethical decision-making measures. The training resulted in enhanced ethical decision-making of researchers in relation to four ethical conduct areas, namely data management, study conduct, professional practices, and business practices. In addition, sensemaking training led to researchers’ preference for decisions involving the application of the broad metacognitive reasoning strategies. Individual trainee and training characteristics were used to explain the study findings. Broad implications of the findings for ethics training development, implementation, and evaluation in the sciences are discussed. (shrink)

The purpose of the current study was to apply and evaluate a procedure to elicit expert judgments about correlations, and to update this information with empirical data. The result is a face-to-face group elicitation procedure with as its central element a trial roulette question that elicits experts' judgments expressed as distributions. During the elicitation procedure, a concordance probability question was used to provide feedback to the experts on their judgments. We evaluated the elicitation procedure in terms of validity and reliability (...) by means of an application with a small sample of experts. Validity means that the elicited distributions accurately represent the experts' judgments. Reliability concerns the consistency of the elicited judgments over time. Four behavioral scientists provided their judgments with respect to the correlation between cognitive potential and academic performance for two separate populations enrolled at a specific school in the Netherlands that provides special education to youth with severe behavioral problems: youth with autism spectrum disorder (ASD), and youth with diagnoses other than ASD. Measures of face-validity, feasibility, convergent validity, coherence, and intra-rater reliability showed promising results. Furthermore, the current study illustrates the use of the elicitation procedure and elicited distributions in a social science application. The elicited distributions were used as a prior for the correlation, and updated with data for both populations collected at the school of interest. The current study shows that the newly developed elicitation procedure combining the trial roulette method with the elicitation of correlations is a promising tool, and that the results of the procedure are useful as prior information in a Bayesian analysis. We present a new approach to the old problem of how to incorporate the role of the observer in statistics. We show classical probability theory to be inadequate for this task and take refuge in the epsilon-model, which is the only model known to us caapble of handling situations between quantum and classical statistics. An example is worked out and some problems are discussed as to the new viewpoint that emanates from our approach.

Non-profit (NP) organizations present complex challenges in managing stakeholder relationships, particularly during times of environmental change. This places a premium on knowing which stakeholders really matter if an effective relationship marketing strategy is to be developed. This article presents the successful application of a model, which combines Mitchell’s theory of stakeholder saliency and Coviello’s framework of contemporary marketing practices in a leading NP organization in the U.K. A cooperative enquiry approach is used to explore stakeholder relationships, dominant marketing practices, and (...) to surface differing perceptions about the organization’s marketing strategy. Development of decision-support and intelligent agent systems necessitates mathematical descriptions of uncertainty and fuzziness in order to model vagueness. This paper seeks to present an outline of Peirce’s triadic logic as a practical new way to model vagueness in the context of artificial intelligence. Charles Sanders Peirce was an American scientist–philosopher and a great logician whose triadic logic is a culmination of the study of semiotics and the mathematical study of anti-Cantorean model of continuity and infinitesimals. After presenting Peircean semiotics (...) within AI perspective, a mathematical formulation of a Peircean triadic set is given in relationship with classical and fuzzy sets. Using basic logical operators, all possible respective implication operators, bi-equivalence operators, valid rules of inference, and associative, distributive and commutative logical properties are derived and verified through the truth function approach. In order to suggest practical directions, aggregation operators for Peirce’s triadic logic have been formulated. A mathematical formulation of a medical diagnostic problem and ER diagram of a library management system using Peirce’s triadic relation show potential for further applications of the proposed triadic set and triadic logic. Alongside, a classical AI game—The Wumpus World—is implemented to show practical efficacy in comparison with binary implementation. Besides giving some preliminary formulations for trichotomous set theory and definition of finite automaton, development of hybrid architectures for intelligent agents and evolutionary computations are discussed as potential practical avenues for Peirce’s triadic logic. ABSTRACTFeelings and cognitions influence judgment through attribution. For instance, the attribution of positive feelings and cognitions to a stimulus leads to a positive judgment of that stimulus. We examined whether misattribution is moderated by the applicability of a distractor to the judgment question. For instance, when are people more likely to attribute to a target person the affective and cognitive experiences triggered by a kitten – when trying to judge the person’s cuteness or trustworthiness? The kitten triggers experiences specifically relevant (...) to cuteness, but people might more easily suspect the kitten’s potential influence when judging cuteness rather than trustworthiness. Using the Affect Misattribution Procedure, we found that applicability increases the effect of misattribution on valenced judgments. This article presents an analysis of contractual relations in sport from the standpoint of the Croatian legislative system. Due to the complexity of the subject matter, the author considers only a small fragment of it - the significance and the role of sport in Croatian society and the law of contracts „as a cornerstone on which „sports law“ has been built and which is of primary importance in most areas where there is an interface between sport and the law, irrespective (...) of whether the sport is being played at an elite level or at a more humble one“. Bearing in mind the limited extent of this article, the autor tries to provide some clarifications and some guidance on how to deal with the designation and the determination of the applicable law for contracts in the sporting context. Considering that there are different legal regimes which may come into play with regard to the designation of the law applicable to contracts in the sporting context, the author first presents the determination of the applicable law according to the Rome I Regulation and then according to the Croatian Arbitration Act, Swiss Private International Law Act and the CAS Code of Sports-related Arbitration, as the most common in sports practice. Then, the author deals with contracts concluded with minor athletes and the determination of the law applicable to some preliminary questions. This paper presents a model for the implementation of educational activities involving musical improvisation that is based on a review of the literature on the psychology of music. Psychology of music is a complex field of research in which quantitative and qualitative methods have been employed involving participants ranging from novices to expert performers. The cognitive research has been analyzed to propose a pedagogical approach to the development of processes rather than products that focus on an expert’s use of improvisation. (...) The intention is to delineate a reflective approach that goes beyond the mere instruction of some current practices of teaching improvisation in jazz pedagogy. The review highlights that improvisation is a complex, multidimensional act that involves creative and performance behaviors in real-time in addition to processes such as sensory and perceptual encoding, motor control, performance monitoring, and memory storage and recall. Educational applications for the following processes are outlined: anticipation, use of repertoire, emotive communication, feedback, and flow. These characteristics are discussed in relation to the design of a pedagogical approach to musical improvisation based on reflection and metacognition development. (shrink)

