The year 1492 is only the last in a series of “ends” that inform the representation of medieval Spain in modern Jewish historical and literary discourses. These ends simultaneously mirror the traumas of history and shed light on the discursive process by which hermetic boundaries are set between periods, communities, and texts. This book addresses the representation of the twelfth and thirteenth centuries as the end of al-Andalus (Islamic Spain). Here, the end works to locate and separate Muslim from (...) class='Hi'>Christian Spain, Jews from Arabs, philosophy from Kabbalah, Kabbalah from literature, and texts from contexts. The book offers a reading of texts that emerge from its Andalusi, Jewish, and Arabic cultural sphere: Maimonides’ Guide of the Perplexed; the major text of Kabbalah, the Zohar; and the Arabic rhymed prose narrative of Ibn al-Astarkuwi. The author argues that these texts are written in a language that disrupts the possibility of locating it in a pre-existing cultural situation, a recognizable literary tradition, or a particular genre. At stake are issues – texts and contexts – that have gained particular urgency in the writings of such recent thinkers as Walter Benjamin, Jacques Derrida, Giorgio Agamben, Jean-Luc Nancy, and Avital Ronell. The book reads the place and taking place of language, interrogating the notion of disappearing contexts and the view that language is derivative of its true place, the context that, having ended, is mourned as silent and lost. In much of the existing research concerning Aljamiado literature, we can observe attempts to assign individual texts or even the whole corpus unequivocally to a Spanish or Arabic/islamic tradition. However, these attempts fail to adequately address the specificities of these texts and sometimes actively obscure important connections. This can be shown through an analysis of the Coplas del Alhichante de Puey Monzón, a pilgrimage narrative in verse from the sixteenth century that has so far mostly been seen as a (...) continuation of the Arabic riḥla. This paper provides an overview of the history, past research and editions, and poetical form of the text, as well as a proposed date for its production, followed by a detailed analysis concerning its possible function which serves as a basis for comparing it to pilgrimage narratives from the Arabic/islamic tradition and its Spanish/christian counterparts. Contrary to what is usually assumed, the Coplas have more in common with the latter than with Arabic riḥla texts. They can therefore be interpreted as a product of a cultural “contact zone” as defined by Mary Louise Pratt. Rather than merely trying to preserve their Islamic heritage and passively receiving Christian influence, Mudéjares and Moriscos actively participated in contemporary developments in Spanish literature and used them for their own ends. For many, the study of literature is still an aesthetic beauty pageant in which “great books” like Laurence Sterne’s Tristram Shandy (1767) or Marie de la Vergne de La Fayette’s La princesse de Clèves (1678) are paraded across the stage in a contest to seduce the Western intelligentsia. 1 The postmodern student of literature may not have much concern for this age-old territorial contest, but she might be interested to learn that the fallout from Hispanism’s quest for the “first modern novel” has involved so much attention to, indeed complication of, Don Quixote, that the book now resembles more a postmodern text than an early modern one. At the turn of the century, we have been left with what Jorge Luis Borges would recognize as an “aleph”: an infinite ideological labyrinth that reflects and/or cannibalizes all forms, thereby escaping all attempts [End Page 68] to describe it. 2 Whatever we currently mean by “Cervantes” (an author, a collection of texts, an ideological construction, and so forth) carries with it an impressive range of critical responses. Cervantes has been labeled converso (Castro, Canavaggio), Christian humanist (Castro, Bataillon, Forcione, Herrero, Vilanova), disillusioned secularist (Lukács, Cascardi), precapitalist (Johnson), anti-essentialist (Wilson), anti-Eusebian (Presberg), Menippean (Bakhtin), feminist (El Saffar, Rabin, Cruz), sadist (Nabokov), ethnocentric imperialist (Mariscal), medieval (Gorfkle), homophobic (Martín), non-organicist Aristotelian (Read), and either discursively or actually homosexual (Combet, Rossi, Smith, Arrabal). This list is nowhere near complete, but the reader will grasp the robust effects of the plurality of perspectives on Cervantes.Each of these interpretations is valid to varying degrees within various contexts, but at present I am interested in reading Cervantes as the author of a multicultural manifesto on behalf of the Moriscos of Southern Spain. 3 Within the contexts of French Marxist philosopher Louis Althusser and Palestinian postcolonial literary critic Edward Said, materialist, postcolonial, and multicultural critiques of various forms of power and their ideologies can be seen as the fundamental propositions of Cervantes’s Don Quixote. 