In A Theory of Justice, John Rawls’s first argument for the inherent stability of a well-ordered society seeks to establish that citizens of such a society would come to share the same or similar senses of justice. In his late work, Rawls significantly revised his second argument for stability, but he repeatedly pronounced himself satisfied with the first. However, the pluralism that so drastically reoriented Rawls’s mature theory also creates destabilizing forces absent in Theory. These destabilizing forces suggest that a (...) shared sense of justice among citizens will be more difficult to achieve. This paper examines Rawl’s late theory in detail to reconstruct how Rawls, despite his stated satisfaction, addressed the destabilizing effects of pluralism through revisions to his first argument for stability. It argues that in his late theory Rawls no longer claims that a well-ordered society could achieve inherent stability. This paper argues that neither a general right to exclude migrants nor a general right to migrate freely exists. The extent of the right to exclude or the right to migrate freely must instead, in the majority of cases, be determined indirectly by examining whether a given immigration law or policy would result in the violation of migrants right to exclude migrants is constrained by what the author calls the indirect principle of freedom of migration. Under this principle, if an (...) immigration law or policy cannot be imposed without violating a migrant's basic rights, then the law or policy cannot be legitimately implemented. The argument for this principle is undertaken both conceptually and substantively. It is then defended against the objections that on the one hand, it may not have enough critical force, and on the other, it may be overly restrictive of states’ power to exclude migrants. (shrink)

Bold approaches to data collection and large-scale quantitative advances have long been a preoccupation for social science researchers. In this commentary we further debate over the use of large-scale survey data and official statistics with ‘Big Data’ methodologists, and emphasise the ability of these resources to incorporate the essential social and cultural heredity that is intrinsic to the human sciences. In doing so, we introduce a series of new data-sets that integrate approximately 30 years of survey data on victimisation, fear (...) of crime and disorder and social attitudes with indicators of socio-economic conditions and policy outcomes in Britain. The data-sets that we outline below do not conform to typical conceptions of ‘Big Data’. But, we would contend, they are ‘big’ in terms of the volume, variety and complexity of data which has been collated and ‘big’ also in that they allow us to explore key questions pertaining to how social and economic policy change at the national level alters the attitudes and experiences of citizens. Importantly, they are also ‘small’ in the sense that the task of rendering the data usable, linking it and decoding it, required both manual processing and tacit knowledge of the context of the data and intentions of its creators. Two substantive comments are made. The first is methodological, and concerns Heyes's proposals for a critical test for theory of mind. The second is theoretical, and concerns the appropriateness of asking questions about theory of mind in nonhuman primates. Although Heyes warns against the apparent simplicity of the theory of mind hypothesis, she underplays the linguistic implications.

Oscar Wilde's The Picture of Dorian Gray, McGinn argues, presents in an extreme and exemplary form, the power of the aesthetic to conceal and to express evil; it shows us what happens if the aesthetic is allowed to dominate over the moral. The character of Dorian has an exterior beauty, which is taken as a sign of virtue, but he has an inner ugliness or an ugliness of soul, which is identified as moral depravity. The lesson of Dorian (...) class='Hi'>Gray, McGinn argues, is that the aesthetic and the moral are inseparable, and it is only the concept of the beautiful soul that can keep the aesthetic impulse under control. McGinn's latest brings together moral philosophy and literary analysis in a way that illuminates both. Setting out to enrich the domain of moral reflection by showing the value of literary texts as sources of moral illumination, McGinn starts by setting out an uncompromisingly realist ethical theory, arguing that morality is an area of objective truth and genuine knowledge. He goes on to address such subjects as the nature of goodness, evil character, and the meaning of monstrosity in the context of (...) an aesthetic theory of virtue, which maintains that goodness of character is the same thing as beauty of soul. On the first page of The Problem of Consciousness , Colin McGinn asks "How is it possible for conscious states to depend on brain states? How can technicolour phenomenology arise from soggy grey matter?" Many philosophers feel that questions like these pose an unanswerable challenge to physicalism. Aimed at philsophy graduates this book investigates mental content in a systematic way and advances a number of claims about how mental content states are related to the body and the world. Internalism is the thesis that they are; externalism is the theory that they are not.

