The subjective deontic "ought" generates counterexamples to classical inference rules like modus ponens. It also conflicts with the orthodox view about modals and conditionals in natural language semantics. Most accounts of the subjective ought build substantive and unattractive normative assumptions into the semantics of the modal. I sketch a general semantic account, along with a metasemantic story about the context sensitivity of information-sensitive operators.

Eyewitness testimony is a powerful form of evidence, and this is especially true in the United States criminal legal system. At the same time, eyewitness misidentification is the greatest contributing factor to wrongful convictions proven by DNA testing. In this paper, I offer a close examination of this tension between the enormous epistemic weight that eyewitness testimony is afforded in the United States criminal legal system and the fact that there are important questions about its reliability as a source of (...) evidence. In Sections 1 and 2, I argue that lineups and interrogations often function by way of extracting testimony from an eyewitness through practices that are manipulative, deceptive, or coercive. I then show, in Section 3, that when testimony that is extracted in these ways is given an unwarranted excess of credibility, the eyewitness in question is the victim of what I call agential testimonial injustice. I conclude that since much of the testimony of eyewitnesses is both extracted and given an excess of credibility, there is a fairly widespread form of epistemic injustice being inflicted upon testifiers in the United States criminal legal system. This calls for reforms along both dimensions—lineups and interrogations should go through a witness's epistemic agency, rather than bypassing, exploiting, or undermining it, and the weight of the resulting testimony should be viewed in the broader context of its significant fallibility. In this paper, I will argue that there is a deep connection between home-based care, technology, and the self. Providing the means for persons to receive care at home is not merely a kindness that respects their preference to be at home: it is an important means of extending their selfhood and respecting the unique selves that they are. Home-based technologies like telemedicine and robotic care may certainly be useful tools in providing care for persons at home, but they also (...) have important implications for sustaining selfhood in ways that are of value to individuals and those who care for them. I will argue, by appealing to Hilde Lindemann’s notion of “holding” persons’ identities in place, that technological interventions are not only useful tools for improving and sustaining health and good care at home, but that they may also help to extend our personal identities and relational capacities in ways that are practically and ethically good. Because of these important goods, I will claim that there is a prima facie moral duty to do this “holding” work and that it is best done by family members and loved ones who are well suited to the job because of their history and relationship with the individual that needs to be “held” in place. This paper treats the political and ethical issues associated with the new caretaking technologies. Given the number of feminists who have raised serious concerns about the future of care work in the United States, and who have been critical of the degree to which society “free rides” on women's caretaking labor, I consider whether technology may provide a solution to this problem. Certainly, if we can create machines and robots to take on particular tasks, we may lighten the care burden (...) that women currently face, much of which is heavy and repetitious, and which results in injury and care “burnout” for many female caretakers. Yet, in some contexts, I argue that high-tech robotic care may undermine social relationships, cutting individuals off from the possibility of social connectedness with others. (shrink)

This study examines the relation between firms’ corporate philanthropic giving and their performance in three other social domains – employee relations, environmental issues, and product safety. Based on a sample of 384 U.S. companies and using data pooled from 1998 through 2000, we find that worse performers in the other social areas are both more likely to make charitable contributions and that the extent of their giving is larger than for better performers. Analyses of each separate area of social performance, (...) however, indicate that the relation between giving and negative social performance (cited concerns) only holds for the environmental issues and product safety areas. We find no significant association between corporate philanthropy and employee relations concerns. In general, these findings suggest that corporate philanthropy may be more a tool of legitimization than a measure of corporate social responsibility. (shrink)

The “expertise defense” is the claim that philosophers have special expertise that allows them to resist the biases suggested by the findings of experimental philosophers. Typically, this defense is backed up by an analogy with expertise in science or other academic fields. Recently, however, studies have begun to suggest that philosophers' intuitions may be just as subject to inappropriate variation as those of the folk. Should we conclude that the expertise defense has been debunked? I'll argue that the analogy with (...) science still motivates a default assumption of philosophical expertise; however, the expertise so motivated is not expertise in intuition, and its existence would not suffice to answer the experimentalist challenge. I'll also suggest that there are deep parallels between the current methodological crisis in philosophy and the decline of introspection-based methods in psychology in the early twentieth century. The comparison can give us insight into the possible future evolution of philosophical methodology. (shrink)

