In his “Space, supervenience and substantivalism”, Le Poidevin proposes a substantivalism in which space is discrete, implying that there are unmediated spatial relations between neighboring primitive points. This proposition is motivated by his concern that relationism suffers from an explanatory lacuna and that substantivalism gives rise to a vicious regress. Le Poidevin implicitly requires that the relationist be committed to the “only x and y ” principle regarding spatial relations. It is not obvious that the relationist is committed to (...) this principle in such a context. An additional motivation for Le Poidevin's argument, that space should be considered to be discrete, is that he believes that substantivalists are committed to a vicious regress. I show that the regress is in fact not of the vicious variety. These two main arguments show that Le Poidevin's suggestion that we drop the density postulate for space is unnecessary. (shrink)

In this paper I address the question of the dynamics of empirical progress, both in theory evaluation and in theory improvement. I meet the challenge laid down by Theo Kuipers in Kuipers (1999), namely to operationalize the task of "instrumentalist abduction," that is, theory revision aiming at empirical progress. I offer a reformulation of Kuipers' account of empirical progress in the framework of (extended) semantic tableaux and show that this is indeed an appealing method by which to account for some (...) specific kind of empirical progress, that of lacunae. Blake's edition of the romance of Chariton has at last made it possible to know what the tradition of the text amounts to and form some opinion of its principal weaknesses. That these include lacunae will be obvious to anyone who even glances through his apparatus criticus; I think there are at least three which neither he nor any of the former editors has noted. The supplements I propose are of course mere examples of (...) how they might be filled; their existence seems pretty certain, but no more than the general sense of what is missing is likely to be got unless some new papyrus or other unexpected find puts us in possession of more evidence. Este artigo apresenta a proposta de abordar o problema da lacuna explicativa na filosofia da mente. De modo alternativo às abordagens tradicionais, analiso o significado da lacuna explicativa segundo o pragmatismo de James em consonância com a perspectiva da filosofia da linguagem comum de Ryle, Austin e Wittgenstein. Como estratégia de desenvolvimento da proposta do artigo, procuro mostrar que a lacuna explicativa resulta de uma má compreensão dos usos dos termos psicológicos. O resultado é uma obsessiva insistência (...) em entificar o significado de ‘mente’ e a crença de que alguns termos psicológicos significam um tipo de entidade existindo além dos nossos usos dos termos psicológicos. Tal crença assume a forma de uma compreensão da visão fundacionalista do mental. O que procuro mostrar finalmente, e também em consonância com as recentes perspectivas enativistas, é que o significado dos termos psicológicos nada tem a ver com a existência de entidades. A crença em tais entidades, como condição de significação dos termos psicológicos, revela um mito filosófico derivado da aceitação da lacuna explicativa. In this article I argue not only for the value of hermeneutics today but also, and especially, how the crucial gesture of hermeneutics is that of changing the subject for the sake of our today. Surveying briefly the main lines of hermeneutical positions along its history and critiques, and connecting these critiques to the discrepancy between theory and practice, between interpretation and the need to change the world, the article proposes that our reality today, reshaped through globalization and the virtual, (...) is performed as a hermeneutics of history. The challenge for today’s hermeneutics is to work out categories for understanding the present as on-going in a world that tends to capture and distort more and more the meaning of freedom of thought. In the final section, I propose a hermeneutics of the on-going, of gerundive time, partially under the inspiration of Paul Celan, as a response that develops the meaning of the freedom of thought. Abstract In an important text, A Thousand Teachings, sometimes