Teacher strikes have taken place in the United States since the end of the 19th century, became much more common in the 1960s, and have enjoyed a resurgence over the past five years (2018-2023). In this paper, we analyze teacher strikes with two main objectives. First, we examine how sexism and misogyny impact discourse around teacher strikes, as well as the justifications that teachers themselves give for striking. We find that teachers are at risk of being deemed ‘immoral’ unless they (...) justify their decision to strike by appealing to their being in the service of others. Pressure to adopt this framing not only negatively impacts teachers’ dignity as human beings deserving of adequate compensation and working conditions, but it also inadvertently upholds unjust patriarchal norms regarding teaching as care work. In the second part of this paper, we put forward alternative framings teachers can adopt in justifying their decisions to strike. The framings are rooted in philosophical literature that allows for self-regarding actions to be recognized as properly moral in certain circumstances. We argue that by extending this recognition to teachers who strike, we combat covert sexist expectations and uphold the dignity of teachers as persons. (shrink)

The relationship between law and morality is a topic which receives special importance and attention, especially in "liberal democracies" in which the law is supposed to regulate highly pluralized and fragmented societies. Under conditions of plurality of values, many social forces and legal theories require a certain kind of neutrality from the legal system, a means of compatibility of the many "world views" and "moral systems" that are present within the same social space. Such a conciliating commitment sounds (...) particularly relevant in times of the doctrinal ubiquity of ideas such as "peace based on human rights". This was the title of the 28th World Congress of the IVR in Lisbon, with the special workshop "Law and Morals" on which this book is based. Somos ainda vítimas da “absolutização do Mercado”: uma autêntica mercantilização da vida e, portanto, também da cultura e da religião. O mercado vai se impondo como único cenário de nossa trama civilizacional atual. Nossos fluxos vitais e também os valores e símbolos culturais e religiosos se tornam mercadoria de consumo e de descarte. Having said that, what does human kind and religion become in this new era? Techno-science has become a horizon of comprehension of man regarding the world and of himself. Not only our lifestyles and our way of life and work are conditioned by technology, but also our deeper identity is lost by the technical difference. We are still victims of the “absolutization of the market”: an authentic mercantilization of life and, therefore, culture and religion. The market presents itself as the only setting of our present civilization’s story line. Our vital fluctuations, as well as the values and religious and cultural symbols become merchandise to consume and discard. In such a context, religion runs the risk of being attacked by a double reductionism. This has been the price that religion decided to pay in exchange for the right of citizenship in a world dominated by techno-science, by the market and by the Mass Media. Keywords : Techno-science. Anselm of Canterbury holds that freedom of the will is a necessary condition for moral responsibility. This condition, however, turns out to be trivially fulfilled by all rational creatures at all times. In order to clarify the necessary conditions for moral responsibility, we must look more widely at his discussion of the nature of the will and of willed action. In this paper, I examine his theory of voluntariness by clarifying his account of the sin of Satan (...) in De casu diaboli. Anselm agrees with Augustine that the sinful act cannot be given a causal explanation in terms of a distinct preceding act of will or desire or choice. He thus rejects volitionalist accounts of Satan's sin and thus of voluntary action in general. He moves beyond his predecessor, however, in insisting on the necessity of an explanation in terms of reasons, and his theory of the dual nature of the rational will is designed to meet this demand. RESUMEN: Hace treinta años la economía mundial, sobre todo en los países desarrollados, sufría, como ocurre ahora, una fuerte crisis económica. De aquella situación surgió un nuevo modelo de regulación de las economías capitalistas al que se llamó neoliberalismo. Desde entonces, con mayor o menor fuerza, ha estado presente en todos los países, aprovechando las condiciones de estos para repetir constantemente los mismos principios: la reducción del Estado, las ventajas del mercado, la autorregulación de éste, etc. Aunque sus premisas (...) parezcan simples o sencillas el neoliberalismo es un proyecto complejo y cambiante, cuya sustentabilidad política y económica se reinventa constantemente y cuya gobernanza y espacialidad es necesario observar y analizar si se quiere avanzar en alternativas viables. El neoliberalismo no vive apartado de proyectos alternativos sino que se mezcla con las alternativas, tiene una forma de gobernanza que muta, que cambia. Con este artículo pretendemos conocer algo más sobre las semejanzas y diferencias que esta ideología presenta según los países.ABSTRACT: Thirty years ago the world economy, especially the developed countries, suffered, as it is the case now, a severe economic crisis. That situation arose a new regulatory model of capitalist economies is called neo-liberalism. In the late eighteenth century, Adam Smith significantly shaped the modern world by claiming that when people individually pursue their own interests, they are together led towards achieving the common good. But can a population of selfish people achieve the economic common good in the absence of moral constraints on their behavior? If not, then what are the moral conditions of market interaction which lead to economically efficient outcomes of trade? Answers to these questions profoundly affect (...) basic concepts and principles of economic theory, legal theory, moral philosophy, political theory, and even judicial decisions at the appellate level. Walter Schultz illustrates the deficiencies of theories which purport to show that markets alone can provide the basis for efficiency. He demonstrates that efficient outcomes of market interaction cannot be achieved without moral normative constraints and then goes on to specify a set of normative conditions which make these positive outcomes possible. Its concrete topic is the theory of just price of Tomás de Mercado, who became a classic because of his direct and at the same time scholarly language. The topic of fair or just price, which is not new in scholastic moral theology, is treated by him in a philosophical manner, using an original view based on practical (...) rationality which caused his work to be reprinted several times. In 1591, in a very innovative way, the doctor Juan de Cárdenas asserts in his Primera parte de los problemas y secretos maravillosos de las Indias, the superiority of the criollos (white people of Spanish origin, born in the American territory) over the Spaniards. His text considers American space as an element that “increases” the capacities of the body and, consequently, of the mind, making the criollos superior to the Spaniards. Cárdenas’ text appears to be a clear break with other (...) texts that consider, on the contrary, the colonial space as a space that “degrades” or “weaks” the body, reducing its physical, intellectual and moral capacities. In contrast to theories that assert that the tropical climate “diminishes” the individual, Juan de Cárdenas develops the idea of a body (and a mind) with enhanced capacities. This paper will analyse the implications and the imaginary mechanisms of this discourse, and its links to a specific social and political context. At the end of the sixteenth century, Mexico and, more broadly, the viceroyalty of New Spain saw the emergence of a new social class, the Creoles, who were increasingly occupying prestigious positions. The theory of the “augmented body” of the criollo, elaborated by Juan de Cárdenas, consolidates the new social hierarchies that were emerging at the same time in colonial Mexico. (shrink)