Identity, existence, predication, necessity, and truth are fundamental philosophical concerns. Colin McGinn treats them both philosophically and logically, aiming for maximum clarity and minimum pointless formalism. He contends that there are real logical properties that challenge naturalistic metaphysical outlooks. These concepts are not definable, though we can say a good deal about how they work. The aim of Logical Properties is to bring philosophy back to philosophical logic.

According to the logical pluralism of Beall and Restall, there are several distinct relations of logical consequence. Some critics argue that logical pluralism suffers from what I call the collapse problem: that despite its intention to articulate a radically pluralistic doctrine about logic, the view unintentionally collapses into logical monism. In this paper, I propose a contextualist resolution of the collapse problem. This clarifies the mechanism responsible for a plurality of logics and handles the motivating data better than the original (...) view. There is an active debate within the field of phonology concerning the cognitive status of substantive phonetic factors such as ease of articulation and perceptual distinctiveness. A new framework is proposed in which substance acts as a bias, or prior, on phonological learning. Two experiments tested this framework with a method in which participants are first provided highly impoverished evidence of a new phonological pattern, and then tested on how they extend this pattern to novel contexts and novel sounds. Participants (...) were found to generalize velar palatalization (e.g., the change from [k] as in keep to [t⌢∫S] as in cheap) in a way that accords with linguistic typology, and that is predicted by a cognitive bias in favor of changes that relate perceptually similar sounds. Velar palatalization was extended from the mid front vowel context (i.e., before [e] as in cape) to the high front vowel context (i.e., before [i] as in keep), but not vice versa. The key explanatory notion of perceptual similarity is quantified with a psychological model of categorization, and the substantively biased framework is formalized as a conditional random field. Implications of these results for the debate on substance, theories of phonological generalization, and the formalization of similarity are discussed. (shrink)

Many weaknesses of game theory are cured by new models that embody simple cognitive principles, while maintaining the formalism and generality that makes game theory useful. Social preference models can generate team reasoning by combining reciprocation and correlated equilibrium. Models of limited iterated thinking explain data better than equilibrium models do; and they self-repair problems of implausibility and multiplicity of equilibria.

Nicolas Malebranche (1638-1715) holds that the senses, imagination, and passions aim at survival and the satisfaction of the body’s needs, rather than truth or the good of the mind. Each of these faculties makes a distinctive and, indeed, an indispensable contribution to the preservation of life. Commentators have largely focused on how the senses keep us alive. By comparison, the imagination and passions have been neglected. In this paper, I reconstruct Malebranche’s account of how the imagination contributes to the preservation (...) of the body by compensating for the limitations of the senses. First, the imagination represents non-actual states of affairs, such as probable or possible future states. Second, the imagination forges new and often helpful associations based on past experiences. Third, the imagination (mis)represents that objects will cause pleasure and pain, thereby imbuing them with emotional significance they would otherwise lack. Together, these features flesh out Malebranche’s view that the imagination is necessary for the preservation of life. (shrink)

ABSTRACTOscar Larsson’s sympathetic critique of constructivist institutionalism calls for a clarification of my understanding of subjectivity, inter-subjectivity, and their mutual interdependence. That interdependence lies at the heart of any genuinely constructivist approach, just as the interdependence of structure and agency lies at the heart of any genuinely institutionalist approach. As such, I reject the charge of subjectivism just as I would that of voluntarism. Building on the social ontology of Berger and Luckmann, we can distinguish between subjectivity and intra-subjectivity and (...) proceed to show how the latter implies a notion of inter-subjectivity. An example of the social construction of a political crisis shows that social facts are made and remade through a fusion of inter- and intra-subjectivities. (shrink)

While not underestimating the value of useful knowledge and skills, it is suggested that education should also develop the subjective self of the learner. A distinction is drawn between an ‘additive’ view of education which simply furnishes the individual with knowledge and skills and a ‘transformative’ concept which concerns itself with changes to more central parts of the learner's self. In developing a concept of the subjective self, reference is made to the Enlightenment notion of the autonomous rational self and (...) the interpersonal or cultural self of the Symbolic Interactionists and Communitarians. Particular attention, however, is given to Heidegger's three categories of entities experienced by the phenomenological self: the ‘present at hand’, the ‘ready to hand’ and those entities with whom we share the experience of ‘being with’. An attempt is made to interpret important aspects of education in terms of the development of learners' growing knowledge and deepening understanding of these three kinds of entity and the relation in which they stand to them. This paper contributes to the study of paracompleteness and paraconsistency. We present two logics that address the following questions in novel ways. How can the paracomplete theorist characterize the formulas that defy excluded middle while maintaining that not all formulas are of this kind? How can the paraconsistent theorist characterize the formulas that obey explosion while still maintaining that there are some formulas not of this kind?