4 Cervantes’s ultimate orientation may perhaps be inescapably Eurocentric, but his responses to the European experience of the rise and expansion of an ethnocentric militaristic nation state are relatively centrifugal when compared to the attitudes of many of his contemporaries.In surveying some of the antihegemonic details of Cervantes’s novel, I am also interested in dispelling the popular myth of Don Quixote. Two brief Late Antique religious texts, respectively by the monk Theophanis and by Monoimus the Arab, present an interesting problem of whether they embody the authors’ experience, or whether they are merely literary constructs. Rather than approaching this issue through the lens of theory, the article shows how phenomenological analysis and studies of living subjectivity can be engaged with the text in order to clarify the contents of introspective experience and the genesis of its religious connotations. The analysis uncovers a (...) previously unnoticed form of embodied introspective religious experience which is structured as a ladder with a distinct internal structure with the high degree of synchronic and diachronic stability. This approach also helps one identify the specific introspective techniques in the canonical and non-canonical literature of early Christian tradition, as related to the concepts of “ theosis ” and “ kenosys ”, as well as to suggest some neurological correspondents of religious cognition. This is the first critical edition and study of a unique and important Muslim polemic against Christians and Jews. The Book of Disputation was written in Arabic by a Mudejar (subject Muslim living under Christian rule in late medieval Iberia) and offers new insight into the cultural and intellectual life of this Muslim minority. The text advances arguments drawn from natural philosophy-largely from Aristotle and Averroes-along with more traditional revealed sources such as the Qur'an and the Bible. Mudejar (...) communities suffered a diminution of religious and political intelligentsia over time. This text, however, highlights the author's particular conception of the world as the creation of God in his defense of Islam, demonstrates the vitality of intellectual life among Muslims in medieval Christian Iberia, and documents the continued cultivation of natural philosophy within these Muslim communities. The philosophical debate presented in these pages is extracted from a 13th-century Coptic Arabic summa ecclesiastica. The venue is alleged to have taken place in Alexandria under the aegis of its proper founder. In a gathering of five philosophers or sages coming from India to the Maghreb, passing of course through Greece, amongst whom was present the great Aristotle, Alexander's preceptor and the undisputed authority that summed up the debate and put an end to it. The disputation turns on (...) the existence or not of a supreme creator and organizer, reminding the public sessions convened by the Sassanid and Muslim Rulers. However, the mise en scène here is linked without contest to the famous encounter of 325 b.C. between the Macedonian Conqueror and the Brahmans or Indian gymnosophites. We know how this episode was glossed in different ways in the Greek literature until it was “recovered” in an apologetic monotheistic view by the new Christian imperial order from the 4th century a.C. onward. Although our Coptic writer from the Middle Ages intends to prove with the text he offers to us the rightness of the “miaphysite” teaching of his Church, he, or his source, stands fully in line with that tradition, despite the fact that we could not trace a specific source from the rich variety of linguistic traditions on the matter. All the same, the ideological and linguistic analysis of the text brings us to suggest a Greek original that goes back to Late Antiquity.RésuméTiré d'une somme ecclésiastique copto-arabe du XIIIe siècle, le débat philosophique que nous présentons ici, est prétendu avoir eu lieu à Alexandrie, sous l'égide de son propre fondateur. Given the civic needs of open Western societies which respect pluralism, democracy and human rights, how should Christians read the Qur’an? I examine four major methods or ways on how Christians do read the Qur’an, and demonstrate that all are inappropriate to the needs of our modern secular democracies. These are often allied to approaches that use the mask of revisionist scholarship to conceal malice and irrational hatred of Islamic values. First, major Christian methods that approach Islam, the Qur’an, (...) and the Prophet Muhammad could be entitled as follows, successively in this chapter: the non/reception method, the externalization method, the rejection method, and the paternalist method. Examples of such methods will be referred to. Second, a further examination of revisionist scholarship and literature shows other methods of approaching Islam and its sacred text and prophet; here, five other methods are outlined, which intertwine with the first four methods; these five are as follows: the Qur’an’s alleged misunderstanding of Christian dogmas method, the radical skepticism of the origins of Islam method, the Qur’an’s half-way to truth method, the Qur’an’s unoriginality method, and Muhammad as a messenger for the Arabs only method. Critical comments follow each of these methods, as a way of overcoming biases and prejudices that nurture Islamophobia and right-wing parties and populist movements. (shrink)

It will present both current challenges and historical perspectives in the relation between logic and law. The perspectives to be discussed involve the interface of the following studies.