ABSTRACT:The primacy of shareholder demands in the traditional theory of the firm has typically excluded marginalised stakeholder voices. However, shareholders involved in social shareholder engagement (SSE) purport to bring these voices into corporate decision-making. In response to ethical concerns about the legitimacy of SSE, we use the lens of discourse ethics to provide a normative analysis at both action and constitutional levels. By specifying three normative questions, we extend the analysis of SSE to identify a political role for shareholders in (...) pursuit of the common good. We demonstrate the desirability for SSE to promote regulatory/institutional change to guarantee marginalised stakeholders a voice in corporate decisions that affect them. The theory of SSE we propose thus calls into question the stark separation of the political and economic spheres and reveals an underlying tension, often overlooked, within the responsible investment literature. Psychiatric ethics spans several overlapping domains, including the guidelines for ethical research in psychiatry, the professional ethics required in the practice of psychiatry, and a broader set of moral and ethical problems and dilemmas distinctive to, or at least magnified by, the mental health care setting. Reviewed here are selected issues arising in the last two domains, some seemingly inevitable components of mental disorder and its cultural history and others resultant from recent changes and discoveries. Even as science explains and (...) demystifies mental disorder, it is concluded, new ethical problems will continue to arise in psychiatry and certain recalcitrant problems will likely persist. The primary purpose behind effectiveness research is to determine whether a treatment with demonstrated efficacy has utility when administered to the general population. The main questions these studies are meant to answer are these: Can the typical patient respond to treatment? Is the treatment acceptable to the typical patient? Can the treatment be administered safely and in its entirety in the typical treatment setting? Is the treatment under study significantly better than the community standard of care both from a cost (...) and outcome perspective? Answering these questions is meant to provide sufficient information to providers and policymakers so that effective interventions can be adopted and become the new community standard. For this research to make a meaningful impact on a provider and policymaker's decision to change the status quo, study interventions should be compared to the existing community standard of treatment, often referred to as treatment as usual. From an ethical perspective, this decision may not always be the safest choice. In some populations, TAU may mean no treatment at all, and in others TAU may be worse than withholding treatment. The effectiveness researcher is then caught between the pull to do no harm and the need for research to have an impact on change. The purpose of this article is to highlight certain conditions when TAU is ethically acceptable and to discuss alternatives when TAU may be an unethical treatment condition. For purposes of precision, we focus exclusively on psychotherapy effectiveness research rather than system-intervention research or medication-intervention research. (shrink)

This article examines the case of institutional inertia in Japanese financial regulation, focusing on the reasons why institutions centered on informal modes of organization and interaction proved particularly The Japanese case serves as a particularly tough test for theories of institutional adaptation and change because even crisis failed to produce timely institutional change. The paper argues that informal, exclusionary and opaque relational ties served as a functional substitute for formal regulation and promoted cooperative government-bank relationships in an earlier period. Yet, (...) when the informal attributes of the system began to impede the sound functioning of the financial system, the very opacity of these ties and the informational dynamics underlying them meant that the Diet and the general public were less than fully aware of the extent of dysfunction present as time went on. According to a standard characterization of dispositions, when a disposition is activated by a stimulus, a manifestation of that disposition typically occurs. For example, when flammable gasoline encounters a spark in an oxygen-rich environment, the manifestation of flammability—combustion—occurs. In the dispositions/powers literature, it is common to assume that a manifestation is an effect of a disposition being activated. (I use “disposition” and “power” interchangeably). I address two questions in this chapter: Could all manifestations be effects that involve things acquiring only (...) dispositional properties? And, is thinking of manifestations as contributions to effects preferable to thinking of them as effects? I defend negative responses to both questions. If all properties are dispositional, as the pandispositionalists claim, then any time the activation of a disposition results is something acquiring a new property, it results in something acquiring another disposition. Some worry that a vicious regress ensues (Swinburne, 1980; Bird, 2007a, 2007b: 132-46). While I believe that regress arguments can be addressed, my worry is that, on the pandispositionalist view, manifestations become unobservable. Thinking of manifestations as effects is problematic in cases where what actually occurs is not the kind of effect that the power is a power for, but rather a complex interaction of various powers. Because of this, some prefer to think of manifestations as contributions to effects (Molnar, 2003: 194-8; Mumford, 2009). I argue against this proposal on the ground that it introduces mysterious new entities into our ontology. In the end, the most plausible view is that a single kind of power can have different kinds of effects, some of which involve the instantiation of non-dispositional properties. I proceed as follows. In the first section of this chapter, I show that the philosophical concept of a manifestation is the concept of an effect. In the second section, I argue against the claim that all manifestations involve instantiations of only dispositional properties. In the third section, I argue against the view that manifestations are contributions rather than effects. (shrink)

