It is common for us to see models as exemplars of things that exist. Models, instead, are merely Peircean indexes, in that they only point to their objects, objects which may in themselves not exist. This is to say that these examples may only exist as thoughts that point to other thoughts or even ideas that point to objects that may not exist because they are paradoxical.

At the forefront of international concerns about global legislation and regulation, a host of noted environmentalists and business ethicists examine ethical issues in consumption from the points of view of environmental sustainability, economic development, and free enterprise.

Public health ethicists face two difficult questions. First, what makes something a matter of public health? While protecting citizens from outbreaks of communicable diseases is clearly a matter of public health, is the same true of policies that aim to reduce obesity, gun violence or political corruption? Second, what should the scope of the government’s authority be in promoting public health? May government enact public health policies some citizens reasonably object to or policies that are paternalistic? Recently, some theorists have (...) attempted to address these questions by arguing that something is a matter of public health if and only if it involves a health-related public good, such as clean water or herd immunity. Relatedly, they have argued that appeals to the promotion of public health should only be used to justify the provision of health-related public goods. This public goods conception of public health (PGC) is meant to enjoy advantages over its rivals in three respects: it provides a better definition of public health than rival views, it respects moral disagreement, and it avoids licensing objectionably paternalistic public health policies. We argue, however, that the PGC does just as poorly, or worse, than its rivals in all three respects. (shrink)

Since the publication of Wahrheit und Methode in 1960 (Tfibingen), Gadamer's hermeneutics has called forth a varied and fruitful response from the Continent, without receiving anything near the same attention from the English-speaking world. Though E. D. Hirsch thought Gadamer sufficiently important in 1965 to merit an early rebuttal and rehabilitation (Validity in Interpretation [New Haven, Conn., 1967], pp. 245-64), Wahrheit und Methode remained unread in England and America, partly because a translation was not available until 1975 (Truth and Method, (...) ed. Garrett Barden and John Cumming [New York]). Even after that date, Gadamer's influence on Anglo-American debate has been largely secondhand, filtering in through such figures as Paul Ricoeur and Jiurgen Habermas. But a renewed interest in the question of what we are to make of tradition, no doubt spurred in large measure by deconstruction's effort to unmake it, has lent Gadamer a new pertinence. One sign that his stock is on the rise is the publication of Joel Weinsheimer's Gadamer's Hermeneutics, a much needed and admirably written introduction to Truth and Method that should push its value even higher. -- JSTOR (June 12, 2012.). Is there anything peculiarly "photographic" about photography—something which sets it apart from all other ways of making pictures? If there is, how important is it to our understanding of photographs? Are photographs so unlike other sorts of pictures as to require unique methods of interpretation and standards of evaluation? These questions may sound artificial, made up especially for the purpose of theorizing. But they have in fact been asked and answered not only by critics and photographers but by laymen. Furthermore, (...) for most of this century the majority of critics and laymen alike have tended to answer these questions in the same way: that photographs and paintings differ in an important way and require different methods in interpretation precisely because photographs and paintings come into being in different ways. These answers are interesting because, even within the rather restricted classes of critics, photographers, and theorists, they are held in common by a wide variety of people who otherwise disagree strongly with each other—by people who think that photographs are inferior to paintings and people who believe they are superior; by people who think that photographs ought to be "objective" and those who believe they should be "subjective"; by those who believe that it is impossible for photographers to "create" anything and by those who believe that they should at least try. Joel Snyder teaches criticism and history of photography at the University of Chicago and is presently compiling a book of his own photographs. The use of artificial intelligence (AI) in healthcare comes with opportunities but also numerous challenges. A specific challenge that remains underexplored is the lack of clear and distinct definitions of the concepts used in and/or produced by these algorithms, and how their real world meaning is translated into machine language and vice versa, how their output is understood by the end user. This “semantic” black box adds to the “mathematical” black box present in many AI systems in which the underlying (...) “reasoning” process is often opaque. In this way, whereas it is often claimed that the use of AI in medical applications will deliver “objective” information, the true relevance or meaning to the end‐user is frequently obscured. This is highly problematic as AI devices are used not only for diagnostic and decision support by healthcare professionals, but also can be used to deliver information to patients, for