This paper analyses the conception of the speaker figures in Plutarch’s Quaestiones Graecae and Quaestiones Romanae and their relationship to each other and to the historical author. The analysis is based on the questions as to what extent it is actually possible to identify a conceived speaker figure in these seemingly note-like writings and if such speaker figure can be assumed to be a completely freely conceived character or is at least in some way related to the person of the (...) historical author. The analysis of the Quaestiones Graecae reveals that the speaker in this treatise is conceived as a competent explainer of the Greek world. He is imbued with Greek culture, but shows no particular proximity to the author’s special interests and competencies. Only a reader who is deeply familiar with the author can discern his presence in some passages, which gives them access to a second level of understanding. The speaker of the Quaestiones Romanae, in contrast, is conceived as a conscientious researcher, who is interwoven with Greek culture and exercises restraint in addressing Roman issues. However, where Greek subjects are concerned, he can take a more pronounced position, thus exhibiting some proximity to the speaker of the Quaestiones Graecae. The analysis of such a passage makes evident that the speaker figures of the two treatises are identical and that their approach is essentially dependent on the subject contemplated. They can be considered as conceptions based on the historical author, whose presence, however, shines through in only some passages. This multi-layered speaker conception shows that both treatises are more thoroughly elaborated from a literary point of view and are more closely interconnected than often assumed by researchers. We show that the respective oversights in the von Neumann's general theorem against all hidden variable theories and Bell's theorem against their local-realistic counterparts are homologous. When latter oversight is rectified, the bounds on the CHSH correlator work out to be ±2√2 instead of ±2.

For a finite von Neumann algebra factor M, the projections form a modular ortholattice L(M). We show that the equational theory of L(M) coincides with that of some resp. all L(ℂ n × n ) and is decidable. In contrast, the uniform word problem for the variety generated by all L(ℂ n × n ) is shown to be undecidable.

Il en est ainsi depuis le commencement de toute société humaine. Mais ce n'est qu'au XX siècle que se manifeste un véritable intérêt pour le fonctionnement et l'importance culturelle des rituels. Il s'agit d'un tournant inspiré par les théories des ethnologues, et placé sous le signe du cultural turn et du performative turn du XX (...) siècle. On se détourne alors des pratiques jusque-là en vigueur de l'abstraction et de la représentation. Or, depuis le «Banquet» de Platon et l'instauration de la «Cène» chrétienne, l'un des rituels les plus importants est l'acte socialement codé de l'ingestion de nourriture, le repas. Avec l'Eat art dont il est le concepteur, Daniel Spoerri a repris ce thème et contribué, par le truchement du rituel piège, à poser un regard neuf sur l'acte de manger au XXe siècle. Tel que Spoerri le met en scène, le «rituel piège» attire l'attention sur le rôle de fondation de sens que joue le rituel dans la culture. Mais il fait apparaître également que les rituels se transforment en pièges idéologiques où tombe quiconque les prend « à la lettre » ou comme des évidences. Spoerri est un des artistes du XX et de ce début du XXI siècle qui, par le biais de leur art, rendent compte de la double fonction du rituel dans la culture: d'une part, le rituel maintient en vie le processus culturel; d'autre part, il est producteur d'idéologies qui font passer des mythes politiques pour naturels, prenant au piège consommateur de nourriture et consommateur d'art tout à la fois.Rituals are the synapses in the cultural fabric which has produced the elements that govern the coexistence and communication of human beings. This is so since the beginning of human society. But it is only 20th century that demonstrates a genuine interest in the operation and cultural importance of rituals. It is a milestone inspired by the theories of ethnologists, and placed under the sign of the cultural turn and performative turn of the twentieth century. It then turns practices far into force of abstraction and representation. However, since the "Banquet" of Plato and the establishment of the "Last Supper" Christian, one of the most important rituals is the act socially coded ingestion of food, meal. Eat with the art of which he is the designer, Daniel Spoerri took up this theme and contributed through the ritual trap, put a new perspective on the act of eating in the twentieth century. Spoerri as the stages, the "ritual trap" draws attention to the role of Foundation meaningful ritual plays in the culture. But it also shows that the rituals are transformed into ideological traps which falls whoever takes "the letter" or as evidence. Spoerri is one of the artists of the 20th and the beginning of the 