This article is the result of an empirical research project analyzing the decision behaviour of Austrian managers in ethical dilemma situations. While neoclassical economic theory would suggest a pure economic rational basis for management decisions, the empirical study conducted by the authors put other concepts to a test, thereby analyzing their importance for managerial decision making: specific notions of fairness, reciprocal altruism, and commitment. After reviewing some of the theoretical literature dealing with such notions, the article shows the (...) results of an online survey working with scenarios depicting ethical dilemma situations. By judging such scenarios the respondents showed their preference for the named concepts, though with different degrees of confirmation. The results (with all limitations of an online survey in mind) support the theoretical work on the named concepts: Fairness elements (including Rawlsian principles of justice and an understanding of fairness as conceived by a reference transaction) play a major part in management decisions in ethical dilemma situations. Also, commitment as a behaviour that sticks to rules even if personal welfare is negatively touched, and reciprocal altruism as a cooperative behaviour that expects a reciprocal beneficial action from other persons have been concepts used by Austrian managers when analyzing ethical dilemmas. The article also tries to put the results into a comparative perspective by taking into account other studies on ethical decision factors conducted with, e.g. medical doctors or journalists, and by discussing intercultural implications of business ethics. We use a sequential voluntary contribution game to compare the relative impact of a first-mover’s non-binding announcement versus binding commitment on cooperation. We find that a non-binding announcement and a binding commitment increase individual contributions to a similar extent. Since announced contributions systematically exceed commitments, in sessions with a non-binding announcement, second-movers tend to contribute more to the group activity than in sessions with a binding commitment. Yet, second-movers appear to be more motivated towards achieving a social optimum when the (...) first-mover uses commitment. We also find that a non-binding announcement has a higher impact on individual propensity to cooperate than the ex post contribution of the first-mover. However, the failure to make announced contributions decreases cooperation even though the first-mover is reassigned in every period. (shrink)

Based on the conflict-of-values theory, this study examines the influences of Machiavellianism and ethical values on anxiety in college students when they face moral dilemmas. Questionnaires on the Chinese equivalent of Machiavellianism, moral identity, and anxiety were completed by 115 Chinese college students. The results suggest that Machiavellianism and ethical values influence anxiety, and the interaction between ethical values and Machiavellianism is significant—among individuals with high ethical values, those with high levels of Machiavellianism exhibit markedly higher levels of anxiety than (...) those with low levels of Machiavellianism. However, among individuals with low ethical values, there is no difference in anxiety between those with low or high levels of Machiavellianism. This research, depicting complex relationships among anxiety, Machiavellianism, and ethical values, suggests that leading people to do good deeds not only requires high ethical values but also necessitates the resistance to negative values such as Machiavellianism. The standard way to test alternative descriptive theories of moral judgment is by asking subjects to evaluate (amongst others) sacrificial dilemmas, where acting classifies as a utilitarian moral judgment and not acting classifies as a deontological moral judgment. Previous research uncovered many situational factors that alter subject’s moral judgments without affecting which type of action utilitarianism or deontology would recommend. This literature review provides a systematic analysis of the experimental literature on the influence of situational factors on moral judgments in (...) sacrificial dilemmas. It analyses 53 articles in detail and reports mean effect sizes, as well as operationalizations, for 36 situational factors that significantly influence moral judgment. Moreover, the review discusses how the impact of situational factors relates to a dual process theory of moral judgment. It supports the view that utilitarian judgments are driven by controlled cognitive processes and shows that the drivers of deontological judgments depend on valence. (shrink)