example to create visual aids for use in shared decision‐making. This paper provides an examination of the range and extent of this problem and its implications, on the basis of cases from the field of intensive care nephrology. We explore how the problematic terminology used in human communication about the detection, diagnosis, treatment, and prognosis of concepts of intensive care nephrology becomes a much more complicated affair when deployed in the form of algorithmic automation, with implications extending throughout clinical care, affecting norms and practices long considered fundamental to good clinical care. I find it more than merely suggestive that we call many different kinds of pictures "realistic." As a category label, "realistic" is remarkably elastic. We cheerfully place into the category pictures that are made in strict accordance with the rules of linear perspective, pictures that are at slight variance with those rules but that nonetheless look perfectly "correct" , and pictures made in flagrant contravention of perspective geometry . We accept as realistic pictures that are made in strict accordance with (...) the rules of perspective construction that we could never judge as being similar to anything we might or could ever see . We accept as realistic pictures that are in sharp disagreement with what we now take to be the facts of vision . . . There is something charming and yet nasty about the belief in the special relation of picture to world. It is charming because it allows us to "enter" with ease into pictures and allows them to "extend" into our world. It allows us to think of pictures as "true to life," to use [Ernst] Gombrich's beguiling term, to look at a picture and ask questions of it, as if we were looking at the world through a window. It allows us to treat pictures as substitutes for the objects they represent and so, for example, to buy clothing from an illustrated catalogue, or to analyze architectural styles from pictures of buildings. In brief, it allows us to feel proximity to what is depicted and urges us to conclude that in certain important respects looking at a picture is equivalent to looking at what is pictured. Abstract: Petri and Gromadzki’s claims about radical neurophenomenology’s position with regard to the existence of a “gap” require clarification. I raise questions about how the three disciplines outlined would contribute, specifically, to an understanding of reciprocal constraints between the experiential and that which is perceived to be external to the subject; and to experience of co-constitution. I suggest that the methodology proposed in the target article could potentially benefit from being supplemented by the use of neurofeedback, in order to retain the neuro element of neurophenomenology. In The Body of Compassion, Joel Shuman presents an important, new theological treatment of contemporary bioethics, weaving together personal experience, a critical treatise on contemporary bioethics, and an exploration of a Christian theological alternative.The author first draws the reader into a consideration of the current state of bioethics by relating the story of his grandfather, a hard-working family man who died a solitary death, unaccompanied by loved ones, in the unfamiliar and sterile world of a hospital. Troubled by the (...) way his grandfather died, Shuman takes the reader along as he explores how modern medicine has distanced itself from dealing with people as living beings beyond their immediate physicality. He examines how various approaches to bioethics over the past twenty years have tried to remedy this problem by prescribing certain standards for treatment and how each of these ultimately has fallen short due to the lack of “a teleological concern for the body”—i.e., to trying to understand what the body is actually for in a larger context. From this point, Shuman deftly moves to a discussion of the centrality of the body to Christianity, focusing on how baptism, participation in the liturgy, and the partaking of the Eucharist all serve to unite Christians as one in the body of Christ. For Christians, the author argues, the body does not just belong to the individual but rather is one with the community of the Church. With this in mind, Shuman proposes a new kind of bioethics for Christians, where care for the body of Christ becomes the model of how we should care for and receive care from each other.This fresh and thought-provoking book is sure to be of interest to ethicists, medical professionals, and everyone who is troubled by places where science and religion intersect and seem to conflict. Erwin Panofsky explicitly states that the first half of the opening chapter of Studies in Iconology—his landmark American publication of 1939—contains ‘the revised content of a methodological article published by the writer in 1932’, which is now translated for the first time in this issue of Critical Inquiry.1 That article, published in the philosophical journal Logos, is among his most important works. First, it marks the apogee of his series of philosophically reflective essays on how to do art history,2 that (...) reach back, via a couple of major pieces on Alois Riegl, to the 1915 essay on Heinrich Wölfflin.3 Under the influence of his colleague at Hamburg Ernst Cassirer, the principal interpreter of Kant in the 1920s, Panofsky from 1915 on exhibits in his work ever more Kantian thinking and language.4 But Logos was not an art-historical review or one dedicated to aesthetics but a principal mainstream journal of the philosophy of culture. In recent work, Joshua Glasgow has offered a