As part of a multifactorial approach to address weak incentives for innovative antimicrobial drug development, market entry rewards are an emerging solution. Recently, the Duke-Margolis Center for Health Policy released the Priority Antimicrobial Value and Entry Award proposal, which combines a MER with payment reforms, transitioning from volume-based to “value-based” payments for antimicrobials. Here, the PAVE Award and similar MERs are reviewed, focusing on further refinement and avenues for implementation.

Stephen Brock's book provides both a magisterial and (...) a definitive answer to this question.Like fine wine, this book has been fermenting and maturing for almost thirty years. Originally a doctoral dissertation, this recently published work has been rewritten, and to a certain extent, reworked by the author with respect to some of its content.Without disregard for nuances, the first chapter introduces the reader to four different groups of Aquinas's interpreters. The first two groups question the full legal character of the natural law in its dependence to the eternal law. The third one questions its naturalness. The fourth group, instead, upholds both the divine origin of the natural law's full legality in its dependence on the eternal law, as well as its natural character.Brock places Dom Odo Lottin, Wolfgang Kluxen, Germain Grisez, and John Finnis in the first group. They maintain that the natural law is a law only in a qualified sense and that it does not entirely fulfill the definition of law. The natural law would provide an intrinsic morality. It should be treated independently from the eternal law. The second group is composed by authors such as Frederick Copleston, Alan Donagan, or Gregory Stevens. Similar to the first group, they argue that the natural law is an autonomous self-standing law, legislated by human reason. Thus, it should be treated independently from the eternal law, except to point out its ultimate origin.The author who exemplifies the third position is Ernest Fortin. Reacting against Finnis, Fortin's position jeopardizes the natural character of the natural law. In his view, the legal force of the first principles of practical reason is not fully actualized until one recognizes the divine institution sanctioning them. [End Page 981]All the authors of the fourth group uphold that the natural law is fully a law on account of its divine origin and that it is also entirely natural insofar as it is naturally known by human reason. Herein Brock places commentators of Saint Thomas such as Francisco Suarez, Dominic Farrell, Lawrence Dewan, and himself. He also includes in this last group other philosophers such as G. E. M. Anscombe and Peter Geach. In the course of his whole study, Brock shows how Aquinas's true position differs from the other members of this group. Special attention is given to the differences between Aquinas's true mind and the interpretations offered by Suarez, Farrell, and, to a certain degree, even by Dewan. In order to better appreciate the depth of this process, I have found it very helpful to read Farrell's The Natural Law According to Aquinas and Suarez in conjunction with Brock's work.The second chapter targets the natural law's legal character in its dependence to the eternal law. It proves that Thomas provides a strict definition of the natural law when he says that it is nothing but a participation of the eternal law in the rational creature. This chapter opens with a historical study concerning the influence of the Summa Fratri Alexandri in the Summa theologiae (ST). Aquinas's understanding of the dependence of the natural law on the eternal law turns out to be more systematic and refined. It is based on a fuller comprehension and development of what law is (the ratio legis).The remainder of the second chapter consists in a superb commentary regarding ST, I-II, q. 91, a. 2, on whether something existing in man is fit to be called a natural law. The theory of lower previsions is designed around the principles of coherence and sure-loss avoidance, thus steers clear of all the updating anomalies highlighted in Gong and Meng's "Judicious Judgment Meets Unsettling Updating: Dilation, Sure Loss, and Simpson's Paradox" except dilation. In fact, the traditional problem with the theory of imprecise probability is that coherent inference is too complicated rather than unsettling. Progress has been made simplifying coherent inference by demoting sets of probabilities from fundamental building blocks to secondary representations (...) that are derived or discarded as needed. In this paper, we defend the view that Spinoza is committed to allowing for the existence of a plurality of possible worlds, that his necessitarianism is merely moderate, not strict enough to exclude the possibility of other worlds. To show that evidence for attributing strict necessitarianism to Spinoza is lacking, we shall concentrate on Don Garrett's article, “Spinoza's Necessitarianism,” in the conviction that his case for attributing strict necessitarianism to Spinoza is the strongest one available.

The use of technologies like artificial intelligence can drive productivity growth, efficiency and innovation. The goal of this study is to develop an anomaly detection method for locating flaws on the surface of sandwich panels using YOLOv5. The proposed algorithm extracts information locally from an image through a prediction system that creates bounding boxes and determines whether the sandwich panel surface contains flaws. It attempts to reject or accept a product based on quality levels specified in the standard. To evaluate (...) the proposed method, a comparison was made with a sandwich panel damage detection method based on a convolutional neural network and methods based on thresholding. The findings show that the proposed method, which is based on an object detector, is more accurate than the alternatives. The characteristics of the model, which can reject or accept a product according to the standard and limit allowable manufacturing flaws to obtain a quality product, also enable this system to improve industrial standards for producing sandwich panels while increasing speed. A comprehensive introduction to current research on the psychology of concept formation and use.