Being Indigenous and operating in an institution such as a university places us in a complex position. The premise of decolonizing history, literature, curriculum, and thought in general creates a tenuous space for Indigenous and non-Indigenous peoples to confront a shared colonial condition. What does decolonization mean for Indigenous peoples? Is decolonization an implied promise to squash the tropes of coloniality? Or is it a way for non-Indigenous people to create another paradigm or site for their own resistance or transgression (...) of thinking? What are the roles of Indigenous and non-Indigenous peoples in this space of educational potential, this curriculum called decolonization? This paper examines the concept of information in situation semantics. For this purpose the most fundamental principles of situation semantics are classified into three groups: principles of the more fundamental kind, principles related to regularity, and principles governing incremental information. Fodor’s well-known criticisms of situation semanticists’ concepts of information target the first group. Interestingly, situation semanticists have been anxious to articulate either the principles of the second group or the principles of the third group in order to meet these criticisms. (...) Based on these observations, I will launch a dilemma for situation semanticists. Either they fail to handle information about individuals or they fail to present any acceptable account of the laws of nature. When researching with or about families in home-based research, there are numerous unexpected ethical issues that can emerge, particularly in qualitative research. This paper is based on reflective accounts of four homed-based research projects, two in the UK and two Australia, which examined ethical dilemmas identified when engaged in home-based research with young children. Using a synergy of ecocultural theory and Foucauldian ideas of Heterotopia as theoretical conceptualisations, the authors employed reflective lenses to guide their approach, and examine dilemmas and (...) complexities when conducting research in the home. We argue that, to address ethical dilemmas, researchers need to problematise and reflect upon the nature of respectful approaches and the ethical implications of their behaviours. We conclude that, although ethical codes are valuable when researching families at home, researchers should plan for and forefront their methodological approaches in ways that are family-centred, whilst also framed by practices that are ethical, respectful and reflective to the situated contexts of family’s ecologies and heterotopias. A strong tradition in philosophy denies the possibility of moral dilemmas. Recently, several philosophers reversed this tradition. In this dissertation, I clarify some fundamental issues in this debate, argue for the possibility of moral dilemmas, and determine some implications of this possibility. ;In chapter I, I define moral dilemmas roughly as situations where an agent morally ought to adopt each of two alternatives but cannot adopt both. Moral dilemmas are resolvable if and only if one of the moral oughts (...) overrides the other. ;In chapter II, I criticize several opponents of moral dilemmas, including utilitarians, Kant, Aquinas, and Ross. My main criticism is that no opponent of moral dilemmas can adequately justify moral residue . ;Chapters III and IV concern the two main arguments against the possibility of moral dilemmas. First, the argument for 'ought' implies 'can' runs as follows. If the agent cannot adopt both, then it is not the case that the agent ought to adopt both. But the agent ought to adopt both, since the agent ought to adopt each . Thus, the defining judgements of a moral dilemma seem to imply a contradiction. In response, I argue that the relation between 'ought' and 'can' is not a logical implication but a conversational implicature. ;Chapter IV concerns the argument from 'ought' implies 'permitted': If the agent ought to adopt one alternative, then the agent is permitted to adopt that alternative, which means that it is not the case that the agent ought not to adopt that alternative. But the agent ought not to adopt that alternative, since the agent ought to adopt the other alternative and cannot adopt both. I respond that 'ought' does not logically imply but conversationally implicates 'permitted'. ;In chapter V, I argue that, despite recent claims, both moral realism and anti-realism are compatible with the possibility of moral dilemmas. Thus, there are several reasons to accept and no reasons to deny the possibility of moral dilemmas. (shrink)

This is an opinionated guide to the literature on epistemic dilemmas. It discusses seven kinds of situations where epistemic dilemmas appear to arise; dilemmic, dilemmish, and non-dilemmic takes on them; and objections to dilemmic views along with dilemmist’s replies to them.

The essays in this volume illuminate a central topic in ethical theory: moral dilemmas. Some contemporary philosophers dispute the traditional view that a true moral dilemma -- a situation in which a person has two irreconcilable moral duties -- cannot exist. This collection provides the historical background to the ongoing debate with selections from Kant, Mill, Bradley, and Ross. This article analyses the dynamics of the use of institutional categories in institutional encounters. The focus is on documenting how categories are invoked to index what is relevant to situated knowing in interactional sequences where there is a need to bridge the gap between action and expectation. This general problem has been studied in the context of interactions between job applicants and vocational guidance officers in a public employment agency. Institutional categories are inference-rich, and they work as flexible tools that (...) allow participants to recontextualize and negotiate the issues at stake. In this sense, categories serve as constitutive tools that can be crafted to fit into a broad range of circumstances. However, in order to produce a relevant account, participants’ ways of reasoning need to fit into the institutionally specific traditions of argumentation and the practical outcomes which need to be produced. In this sense, the focus on accounting practices is illuminating when attempting to understand the situated knowing that maintains institutional practices. (shrink)

False dilemma is a specific form of reasoning : despite the fact that it is based on a deductively valid argument form, it is rightly depicted as fallacy. A systematic exposition of false dilemma is missing in theoretical approaches to fallacies. This article formulates six criteria for a well-grounded exposition of a fallacy, suggesting also a systematic exposition of false dilemma. These criteria can be used to both explain, and categorise, the various false dilemma fallacies. The (...) article introduces distinction between four types of false dilemma : False quandary, Defeasible sound quandary, False obstruction and Defeasible sound obstruction. The types of criticism appropriate for each variant of false dilemma are suggested. Being able to discover false dilemma in situations when it is important to make good and free choices is a significant dimension of critical thinking. It may liberate us from accepting the consequences that necessarily follow from prearranged alternatives, when these are not the only alternatives possible. It may also liberate us from refraining from actions on the basis of obstructive disjunctive statements. In that respect, the faculty of critical thinking directed at uncovering reasoning based on false dilemma may also initiate the discovery of new alternatives, or discover the ways of unifying seemingly opposing alternatives. Thus, a well-developed ability to understand the tricky argumentative moves of false dilemma may be a good step towards initiating some features of creative thinking. (shrink)

