El término '"Dialéctica" hace referencia tanto al movimiento de autodesenvolvimento del concepto - en este caso el de derecho y, em sentido amplio - como a la estrutura de ese movimiento, al cual Hegel trata de encuadrar en esquemas provenientes de la Lógica dei concepto, especialmente en la triada 'tesis - antítesis - síntesis', lo cual potencia la complejidad dei texto y dificulta su comprensión. Uma hermenéÚtica esclarecedora de la lógica dialéctica en juego, donde a la contradicción!e cabe el papel (...) protagónico, exige tener en cuenta estos aspectos como también e: hecho de que Hegel, en su concepción de la Dialéctica asume la herencia de la filosofia aristotélica, tanto como del Idealismo Trascendental moderno, los que se entremezclan permanentemente en intrincada red de múltiples significaciones. La distinción de todos estas aspectos y de su rol en la exposición de la Filosofia del Derecho es imprescindible, tanto para una interpretación adecuada de su letra y espíritu, como de su significación actual. This paper argues that patients' duties are derivable from the idea which typically grounds the idea of patients' rights: patient autonomy. The autonomous patient, joined in partnership with the health care professional, has self-regarding obligations and obligations to others, including health care professionals. This paper addresses two related topics: 1. The disanalogies between elective cosmetic practices and sex reassignment surgery. Why does it seem necessary for me – an aging professional woman – to ignore the blandishments of hairdressers wielding dyes and dermatologists wielding acids and scalpels? Why does it not seem equally necessary for a transgendered person to repudiate sex reassignment procedures? 2. The role of the body in identity and agency. How do phenomenological insights regarding the constitution of selfhood in relation (...) to the interplay between the body image and corporeal know-how contribute to an account of the agency of transgendered individuals? Studying several paintings by contemporary feminist artist Jenny Saville has advanced my thinking on these topics. Saville’s imagery is an invaluable aid to reflection on these issues because she uses her painterly technique, which critics often dub “virtuoso,” to represent lived human bodies. In her work, viewers encounter representations of subjectivized, agentic corporeity, as distinct from inert, objectified flesh. Moreover, her sympathetic engagement with nonconformist, devalued bodies helps to reconfigure the standard gestalts of the human body that viewers typically carry with them and thus to convert fear and/or disgust into appreciation and understanding. In this paper, I consider three of Saville’s paintings. Plan, Saville’s self-portrait as a nude female whose body has been prepped for liposuction, conveys the pathos of this procedure. Matrix is a nude portrait of self-described “gender variant visual artist” Del LaGrace Volcano. In the words of one critic Saville’s depiction of Volcano’s nude intersexed body “restores beauty to the primitive [female] genital organ.” Passage, another nude portrait of an intersexed individual, is an image of vibrant sexuality despite the presumptively jarring juxtaposition of breasts and a penis. I argue that conceiving the agentic subject as a rational deliberative capability that uses a conjoined body as the instrument of its will makes it impossible to theorize the agency of transgendered people. In contrast, when agentic subjects are understood as embodied subjects and embodiment is understood as a dimension of practical intelligence, the agency of transgendered individuals is intelligible. Ziel der Abhandlung ist die Untersuchung der grundlegenden Prinzipien einer autonombiologischen Kausalität. Wenn die Biologie in autonomer Weise auf ihr gemässe Prinzipien gegründet werden soll —wie das die Physik in ihrer Sphäre auch durchgeführt hat —, dann muss das biologische Denken sich zunächst von einem Idol befreien, das ihr von der klassischen Physik aufgezwungen ist. Das ist der Begriff des „Mechanismus”, der bei seiner Schaffung gewiss von grossem Werte auch für die Biologie gewesen ist, der aber heute dem biologischen Denken (...) grossen Schaden dadurch zufügt, dass er es in eine ihm völlig fremde Richtung zwängt.Die Organismen und alle ihre Organe von der einfachsten Zellorganelle bis zum komplexesten Organsystem sind aber keine Mechanismen sondern Holismen . Es wird versucht, die wesentlichen Kriterien des Holismusprinzips zu bestimmen. Zunächst gilt für sie das Axiom von v.Ehrenfels, demzufolge jeder Holismus „mehr ist als die Summe seiner Teile”. Das wird im einzelnen genauer analysiert. Weiterhin gilt für Holismen das Kompensationsprinzip vonGoethe. Damit im Zusammenhang stehen die Prinzipien der „spezifischen Energie” vonJohannes