The current society is ruled by the capitalist economic system. Its main feature is the centrality of the profit. Human life and other species of life, nowadays take the risk of being manipulated to obtain that profit. So, the reality of health risks to be swayed by this market mentality and end up reducing the person and the human body as a marketing object. By facing this reality should reaffirm in us that life is worthy in itself, and therefore (...) must be respected in its integrity. Thus, the Bioethics reflection, despite any interests, must place the human life in the center in order to establish the criteria of morality in the researches. After briefly presenting the approaches to price theory developed in American colonial scholasticism by Tomás de Mercado, Bartolomé de Albornoz and Juan de Matienzo, we intend to demonstrate the preponderant role played by Aristotle and the peculiar reception given to him by these authors in their respective works.

The paper maps out an alternative to a behavioural (economic) approach to business ethics. Special attention is paid to the fundamental philosophical principle that any moral ‘ought’ implies a practical ‘can’, which the paper interprets with regard to the economic viability of moral agency of the firm under the conditions of the market economy, in particular competition. The paper details an economic understanding of business ethics with regard to classical and neo-classical views, on the one hand, (...) and institutional, libertarian thought, on the other hand. Implications are derived regarding unintentional and passive intentional moral agency of the firm. The paper moves on to suggest that moral agency can be economically viable in competitive ‘market’ interactions, which is conventionally disputed by classical/neo-classical and institutional, libertarian economics. The paper here conceptualises active moral agency of the firm as the utilisation of ethical capital in firm--stakeholder interactions. This yields a reinterpretation of instrumental stakeholder theory. (shrink)

According to the standard reading of Anselm’s De casu diaboli 12 through 14, the angels are morally responsible only if their own wills are in a radical way within their own power. By giving to angels two wills, i.e., two basic inclinations or volitional dispositions, Anselm’s God yields to the angels room for a free choice—indeed imparts on them the necessity of such a choice: in the case where an angel’s own happiness is incommensurable with justice, the angel must choose (...) or “will” which disposition to act in accordance with. The standard reading thus takes Anselm to argue for a form of voluntarism. In this paper I argue that the underlying moral psychology of De casu diaboli is neither voluntarist nor intellectualist. A voluntarist reading renders Anselm’s views on motivation incoherent, whereas his views on the conditions of morally right action run afoul of crucial intellectualist assumptions. (shrink)

The paper discusses legal implications of the expansion of practical uses of mathematics in social life. Taking as a starting point the omnipresence of mathematical infrastructures underlying policies, technology and markets, the paper proceeds by attending to relevant materials offered by general philosophy, legal philosophy, and the history and philosophy of mathematics. The paper suggests that the modern transformation of mathematics and its practical applications have spurred the emergence of multiple useful technologies and forms of social interaction but have impoverished (...) access to meanings originating in the lifeworld. The paper also argues that, as part of devices of interest aggregation and expert networks, mathematical infrastructures can be scrutinized by a revised form of legal practice that subjects them to legal critique and reconstruction in order to overcome conditions that have eroded the moral self-awareness of individuals and communities and their existential meanings. In the second Critique, Kant claims that the moral law is given as a fact of reason. In this paper, contra the standard view, I argue that there is a non-dogmatic way of defending this claim. And Kant’s principle of morality is widely taken to be a formal principle. How then can such a formal principle be reconciled with our substantial moral end? In this paper, I also argue that Kant’s principle of morality can be construed as a (...) formal principle in the sense that it provides correctness conditions for moral laws, rather than providing specific moral laws.Dans sa deuxième Critique, Kant affirme que la loi morale se donne comme un fait de raison. Dans cet article, contrairement à la position standard, nous prétendons qu’il existe une autre façon — non dogmatique — de défendre cette affirmation. Par ailleurs, le principe de moralité de Kant est largement considéré comme étant formel. Comment un tel principe formel peut-il être réconcilié avec notre fin morale substantielle? Nous soutenons également que le principe de moralité de Kant peut être interprété comme un principe formel dans le sens où il fournit des conditions d’acceptabilité pour les lois morales, et non des lois morales spécifiques. Following some suggestions given by McDaniel, we propose a view of analogy in which the semantic phenomenon is associated with the more or less natural character of the property or properties that the entities that satisfy the analogous predicate instantiate. A predicate "θ" is analogous if and only if the property Θ, which something instantiates, if and only if it is θ, is less natural that any property Ξ so that anything that instantiates Ξ, instantiates Θ. This chapter argues for deregulation of the credit-rating market. Credit-rating agencies are supposed to contribute to the informational needs of investors trading bonds. They provide ratings of debt issued by corporations and governments, as well as of structured debt instruments (e.g. mortgage-backed securities). As many academics, regulators, and commentators have pointed out, the ratings of structured instruments turned out to be highly inaccurate, and, as a result, they have argued for tighter regulation of the industry. This chapter shows, however, (...) that the role of credit-rating agencies in achieving justice in finance is not as great as these commentators believe. It therefore argues instead for deregulation. Since the 1930s, lawgivers have unjustifiably elevated the rating agencies into official, legally binding sources of information concerning credit risk, thereby unjustifiably causing many institutional investors to outsource their epistemic responsibilities, that is, their responsibility to investigate credit risk themselves. Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, (...) participants tended to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