In this paper, I will examine the notion of an epistemic dilemma, its characterizations in the literature, and the different intuitions prompted by it. I will illustrate that the notion of an epistemic dilemma is expected to capture various phenomena that are not easily unified with one concept: while some aspects of these phenomena are more about the agent in a certain situation, other aspects seem to be more about the situation as such. As a consequence, incompatible intuitions (...) emerge concerning the transparency of epistemic dilemmas as well as regarding the role that doxastic suspension plays in resolving cases of epistemic dilemma. I suggest to distinguish between the mental state of agents who find themselves in an epistemic dilemma and the normative situation that gives rise to a dilemma. I will refer to the agent’s mental state as epistemic conflict and will reserve the term epistemic dilemma for evidential situations in which epistemic principles either recommend incompatible doxastic responses or render all options impermissible. The concept of epistemic conflict not only captures the mental state of agents who find themselves in a genuine epistemic dilemma but also applies to agents who face difficult epistemic choices that they cannot resolve without substantial cognitive (and often pragmatic) effort, for example, via doxastic suspension. A major contribution to the social scientific understanding of how people make sense of their lives, Ideological Dilemmas presents an illuminating new approach to the study of everyday thinking. Contradictory strands abound within both ideology and common sense. In contrast to many modern theorists, the authors see these dilemmas of ideology as enabling, rather than inhibiting: thinking about them helps people to think meaningfully about themselves and the world. The dilemmas within ideology and their effects on thinking are explored through (...) the analysis of what people say in specific key situations: education, medical care, race and gender. The authors identify common ideological themes running through the common-sense discourses they analyse. They highlight the tensions between themes of equality and authority, freedom and necessity, individuality and collectivity. Time and again, the contradictions between these ideological themes crop up as respondents argue and puzzle over their social worlds. Written with refreshing clarity, the discussion cuts across the boundary which often separates sociology from social psychology. Telling the truth is one of the most respected virtues in medical history and one of the most emphasized in the code of medical ethics. Health care providers are frequently confronted with the dilemma as to whether or not to tell the truth. This dilemma deepens when both choices are critically vicious: The choice is no longer between “right and right” or “right and wrong,” it is between “wrong and wrong.” In the case presented and discussed in this (...) paper, a research team in Saudi Arabia unintentionally uncovered information regarding misattributed paternity. In such a situation and in the context of a tribal cultural system, what should the team do with this information? This case analysis demonstrates the joint application of ethical resources originating from within and outside the Saudi Arabian context. The article analyses the case based on the moral problems involved, relevant medical application, and the impact of such information in the Saudi tribal and Islamic domains. The most pertinent relevant values and secular debates on similar matters are discussed. Finally, the article aims to provide an Islamic dimension of family, fatherhood, and adultery. (shrink)

The author defines moral dilemmas as situations where there is a moral requirement for an agent to adopt each of two alternatives, And the agent cannot adopt both, But neither moral requirement overrides the other. The author then argues that moral dilemmas are possible because conflicting moral requirements can be either symmetrical or incomparable in a way that is limited enough to be plausible but still strong enough to yield moral dilemmas.

I distinguish two different arguments against cognitivism in Bernard Williams’ writings on moral dilemmas. The first turns on there being a truth of the matter about what we ought to do in moral a dilemma. That argument can be met by appealing to our epistemic shortcomings and to pro tanto obligations. However, those responses make no headway with the second argument which concerns the rationality of the moral regret that we feel in dilemma situations. I show how (...) the rationality of moral regret can be explained on an ‘independent desire’ model. And I show how Williams’ second argument only appears to have force because of a certain faulty way of conceiving of the issue over cognitivism. But Williams’ argument rightly alerts us to the rational role of desire in our moral thought. (shrink)

