The COVID-19 pandemic crisis has necessitated widespread adaptation of revised treatment regimens for both urgent and routine medical problems in patients with and without COVID-19. Some of these alternative treatments maybe second-best. Treatments that are known to be superior might not be appropriate to deliver during a pandemic when consideration must be given to distributive justice and protection of patients and their medical teams as well the importance given to individual benefit and autonomy. What is required of the doctor discussing (...) these alternative, potentially inferior treatments and seeking consent to proceed? Should doctors share information about unavailable but standard treatment alternatives when seeking consent? There are arguments in defence of non-disclosure; information about unavailable treatments may not aid a patient to weigh up options that are available to them. There might be justified concern about distress for patients who are informed that they are receiving second-best therapies. However, we argue that doctors should tailor information according to the needs of the individual patient. For most patients that will include a nuanced discussion about treatments that would be considered in other times but currently unavailable. That will sometimes be a difficult conversation, and require clinicians to be frank about limited resources and necessary rationing. However, transparency and honesty will usually be the best policy. Healthcare priority-setting institutions have good reason to want to demonstrate that their decisions are morally justified—and those who contribute to and use the health service have good reason to hope for the same. However, finding a moral basis on which to evaluate healthcare priority-setting is difficult. Substantive approaches are vulnerable to reasonable disagreement about the appropriate grounds for allocating resources, while procedural approaches may be indeterminate and insufficient to ensure a just distribution. In this paper, we set out a complementary, (...) coherence-based approach to the evaluation of healthcare priority-setting. Drawing on Rawls, we argue that an institutional priority-setter’s claim to moral justification can be assessed, in part, based on the extent to which its many normative commitments are mutually supportive and free from dissonance; that is, on the ability to establish narrow reflective equilibrium across the normative content of a priority-setter’s policy and practice. While we do not suggest that the establishment of such equilibrium is sufficient for moral justification, we argue that failure to do so might—like the proverbial canary in the coalmine—act as a generalised warning that something is awry. We offer a theoretical argument in support of this view and briefly outline a practical method for systematically examining coherence across priority-setting policy and practice. (shrink)

This work offers a new democratic case for federalism, understood as a form of governance in which multiple entities in a country possess final decision-making authority (viz., can make decisions free from others substituting their decisions, issuing fines, etc.) over at least one subject (e.g., immigration, defense). It argues that leading solutions to the democratic boundary problem provide overlapping arguments for federalism. The underlying logic and many details of the most commonly cited solutions focused on those relevantly affected by and (...) subject to decisions each support three distinct arguments (focused on voteshares, other forms of democratic influence, and persistent minorities) for multiple demoi possessing authority in a polity. Federalism is the best available method for recognizing the distinct demoi. This not only supports federal governance as opposed to unitary governance and subsidiarity. Fossil fuel divestment movements have gained momentum since 2011, aimed at ending fossil fuel use and a move toward a cleaner, affordable, and sustainable energy system, for business and society. The present study investigates the direct impact of fossil fuel divestment announcements on stock prices of firms listed on the United States' stock exchanges. Using an event study and guided by the United Nation's sustainable development goals (SDGs), we test the effects of 116 divestments announcements between 2014 and 2019 on (...) 51 publicly traded fossil fuel companies. Our results suggest that there is a negative effect of these announcements on fossil fuel firm stock prices. Also, we find that the type of fossil fuel firm (coal or oil and gas), the type of divestment (partial, coal only, or full), the timing of the announcement, and the size of the divesting investor have some explanatory power in relation to the (cumulative) abnormal returns following the divestment announcements. While the negative impact on stock prices is not surprising, the reaction from the divested firms after such large divestitures is not consistent with what may be expected, given past reactions to divestitures seeking to achieve different social goals. Given the SDGs, it seems clear why investors are divesting themselves from fossil fuel firms, but why has the reaction to the 116 divestments led to very little change in the way these publicly traded fossil fuel firms do business given their direct and growing impacts on society? Marcos Eberlin is a chemist and mass spectrometer who advances in a new book a refined Intelligent Design theory hinging on “foresight,” or the apparent teleology and purpose discernible in biological, chemical, and other complex life systems. Repurposing older ID arguments, such as those of “irreducible complexity,” and introducing new examples of phenomena pointed to by other ID theorists, Eberlin makes a strong argument for mindful creation by a “superintellect”. But is ID sufficient to answer Darwinism? Does “foresight” go far (...) enough in providing an alternative view of the origin of complex lifeforms? I argue that Eberlin, and other ID theorists, does not have a robust-enough definition of science to counter non-theistic theories of biology and biochemistry. An Aristotelian-Thomistic understanding of science allows us to go beyond the divide between ID and a-theistic theories and move the science-and-faith debate onto more solid ground. (shrink)

