Codes of conduct are viewed here as a community’s attempt to communicate its expectations and standards of ethical behavior. Many organizations are implementing codes, but empirical support for the relationship between such codes and employee conduct is lacking. We investigated the long term effects of a collegiate honor code experience as well as the effects of corporate ethics codes on unethical behavior in the workplace by surveying alumni from an honor code and a non-honor code college who now work in (...) business. We found that self-reported unethical behavior was lower for respondents who work in an organization with a corporate code of conduct and was inversely associated with corporate code implementation strength and embeddedness. Self-reported unethical behavior was also influenced by the interaction of a collegiate honor code experience and corporate code implementation strength. (shrink)

Analogy and similarity are central phenomena in human cognition, involved in processes ranging from visual perception to conceptual change. To capture this centrality requires that a model of comparison must be able to integrate with other processes and handle the size and complexity of the representations required by the tasks being modeled. This paper describes extensions to Structure-Mapping Engine since its inception in 1986 that have increased its scope of operation. We first review the basic SME algorithm, describe psychological evidence (...) for SME as a process model, and summarize its role in simulating similarity-based retrieval and generalization. Then we describe five techniques now incorporated into the SME that have enabled it to tackle large-scale modeling tasks: Greedy merging rapidly constructs one or more best interpretations of a match in polynomial time: O); Incremental operation enables mappings to be extended as new information is retrieved or derived about the base or target, to model situations where information in a task is updated over time; Ubiquitous predicates model the varying degrees to which items may suggest alignment; Structural evaluation of analogical inferences models aspects of plausibility judgments; Match filters enable large-scale task models to communicate constraints to SME to influence the mapping process. Within the philosophy of sport, the phenomenon of practising has received very little attention, whereas other related aspects of sport such as excellence and competition have been subjected to many and thorough studies. This essay will attempt to clarify this particular phenomenon of practising through the notion of athletic ascetics, which will be analysed as a special variant of askēsis. Drawing especially on Foucault’s lectures on ascetics in ancient philosophy and Sloterdijk’s anthropology of the practising life, the essay outlines and (...) interrogates the potential relevance of an ascetological understanding of sport. Through both descriptive and normative analysis, it is argued that athletic ascetics can refine our understanding of performance in sport and comprise an embodied account of the formative aspect of ethics, with implications for ethical considerations related to performance enhancement. This research explores the field dynamics that facilitated the emergence of a dominant understanding of business’ role in sustainable development (SD). Based on a study of the U.N. Earth Summits, we examine how actors meet every decade to battle for definitional control of what SD means for business, and what business means for SD. Through a discourse analysis of texts from business, policy, and civil society actors during each Summit, we illustrate how an ensuing discursive struggle shifts the role of (...) business in SD from being largely undefined in 1992, to being considered an SD partner in 2002, and finally to becoming a driver of SD by 2012. We contend that these shifts occurred largely due to two field dynamics: (a) rearranging of field boundaries and (2) forming of a discourse coalition. Accordingly, our study highlights how disparate actors coalesce around a shared-meaning system and collectively shape the role of business role in SD. However, we argue that despite the allure of a unified meaning-making process between once antagonistic actors, business–SD relations are underpinned by politicized interaction where certain actors come to dominate, and, in doing so, marginalize others. This paper begins with the decisive moment of the 2010 Champions League final, as Diego Milito dribbles past van Buyten to settle the score. By taking a closer look at this situation we witness a complex and ambiguous movement phenomenon that seems to transcend established phenomenological accounts of performance, as a creative performance such as this cannot be reduced to bodily self-awareness or absorbed skilful coping. Instead, the phenomenon of the feint points to a central question we need to ask (...) when investigating performance in football: ?How can one intentionally transcend the expectations of others?? In order to clarify this, the paper will conduct a contextual analysis of a feint drawing on existential philosophy and phenomenology. The main argument is that the feint incarnates a fundamental and indispensable strategy in the game context of football and the analysis of it throws light on central existential phenomena involved in game creativity, with appearance, seduction, commitment and value being the focal ones. The analysis suggests a broader notion of expertise by pointing to the need of stressing the dynamic and social game context. What the feint explicates is that in football it is not enough to be aware of your own body or rely on your embodied habits. In order to cope in the game situation it is also necessary to be absorbed in the other and transcend his or her expectations. (shrink)

