BackgroundJunior medical doctors have a key role in discussions and decisions about treatment and end-of-life care for people with dementia in hospital. Little is known about junior doctors’ decision-making processes when treating people with dementia who have advance care directives, or the factors that influence their decisions. To describe among junior doctors in relation to two hypothetical vignettes involving patients with dementia: their legal compliance and decision-making process related to treatment decisions; the factors influencing their clinical decision-making; and the factors (...) associated with accurate responses to one hypothetical vignette. MethodA cross-sectional survey of junior doctors, including trainees, interns, registrars and residents, on clinical rotation in five public hospitals located in one Australian state. The anonymous, investigator-developed survey was conducted between August 2018 and June 2019. Two hypothetical vignettes describing patients with dementia presenting to hospital with an ACD and either: bacterial pneumonia; or suspected stroke were presented in the survey. Participants were asked to indicate whether they would commence treatment, given the ACD instructions described in each vignette.ResultsOverall, 116 junior doctors responded. In Vignette 1, 58% of respondents selected the legally compliant option. Participants who chose the legally compliant option perceived ‘following patient wishes’ and ‘legal requirements to follow ACDs’ as equally important reasons for complying with the ACD. The most common reason for not selecting the legally compliant option in Vignette 1 was the ‘ACD is relevant in my decision-making process, but other factors are more relevant’. In Vignette 2, 72% of respondents indicated they would commence treatment and 18% selected they would not commence treatment.. Similar reasons influenced participant decision-making in Vignette 2, a less legally certain scenario.ConclusionsThere are critical gaps in junior doctors’ compliance with the law as it relates to the implementation of ACDs. Despite there being differences in relation to the legal answer and its certainty, clinical and ethical factors guided decision-making over and above the law in both vignettes. More education and training to guide junior doctors’ clinical decision-making and ensure compliance with the law is required. (shrink)

Concerns about “classroom advocacy” and “politicized teaching” have recycled into near-critical mass, even in the mass media. The book is well-arranged, too, with a (...) solid sample of deconstructionist, New Historicist, Marxist, feminist, and cultural studies, and more mix-and-match theorists describing their classroom aims and means in twenty-one essays grouped into four sections. Sadoff and Cain offer elegantly evasive introductions—not only to these essays per se, but to the issues these essays purport to address. In “Surveying Theory,” David B. Downing, John Kucich, Susan S. Lanser, Lynette Felber, Donald G. Marshall, and Gary Waller lay broadly “anti-foundational” groundwork. In “Focusing,” Diana Fuss, Sandra A. Grayson, Beverly Lyon Clark, Evan Carton, Laurie A. Finke, Jonathan Arac, and Cary Nelson deconstruct things in more detail. In “Theory and Culture,” Huston Diehl, Cannon Schmitt and Donald Ulin, Lindon Barrett, Simon Gikandi, D. N. Rodowick, and Jan Gorak again widen the scope of “theorized teaching,” aiming regulation anticanonical shrapnel at every bastion of coded convention. And while readers may pause over [End Page 336] its backcover promise of “lively and accessible prose,” on the whole, the book is unusually readable for an MLA publication about theory.Since Teaching Contemporary Theory to Undergraduates is a how-to directed at true-believers, it might seem like critical blindsiding to address its fundamental assumptions rather than its tactical suggestions, to focus on its “theory” rather than on its pedagogy. Yet such a focus is not only fair but necessary. The pedagogy is in this book a pawn of the theory. And the theory is, at best, a lesson in how not to teach students how to learn. For despite all its noisy celebrations of methodological, cultural, ontological, and occasionally even human “difference,” the anthology is really a chorus of self-defeating dogma. 1 Like the virtue of variety, even the relative absence of jargon here works as much against as for the book, revealing self-contradictions so perfectly unwitting that they are twice as funny. It is a good thing, then, that the authors eventually contradict these claims, too—even if they know not that they do.The canon? In accordance with postmodern tradition, “the canon” can be calibrated to be whatever best attacks whatever other tradition a particular theorist is aiming at. It is a very modular “monolith.” And theorists never try to “overdetermine” definitions, anyway. The classroom? As an “overdetermined” site of class-struggle, “the classroom (and the academy at large) is... a social institution designed to reproduce the interests, values, and politics of the dominant social classes” (p. 104). Convention? Anything “mainstream” is so polluted with “the notion of mastery, of total and complete knowledge” that even assigning “mainstream” theorists in a theory class “reproduces that hegemony, no matter how critically we read them” (pp. 105, 61). The runoff of mainstream theorists quoted here—conventional MLA Style—makes the same point. Culture? As always already—and only—“a struggle between power and its disenfranchised shadow,” culture “systematically excludes and marginalizes disenfranchised social members” (pp. 263–64, 20–21).Education? As Paulo Freire has revealed, 2 on the one, bad, goatish, wrong Right-wing hand of God, there is the repressive “banking” model of education; on the other, good-shepherdish, right Left-wing side, there is the liberating “problem-posing” model. You are either a droning clerk bent on subduing students into serfdom, or you are a resistance fighter lighting fuses of freedom. “Instrumental activity” does “pedagogical violence,” making the teacher a tyrant and the student a victim, a “submissive imitator” in a “system” that’s “abidingly committed [End Page 337] to the vision of a white-supremacist oligarchy.” Even asking students what level of “guidance” they feel they need is imposing “rhetorical control” (pp. 32, 23, 222, 135).Facts? Richard Waller, Fellow and Secretary of the Royal Society, is probably best remembered for editing Robert Hooke’s posthumously published works. Yet, Waller also created numerous drawings, paintings, and engravings for his own work and the Society’s publications. From precisely observed grasses to allegorical frontispieces, Waller’s images not only contained a diverse range of content, they are some of the most beautiful, colorful, and striking from the Society’s early years. This article argues that Waller played a (...) distinctly important role in shaping the visual program of the Royal Society by virtue of his multiple functions as reliable administrator and translator, competent natural philosopher, and skilled image-maker. It analyzes Waller’s visual works in the context of his graphic training—in part influenced by his mother Mary More—and situates them within the context of English image-making traditions and Waller’s own natural philosophical interests. Examined as a functional whole, Waller’s career as a Fellow of the Royal Society emerges as an important case study in the fusion of visual and scientific practices in early-modern England. (shrink)

