Kant's attempt to establish the principles behind the faculty of judgment remains one of the most important works on human reason.

When I began working on my dissertation on Kant’s aesthetic theory in 1971, I was able to read virtually all of the extant literature on the Critique of Judgment in English, German, andFrench going back to Hermann Cohen’s Kants Begr¨undung der A¨ sthetik of 1889, while also reading most of what I wanted to read of eighteenth-century British and German aesthetics before Kant—not because I had paid my dues to Evelyn Wood, but just because there was not all that much (...) to read.1 I pity the graduate student who sets out to write a dissertation on the third Critique now: since Donald Crawford, Francis Coleman, Jens Kulenkampff, Eva Schaper, and I published books on Kant’s aesthetics between 1974 and 1979 there has been a continuing flood of articles (this journal receives more submissions on Kant’s aesthetics annually than on any other historical topic) and books, a flood that has only accelerated since 2000. Confining myself only to monographs and anthologies on Kant’s aesthetics or the third Critique as a whole (but not those devoted exclusively to teleology) in English, German, and French on my shelves, and no doubt missing some, at least in German and French, I find twenty-eight monographs and anthologies published in the period between 1980 and 1999 and another twenty-seven just since 2000. (Indeed, two more have arrived on my desk since this article was written.)3 Someone setting out to work on the third Critique now has at least as many books from the last decade alone to read as I had in 1971 from the eight preceding decades. The present review will make only a small dent in this pile: I will discuss just five monographs and one introduction to the third Critique, all published in English in 2006 and 2007. (shrink)

Many critics seem to consider it inappropriate or unnecessary to ask what Montaigne means by the faculty of judgment. Laumonier speaks of "Ie bon sens, qu'il oppose si souvent a la memoire et qu'il appelle encore 'jugement' et 'entendement', c'est-a-dire la faculte de penser et de reflechir juste. " 1 Our appreciation of what is implied by judgment, that is by Montaigne's notion of judgment, has been delayed perhaps by a too facile acceptance of a so-called synonymity of meaning (...) among the psychological terms used by Montaigne. In a discussion of key concepts in Montaigne, Donald M. Frame has accurately summarized the present situation with regard to our knowledge of Montaigne's notion of judgment and other key concepts: "We all have our hunches, but we need more than that. " 2 For the expression of his interest and concern for the intellectual and moral activities and capabilities of the mind, Montaigne draws upon a broad and elementary semantic field. These primary psychological terms are jugement, entendement, sens, raison, discours, and conscience. Al­ though these words may be used synonymously, Montaigne does seem to maintain certain basic distinctions among them; frequent substi­ tutions of terms must be the result of semantic and ideational differ­ ences. Moreover, the association of several psychological words within a single sentence implies gradations, however slight they may be. (shrink)

Primarily a work in moral and political thought, it also relies extensively on research in cognitive neuroscience to confirm and extend our understanding of the faculty of judgment. Ever since the ancient Greeks first discussed practical wisdom, the faculty of judgment has been an important topic for philosophers and political theorists. It remains one of the virtues most demanded of our public officials. The (...) greater the liberties and responsibilities accorded to citizens in democratic regimes, the more the health and welfare of society rest upon their exercise of good judgment. Kant claims that the faculty of judgment and the Critique of Judgment are necessary for the completion of the critical system. He states that judgment has a special role to play within the critical system. This view is reiterated by commentators such as Vleeschauwer who says that the third Critique “truly brings to completion the whole Critical philosophy” and Macmillan who calls the third Critique “the ‘crowning phase’ of Critical Philosophy.”.