Physics has been thought to truly represent reality since at least Galileo, and the foundations of physics are always established using philosophical ideas. In particular, the elegant naming of physical entities is usually very influential in the acceptance of physical theories. We here demonstrate (using current developments in thermodynamics as an example) that both the epistemology and the ontology of physics ultimately rest on poetic language. What we understand depends essentially on the language we use. We wish to establish our (...) knowledge securely, but strictly speaking this is impossible using only analytic language. Knowledge of the meanings of things must use a natural language designed to express meaning, that is, poetic language. Although the world is really there, and although we can indeed know it truly, this knowledge is never either complete or certain but ultimately must rest on intuition. Reading a recently discovered artefact with a palaeo-Hebrew inscription as from the first century, we demonstrate from it that this ontological understanding long predates the Hellenic period. The linguistic input children receive across early childhood plays a crucial role in shaping their knowledge about the world. To study this input, researchers have begun applying distributional semantic models to large corpora of child‐directed speech, extracting various patterns of word use/co‐occurrence. Previous work using these models has not measured how these patterns may change throughout development, however. In this work, we leverage natural language processing methods—originally developed to study historical language change—to compare caregivers' use of words when talking to (...) younger versus older children. Some words' usage changed more than others; this variability could be predicted based on the word's properties at both the individual and category levels. These findings suggest that caregivers' changing patterns of word use may play a role in scaffolding children's acquisition of conceptual structure in early development. (shrink)

Against contextualism, Duncan Pritchard has argued that conversational pragmatics give rise to an argument in favour of invariantist neoMooreanism. More specifically, he argues that when we conjoin a Moorean view with a warranted assertability manoeuvre, we can satisfy our pretheoretical intuitions (which are decidedly invariantist), whereas contextualists cannot. In the following paper, I challenge Pritchard’s argument and contend that he is too quick to declare victory for invariantism, for not only does the WAM he employs appear to be ad hoc (...) vis-à-vis DeRose’s plausible criteria, but it also seems to have very implausible pragmatic implications when subjected to close scrutiny. According to the thesis of the guise of the normative, all desires are associated with normative appearances or judgments. But guise of the normative theories differ sharply over the content of the normative representation, with the two main versions being the guise of reasons and the guise of the good. Chapter 6 defends the comparative thesis that the guise of reasons thesis is more promising than the guise of the good. The central idea is that observations from the theory of (...) content determination can be used in order to constrain possible theories of the representational contents associated with desire. The authors argue that the initially most promising versions of the guise of the good fail to meet these constraints, and then explain the steep challenge confronting any who wish to craft a new guise of the good theory which meets the constraints while also preserving the initial motivations for adopting any guise of the normative theory at all. The most important and extensive of Bernard Bolzano’s (1781–1848) correspondences is the one with his student and friend Michael Josef Fesl (1788–1864) which comprises altogether some 730 letters. Due to the great number of letters, starting with 1831, only Bolzano’s contributions are contained in his Collected Writings. Therefore, Fesl’s letters to Bolzano are published in the series "Beitraege zur Bolzano-Forschung". The present volume contains 88 letters that Fesl wrote in the years 1839 to 1841 to his “most-beloved teacher and (...) friend”. They focus on the works published by Bolzano during those years as well as on several projects that could not be realized. Moreover, they deal with philosophical trends, theological questions and political problems as well as with the epidemics of that time and their various treatments (including their success). Finally, Fesl also discusses the qualities of three portraits of Bolzano’s created by Áron Pulzer, Heinrich Hollpein und Karl Hoffmann during those years. (shrink)