Why does social injustice exist? What role, if any, do implicit biases play in the perpetuation of social inequalities? Individualistic approaches to these questions explain social injustice as the result of individuals’ preferences, beliefs, and choices. For example, they explain racial injustice as the result of individuals acting on racial stereotypes and prejudices. In contrast, structural approaches explain social injustice in terms of beyond-the-individual features, including laws, institutions, city layouts, and social norms. Often these two approaches are seen as competitors. (...) Framing them as competitors suggests that only one approach can win and that the loser offers worse explanations of injustice. In this essay, we explore each approach and compare them. Using implicit bias as an example, we argue that the relationship between individualistic and structural approaches is more complicated than it may first seem. Moreover, we contend that each approach has its place in analyses of injustice and raise the possibility that they can work together—synergistically—to produce deeper explanations of social injustice. If so, the approaches may be complementary, rather than competing. (shrink)

In this note, my aim is to point out a phenomenon that has not received much attention; a phenomenon that, in my opinion, should not be overlooked in the professional practice of philosophy, especially within feminist efforts for social justice. I am referring to the way in which being a non-native speaker of English interacts with the practice of philosophy.1 There is evidence that non-native speakers are often perceived in prejudiced ways. Such prejudiced perception causes harm and, more importantly, constitutes (...) wrongdoing. As in other cases of prejudiced perception and biased behavior, it would be pretentious and misguided to expect philosophers and the philosophy profession to be free from this vice. There are good reasons to think that this prejudiced perception is bad not only for the persons who are perceived in such a way, but also for the profession, for it might make us miss important things that could improve philosophy in general. I claim we should be more sensitive to this phenomenon, both out of concern for justice, and for the sake of doing better philosophy. (shrink)

abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

The Air Quality Index (AQI) shows the state of air pollution in a unique and more understandable way. This work aims to forecast the AQI in Algeciras (Spain) 8 hours in advance. The AQI is calculated indirectly through the predicted concentrations of five pollutants (O3, NO2, CO, SO2 and PM10) to achieve this goal. Artificial neural networks (ANNs), sequence-to-sequence long short-term memory networks (LSTMs) and a newly proposed method combing a rolling window with the latter (LSTMNA) are employed as the (...) forecasting techniques. Besides, two input approaches are evaluated: using only the data from the own time series of the pollutant in the first case or adding exogenous variables in the second one. Several window sizes are employed (24, 28 and 72 hours) with ANNs and LSTMNAs. Additionally, several feature ranking methods are applied in the exogenous approach to select the most relevant lagged variables to feed the models. Results show how the proposed exogenous approach increases the performance of the prediction models. Besides, the newly proposed method LSTMNA provides the best performances in most of the cases evaluated. Hence, it constitutes an exciting alternative to standard LSTMs and ANNs to predict pollutants concentrations and, consequently, the AQI. (shrink)

(Updated 5/23/24) This unpublished paper, which readers should feel free to cite, is posted primarily for the historical record. In recent work that has, deservedly, received some attention, Paul R. Daniels presents and defends a non-standard theory of persistence that he dubs transdurantism, according to which persisting objects are temporally extended simples. This is exactly what I do in work dating back to Spring 2004. (This work includes this version of this paper, as well as later version that was presented (...) to the University of Rochester's Philosophy Department in 2005.) While this might be a total coincidence, I doubt that it is, especially given that 'transdurantism' appears as a name for a theory of persistence associated with me in at least two places in the literature, one of which includes a citation of this paper. The paper begins with a discussion of what I call 'locative relations' (the relations borne by material objects to the regions of space and time they occupy), which draws relevant distinctions that others have failed to draw. The results of this discussion are then used in constructing spatial analogues for the three established theories of persistence--endurantism, perdurantism, and exdurantism--as well as for transdurantism. Next, these four views concerning persistence are explicitly formulated and a defense of their formulation is offered. Finally, transdurantism's advantages and disadvantages relative to the other theories are discussed. The main goal of the paper is to challenge the trichotomy between the established theories by arguing that transdurantism is also a viable view concerning persistence through time. One might readily say that scientists have not yet reached the proper answers, but judging from what they have already accomplished satisfactory answers will be forthcoming in the revolving years. Gregory T. Doolan provides here the first detailed consideration of the divine ideas as causal principles. He examines Thomas Aquinas's philosophical doctrine of the divine ideas and convincingly argues that it is an essential element of his metaphysics. According to Thomas, the ideas in the mind of God are not only principles of his knowledge, but they are productive principles as well. In this role, God's ideas act as exemplars for things that he creates. As Doolan shows, this theory (...) of exemplarism is an integral part of Thomas's account of the existence and order of the created universe. It also accounts in part for the freedom of God's creative act. The volume begins with an introduction to Thomas's doctrine of exemplarism and then addresses his arguments for the existence of exemplar ideas within the mind of God. Having established the existence of divine ideas, Doolan considers how Thomas reconciles their multiplicity with God's simplicity. The work identifies the various things for which Thomas posits divine ideas. As Doolan is careful to show, Thomas does not consider all of these ideas to be exemplars because not all of them act as causal principles. After identifying the ideas that do act in this way, Doolan considers how such exemplars can be causes of natural things without compromising the causality of natural agents. The volume culminates with a consideration of the role that the divine ideas play within the structure of Thomas's theory of participation. ABOUT THE AUTHOR: Gregory T. In contrast to individualistic explanations of social injustice that appeal to implicit attitudes, structural explanations are unintuitive: they appeal to entities that lack clear ontological status, and the explanatory mechanism is similarly unclear. This makes structural explanations unappealing. The present work proposes a structural explanation of one type of injustice that happens in conversations, discursive injustice. This proposal meets two goals. First, it satisfactorily accounts for the specific features of this particular kind of injustice; and second, it articulates a structural (...) explanation that overcomes their unattractiveness. The main idea is that discursive injustice is not the result of biased interlocutors, but of problematic discursive norms. (shrink)