BackgroundIn the Netherlands, patients have the legal right to make a request for euthanasia to their physician. However, it is not clear what it means in a moral sense for a physician to receive a request for euthanasia. The aim of this study is to explore the moral values of physicians regarding requests for euthanasia. MethodsSemi-structured interviews were conducted with nine primary healthcare physicians involved in decision-making about euthanasia. The data were inductively analyzed which lead to the emergence (...) of themes, one of which was about values regarding end-of-life decisions.ResultsFour clusters of values related to euthanasia requests are described: values related to 1) the patient; 2) the family; 3) the physician; and 4) life and death. The data show that the participants value patient autonomy as a necessary but not sufficient condition for meeting a euthanasia request. A good relationship with the patient and the family are important. For the physician, the values physician autonomy, responsibility, understanding the patient and relief of suffering play a role. Life as an intrinsic good and a peaceful death are also important values.ConclusionThis study shows that next to patient autonomy and the relationship with the patient and the family, it is important for the participants to act in accordance with their professional values and to do justice to values related to life and death. The awareness of going against the intrinsic value of life is crucial, even if performing euthanasia may result in a feeling of relief or gratitude afterwards. (shrink)

Resumen: Varios filósofos han hecho notar que el naturalismo metafísico ha sido un supuesto compartido por los miembros de la comunidad científica involucrada en la investigación acerca del origen de la vida. Es una consecuencia de esta presuposición que la emergencia de la vida debe haber sido muy probable bajo las condiciones físicas y químicas de la Tierra primitiva. El estado de la investigación sobre el origen de la vida, sin embargo, está muy lejos de poseer una hipótesis naturalista convincente (...) en los términos buscados. La actitud de los investigadores y de algunos filósofos ha sido suponer que estos fracasos no son una razón para pensar que alguna otra hipótesis naturalista no fuese a funcionar. Aquí se ofrece una reconstrucción epistemológica de esta actitud en términos bayesianos. Se argumenta, luego, que el aislamiento del naturalismo metafísico respecto de la desconfirmación no es racional, y podría convertirse en un obstáculo para el avance del conocimiento. Abstract: Several philosophers have noted that metaphysical naturalism has been an assumption shared by the members of the scientific community involved in the research concerning the origin of life. It is a consequence of this presupposition that the emergence of life should have been very probable under the physical and chemical conditions in the primitive Earth. The state of the research on the origin of life, though, is very far from having a convincing naturalist hypothesis in the terms sought after. The attitude of the researchers and some philosophers has been to suppose that these failures are not reason to think that some other naturalist hypothesis won’t work. Here, an epistemological reconstruction of this attitude in Bayesian terms is offered. It is argued that the insulation of metaphysical naturalism from disconfirmation is not rational, and would become an obstacle to the advancement of knowledge. (shrink)

This essay develops a loosely understood Marxist notion of material conditions in light of the Caribbean plantation complex. The racial order endemic to the plantation and its continuation in post-emancipation contexts undermines any spurious base/superstructure distinction at work in an understanding of material conditions even in some accounts of racial capitalism. Material conditions are as ideological as they are “infrastructural” (Sylvia Wynter) in being ongoingly articulated by anti-black coordinates of sense. The ongoing actualization of the racial order (...) of slavery is understood not as required by altered material conditions, but rather as altering material conditions. The essay considers the continuity of the racial order of the plantation through the contract in a specific site, namely, post-emancipation Puerto Rico. (shrink)

Despite societal concerns about the welfare of commercial laying hens, little attention has been paid to the welfare implications of the choices made by the genetics companies involved with their breeding. These choices regarding trait selection and other aspects of breeding significantly affect living conditions for the more than 7 billion laying hens in the world. However, these companies must consider a number of different commercial and societal interests, beyond animal welfare concerns. In this article we map some of (...) the relevant dilemmas faced by genetics companies in order to outline the scope of opportunities to improve welfare under current market conditions. This includes identifying cases where different animal welfare concerns conflict. We discuss the moral responsibility of laying hen genetics companies and the welfare implications that derive from the choices they make and the policies they follow. In addition to evaluating a selection of predominant current practices and breeding goals, we outline different angles from where to assess the moral legitimacy of various industry practices and policies. We discuss specific issues such as injurious pecking, bone health, induced moulting, chick culling and the circumstances of breeding stock. (shrink)