Dominance feminism and afropessimist theory, despite their critical appearances three decades apart, are undergirded by similar rhetorical strategies, political commitments and argumentative moves. This is the case even as afropessimism’s citational trajectory rarely invokes dominance feminism, and often positions itself as a critique of feminism’s imagined conception of gender as white, one that is thought to be most emphatically announced in the work of scholars like MacKinnon who invest in a gender binary, and in women’s oppressed location in this binary. (...) In this article, I insist on reading dominance feminism and afropessimism together. In so doing, I aspire to challenge afropessimism’s prevailing conception of gender, revealing that while it is often critical of feminist conceptions of gender – particularly conceptualisations of gender that are thought to insist on the shared experiences and positions of women – it actually relies on similar argumentative moves, and even rhetorical seductions, as dominance feminism. In this article, we develop a hierarchical Bayesian model of learning in a general type of artificial language‐learning experiment in which learners are exposed to a mixture of grammars representing the variation present in real learners’ input, particularly at times of language change. The modeling goal is to formalize and quantify hypothesized learning biases. The test case is an experiment (Culbertson, Smolensky, & Legendre, 2012) targeting the learning of word‐order patterns in the nominal domain. The model identifies internal biases of (...) the experimental participants, providing evidence that learners impose (possibly arbitrary) properties on the grammars they learn, potentially resulting in the cross‐linguistic regularities known as typological universals. Learners exposed to mixtures of artificial grammars tended to shift those mixtures in certain ways rather than others; the model reveals how learners’ inferences are systematically affected by specific prior biases. These biases are in line with a typological generalization—Greenberg's Universal 18—which bans a particular word‐order pattern relating nouns, adjectives, and numerals. (shrink)

Are women's requests for aid in dying honored more often than men's, or less? Feminist arguments can support conclusions either that gendered perceptions of women as self‐sacrificing predispose physicians to accede to women's requests to die — or that cultural understandings of women as not fully rational agents lead physicians to reject their requests as irrational.

Philosophical theorizing is often, either tacitly or explicitly, guided by intuitions about cases. Theories that accord with our intuitions are generally considered to be prima facie better than those that do not. However, recent empirical work has suggested that philosophically significant intuitions are variable and unstable in a number of ways. This variability of intuitions has led naturalistically inclined philosophers to disparage the practice of relying on intuitions for doing philosophy in general (e.g. Stich & Weinberg 2001) and for doing (...) moral philosophy in particular (Appiah 2008; Doris & Stich 2005; Horowitz 1998; Nadelhoffer & Feltz 2008; Sinnott Armstrong 2008). In this paper, we will draw on naturalistic considerations to offer some solace to philosophers who rely on intuitions. We wouldn’t call this a defense of intuitions, exactly, since we are sympathetic with much of the naturalists’ critique. But we want to introduce into the debate some neglected naturalistic reasons to be optimistic about intuitions, focusing especially on ethical intuitions. (shrink)

Lapses in ethical conduct by those in corporate and public authority worldwide have given business researchers and practitioners alike cause to re-examine the antecedents to personal ethical values. We explore the relationship between ethical values and an individual’s long-term orientation or LTO, defined as the degree to which one plans for and considers the future, as well as values traditions of the past. Our study also examines the role of work ethic and conservative attitudes in the formation of a person’s (...) long-term orientation and consequent ethical beliefs. Empirically testing these hypothesized relationships using data from 292 subjects, we find that long-term perspectives on tradition and planning indeed engender higher levels of ethical values. The results also support work ethic’s role in fostering tradition and planning, as well as conservatism’s positive association with planning. Additionally, we report how tradition and planning mediate the influence of conservatism and work ethic on the formation of ethical values. Limitations of the study and future research directions, as well as implications for business managers and academics, are also discussed. (shrink)