overlooked by scholars, Sankara expounds non?dualist religion. This article analyses Sankara's thought for its theoretical and practical perspectives. First, the discussion views non?duality from the viewpoint of ignorance. This pluralistic/dualistic perspective obscures the unenlightened seeker's vision of the Ultimate Truth. Secondly, the study examines Sankara's introduction of a transitional idea, Unevolved Name?and?Form (avy?krte n?mar?pe). Such an idea assists the seeker's intellectual progress from the state of ignorance to a rational understanding leading (...) toward nonduality (Advaita Ved?nta). Finally, the exposition clarifies Sankara's expression of the ?knowledge of Brahman?. This fulfilling wisdom affects a transformation of the life experience of the unenlightened. Utilitarianism has always been a dominant forceful position in ethical philosophy since its inception. However, it is not without its critiques. This paper attempts to answer the question what is it that is lacking in utilitarianism that makes it vulnerable to these critiques and causes it to fail to meaningfully talk about human morality. The paper attempts to answer the question by taking recourse to two concepts not considered in utilitarianism – emotivism and separateness of persons. This work is not only one of the primary sources for the history of the Later Roman Empire in the fourth and early fifth centuries a.d., but it is also the primary witness to the now fragmentary Histories of Eunapius of Sardis which it faithfully epitomizes. Analyzing the cultural (...) significance of modern ascetic rationalism, Weber initially wanted to extend the PE stepping back in time and study the historical development of methodical rational ways of life preceding the Reformation. Between publication of the PE essays and his death in 1920, Weber then specified his research agenda and elaborated on his earlier views. First these specifications and elaborations were made as a response to a series of writings by Ernst Troeltsch, particularly The Social Teachings of the Christian Churches and Groups, 2 and later while preparing a study on The Christianity of the Occident as part of his Collected Essays in the Sociology of Religion. This paper characterizes a phenomenon I call ‘binarism grammatical lacuna’ (BGL). BGL occurs when non-binary sex and gender identities are forced to choose between being he or she by the grammar of a language owing to the sex/gender binary. Although hermeneutical injustice (HI) lies at its core, given that non-binary communities come up with hermeneutical devices to overcome unintelligibility and these tools are discredited, a variety of epistemic injustices, besides HI, intertwine in BGL. I address contributory injustice, pragmatic competence (...) injustice, testimonial injustice, and testimonial smothering. Section 1 introduces the phenomenon by portraying it as an ensemble of epistemic injustices. Section 2 elucidates the variety of HI at the core of BGL by examining the case of mainstream Spanish, and section 3 reveals it as producing the primary harm of HI. Section 4 studies the relationship between grammar, ideology, and language use, calling attention to the fact that grammatical lacunae are performatively reenacted in daily speech acts. Section 5 explores the agential dimension of BGL, examining responsibilities. In addition to addressing some of the forms of epistemic injustice that might intertwine in BGL besides HI, I portray non-marginalized users of binary grammar when addressing non-binary people as hermeneutical misfirers. The question I have proposed to reflect on in this article is whether, and if so, in what terms, a non-reductionist and interactionist physicalist approach explains the relationship between consciousness and brain. For that, I took as a guiding thread the problem of the explanatory gap, which was faced with the problem of the ontological gap, which involves two intertwined issues: 1. Does the existence of an explanatory gap implies the existence of an ontological gap? 2. Does the nonexistence of (...) an ontological gap imply the nonexistence of an explanatory gap? I believe this reflection is welcome, since these two perspectives, the epistemological and the ontological, are often confused, and not understood. (shrink)