What are the types of action at issue in the free will and moral responsibility debate? Are the neuroscientists who make claims about free will and moral responsibility studying those types of action? If not, can the existing paradigm in the field be modified to study those types of action? This paper outlines some claims made by neuroscientists about the inefficacy of conscious intentions and the implications of this inefficacy for the existence of free will. It argues that, typically, the (...) types of actions at issue in the philosophical literature require proximal or distal conscious decisions and have the right kind of connection to reasons. It points out that neuroscientists are not studying this class of actions, as their studies focus on simple commanded actions (e.g., finger flex) and simple Buridan choices (e.g., push the left or right button). Finally, it argues that neuroscience already has the resources to study the types of action relevant for free will and moral responsibility and outlines two experiments which focus on skilled actions and moral choices that could be run using the available technology. This paper offers an overview of "the species problem", arguing for a view of species as homeostatic property cluster kinds, positioning the resulting form of realism about species as an alternative to the claim that species are individuals and pluralistic views of species. It draws on taxonomic practice in the neurosciences, especially of neural crest cells and retinal ganglion cells, to motivate both the rejection of the species-as-individuals thesis and species pluralism.

This paper explores the relationship between eugenics, disability, and dehumanization, with a focus on forms of eugenics beyond Nazi eugenics.

Are interpersonal comparisons of desire possible? Can we give an account of how facts about desires are grounded, that underpins such comparisons? This paper supposes the answer to the first question is yes, and provides an account of the nature of desire that explains how this is so. The account is a modification of the interpretationist metaphysics of representation that the author has recently been developing. The modification is to allow phenomenological affective valence into the “base facts” on which correct (...) interpretation is grounded. To use this extra resource within that theory to vindicate interpersonal comparisons, we will need to appeal rational connections between level of valence and level of desire, which this paper sets out and examines. The impressive variation amongst biological individuals generates many complexities in addressing the simple-sounding question what is a biological individual? A distinction between evolutionary and physiological individuals is useful in thinking about biological individuals, as is attention to the kinds of groups, such as superorganisms and species, that have sometimes been thought of as biological individuals. More fully understanding the conceptual space that biological individuals occupy also involves considering a range of other concepts, such as life, reproduction, and agency. In this paper I begin by arguing that there are significant intellectual and normative continuities between pre-Victorian hereditarianism and later Victorian eugenical ideologies. Notions of mental heredity and of the dangers of transmitting hereditary ‘taints’ were already serious concerns among medical practitioners and laymen in the early nineteenth century. I then show how the Victorian period witnessed an increasing tendency for these traditional concerns about hereditary transmission and the integrity of bloodlines to be projected onto the level of national health. Tracing the gradual emergence of eugenical thought, I also highlight some of the more fundamental social, political and intellectual factors that promoted this predilection for extrapolating from the individual lineage to the nation and race. In doing so I argue that fully fledged eugenical thought was always unlikely to emerge prior to the early Victorian period. However, I am also able to show that Francis Galton's 1865 eugenical proposals were far from innovative and that identifying him as the ‘father’ of the eugenics movement is highly misleading. In Against Moral Responsibility, Bruce Waller launches a spirited attack on a system that is profoundly entrenched in our society and its institutions, deeply rooted in our emotions, and