Maintenance of proper health and prevention of diseases of civilization are now significant public health problems. Nutrition is an important factor in the development of youth, as well as the current and future state of health. The aim of the study was to show the benefits of the application of cluster analysis to assess the dietary habits of high school students. The survey was carried out on 1,631 eighteen-year-old students in seven randomly selected secondary schools in Bialystok using a self-prepared (...) anonymous questionnaire. An evaluation of the time of day meals were eaten and the number of meals consumed was made for the surveyed students. The cluster analysis allowed distinguishing characteristic structures of dietary habits in the observed population. Four clusters were identified, which were characterized by relative internal homogeneity and substantial variation in terms of the number of meals during the day and the time of their consumption. The most important characteristics of cluster 1 were cumulated food ration in 2 or 3 meals and long intervals between meals. Cluster 2 was characterized by eating the recommended number of 4 or 5 meals a day. In the 3rd cluster, students ate 3 meals a day with large intervals between them, and in the 4th they had four meals a day while maintaining proper intervals between them. In all clusters dietary mistakes occurred, but most of them were related to clusters 1 and 3. Cluster analysis allowed for the identification of major flaws in nutrition, which may include irregular eating and skipping meals, and indicated possible connections between eating patterns and disturbances of body weight in the examined population. We explore an application of homological algebra to set theoretic objects by developing a cohomology theory for Hausdorff gaps. This leads to a natural equivalence notion for gaps about which we answer questions by constructing many simultaneous gaps. The first result is proved in ZFC while new combinatorial hypotheses generalizing ♣ are introduced to prove the second result. The cohomology theory is introduced with enough generality to be applicable to other questions in set theory. Additionally, the notion of an incollapsible (...) gap is introduced and the existence of such a gap is shown to be independent of ZFC. (shrink)

We give some applications of mixed support forcing iterations to the topics of disjoint stationary sequences and internally approachable sets. In the first half of the paper we study the combinatorial content of the idea of a disjoint stationary sequence, including its relation to adding clubs by forcing, the approachability ideal, canonical structure, the proper forcing axiom, and properties related to internal approachability. In the second half of the paper we present some consistency results related to these ideas. We construct (...) a model in which a disjoint stationary sequence exists at the successor of an arbitrary regular uncountable cardinal. Suppose we are asked to draw up a list of things we take to exist. Certain items seem unproblematic choices, while others (such as God) are likely to spark controversy. The book sets the grand theological theme aside and asks a less dramatic question: should mathematical objects (numbers, sets, functions, etc.) be on this list? In philosophical jargon this is the ‘ontological’ question for mathematics; it asks whether we ought to include mathematicalia in our ontology. A new approach to landscape ecology involves the application of the eco-field hypothesis and the General Theory of Resources. In this study, we describe the putative eco-field of bark beetles as a spatial configuration with a specific meaning-carrier for every organism-resource interaction. Bark beetles are insects with key roles in matter and energy cycles in coniferous forests, which cause significant changes to forestry landscapes when outbreaks occur. Bark beetles are guided towards host trees by the recognition of semiotic signals using (...) a specific eco-field. These signals mainly comprise a group of scents, which are called the odourtope. Their interactions with other organisms occur by sharing relevant information from the eco-field networks in the forest ecosystem. The eco-field networks modulate the expansion of the realized semiotic niche of the bark beetle towards the potential semiotic niche. Moreover, the niche construction process can be initiated by interchanging signals among species living in the same place, where these signals allow the exploitation of the required resources. If different organisms are interdependent on signals in eco-field networks, then this process may result in the establishment of mutualistic relationships. This is an example of how evolutionary processes are initiated by the recognition of signals in a network of eco-fields. (shrink)

Machine learning algorithms may radically improve our ability to diagnose and treat disease. For moral, legal, and scientific reasons, it is essential that doctors and patients be able to understand and explain the predictions of these models. Scalable, customisable, and ethical solutions can be achieved by working together with relevant stakeholders, including patients, data scientists, and policy makers.