RESUMO:O objeto de estudo deste artigo é a condição humana. Qual a possibilidade de existência da condição humana fundamentada na liberdade? O objetivo é relacionar esfera pública, política, liberdade e condição humana. A elaboração teórica considerou obras de Etienne de La Boétie, Hannah Arendt, Cornelius Castoriadis, entre outros. Na atualidade, ocorre a supressão da condição humana, pois a esfera pública tem a ingerência da esfera privada, predominando a razão instrumental e a lógica do mercado, e o homem é afastado (...) da vida política. Por isso, a nossa ação política pela liberdade é fundamental para a problematização do processo de banalização do mal e da servidão voluntária. A coragem é uma virtude indispensável à ação política, é necessária para nos libertarmos da dominação e do servilismo da vida privada e conquistarmos a vida política. A centralidade da ação política do homem é a sua condição de ser atuante para a reafirmação da esfera pública, do mundo da pluralidade, humano e comum. Todavia, a condição humana fundamentada na liberdade implica a superação da atividade e do pensamento pragmáticos e fragmentários da vida cotidiana e a constituição da praxis na dimensão humano-genérica consciente. ABSTRACT:The subject of this article is the human condition. What is the possibility of the existence of the human condition founded on freedom? The aim is to connect the public sphere, politics, freedom, and the human condition. The works of Etienne de La Boétie, Hannah Arendt, Cornelius Castoriadis, and others, are considered. At the present time there is occurring a suppression of the human condition, because the public sphere exists under the interference of a private sphere in which instrumental reason and market logic prevail. People are divorced from political life. For this reason, political action seeking freedom is essential for addressing the problems of the banalization of evil and voluntary servitude. Courage is an indispensable virtue to political action; it is necessary for liberating us from the domination and servitude of private life, as well as for attaining political life. The centrality of human beings’ political action is the condition for acting to reaffirm the public sphere and the world of plurality, both human and common. However, the human condition founded on freedom supposes the overcoming of the pragmatic and fragmented activity and thinking of daily life, and requires the constitution of praxis in the conscious human-generic dimension. In Nicomachean Ethics IV Aristotle exposes the characteristics of the moral virtue of the μεγαλοψυχία and offers a detailed description of the conditions of the magnanimous. St. Thomas in his commentary on Ethics follows the Aristotelian text apparently without disagreeing with the Greek author, and completes this exposition with other texts found in the Summa Theologica. The aim of this paper is to highlight the differences, if there are any, between the Aristotelian conception of the μεγαλοψυχία and that (...) of Saint Thomas, considering also whether the virtue of humility that appears in the Thomist texts can be equated to the vice of the pusillanimity of which Aristotle speaks. BackgroundMoral distress is a phenomenon that can lead to an imbalance of the mind and body. There are many coping strategies to overcome the obstacles that lead the subject to this condition. Some coping strategies are capable of being achieved through the cultivation of moral resilience.AimThe aim is to identify the strategies of moral resilience in the nursing management of University Hospitals in Brazil.Research designThe research design is the qualitative study with discursive textual analysis.Participants and research context: 44 (...) nurse managers and nurses in leadership positions participated in a total of 30 University Hospitals in Brazil. Data were collected online, using a questionnaire with open questions.Ethical considerationsThe Ethics Committee approved the study. Participants received information about the research, agreed to respond to the questionnaire, and were guaranteed anonymity.FindingsPersonal adaptive strategies (intrapersonal and interpersonal) and organizational collaborative strategies (intrinsic and transformational management) emerged from this process. The intrapersonal strategies involved elements of rationality, flexibility, rebalancing practices, moral courage, and detachment. The interpersonal strategies addressed support networks, team involvement, and dialog. Organizational strategies dealt with actions which reorient ethical infrastructure, ethical education, and psychological protection, as well as fostering dialogical relationships, empowerment, and cooperation.ConclusionFrom the perspective of social historical construction, it is understood that developing personal and organizational strategies is essential to cultivating moral resilience. Se (...) puede tener un juicio, pero no necesariamente actuar en consecuencia. / I argue in this article that we are not consistent utilitarians at all times, nor irrational dogmatic deontologists, rather, a mixture of utilitarianism and deontologism that depends on a series of factors undiscovered or convincingly explained both epigenetic, evolutionary, as educational, axiological, psychological learned, conscious and unconscious in decision making. Vale-se de reflexões a partir de observação participante e de consulta a bibliografia especializada. Apontam-se algumas das formas com as quais essas igrejas se midiatizam e se inserem num contexto de espetacularização e mercadorização próprios da sociedade do tempo presente e imediato. O mercado religioso no qual se inserem as agências que (...) praticam este tipo de marketing passa por contextos de adequação ao capital simbólico e ao arcabouço cultural dos fiéis, sendo possível identificar o investimento ideológico e econômico na fabricação e veiculação de suas estratégias, discursos e mercadorias. For this purpose, the reflections from participant observation and literature on the subject are validated. Some of the ways these churches mediate themselves and are part of a context of spectacle and commoditization are also pointed out. The religious market has adequate to the symbolic capital and to the cultural framework of the participants of the churches. Because of that it is possible to identify the ideological and economic investment in the manufacturing and delivery of their strategies, discourses and products. This article aims to highlight some of the ways in which neo-Pentecostal churches convey the goods they produce and the speeches that reflect them, relating them to a mass culture and a society of the spectacle. At a time in which labour markets are becoming increasingly globalised and precarisation processes are altering young people’s working and living conditions, a whole network of public and private agencies are developing different entrepreneurship programmes as the main mechanism to deal with youth exclusion and unemployment. Grounded in two on-going research projects conducted in Europe and Australia, this article proposes a preliminary, thought-provoking engagement with the concept of global grammars of enterprise to examine how the truth regimes are framed (...) and articulated in these networks. We argue that this concept enables us to identify, examine and analyse the shifting, unstable, but always strategic power relations between the governmental discourses on entrepreneurship and the enterprising behaviour and dispositions of persons and groups, and the particular «declensions» and local «translations» of the ideas of entrepreneurship that organisations and young people perform within a process of globalised precarisation.Al albur de la globalización de los mercados laborales, al mismo tiempo que ciertos procesos de precarización están alterando profundamente las condiciones de vida y de trabajo de las personas jóvenes, se despliega toda una red de agentes públicos y privados que buscan fomentar el emprendimiento como principal mecanismo para enfrentar la exclusión y el paro juvenil. In the Cypriot trilogy Isocrates does not intend to carry out only an oratorical exercise on his conception of the monarchic regime. These are speeches whose primary meaning was to carry out a diplomatic action whose intention was for Cyprus to support the Athenian hegemonic cause. They were written at the precise moment when Timotheus travelled through the Aegean Sea and the north of Greece in order to consolidate Athenian expansionism. In this way, he made a sequence of political speeches (...) in which he used his own philosophical notions adapting them, on the one hand, to the Cypriot political situation characterized by confrontations between the pro-Hellenic and pro-Persian factions and, on the other hand, to the strategic needs of Athens. Los cuidados paliativos deben manejar los diferentes problemas que los pacientes y las familias pueden tener al final de la vida. La sedación es una maniobra terapéutica utilizada con cierta frecuencia en cuidados paliativos y constituye una buena práctica médica cuando está bien indicada; sin embargo, presenta el riesgo de conculcar algunos principios éticos. Los principios de beneficencia y autonomía son posiblemente los principios éticos mayormente afectados cuando se considera la sedación. Se deben cumplir los siguientes requisitos: síntoma refractario, enfermedad (...) terminal y consentimiento, y en lo posible estar avalada por una segunda opinión médica. La sedación paliativa no es eutanasia y las diferencias están en el objetivo, el proceso y el resultado. En el presente trabajo se discuten algunos de los aspectos para prevenir la conculcación de los principios éticos, asimismo se proporcionan algunas sugerencias para ayudar en la toma de decisiones. Palliative care to the different problems encountered by patients and their families at the end of life. Sedation is a therapeutic manoeuvre frequently used in palliative medicine, that could eventually infringe some ethical principles. From our standpoint, beneficence and autonomy are probably the most affected principles when sedation is considered. The following conditions are required in order for it to be applied: refractory symptom, terminal illness and consent, and as long as possible, the decision must be supported by a second medical opinion Palliative sedation is different from euthanasia, and the differences lie in the objective, the pro- cess and the result. Some measures to prevent such violations to occur are discussed, and suggestions intended to guide in decision making are proposed. (shrink)