21st century, through their art, reflect the dual role of ritual in culture: on the one hand, the ritual keeps life the cultural process, on the other hand, it is a producer of ideologies that pass for political myths natural trapping consumer food and consumer of art at the same time. Critical pedagogy has often been linked in the literature to faith traditions such as liberation theology, usually with the intent of improving or redirecting it. While recognizing and drawing from those previous linkages, Jacob Neumann goes further in this essay and develops the thesis that critical pedagogy can not just benefit from a connection with faith traditions, but is actually, in and of itself, a practice of faith. In this analysis, he juxtaposes critical pedagogy against three conceptualizations of faith: John (...) Caputo's blurring of the modernist division between faith and reason, Paul Tillich's argument that faith is “ultimate concern,” and Paulo Freire's theology and early Christian influences. Using this three-pronged approach, Neumann argues that regardless of how it is seen, critical pedagogy manifests as a practice of faith “all the way down.”. (shrink)

Anstatt die Herkunft von Leibniz' Monadenkonzept in rezeptionsgeschichtlicher Perspektive nachweisen zu wollen, erklärt die vorliegende Studie die offensichtliche Präsenz und Virulenz des Monadenbegriffs im 17. und 18. Jahrhundert selbst zu ihrem Untersuchungsgegenstand.Sie rekonstruiert den frühneuzeitlichen Bildungskanon zum Pythagoreismus, in dem der Monadenbegriff tradiert worden ist, und analysiert vor diesem Hintergrund die monadologischen Philosophien von Gottfried Wilhelm Leibniz, Christian Wolff und Andreas Clavius. An reichem Quellenmaterial zeigt sie, wie die ahistorisch argumentierenden Monadologien von Leibniz und Wolff von deren Zeitgenossen rehistorisiert (...) bzw. This theory breaks down the symmetry between producers and consumers and gives more importance to reproduction rather than scarcity. In his analysis of multiple-product systems, Bidard focuses on the notion of an all-engaging system which elucidates the link with von Neumann's theory; examines the notions of sector and (...) vertical integration which make possible an elegant treatment of fixed capital; clarifies the status of the internal rate of return; proposes a general theory of rent. In the discussion of capital theory and marginal equalities or, more specifically, the treatment of exhaustible resources, Bidard compares different readings of Sraffa's work and revisits the question of relationships between classical theory and the general equilibrium theory. L'article s'attache à dégager le fil rouge qui relie les réflexions de Wilhelm Gottfried Leibniz sur les jeux de société à la théorie des jeux, telle qu'on la trouve dans l'ouvrage de John Von Neumann et Oskar Morgenstern. L'itinéraire décrit passe par les travaux de plusieurs mathématiciens du XVIIIe siècle sur différents jeux de hasard, pour aboutir aux recherches de quelques-uns des fondateurs des mathématiques modernes, comme Ernst Zermelo pour la théorie des ensembles et Émile Borel pour la théorie des (...) probabilités. Il montre comment une analyse mathématique des jeux de société a débouché sur l'élaboration d'une grille générale d'analyse des phénomènes sociaux. We show that a finite orthomodular poset with a strong section Δ of states (probability measures) is distributive if and only if Δ has the unique Jordan-Hahn decomposition property(UJHDP). That this result does not extend to infinite orthomodular posets is shown by the projection lattices of von Neumann algebras without direct summand of typeI 2, for which the set of completely additive states is strong and has theUJHDP. The paradigm for modelling decision-making under uncertainty has undoubtedly been the theory of Expected Utility, which was first developed by von Neumann and Morgenstern (1944) and later extended by Savage (1954) to the case of subjective uncertainty. The inadequacy of the theory of Subjective Expected Utility (SEU) as a descriptive theory was soon pointed out in experiments, most famously by Allais (1953) and Ellsberg (1961). The observed departures from SEU noticed by Allais and Ellsberg became known as “paradoxes”. The Ellsberg (...) paradox gave rise, several years later, to a new literature on decision-making under ambiguity. The theoretical side of this literature was pioneered by Schmeidler (1989). This literature views the departures from SEU in situations similar to those discussed by Ellsberg as rational responses to ambiguity. The rationality is “recovered” by relaxing Savage's Sure-Thing principle and adding an ambiguity-aversion postulate. Thus the ambiguity-aversion literature takes a normative point of view and does consider Ellsberg-type choices as behavioural “anomalies”. (shrink)

