Despite recent advances in ways to prevent transmission of HIV from a mother to her child during pregnancy, infants continue to be born and become infected with HIV, particularly in southern Africa where HIV prevalence is the highest in the world. In this region, emphasis has shifted from voluntary HIV counselling and testing to routine testing of women during pregnancy. There have also been proposals for mandatory testing. Could mandatory testing ever be an option, even in high-prevalence settings? Many previous (...) examinations of mandatory testing have dealt with it in the context of low HIV prevalence and a well-resourced health care system. In this discussion, different assumptions are made. Within this context, where mandatory testing may be a strategy of last resort, the objections to it are reviewed. Special attention is paid in the discussion to the entrenched vulnerability of women in much of southern Africa and how this contributes to both HIV prevalence and ongoing challenges for preventing HIV transmission during pregnancy. While mandatory testing is ethically plausible, particularly when coupled with guaranteed access to treatment and care, the discussion argues that the moment to employ this strategy has not yet come. Many barriers remain for pregnant women in terms of access to testing, treatment and care, most acutely in the southern African setting, despite the presence of national and international human rights instruments aimed at empowering women and removing such barriers. The number of people in immediate need of anti‐retroviral treatment (ART) in the southern African region continues to significantly exceed the capacity of health systems there to provide it. Approaches to this complex rationing dilemma have evolved in different directions. The ethical concepts of fairness and equity have been suggested as a basis to guide the development of approaches to select patients for ART. This article reports the results of a case study on patient selection at a rural ART clinic (...) in Lesotho. The purpose of the study was to examine whether or not such concepts had relevance or operative value for a treatment team providing ART in rural Lesotho. The study found that while concepts of fairness and equity were relevant to the work of the treatment team, patient selection practices did not necessarily reflect what these concepts entail. The idea of fairness as a structured, formalized selection process did not figure in the approach to ART provision at the site. A less formal, ‘first‐come‐first‐served’ approach was adopted. While there was knowledge among some team members that social, economic or geographic conditions inhibit individuals and groups from gaining access to ART and that this was inequitable, it was felt that there was little they could do to try to mediate the impact of these conditions. The study's findings pose importance questions about the approach to ART programming in resource constrained settings. The findings also question the relevance of trying to achieve fairness and equity when the gap between need for care and capacity to provide it remains so large. (shrink)

Totality states of affairs (Russell's 'general facts') are defended against Martin's criticisms. Although higher-order, they are not 'abstract in Quine's sense. If space-time is the whole of being, and if it can be seen as a vast conjunction of states of affairs, then the state of affairs that this is the totality of lower-order states of affairs is not additional to, but completes, space-times. If totality states of affairs are admitted, then there seems no need for any further negative (...) states of affairs additional to totality states of affairs. (shrink)

I used to think of the connection between a particular and a universal that it instantiates as a contingent one. Now I think that this is not quite right. This revision, as I now see it, is not a very large one. I still think that the states of affairs (Russell’s facts in his great Lectures on Logical Atomism) that unite particulars and universals are contingent beings. But the connection within states of affairs is, in a certain way, necessary.

In A World of States of Affairs(Cambridge University Press, 1997) David Armstrong offers acomprehensive metaphysics based on the thesis that the world consistsof states of affairs. Among the entities postulated by Armstrong's theory are relations, including non-symmetrical relations, and whileArmstrong does not agree with Russell that all relations have adirection or definite order among their places, he does explicitlyacknowledge that the slots of a non-symmetrical relation have adefinite order or direction. I first show that non-symmetricalrelations pose a (...) problem for Armstrong's theory by raising TheProblem of Converse Relations. I then argue that the bestresolution of this problem in the context of Armstrong's theoryinvolves adopting an analysis of the order or direction of a relationthat differs from the analysis that Russell assumes. This is a study of a crucial and controversial topic in metaphysics and the philosophy of science: the status of the laws of nature. D. M. Armstrong works out clearly and in comprehensive detail a largely original view that laws are relations between properties or universals. The theory is continuous with the views on universals and more generally with the scientific realism that Professor Armstrong has advanced in earlier publications. He begins here by mounting an attack on the (...) orthodox and sceptical view deriving from Hume that laws assert no more than a regularity of coincidence between instances of properties. In a series of papers, Donald Davidson :3–17, 1984, The philosophical grounds of rationality, 1986, Midwest Stud Philos 16:1–12, 1991) developed a powerful argument against the claim that linguistic conventions provide any explanatory purchase on an account of linguistic meaning and communication. This argument, as I shall develop it, turns on cases of what I call lexical innovation: cases in which a speaker uses a sentence containing a novel expression-meaning pair, but nevertheless successfully communicates her intended meaning to her audience. I will argue that cases of lexical innovation motivate a dynamic conception of linguistic conventions according to which background linguistic conventions may be rapidly expanded to incorporate new word meanings or shifted to revise the meanings of words already in circulation. I argue that this dynamic account of conventions both resolves the problem raised by cases of lexical innovation and that it does so in a way that is preferable to those who—like Davidson—deny important explanatory roles for linguistic conventions. The philosophical literature on sport and games has had little to say about boredom beyond presuming that sports and games can be important ways of overcoming or preventing it. But boredom is an interesting and often misunderstood phenomenon with overlooked implications in this context. Boredom has significant human value and motivates play in ways that contribute to well-being and culture, often through encouraging engaged agency and exploration of novelty.