_Making Sense of Tantric Buddhism_ fundamentally rethinks the nature of the transgressive theories and practices of the Buddhist Tantric traditions, challenging the notion that the Tantras were "marginal" or primitive and situating them instead--both ideologically and institutionally--within larger trends in mainstream Buddhist and Indian culture. Critically surveying prior scholarship, Wedemeyer exposes the fallacies of attributing Tantric transgression to either the passions of lusty monks, primitive tribal rites, or slavish imitation of Saiva traditions. Through comparative analysis of modern historical narratives--that depict (...) Tantrism as a degenerate form of Buddhism, a primal religious undercurrent, or medieval ritualism--he likewise demonstrates these to be stock patterns in the European historical imagination. Through close analysis of primary sources, Wedemeyer reveals the lived world of Tantric Buddhism as largely continuous with the Indian religious mainstream and deploys contemporary methods of semiotic and structural analysis to make sense of its seemingly repellent and immoral injunctions. Innovative, semiological readings of the influential _Guhyasamaja Tantra_ underscore the text's overriding concern with purity, pollution, and transcendent insight--issues shared by all Indic religions--and a large-scale, quantitative study of Tantric literature shows its radical antinomianism to be a highly managed ritual observance restricted to a sacerdotal elite. These insights into Tantric scripture and ritual clarify the continuities between South Asian Tantrism and broader currents in Indian religion, illustrating how thoroughly these "radical" communities were integrated into the intellectual, institutional, and social structures of South Asian Buddhism. Based on the concept of shareholder primacy, many scholars have argued that it is more important for businesses to earn profits for their shareholders than to provide benefits to society at large. Corporate social responsibility is often regarded as an investment that comes at the expense of shareholders. In contrast, research analyzing the connections between the equity ownership structure of a company and its level of CSR engagement suggests that CSR offers benefits to shareholders that go beyond direct financial returns (...) from investments. This study provides a comprehensive review and systematic assessment of theoretical considerations and approaches regarding different forms of equity ownership and their relationships to CSR, and it discusses the relevant benefits and motivations of shareholders. The perceived value of these CSR benefits varies among different types of shareholders, as they assign unequal values to short-term financial or to rather long-term CSR benefits. Based on a literature sample of 146 publications, this review demonstrates central problems inherent in previous analyses. Given the ambiguous and partially contradictory findings of prior research, this study identifies potential moderating influences that help clarify empirical evidence. A contingency approach is suggested in future research, as this can help resolve the problem of contradictory empirical findings and theoretical arguments. (shrink)

Corporations significantly influence the public and political spheres. In light of this corporate power in society, academics have criticized the lack of legitimization (i.e., the legitimacy gap) and highlighted a potential divergence between corporate resource allocation and the needs and preferences of the public (i.e., the social issues gap). To address these problems, democratizing organizations has been proposed as a potential solution. In line with this, the authors argue that an increase in corporate power outside the economic realm should be (...) counterbalanced by more democratic corporate governance (i.e., an internalization of democracy). While important groundwork exists, academic attention to these topics remains limited. The authors provide an overview of the literature linking corporate power and the claim for democratizing organizations, advocate for legitimization, identify research gaps, and develop a research agenda to inspire and guide future research efforts. The paper's findings suggest the importance of conceptual and empirical research on the micro-, meso-, and macro-levels and the cross-level effects, which is needed to advance this incipient research area. Future research must (1) clearly define corporate power and discuss how democratizing organizations can contribute to more legitimate organizational decisions, (2) unveil novel approaches for more democratic corporate governance, and (3) understand the organizational- and individual-level factors necessary for the successful realization of democratic organizations. This article explores Muslim conversion to Christianity using a body of hagio-graphical sources in Arabic, Armenian, Georgian, Greek, and Latin. Through these lives of Christian martyrs, the article seeks to understand why Muslims undertook the surprising journey from “mosque to church” in the early centuries after the conquests. Many studies of Islamization are teleological, aiming to explain the large-scale conversion of the Middle East by the end of the Crusades. In contrast, this article aims to show why Islamization—especially (...) in the Umayyad and early ʿAbbāsid periods—could be highly contingent, even fragile, at a time when Muslims formed a numerical minority in many regions under their control. I.J. Good's ``On the Principle of Total Evidence" (1967) looms large in decision theory and Bayesian epistemology. Good proves that in Savage's (1954) decision theory, a coherent agent always prefers to collect, rather than ignore, free evidence. It is now well known that Good's result was prefigured in an unpublished note by Frank Ramsey (Skyrms 2006). The present paper highlights another early forerunner to Good's argument, appearing in Janina Hosiasson's ``Why do We Prefer Probabilities Relative to Many Data?" (1931), that (...) has been neglected in the literature. Section 1 reviews Good's argument and the problem it was meant to resolve; call this the \textit{value of evidence problem}. Section 2 offers a brief history of the value of evidence problem and provides biographical background to contextualize Hosiasson's contribution. Section 3 explicates the central argument of Hosiasson's paper and considers its relationship to Good's (1967). (shrink)

This paper discusses two recent books by Vicki Müller-Lüneschloß on Schelling's Stuttgart Private Lectures.

