An ethical analysis of Jordan's Clinical Research Law, which became effective in 2001, was performed. Accordingly, this paper discusses the major components, key strengths and weaknesses of this law. As an initial effort, the Law addresses important aspects of research ethics and, hence, should serve as an example for other Arab Countries in the Middle East. Unique aspects of the Law include the requirement that those conducting any study have insurance that can compensate for research injuries and a system of (...) fines and punishments for noncompliance with the Law. There are, however, some key items missing in the Jordanian Law. For example, the Law does not mention the requirement of a favourable assessment of risks and benefits, the fair selection of subjects, or articles regarding the protection of the rights and welfare of children and other vulnerable subjects participating in research. The paper concludes with the suggestion that new amendments should be considered for future revisions of the Clinical Research Law in Jordan. (shrink)

In the late 1970s, while working in my laboratory at the American Health Foundation, I received a phone call from Henry Spira. Not one for small talk, he did not even bother introducing himself beyond his name. He immediately began questioning me about my studies using the protozoan Tetrahymenathermophila, which I hoped would serve as an alternative to the Draize ocular irritation test. While flattered that someone cared about my work, I was soon lost in confusion and skepticism about (...) the true purpose of his call. Who was Henry Spira? Why did he want to visit my animal facility and why did he want to bring a physician colleague with him? Not only was I naive about the budding opposition to the Draize test, I was equally naive that it was Spira, an ardent animal protectionist, who was leading the fight. This seminal interaction began a friendship that spanned nearly twenty years; a friendship that indelibly changed my perception of nonhuman animals and how I relate to them. (shrink)

In his new book the eminent Kant scholar Henry Allison provides an innovative and comprehensive interpretation of Kant's concept of freedom. The author analyzes the concept and discusses the role it plays in Kant's moral philosophy and psychology. He also considers in full detail the critical literature on the subject from Kant's own time to the present day. In the first part Professor Allison argues that at the centre of the Critique of Pure Reason there is the foundation for (...) a coherent general theory of rational agency. The second part employs this account of rational agency as a key to understanding Kant's concept of moral agency and associated moral psychology. Henry E. Allison presents an analytical and historical commentary on Kant`s transcendental deduction of the pure concepts of the understanding in the Critique of Pure Reason. He argues that, rather than providing a new solution to an old problem, it addresses a new problem, and he traces the line of thought that led Kant to the recognition of the significance of this problem in his 'pre-critical' period. In addition to the developmental nature of the account of Kant`s views presented (...) here, two distinctive features of Allison's reading of the deduction are a defense of Kant`s oft criticized claim that the conformity of appearances to the categories must be unconditionally rather than merely conditionally necessary and an insistence that the argument cannot be separated from Kant`s transcendental idealism. One of the most influential of the Victorian philosophers, Henry Sidgwick also made important contributions to fields such as economics, political theory and classics. A proponent of the utilitarianism of Jeremy Bentham and John Stuart Mill, which he analysed in his classic work The Methods of Ethics, he later turned to the practical side of politics in this work, published in 1891. His aim was to have a 'rational discussion of political questions in modern states', and he offers a (...) thorough examination of Victorian politics, beginning with a discussion of political theory before moving on to more concrete matters such as property and law. The later chapters discuss the function of government through themes such as procedural matters, international affairs, war, political parties, and public participation, giving a comprehensive account of both ideas about and the functioning of late-nineteenth-century government. Autonomous vehicles are one of the most spectacular recent developments of Artificial Intelligence. Among the problems that still need to be solved before they can fully autonomously participate in traffic is the one of making their behaviour conform to the traffic laws. This paper discusses this problem by way of a case study of Dutch traffic law. First it is discussed to what extent Dutch traffic law exhibits features that are traditionally said to pose challenges for AI & Law models, (...) such as exceptions, rule conflicts, open texture and vagueness, rule change, and the need for commonsense knowledge. Then three approaches to the design of law-conforming AV are evaluated in light of the challenges posed by Dutch traffic law, which includes an assessment of the usefulness of AI & Law models of nonmonotonic reasoning, argumentation and case-based reasoning. Prakken gives an argumentation‐based analysis of the manslaughter case using logical tools developed in AI. Prakken regards evidential argumentation as the construction and attack of ‘trees of inference’ from evidence to conclusions by applying generalizations. He argues that this approach clearly shows how evidence and hypotheses relate and what are the points of disagreement, but that it cannot give a clear overview over a case and lacks a systematic account of degrees of uncertainty.