In this paper we distinguish between epistemic dilemmas, epistemic quasi-dilemmas, and quasi epistemic dilemmas. Our starting point is the commonsense position that S faces a genuine dilemma only when S must take one of two paths and both are bad. It’s the “must” that we think is key. Moral dilemmas arise because there are cases where S must perform A and S must perform B—where ‘must’ implies a moral duty—but S cannot do both. In such a situation, S is (...) doomed to violate a moral obligation. Analogously, S face’s a genuine epistemic dilemma only if she has an epistemic duty to believe that p and at the same time an epistemic duty to not believe that p (either because she has a duty to believe ~p or a duty to suspend judgment). We argue that such cases never arise because there is no epistemic duty to adopt a particular doxastic attitude towards any particular proposition (ever). Hence, there are no epistemic dilemmas. Nevertheless, one might suppose there are situations in which one’s evidence pulls in different directions without determining a uniquely justified doxastic attitude. Such epistemic quasi-dilemmas aren’t full-fledged dilemmas, but they are arguably close enough to pose a genuine problem for the believer. But we argue that there are no genuine epistemic quasi-dilemmas either: They are all resolvable in principle. Fans of dissonance will not be totally disappointed, however, since we argue that there may well be quasi-epistemic dilemmas. These are genuinely unwinnable situations in which one’s moral or pragmatic obligations to do epistemically-relevant things make incompatible demands. (shrink)

Background Recently, palliative care is increasingly important, with an emphasis on the process of dying with dignity. However, nurses who care for such patients experience the associated ethical dilemmas. Objective To explore the meaning of nurses’ experiences in dealing with ethical dilemmas in relation to palliative sedation. Research design A qualitative research design was employed with a thematic analysis approach. Participants and research context Using purposive sampling, 15 nurses, working at palliative care units for at least 1 year, were recruited (...) as participants. Data were collected using unstructured in-depth interviews, and data collection and analysis was performed simultaneously. Ethical considerations Ethical approval was obtained from the authors’ institutional review board. All participants provided informed consent. For the face-to-face interview, the South Korean standard COVID-19 quarantine guidelines, such as mandatory masking and social distancing, were followed. Results Dilemmas raised by patients, were related to concerns about appropriate drug dose; dilemmas raised by nurses, were related to passive care, sense of guilt for failure to predict death, and colleague’s disrespectful attitudes toward patients; dilemmas from patients’ families were related to demands for palliative sedation and reversal of those demands. Care actions to deal with ethical dilemmas comprised evidence-based care, person-centered thinking, reflecting on the death situation, compassion, providing explanation and help to family members. Conclusion Nurses’ ethical dilemmas were pre-dominantly influenced by themselves, rather than by the patients or their families, especially if they felt they could not do their best for patients. The core concept of care actions to deal with the ethical dilemmas, was person-centered care and compassion. Then, how patients and their family members perceive person-centered care and compassion, should be further explored to improve palliative sedation. (shrink)

The demands of morality can seem straightforward. Be kind to others. Do not lie. Do not murder. But moral life is not so simple. We are often confronted with difficult situations in which someone is going to get hurt no matter what we do, in which we cannot meet all of our obligations, in which loyalties come into conflict, in which we cannot help everyone who needs it, or in which we must compromise on important values. It is natural (...) to describe such situations as moral dilemmas. This chapter is about the psychology of how we represent, process, and make decisions about what to do when moral life is difficult in this way. Our first aim is to provide some conceptual clarity on what exactly turns a choice situation into a moral dilemma. Here, we propose a normative account of moral dilemmas in terms of moral appropriate feelings of conflict in response to strongly conflicting reasons. Our second aim is to critically survey existing psychological work, providing an overview of some important findings, while raising questions for future research. (shrink)