The classical conception of academic freedom associated with Wilhelm von Humboldt and the rise of the modern university has a quite specific cultural foundation that centres on the controversial mental faculty of 'judgement'. This article traces the roots of 'judgement' back to the Protestant Reformation, through its heyday as the signature feature of German idealism, and to its gradual loss of salience as both a philosophical and a psychological concept. The influence of Immanuel Kant’s philosophy on the ideas of Gilles Deleuze was quite substantial. However, analyses of the correlation between the ideas of the two philosophers have not yet received proper research attention, especially in Russian-language literature. To reveal the essence and history of the development of Deleuze’s attitude to Kant, the former’s work, Kant’s Critical Philosophy: The Doctrine of the Faculties (1963), in which the French philosopher aims to find the potential limits of interpretation of Kant’s philosophy. Deleuze (...) appeals to Kant’s study of faculties, in which he finds contradictions and “gaps” that find their solution in the Critique of Judgment. Deleuze refers to the free coherence of the faculties as to “something third”, which gives options for reactualising Kant’s philosophy without striving to overcome it. I also provide a brief history of the issues related to Kant­ian philosophy, appearing in the works of Deleuze — from a course of lectures on the problem of grounds, given by the young Deleuze at the Lyceum Louis the Great in Paris, to his last article published in his lifetime, “Immanence: A Life”, in which Deleuze brings up the question of the transcendental field. Despite the fact that Kant and Deleuze are more often contrasted than considered as possible allies, and despite the cases of criticisms of Kant by Deleuze, I defend the thesis that their philosophical projects are firmly linked. Considering Kant’s presence in Deleuze’s study, I conclude that Kant’s philosophy has shaped some key aspects of the French philosopher’s thinking — in particular, the concept of “transcendental empiricism” — and also has influenced Deleuze’s ideas about difference, becoming, ground and immanence. How much is given in perceptual experience, and how much must be constructed? John Locke's answer to this question contains two prima facie incompatible strands. On the one hand, he claims that ideas of primary qualities come to us passively, through multiple senses: the idea of a sphere can be received either by sight or touch. On the other hand, Locke seemingly thinks that a faculty he calls “judgment” is needed to create visual ideas of three‐dimensional shapes. How can (...) these accounts be made consistent? The problem comes to a head in the discussion of Molyneux's problem: can a person born blind and then made to see identify a sphere and a cube, when he had only touched them in the past? Locke's answer is no, but, as George Berkeley points out, it is hard to see why: if the ideas of shapes come to us through sight as well as touch, nothing should stop Molyneux man from instantly recognizing sphere and cube. Pace much of the existing literature, I argue that although Locke does think we receive visual ideas of primary qualities, the faculty of judgment is required to “inflate” those ideas into three dimensions and to correct for other perspectival distortions. I then show how this answer is consistent with the rest of his theory of perception. (shrink)

Teachers in vocational education face two problems. (1) Learning involves the ability to transcend and modify learned knowledge to new circumstances. How should vocational education prepare students for future, unknown tasks? (2) Students should strive to produce work of good quality. How does vocational education help them develop their faculty of judgment to differentiate between better and worse quality? These two ques- tions are tightly interwoven. The paper compares the didactics of philosophy and sloyd. Both developed independently, but their (...) solutions to how one advances the capacity for reflective judgment are similar. Central to this capacity is not merely devising efficient means to work towards pre-existing aims, but to reflect in practice on what one’s aim are and should be. This implies reflection on what future problems, as well as solutions to them, demand of us cognitively, socially and morally. (shrink)

