This essay proposes a design perspective on argumentation, intended as complementary to empirical and critical scholarship. In any substantive domain, design can provide insights that differ from those provided by scientific or humanistic perspectives. For argumentation, the key advantage of a design perspective is the recognition that humanity’s natural capacity for reason and reasonableness can be extended through inventions that improve on unaided human intellect. Historically, these inventions have fallen into three broad classes: logical systems, scientific methods, and disputation frameworks. (...) Behind each such invention is a specifiable “design hypothesis”: an idea about how to decrease error or how to increase the quality of outcomes from reasoning. As problems in contemporary argumentation practice become more complex, design thinking rises in relevance and importance. Contemporary reasoning about health is infused with the work products of experts, and expert reasoning about health itself is an active site for invention and design. Building on Toulmin’s largely undeveloped ideas on field-dependence, we argue that expert fields can develop new inference rules that, together with the backing they require, become accepted ways of drawing and defending conclusions. The new inference rules themselves function as warrants, and we introduce the term “warranting device” to refer to an assembly of the (...) rule plus whatever material, procedural, and institutional resources are required to assure its dependability. We present a case study on the Cochrane Review, a new method for synthesizing evidence across large numbers of scientific studies. After reviewing the evolution and current structure of the device, we discuss the distinctive kinds of critical questions that may be raised around Cochrane Reviews, both within the expert field and beyond. Although Toulmin’s theory of field-dependence is often criticized for its relativism, we find that, as a matter of practical fact, field-specific warrants do not enjoy immunity from external critique. In normative pragmatics, a kind of empirical discourse analysis organized by normative theory, the analysis of any communication process begins with an idealized model of the discourse that can be compared with actual practices. Idealizations of argumentation can be found, among other places, in theoretical descriptions of ‘critical discussion’ and other dialogue types. Comparing ideal models with actual practices can pinpoint defects in the models (leading to theoretical refinements), but it can also identify deficiencies in practice. This latter possibility invites (...) redesign around well-justified idealizations. This paper outlines an approach to the design of discourse processes and illustrates the approach with contrastive analysis of several recently developed protocols for discussion and debate on the worldwide web. In public policy debate such as the controversy over abstinence-only sex education, scientific conclusions enter the discourse as black boxes consisting of a result returned from an external and largely impenetrable process. In one way of looking at black box arguments, there is nothing fundamentally new for the argumentation theorist: A black box argument is very like any other (...) appeal to authority, and what might be said about any particular form of black box will turn out to be a particularized version of what might be said about evaluating arguments based on authority. But in another way of looking at black box arguments, they are a constantly evolving technology for coming to conclusions and making these conclusions broadly acceptable. Black boxes are to argumentation what material inventions are to engineering and related sciences. They are anchored in and constrained by fundamental natural processes, but they are also new things that require theoretical explication and practical assessment. (shrink)

Digressions in argumentative discussion are a kind of failure of relevance. Examination of what actual cases look like reveals several properties of argumentative relevance: (1) The informational relevance of propositions to the truth value of a conclusion should be distinguished from the pragmatic relevance of argumentative acts to the task of resolving a disagreement. (2) Pragmatic irrelevance is a collaborative phenomenon. It does not just short-circuit reasoning; it encourages a failure to take up the demands of an argumentative task. (3) (...) Pragmatic irrelevance can occur not simply by the absence of a connection between what is said and some standpoint in dispute, but also by the presence of a connection between what is said and a competing use of the information. How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

A background assumption of this paper is that the repertoire of inference schemes available to humanity is not fixed, but subject to change as new schemes are invented or refined and as old ones are obsolesced or abandoned. This is particularly visible in areas like health and environmental sciences, where enormous societal investment has been made in finding ways to reach more dependable conclusions. Computational modeling of argumentation, at least for the discourse in expert fields, will require the possibility of (...) modeling change in a stock of schemes that may be applied to generate conclusions from data. We examine Randomized Clinical Trial, an inference scheme established within medical science in the mid-20th Century, and show that its successful defense by means of practical reasoning allowed for its black-boxing as an inference scheme that generates (and warrants belief in) conclusions about the effects of medical treatments. Modeling the use of a scheme is well-understood; here we focus on modeling how the scheme comes to be established so that it is available for use. (shrink)