Starting from MacIntyre’s virtue ethics, we investigate several codes of conduct of banks to identify the type of virtues that are needed to realize their mission. Based on this analysis, we define three core virtues: honesty, due care, and accuracy. We compare and contrast these codes of conduct with the actual behavior of banks that led to the credit crisis and find that in some cases banks did not behave according to the moral standards they set themselves. However, although (...) banks and the professionals working in them can be blamed for what they did, one should also acknowledge that the institutional context of the free market economy in which they operated made it difficult to live up to the core values lying at the basis of the codes of conduct. Given the neo-liberal free market system, innovative and risky strategies to enhance profits are considered desirable for the sake of shareholder’s interests. A return to the core virtues in the financial sector will therefore only succeed if a renewed sense of responsibility in the sector is supported by institutional changes that allow banks to put their mission into practice. Para isso coloca em questão o conceito de religião como a expressão de fé em entes transcendentes ou sobrenaturais, porque ele se aplica bem a religiões deístas como o cristianismo, mas deixa em segundo plano o fundamento mesmo do fenômeno religioso: a sacralidade. Recuperando a teoria de Durkheim, este artigo parte da hipótese de que a sacralidade é fundamental também nas sociedades de mercado. (...) Abandonando o conceito de religião derivado da fé, propõe uma explicação sociológica da religião nas contemporâneas sociedades de mercado por sua sacralidade. It calls into question the concept of religion as the expression of faith in transcendent or supernatural beings, because it is well suited to theistic religions like Christianity, but leaves in the background the very foundation of religious phenomena: the sacredness. Recovering Durkheim's theory, this article assumes the hypothesis that sacredness is essential also in market societies. Abandoning the concept of religion derived from faith, it proposes a sociological explanation of religion in contemporary market societies by its sacredness. The argument is organized in five steps: (1) the "twilight of the great gods" in market societies; (2) criticism to the concept of religion related to faith; (3) recovering the contribution of Durkheim for the study of religion as a social fact; (4) the fetishism of merchandise as the base for the sacredness of the market; (5) the place of current religions in market societies. Building on recent literature on the history of political economy and Spanish imperial history, the article reconstructs the ideas that supported the colonial development of the meat industry in the Río de la Plata. Archival and printed sources are employed to illustrate the different arguments revolving around colonial economic development and imperial rule, in the words and practices of merchants, explorers, administrators and ministers. This way, it is possible to disclose the multiple imperial visions circulating in the Spanish (...) Atlantic. The analysis suggests that economic reformism was not only a European intellectual and political movement but was shared and appropriated by Spanish Americans. They employed arguments in political economy to foster their agenda, namely the economic improvement of their territory in the broader context of the Spanish commercial empire. If a shared consensus around imperial political economy between Spanish and Spanish American vassals provided arguments supporting this colonial industry, the diverging economic interests, imperial rivalries, and the different geographical spaces of enunciation determined a variable dialectic between projects for the expansion of salted meat production and their realisation. Some libertarians argue that informed consent alone makes transactions in the labour market morally justified. In contrast, some of their critics claim that such an act of consent is no guarantee against coercion. To know whether agreements are voluntary, we need to assess the quality of the offers or the prevailing background conditions. ISCT theorists argue that it is imperative to take social norms into account when evaluating the labour market. We present a novel framework for (...) class='Hi'>moral assessment in the labour market, which takes consent, background conditions and norms into account, but which mainly focuses on the offers and demands made. Consent renders a transaction legitimate in the same way we regard a fair election legitimate even if we object to its outcome. For offers to be substantially justified, exploitation must be avoided and offers must give expression to the value of community. Only then they are morally justified. (shrink)