This paper explores the possibility of moral conflict in Kant’s ethics. An analysis of the only explicit discussion of the topic in his published writings confirms that there is no room for genuine moral dilemmas. Conflict is limited to nonconclusive ‘grounds’ of obligation. They arise only in the sphere of ethical duty and, though defeasible, ought to be construed as the result of valid arguments an agent correctly judges to apply in the situation at hand. While it is difficult to (...) determine in theory what makes some of them stronger than others, these ‘grounds’ can account for practical residue in conflict cases and for a plausible form of agent regret. Moral dilemmas set a challenge for ethical theory. They are situations where agents seem to be under an obligation both to do, and to refrain from doing, a specific act. Are such situations possible? What is their exact nature? These are the questions that _Moral Dilemmas_ tries to answer. The book argues that moral theories should not allow for the possibility of irresolvable dilemmas, for situations in which no right answer exists. To this end, arguments seeking to (...) prove the existence of irresolvable dilemmas, especially the argument from the incommensurability of values, are discussed at length and refuted. The book shows that though on the normative level dilemmas are resolved, they typically involve a high moral cost for which there is no adequate compensation. This moral cost is the source of the regret and pain suffered by agents in moral dilemmas. Thus, moral dilemmas do not point to any inconsistency in our moral reasoning or theory, but to a problematic aspect of the human condition; at times (probably less often than is usually believed), human beings are justified, and even required, to dirty their hands by behaving in ways that in ordinary situations would be strictly forbidden and condemned. In spite of the growing interest in nursing ethics, few studies have focused on ethical dilemmas experienced by nurses working with clinical studies as ‘research nurses’. The aim of the present study was to describe and explore ethical dilemmas that Swedish research nurses experience in their day-to-day work. In a qualitative study a purposeful sample of six research nurses from five wards of differing disciplines in four Swedish hospitals was interviewed. The analysis displayed several examples of ethical dilemmas, primarily tensions (...) between the nurses’ obligations to the study and to the patients involved. A guiding moral principle for the nurses was patient-centeredness, where the interest of research must not override the interest of the patient. In situations where tensions between research and patient interests occurred, and doctors and nurses disagreed upon the judgement, the nurses sometimes chose to follow the doctors’ advice, and thus acted against their own moral judgment. Such situations seemed to create feelings of moral distress among the nurses. They described their profession as being ‘invisible’ and as lacking opportunities for ethical competence building. The conclusion is that research nurses frequently experience severe and difficult ethical dilemmas in their daily work. They need to be acknowledged as a particular profession in the health care organisation and encouraged to develop their specific ethical competence. (shrink)

Situation theorists such as John Barwise, John Etchemendy, John Perry and François Recanati have put forward the hypothesis that linguistic representations are situated in the sense that they are true or false only relative to partial situations which are not explicitly represented as such. Following Recanati's lead, I explore this hypothesis with respect to mental representations. First, I introduce the notion of unarticulated constituent, due to John Perry. I suggest that the question of whether there really are such constituents (...) should divide in two issues, one concerning language and the other concerning thought. Then I formulate a dilemma that any friend of cognitive unarticulated constituents must face: alleged unarticulated constituents seem to be either articulated or non-constituents after all. The dilemma is strengthened by the fact that unarticulated constituents cannot be inferentially relevant. In §4, three constraints on entertaining situated representations are spelled out. First, although the situation within which one is immersed is not represented as such, there must be cognitive facts that make immersion possible, and explain why one is implicitly related to a particular situation as opposed to another. Second, the move from a given representation to one which articulates the situation requires the capacity to contrast the latter with others in the same range. Third, I suggest that conceptual representations differ from non-conceptual ones in the permanent possibility of detachment that they allow. I then illustrate how these constraints work in three sorts of cases. In the first, thoughts like It's raining and It's over are implicitly related to their situations via some practical capacity of keeping track of particular places or times. In the second sort of cases, the relevant situations are not given, but stipulated, like in In Constance, it's raining. Cases of the third sort are those in which an unarticulated constituent is relevant to a whole system of representations, for instance the perceptual system. In the last section, I use the notion of ad hoc representation to defend the cognitive application of situation semantics against an important objection. (shrink)

A moral dilemma is a situation where an agent’s obligations conflict. Debate in this area focuses on the question of whether genuine moral dilemmas exist. This question involves considering not only the nature and significance of dilemmas, but also the connections between dilemmas, the logic of obligation and moral emotions.

Conceptual limitations restrict our epistemic options. One cannot believe, disbelieve, or doubt what one cannot grasp. I show how, even granting an epistemic ought-implies-can principle, such restrictions might lead to epistemic dilemmas: situations where each of one’s options violates some epistemic requirement. An alternative reaction would be to take epistemic norms to be sensitive to one’s options in ways that ensure dilemmas never arise. I propose, on behalf of the dilemmist, that we treat puzzlement as a kind of epistemic (...) residue, roughly analogous with guilt, appropriate only when one has violated an epistemic requirement. Sometimes, in bumping up against the limits of one’s concepts, it is appropriate to be puzzled no matter what one believes. Puzzlement can thus play the same role in an epistemic dilemmist’s theory that guilt plays in the theories of many moral dilemmists. (shrink)