Müller, das Prinzip vonRedi , das Prinzip vonVernadsky über die Konstanz der Biosphäre, das Prinzip der phylogenetischen Kompensationen und das Prinzip von der „Ektropie” der Biosphäre.Alle diese Prinzipien werden im einzelnen diskutiert und analysiert. In engstem Zusammenhang miteinander bilden sie ein autonomes Axiomengefüge für die Biologische Erkenntnis, durch welches wiederum die eigentümlich „biologische Kausalität” charakterisiert ist. Genau in diesem Sinne sind Holismen „verae causae” .El presente ensayo tiene por fin supremo la investigación de los principios basicos de una autónoma causalidad biologica. Si se quiere fundar la Biologia en sus propios principios autónomos —como se lo ha hecho también con la Fisica misma —, entonces será primeramente necesario que la Biologia se delibera de una ideologia completamente extraña para ella, la cual la Fisica clásica le ha transferido. Esto es el concepto del “mecanismo”, que en su origin ha sido de gran valor también para la Biologia, pero que hoydia produce enorme daño a la Biologia.Los organismos y todos sus órganos de la mas simple organela celular hasta el mas complicado sistema de órganos sin embargo de ninguna manera no son mecanismos sino al contrario holismos . Ahora se ensaya de determinar los criterios esenciales del principio del holismo. Primero es valido para los holismos el axioma de v.Ehrenfels que dice que cada Organismo representa “más que la suma de sus partes”. Además vale para holismos el principio de la compensación deGoethe. Con esto están relacionados los principios de la “energia especifica” deJuan Müller, el axioma deRedi , el principio deVernadsky acerca de la constancia de la biósfera, el principio de las compensaciones filogenéticas y el principio de la “ectropia” de la biósfera.Todos los mencionados principios y axiomas serán discutidos y analizados en sus particularidades. En su conjunto representan ellos un sistema de axiomas autónomos para el conocimiento biológico, el cual como tal caracteriza también la asi llamada causalidad biologica. Hume presenta su teoría estética en el ensayo Sobre el criterio del gusto [On the Standard of Taste], en el que propone la existencia de un criterio [standard] capaz de zanjar discusiones de gusto. Ese criterio se basa en la existencia de ciertas formas y cualidades que complacen naturalmente a todo ser humano. Hume asevera que tal criterio corresponde a la opinión del crítico: un hombre que ha desplegado particularmente sus facultades cognoscitivas, lo cual le permite percibir esas finas cualidades (...) que suscitan naturalmente el placer de lo bello en el ser humano. Con respecto a en qué consisten esas formas y cualidades universalmente placenteras, Hume guarda silencio. Pretendo mostrar cómo la teoría de la emoción en la música desarrollada por Leonard Meyer en su texto Emoción y significado en la música (Emotion and Meaning in Music) puede aportar inmensidades en ese aspecto. La doctrina del «Diseño Inteligente» formulada por Phillip E. Johnson, Michael Behe, William A. Dembski o Stephen C. Meyer se presenta como una alternativa científica al Neodarwinismo. Para el naturalismo filosófico o el ateísmo, pero también para la comunidad científica, sólo es una forma de pseudo-ciencia dependiente de la doctrina del «creacionismo protestante» y la interpretación literal bíblica. Las críticas filosóficas más importantes, sin embargo, proceden del neo-tomismo norteamericano. En este artículo de investigación se muestra, que durante la fabricación de hierro, las escorias han sido una fuente información del producto obtenido. Esto aplica a toda la historia de la fabricación de este metal desde el inicio de la edad del hierro. Los estudios en este campo se conocen como arqueo de metalurgia y se inicia desde la paleo metalurgia hasta el presente. Las escorias primitivas obtenidas a partir de su separación de la masa de hierro sólida obtenidas en (...) procesos muy primitivos y más modernas como la forja catalana. Estudios petrográficos, de difracción de rayos X y de fluorescencia de rayos x, han revelado la existencia fayalita, en escorias siderometalúrgicas antigüas a temperaturas por debajo del punto eutéctico,deducidas como entre 1150°C y 1200°C. Más recientemente, la presencia de fayalita ha sido revelada en procesos de reducción operando con temperaturas menores a los 900°C. En este documento se presenta una explicación para tal hecho mediante un análisis de las energías asociadas a los sistemas. Cerámicos compuestos de FeO- SiO2-MgO- P2O5 presentes en dichos procesos. This paper explores the relationships between American phenomenology of music and conventional studies of musical analysis. The temporality of experience is a central topic in the phenomenology of music: recent research in USA has focused on musical time-consciousness (Schutz and