This article investigates to what extent protocols for dynamicdisputes, i.e., disputes in which the information base can vary at differentstages, can be justified in terms of logics for defeasible argumentation. Firsta general framework is formulated for dialectical proof theories for suchlogics. Then this framework is adapted to serve as a framework for protocols fordynamic disputes, after which soundness and fairness properties are formulated for such protocols relative to dialectical proof theories. It then turns out that certaintypes of protocols that are (...) perfectly fine with a static information base, arenot sound or fair in a dynamic setting. Two articles in the September–October 2022 issue of the Hastings Center Report discuss health‐related reasons that people might have to actively bring their lives to an end. In one, Brent Kious considers the situation of a person who, because of illness, becomes a burden on loved ones. A person in such a situation might prefer to die, and Kious argues that, while there is no obligation to hasten one's death, the choice to do so could sometimes be reasonable. In a (...) second article, Henri Wijsbek and Thomas Nys discuss a case in the Netherlands in which a woman with severe dementia was euthanized at a point when her advance euthanasia directive did not align with what she said, when asked, about death. Wijsbek and Nys defend the authority of her advance directive against a range of objections.In a third article, Henry Silverman and Patrick Odonkor, physicians at the University of Maryland Medical Center, where the first pig‐to‐human heart transplantation was performed in early 2022, develop recommendations for clinical trials of porcine heart transplantation. And an essay in the issue criticizes the allocation recommendations developed for Covid‐19 vaccines by the U.S. Centers for Disease Control and Prevention's Advisory Committee on Immunization Practices. In this paper a new use case for legal argumentation support tools is considered: supporting discussions about analyses of complex criminal cases with the help of Bayesian probability theory. By way of a case study, two actual discussions between experts in court cases are analysed on their argumentation structure. In this study the usefulness of several recognised argument schemes is confirmed, a new argument scheme for arguments from statistics are proposed, and an analysis is given of debates between experts about (...) the validity of their arguments. From a practical point of view the case study yields insights into the design of support software for discussions about Bayesian analyses of complex criminal cases. (shrink)

Although a good deal has been written about Kant's conception of free will in recent years, there has been no serious attempt to examine in detail the development of his views on the topic. This book endeavours to remedy the situation by tracing Kant's thoughts on free will from his earliest discussions of it in the 1750s through to his last accounts in the 1790s. This developmental approach is of interest for at least two reasons. First, it shows that the (...) path that led Kant to view freedom as a transcendental power that is both radically distinct from and compatible with the causality of nature was a winding one. Second, it indicates that, despite the variety of views of free will that Kant held at various times, the concept occupied a central place in his thought, because it was the point of union between his theoretical and practical philosophy. This article reassesses the concept of identification in line with the increased importance phenomenology has taken on in film-philosophy of the 1990s and 2000s. In the 1970s and 1980s, a Lacanian psychoanalytic interpretation of identification dominated film theory and criticism, and spectatorial engagement with elements of films was understood as what psychoanalysis calls secondary identification – the identification with stable subject-positions (characters) in the film-text. But non-Lacanian psychoanalysis and Merleau-Ponty’s existential phenomenology offer film-philosophy a very different understanding of identification as (...) a non image-based, ‘blind’, bodily affective tie that is established between spectators and what Vivian Sobchack describes as ‘the sense and sensibility of materiality itself’ (Sobchack 2004, 65). By first exploring how this more bodily (for psychoanalysis, primary ) identification is theorized by psychoanalysts (Freud, Paul Schilder, Henri Wallon) and by film theorists (Kaja Silverman), the article proposes that film criticism make greater use of it in order to engage more meaningfully with the visible cultural specificities – size, skin colour, age, sex – of the images of bodies viewed on cinema screens. It is not just ‘the’ body that needs bringing back into thinking about film spectatorship, but culturally differentiated bodies , both on the screen and in the auditorium. A psychoanalytic and phenomenological film criticism of embodied cultural identity, one that attends to the materiality of the film and of the body-images and objects on the screen, may be the most culturally and politically useful successor to ‘screen’ theory of the 1970s and 1980s. Until about thirty years ago, the extent of disclosure about and consent-seeking for medical interventions was influenced by a beneficence model of professional behaviour. Informed consent shifted attention to a duty to respect the autonomy of patients. The new requirement arrived on the American scene in two separate contexts: for daily practice in 1957, and for clinical study in 1966. A confusing double standard has been established. 'Daily consent' is reviewed, if at all, only in retrospect. Doctors are merely exhorted (...) to obtain informed consent; they often minimise uncertainties about 'best' treatment and they feel duty-bound to provide patients with an unequivocal recommendation for action. 'Study consent' in a clinical trial is reviewed prospectively, and doctors are compelled by regulation to point out that there is insufficient evidence to make a rational choice between two compared treatments. It has been impossible to devise informed consent practices that satisfy, in full, the competing moral imperatives of respect for autonomy, concern for beneficence with emphasis on the value of health, and a vigil for justice. A way must be found to experiment with various discretionary approaches that would strike a realistic balance among competing interests. (shrink)