The most influential theory of law in current analytic legal philosophy is legal positivism, which generally understands law to be a kind of institution. The most influential theory of institutions in current analytic social philosophy is that of John Searle. One would hope that the two theories are compatible, and in many ways they certainly are. But one incompatibility that still needs ironing out involves the relation of the social rule that undergirds the validity of any legal system (H.L.A. Hart's (...) rule of recognition) to Searle's notion of codification: the idea that institutions need official declarations of their constitutive rules in order to enjoy the full benefits of institutions. The incompatibility arises from the fact that, in order to do its institutional work, the basic validity rule must be codified in Searle's sense—yet, given the particular role it has in legal positivism, it may be impossible to codify in the Searlean sense. In this paper I develop the incompatibility in detail, consider and reject consigning the basic validity rule to Searle's “Background” capacities that support institutional facts, and conclude that the best route to eliminating it while doing a minimum of damage to the two theories is to make a slight emendation to Searle's theory of institutions. Francisco Ayala and others have argued that recent genetic evidence shows that the origins of the human race cannot be monogenetic, as the Church hastraditionally taught. This paper replies to that objection, developing a distinction between biological and theological species first proposed by Andrew Alexanderin 1964.

Rejection of the philosophical relevance of history of philosophy remains pronounced within contemporary analytic philosophy. The two main reasons for this rejection presuppose that strict deduction is both necessary and sufficient for rational justification. However, this justificatory ideal of scientia holds only within strictly formal domains. This is confirmed by a neglected non-sequitur in van Fraassen’s original defence of ‘Constructive Empiricism’. Conversely, strict deduction is insufficient for rational justification in non-formal, substantive domains of inquiry. In non-formal, substantive domains, rational justification (...) is also, in part, ineliminably social and historical, for sound reasons Hegel was the first to articulate. Demonstrating this involves considering closely two key reasons many analytic philosophers (still) reject the philosophical relevance of historical philosophy (§2). As specific example of presumed, though fallacious, deductivism about justification in the non-formal domain of empirical knowledge is found in van Fraassen’s (1980) defence of ‘Constructive Empiricism’ (§3). These first two sections contend that philosophical consideration of historical philosophy is required to properly formulate key issues in non-formal domains. I next consider the further issues involved rational justification in non-formal domains, issues quintessentially posed by the Pyrrhonian Dilemma of the Criterion (§4). Finally I consider what kind of history of philosophy is required for cogent philosophy in non-formal domains (§5). (shrink)

Catholic evolutionists have proposed to reconcile evolutionary anthropogenesis with Catholic doctrine by suggesting that a created soul could be infused into a body produced by evolution from an animal body. Could such an infusion yield not just a Platonic composite but a being with the unity of substance required by a Thomistic philosophy of nature? How could such a soul be the form of the body into which it was infused? This paper suggests that animals seem to have sense-powers with (...) a level of complexity, if not sufficient to underlie the abstraction of concepts in a being that also has a rational soul, then at least nearly so. The burden of proof lies rather on those who think that evolutionary development of such powers is not possible. In its final section, the paper argues that the existence of Eve as a second, and the only additional, initial rational being does not create special problems for the view here articulated. (shrink)

It has been reported by some studies that the desire to be involved in decisions concerning one’s healthcare especially with regard to obtaining informed consent is related to educational status. The purpose of this study, therefore, is to assess the influence of educational status on attitude towards informed consent practice in three south-eastern Nigerian communities.

Sketching is a powerful means of working out and communicating ideas. Sketch understanding involves a combination of visual, spatial, and conceptual knowledge and reasoning, which makes it both challenging to model and potentially illuminating for cognitive science. This paper describes CogSketch, an ongoing effort of the NSF-funded Spatial Intelligence and Learning Center, which is being developed both as a research instrument for cognitive science and as a platform for sketch-based educational software. We describe the idea of open-domain sketch understanding, the (...) scientific hypotheses underlying CogSketch, and provide an overview of the models it employs, illustrated by simulation studies and ongoing experiments in creating sketch-based educational software. In the extended mind literature, one sometimes finds the claim that there is no neural correlate of consciousness. Instead, there is a biological or ecological correlate of consciousness. It is sometimes suggested that the history of computation in cognitive science is one in which the formal apparatus of Turing-equivalent computation, or effective computability, was exported from mathematical logic to ever wider areas of cognitive science and its environs. This paper, however, indicates some respects in which this suggestion is inaccurate. Computability theory has not been focused exclusively on Turing-equivalent computation. Many essential features of Turing-equivalent computation are not captured in definitions of computation as symbol manipulation. Turing-equivalent computation did (...) not play the role in McCulloch and Pitts’s early cybernetic work that is sometimes attributed to it. Although Maimonides' discussion of creation is one of his greatest contributions - he himself claims that belief in creation is second in importance only to belief in God - there is still considerable debate on what that contribution was. Kenneth Seeskin takes a close look at the problems Maimonides faced and the sources from which he drew. He argues that Maimonides meant exactly what he said: the world was created by a free act of God so that the existence (...) of everything other than God is contingent. In religious terms, existence is a gift. In order to reach this conclusion, Seeskin examines Maimonides' view of God, miracles, the limits of human knowledge, and the claims of astronomy to be a science. In ‘(Really) Defending Exclusionary Reasons’, Monti seeks to defend Raz’ notion of exclusionary reasons from the attack made by Daniel Whiting. Monti agrees with Whiting that exclusionary reasons cannot motivate and so suggests that they operate by guiding rather than motivating. However, Monti’s account of guiding omits the key feature that they can guide even when one’s action is the opposite to what the exclusionary reason seems to recommend. An amended account of what it is to be guided by exclusionary (...) reasons is needed to give the Razian account the explanatory power it is due. (shrink)