Background Providing understandable information to patients is necessary to achieve the aims of the Informed Consent process: respecting and promoting patients’ autonomy and protecting patients from harm. In recent decades, new, primarily digital technologies have been used to apply and test innovative formats of Informed Consent. We conducted a systematic review to explore the impact of using digital tools for Informed Consent in both clinical research and in clinical practice. Understanding, satisfaction and participation were compared for digital tools versus the (...) non-digital Informed Consent process. Methods We searched for studies on available electronic databases, including Pubmed, EMBASE, and Cochrane. Studies were identified using specific Mesh-terms/keywords. We included studies, published from January 2012 to October 2020, that focused on the use of digital Informed Consent tools for clinical research, or clinical procedures. Digital interventions were defined as interventions that used multimedia or audio–video to provide information to patients. We classified the interventions into 3 different categories: video only, non-interactive multimedia, and interactive multimedia. Results Our search yielded 19,579 publications. After title and abstract screening 100 studies were retained for full-text analysis, of which 73 publications were included. Studies examined interactive multimedia, non-interactive multimedia, and videos, and most studies were conducted on adults. Innovations in consent were tested for clinical/surgical procedures and clinical research. For research IC, 21 outcomes were explored, with a positive effect on at least one of the studied outcomes being observed in 8/12 studies. For clinical/surgical procedures 49 outcomes were explored, and 21/26 studies reported a positive effect on at least one of the studied outcomes. Conclusions Digital technologies for informed consent were not found to negatively affect any of the outcomes, and overall, multimedia tools seem desirable. Multimedia tools indicated a higher impact than videos only. Presence of a researcher may potentially enhance efficacy of different outcomes in research IC processes. Studies were heterogeneous in design, making evaluation of impact challenging. Robust study design including standardization is needed to conclusively assess impact. (shrink)

Evidence from optic ataxic patients with bilateral lesions to the superior parietal lobes does not support the view that there are separate planning and control mechanisms located in the IPL and SPL respectively. The aberrant reaches of patients with bilateral SPL damage towards extrafoveal targets seem to suggest a deficit in the selection of appropriate motor programmes rather than a deficit restricted to on-line control.

Faith is thus a central part of a flourishing life. -/- This article is about the philosophy of faith. There are many philosophical questions about faith, such as: What is faith? What are its main components or features? What are the different kinds of faith? What is the relationship between faith and other (...) similar states, such as belief, trust, knowledge, desire, doubt, and hope? Can faith be epistemically rational? Practically rational? Morally permissible? -/- This article addresses these questions. It is divided into three main parts. The first is about the nature of faith. This includes different kinds of faith and various features of faith. The second discusses the way that faith relates to other states. For example, what is the difference between faith and hope? Can someone have faith that something is true even if they do not believe it is true? The third discusses three ways we might evaluate faith: epistemically, practically, and morally. Através de revisão de literatura, foi realizada uma sucinta contextualização dos anos iniciais da formação familiar e acadêmica do autor, bem com a constituição do grupo de pesquisa, referências fundamentais à consolidação de conceitos e ideários que se tornaram basilares às análises da trajetória das ações políticas dirigidas a educação nacional, percorrendo desde o Brasil Colônia à atualidade, com a (...) homologação da Lei 9394/96. Percurso histórico que possibilitou ao autor destacar quatro características recorrentes nas ações da gestão educacional: filantropia, protelação, fragmentação e improvisação. Mesmo com as constatações, Saviani conclama à luta pela construção de uma educação pública responsável e comprometida com os valores à uma sociedade mais justa e igualitária. (shrink)

Darwinism, Democracy, and Race examines the development and defence of an argument that arose at the boundary between anthropology and evolutionary biology in twentieth-century America. In its fully articulated form, this argument simultaneously discredited scientific racism and defended free human agency in Darwinian terms. The volume is timely because it gives readers a key to assessing contemporary debates about the biology of race. By working across disciplinary lines, the book's focal figures--the anthropologist Franz Boas, the cultural anthropologist Alfred Kroeber, the (...) geneticist Theodosius Dobzhansky, and the physical anthropologist Sherwood Washburn--found increasingly persuasive ways of cutting between genetic determinist and social constructionist views of race by grounding Boas's racially egalitarian, culturally relativistic, and democratically pluralistic ethic in a distinctive version of the genetic theory of natural selection. Collaborators in making and defending this argument included Ashley Montagu, Stephen Jay Gould, and Richard Lewontin. Recent ideological positioning on the world stage has born a startling resemblance to a form of positioning within nursing theory – that of taking complex ideas, reducing them to a simplistic binary form, and uncritically adopting one half of that form. In some cases, this adoption of a binary position has led to a passionately held form of ‘othering’ that prohibits a healthy and critical engagement with ideas. As alluring as settling for the binary form may be – we argue (...) for holding binaries in tension as a catalyst for stimulating dialogue – reasoning and exploration of new ways of wrestling with the social and moral complexity of nursing. Gilbert Harman’s famous principle of Clutter Avoidance commands that “one should not clutter one’s mind with trivialities". Many epistemologists have been inclined to accept Harman’s principle, or something like it. This is significant because the principle appears to have robust implications for our overall picture of epistemic normativity. Jane Friedman (2018) has recently argued that one potential implication is that there are no genuine purely evidential norms on belief revision. In this paper, we present some new objections to a suitably (...) formulated version of the clutter principle qua norm on belief revision. Moreover, we argue that the clutter principle is best understood as a norm on non-doxastic stages of inquiry. In our view, it is a norm of asking and considering questions rather than a norm of settling on an answer to a question by forming a belief. (shrink)