definition of racism that is supposed to put to rest the debates between cognitive, behavioral, attitudinal, and institutionalist definitions. The key to such a definition, he argues, is the idea of disrespect. He claims: “φ is racist if and only if φ is disrespectful toward members of racialized group R as Rs.” While this definition may capture an important commonality among cognitive, behavioral, and attitudinal accounts of racism, I argue that his attempt (...) to expand the definition to cover institutional or “structural” racism is less persuasive. Alternatively, I argue that structural racism must be understood in terms of injustice rather than disrespect. This involves giving a fuller account of how institutions are related to the beliefs, actions, and intentions of individuals, and thus how they can come to embody a certain kind of agency. (shrink)

Issues of race have traditionally been addressed in medical school curricula in a didactic manner. However, medical school curricula often lack adequate opportunity for the application of learning material relating to race and culture. When confronted with acts of racism in clinical settings, students are left unprepared to respond appropriately and effectively. Forum Theatre offers a dynamic platform by which participants are empowered to actively engage with and become part of the performance. When used in an educational context, Forum Theatre (...) can be a powerful tool for students to interact with a wide variety of social issues. This paper describes the process by which one medical school designed a workshop in the Forum Theatre style to equip students to respond to racism observed in clinical settings. Based on real student experiences, the Responding to Racism in the Clinical Setting workshop was designed to give students an opportunity to combine cultural humility, communication theory and conflict resolution skills in order to prepare for interactions in clinical stages of medical education. As a result of workshop evaluations, surveys, and written reflections, the authors propose that Forum Theatre is a novel teaching modality for incorporating issues of race and culture into medical curriculum. Surely [John R.] Searle must rely on a stable, formal conception of the point of view. He sets Las Meninas on a par with the antimony of the liar and the paradoxes of set theory. But nothing is an antimony or a paradox just because it seems so or just because it is confusing or difficult, even if it seems so to everyone. To deserve such a description, a thing must be, so to speak, intrinsically intractable, not merely resistant when (...) looked at in a particular way. If a man says "I do not believe I am alive," that would be odd, and it would be hard to understand just what he means, and it may even be hard or impossible to believe that he is telling the truth; but there is no antimony. If a man says "I am lying," then we have a primitive version of the antimony of the liar. Given the meaning of this utterance—and nothing else—there is no way to get a grip on it. If what the man says is true, then it's false; if what he says is false, then it's true. Human rights may feel self-apparent to us, but less than 80 years ago, one of the most advanced countries at the time acted based on an utterly contrary ideology. The view of social Darwinism that abandoned the idea of the intrinsic value of human lives instead argued that oppression of the inferior is not only inevitable but desirable. One of the many catastrophic outcomes is the medical data obtained from inhuman experiments at concentration camps. Ethical uncertainty over whether the resulting (...) insights should be a part of the medical literature provides a chance to consider the seemingly irreplaceable social construct of human dignity. Would any medical benefit justify the utilization of this illicit data? Would utilization even qualify as an insult to the dignity of the exploited subjects, or is this a question about intersubjective meaning? This work discusses the wisdom in blind adherence to human dignity, the possibility of retrospective insults, moral complicity, contrary viewpoints, and possible resolutions. (shrink)

The close relationship between Buddhism and medicine that has become so visible thanks to the contemporary ‘mindfulness revolution’ is not necessarily unique to the twenty-first century. The ubiquitous contemporary emphasis on the health benefits of Buddhist and Buddhist-inspired practice is in many ways the latest chapter in a symbiotic relationship between Buddhism and medicine that is both centuries-long and of global scope. This article represents the first steps toward writing a book that explores the global history of Buddhism and medicine (...) ‘from Sarnath to Silicone Valley’. It identifies patterns in the transmission and reception of texts and ideas, networks of circulation, and intersections with local and regional histories that shaped the history of Buddhist ideas and practices concerning physical health and healing. This article investigates the biopolitical dimensions that have grown out of the union between biocapitalism and current science education reform in the US. Drawing on science and technology study theorists, I utilize the analytics of promissory valuation and salvationary discourses to understand how scientific literacy in the neo‐Sputnik era has deeply involved educational life in biocapitalist circuits of exchange and production. I lay out this emerging terrain of ‘futuricity’ through a biopolitical analysis of the National Academies highly influential policy recommendation (...) on