This paper focuses on experiences from a case study dealing with the Swiss type of a consensus conference called “PubliForum” concerning “Genetic Technology and Nutrition” (1999). Societal and ethical aspects of genetically modified food meanwhile can be seen as prototypes of topics depending on the involvement of the public through a participatory process. The important role of the lay perspective in this field seems to be accepted in practice. Nevertheless, there is still some theoretical controversy about the necessity and democratic (...) legitimacy of participatory processes in general, and especially about those dealing with technological or environmental problems (sustainable development) concerning society. From an ethical point of view, a lot of heterogeneous problems concerning contents and procedures of public participation can be pointed out, not only on the theoretical level but also in practice, e.g., concerning the communication process between laypersons and experts. The intention of our paper is to give hints and to clarify criteria that support the communication process leading to a dialog of autonomous citizens and which especially consider ethical aspects in the field. One important result is that there must be an orientation for all members of a consensus conference having clear rules and knowing their different roles that support transparency, credibility, and fairness of the whole procedure and a “good product”: a substantial final document or citizens’ report. Proper wiring of the nervous system requires tight control of the number of nerve terminals that innervate a target tissue. Recent work by Deppmann et al.,1 now suggests that this is achieved by feedback‐mediated neuronal competition for target‐derived survival cues. : To what extent do moral judgments depend on conscious reasoning from explicitly understood principles? We address this question by investigating one particular moral principle, the principle of the double effect. Using web-based technology, we collected a large data set on individuals’ responses to a series of moral dilemmas, asking when harm to innocent others is permissible. Each moral dilemma presented a choice between action and inaction, both resulting in lives saved and lives lost. Results showed that: patterns of moral (...) judgments were consistent with the principle of double effect and showed little variation across differences in gender, age, educational level, ethnicity, religion or national affiliation and a majority of subjects failed to provide justifications that could account for their judgments. These results indicate that the principle of the double effect may be operative in our moral judgments but not open to conscious introspection. We discuss these results in light of current psychological theories of moral cognition, emphasizing the need to consider the unconscious appraisal system that mentally represents the causal and intentional properties of human action. The goal of this essay is to assess the Selected-Effects Etiological Theory of biological function, according to which a trait has a function F if and only if it has been selected for F. First, I argue that this approach should be understood as describing the paradigm case of functions, rather than as establishing necessary and sufficient conditions for function possession. I contend that, interpreted in this way, the selected-effects approach can explain two central properties of functions and can satisfactorily (...) address some recent counterexamples. This reading, however, shows that there is only a partial overlap between biological functions and selected effects, so the former cannot be reduced to the latter. Finally, I maintain that this result is still compatible with a naturalistic theory of function that appeals to some evolutionary process. (shrink)

In this paper a model for barrecursion is presented. It has as a novelty that it contains discontinuous functionals. The model is based on a concept called strong majorizability. This concept is a modification of Howard's majorizability notion; see [T, p. 456].

This paper explains how the current architecture of the pharmaceutical markets has created a misalignment of financial incentives and public health that is a central cause of harmful practices. It explores three possible solutions to address that misalignment: taxes, increased financial penalties, and drug pricing based on value. Each proposal could help to partly realign financial incentives and public health. However, because of the limits of each proposal, there is no easy solution to fixing the problem of financial incentives.

This paper explores the nature of the relationship between corporate social responsibility (CSR) and competitiveness. We start with the commonly held view that firm competitiveness is defined by the market. That is, the question of what are the critical competitiveness factors is answered by looking at how companies and financial analysts describe and evaluate a firm. To analyze this, we review the current state of the art on the relationship between CSR and competitiveness. Second, CSR criteria used by financial analysts (...) is identified and compared with company valuation methods. Third, the results of a multi-stakeholder dialogue on CSR and competitiveness of the European financial sector are presented. As a conclusion, we argue that CSR and competitiveness relate through a learning and innovation cycle, where corporate values, policies and practices are permanently defined and re-defined. Thus, we propose that learning takes place as CSR is embedded in business processes, and that once it has been integrated, in turn, it generates innovative practices, and finally, competitiveness. At the end of the paper, we propose that CSR in practice consists of managing inherent paradoxes generated by the tension between CSR and business policies. (shrink)