In this article I define civil disobedience and classify it into four forms based on motive and extent of dissent. I then present Thomas Aquinas's account for justified civil disobedience. After first determining how a law or system of laws is unjust, the duty (virtue) of obedience to just and unjust laws is discussed. Finally, I argue that of the four possible forms of civil disobedience, Aquinas's natural Law Theory only clearly allows the fourth, i.e., altruistic disobedience of an unjust (...) system of rule, while at times also apparently allowing the third, i.e., altruistic disobedience of an unjust law. This article examines some of the conceptual history of collective political action within feminist movements beginning with sisterhood and moving to feminist political solidarity. I argue that feminist political solidarity is built on a commitment by individuals to form a unity in opposition to injustice or oppression. Three moral relations emerge from this understanding of feminist political solidarity: the relation to the cause, the relation among members of the solidary group, and the relation between the solidary group and the larger (...) society. These relations evoke certain obligations and responsibilities which I present and defend. Feminist political solidarity is informed by the particularities of the cause and thus any theoretical account of the moral obligations is necessarily limited, but by looking at these three relations together with a sociological account of transnational feminist political solidarity drawn from Clare Weber’s sociological description of the Women’s Empowerment Project, a clearer picture of some of the moral requirements of a commitment to feminist political solidarity emerges. -/- . Megan1 is a young teenage patient who suffered a stillbirth at 28 weeks, leading to a year long police investigation dropped only after postmortem tests found that her pregnancy was lost due to natural causes. The stress of the investigation and her isolation from friends and support network following the seizure of her mobile and laptop compounded the trauma of the stillbirth, leaving her requiring emergency psychiatric care. Aisha1 is a vulnerable patient who suffered a premature delivery, having experienced similar (...) problems in earlier pregnancies. Things happened so quickly that Aisha delivered on her own at home, only then seeking medical care. She told hospital staff that earlier in her pregnancy she had considered an abortion. As a result, she found herself interviewed under police caution and was required to surrender her phone and tablet, limiting access to friend and family support just when most needed. Aisha was denied unsupervised access to her baby in the intensive care unit, needing to hand over expressed breast milk to a receptionist. These stories, which were reported in a recent meeting in Parliament,1 are sadly far from unusual. They reflect the collateral damage of a growing trend towards more enthusiastic enforcement of the archaic abortion laws of England and Wales.2–5 In such cases, women who present with miscarriage, stillbirth or a premature delivery have aroused the suspicion of health professionals, sometimes because—like Aisha—they speak honestly about having considered abortion earlier in their pregnancies. They then find themselves reported to the police, required to surrender electronic devices and sometimes advised by duty solicitors to speak to no one about events leading to their investigation, thus being denied emotional and full clinical support at a time of significant trauma. How is what an agent ought to do at time t related to what they ought to do over a period of time that includes t? I revisit an example that sheds light on this question, taking account of issues to do with the agent's intentions and the distinction between subjective and objective obligation.

Dobbs v. Jackson Women’s Health continues a trajectory of U.S. Supreme Court jurisprudence that undermines the normative foundation of public health — the idea that the state is obligated to provide a robust set of supports for healthcare services and the underlying social determinants of health. Dobbs furthers a longstanding ideology of individual responsibility in public health, neglecting collective responsibility for better health outcomes. Such an ideology on individual responsibility not only enables a shrinking of public health infrastructure for reproductive (...) health, it facilitates the rise of reproductive coercion and a criminal legal response to pregnancy and abortion. This commentary situates Dobbs in the context of a long historical shift in public health that increasingly places burdens on individuals for their own reproductive health care, moving away from the possibility of a robust state public health infrastructure. Iris Marion Young took a strong stance against humanitarian intervention and other so-called legitimate instances of what she calls ‘official violence’. Nevertheless, she was also aware that there may be some situations for which military humanitarian intervention should at least be considered. Young was concerned that some states will use their obligation to defend against human rights violations as a mechanism in securing or maintaining global dominance. In addition, she recognized that what counts as a violation of human rights is (...) not uncontroversial; human rights norms and conventions are interpreted, negotiated, and otherwise contested. In this article, I build on Young’s arguments for a social connection model of responsibility by applying it to a situation where a forceful response to violence might be justified. I juxtapose Young’s position with the emerging international standard called ‘the responsibility to protect’ in order to suggest an account of intervention for global governance relations. (shrink)

Social criticism can take on many forms ranging from theoretical exposition to non-violent protests. This paper considers literary art as a form of social criticism and uses Morrison's novel Paradise as the exemplary case to show that the confrontation of unjust ideas through social criticism is essential in building non-oppressive relations open to diversity. In this sense, social criticism is a paradigm of communication that, although often entailing conflict, ultimately aims at reconciliation. I begin with a discussion of social criticism (...) followed by a short synopsis of the novel. I then examine the novel as social criticism focusing on a process I call "twinning." The paper ends with a critical evaluation of the power and possibilities of literary art as social criticism. (shrink)

“Female sexual dysfunction” is the type of contested disease that has sparked concern about the role of the pharmaceutical industry in medical science. Many policies have been proposed to manage industry influence without carefully evaluating whether the proposed policies would be successful. We consider a proposal for incorporating citizen stakeholders into scientific research and show, via a detailed case study of the pharmaceutical regulation of flibanserin, that such programs can be co-opted. In closing, we use Holman’s asymmetric arms race framework (...) as a tool for evaluating policies in industry-funded science. (shrink)