Abstract This article examines the common claim that there are gaps in international law that undermine accountability of private military and security companies. A multi-actor analysis examines this question in relation to the commission of international crimes, violations of fundamental human rights, and ordinary crimes. Without this critical first step of identifying specific deficiencies in international law, the debate about how to enhance accountability within this sector is likely to be misguided at best.

Tarski avoids the liar paradox by relativizing truth and falsehood to particular languages and forbidding the predication to sentences in a language of truth or falsehood by any sentences belonging to the same language. The Tarski truth-schemata stratify an object-language and indefinitely ascending hierarchy of meta-languages in which the truth or falsehood of sentences in a language can only be asserted or denied in a higher-order meta-language. However, Tarski’s statement of the truth-schemata themselves involve general truth functions, and in particular (...) the biconditional, defined in terms of truth conditions involving truth values standardly displayed in a truth table. Consistently with his semantic program, all such truth values should also be relativized to particular languages for Tarski. The objection thus points toward the more interesting problem of Tarski’s concept of the exact status of truth predications in a general logic of sentential connectives. O presente artigo busca problematizar as questões acerca da produção de uma Base Nacional Comum para a Formação Inicial de Professores da Educação Básica, BNC-Formação, (BRASIL, 2019) que ancora a formação docente no Brasil em uma concepção de resolução de problemas e voltada apenas para a aplicabilidade de um currículo como previsto na BNCC. Na perspectiva brasileira de inacabamento do sujeito proposto por Paulo Freire (1992, 2009,2010) e compondo uma compreensão de formação permanente descrita por Gaston Pineau (1985, 2003) buscamos (...) refletir como esse modelo descola à docência para uma posição de subalternidade, no qual as trajetórias dos profissionais são inviabilizadas e padronizadas. Neste sentido, fundamentado no pressuposto do ciclo de políticas de Stephen Ball (2011), buscamos compreender os pareceres números um e dois publicados em 2019 como um modelo prescritivo de formação de professores, como previsto por Ivor Goodson (1995, 2004), ainda que focando apenas nos dois primeiros momentos de ciclo de políticas do autor: os contextos de influência e de produção do texto, pois trata-se um movimento recente, uma vez que sua concretização vislumbra sua finalização dos currículos no ano corrente. O que observamos com a análise apresentada é uma proposta de formação que remonta os modos de um caminho prescritivo da docência pelo qual a formação docente está deslocada da vida e da proposição da formação permanente que tem o indivíduo como um sujeito formado pela (auto)formação – (hetero)formação – (eco)formação em diálogo com a sua história de vida. The effectiveness of placed-based education in inspiring care for natural and local environments, improving academic performance, dispelling with artificial dichotomies, and grounding philosophic discourse is supported by research whose results have been published not only concerning elementary and alternative settings, but collegiate ones as well. However, very little if any reporting has been done on its effectiveness in formal logic. Given the foundational nature of logic and its tendency to fulfill general education requirements, this is unfortunate. Though I am persuaded (...) it takes more than pedagogical magic wands to inspire self-driven student success, reflections on and examples of the actual constructions of a collegiate level introductory logic course that uses place- based curricula that also boasts some general statistical reassurance seems worth sharing. And, much to my own enjoyment, “sharing” provides me with an opportunity to describe a well-received extra credit opportunity involving a nationally recognized on campus tree tour. (shrink)

Segundo as respectivas noções de experiência e processo de James e Whitehead, o artigo procura mostrar que a lacuna explicativa é um mito filosófico na medida em que sustenta uma continuidade ontológica ao mesmo tempo conjugada com uma descontinuidade epistemológica entre mente e mundo ou mente e cérebro – em particular, como ilustração dessa incongruência entre continuidade e descontinuidade, (...) o núcleo do artigo se concentra em torno da revisão do chamado problema dos qualia. Partindo do empirismo de James e Whitehead, e tendo em vista a noção de continuidade, o artigo indica uma alternativa ao déficit epistemológico da lacuna explicativa assim como à visão internalista de mente que ela inspira – a ideia de que a mente está enclausurada no cérebro. Como resultado final, o artigo indica a atualidade do empirismo de James e Whitehead em consonância com as crescentes abordagens não-internalistas de mente e cognição em termos de continuidade que as noções respectivas de James e Whitehead de experiência e processo sugerem. This article compares and contrasts the patenting of animals, humans, and biotechnological inventions in the United States, at the European Patent Office, and within the European Union. It shows that morality is not a concern of U.S. legislative instruments or courts and patents have been granted liberally on living organisms, from microorganisms to mammals, in North America since the 1980s. By way of contrast, both European legislative instruments enshrine a morality bar that must be employed to deny patentability. Their implementation, (...) however, is unpredictable due to a lack of detailed guidance on what morality means. The remit of the morality bar extends principally to humans, but the interests of animals must now also be factored into the equation. The manner in which this is done is unclear and patents on plants, although controversial among the public in general, do not unduly trouble lawmakers now that a significant time has elapsed since this Rubicon was crossed. This article explains and critically assesses these systems while identifying some of the ethical problems that are likely to emerge in due course focusing on the ad hoc regard paid to animals and the lack of a structured approach to considering their rights or welfare. According to Hempel's paradox, evidence (E) that an object is a nonblack nonraven confirms the hypothesis (H) that every raven is black. According to the standard Bayesian solution, E does confirm H but only to a minute degree. This solution relies on the almost never explicitly defended assumption that the probability of H should not be affected by evidence that an object is nonblack. I argue that this assumption is implausible, and I propose a way out for Bayesians. Sarah Franklin’s Biological relatives: IVF, stem cells, and the future of kinship and Charis Thompson’s Good science: the ethical choreography of stem cell research, examine recently normalized biotechnologies. Franklin’s monograph extends her previous work on in vitro fertilization , deconstructing the success of a technology that, she argues, has grown “curiouser and curiouser” while taking hold in scientific and social life. IVF in its diverse aspects becomes a lens for scrutinizing our ambivalence about new technology, which Franklin articulates by putting (...) disparate literatures into conversation: feminist science studies, political economy, fine art, and more. Thompson’s Good science focuses more concretely on the first decade of human pluripotent stem cell research, tracing the field from the innovation of cultured human embryonic stem cells through Bush-era policy debates, to current acceptance of stem cell research as a part of the scientific and policy landscape. Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. By systematically deconstructing and analysing scientific texts for irrational unconscious motivations, new scientific associations can be produced.