El presente trabajo se propone establecer la actualidad de una ética de las virtudes de estilo aristotélico en el ámbito de la ética clínica. La relación establecida por Maclntyre entre las prácticas y los “patrones de excelencia” que rigen internamente su ejercicio, juntamente con el enfoque de Pellegrino y Thomasma de la medicina como “comunidad moral” en la que las habilidades técnico-científicas y la disposición moral del agente configuran una unidad indisoluble en el acto médico, son la base (...) del análisis sobre la especificidad de la práctica médica y los consecuentes requerimientos morales de quienes la ejercen. La crisis de la medicina occidental que en los últimos treinta años provocó importantes puntos de fractura con la tradición hipocrática, ofrece una posibilidad de salida reinterpretando sus propios fines. De ello se sigue la necesidad de retomar líneas de la tradición que el ideal de la medicina científica, las reglas del mercado y la burocratización de la atención sanitaria parecieran haber obturado. En esta encrucijada es donde el énfasis puesto por la ética de las virtudes en el ethos profesional, anclado en el compromiso con las personas concretas cuyo beneficio da sentido a la actividad y a las instituciones médicas, resulta imprescindible para balancear las falencias de una ética fundada en principios, sin que ello implique renunciar a los efectivos logros del universalismo moral.This work is meant to set up the present importance of the ethic of virtues, which follows the Aristotelian style in the field of clinical ethics. The relationship established by Maclntyre between the practices and the “patterns of excellence” which internally guides these practices, together with the view of Pellegrino and Thomasma about medicine as a “moral community” in which the technical-scientific skills and the agent’s moral dispositions shape an indissoluble link in the medical act, are the basis for the analysis on the specificity of the medical practice and the moral requirements of the practitioners. The crisis of western medicine that in the last thirty years has given rise to important break points with the hippocratic tradition, offers a possible resolution by the re-interpretation of its proper ends. Therefore, it is a need to return to traditional ways that seem to have lost vigour for the dominance of the ideal of a scientific medicine, for the market rules and bureaucratized health care. In this intersection, the emphasis on a virtue ethic on the professional ethos, grounded on the engagement with the patient whose benefit gives meaning to the activity and medical institutions, is indispensable for the balance of the failures of a principle-based ethic without renouncing to the effective achievement of moral universalism. The market failures approach to business ethics has recently garnered substantial critical attention (see, e.g., Cohen and Peterson 2019; Moriarty 2020; Steinberg 2017; Hsieh 2017; von Kriegstein 2016; Smith 2018; Endorfer and Larue 2022; Singer 2018). Though precursors of this view can be found in the literature (e.g., McMahon 1981; Friedman 1970), it was Joseph Heath (2004, 2006, 2014, 2023) who developed the approach and gave it its name. The market failures approach (henceforth: MFA) is concerned with the (...) ethical obligations of managers of firms (Heath 2014, 69). Roughly, it holds that managers ought not to conduct their businesses in a way that exploits market failures. “Market failure” is a technical term, meaning any failure of the conditions of the first fundamental welfare theorem, sometimes called the “Pareto conditions” (see Arrow 1951). The theorem states that if the Pareto conditions hold, then the market equilibrium will use society’s scarce resources efficiently, meaning that no one could be made better-off without making anyone else worse off. Efficiency, according to Heath (2014, chapter 7), is the implicit morality of the market. We coordinate much of our shared activity using markets, Heath claims, because of their ability to produce efficient results. Markets are good forms of social organization, according to Heath, because they are the best way to promote our values given empirical facts about the frailties of human psychology and the informational constraints that we face. As such, managers ought not compromise the very conditions that justify a market economy by profiting from breakdowns in the market’s efficiency. Managers are permitted to maximize profits, so long as they do not violate the market’s norm of efficiency in so doing. This is because the fundamental justification for the profit motive is that it is necessary for the operation of the price system which is essential to the efficiency properties of markets. In this paper, I will argue that the MFA is more general than even Heath himself claims. The MFA describes the professional obligations of managers, but the view I develop, the generalized market failures approach, describes the obligations of all market participants. Since efficiency is the implicit morality of the market, it binds not just managers, but all market participants, including consumers, investors and workers. Market participants are permitted to maximize the benefit they gain from market interactions, as long as they do so in a way that does not take advantage of any market failures. Generalizing the MFA in this way has three benefits: first, we gain a unified understanding of the ethics of non-managerial market roles; second, we will develop an even better understanding of the duties of managers; finally, it gives us the resources to respond to some familiar objections to the MFA found in the literature. In the next section, I will further motivate the MFA and explain how this motivation can be easily generalized to other market roles. Importantly, one can avoid benefiting from a market failure in two distinct ways: by avoiding transactions that exploit market failures or by transacting in such markets and then remediating the harm done, by compensating those negatively affected by the market failure. This section concludes by discussing how the remediation duties are to be split between the transacting parties and how to identify the parties to whom compensation is owed. In section 3, I use the tools of the generalized MFA to develop a unified ethics of consumption, investment and labor, respectively. This is the basis of a grand abductive argument for the generalized MFA. The view is strongly supported by the fact that it provides attractive and unifying explanations of our obligations in domains as variegated as carbon offsetting, CEO compensation, the reparations white Americans owe to black Americans and occupational licensure. Is it OK to lie to Siri? Is it bad to mistreat a robot for our own pleasure? Under what condition should we grant a moral status to an artificial intelligence (AI) system? This paper looks at different arguments for granting moral status to an AI system: the idea of indirect duties, the relational argument, the argument from intelligence, the arguments from life and information, and the argument from sentience. In each but the last case, we find unresolved (...) issues with the particular argument, which leads us to move to a different one. We leave the idea of indirect duties aside since these duties do not imply considering an AI system for its own sake. The paper rejects the relational argument and the argument from intelligence. The argument from life may lead us to grant a moral status to an AI system, but only in a weak sense. Sentience, by contrast, is a strong argument for the moral status of an AI system—based, among other things, on the Aristotelian principle of equality: that same cases should be treated in the same way. The paper points out, however, that no AI system is sentient given the current level of technological development. (shrink)