In the last forty years there has been a resurgence of interest in moral dilemmas—situations in which through no fault of a person’s own, he or she is morally required to do one thing, required to do another, but cannot do both. Some prominent figures have argued that such things could be. Opponents have marshaled several anti-dilemma arguments in response. For the most part, this debate has centered on issues in metaethics. Those metaethical questions are interesting, and resolving (...) them could (in principle, at least) settle the debate about moral dilemmas. However, this paper will show that this exclusive focus on metaethics has been a mistake. Both dilemma advocates and dilemma opponents have failed to recognize that the debate could also be settled by answering an important question in normative ethics: is it possible for there to be an absolute prohibition on allowing something to happen? If the answer is yes, then dilemmas are possible, and if the answer is no, then they are not. Furthermore, it will be argued that it is our instincts about this normative issue that truly shape our views on the dilemmas debate. After sorting out these issues, the paper argues that as yet there is no good reason to rule out the theory of dilemma advocates, and thus that the widespread rejection of moral dilemmas is not as well-founded as is often assumed. This study explores how therapists deal with ethical dilemmas in psychotherapy with older adults. Semi-structured interviews were conducted with 14 therapists and analyzed using grounded theory methodology. Findings clustered around three themes: (i) respecting autonomy when interacting with family of vulnerable and dependent older patients; (ii) prioritizing respecting autonomy in risk situations and in suspected financial abuse without impaired judgment; and (iii) prioritizing protecting the patient in risk situations of patients with dementia and of suspected physical abuse or (...) neglect. These findings highlight several important issues regarding the management of ethical dilemmas in psychotherapy with vulnerable and dependent older adults. (shrink)