Australia’s experience of the COVID-19 pandemic has been widely perceived to have been a successful one, based on the relatively few number of lives lost to the virus compared to the rest of the world. There remain, nonetheless, serious ethical challenges at the heart of the Australian response to COVID-19. The broadly positive outcomes of Australia’s pandemic response mask more troubling developments within its political culture, and the costs it has imposed on its society. Across the management, social science, and business ethics literatures, and in much of the philosophy literature, trust is characterized as a disposition to act given epistemic states—beliefs and/or expectations about others and about the risks involved. This characterization of trust is best thought of as epistemological because epistemic states distinguish trust from other dispositions. The epistemological characterization of trust is the amoral one referred to in the title of this paper, and we argue that this characterization is conceptually inadequate. We (...) outline and defend an alternative conception of trust as a moral phenomenon: when A trusts B to do something, A invites B to acknowledge and accept an obligation; when B accepts the invitation, B takes on an obligation; in that way trust creates an obligation. We conclude with an application, drawing out the difference between the epistemological conception of trust and our own in the context of Ghoshal et al.'s (Sloan Management Review 40:9—20, 1995, Academy of Management Learning & Education 4:75—91, 2005) critique of transaction cost theories of the firm. Improper dependencies slant policy over a drug's life span, biasing the development of new drugs, the testing and marketing approval for new drugs, and the monitoring of patient safety after drugs are marketed. This article examines five ways in which the public improperly depends on pharmaceutical firms that compromise the integrity of pharmaceutical policy. Today the public relies on pharmaceutical firms: (1) to set priorities on drug research and development; (2) to conduct clinical trials to test whether drugs are safe (...) and effective; (3) to decide what clinical trial data to disclose to the public; (4) to monitor post marketing drug safety; (5) to supply product information to physicians and to finance continuing medical education and other professional activities. To mitigate risk, should companies signal a broad range of environmental, social, and governance initiatives or instead focus on only a few ESG issues? Drawing on signaling theory, we propose that a broad array of ESG initiatives generates not only signal consistency but also accelerating signal costs. Our empirical results support the resultant hypothesis of a curvilinear relationship between ESG scope and equity risk. In addition, this U-shaped curve seems to become steeper when firms face multiple media-reported ESG controversies. Overall, (...) our study qualifies the conventional wisdom that firms can reduce equity risk by attending to a wide variety of stakeholders and highlights the moderating impact of the firm’s media environment. Through the 1960s, many people claimed that drug advertising was educational and physicians often relied on it. Continuing Medical Education (CME) was developed to provide an alternative. However, because CME relied on grants, industry funders chose the subjects offered. Now policymakers worry that drug firms support CME to promote sales and that commercial support biases prescribing and fosters inappropriate drug use. A historical review reveals parallel problems between advertising and industry-funded CME. To preclude industry influence and improve CME, we should (...) ensure independent funding by taxing medical industries, facilities and physicians. Independent public and professional authorities should create CME curricula. An independent agency should allocate all funds to educational institutions for approved curricula. (shrink)

In this article we present a new approach to practical artificial intelligence (AI) ethics in heavy industry, which was developed in the context of an EU Horizons 2020 multi partner project. We begin with a review of the concept of Industry 4.0, discussing the limitations of the concept, and of iterative categorization of heavy industry generally, for a practical human centered ethical approach. We then proceed to an overview of actual and potential AI ethics approaches to heavy industry, suggesting that (...) current approaches with their emphasis on broad high-level principles are not well suited to AI ethics for industry. From there we outline our own approach in two sections. The first suggests tailoring ethics to the time and space situation of the shop floor level worker from the ground up, including giving specific and evolving ethical recommendations. The second describes the ethicist’s role as an ethical supervisor immersed in the development process and interpreting between industrial and technological (tech) development partners. In presenting our approach we draw heavily on our own experiences in applying the method in the Use Cases of our project, as examples of what can be done. (shrink)