Smith) or on analytical applications (Clifton, Lochhead, Ferrara). Many methods of musical analysis, like phenomenological methods, are concerned to study subjective temporal structures: Schenkerian and post-Schenkerian scholars (Salzer, Meyer, Narmour, Lewin) have elaborated specific systems for the explanation of musical (...) form on a experiential basis. Among the many applications of artificial intelligence (AI), virtual assistants are one of the tools most likely to grow in the future. The development of these systems may play an increasingly important role in many facets of our lives. Therefore, given their potential importance and present and future weight, it is worthwhile to analyze what kind of challenges they entail. In this chapter, we will provide an overview of the ethical aspects of artificial virtual assistants. First, we provide a conceptual (...) clarification of the term ‘virtual assistant’, including different types of interfaces and recommender systems. Second, we address three ethical issues related to the deployment of these systems: their effects on human agency and autonomy and the subsequent cognitive dependence they would generate; the human obsolescence that may cause a generalized extension of the dependence problem; and the invasions of privacy that virtual assistants may cause. Finally, we outline the debates about the use of virtual assistants to improve human moral decisions and some areas in which these systems can be applied. (shrink)

This paper presents two studies on the development and validation of a ten-item scale of epistemic vice and the relationship between epistemic vice and misinformation and fake news. Epistemic vices have been defined as character traits that interfere with acquiring, maintaining, and transmitting knowledge. Examples of epistemic vice are gullibility and indifference to knowledge. It has been hypothesized that epistemically vicious people are especially susceptible to misinformation and conspiracy theories. We conducted one exploratory and one confirmatory observational survey study on (...) Amazon Mechanical Turk among people living in the United States. We show that two psychological traits underlie the range of epistemic vices that we investigated: indifference to truth and rigidity. Indifference manifests itself in a lack of motivation to find the truth. Rigidity manifests itself in being insensitive to evidence. We develop a scale to measure epistemic vice with the subscales indifference and rigidity. The Epistemic Vice Scale is internally consistent; has good convergent, divergent, and discriminant validity; and is strongly associated with the endorsement of misinformation and conspiracy theories. Epistemic vice explains additional variance in the endorsement of misinformation and conspiracy theories over and above demographic and related psychological concepts and shows medium to large effect sizes across outcome measures. We demonstrate that epistemic vice differs from existing psychological constructs, and show that the scale can explain individual differences in dealing with misinformation and conspiracy theories. We conclude that epistemic vice might contribute to “postfactive” ways of thinking. (shrink)

In 1813, J.-V. Poncelet discovered that if there exists a polygon of n-sides, which is inscribed in a given conic and circumscribed about another conic, then infinitely many such polygons exist. This theorem became known as Poncelet’s porism, and the related polygons were called Poncelet’s polygons. In this article, we trace the history of the research about the existence of such polygons, from the “prehistorical” work of W. Chapple, of the middle of the eighteenth century, to the modern approach of (...) P. Griffiths in the late 1970s, and beyond. Esta entrevista se realizó en dos sesiones vía Zoom, cuyas fechas están ubicadas en agosto de 2021. La primera conversación que se tuvo consistió en que el filósofo Modesto Gómez Alonso brindara unas ideas panorámicas y reflexivas, las cuales se han colocado al inicio de cada resolución. Entretanto, en la segunda conversación, se partió de lo planteado anteriormente y de algunos apuntes que permitieron esbozar de una forma más contundente las respuestas. Todo este procedimiento sirvió para que se pudiera tratar (...) sobre la noción de la epistemología desde sus múltiples manifestaciones. Es por eso por lo que el filósofo Modesto Gómez recurrió a concepciones afines, como aquellas que proporcionan el conocimiento, al igual que buscó explicar con mayor detalle al citar a autores como Descartes, Sosa, entre otros. En ese sentido, esta entrevista tuvo el propósito de buscar las conexiones que existen de la Filosofía con la vida cotidiana en cuanto a que se indaga de las posibilidades de contribuir al conocimiento y contar con las herramientas