In 1764, Kant published his Observations on the Feeling of the Beautiful and the Sublime and in 1790 his influential third Critique , the Critique of the Power of Judgment . The latter contains two parts, the 'Critique of the Aesthetic Power of Judgment' and the 'Critique of the Teleological Power of Judgment'. They reveal a new principle, namely the a priori principle of purposiveness ( Zweckmäßigkeit ) of our power of judgment, and thereby offer new a priori grounds for (...) beauty and biology within the framework of Kant's transcendental philosophy. They also unite the previous two Critiques , the Critique of Pure Reason and the Critique of Practical Reason . Besides contributing to general and systematic aspects within his transcendental philosophy, Kant's aesthetics also offers new insights into old problems. It deals with feeling versus experience, subjectivity versus objectivity, disinterested pleasure, aesthetic universality, free and adherent beauty, the sensus communis , genius, aesthetic ideas, beauty as the symbol of morality, beauty of nature versus beauty of art, the sublime, and the supersensible. In this article I will limit myself to this critical aesthetics of Kant. But I will also discuss the ugly and the possibility of beauty in mathematics and see whether Kant's theory can successfully explain or deal with them. I will also compare his theory with philosophical ideas from a very different tradition, namely from Confucius, not only as a challenge to Kant's theory, but also because there is a growing interest from the Chinese side in combining ideas from Confucius and Kant, an interest that might well become influential in both East and West during the 21st century. En su mayoría, estos documentos están relacionados con el juez de Jerusalén �araf al-Di-n ?I-sa- b. Ga-nim y con el periodo en el que se mantuvo en el cargo, entre 793/1391 y 797/1395. La muestra de documentos estudiada, sobre todo inventarios de bienes, pero también documentos relacionados con otras áreas del derecho que pertenecen a la competencia del qa-di-, contradicen la hipótesis (...) de que los documentos del corpus del Haram al-�ari-f son registros del tribunal compilados sistemáticamente en un archivo. Los certificados judiciales sobre ventas de bienes inmuebles y otras transacciones que se han conservado de otros periodos en el corpus no aparecen precisamente para el periodo que va entre los años 793/1391 y 797/1395. De esta época abundan también documentos relativos a las transacciones financieras realizadas dentro de instituciones para las que el juez tenía jurisdicción. La necrología realizada por el cronista contemporáneo Ibn Hiy^y^i- (d. 816/1413) abre una perspectiva interesante para explicar la selección de documentos relacionados con �araf al-Di-n, que estuvo involucrado en un enorme asunto de corrupción. Christian Marazzi's first book: a post-Fordist classic on the roots to economic crises in the contemporary age. Communication as work: we have recently experienced a profound transformation in the processes of production. While the assembly line excluded any form of linguistic productivity, today, there is no production without communication. The new technologies are linguistic machines. This revolution has produced a new kind of worker who is not a specialist but is versatile and infinitely adaptable. If standardized mass production was (...) dominant in the past, today we produce an array of different goods corresponding to specific consumer niches. This is the post-Fordist model described by Christian Marazzi in Capital and Affects. Tracing the development of this new model of labor from Toyota plants in Japan to the most recent innovations, Marazzi's critique goes beyond political economy to encompass issues related to social life, political engagement, democratic institutions, interpersonal relations, and the role of language in liberal democracies. This translation at long last makes Marazzi's first book available to English readers. Capital and Affects stands not only as the foundation to Marazzi's subsequent work, but as foundational work in post-Fordist literature, with an analysis startlingly relevant to today's troubled economic times. Alle philosophischen Grundbegriffe können zwar klar erkannt, ihrerseits aber nicht vermittels deutlicher Begriffe bestimmt werden. Deshalb rekurriert etwa Frege zur Erläuterung der Unterscheidung zwischen den kategorialen Begriffen „Begriff“ und „Gegenstand“ auf die Metapher des Ungesättigten. The western-based leadership and ethics literatures were reviewed to identify the key characteristics that conceptually define what it means to be an ethical