This book surveys the leading modern theories of property - Lockean, libertarian, utilitarian/law-and-economics, personhood, Kantian and human flourishing - and then applies those theories to concrete contexts in which property issues have been especially controversial. These include redistribution, the right to exclude, regulatory takings, eminent domain and intellectual property. The book highlights the Aristotelian human flourishing theory of property, providing the most comprehensive and accessible introduction to that theory to date. The book's goal is neither to cover every conceivable theory (...) nor to discuss every possible facet of the theories covered. Instead, it aims to make the major property theories comprehensible to beginners, without sacrificing accuracy or sophistication. Psychophysical scaling models of the form R = f, with R the response and I some intensity of an attribute, all assume that people judge the amounts of an attribute. With simple biases excepted, most also assume that judgments are independent of space, time, and features of the situation other than the one being judged. Many data support these ideas: Magnitude estimations of brightness increase with luminance. Nevertheless, I argue that the general model is wrong. The stabilized retinal image literature (...) shows that nothing is seen if light does not change over time. The classification literature shows that dimensions often combine to produce emergent properties that cannot be described by the elements in the stimulus. These and other effects cannot be adjusted for by simply adding variables to the general model because some factors do not combine linearly. The proposed alternative is that people initially judge the entire stimulus – the object in terms of its environment. This agrees with the constancy literature that shows that objects and their attributes are identified through their relations to other aspects of the scene. That the environment determines judgments is masked in scaling studies where the standard procedure is to hold context constant. In a typical brightness study the essential stimulus might be the intensity of the light or a difference between the light and the background. The two are perfectly confounded. This issue is examined in the case of audition. Judgments of the loudness of a tone depend on how much that tone differs from the previous tone in both pitch and loudness. To judge loudness people first seem to process the stimulus object in terms of differences between it and other aspects in the situation; only then do they assess the feature of interest. Psychophysical judgments will therefore be better interpreted by theories of attention that are based in biology or psychology than those that are based in classical physics. (shrink)

Groups of people are commonly said to be collectively responsible for what has happened. Sometimes the groups claimed to be responsible are vast in size, as when collective responsibility is ascribed to the class of all Americans or the class of all white males. In this book the concept of collective responsibility is analyzed. It is examined not only in the light of what philosophical proponents have said about it, but a genuine attempt is made to make sense of what (...) ordinary people say about responsibility when it is ascribed to groups of people. Accordingly, it is distinguished from related concepts such as shared responsibility and moral taint. Parallels are examined between the actions of an individual and the actions of a group or collective, parallels which seem to make ascriptions of collective responsibility more plausible. Some philosophers oppose collective responsibility and argue for an individualist type of position; in this regard the positions of Lewis and Sverdlik are critically examined. The final chapter contains the author's own position, a position which affirms that collective responsibility is possible but which also preserves some of the central intuitions of the individualist. Some philosophers have offered structural representations as an alternative to indicator-based representations. Motivating these philosophers is the belief that an indication-based analysis of representation exhibits two fatal inadequacies from which structural representations are spared: such an analysis cannot account for the causal role of representational content and cannot explain how representational content can be made determinate. In fact, we argue, indicator and structural representations are on a par with respect to these two problems. This should not be surprising, we contend, (...) given that the distinction between indicator and structural representations is better conceived as one involving degree rather than kind. (shrink)