On the face of it, Plato's treatment of aisthesis is decidedly ambiguous. Sometimes he treats aisthesis as a faculty which, though distinct from all rational capacities, is nonetheless capable of forming judgments such as ‘This stick is bent’ or ‘The same thing is hard and soft’. In the Theaetetus, however, he appears to separate aisthesis from judgment, isolating the former from all prepositional, identificatory and recognitional capacities. The dilemma is easily expressed: Is perception a judgmental or cognitive capacity, or is (...) it a non-judgmental, non-cognitive capacity? If the former, how does perception differ from belief? If the latter, is perception a faculty of the rational or irrational soul? Not surprisingly, the topic has received much scrutiny over the years. And equally unsurprisingly, the debate has turned as much on what it means for a capacity to be judgmental, cognitive, non-judgmental or non-cognitive, as on whether Plato says that it is of either kind. At 47e–53c of the Timaeus Plato presents his most detailed metaphysical analysis of particulars. We are told about the construction of the physical universe, the ways we can and cannot talk about the phenomena produced, and about the two causes – Necessity and Intelligence – which govern the processes and results of production. It seems to me that we are told too much and too little: too much, because we have two accounts of the generation of phenomenal particulars – one, (...) the ‘formal account’, which makes use of the receptacle, Forms and form-copies, and a second, the ‘geometrical account’, which appeals to geometrical shapes, the Demiurge and, apparently, matter; too little, because there is insufficient guidance as to how to relate the two accounts. Organizations continue to show renewed focus on managing their ethics programs by developing organizational infrastructures to support their ethics implementation efforts. An important part of this process has been the creation of an ethics officer position. Whether individuals appointed to the position are successful in the role or not may depend on a number of factors. This study presents a suggested framework for their effectiveness. The framework includes a focus on personal, organizational and situational factors to predict performance in the (...) role. The study examines the complex nature of the role. These include task complexity, low task visibility, role conflict, and role ambiguity. Personal, organizational and situational factors that can serve as buffers against the complexities associated with the role are presented. The study suggests that individuals with certain competencies and orientations may be better suitable for the ethics position, and firms need to consider key organizational and situational issues critical to the performance of an ethics officer. The research and practice implications of the study are given. (shrink)

In more than half of its states, the USA has recently passed or proposed legislation to limit or ban public educational curricular reference to race, gender, sexuality, or other identity topics. The stated justifications for these legislative moves are myriad, but they share a foundational claim; namely, these topics are asserted to be politically and socially divisive such that they ought not to be included within state-controlled schools. In this paper, we consider the claims of divisiveness regarding these topics and (...) explore whether, even if taken in good faith, the popular versions of these arguments and actions are epistemically defensible. We conclude that these bans are an epistemic injustice and therefore argue for their end. The article proceeds to consider the foundational claims of epistemic injustice, followed by the invocation of epistemic standards by which the arguments for these bans can be evaluated. The article then transitions to a close application of these standards, weighing the possible epistemic gains and losses. Before concluding, we consider objections and explore the social and epistemic significance of these issues. (shrink)