By looking at the situations faced by the protagonists of two classic plays , I try to shed light on what it means to face an insoluble moral dilemma, what it might mean to deal with it, and how the dilemma can reveal certain crucial information about the decision-maker to us readers-spectators, to other characters in the play who witness, or are implicated by, the incident, as well as, and perhaps most importantly, to the protagonist himself. In (...) so doing, I distinguish the above dilemmas from moral-prudential dilemmas and from apparent dilemmas constituted by the mere lack of epistemological access. Indeed, I generally resist the various reductive approaches characteristic of much analytic moral philosophy, and challenge the notion of a uniquely right answer to which all rational moral agents can be held accountable. : Autonomous driving systems promise important changes for future of transport, primarily through the reduction of road accidents. However, ethical concerns, in particular, two central issues, will be key to their successful development. First, situations of risk that involve inevitable harm to passengers and/or bystanders, in which some individuals must be sacrificed for the benefit of others. Secondly, and identification responsible parties and liabilities in the event of an accident. Our work addresses the first of these ethical problems. We (...) are interested in investigating how humans respond to critical situations and what reactions they consider to be morally right or at least preferable to others. Our experimental approach relies on the trolley dilemma and knowledge gained from previous research on this. More specifically, our main purpose was to test the difference between what human drivers actually decide to do in an emergency situations whilst driving a realistic simulator and the moral choices they make when they pause to consider what they would do in the same situation and to better understand why these choices may differs. The objective of this survey was to assess the extent to which nurses encounter and identify dilemma-generating situations in the light of the publication and circulation of the Israeli code of ethics for nurses in 1994. The results are being used as a basis for a programme aimed at promoting nurses' decision-making skills in coping with ethical dilemmas. In this era of major advances in medicine, the nurse's role as the protector of patient rights may bring about conflicts (...) with physicians' orders, with institutional policies, or with patients' families. Nurses will then become confronted with ethical and moral dilemmas. A nationwide survey was carried out to identify and describe the ethical conflicts with which nurses in Israel are confronted in the course of their work. A third of the enumerated dilemmas were encountered by more than 50% of the nurses. The major determinant influencing encounters with dilemmas, as perceived by the participating nurses, was their work setting, namely, the hospital versus the community. It was shown that nurses seek support mainly among their peers, they are barely familiar with the Israeli Code, and they consider their own families as the predominant factor in shaping their ethical attitudes. Ethical dilemmas are part of medicine, but the type of challenges, the frequency of their occurrence and the nuances in the difficulties have not been systematically studied in low-income settings. The objective of this paper was to map out the ethical dilemmas from the perspective of Ethiopian physicians working in public hospitals. A national survey of physicians from 49 public hospitals using stratified, multi-stage sampling was conducted in six of the 11 regions in Ethiopia. Descriptive statistics were used and the (...) responses to the open-ended question “If you have experienced any ethical dilemma, can you please describe a dilemma you have encountered in your own words?” were analyzed using a template analysis process. A total of 587 physicians responded, and 565 met the inclusion criteria. Twelve of 24 specified ethically challenging situations were reported to be experienced often or sometimes by more than 50% of the physicians. The most frequently reported challenge concerned resource distribution: 93% agreed that they often or sometimes had to make difficult choices due to resource limitation, and 83% often or sometimes encountered difficulties because patients were unable to pay for the preferred course of treatment. Other frequently reported difficulties were doubts about doing good or harming the patient, relating to conflicting views, concern for family welfare, disclosure issues and caring for patients not able to consent. Few reported dilemmas related to end-of-life issues. The 200 responses to the open-ended question mirrored the quantitative results. Ethiopian physicians report ethical challenges related more to bedside rationing and fairness concerns than futility discussions and conflicts about autonomy as described in studies from high-income countries. In addition to the high report of experienced challenges, gravity of the dilemmas that are present in their narratives are striking. Recognition of the everyday experiences of physicians in low-income settings should prompt the development of ethics teaching and support mechanisms, discussion of ethical guidelines as well as increase our focus on how to improve the grave resource scarcity they describe. Moral dilemmas – situations in which an agent has a moral requirement to do each of two acts but cannot do both – seem to suggest some kind of inconsistency. I argue that the inconsistency felt intuitively is actually a logical inconsistency, and then go on to show that we can neither deny the existence of moral dilemmas nor give up the deontic principles involved in the deduction of a contradiction, as both our moral judgements and the deontic principles (...) depend on intuitions that form the basis of our morality. Rather than rejecting our intuitions and thus undermining morality, I suggest regarding moral dilemmas as situations in which a contradiction is not only false, but at the same time true. From a philosophical standpoint, the work presented here is based on van Fraassen [26]. The bulk of that paper is organized around a series of arguments against the assumption, built into standard deontic logic, that moral dilemmas are impossible; and van Fraassen only briefly sketches his alternative approach. His paper ends with the conclusion that “the problem of possibly irresolvable moral conflict reveals serious flaws in the philosophical and semantic foundations of ‘orthodox’ deontic logic, but also suggests a rich set (...) of new problems and methods for such logic.” My goal has been to suggest that some of these methods might be found in current research on nonmonotonic reasoning, and that some of the problems may have been confronted there as well.I have shown that nonmonotonic logics provide a natural framework for reasoning about moral dilemmas, perhaps even more useful than the ordinary modal framework, and that the issues surrounding the treatment of exceptional information within these logics run parallel to some of the problems posed by conditional oughts. However, there is also another way in which deontic logic might benefit from a connection to nonmonotonic reasoning. A familiar criticism among ethicists of work in deontic logic is that it is too abstract, and too far removed from the kind of problems confronted by real agents in moral deliberation. It must be said that similar criticisms of abstraction and irrelevance are often lodged against work in nonmonotonic reasoning by more practically minded researchers in artificial intelligence; but here, at least, the criticisms are taken seriously. Nonmonotonic logic aims at a qualitative account of commonsense reasoning, which can be used to relate planning and action to defeasible goals and beliefs; and at least some of the theories developed in this area have been tested in realistic situations. By linking the subject of deontic logic to this research, it may be possible also to relate the idealized study of moral reasoning typical of the field to a more robust treatment of practical deliberation. In this paper I argue that a phenomenological account of moral sense-bestowal can provide valuable insight into the possibility of moral dilemmas. I propose an account of moral sense-bestowal that is grounded in the phenomenology of expression that Maurice Merleau-Ponty developed throughout the course of his philosophical work, and most explicitly in the period immediately following the publication of Phenomenology of Perception. Based on this Merleau-Pontian account of moral sense-bestowal, I defend the view that there are genuine moral dilemmas, i.e., (...) that we can be faced with situations of conflicting oughts that we cannot resolve without moral remainder. From classical antiquity to contemporary times, challenging situations of dilemmatic or paradoxical nature continue to fascinate both scholars and the casual reader. Although Western literature provides a fruitful source of philosophical discussion on the circumstances under which a morally competent agent faces incompatible moral requirements, Sinology has rarely accepted the idea of moral dilemmas in Chinese philosophy in general and Confucianism in particular. The present paper explores moral and morally motivated dilemmas in Liu Xiang’s 劉向 Lienü Zhuan 列女傳 and (...) the philosophical strategies employed for their resolution within the framework of the Confucian tradition, emphasizing similarities with Western traditions such as Greek tragedy or Thomistic philosophy. This chapter focuses on one of the common fallacies in Western philosophy, 'false dilemma (FD)'. According to Andrea A. Lunsford, John J. Ruskiewicz, and Keith Walters, a FD tends to “reduce a complicated issue to excessively simple terms” or, when intentionally created, tends to “obscure legitimate alternatives”. FD reflects incorrect thinking because it presents a problem or issue as having only two possible solutions when in fact there are more. Liam Dempsey noted that shows such as The Daily Show (...) and The Colbert Report often employed FD in order to highlight the “theatrics” that are found in political events or the use of FD by politicians. Politics aside, an FD exists anytime an extreme dichotomy of choices appears as the only possible answers. Advertisers also create an FD when creating a situation with only two outcomes and the only correct or positive outcome leads to their brand. (shrink)