Some 30 years ago the role of the clinical ethics consultant (CEC) was formalized. At the time, the perception of the role differed between two groups serving in that capacity, clinicians and nonclinicians. Differences in their roles reflected their training and experience.These divergent views were resolved semantically by designating the role of the CEC as “ethics facilitation.” In practice the different perspectives have remained. However, the subsequent published literature on clinical ethics consultation has not adequately reflected the activity of the (...) clinician as a CEC.There have been recurring unanswered calls for the acquisition of empirical data on the nature of the problems that prompt ethics consultation requests and the functions required to address them. The authors introduce a template that provides a means to acquire such data for clinician ethicists. A similar instrument could be constructed to reflect the role of the nonclinician ethicist serving in that capacity. (shrink)

This paper addresses the relationship between theoretical and applied ethics. It directs philosophical attention toward the concept of ideology, conceived as a bridge between high-level principles and decision-making practice. How are we to understand this bridge and how can we avoid the naturalistic fallacy while taking ideology seriously?It is then suggested that the challenge posed by ideology in the arena of organizational ethics is in many ways similar to the challenge posed by developmentalist accounts of moral stages in the arena (...) of individual ethics, namely, how to account for the normative force of frameworks that are theoretically derivative yet practically essential. One of the largest, oldest, and most interesting challenges in health care is the balancing act in which clinicians have generally uncontroversial duties both to individual patients and to communities. Physicians and nurses must — so we teach them — put patients first, and at the same time recognize that individuals are members of communities. Individuals affect the health of communities, and communities affect the health of individuals. Thus, the moral and professional duties that result are sometimes in conflict.Moreover, the (...) traditional, prosaic clinical encounter is evolving in an environment increasingly shaped by electronic health records, personal health records, pharmacogenomics and vast networks of data collection and storage for public health surveillance, human subjects research, health services evaluation, and comparative effectiveness research. This article reviews the use of implantable radiofrequency identification (RFID) tags in humans, focusing on the VeriChip (VeriChip Corporation, Delray Beach, FL) and the associated VeriMed patient identification system. In addition, various nonmedical applications for implanted RFID tags in humans have been proposed. The technology offers important health and nonhealth benefits, but raises ethical concerns, including privacy and the potential for coercive implantation of RFID tags in individuals. A national discussion is needed to identify the limits of acceptable use of (...) implantable RFID tags in humans before their use becomes widespread and it becomes too late to prevent misuse of this useful but ethically problematic technology. If social inequality results from discriminatory behaviors or policies based on membership in a race and ethnicity, as it certainly has in the U. S., should policy in a liberal society offer group-based benefits? The civil rights era answered positively. Identity politics, diversity rationales, and pressures for color-blind policy are challenging that answer. What and how we measure is in the middle of the argument.

The advent of distinctively Modern European philosophy at the turn of the seventeenth century was occasioned by two major developments: the painful recognition after thirty years of religious war that principles of public conduct must be justified independently of sectarian religious dogma; and the growth of natural science, especially discoveries in astronomy that linked terrestrial and celestial physics in a newly mathematicized, explanatory mechanics founded by Galileo and dramatically extended by Newton. The roles of reason and empirical evidence in inquiry, (...) and their superiority to custom and tradition for knowledge of nature were undeniable, though their respective roles and proper epistemological accounting were far from obvious. I review briefly some key points in the advent of natural science in order show that some fundamental philosophical predilections have obscured the proper roles of reason and evidence in the philosophical accounting of scientific knowledge. These predilections are found both among rationalists and among empiricists. Though they may be more readily apparent among seventeenth and eighteenth century philosophers, they are no less prevalent in mainstream analytical philosophy of science. Their diagnosis augurs a fundamental philosophical reorientation, a reorientation inaugurated, indeed, by Hegel. (shrink)