vigorously defended by philosophers from ancient times to the present. Waller argues that, despite the creative defenses of it by contemporary thinkers, moral responsibility cannot survive in our naturalistic-scientific system. The scientific understanding of human behavior and the causes that shape human character, he contends, leaves no room for moral (...) responsibility. Waller argues that moral responsibility in all its forms--including criminal justice, distributive justice, and all claims of just deserts--is fundamentally unfair and harmful and that its abolition will be liberating and beneficial. What we really want--natural human free will, moral judgments, meaningful human relationships, creative abilities--would survive and flourish without moral responsibility. In the course of his argument, Waller examines the origins of the basic belief in moral responsibility, proposes a naturalistic understanding of free will, offers a detailed argument against moral responsibility and critiques arguments in favor of it, gives a general account of what a world without moral responsibility would look like, and examines the social and psychological aspects of abolishing moral responsibility. Waller not only mounts a vigorous, and philosophically rigorous, attack on the moral responsibility system, but also celebrates the benefits that would result from its total abolition. (shrink)

In this article the author makes the case for a hybrid sourcehood–leeway compatibilist account of free will. To do so, she draws upon Lehrer’s writing on free will, including his preference-based compatibilist account and Frankfurt-style cases from the perspective of the cognizant agent. The author explores what distinguishes kinds of intentional influence in manipulation cases and applies this distinction to a new perspectival variant of Frankfurt cases, those from the perspective of the counterfactual intervenor. She argues that it matters what (...) kind of intentional influence is at issue in the counterfactual intervention and, further, that our judgments about desert of praise are affected by occupying the POV of the counterfactual intervenor. The author concludes that such attention to perspectival variants of Frankfurt cases supports the view that compatibilist sourcehood accounts of moral responsibility require an additional compatibilist could-have-done-otherwise condition to capture a more robust sense of moral responsibility. Loss of autonomous control—and a sense of helplessness—causes depression, increased sensitivity to pain, greater vulnerability to disease, and death. Well established by a wide range of psychological and physiological studies, the positive effects of patient autonomy are well known to competent physicians, nurses, and therapists. Drawing on a passage from Ramsey's Truth and Probability, we formulate a simple, plausible constraint on evaluating the accuracy of credences: the Calibration Test. We show that any additive, continuous accuracy measure that passes the Calibration Test will be strictly proper. Strictly proper accuracy measures are known to support the touchstone results of accuracy-first epistemology, for example vindications of probabilism and conditionalization. We show that our use of Calibration is an improvement on previous such appeals by showing how it answers (...) or sidesteps problems that have been raised for previous work in this area. (shrink)

My aim is to propose affectivity as a criterion for personal identity. My proposal is to be taken in its weak version: affectivity as _only one_ of the criteria for personal identity. I start by arguing for affectivity being a better candidate as a criterion for personal identity than thinking. Next, I focus on synchronic vs. diachronic and on ontic vs. epistemic distinctions (my proposal will concern diachronic ontic personal identity) and consider the realm of affectivity in its temporal dimension. (...) In my argument, I rely on the genuineness of affectivity and I exploit chiefly long- or everlasting feelings (or emotions) and those which involve the feeling subject more rather than less. Rebecca Lloyd Waller defends a temporal dualist interpretation of Descartes’ account of time to directly engage and address common interpretive puzzles. Descartes' Temporal Dualism offers a significant contribution to the understanding of an important, but frequently neglected component of Descartes’ ontology.