Codes of ethics and conduct have become common in UK organisations. This paper explores how such codes are understood and responded to by those whom the codes seek to influence. The study is an interpretative one, based on interview material, in which a dialectical pattern is seen in employees’ reactions to codes. Initial contradictions are found in codes of ethics and in codes of conduct . These tensions create perceptions of a two‐tier system in organisations in which core employees are (...) subject to codes of ethics that are loosely applied, but non‐core staff are subject to codes of conduct that are strictly applied. However, even core staff are aware of a dialectical contradiction in their position. They believe that loyalty to the organisation is the price they pay for being allowed freedom of integrity by their organisations, but that the price they have to pay for showing integrity may be breaking faith with their organisations. This chiasmus of integrity and loyalty represents a difficulty for the project of improving standards of corporate citizenship. The use of this trope and other rhetorical figures to exemplify processes of understanding and interpretation in organisations is discussed. (shrink)

In this paper I examine the psychological traits that can play a constitutive role in having an evil character, using a recent affect-based account by Colin McGinn as my starting point. I distinguish several such traits and defend the importance of both affect and action-based approaches. I then argue that someone who possesses these characteristics to the greatest possible extent—the purely evil individual—can actually be less depraved than one whose character is not so thoroughly penetrated by such traits. The dichotomy between virtue and self‐interest or pleasure is held to face modern moral educators with a conflict between the interest of society and that of their pupils, as well as presenting obvious motivational difficulties. Three possibilities for mitigating this conflict are offered. First, it is argued that virtue is an essential constituent of our well‐being insofar as even undetected wickedness isolates us from others. Second, young people, alienated by the negative nature of conventional morality, may respond positively to certain (...) moral appeals in a way that is fulfilling and life‐enhancing. Third, it is argued that moral education which emphasises the rights of young people themselves alongside those of others would be both more reputable and more effective than that based on the opposition between virtue and self‐interest or pleasure. Philosophers of education have always been interested in epistemological issues. In their efforts to help inform educational theory and practice they have dealt extensively with concepts like knowledge, teaching, learning, thinking, understanding, belief, justification, theory, the disciplines, rationality and the like. Their inquiries have addressed issues about what kinds of knowledge are most important and worthwhile, and how knowledge and information might best be organised as curricular activity. They have also investigated the relationships between teaching and learning, belief and opinion, (...) knowledge and belief, and data and information. For some a key issue has been how students can become autonomous knowers. This issue has often been bound up with questions about what count as appropriate standards for reasonableness or rationality, and the conditions under which we can properly regard understanding as having occurred. During the past decade renewed interest has been shown in what is involved in becoming an authority, expert or competent performer in a given area of knowledge, as well as in how we evaluate and critique different or competing beliefs, theories, points of view or paradigms. Consciousness lacks extension and other spatial properties. But how can this be, if it arises from matter in space? The paper argues that this conundrum can only be solved by recognizing that our current conception of space is fundamentally inadequate. However, no other conception is available to us.

Property rights are the rules governing ownership in society. This Element offers an analytical framework to understand the origins and consequences of property rights. It conceptualizes of the political economy of property rights as a concern with the follow questions: What explains the origins of economic and legal property rights? What are the consequences of different property rights institutions for wealth creation, conservation, and political order? Why do property institutions change? Why do legal reforms relating to property rights such as (...) land redistribution and legal titling improve livelihoods in some contexts but not others? In analyzing property rights, the authors emphasize the complementarity of insights from a diversity of disciplinary perspectives, including Austrian economics, public choice, and institutional economics, including the Bloomington School of institutional analysis and political economy.