In the recent literature on contextualism and relativism, one often finds disputes as to which kind of consideration would be relevant for positing a feature of a context as a parameter in the ‘‘circumstance of evaluation’: via the presence of an operator in the language which shifts that feature (Stanley) or by being a feature of a context with respect to which the truth of ‘‘propositions’’ expressed in the context is relative (McFarlane). This kind of dispute arises from two different (...) independent roles that elements in ‘‘circumstances of evaluation’’ are sometimes assumed to have. I distinguish indices from points of evaluation, and motivate its significance in the debate. (shrink)

In this timely study, Dawes defends the methodological naturalism of the sciences. Though religions offer what appear to be explanations of various facts about the world, the scientist, as scientist, will not take such proposed explanations seriously. Even if no natural explanation were available, she will assume that one exists. Is this merely a sign of atheistic prejudice, as some critics suggest? Or are there good reasons to exclude from science explanations that invoke a supernatural agent? On the one hand, (...) Dawes concedes the bare possibility that talk of divine action could constitute a potential explanation of some state of affairs, while noting that the conditions under which this would be true are unlikely ever to be fulfilled. On the other hand, he argues that a proposed explanation of this kind would rate poorly, when measured against our usual standards of explanatory virtue. (shrink)

Cet article remet en question les fondements théoriques et pédagogiques de la notion de compétence éthique ainsi que la conception de l’éthique qu’elle préfigure. Après une analyse du contexte d’émergence de cette notion, notamment dans le champ de la santé, nous verrons en quoi l’approche socioconstructiviste de l’apprentissage, à laquelle se réfèrent de nombreux dispositifs de formation, fait de l’éthique une ressource d’action visant l’adaptation passive des professionnels au contexte organisationnel et socioprofessionnel. Nous proposerons dès lors de revisiter l’apprentissage de (...) l’éthique dans une approche pragmatiste plus critique et plus émancipatrice. Nous en exposerons les principales orientations pédagogiques et insisterons, pour conclure, sur la responsabilité des environnements socioprofessionnels. Ces derniers sont appelés à devenir plus capacitants, c’est-à-dire à créer les conditions favorables au développement de cet apprentissage de l’éthique. (shrink)

In this paper, I discuss exploitative transactions in bioethics. Examples of this kind of transactions allegedly include, among others, commercial surrogacy, organ selling, and research with human subjects in developing countries. The most problematic kind of exploitation is what Allan Wertheimer calls “mutually advantageous exploitation:” the weak party’s consent for the transaction is an effective and rational consent. Moreover, W does not suffer any harm by the transaction; on the contrary, the transaction benefits W. My aim in this paper is (...) twofold. From the perspective of individual ethics, I offer a model to understand the nature of the wrongfulness of the strong party’s action. And from the perspective of legal ethics, I suggest some reasons to believe that the prohibition of beneficial exploitative contracts is problematic and can only be justified in very exceptional cases. Bioethics embraces a number of ethical problems connected to medicine, biomedical research, and health law. Most of these have both a universal dimension and a more particular one. Reproductive rights, exploitation, commodification, biomedical research, and the protection of the environment, among others, are issues that can be discussed from a universal perspective.

This chapter is a work in applied metaphysics. Recent discussions of monism and metaphysical dependence are deployed to develop a view—the doctrine of divine priority (DDP)—that is a viable alternative to the doctrine of divine simplicity (DDS). DDS and the traditional motivation for it are discussed, then DDP is introduced by way of an analogy involving Jonathan Schaffer’s distinction between two forms of monism. It is argued that DDP is an alternative to DDS by showing that it is consistent with (...) the traditional motivation for the latter view, and argued that DDP is a viable alternative by showing that objections to its peculiar implications rest on assumptions that can reasonably be rejected. In the concluding section, the findings of the main discussion are summarized and DDP’s potential theological import is illustrated with a brief discussion of a possible solution to the Problem of the Trinity it affords. Wittgenstein's Tractatus has generated many interpretations since its publication in 1921, but over the years a consensus has developed concerning its criticisms of Russell's philosophy. In Wittgenstein's Apprenticeship with Russell, Gregory Landini draws extensively from his work on Russell's unpublished manuscripts to show that the consensus characterises Russell with positions he did not hold. Using a careful analysis of Wittgenstein's writings he traces the 'Doctrine of Showing' and the 'fundamental idea' of the Tractatus to Russell's logical atomist research program, (...) which dissolves philosophical problems by employing variables with structure. He argues that Russell and his apprentice Wittgenstein were allies in a research program that makes logical analysis and reconstruction the essence of philosophy. His sharp and controversial study will be essential reading for all who are interested in this rich period in the history of analytic philosophy. (shrink)