Kant’s early work The False Subtlety of the Four Syllogistic Figures is typically considered a narrow, technical work still embedded in the tradition of Wolffian logic. I argue instead that it needs to be considered in light of Kant’s developing theory of cognition and his corresponding criticism of the Wolffian single faculty theory. Whereas the mature Kant criticizes the rationalists for misrepresenting the nature of sensibility, the urgent task facing him at this stage seems to have been a proper (...) determination of the nature of the understanding. On the Wolffian framework, the latter is defined in a merely nominal manner, in terms of a generic cognitive task: the distinct representation of the possible. On Kant’s view, however, distinctness entails a capacity to relate representations, which only happens in the act of judgment. Thus, the stated aim of the False Subtlety notwithstanding, the work attempts to reorganize the logical operations around the capacity to judge. In turn, by defining the higher faculty of cognition in terms of an act of relating representations, Kant wants to show that this faculty cannot stem from a power of representation that we share with non-rational animals and must instead rest on a different fundamental power, which at the time he alternatively calls “inner sense” or “consciousness”. The core argument in this paper is that, to reconstruct the last unwritten section on Judging in Hannah Arendt's Life of the Mind , it is necessary to address what Arendt was doing with the book as a whole and how the different parts relate internally to one another. This is no easy matter, especially as the existing sections on Thinking and Willing are quite different in tone from one another. My proposition is that the work should be read as (...) a critique of the life of the `modern' mind, and especially of the differentiation of the modern mind into distinct and reified faculties. The work as a whole is an attempt to understand the distorted forms of modernization that result from the division of the life of the mind into opposing faculties. It is, so to speak, a critique of the combined and uneven development of the life of the modern mind. While Arendt famously argues that the activity of thinking itself conditions people against evildoing, the spectre that informs her analysis of both thinking and willing is the danger of nihilism inherent in these mental activities. The work raises vital questions concerning the conditions under which this danger is actualized and the means by which it might be averted. What this entails for our reconstruction of the missing section on judgment is that, rather than see it as the core of Arendt's contribution to political thought or as the promised solution to an impasse, we should explore the equivocations of judging. This aporetic reading of the text helps clarify Arendt's concerns over the separation of the life of the mind from the world and the role of both judging and understanding in renewing its connections to the world. Kant’s distinction between the determining and reflecting power of judgment in the third Critique is not well understood in the literature. A mainstream view unifies these by making determination the telos of all acts of judgment (Longuenesse 1998). On this view, all reflection is primarily in the business of producing empirical concepts for cognition, and thus has what I call a determinative ideal. I argue that this view fails to take seriously the independence and autonomy of the ‘power of judgment’ (...) [Urteilskraft] as a higher cognitive faculty in its own right with its own a priori principle. Instead of seeing merely reflecting judgments as failed or incomplete acts of judgment, I argue that these are in fact paradigmatic of the activity of the power of judgment. More precisely, the reflecting power of judgment just is the power of judgment. Accordingly, reflecting judgment takes precedence over determining judgment; while the former operates according to a law that it gives itself, the latter requires another higher cognitive faculty to provide its principle. On my view, reflecting judgment should be understood as the capacity for purposive subsumption—most clearly seen in the activity of mere reflection. (shrink)

This study focuses on Kant's attempt to find the link between feeling and cognition on a priori grounds in the three Critiques to make philosophical judgment possible. As such it treats the area of aesthetics and its formal principles. This work explores the enigma: How is it that Kant values the talent to judge more than understanding and reason; indeed the lack of it «no school can make good». Yet, even though Kant demonstrates how a priori synthetic judgments and a (...) priori moral judgments are possible as particular pronouncements, he analyzes the power of judgment itself as an independent faculty only in the last Critique. The author argues that the aesthetic factor plays a recalcitrant, yet vital and necessary role in all human judging. Finding an adequate niche for feeling and its a priori principles becomes a key problem not just for Kant but for the entire philosophical enterprise. (shrink)