adecuadas. This article demonstrates that non-mechanistic, dynamical explanations are a viable approach to explanation in the special sciences. The claim that dynamical models can be explanatory without reference to mechanisms has previously been met with three lines of criticism from mechanists: the causal relevance concern, the genuine laws concern, and the charge of predictivism. I argue, however, that these mechanist criticisms fail to defeat non-mechanistic, dynamical explanation. Using the examples of Haken et al.’s model of bimanual coordination, and Thelen et al.’s (...) dynamical field model of infant perseverative reaching, I show how each mechanist criticism fails once the standards of Woodward’s interventionist framework are applied to dynamical models. Este artículo cuestiona la composición endógena de los personajes protagónicos de los largometrajes Días de Santiago (2004) y Hombre Araña (2002). Ellos presentarán dos estereotipos distintos de vivencias y coincidirán con el cuestionamiento consuetudinario de sus propias identidades. Esa percepción permitirá precisar en el objetivo de este trabajo, que consiste en fundamentar las transgresiones psicológicas de los involucrados, pese a su configuración definida y reconocible para el espectador. Para lograrlo, se recurrirá al análisis sociológico que propone Iuri Lotman desde la (...) semiótica cultural, que será complementado con la confrontación con los filmes Un perro andaluz (1929), Tiempos modernos (1936), Ahí está el detalle (1940), Gregorio (1984) y La espalda del mundo (2000). Luego, se empleará la semiótica tensiva de Jacques Fontanille para elaborar esquemas afines al desenvolvimiento del superhéroe, así como también se diferenciarán los regímenes de sentido que se asemejan a la lógica de la trama. The purpose of this paper is to formulate first-order Peano arithmetic within the resources of relevant logic, and to demonstrate certain properties of the system thus formulated. Striking among these properties are the facts that it is trivial that relevant arithmetic is absolutely consistent, but classical first-order Peano arithmetic is straightforwardly contained in relevant arithmetic. Under, I shall show in particular that 0 = 1 is a non-theorem of relevant arithmetic; this, of course, is exactly the formula whose unprovability was (...) sought in the Hilbert program for proving arithmetic consistent. Under, I shall exhibit the requisite translation, drawing some Goedelian conclusions therefrom. Left open, however, is the critical problem whether Ackermann’s rule γ is admissible for theories of relevant arithmetic. The particular system of relevant Peano arithmetic featured in this paper shall be called R♯. Its logical base shall be the system R of relevant implication, taken in its first-order form RQ. Among other Peano arithmetics we shall consider here in particular the systems C♯, J♯, and RM3♯; these are based respectively on the classical logic C, the intuitionistic logic J, and the Sobocinski-Dunn semi-relevant logic RM3. And another feature of the paper will be the presentation of a system of natural deduction for R♯, along lines valid for first-order relevant theories in general. This formulation of R♯ makes it possible to construct relevantly valid arithmetical deductions in an easy and natural way; it is based on, but is in some respects more convenient than, the natural deduction formulations for relevant logics developed by Anderson and Belnap in Entailment. As we wrestle with the role and limits of policing, a political philosopher who spent over two decades as a New York City police officer and Vermont chief of police presents a normative account of what it means to police a pluralist democracy. Invoking his vast experience, Brandon del Pozo argues that we all have the prerogative to use force to protect others, but police embody the government's unique duty to do so effectively and with restraint. He recasts order maintenance (...) as brokering and enforcing the fair terms of social cooperation in our public spaces, for the protection of minority interests, and for a society where diverse conceptions of the good can flourish. The reasons why we police, he says, must be ones that all citizens can evaluate as equals. Social network structure has been argued to shape the structure of languages, as well as affect the spread of innovations and the formation of conventions in the community. Specifically, theoretical and computational models of language change predict that sparsely connected communities develop more systematic languages, while tightly knit communities can maintain high levels of linguistic complexity and variability. However, the role of social network structure in the cultural evolution of languages has never been tested experimentally. Here, we present results from (...) a