El objetivo de este artículo es analizar el concepto de donación en la ética contemporánea. Este análisis se realiza en tres momentos: el primero se sitúa en la introducción y muestra que es un concepto importante en el que convergen la fenomenología, el personalismo y la hermenéutica. Esta convergencia no solo supone un uso frecuente del concepto sino un abuso del mismo cuando se construye de espalda a las mediaciones objetivas o institucionales que lo condicionan. El segundo presenta una antropología (...) del don y muestra su relación con los objetos, la reciprocidad, la deuda y la libertad. En el tercer momento se describe la filosofía de la donación de Paul Ricoeur, donde se comprueba un uso crítico y reflexivo de esta categoría, así como su diálogo con M. Hénaff. The aim of this paper is to analyze the concept of donation in contemporary ethics. This analysis is done in three stages: the first is the introduction and shows that it is an important concept in the converging phenomenology, personalism and hermeneutics. This convergence is not only a frequent use of the concept but an abuse of it when builáng back to mediation or institutional objective that condition. The second presents an anthropology of the gift and shows their relationship to objects, reciprocity, debí and freedom. The third moment descubes the philosophy of Paúl Ricoeur donation, which verifies critical and reflective use of this category and its dialogue with M. Hénaff. (shrink)

In this paper, prediction markets that encourage traders to bet on matters of life and death are used to explore the varieties and dynamics of moral repugnance. We define moral repugnance as morally charged feelings of revulsion that correspond (correctly, incorrectly, and indeterminately) to moral reasons and contexts. Rich variations of moral repugnance and their dynamic qualities are presented by investigating the contextual frames in which they arise. These contextual frames constitute interacting conditions composed of (...) information about states of affairs, moral reasons, and feelings of revulsion. Through careful study of two medical prediction markets that encourage betting on death, we can observe the interaction between these causal conditions to see how the varieties of moral repugnance emerge. We also present three interesting results that arise from analyzing the dynamics of moral repugnance in response to prediction markets. First, a prediction market can elicit several conflicting types of moral repugnance at the same time. Second, moral indeterminacy can arise in two different ways when judging prediction markets. Finally, some prediction markets can generate a moral endogeneity problem, a disruptive feedback loop between a given prediction market and the morally relevant outcome it predicts. (shrink)