This article begins with an ethnographically documented incident whereby nursing students dissected a medical human simulator model and rearranged it so that the “male” head and torso was attached to the “female” lower half. They then joked about the embodiment of the model, thus staging a scene of anti-trans ridicule. The students’ lack of ability, or purposeful refusal, to recognize morphological biodiversity in medical settings indicates a lacuna in clinical imaginaries. Even as trans-identified and gender nonconforming people increasingly access (...) care in the clinic, the lacuna of transsex—as a proxy term for non-binary embodiment—persists at the heart of clinical practice. This article concludes that we might engage in more ethical clinical practice if we recognize and affirm the trace of multiple forms of human being in the non-human simulator. (shrink)

Assessments of cetacean behavior has been hampered by popular misconceptions and mythic imagery. Rendell and Whitehead argue persuasively for accepting the idea of cetacean culture. Approaches to however, must resist positivist approaches that reaffirm the observable. Culture is also comprised of when organisms choose to resist or avoid behavioral patterns.

This paper draws upon Hannah Arendt's idea of the 'right to have rights' to critique the current protection gap faced by refugees today. While refugees are protected from refoulement once they make it to the jurisdiction or territory of a state, they face an ever-increasing array of non-entrée policies designed to stymie access to state territory. Without being able to enter a state capable of securing their claims to safety and dignity, refugees cannot achieve the rights which ought to be (...) afforded to them under international law. Drawing upon both legal theory and political philosophy, this paper argues that refugees today, just as the stateless in Arendt’s time, must be afforded the ‘right to have rights’, understood as a right to enter state territory. O presente artigo emergiu de uma reflexão sobre os percalços que afligem e chocam os professores, sobretudo no início da carreira, entre os quais se destaca tanto nos estudos quanto nos relatos propalados pelos próprios professores, a violência manifestada dentro e fora das salas de aula. Dada essa constatação e a evidente necessidade de sua superação para além de medidas efêmeras, esta pesquisa traça dois objetivos igualmente relevantes: a) incitar a discussão da violência no momento da formação docente inicial, bem (...) como o surgimento de novos estudos acerca dessa temática no âmbito da pesquisa acadêmica; e b) transgredir a tradição de pesquisas que consistem em recomendar prescrições a serem aplicadas sobre como banir a violência escolar, desconsiderando as peculiaridades de cada contexto. Tais objetivos são provenientes da seguinte questão norteadora: quais estratégias são desenvolvidas nos cursos de licenciatura que visam à preparação do futuro professor para lidar com o fenômeno da violência na escola básica? Intentando responder a essa questão e, portanto, contemplar os objetivos delineados optou-se pela análise de material bibliográfico especializado, sistematicamente selecionado, como procedimento metodológico. Como principal resultado, verificou-se que a discussão da temática da violência escolar na formação inicial é algo ainda escasso na prática e incipiente na esfera da pesquisa. Assim sendo, enfatiza-se a importância do fortalecimento de tal discussão a fim de que, ao ingressarem na carreira docente, futuros professores sintam-se devidamente subsidiados para enfrentarem os desafios cotidianos que venham a se manifestar ao longo do exercício da profissão.