One of the ethical issues that has been raised recently regarding emerging neurotherapies is that people will be coerced explicitly or implicitly in the workplace or in schools to take cognitive enhancing drugs. This article builds on this discussion by showing how the law may pressure people to adopt emerging neurotherapies. It focuses on a range of private law doctrines that, unlike the criminal law, do not come up very often in neuroethical discussions. Three doctrines—the doctrine of mitigation, the standard (...) of care in negligence, and child custody determinations in family law—are addressed to show how the law may pressure people to consent to treatment by offering a choice between accepting medical treatment and suffering a legal disadvantage. The doctrines considered in this article apply indirect pressure to submit to treatment, unlike court-ordered medical treatment, which applies direct pressure and is not addressed here. The outcome of this discussion is to show that there is a greater range of social pressures that may encourage the uptake of novel neurotherapies than one might initially think. Once treatments that were developed and offered with therapeutic benefits in mind become available, their existence gives rise to unintended legal consequences. This certainly does not mean we should cease developing new therapies that may be of tremendous benefit to patients, but it does raise some questions for physicians and for legal policy-makers. How should physicians, who are required by medical ethical principles to obtain valid consent to treatment, react to a patient’s reluctant consent that is driven by legal pressure? From the legal policy perspective, are our legal doctrines satisfactory or should they be changed because, for example, they unduly promote the collective interest over individual freedom to reject medical treatment or because they channel us toward economically efficient treatments to the detriment of more costly but potentially superior approaches of dealing with behavioural problems? This essay addresses feminist approaches to medical aid in dying (MAID), considering whether it is a practice that should be supported for women and other marginalized groups. Some feminists have raised rights and justice-based arguments in support of MAID; others have taken a care-based approach to suggest that the practice violates relationships of care and only worsens distrust between marginalized groups and the medical establishment. I argue that we need to adopt both justice and care approaches to develop a robust (...) feminist account of MAID. I defend a woman’s right to choose death in cases of terminal illness or suffering but argue that relational concerns of care, trust, and trustworthiness must be addressed at the same time to ensure that MAID is justly practiced and accessible to all those who want it. This article conceptualizes labor force exits as a parallel option to employer changes in the gender-specific opportunity structure for employed young women. It argues that the same working conditions should predict both employment exits and employer changes. Family characteristics, rather than working conditions, should differentiate between job changers and job leavers. These hypotheses were tested with 1970-1980 data from the National Longitudinal Survey. Results from logit analyses showed that employment conditions do affect young women's decisions to change jobs or exit (...) the labor force, and influence them in similar ways, and that household factors affect labor force exits more strongly than they do job changes. While pregnant women are more likely to leave the labor force, both improved job conditions and existing preschool children enhance the likelihood of continuous employment for pregnant women. Mammals have an XX:XY system of chromosomal sex determination in which a small heterochromatic Y controls male development. The Y contains the testis determining factor SRY, as well as several genes important in spermatogenesis. Comparative studies show that the Y was once homologous with the X, but has been progressively degraded, and now consists largely of repeated sequences as well as degraded copies of X linked genes. The small original X and Y have been enlarged by cycles of autosomal addition (...) to one partner, recombination onto the other and continuing attrition of the compound Y. This addition–attrition hypothesis predicts that the pseudoautosomal region of the human X is merely the last relic of the latest addition. Genes (including SRY) on the conserved or added region of the Y evolved functions in male sex determination and differentiation distinct from the general functions of their X‐linked partners. Although the gonadogenesis pathway is highly conserved in vertebrates, its control has probably changed radically and rapidly in vertebrate – even mammalian – evolution. (shrink)

During his presidency, Donald Trump announced an expanded "conscience rule" for healthcare workers according to which they would have the protected right to morally and religiously oppose a variety of procedures, including abortion, sterilization, assisted suicide, and other medical procedures. In recent years there has been concern among law enforcement and national security organizations about the use of “anonymous” prepaid mobile phone service and its purported role in supporting criminal and terrorist activities. As a result, a number of countries have implemented registration requirements for such service. Privacy rights advocates oppose such regulatory measures, arguing that there is little practical value in attempting to register prepaid mobile devices, and the issue raises important questions about a citizen's entitlement to anonymity in (...) the ownership of a networked communications device. This article provides an overview of the issue and presents findings drawn from a recent study on prepaid mobile phone regulation in the Organisation for Economic Co-operation and Development countries. The article concludes by suggesting that there are significant problems with the claim that mandatory registration of prepaid mobile phone service is a necessary or an effective regulatory course of action. Ecumenical views in metaethics hold that normative utterances express hybrid mental states, states which include both a cognitive and a conative component. The ecumenicist can have her cake and eat it too: the view reaps the benefits of both cognitivist and non-cognitivist theories of normative judgement. The conative component of normative judgements accounts for their necessary link with motivation and rational action. The cognitive component makes it possible for the ecumenicist to endorse expressivism without facing the most difficult Frege-Geach challenges. (...) Ridge (2014) provides a defence of ecumenical expressivism about practical normativity that is both ambitious and compelling. I discuss and try to challenge two (unrelated) parts of the view. In the first section, I’ll raise a question for Ridge’s strategy for addressing the Frege-Geach problem, and in particular his proposed recipe for how to interpret normative assertions of arbitrary logical complexity. Then I discuss Ridge’s defence of cognitivism about rationality. I try to highlight some considerations that make expressivism about theoretical and practical rationality attractive. (shrink)