Many political theorists defend the view that egalitarian justice should extend from the domestic to the global arena. Despite its intuitive appeal, this ‘global egalitarianism’ has come under attack from different quarters. In this article, we focus on one particular set of challenges to this view: those advanced by domestic egalitarians. We consider seven types of challenges, each pointing to a specific disanalogy between domestic and global arenas which is said to justify the restriction of egalitarian justice to the former, (...) and argue that none of them – both individually and jointly – offers a conclusive refutation of global egalitarianism. Globalization arguably generated a governance gap that is being filled by transnational rule-making involving private actors among others. The democratic legitimacy of such new forms of governance beyond nation states is sometimes questioned. Apart from nation-centered democracies, such governance cannot build, for example, on representation and voting procedures to convey legitimacy to the generated rules. Instead, alternative elements of democracy such as deliberation and inclusion require discussion to assess new instruments of governance. The recently published standard ISO 26000 is an (...) interesting example of transnational governance. ISO 26000 was developed in a lengthy multiorganizational process for the purpose of giving guidance on the social responsibility of organizations. By assessing the specific case of ISO 26000, this study sheds light on the question of how legitimacy beyond nation-state democracy is ensured or constricted. Centering on the idea of deliberate democracy and democratic legitimacy, the study offers in-depth insights on the normative legitimacy of the development process of ISO 26000. Positioned on the interface of business studies and public policy, this article contributes to the academic literature on transnational governance and on the role of multistakeholder processes in shaping the role of business in society. Our aim in this brief essay is not to defend a particular policy or attitude toward lockdown measures in the United States or elsewhere, but to consider the scope and limits of different types of arguments that can be offered for them. Understanding the complexity of these issues will, we hope, go some way to helping us understand each other and our attitudes toward state responses to the pandemic.

Climate change and other harmful large-scale processes challenge our understandings of individual responsibility. People throughout the world suffer harms—severe shortfalls in health, civic status, or standard of living relative to the vital needs of human beings—as a result of physical processes to which many people appear to contribute. Climate change, polluted air and water, and the erosion of grasslands, for example, occur because a great many people emit carbon and pollutants, build excessively, enable their flocks to overgraze, or otherwise stress (...) the environment. If a much smaller number of people engaged in these types of conduct, the harms in question would not occur, or would be substantially lessened. However, the conduct of any particular person (and, in the case of climate change, of even quite large numbers of people) could make no apparent difference to their occurrence. My carbon emissions (and quite possibly the carbon emissions of much larger groups of people dispersed throughout the world) may not make a difference to what happens to anyone. When the conduct of some agent does not make any apparent difference to the occurrence of harm, but this conduct is of a type that brings about harm because many people engage in it, we can call this agent an overdeterminer of that harm, and their conduct overdetermining conduct. When can or should citizenship be granted to prospective members of states? When can or should states withdraw citizenship from their existing members? In recent decades, political philosophers have paid considerable attention to the first question, but have generally neglected the second. There are of course good practical reasons for prioritizing the question of when citizenship should be granted—many individuals have a strong interest in acquiring citizenship in particular political communities, while many fewer are at risk of denationalization. Still, loss (...) of membership in a political community is a practice with a long history that continues to take place today. -/- Concerns about national security have recently led several liberal democratic states to pass, strengthen or consider legislation that would empower their governments to denationalize certain persons.] At the international level, formal norms governing denationalization are vague and generally toothless, and there are no international legal norms that restrict denationalization to citizens who hold another citizenship or wish to take up citizenship elsewhere (Worster, 2009). So it is important to determine whether there are conditions under which denationalization can be morally justified and, if so, what those conditions are. We shall argue that while denationalization is ordinarily impermissible, there is a class of crime committed by citizens that may render it not only permissible, but a fitting response on the part of the state. Traditionally, moral philosophers have distinguished between