science education, Rising Above the Gathering Storm as well as the Association of American Universities' National Defense Education and Innovation Initiative. Here it is argued that the educational subject usually seen as a site of human capital investment can better be understood as a ‘biovalue’ in at least two senses: the educational subject's body as a site of investment and as an extractable source of value directly related to the larger globally competitive regime of the rapidly growing bioeconomy. I conclude my analysis of the vital politics at play in the biocapitalist articulation of science education with an alternative model of scientific literacy that is based in what I call biodemocratic practices. I explore such a rereading of scientific literacy through the example of the GrowHaus—a sustainable urban farm situated in a marginalized community in a major US city. The GrowHaus offers a model of scientific literacy that rejects extractive ethics associated with biocapitalist production and instead promotes a sustainable and socially just practice of science. In 2000, firearms were used in 10,801 homicides – two-thirds of all homicides in the U.S. – and 533,470 non-fatal criminal victimizations including rapes, robberies, and assaults. The social costs of gun violence in the United States are also staggering, and have been estimated to be on the order of $100 billion per year.Illegal gun carrying, usually concealed, in public places is an important risk factor for firearm-related crime. In past work, Habermas has claimed that justice and solidarity stand in a complementary relationship—that ‘ethical’ relations of solidarity are the ‘reverse side’ of justice. Yet in a recent address to the World Congress of Philosophy, he rejects this idea. This paper argues against this rejection. After explaining the idea, arguing for its centrality to Habermas' thought, and evaluating Habermas' scant reflections on this major transformation, I argue that his rejection of the idea is a result of a newfound skepticism (...) about the power of secular reason, and should thus be understood in terms of his corresponding turn to religious traditions as alternative sources of solidarity. I argue against this ‘religious turn’ by developing an alternative advocated by Habermas himself in earlier reflections—attention to real sociopolitical movements. In particular, I analyze feminist and black liberation movements to demonstrate that Habermas' pessimism about secular sources of justice-producing solidarity is unwarranted, and that, while ‘postsecular’ sources may provide one avenue for actionable solidarity, they are not the only one. I conclude by identifying a conceptual commonality in these two alternatives: an inclusive conception of what it means to be human. (shrink)

This article revisits the Frankfurt School’s reflections on race, anti-Semitism and fascism, focusing especially on the theory of race implicit in Dialectic of Enlightenment. It argues that this theory has the potential to be developed into a critical functionalist theory of race that avoids both class and race reductionism, offering a thoroughly intersectional competitor to currently dominant philosophies of race. The key to such a theory is the view that racialization plays a functional role in sustaining capitalist exploitation. While Horkheimer (...) and Adorno focus on the scapegoat function of racialization, I argue that this function, while important, does not exhaust the possible functionalities of racialization and neglects an especially crucial function: the maintenance of a specifically racial form of exploitation. This paper offers a qualified defence of physician non-compliance with antiabortion legislation in the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. The paper examines two ethically troubling trends of post-Dobbs legislation: narrow and vague maternal health exemption clauses and mandatory reporting of miscarriages in jurisdictions where patients may criminal prosecution for medically induced abortions. It then examines and defends a professional obligation on the part of physicians to comply with the law. This obligation, however, (...) is defeasible. The paper then argues that physicians’ obligations to comply with the law is defeated when the law is illegitimate and following the law would constitute bad medical practice. Finally, it argues that the ethically troubling trends in post-Dobbs antiabortion legislation may meet these criteria. (shrink)

Authenticity has played a central role in modern philosophical discourse, where it has often been interpreted individualistically. But concerns about authenticity also arise in relation to questions of group membership, and become especially pressing in the case of minority and disadvantaged groups. In this essay, I develop an alternative conception of authenticity based upon the intersubjective relation of trust. This relational conception is better equipped to make sense of both individual and collective authenticity, which, I ultimately argue, are two sides (...) of the same coin. (shrink)