behavioral group communication study, in which we examined the formation of new languages created in the lab by micro‐societies that varied in their network structure. We contrasted three types of social networks: fully connected, small‐world, and scale‐free. We examined the artificial languages created by these different networks with respect to their linguistic structure, communicative success, stability, and convergence. Results did not reveal any effect of network structure for any measure, with all languages becoming similarly more systematic, more accurate, more stable, and more shared over time. At the same time, small‐world networks showed the greatest variation in their convergence, stabilization, and emerging structure patterns, indicating that network structure can influence the community's susceptibility to random linguistic changes (i.e., drift). Mechanistic explanations are often said to explain because they reveal the causal structure of the world. Conversely, dynamical models supposedly lack explanatory power because they do not describe causal structure. The only way for dynamical models to produce causal explanations is via the 3M criterion: the model must be mapped onto a mechanism. This framing of the situation has become the received view around the viability of dynamical explanation. In this paper, I argue against this position and show that dynamical (...) models can themselves reveal causal structure and consequently produce nonmechanistic, dynamical explanations. Taking the example of cell fates from systems biology, I show how dynamical models, and specifically the attractor landscapes they describe, identify the causes of cell differentiation and explain why cells select particular fates. These dynamical features of the system better fit Woodward’s (2010, 2018) criteria of specificity and proportionality and make them the best candidate causes of cell fates than mechanisms. I also show how these causes are irreducible and inaccessible to mechanistic models, making 3M unworkable and counterproductive in this case. Dynamical models can reveal dynamical causes and thereby provide causal explanations. (shrink)

Some theories of time entail that the present can change before or after it has happened. Examples include views on which time-travelers can change the past, the glowing block theory, Peter Geach’s mutable future view, and the moving spotlight theory. This paper argues that such ante factum or posthumous change requires a heterodox “split time” view on which earlier-than is not the converse of later-than.

The assumption that students are differently talented often underlies the public and philosophical debate about the justice of school systems. It is striking that despite the centrality of the notion of ‘talent’ in these debates, the concept is hardly ever explicated. I will suggest two explications: First, philosophers who point to different talents often assume that these are somehow fixed potentials that pose limits to what someone can achieve. According to this understanding, no matter how hard someone tries, she simply (...) cannot perform well due to a lack of talent. Second, talking about different talents can be understood as saying that two students who will receive the same amount of educational resources are nevertheless expected to perform differently in the future. In the public as well as the philosophical debate it is common to assume that educational prospects should be equalized when it comes to unequal social backgrounds, but not when it comes to unequal talents. In this paper, I put into question three reasons that could speak in favor of this assumption: the first refers to the connection between talents and limits, the second to the relation between talents and the transformation of resources and the last one to the idea that talents somehow go back to the person’s true self. This paper offers an elementary proof that formal arithmetic is consistent. The system that will be proved consistent is a first-order theory R♯, based as usual on the Peano postulates and the recursion equations for + and ×. However, the reasoning will apply to any axiomatizable extension of R♯ got by adding classical arithmetical truths. Moreover, it will continue to apply through a large range of variation of the un- derlying logic of R♯, while on a simple and straightforward translation, (...) the classical first-order theory P♯ of Peano arithmetic turns out to be an exact subsystem of R♯. Since the reasoning is elementary, it is formalizable within R♯ itself; i.e., we can actually demonstrate within R♯ (or within P♯, if we care) a statement that, in a natural fashion, asserts the consistency of R♯ itself. The reader is unlikely to have missed the significance of the remarks just made. In plain English, this paper repeals Goedel’s