doing and allowing harm, and have normally proceeded as if this bipartite distinction can exhaustively characterize all cases of human conduct involving harm. By contrast, cognitive scientists and psychologists studying causal judgment have investigated the concept ‘enable’ as distinct from the concept ‘cause’ and other causal terms. Empirical work on ‘enable’ and its employment has generally not focused on cases where human agents enable harm. In this paper, we present new empirical evidence to support (...) the claim that some important cases in the moral philosophical literature are best viewed as instances of enabling harm rather than doing or allowing harm. We also present evidence that enabling harm is regarded as normatively distinct from doing and allowing harm when it comes to assigning compensatory responsibility. Moral philosophers should be exploring the tripartite distinction between doing harm, allowing harm, and enabling harm, rather than simply the traditional bipartite distinction. Cognitive scientists and psychologists studying moral judgment, who have so far largely adopted the bipartite distinction in this area of research, should likewise investigate the tripartite distinction. Based on the concept of shareholder primacy, many scholars have argued that it is more important for businesses to earn profits for their shareholders than to provide benefits to society at large. Corporate social responsibility is often regarded as an investment that comes at the expense of shareholders. In contrast, research analyzing the connections between the equity ownership structure of a company and its level of CSR engagement suggests that CSR offers benefits to shareholders that go beyond direct financial returns (...) from investments. The perceived value of these CSR benefits varies among different types of shareholders, as they assign unequal values to short-term financial or to rather long-term CSR benefits. Based on a literature sample of 146 publications, this review demonstrates central problems inherent in previous analyses. Given the ambiguous and partially contradictory findings of prior research, this study identifies potential moderating influences that help clarify empirical evidence. A contingency approach is suggested in future research, as this can help resolve the problem of contradictory empirical findings and theoretical arguments. (shrink)

In this paper, Christian Morgner provides a critical reading of Niklas Luhmann's thinking as ignoring human beings or even as antihumanist. Here, he presents an alternative view that centers on Luhmann's idea of the child or human being as a medium. To explain Luhmann's use of these ideas to conceptualize the child and the consequences for research, Morgner refers to the translation of Luhmann's paper “The Child as the Medium of Education” and to as yet unpublished material from his (...) famous card-box reference system. Drawing on these materials, Morgner can more clearly illuminate Luhmann's novel perspective and how it could inform further theoretical development, supported by new analysis of existing research in other fields, including developmental psychology, education, philosophy, and sociology. He concludes that, far from neglecting the human, Luhmann's theory takes human being very seriously and acknowledges its key role as a form-giving medium in addressing the challenges faced by contemporary society. This renewed perspective should be of particular interest to educational theorists, enabling them to more freely apply his ideas in various settings. (shrink)

There is no cure or vaccine for HIV/AIDS. The only life-prolonging treatment available is antiretroviral (ARV) therapy. WHO estimates, however, that less than 5 percent of those who require treatment in developing countries currently enjoy access to these medicines. In Africa fewer than 50,000 people–less than 2 percent of the people in need–currently receive ARV therapy. These facts have elicited strongly divergent reactions, and views about the appropriate response to this crisis have varied widely.The intensity of the debate concerning access (...) to life-prolonging medicines for the treatment of HIV/AIDS, and the heated rhetoric with which they are often conducted, suggest that these disagreements may be rooted in deeper disagreements of value. It is not obvious, however, what disagreements of value are at stake in this debate. By analyzing the statements of scholars, public officials, activist organizations, and private sector representatives, each of whom may endorse very different policy recommendations on access to HIV/AIDS drugs, we have identified and created a typology of the different sources of disagreement in the debate. We conclude that the central disagreements concerning access to medicines arise from competing understandings of how responsibilities for bringing remedy to hardships should be allocated to different agents and institutions. A central lesson that emerges from our analysis is that thinking about “health equity” must extend beyond the explanation and justification of goals, values, and