This text aims to convey some of the interest and charm of modal logic, and to put a reader new to the subject in a position to have an informed opinion as to its applicability to each of several areas of philosophical concern in which the merits of a modal approach' have been controversial. he main focus, for these purposes, is on normal modal logics, though some attention is given to the non-normal side of the picture.

Social work supervision is a forum in which social workers and supervisors have the opportunity to explore ethics within their practice. It is also where social workers experience ongoing learning and development regarding ethics. This article is a selective review of social work supervision and ethics literature. Key areas identified are: 1) the role of supervision in the monitoring and development of ethical social work practice; 2) supervisors’ knowledge and application of codes of ethics, ethical theories, principles and ethical decision-making (...) models; 3) ethical supervisory relationships, processes and practices. A lack of research evidence was identified regarding the application of ethics within supervision and in relation to the interactional process of ethical exploration, inquiry and dialogue within sessions. Considering this lack of evidence, we propose that ethics be integrated throughout the supervision process through the development of care ethics culture, ethical sensitivity and ethical dialogue. The article concludes with recommendations about bringing ethics to the forefront in supervision. Recommendations are also made concerning further research pertaining to the monitoring and development of ethical social work practice through supervision, supervisors’ ethics knowledge, the interactional process of ethical supervisory practice with supervisees and the influence of organisational culture upon ethics and supervision. Abstract.Klaus Günther's (1988) book developed the distinction between two kinds of discourse, the foundation discourse and the application discourse. In an article (Günther 1989a) following the publication of the book, he used this basic distinction as the starting point for a criticism of the special case‐thesis as defended by Robert Alexy (1978, 32ff., 263ff.; Alexy 1989, 16ff., 213ff.). The aim of this article is to criticize this criticism in its turn and to show that the special case‐thesis does not need (...) the reformulation which Günther proposes. It should be clear from the outset that this concerns an internal discussion in the field of discourse theory; certain discourse‐theoretical premises are taken for granted. In order to understand Giinther's criticism I will first give a brief account of the distinction he has made. (shrink)

Existing ethics guidelines, influential literature and policies on ethical research generally focus on real-time data collection from humans. They enforce individual rights and liberties, thereby lowering need for aggregate protections. Although dependable, emerging public health research paradigms like research using public health data raise new challenges to their application. Unlike traditional research, RUPD is population-based, aligned to public health activities, and often reliant on pre-collected longitudinal data. These characteristics, when considered in relation to the generally lower protective ethico-legal frameworks of (...) the Global South, including Africa, highlight ethical gaps. Health and demographic surveillance systems are examples of public health programs that accommodate RUPD in these contexts. We set out to explore the perspectives of professionals with a working knowledge of these systems to determine practical ways of appropriating the foundational principles of health research to advance the ever growing opportunities in RUPD. We present their perspectives and in relation to the literature and our ethical analysis, make context relevant recommendations. We further argue for the development of a framework founded on the discussions and recommendations as a minimum base for achieving optimal ethics for optimal RUPD in the Global South. (shrink)

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. Given UBI’s performance in poor and rural areas of India and Namibia and its transformative effects on livelihoods, one can foresee a potential for UBI supporting refugees and Internally Displaced Persons rebuild their lives in their country of origin. Furthermore, given UBI’s egalitarian rationale stemming from the idea of a more just society with a minimum level of economic security to all, UBI can be considered a key element of a state’s welfare system, the relevance of which cannot be overstated (...) for countries emerging from conflict. Additionally, the field of international aid has as of recently, for efficiency considerations, started questioning its policies focused on in-kind aid, vouchers, prescribed spending in favor of cash transfers. To test UBI’s potential in post-conflict scenarios, we propose to examine its applicability in Syria, source of today’s largest refugee population. (shrink)

Discussions of the applicability of mathematics in the natural sciences have been flawed by failure to realize that there are multiple senses in which mathematics can be ‘applied’ and, correspondingly, multiple problems that stem from the applicability of mathematics. I discuss semantic, metaphysical, descriptive, and and epistemological problems of mathematical applicability, dwelling on Frege's contribution to the solution of the first two types. As for the remaining problems, I discuss the contributions of Hartry Field and Eugene Wigner. Finally, I argue (...) that there are epistemological problems concerning the applicability of mathematics that nobody in the philosophical community has yet confronted, though the problems are well known to physicists.