The Crisis of Judgment in Kant's Three Critiques is intended as an analysis and reconstruction of the role of the faculty of judgment as it evolves through the course of Kant's critical philosophy. It offers an analysis of the mental power of judgment and systematically develops its links to feeling, cognition, and the will. In the introductory chapter, Scherer spells out the two guiding questions of her study: How does judgment relate systematically to understanding, reason, and the will? Is (...) judgment constitutive or regulative? Scherer's study emphasizes the architectonic and antinomic nature of reason in Kant, thereby stressing the necessarily resolutive function of judgment. The purpose of this dissertation is to establish an interpretive framework for the study of Kant's Critique of Judgment. The central themes of the text are presented in the first chapter in terms of two different problems. The first is referred to as the prima facie problem. This problem concerns the search for a transcendental principle for the faculty of judgment corresponding to the principles established for understanding and reason in the first two critiques. The second is referred to (...) as the systematic problem. This problem concerns the search for a transcendental principle which can mediate between the domains of understanding and reason and provide for a "unity of transition" between nature and freedom. ;The value of this interpretation is demonstrated in the second chapter through a criticism of Paul Guyer's work on the third critique, Kant and the Claims of Taste . This criticism focuses on Guyer's interpretive method and scholarship. ;The interpretation is developed further in the third and fourth chapters in which specific problems that have not been dealt with adequately in the recent literature in English are addressed. The systematic argument of the two introductions that Kant prepared for the text is presented in the third chapter. Finally, the fourth chapter focuses on the deduction of pure aesthetical judgments and advances an account of this argument that is shown to be preferable to the account of Guyer as well as that developed by Donald Crawford in his study Kant's Aesthetic Theory. This essay argues that, contrary to the prevailing view according to which reflection in Kant's aesthetic judgment is interpreted as ‘the logical actus of the understanding’, we should pay closer attention to Kant's own formulation of aesthetic reflection as ‘an action of the power of imagination’. Put differently, I contend in this essay that the rule that governs and orders the manifold in aesthetic judgment is imagination's own achievement, the achievement of the productive synthesis of the ‘fictive power’, entirely independent (...) of the understanding. While this view does not entail that the faculty of the understanding is not necessary in aesthetic reflection, a stronger emphasis on the role of imagination in aesthetic reflection allows us to realize that its schematizing and interpretive activity, while consistent with, goes well beyond the discursive demands of the understanding insofar as it intimates the supersensible ground of freedom that manifests itself as ‘the feeling of life’. Therefore, I show in this essay that the imagination's unique interpretive power has a special role in completing Kant's critical system by facilitating the connection of the sensible to the supersensible, which further helps us appreciate imagination's practical as opposed to merely cognitive significance. In this paper I argue that 1) Kant’s power of judgment is constitutively always reflecting, as its lawful employments involve a preliminary self-reference of the faculties the power of judgment itself is required to connect and let them match with each other. Accordingly, I claim that 2) the principle of purposiveness is the principle of the power of judgment as such, and not just of an allegedly self-standing reflecting branch of this faculty. I criticize the view that Kant draws (...) a dichotomy between reflecting and determining judgments and argue that 3) Kant’s point in the third Critique is to rule out the amphiboly between the reflecting and the determining employment of the principle of purposiveness. The power of judgment is, as such, always reflecting: while in the case of cognition it also works in a determining way, in the case of both aesthetics and teleology it is only reflecting, i.e., self-purposive – as it sets its function as its own end. So just what Dante scorns as unworthy alike of heaven and hell, Botticelli accepts, that middle world in which men take no side in great conflicts, and decide no great causes, and make great refusals.In what follows, I examine a notion of desire that, I shall claim, is implicit in Immanuel Kant's theorization of aesthetic judgment in the Critique of Judgment.1 At first, this undertaking is likely to seem misguided. The Kantian approach to the sublime in the Critique of the Power of Judgment is based on an antagonism between two faculties, Imagination and Reason. In order to understand this conflict under new conceptual coordinates, and pursuing a triple exegetical, aesthetical and political interest, the aim of the present paper is to develop the brutal character proper to the conceptual dynamics deployed in such an approach. Reconstructing this mouvement from the incidences of the term Gewalt, under a brutalism of the (...) sublime, we focus on the inquiry of the violence that the Imagination experiences in its mathematical determination and, on the other hand, of the power that Reason holds according to the dynamic determination of the sublime. Thus, under such a perspective, violence, power and subjective impotence will appear as constitutive characters of the genesis of the feeling of the sublime within the horizon of transcendental philosophy. In this paper I develop a new account of the philosophical motivations for Descartes’s theory of judgment. The theory needs explanation because the idea that judgment, or belief, is an operation of the will seems problematic at best, and Descartes does not make clear why he adopted what, at the time, was a novel view. I argue that attending to Descartes’s conception of the will as the active, free faculty of mind reveals that a general concern with responsibility motivates (...) his theory of judgment. My account avoids some unappealing features of the standard interpretation, renders the theory more plausible than many have suggested, and explains why his theory does not fall neatly into any current-day position on the issue of the control we have over belief. : The aim of this article is to explore the origin of the difficulty of founding the reflecting power of judgment as Kant outlines it in the Preface of the third Critique. Although a foundation for this faculty was only established in 1790, we must interpret it as a critical solution to an old problem, which Kant had already recognized around 1770. Through his comprehension of the meaning of healthy understanding and native wit he already confirms the impossibility of (...) determining the correctness of our judging activity from the use of rules. This approach of the problem must be understood in the context of the controversy about the concept ‘logica naturalis’ in the Leibniz-Wolffian aesthetics and logic. In close conjunction with this tradition, Kant already tries to offer an elucidation of the question of judging through the aesthetics. (shrink)