leader. Data from the Global Leadership and Organizational Effectiveness (GLOBE) project were then used to analyze the degree to which four aspects of ethical leadership – Character/Integrity, Altruism, Collective Motivation, and Encouragement – were endorsed as important for effective leadership across cultures. First, using multi-group confirmatory factor analyses measurement equivalence of the ethical leadership scales was found, which (...) provides indication that the four dimensions have similar meaning across cultures. Then, using analysis of variance (ANOVA) tests each of the four dimensions were found to be universally endorsed as important for effective leadership. However, cultures also varied significantly in the degree of endorsement for each dimension. In the increasingly global business environment, these findings have implications for organizations implementing ethics programs across cultures and preparing leaders for expatriate assignments. We like to think of ourselves, our friends, and our families as decent people. We may not be saints, but we are still honest, relatively kind, and mostly trustworthy. Miller argues here that we are badly mistaken in thinking this. Hundreds of recent studies in psychology tell a different story: that we all have serious character flaws that prevent us from being as good as we think we are - and that we do not even recognize that these flaws exist. (...) But neither are most of us cruel or dishonest. Instead, Miller argues, we are a mixed bag. On the one hand, most of us in a group of bystanders will do nothing as someone cries out for help in an emergency. Yet it is also true that there will be many times when we will selflessly come to the aid of a complete stranger - and resist the urge to lie, cheat, or steal even if we could get away with it. Much depends on cues in our social environment. Miller uses this recent psychological literature to explain what the notion of "character" really means today, and how we can use this new understanding to develop a character better in sync with the kind of people we want to be. Political theorists have offered many accounts of collective decision-making under pluralism. I discuss a key dimension on which such accounts differ: the importance assigned not only to the choices made but also to the reasons underlying those choices. On that dimension, different accounts lie in between two extremes. The ‘minimal liberal account’ holds that collective decisions should be made only on practical actions or policies and that underlying reasons should be kept private. The ‘comprehensive deliberative account’ stresses the importance of (...) giving reasons for collective decisions, where such reasons should also be collectively decided. I compare these two accounts on the basis of a formal model developed in the growing literature on the ‘discursive dilemma’ and ‘judgment aggregation’ and address several questions: What is the trade-off between the (minimal liberal) demand for reaching agreement on outcomes and the (comprehensive deliberative) demand for reason-giving? How large should the ‘sphere of public reason’ be? When do the decision procedures suggested by the two accounts agree and when not? How good are these procedures at truthtracking on factual matters? What strategic incentives do they generate for decision-makers? My discussion identifies what is at stake in the choice between minimal liberal and comprehensive deliberative accounts of collective decisionmaking, and sheds light not only on these two ideal-typical accounts themselves, but also on many characteristics that intermediate accounts share with them. In normative political theory, it is widely accepted that democracy cannot be reduced to voting alone, but that it requires deliberation. In formal social choice theory, by contrast, the study of democracy has focused primarily on the aggregation of individual opinions into collective decisions, typically through voting. While the literature on deliberation has an optimistic flavour, the literature on social choice is more mixed. It is centred around several paradoxes and impossibility results identifying conflicts between different intuitively plausible desiderata. In (...) recent years, there has been a growing dialogue between the two literatures. This paper discusses the connections between them. Important insights are that (i) deliberation can complement aggregation and open up an escape route from some of its negative results; and (ii) the formal models of social choice theory can shed light on some aspects of deliberation, such as the nature of deliberation-induced opinion change.