Ethical codes have been hailed as an explicit vehicle for achieving more sustainable and defensible organizational practice. Nonetheless, when legal compliance and corporate governance codes are conflated, codes can be used to define organizational interests ostentatiously by stipulating norms for employee ethics. Such codes have a largely cosmetic and insurance function, acting subtly and strategically to control organizational risk management and protection. In this paper, we conduct a genealogical discourse analysis of a representative code of ethics from an international corporation (...) to understand how management frames expectations of compliance. Our contribution is to articulate the problems inherent in codes of ethics, and we make some recommendations to address these to benefit both an organization and its employees. In this way, we show how a code of ethics can provide a foundation for ethical sustainability, while addressing management intentions and employees’ ethical satisfaction. (shrink)

The contemporary process of financialization has been a major driver of the remarkable changes witnessed in global food and agricultural markets over the past decade, contributing to the rise and subsequent volatility of food and agricultural commodity prices since 2006. In the wake of these developments it has become clear that the turmoil has intensified the relationship between agriculture and finance in ways that have profound and enduring implications for the sector, and the people whose lives and livelihoods depend upon (...) it. This symposium brings together four original research articles that contemplate the contemporary relationship between the agrifood and financial sectors. They examine a variety of overlapping themes, including the creation of financial assets from farmland and agricultural commodities, the activities of different types of investors in these assets in specific geographic contexts, and the challenges of governing this activity at the global scale. These articles show that the period of market volatility that began a decade ago re-invigorated investor interest in financial products linked to agriculture and farming, and inspired the packaging of new forms of financial assets in ways that have affected politics and practice on the ground, and are likely to leave a lasting legacy. While there is a growing body of work on moral issues and global governance in the fields of global justice and international relations, little work has connected principles of global health justice with those of global health governance for a theory of global health. Such a theory would enable analysis and evaluation of the current global health system and would ethically and empirically ground proposals for reforming it to more closely align with moral values. Global health governance has been framed (...) as an issue of national security, human security, human rights, and global public goods. The global health governance literature is essentially untethered to a theorized framework to illuminate or evaluate governance. This article ties global health justice and ethics to principles for governing the global health realm, developing a theoretical framework for global and domestic institutions and actors. (shrink)