Philosophical aesthetics have seen an amazing revival over the past decade, as a radical questioning of the very grounds of Western epistemology has revealed that descriptions of what used to be seen as specific to aesthetic experience can instead be viewed as a general model for human cognition. In this revival, no text in the classical corpus of Western philosophy has been more frequently discussed and debated than the dense, complex paragraphs inserted into Kant's Critique of Judgment as sections 23-29: (...) the Analytic of the Sublime. This book is a rigorous explication de texte, a close reading of these sections. The Analytic of the Sublime, he points out, tries to argue that human thought is always constituted through a similar incompatibility between different intellectual and affective faculties. These lessons thus try to isolate the analysis of a differend of feeling in Kant's text, which is also the analysis of a feeling of differend, and to connect this feeling with the transport that leads all thought (critical thought included) to its limits. It might at first seem that the senses (the five traditionally recognized conduits of outer sense) would have very little to contribute to an investigation of Kant's aesthetics. Is not Kant's aesthetic theory based on a relation of the higher cognitive faculties? Much however can be revealed by asking to what degree sight is essential to aesthetic judgment (of beauty and the sublime) as Kant describes it in the 'Critique of Judgment.' Here the sublime receives particular attention.

Po eni strani Kantov pojem »reflektirajoče razsodne moči« Arendtovi omogoči prikaz določene nujnosti v politični presoji, za katero je značilno, da se vedno odvija v singularnih okoliščinah in se ne more sklicevati na nobeno vnaprejšnje, univerzalno ali splošno merilo. Po drugi strani Arendtova interpretira »nezainteresirano ugajanje«, ki je pri Kantu predpostavka za estetsko sodbo, kot nujni (...) pogoj teoretičnega motrenja zgodovine. Pomembni interpreti, kot sta Beiner in Vollrath, so na osnovi tega trdili, da gre za protislovje. V svojem besedilu želim pokazati, da se to protislovje razreši v »hermenevtični etiki«, ki jo je možno pokazati v delih Hannah Arendt, celo v najbolj zgodnjih.Hannah Arendt’s interpretation of Kant’s conception of the »power of judgment« extracts this faculty from its intended context, considerations of the beautiful and of nature, and grants it a political significance. On the one hand, Kant’s conception of a »reflective power of judgment« offers Arendt the possibility of referring to a certain necessity in political judgments; judgments which always take place under singular conditions and which cannot presume a universal or general measure. On the other hand, Arendt interprets »disinterested pleasure«, which is for Kant a presupposition of aesthetic judgment, as a necessary condition for theoretical considerations of history. Between these two aspects of Arendt’s Kant interpretation, important scholars, such as Beiner and Vollrath, have claimed to find a contradiction. In my article I would like to show that this contradiction is dissolved by way of a »hermeneutical ethics«, which can be identified throughout the work of Hannah Arendt, even in its earliest forms. In order to highlight this relation, I shall investigate the concept of the technique of nature, as it has been introduced in Critique of the Power of Judgment. According to Kant, the technique of nature allows the laws of reason to represent the agreement of the transcendental principles of reason with nature. Thus, the concept of the technique of nature assumes a fruitful role by exposing, through an analogy with human faculties, the productive activity of nature, as if its activity were oriented towards ends. It is well known that Kant connects judgment and feeling in the third Critique. However, the precise relationship between these two faculties remains virtually unexplored, in large part due to the unpopularity of Kant’s faculty psychology. This paper considers why, for Kant, judgment and feeling go together, arguing that he had good philosophical reasons for forging this connection. The discussion begins by situating these faculties within Kant’s mature faculty psychology. While the ‘power of judgment’ [Urteilskraft] is fundamentally reflective, (...) feeling [Gefühl] reveals itself as essentially non-discursive. Their systematic connection emerges through the principle of purposiveness [Zweckmäßigkeit], which the former legislates for the latter. I claim that we must understand this notion in terms of the suitability of the faculties for each other, as displayed in mere reflection. That is, we can only recognize the fitness of two things for each other through feeling, which, in turn, is the only way that we can engage in the activity of merely reflecting judgment. I conclude by gesturing at an even further way in which judgment and feeling are related, based on their mutual role in orienting all of the faculties of the human mind. (shrink)