What is the purpose of political theoretical endeavour and what methods should the early 21st-century political theorist employ? These questions – which touch on issues which go to the very heart of the vocation of political theory – have become increasingly contentious in recent years. The period since the late 1980s has been one in which theorists have increasingly disagreed not only about conventional matters of normative contention but also about the means by which to seek to resolve them. This (...) article examines a central tension that has characterized that general methodological disagreement, namely the place of empirical inquiry within the repertoire of the professional political theorist. Having carefully examined the contentions of an eclectic range of contributors to the debate, including G.A. Cohen, Alasdair MacIntyre and David Miller, this article argues that efforts either wholly to separate empirical investigation from normative enquiry or to bind the two ever-closer together are fraught with difficulties. It concludes by contending that political theorists ought to take aspects of the empirical political and social sciences extremely seriously while avoiding the temptation to have their normative agenda dictated to them by the contingent pressures of the here and now. And can we regard the situation in which he never comes into existence as worse for him? In this paper, we argue that both questions should be answered affirmatively. Neurocognitive models (e.g., Schirmer & Kotz, 2006) have helped to characterize how listeners incrementally derive meaning from vocal expressions of emotion in spoken language, what neural mechanisms are involved at different processing stages, and their relative time course. But how can these insights be applied to communicative situations in which prosody serves a predominantly interpersonal function? This comment examines recent data highlighting the dynamic interplay of prosody and language, when vocal attributes serve the sociopragmatic goals of the speaker or reveal (...) interpersonal information that listeners use to construct a mental representation of what is being communicated. Our comment serves as a beacon to researchers interested in how the neurocognitive system “makes sense” of socioemotive aspects of prosody. (shrink)

This study presents the theoretical apparatus of Foucault's early historical analyses as a version of Kantian criticism. In an initial textual exposition, the author attempts to distill a unified discursive practice from Kant's theoretical writings, arguing for Foucault's proximity to Kant on the basis of this reconstruction, by showing that his studies are modeled on this way of thinking. By recasting it in this framework, an unorthodox version of Foucault's work is generated, one that is at odds with the tendency (...) to emphasize a certain skepticism about the possibility of universal and necessary knowledge in his writings, and to mistake it for irrationalism and a hostility to the practice of theory. By drawing attention to the structural parallel between Foucault's practice and Kantian criticism, this study belies this picture. (shrink)

Without the support of imagination, one would not have the slightest idea of the cruel ‘real’ that has occurred in the Nazi extermination camps. Yet, in documentaries imaging the events of the Shoah, one runs the risk of missing their most basic property, namely their unimaginability. The mere idea that one is able to imagine the unimaginable comes down to a denial of the Shoah’s status as an event that defies our understanding. The unimaginable ‘real’ of the Shoah, however, is (...) not simply located in its object, in the cruelty of what happened in the camp. The Shoah makes us at the same time facing the unimaginable ‘real’ of the modern subject—the blind spot in our own identity. If we need imagination to deal with the Shoah, it is also because of an ungraspable ‘real’ in ourselves. This is why adequate Shoah representations, acknowledging their object as being beyond representation, include the same ‘beyond’ concerning the subject of the Holocaust memory. The essay makes this clear in an elaborated comparison of Claude Lanzmann’s 1985 film, Shoah, with some conceptual works of art from the late nineties—all of this ‘fine-tuned’ in a reflection upon Ingmar Bergman’s Persona. In this article we present a new experimental paradigm: comparative visual search. Each half of a display contains simple geometrical objects of three different colors and forms. The two display halves are identical except for one object mismatched in either color or form. The subject's task is to find this mismatch. We illustrate the potential of this paradigm for investigating the underlying complex processes of perception and cognition by means of an eye‐tracking study. Three possible search strategies are outlined, discussed, (...) and reexamined on the basis of experimental results. Each strategy is characterized by the way it partitions the field of objects into “chunks.” These strategies are: (i) Stimulus‐wise scanning with minimization of total scan path length (a “traveling salesman” strategy), (ii) scanning of the objects in fixed‐size areas (a “searchlight” strategy), and (iii) scanning of object sets based on variably sized clusters defined by object density and heterogeneity (a “clustering” strategy). To elucidate the processes underlying comparative visual search, we introduce besides object density a new entropy‐based measure for object heterogeneity. The effects of local density and entropy on several basic and derived eye‐movement variables clearly rule out the traveling salesman strategy, but are most compatible with the clustering strategy. Post-industrial societies confront common problems in pharmaceutical industry-physician relations. In order to promote sales, drug firms create financial relationships that influence physicians' prescriptions and sometimes even reward physicians for prescribing drugs. Three main types exist: kickbacks, gifts, and financial support for professional activities. The prevalence of these practices has evolved over time in response to changes in professional codes, law, and markets. There are certainly differences among these types of ties, but all of them can compromise physicians' independent judgment and (...) rational prescribing.Drug firms have paid kickbacks for prescribing drugs, purchasing drugs, switching brands prescribed, adding a drug to a hospital formulary, enrolling patients in post-marketing clinical trials, and writing practice guidelines that encourage the use of certain drugs.