In both the philosophy and psychology of emotion there is disagreement regarding the role of biology/genetics and culture/sociality in emotional development and experience. Using recent insights from developmental psychology and biology, and particularly recent developments in metaphysics of mind, I argue that distinctly human emotionality requires the complex interaction of both. Human neonates and caregivers are genetically preadapted to enable emotional ontogenesis in the context only of a complexly interdependent linguistically-mediated social relationship. This relationship provides the requisite sensory-perceptual stimulation to (...) excite intracellular genetic activity and the resultant development/maturation of emotion-related neural substrata. This genetic preadaptation and the close linguistically-mediated social relationship together provide the necessary and sufficient conditions for the gradual development of human adult emotionality. ObjectivesTo describe reporting of informed consent in pragmatic trials, justifications for waivers of consent and reporting of alternative approaches to standard written consent. To identify factors associated with (1) not reporting and (2) not obtaining consent.MethodsSurvey of primary trial reports, published 2014–2019, identified using an electronic search filter for pragmatic trials implemented in MEDLINE, and registered in ClinicalTrials.gov.ResultsAmong 1988 trials, 132 (6.6%) did not include a statement about participant consent, 1691 (85.0%) reported consent had been obtained, 139 (7.0%) reported a (...) waiver and 26 (1.3%) reported consent for one aspect (eg, data collection) but a waiver for another (eg, intervention). Of the 165 trials reporting a waiver, 76 (46.1%) provided a justification. Few (53, 2.9%) explicitly reported use of alternative approaches to consent. In multivariable logistic regression analyses, lower journal impact factor (p=0.001) and cluster randomisation (p<0.0001) were significantly associated with not reporting on consent, while trial recency, cluster randomisation, higher-income country settings, health services research and explicit labelling as pragmatic were significantly associated with not obtaining consent (all p<0.0001).DiscussionNot obtaining consent seems to be increasing and is associated with the use of cluster randomisation and pragmatic aims, but neither cluster randomisation nor pragmatism are currently accepted justifications for waivers of consent. Rather than considering either standard written informed consent or waivers of consent, researchers and research ethics committees could consider alternative consent approaches that may facilitate the conduct of pragmatic trials while preserving patient autonomy and the public’s trust in research. Disposition terms, such as 'cowardice,' 'fragility' and 'reactivity,' often appear in explanations. Sometimes we explain why a man ran away by saying that he was cowardly, or we explain why something broke by saying it was fragile. Scientific explanations of certain phenomena feature dispositional properties like instability, reactivity, and conductivity. And these look like causal explanations - they seem to provide information about the causal history of various events. Philosophers such as Ned Block, Jaegwon Kim, Elizabeth Prior, Robert Pargetter, and (...) Frank Jacksonl have suggested reasons for thinking that dispositions are causally inert. I call this the "Inert Dispositions View." According to this view, the glass's fragility was not responsible for its breaking; the man's cowardice was causally impotent as he fled. The Inert Dispositions View would call many of the explanations we give into question. By employing a disposition in an explanation, we might have thought we were giving a causal explanation of the event. Perhaps we took ourselves to be explaining an effect with some feature of its cause that was responsible for the effect. However, if dispositions are causally inert, we are explaining the event in some other way, or not really explaining it at all. The Inert Dispositions View suggests that something is amiss with many scientific explanations. If properties like conductivity and volatility are causally inert, it is not clear how appealing to them provides us with information about why certain phenomena occur. This is especially problematic if one thinks, as some do, that the fundamental properties that scientists attribute to the ultimate constituents of matter -- things like force, mass, charge, impenetrability -- are dispositional. If, as Simon Blackburn says, "science finds only dispositional properties all the way down,"2 and if dispositions are causally inert, it would seem that science does not provide us with real causal explanations. The Inert Dispositions View implies that there is something amiss with psychological explanations as well. At least some psychological states are dispositional -- being courageous or shy, being such that you would accept a drink if you were offered one. On some views, all mental states are like dispositions, since having a mental state is a matter of having some brain state or other that performs a certain causal role. If mental properties are relevantly similar to dispositions, and dispositions are inert, then mental properties make no difference to what a body does. However, it is natural to think that my believing and desiring certain things has much to do with my body moving in certain ways. It would take powerful arguments to cast these beliefs into serious doubt. In this paper, I defend the causal efficacy of dispositions against two types of arguments that l call "Analyticity Arguments" and "No Work Arguments." According to Analyticity Arguments, there is an analytic or necessary connection between a disposition and its manifestation, and this goes to show that there is no causal connection. I argue, on the contrary, that it shows no such thing. According to No Work arguments, manifestations of dispositions already have sufficient causes, and so there is "no work" for dispositions to do. I claim that these arguments rest on some questionable assumptions. (shrink)

Post-traumatic stress disorder is a “young” disorder formally recognized in the early 1980s, although the symptoms have been noted for centuries particularly in relation to military conflicts. PTSD may develop after a serious traumatic experience that induces feelings of intense fear, helplessness or horror. It is currently characterized by three key classes of symptoms which must cause clinically significant distress or impairment of functioning: persistent and distressing re-experiencing of the trauma; persistent avoidance of stimuli associated with the trauma and numbing (...) of general responsiveness; and persistent symptoms of hyper-arousal. One of the possible symptoms within the second class is difficulty in remembering an important aspect of the traumatic event.PTSD is not an uncommon condition, with an estimated lifetime prevalence of about 7-9% based on studies conducted in the United States and Canada, with women at higher risk than men. While not everyone who experiences a significant trauma will go on to develop PTSD, about a third will do so. Sexual assault, along with other forms of assaultive violence, pose a comparatively high risk of PTSD. (shrink)

This paper is one of four interrelated action papers resulting from the 2008 National Summit on Legal Preparedness for Obesity Prevention and Control. Summit participants engaged in discussions on the current state of the law with respect to obesity, nutrition and food policy, physical activity, and physical education. Participants also identified gaps in the law at all jurisdictional levels and relevant to numerous sectors and disciplines that have a stake in obesity prevention and control.The companion paper, “Assessment of Laws and (...) Legal Authorities for Obesity Prevention and Control,”identified numerous laws and policies enacted to target the three domains of healthy lifestyles, healthy places, and healthy societies. That paper identified several gaps in the law that require attention and action. This paper addresses those gaps and presents applicable laws and legal authorities that public health professionals and lawyers can consider to implement to close the gaps. (shrink)
