The paper examines the conditions under which we are responsible for actions performed under duress, focusing on a real case in which a soldier was compelled at gunpoint to participate in the massacre of civilian prisoners. The case stands for a class of cases in which the compelled act is neither clearly justified nor clearly excused on grounds of temporary incapacity, but in which it is nonetheless plausible that the agent is not morally blameworthy. The theoretical challenge is to identify (...) the excuse in such cases and to explain its basis. The paper argues that when mortal duress excuses in cases of this sort, it does so because the compelled act, though impermissible and freely chosen, nonetheless fails to manifest ‘an insufficiently good will’. The argument depends on a potentially controversial thesis in the ethics of concern, namely, that a thoroughly decent moral agent—someone who cares enough about morality and the values that underlie it—will not always be moved to do what he knows he ought to do. This chapter explores bridge-law non-naturalism: the view that when a particular thing possesses a moral property or stands in a moral relation, this fact is metaphysically grounded in non-normative features of the thing in question together with a general moral law. Any view of this sort faces two challenges, analogous to familiar challenges in the philosophy of science: to specify the form of the explanatory laws, and to say when a fact of that form qualifies as a law. In this stimulating investigation, Gideon Freudenthal has linked social history with the history of science by formulating an interesting proposal: that the supposed influence of social theory may be seen as actual through its co herence with the process of formation of physical concepts. The reinterpre tation of the development of science in the seventeenth century, now widely influential, receives at Freudenthal's hand its most persuasive statement, most significantly because of his attention to the theoretical form which is charac (...) teristic. of classical Newtonian mechanics. He pursues the sources of the parallels that may be noted between that mechanics and the dominant philosophical systems and social theories of the time; and in a fascinating development Freudenthal shows how a quite precise method - as he descriptively labels it, the 'analytic-synthetic method' - which underlay the Newtonian form of theoretical argument, was due to certain interpretive premisses concerning particle mechanics. If he is right, these depend upon a particular stage of con ceptual achievement in the theories of both society and nature; further, that the conceptual was generalized philosophically; but, strikingly, Freudenthal shows that this concept-formation itself was linked to the specific social relations of the times of Newton and Hobbes. Gideon Yaffe presents a theory of criminal responsibility according to which child criminals deserve leniency not because of their psychological, behavioural, or neural immaturity but because they are denied the vote. He argues that full shares of criminal punishment are deserved only by those who have a full share of say over the law.

In Being Realistic About Reasons T. M. Scanlon argues that particular fact about reasons are explained by contingent non-normative facts together with pure normative principles. A question then arises about the modal status of these pure principles. Scanlon maintains that they are necessary in a sense, and suggests that they are ‘metaphysically’ necessary. I argue that the best view for Scanlon to take, given his other commitments, is that these pure normative principles are metaphysically contingent in some cases and necessary (...) only in a weaker sense. Change blindness illustrates a remarkable limitation in visual processing by demonstrating that substantial changes in a visual scene can go undetected. Because these changes can ultimately be detected using top–down driven search processes, many theories assign a central role to spatial attention in overcoming change blindness. Surprisingly, it has been reported that change blindness can occur during blink-contingent changes even when observers fixate the changing location [O’Regan, J. K., Deubel, H., Clark, J. J., & Rensink, R. A. . Picture changes (...) during blinks: Looking without seeing and seeing without looking. Visual Cognition, 7, 191–212]. However, eye blinks produce a transient disruption of vision that is independent of any associated changes in the retinal image. We determined whether these ‘attentive blank stares’ could occur in the absence of blink-mediated visual suppression. Using a flicker change-blindness paradigm we confirm that despite direct attentive fixations, obvious scene changes often remain undetected. We conclude that change detection involves object or feature based attentional mechanisms, which can be ‘misdirected’ despite the allocation of spatial attention to the position of the change. Gideon Yaffe presents a ground-breaking work which demonstrates the importance of philosophy of action for the law. Many people are serving sentences not for completing crimes, but for trying to. Yaffe's clear account of what it is to try to do something promises to resolve the difficulties courts face in the adjudication of attempted crimes.

Descartes is well known as a mathematician and natural philosopher. However, none of Descartes's biographers has described the invitation he received in 1633 to fill a chair in theoretical medicine at the University of Bologna, or the fact that he was already sufficiently known and respected for his medical knowledge that the invitation came four years before his first publication. In this note I authenticate and contextualize this event, which I refer to as the ‘Bologna affair’. I transcribe the letter (...) written to the Bolognese Senate announcing efforts to bring Descartes to the university and explain the events that led to Descartes receiving the invitation. While many questions about the Bologna affair cannot be answered because of the paucity of the historical record, I conclude that the event invites us to consider again the larger historiographical issue of how best to integrate the history of medicine with the history of science and philosophy during the early modern period. When a person acts from ignorance, he is culpable for his action only if he is culpable for the ignorance from which he acts. The paper defends the view that this principle holds, not just for actions done from ordinary factual ignorance, but also for actions done from moral ignorance. The question is raised whether the principle extends to action done from ignorance about what one has most reason to do. It is tentatively proposed that the principle holds in full (...) generality. Wallace does not provide an explicit account of moral fairness. Rather he gives substance the notion by articulating two concrete principles governing blame which are meant to be—and in some sense clearly are—demands of fairness.