This work contributes to recent transdisciplinary efforts to view the Haitian slave revolt (1791–1804) as the historical inspiration for Hegel’s master-slave dialectic. Reconstructions offered by contemporary postcolonial scholars argue that the Haitian revolt was chronicled in Minerva as Hegel raced to finish his Phenomenology. Benhabib recently recognized the Hegel-Haiti thesis as entailing the sort of inclusive dialogical learning process necessary to validate subaltern experiences. The thesis has also drawn its share of sceptical scrutiny as Badiou claims that it risks forcing (...) an unnecessary moral dissymmetry, neglects objectionable features of enslavement and imposes a mismatch between apolitical subject and revolutionary. In reply, we appeal to the pioneering work of Tavares to show that the asymmetrical construction of classification schemes for persons of mixed-racial statuses accords with decades of documented literary exchanges between Hegel and Gregoire. We then turn to the work of James on the role of mixed-race merchants in the testimonial accounts of late 18th century French historians to show that European literate publics were well aware of the extremely coercive forms of commodified labour found in Saint-Domingue. We then invoke the archival work of Du Bois on French, British and American parliamentary proceedings that show the provisional colonial identities ascribed to Caribbean subjects did not hinder their self-conscious exercise of political agency. Viewing Hegel in terms of the historiographic records of the racial ontologies of early modern transatlantic literary exchanges helps explain how he adapted these tropes concerning mixed-race subjects in a manner that better explains many of the anomalous features of the dialectic. However, conferring the Haitian revolution its proper world-historical warrant as inspiration for his infamous master-slave dialectic need not lead us to overlook Hegel’s complicity with many of the epistemic and ontological flaws of colonial tropes held in early modern transatlantic print. The financial crisis of 2008–2009 presents us with the opportunity to not only understand what has happened in the markets but also to reflect on the purpose of the marketplace. Drawing from expert economic analyses, we first assess the central lesson of the crisis—the failure of self-regulation by rational self-interest to moderate externalized risk in financial markets. Second, we ask the philosophical question occasioned by the crisis concerning the moral meaning of economic activity: Is market exchange solely for (...) the sake of self-interest? Reflecting on the poetry of Kahlil Gibran and engaging with the recent encyclical of Pope Benedict XVI, we turn our attention from political economy to moral economy: the relationships among market exchange, self-interest, and the common good—and, in particular, the prior conditions of market exchange and their moral significance for the present crisis. Saint Augustine is sometimes introduced as the first theologian-philosopher, a founder of the Western theologico-philosophical tradition, and a figure who unites two historical times—the Late Antiquity with the Middle Ages—and two different major schools—the Hellenistic philosophy with Christianity. Augustine lives and writes in the era of eudaimonism, teleology and virtue ethics, and he accomplishes, as we will see, a clear shift in the context of these doctrines. In this paper, we reconstruct Augustine’s philosophical approach to human psychology, looking at the (...) elements that bring together a philosophical anthropology, especially by focusing on human agency. Through an interpretative study of De libero arbitrio, we will address concepts such as the soul, freedom of choice, virtue, justice, faith and knowledge, seen as components of action, human freedom, intellect and the will. My main claim is that Augustinian thought and medieval philosophy generally can still offer arguments in practical philosophy as much as they can promote our understanding of moral agency. I intend to revive the interest both in this particular Augustinian work and in the forgotten concept of liberum arbitrium that is introduced and represents Augustine’s idea of a mediator, an arbitrator between reason and the will. This paper argues that economic agents, including corporations, have the duty to further justice, not just a duty merely to comply with laws and do their share. The duty to further justice is the requirement to assist in the establishment of just arrangements when they do not exist in society. The paper is grounded in liberal theory and draws heavily on one liberal theorist, Kant. We show that the duty to further justice must be interpreted as a duty of virtue (...) that is owed. This means that the duty is not enforceable but that violating this duty is still wrong and not merely non-virtuous. Our analysis has consequences for the morality of commercial life. It is often suggested that the morality of the market is a special, restricted morality that is leaner than the morality that agents must acknowledge outside the market. If our analysis is correct, the duty to further justice cannot be exempted from market morality, even if it is agreed that this must be leaner than the morality outside commercial life. Our analysis also has direct consequences for John Ruggie’s view on the responsibilities of businesses. Ruggie has never explicitly acknowledged a duty on the part of business enterprises to further justice. If our analysis is correct, his view is contradictory in that it presupposes the normative validity of free market enterprise yet shrinks from taking into account the conditions of its possibility. In this paper we engage with and contribute to the critical project of highlighting the dilemmas that arise from structurally unequal and unjust social, political, and institutional realities when dealing with past wrongs or, better phrased, historic injustices. We emphasise the present-time character of historic injustices. We think that there is a risk of allochronism in discussing historic injustices mainly as wrongs done in the past. This risk consists in making people forget that redressing these injustices is something to be (...) done in an unjust present structured by domination, and that those very past wrongs and harms helped to shape the present-time condition of structural injustice. As the misplacing in the past phenomena that occur in the present and in one’s practical context, allochronism has the effect that people do not feel responsible for those present-time injustices that derive from wrongs done in the past. Our aim is to propose one way of dealing with this risk of misallocating responsibility (and thus accountability), which consists in intersecting the notion of historic injustices with the notion of coloniality. After showing how an approach oriented by the notion of coloniality helps surmount the negative effects of allochronism and provides a significant complement to a structural approach to injustice (Sect. ‘ Coloniality and Responsibility for Justice ’), we turn to Frantz Fanon (Sect. ‘ Fanon ’) and José Carlos Mariátegui (Sect. ‘ Mariátegui ’) to illustrate the relationship between coloniality and justice and how it is possible to render a construal of ‘past wrongs’ without losing sight of their pervasiveness in the present time. When visual attention is directed away from a stimulus, neural processing is weak and strength and precision of sensory data decreases. From a computational perspective, in such situations observers should give more weight to prior expectations in order to behave optimally during a discrimination task. Here we test a signal detection theoretic model that counter-intuitively predicts subjects will do just the opposite in a discrimination task with two stimuli, one attended and one unattended: when subjects are probed to discriminate the (...) unattended stimulus, they rely less on prior information about the probed stimulus’ identity. The model is in part inspired by recent findings that attention reduces trial-by-trial variability of the neuronal population response and that they use a common criterion for attended and unattended trials. In five different visual discrimination experiments, when attention was directed away from the target stimulus, subjects did not adjust their response bias in reaction to a change in stimulus presentation frequency despite being fully informed and despite the presence of performance feedback and monetary and social incentives. This indicates that subjects did not rely more on the priors under conditions of inattention as would be predicted by a Bayes-optimal observer model. These results inform and constrain future models of Bayesian inference in the human brain. (shrink)

Over the past decades, the modernization of agriculture in the Western world has contributed not only to a rapid increase in food production but also to environmental and societal concerns over issues such as greenhouse gas emissions, soil quality and biodiversity loss. Many of these concerns, for example those related to animal welfare or labor conditions, are stuck in controversies and apparently deadlocked debates. As a result we observe a paradox in which a wide range of corporate social responsibility (...) initiatives, originally seeking to reconnect agriculture and society, frequently provoke debate, conflict, and protests. In order to make sense of this pattern, the present paper contends that Western agriculture is marked by moral complexity, i.e., the tendency of multiple legitimate moral standpoints to proliferate without the realistic prospect of a consensus. This contention is buttressed by a conceptual framework that draws inspiration the contemporary business ethics and systems-theoretic scholarship. From the systems-theoretic point of view, the evolution of moral complexity is traced back to the processes of agricultural modernization, specialization, and differentiation, each of which suppresses the responsiveness of the economic and legal institutions to the full range of societal and environmental concerns about agriculture. From the business ethics point of view, moral complexity is shown to prevent the transformation of the ethical responsibilities into the legal and economic responsibilities despite the ongoing institutionalization of CSR. Navigating moral complexity is shown to require moral judgments which are necessarily personal and contestable. These judgments are implicated in those CSR initiatives that require dealing with trade-offs among the different sustainability issues. (shrink)