The paper offers an analysis of Protagoras’ fr. DK 80 B 1 and rejects the traditional reading of Protagoras as relativist. By considering the ipsissima verba that Protagoras makes use of in his passage, it is argued that alternative interpretations are possible, of which epistemological reism and psychological individualism are proposed. On a more general level, it is discussed to what extent Protagoras’ fragment contains descriptive rather than normative claim.

Kenneth Burke, arguably the most important American literary theorist of the twentieth century, helped define the theoretical terrain for contemporary literary and cultural studies. His perspectives were literary and linguistic, but his influences ranged across history, philosophy, and the social sciences. In this important and original study Robert Wess traces the trajectory of Burke's long career and situates his work in relation to postmodernity. His study is both an examination of contemporary theories of rhetoric, ideology, and the subject, and (...) an explanation of why Burke failed to complete his Motives trilogy. Burke's own critique of the 'isolated unique individual' led him to question the possibility of unique individuation, a strategy which anticipated important elements of postmodern concepts of subjectivity. Waller Keywords freedom, locus of control, psychoanalysis, self-efficacy, volition Cognitive behavioral research on locus of control and self-efficacy has produced an extensive body of empirical results that might prove useful to psychoanalytic researchers endeavoring to strengthen the empirical foundation of psychoanalytic therapy. Cognitive-behaviorists and psychoanalysts share a common (...) interest in the importance of perspectives and belief systems and their impact on individual freedom, and comparative research on therapeutic effectiveness could yield benefits for both therapeutic approaches.Locus of control and self-efficacy are central elements in cognitive-behavioral psychology, and they play an important role in cognitive-behavioral therapy. Although the psychoanalytic approach does not explicitly employ those concepts, psychoanalytic therapists are obviously concerned with problems of effective action and internal obstacles to action. Attention to these two perspectives and their overlapping interests offers potential benefits for both the cognitive-behavioral and the psychodynamic approaches to psychological research and therapy.One potential benefit is the development of useful tools for advancing empirically based research on psychoanalysis. As Lehrer (1999) states, it is advantageous to ground psychoanalysis in "firm empirical evidence whenever possible." Although there have obviously been significant positive steps in that direction (Singer 2003; Weiss 1995, 1988; Weiss and Sampson 1986), psychoanalytic researchers have recognized that one source of difficulty is in finding clearly measurable research objectives and hypotheses (Burgin 2002). Cognitive-behavioral research on locus of control and self-efficacy has produced an extensive body of research using clear measurement standards that could prove useful in the empiricist approach to psychodynamic theories. In particular, those cognitive-behavioral research findings might offer a means of extending empirical investigation of psychodynamic theory in a direction usually regarded as difficult to test empirically: the study of psychoanalytic effectiveness to "change your way of seeing" (Lieberman 1999). Shifting locus of control or efficacy expectations in specific domains (Bandura 1997) [End Page 125] would empirically confirm the effectiveness of psychoanalytic techniques. It might well be that some efficacy expectations are enhanced more effectively by psychodynamic processes than by cognitive-behavioral therapy, or that psychoanalysis is effective in enhancing some specific efficacy expectations but not others. This could potentially extend the empirical examination of psychoanalytic theory as well as provide a base of comparison with cognitive-behavioral therapy techniques.Although self-efficacy enhancement might be a fruitful empirical test for psychodynamic therapy, therapeutic intervention to modify locus of control potentially could be even more productive. Current research indicates that one's orientation toward locus of control is a relatively stable characteristic, although it can be modified (Holyrod et al. 1984; Rotter 1979; Sadow and Hopkins 1993). One reason for locus of control stability may be that the locus of control imposes a perspective on the conceptualization of all one's experiences: from a strong internal locus of control perspective I view failures and successes as largely my own doing, whereas from an external locus perspective even my most effective efforts are seen as events that were outside my control: "I guess it was just my time to do well on a math exam," rather than "My hard work for that exam really paid off." (Lieberman makes this phenomenon quite clear in his excellent discussion of transparency.) Although locus of control is not easily modified, it is important to find effective means of helping subjects to achieve such changes, because research shows that a strong internal locus of control is positively correlated with success in work, sports, studies, marriage, and psychological adjustment (Lefcourt 1981, 1992), as well as with better health care behavior and better health (Bandura 1977; Schorr and Rodin 1982; Schulz 1976; Schulz and Hanusa 1978; Wallston 1993). Those deeply enmeshed in an external locus of control enjoy less real freedom and suffer severe disadvantages.How does one effect a shift in such a basic orientation? Not easily.