famous second theorem. (That’s the one that asserts that sufficiently strong systems are inadequate to demonstrate their own consistency.) That theorem (or at least the significance usually claimed for it) was a mis- take—a subtle and understandable mistake, perhaps, but a mistake nonetheless. Accordingly, this paper reinstates the formal program which is often taken to have been blasted away by Goedel’s theorems— namely, the Hilbert program of demonstrating, by methods that everybody can recognize as effective and finitary, that intuitive mathematics is reliable. Indeed, the present consistency proof for arithmetic will be recognized as correct by anyone who can count to 3. (So much, indeed, for the claim that the reliability of arithmetic rests on transfinite induction up to ε0, and for the incredible mythology that underlies it.). (shrink)

Vice epistemology studies the qualities of individuals and collectives that undermine the creation, sharing, and storing of knowledge. There is no settled understanding of which epistemic vices exist at the collective level. Yet understanding which collective epistemic vices exist is important, both to facilitate research on the antecedents and effects of collective epistemic vice, and to advance philosophical discussions such as whether some collective epistemic vices are genuinely collective. I propose an empirical approach to identifying epistemic vices in corporations, analyzing (...) a large dataset of online employee reviews. The approach has parallels to the methodology for identifying the big-five personality traits. It surfaces epistemic vices that are attributed to corporations by its own members and reduces the number of vices to the minimum required to describe differences between corporations. This approach yields a new taxonomy of epistemic vices for corporations. While two vices identified have close correlates in the existing literature, four others have not been identified at all or only in aspects. Two of these vices are ‘genuinely’ collective in the sense that they can only be attributed to collectives. (shrink)

Si tratta di una vicenda che presenta i motivi fondamentali di ogni racconto epico e tragico. Ispirandosi a questa convinzione l’articolo ripercorre alcune delle maggiori opere letterarie che hanno raccontato da diversi punti di vista lo scontro tra Becket e il (...) suo re: alcune delle agiografie medievali, Alfred Tennyson, Conrad Ferdinand Meyer nel XIX secolo, e – nel XX – Thomas Stearns Eliot, Christopher Fry e Jean Anouilh. The relativist position on knowledge is summarized by Protagoras’ phrase “Man is the measure of all things”. Protagoras’ detractors countered that there was no reason for his pupils to employ him since, by his own admission, his lessons lacked privilege. This the educationist’s relativist paradox. The Enlightenment tradition of Descartes, Locke and Kant solved this paradox by distinguishing given objective knowledge from constructed subjective knowledge, but this position has itself been discredited by the work of Sellars, Quine and many other (...) thinkers. Because the Enlightenment solution to the educationist’s relativist paradox is no longer satisfactory, an alternative solution to this paradox is proposed. This alternative re-examines both the basis of empiricism and the role and origins of language, and introduces the concepts of triggered hallucinations, cognitive evolutionary pressure, and cognitive empathetic resonance. Cognitive empathetic resonance provides a mechanism that can explain how our thoughts and actions are made possible by language; it is language that acts as a creative and generative force and helps us to live in the world we do. This approach inverts the empiricist claim that ideas start off grounded in an external reality and develop into more sophisticated concepts. The view of ideas presented here is that ideas are free-floating and, if they are grounded at all, are grounded as an active post-hoc process. The conclusion is that although facts do exist and are privileged, this is not because they are ‘given’ but because they are the ante required to join a space of discourse. (shrink)

This paper presents 59 new studies (N = 72,310) which focus primarily on the “bat and ball problem.” It documents our attempts to understand the determinants of the erroneous intuition, our exploration of ways to stimulate reflection, and our discovery that the erroneous intuition often survives whatever further reflection can be induced. Our investigation helps inform conceptions of dual process models, as “system 1” processes often appear to override or corrupt “system 2” processes. Many choose to uphold their intuition, even (...) when directly confronted with simple arithmetic that contradicts it – especially if the intuition is approximately correct. (shrink)