It highlights areas of interdisciplinary research interest, including facial expression, expressive action, and the role of both normativity and context in emotion perception. Whilst philosophical discussion of emotional expression has addressed the nature of expression and its relation to action theory, psychological work on the topic has focused on the specific mechanisms underpinning different facial expressions and their recognition. Further, work in both (...) legal and political theory has had much to say about the normative role of emotional expressions, but would benefit from greater engagement with both psychological and philosophical research. This article considers how race and gender shape latina and Latino paths to school success in college. A purposive sample of successful high school and college students was selected. Through interviews, fieldwork, and school records, the researchers find that Latinas navigate successfully through negative stereotypes by maintaining positive definitions of themselves and by emphasizing their group membership as Latina. Young Latino men also see themselves as part of a larger cultural group but tend to have less positive racial and ethnic (...) identities than women do. Typically, they are supported by mentors, such as white athletic coaches, and tend to draw from the meritocratic ethos of sports, regarding their success in individualistic terms. While successful Latinas do not assimilate in the ways predicted by the literature, the young men in this study accept the individualistic and meritocratic ethos of the dominant culture, but with a psychological price. Pierce SINCE TERMS ARE THE TOOLS of literary study, it is important to keep these tools in good condition, above all by having clear and functional meanings for them. Notoriously, many critical arguments about texts are in fact differences about terminology, and many confused arguments are built on vague or arbitrarily used terms. Few (...) have been the subject of more critical worrying and infighting than "poetry," 1 and few are more disparately defined. Definitions that are fuzzy or tendentious confuse many a discussion of poetry, and in particular they often narrow our response to the rich variety of the texts in front of us by silently imposing a view of what poetry ought to be. I would like to suggest that a Wittgensteinian approach to meaning can cut through a lot of the difficulty that surrounds the term. The refined understanding of the term "poetry" will result in a certain demystification, but it will dissipate only a false mystery based on confusion, not the real mystery of depth and richness that poetry can offer.What does it mean to approach this issue as a Wittgensteinian? The main principle is that the meaning of a term is its use, the way people deploy it in their speaking and writing, the work that it does. 2 A word does not have an essential core of meaning of which the various social uses are approximations; rather those social uses are the meaning. Some historicists see insuperable barriers in trying to understand utterances from different times and cultures, and some skeptics see such barriers in trying to read other minds. In Ludwig Wittgenstein's famous utterance about not understanding a talking lion, is the early modern Englishman Shakespeare one of those lions? Studies of hermeneutics have rarely dealt with eighteenth-century British thought, yet during this period debates over the interpretation of texts plagued and invigorated religious, intellectual, and political life in England. This important book is the first to deal with hermeneutical issues in British scriptural, legal, historical, political, and literary interpretation. Examining the work of Swift, Locke, Toland, Bolingbroke, Hume, Reid, Blackstone, and Burke, Joel C. Weinsheimer discusses common philosophical problems of understanding, concentrating especially on their theories about the application (...) of taste to discern interpretive truth. Weinsheimer's approach is primarily philosophical. In each area of hermeneutic endeavor, he asks such questions as why it is necessary to interpret, what it means to interpret, what does not need interpreting, what constitutes the signs of right understanding, and what accounts for the multiplicity of interpretations. He concludes that hermneutics in eighteenth-century England became the site of a contest and possible reconciliation between reason and history. Driven by the need to escape rationalist formalism as well as an opposite though equally sterile antiquarianism, interpretation offered a new way of thinking about truth, as belonging to reason and history together. There is a rich history in early critical theory of attempting to harness the power of aesthetic imagination for the purposes of political liberation. But this approach has largely faded to the background of contemporary critical theory, eclipsed lately by attempts to reconstruct and apply norms of rationality to processes of democratic will formation à la Habermas. This paper represents a small attempt to return the aesthetic element to its proper place within critical theory, by investigating the aesthetic aspects of (...) certain forms of resistance to technological domination, forms of resistance that become “embodied” in technologies themselves. The phenomena of customization and personalization of technologies, although already co-opted in a variety of ways, are examples of such resistance. I begin then, by specifying the conventional method of understanding technological domination: the differentiation thesis. I then show how this understanding of technological development fails to grasp the reality of technologies as they are embodied in social contexts. A more accurate understanding of these contexts demonstrates that aesthetic imagination plays an important role in politicizing technologies, and enrolling these technologies themselves in the project of resisting the general phenomenon of technological domination. This helps us begin to understand what it might mean to translate the insights of early critical theory into a contemporary critical praxis. (shrink)