In this paper we point out some interesting structural similarities between vagueness and moral dilemmas as well as between some of the proposed solutions to both problems. Moral dilemma involves a situation with opposed obligations that cannot all be satisfied. Transvaluationism as an approach to vagueness makes three claims concerning the nature of vagueness: (1) it involves incompatibility between mutually unsatisfiable requirements, (2) the underlying requirements retain their normative power even when they happen to be overruled, and (3) this (...) incompatibility turns out to be rather benign in practice. Given that transvaluationism is inspired by moral dilemmas, these claims are assessed in respect to them. Transvaluationism provides a smooth account of the mentioned claims concerning vagueness. Following a brief discussion of Sorensen’s views on moral dilemmas and conflict vagueness, we offer a model of moral pluralism accommodating structurally similar claims about the nature of moral conflict and moral dilemmas. The essay discusses the religious and ethical message of Shusaku Endo’s Silence. Briefly focusing first on the plot of the novel, the article proceeds to discuss the moral dilemma that is the core of the novel and asks whether the dilemma is symmetrical or incommensurable. Next, the essay analyzes the dilemma from the point of view of Max Scheler’s theory of the tragic. Finally, to highlight Rodrigues’s tragic situation, it discusses the notion of the hiddenness of God.

In this article we discuss the ethical dilemmas facing performance evaluators and the "evaluatees" whose performances are measured in a business context. The concepts of role morality and common morality are used to develop a framework of behaviors that are normally seen as the moral responsibilities of these actors. This framework is used to analyze, based on four empirical situations, why the implementation of a performance measurement system has not been as effective as expected. It was concluded that, in (...) these four cases, unethical behavior (i.e. deviations from the ethical behaviors identified in the framework) provided, at least to some extent, an explanation for the lower than expected effectiveness of the performance measurement procedures. At the end of the paper we present an agenda for further research through which the framework could be further developed and systematically applied to a broader set of cases. (shrink)

Managers throughout the world regularly face ethical dilemmas that have important, and perhaps complex, professional and personal implications. Further, societal consequences of decisions made can be far-reaching. In this study, 210 financial services managers from Australia, Chile, Ecuador and the United States were queried about their ethical beliefs when faced with four diverse dilemmas. In addition, the situational context was altered so the respondent viewed each dilemma from a top management position and from a position of economic hardship. Results (...) suggest a complex interaction of situation, culture and issue when individuals make ethical judgments. Specifically, Chileans were found to have different beliefs about sex discrimination and child labor dilemmas when compared to their colleagues from the other three nations. Chileans and Australians also disagreed on the bribery dilemma. Anglo managers were more likely than Latin American managers to change their ethical responses when the situation was altered. For multinational firms interested in maintaining healthy ethical climates, the findings suggest that culturally contingent ethical guidelines, or policies adapted to the local customs, must be considered. Further, managers must remain aware of issues related to specific situations, both internal and external, that would cause subordinates to alter their moral judgment. (shrink)

Departing from hypothetical dilemmas and drawing on examples from law, this paper offers a pragmatist account of normative induction that characterizes moral particularism and generalism as stages of inquiry into ethical problems, rather than rival accounts of moral knowledge and motivation. Pragmatism’s response to analytical moral theory lies in understanding the transformative nature of John Dewey’s social continuum of inquiry. The continuum is unrecognized in the analysis of hypothetical dilemmas, like the trolley problem, but can clearly be seen in studies (...) of law. Real moral dilemmas represent actual conflicts, of which the dimensions emerge through experience and the solution cannot be addressed through the analysis of cleverly balanced moral puzzles. Repeated over time, real problems drive the consensual formation and revision of social practices and the predication of general moral rules and principles. Ethical particularism holds that the evaluative cannot be “cashed out” propositionally, and that it is descriptively “shapeless.” It fails to recognize that real moral problems occur in a continuum, and at first encounter a shapeless particularist context of seemingly unlimited non-moral properties. Normativity is driven by repetition of similar situations toward shared practices and descriptive predication. Rather than a Dancian retention of epistemic status by defeated reasons, this illustrates retirement of relevant properties and accompanying reasons, transformation of the reasons environment, and a pluralist normative ontology. Against theses of Bernard Williams and Bas C. van Fraassen, it is argued that there are no facts about moral dilemmas, characterizable independently of any moral theory. It is further argued that any adequate theory which denies that there are genuine moral dilemmas must provide a convincing account of how and why moral agents take themselves to be in dilemmatic situations.