_In Perception, Empathy, and Judgment_ Arne Johan Vetlesen focuses on the indispensable role of emotion, especially the faculty of empathy, in morality. He contends that moral conduct is severely threatened once empathy is prevented from taking part in an interplay with cognitive faculties in acts of moral perception and judgment. Drawing on developmental psychology, especially British "object relations" theory, to illuminate the nature and functioning of empathy, Vetlesen shows how moral performance is constituted by a sequence involving perception, judgment, (...) and action, with an interplay between the agent's emotional and cognitive faculties occurring at each stage. In the powerful tradition from Kant to present-day theorists such as Kohlberg, Rawls, and Habermas, reason is privileged over feeling and judgment over perception, in such a way that basic philosophical questions remain unasked. Vetlesen focuses our attention on these questions and challenges the long-standing assertion that emotions are damaging to moral response. In the final chapter he relates his argument to recent feminist critiques that have also castigated moral theorists in the Kantian tradition for their refusal to recognize a role for emotion in morality. While the book's argument is philosophical, its method and scope are interdisciplinary. In addition to critiques of such philosophers as Arendt, MacIntyre, and Habermas, it contains discussions of specific historical, ideological, and sociological factors that may cause "numbing"—selective or broad-ranging, pathological insensitivity—in humans. The Nazis' mass killing of Jews is studied to illuminate these and other relevant empirical aspects of large-scale immoral action. (shrink)

My aim in this paper is to provide an account of practical judgement, for Kant, that situates it within his theory of judgement as a whole—particularly, with regards to the distinction between the determining and reflecting use of judgement. I argue that practical judgement is a kind of determining judgement, but also one in which reflecting judgement plays a significant role. More specifically, I claim that practical judgement arises from the cooperation of the (...) reflecting power of judgement with the faculty of reason—the former assisting the latter in the application of its principle. I conclude by considering a possible role for feeling in practical judgement. (shrink)

A cross-sectional study explored the moral judgement competence and moral attitudes of 310 Czech and Slovak and 70 foreign national students at the Medical Faculty of Charles University in Hradec Králové, Czech Republic. Lind's Moral Judgement Test was used to evaluate moral judgement competence and moral attitudes depending on factors such as age, number of semesters of study, sex, nationality and religion. Moral judgement competence decreased significantly in the Czech and Slovak medical students as they (...) grew older; in medical students from other countries it did not significantly increase. The influence of other factors (sex, nationality and religion) on moral judgement competence was not proven in either the Czech and Slovak or the foreign national medical students. Moral attitudes do not change; the Czech and Slovak as well as the foreign students preferred the post-conventional levels of moral judgement (Kohlberg's 5th and 6th stages). The fact that the Czech and Slovak students' moral judgement competence decreased with age and number of semesters of study completed is not an optimistic sign: medical students who had undergone a lower number of semesters of study were morally more competent. In this essay, I focus on two questions. First, what is Kant's understanding of the sense in which our faculties form a unified system? And, second, what are the implications of this for the metaphysical relationships between the faculties within this system? To consider these questions, I begin with a brief discussion of Longuenesse's groundbreaking work on the teleological unity of the understanding as the faculty for judgment. In doing so, I argue for a generalization of Longuenesse's account along (...) two dimensions. The result is a picture of our faculties as forming a teleological system—unified under the overarching aims of reason as the highest rational faculty. Then I discuss the recent debate between “additive” and “transformative” interpretations of the relationship between sensibility and the understand- ing, before proposing that we should interpret Kant as endorsing a moderate form of the “transformative” reading, which captures important elements of both the “additive” and the “transformative” account. Since the 18th century, one of the key features of diagnosed psychopaths has been “moral colorblindness” or an inability to form moral judgments. However, attempts at experimentally verifying this moral incapacity have been largely unsuccessful. After reviewing the centrality of “moral colorblindness” to the study and diagnosis of psychopathy, I argue that the reason that researchers have been unable to verify that diagnosed psychopaths have an inability to make moral judgments is because their research is premised on the assumption that (...) there is a specific moral faculty of the brain, or specific “moral” emotions, and that this faculty or set of emotions can become “impaired”. I review recent research and argue that we have good reason to think that there is no such distinct capacity for moral judgment, and that, as a result, it is impossible for someone’s “moral judgment faculty” to become selectively disabled. I then discuss the implications of such a position on psychopathy research, the coherence of the disorder, and the moral responsibility of psychopaths. (shrink)