Setting the two hypotheses of complete neglect and full use of base rates against each other is inappropriate. The proper question concerns the degree to which base rates are used (or neglected), and under what conditions. We outline alternative approaches and recommend regression analysis. Koehler's conclusion that we have been oversold on the base rate fallacy seems to be premature.

In Michael Moore's important book Causation and Responsibility, he holds that causal contribution matters to responsibility independently of its relevance to action. We are responsible for our actions, according to Moore, because where there is action, we typically also find the kind of causal contribution that is crucial for responsibility. But it is causation, and not action, that bears the normative weight. This paper assesses this claim and argues that Moore's reasons for it are unconvincing. It is suggested that sometimes (...) a person's responsibility for that to which he causally contributes depends on his recognition of an identity between himself and the protagonist of the event for which he is held responsible. Since this fact about identity is not captured by causal contribution, action matters to responsibility for reasons that are not exhausted by the fact that action involves causal contribution. The relevance of this idea for accomplice liability is also briefly discussed. (shrink)

Fictionalism about possible worlds is the view that talk about worlds in the analysis of modality is to be construed as ontologically innocent discourse about the content of a fiction. Versions of the view have been defended by D M Armstrong (in "A Combinatorial Theory of Possibility") and by myself (in "Modal Fictionalism', "Mind" 99, July 1990). The present note argues that fictionalist accounts of modality (both Armstrong's version and my own) fail to serve the fictionalists ontological purposes because they (...) imply that as a matter of necessity there exist many worlds. In this paper I address Descartes’ use of analogy in physics. First, I introduce Descartes’ hypothetical reasoning, distinguishing between analogy and hypothesis. Second, I examine in detail Descartes’ use of analogy to both discover causes and add plausibility to his hypotheses—even though not always explicitly stated, Descartes’ practice assumes a unified view of the subject matter of physics as the extension of bodies in terms of their size, shape and the motion of their parts. Third, I present Descartes’ unique “philosophy (...) of analogy”, where the absence of analogy serves as a criterion for falsifying proposed explanations in physics. I conclude by defending Descartes’ philosophy of analogy by appeal to the value scientists assign to simplicity in their explanations. (shrink)

In his 'Inquiry', Reid claims, against Berkeley, that there is a science of the perspectival shapes of objects ('visible figures'): they are geometrically equivalent to shapes projected onto the surfaces of spheres. This claim should be understood as asserting that for every theorem regarding visible figures there is a corresponding theorem regarding spherical projections; the proof of the theorem regarding spherical projections can be used to construct a proof of the theorem regarding visible figures, and vice versa. I reconstruct Reid's (...) argument for this claim, and expose its mathematical underpinnings: it is successful, and depends on no empirical assumptions to which he was not entitled about the workings of the human eye. I also argue that, although Reid may or may not have been aware of it, the geometry of spherical projections is not the only geometry of visible figure. (shrink)

Metaphysicians of Meaning is the first book to challenge the accepted understanding of Russell's On Denoting and Frege's On Sense and Reference . Makin compares the work Russell did shortly before his famous essay "On Denoting" with the essay itself and argues that this comparison shows that the traditional view of the problem Russell was trying to solve is untenable. He then examines Frege's classic essay and argues that some of the less well-known views that Frege held have radical implications (...) for our understanding of this essay. (shrink)

This title was first published in 2002. This collection of essays aims to present a wide range of interpretations of central themes in Spinoza's philosophy. Philosophical interpretations of Spinoza divide into three general categories. The first sets Spinoza within what is taken to be his historical context. Special emphasis is laid here on aspects of his teaching that seem to bear the influence of Spinoza's own education (and self-education), either through concepts assimilated into his own thinking, or those he undertook (...) to refute and displace. A second interpretative approach uses analytical tools in an attempt to reconstruct Spinozistic issues and theories critically. Finally, there are philosophers who explore Spinoza's texts in their own terms, attempting to present a coherent picture of one or more aspects of Spinoza's teaching. Given the broad span of issues with which Spinoza deals, the latter is often the most difficult track to follow. The 25 articles in this collection exemplify these three attitudes to Spinoza interpretation, though most avail themselves of more than one. In making the selection the editors preferred studies that treat their subject as a viable, endurable philosophical issue, whether the writer accepts Spinoza's presentation or highlights his difficulties. On each issue the articles critically analyze the texts, rather than simply portraying the Spinozistic ideas they express. (shrink)