ideals, and engage more honestly with the difficult question of how responsibilities for bringing remedy to health crises should be allocated in complex social contexts. In recent years it has often been claimed that policies such as subsidies paid to domestic producers by affluent countries and tariffs on goods produced by foreign producers in poorer countries violate important moral requirements because they do severe harm to poor people, even kill them. Such claims involve an empirical aspect—such policies are on balance very bad for the global poor—and a philosophical aspect—that the causal influence of these policies can fairly be characterized as doing severe harm and killing. (...) In this essay, we examine the philosophical aspect of this issue. We conclude that these policies do not do harm to the poor, but rather enable harm to them in various ways, and explore the moral implications of this fact. (shrink)

This paper contends that in Africa, the belief in the reality of the spirit world is a persistent phenomenon, which occupies a significant place in their religiosity. By building their theologies around the existential needs of the African people, the prophetic and deliverance ministries represent a contextual approach to Christianity in Africa. Nevertheless, an examination of the strengths and weaknesses of these ministries reveal that their approach may fit well into the African cultural milieu, but their emphasis is a threat (...) to the progress of Christian discipleship in Africa and among Africans in the diaspora. Despite their rapid numerical growth, the deliverance ministries cannot bring the African out of the fear of witchcraft and other supernatural powers. The paper concludes that to be able to mitigate the challenges of these ministries, pragmatic solutions being discussed at the academic levels must be made accessible to grassroots prophets. Within a German sample, the current cross-sectional questionnaire study conducts interreligious and interdenominational comparisons between Catholics, Protestants, free-church Protestants, Bahá’ís, Muslims, Spiritualists, i.e., religiously unaffiliated persons who label themselves as “spiritual,” and religious/spiritual “nones.” The comparisons refer to self-ratings of religiosity and spirituality, centrality of religiosity, as assessed by the Centrality of Religiosity Scale, and God concepts. The study is largely exploratory in nature, but also aims at identifying contexts of faith in which the term “spiritual” is typically used as (...) a self-description. The results show that only Spiritualists and free-church Protestants substantially label themselves as “spiritual.” However, they differ in many respects from each other, thus representing two distinct contexts of faith. The results further reveal a medium position of Catholics and Protestants in between the other subgroups, commonalities as well as specific differences between free-church Protestants, Bahá’ís, and Muslims, and some religious/spiritual approaches even within the “nones.”. A fresh interpretation of Jeremy Bentham, finding that his “radical foolery” embodied a social ethics that was revolutionary for its time. Jeremy Bentham (1748–1832) is best remembered today as the founder of utilitarianism (a philosophy infamously abused by the Victorians) and the conceiver of the Panopticon, the circular prison house in which all prisoners could be seen by an unseen observer—later seized upon by Michel Foucault as the apotheosis of the neoliberal control society. In this volume in the Untimely Meditation (...) series, Christian Welzbacher offers a new interpretation of Bentham, arguing that his “radical foolery” (paraphrasing Goethe's characterization of Bentham) actually embodied a social ethics that was new for its time and demands proper historical contextualization rather than retroactive analysis from the vantage point of late capitalism. Welzbacher provides just such an analysis, offering an account of the two great utilitarian projects that occupied Bentham all his life: the Panopticon and the Auto-Icon. Welzbacher rescues the Panopticon from the misapprehensions of Foucault, Orwell, and Lacan, arguing that Bentham saw the Panopticon as a pedagogical instrument incorporating the tenets of reason; construction and function, plan and influence, architecture and politics are brought into alignment. Bentham extolled the discovery in words that could easily be ascribed to Le Corbusier, Bruno Taut, or any other modernist architect. The Auto-Icon expressed Bentham's theories that the dead should benefit later generations; these theories were effectively sealed when Bentham decided to have his body preserved and put on display. (It can be seen today in a cabinet at University College London.) He also donated his inner organs to science—a practice outlawed at the time—and posthumously stage-managed his own ceremonial autopsy. Welzbacher reveals a Bentham who raised questions that feel familiar and current, invoking topoi that would come to define the modern era and that reverberate to this day. (shrink)