Examining the social and political upheavals that characterized the collapse of public judgment in early modern Europe, Liberating Judgment offers a unique account of the achievement of liberal democracy and self-government. The book argues that the work of John Locke instills a civic judgment that avoids the excesses of corrosive skepticism and dogmatic fanaticism, which lead to either political acquiescence or irresolvable conflict. Locke changes the way political power is assessed by replacing deteriorating vocabularies of legitimacy with a new language (...) of justification informed by a conception of probability. For Locke, the coherence and viability of liberal self-government rests not on unassailable principles or institutions, but on the capacity of citizens to embrace probable judgment. The book explores the breakdown of the medieval understanding of knowledge and opinion, and considers how Montaigne's skepticism and Descartes' rationalism--interconnected responses to the crisis--involved a pragmatic submission to absolute rule. Locke endorses this response early on, but moves away from it when he encounters a notion of reasonableness based on probable judgment. In his mature writings, Locke instructs his readers to govern their faculties and intellectual yearnings in accordance with this new standard as well as a vocabulary of justification that might cultivate a self-government of free and equal individuals. The success of Locke's arguments depends upon citizens' willingness to take up the labor of judgment in situations where absolute certainty cannot be achieved. (shrink)

ABSTRACT In this paper, I advance a new interpretation of the argumentative structure of the third Critique, which in turn clarifies the connection between its two apparently unrelated parts. I propose to read the third Critique as a response to Kant’s question of hope, which concerns the satisfaction of reason’s practical and theoretical interests. On this proposal, while the first part on aesthetics describes what we—as possessors of theoretical reason – may hope for, the second part, on teleology, describes what (...) we – as possessors of practical reason – may hope for. The main question of the third Critique is, ‘What may we hope if we act as we should, i.e. act rationally?’ Kant’s implicit answer is, ‘to attain the ideals of reason, which leads to happiness as a consequence of it.’ This novel reconstruction of the argumentative structure of the third Critique contributes to the literature by (i) explaining how the two parts of the third Critique on aesthetics and teleology are connected, (ii) clarifying how the ideals of reason are connected to hope and happiness, and (iii) showing how the spheres of nature and freedom can be synthetically unified through the faculty of judgment. The harmonious free play of the imagination and understanding is at the heart of Kant’s account of beauty in the Critique of the Power of Judgement, but interpreters have long struggled to determine what Kant means when he claims the faculties are in a state of free play. In this article, I develop an interpretation of the free play of the faculties in terms of the freedom of attention. By appealing to the different way that we attend to objects (...) in aesthetic experience, we can explain how the faculties are free, even when the subject already possesses a concept of the object and is bound to the determinate form of the object in perception. To speak of Heidegger’s “Logical Investigations” does not mean returning to Heidegger’s interpretation or interpretations of Husserl’s Logische Untersuchungen, from the Marburg lecture course of 1925 to the last seminar at Zähringen in 1973. As we know, Heidegger’s reading here is always charitable, and we also know that his reading always displays a positive assessment of the central role of the doctrine of categorial intuition, the doctrine with (...) which Husserl came closest to the question of being.