This paper seeks to answer the following question: What is a minimal set of entities that form an ontology of the natural world, given our well-established physical theories? The proposal is that the following two axioms are sufficient to obtain such a minimalist ontology: (1) There are distance relations that individuate simple objects, namely matter points. (2) The matter points are permanent, with the distances between them changing. I sketch out how one can obtain our well-established physical theories on the (...) basis of just these two axioms. The argument for minimalism in ontology then is that it yields all the explanations that one can reasonably demand in science and philosophy, while avoiding the drawbacks that come with a richer ontology. The objective of this thesis – Reflective Equilibrium as a Form of Life – is to contribute to the deepening of understanding of the method of reflective equilibrium – a method of internal epistemic justification. In the first part of the study, four paradigmatic conceptions of the method will be analyzed in order to carve out a conceptual core: The ones by John Rawls – who coined the name of the method – Norman Daniels, Michael DePaul and Catherine Elgin. (...) I will argue that the conceptual core of the method contains four elementary rules: 1) A minimalistic fallibilism, 2) a moderate holism, 3) a minimalistic rationality, and 4) a weak foundationalism. Compliance with these rules is necessary and jointly sufficient for any epistemic procedure of justification to be in accordance with the method of reflective equilibrium. The second part of the study is intended to answer some of the open questions concerning this definition of the conceptual core of the method. It will be argued that the a minimalistic fallibilism, as a very central element of the method, is justified since there is no belief whose truth is transparent to an epistemic agent. Even if it were the case that such beliefs exist, there would be attractive options of retreat which provide a quasi-universal justification of minimalistic fallibilism. It will also be argued that all alternative methods of justification are either compatible with the method of reflective equilibrium or are not justified. While a metajustification of the method – understood as a justification of the method employing the method itself – is on the one hand not completely satisfactory, as it presupposes the acceptance of the method before it is justified, it is epistemically acceptable on the other hand, since it allows for a critical inquiry and is open-ended. It will be pointed out that a moderate foundationalism can be justified by the method for some specific area of inquiry insofar as basic beliefs can be identified. Yet, the default-position of the method is only a weak foundationalism (often also termed “coherentism”). With regard to the possibility of a formal interpretation of the method with which one could specify key terms used in the definition of the conceptual core, I will sketch general ways such a formalization might take. However, I will argue that the informal interpretation of the method has priority over any formal interpretation. In the third and concluding part of the study, I will present the claim that one should interpret the method of reflective equilibrium as a form of life. This means that the method is at least implicitly accepted by some epistemic agents: they have developed a disposition and ability to act according to the method. This interpretation of the method can be related to the notion of critical thinking, which, as a civic virtue and educational ideal, is subject of empirical research and practical application. A possible misunderstanding with respect to the method of reflective equilibrium as a form of life should be avoided: To interpret the method as a form of life does not indicate that it must be a comprehensive form of life. Acknowledging it in private life is optional. According to the proposed understanding of the method it is primarily a public and political form of life. (shrink)

It is widely believed that open and public speech is at the heart of the democratic ideal. Public discourse is instrumentally epistemically valuable for identifying good policies, as well as necessary for resisting domination (e.g., by vocally challenging decision-makers, demanding public justifications, and using democratic speech to hold leaders accountable). But in our highly polarized and socially fragmented political environment, an increasingly pressing question is: do actual democratic societies live up to the ideal of inclusive public speech? In this essay, (...) I explore Maxime Lepoutre's defence of discursive democracy from the challenge of defective public discourse. I argue that political ignorance, dogmatism, and social fragmentation present more formidable challenges to discursive democracy than Lepoutre acknowledges. The standard way to test alternative descriptive theories of moral judgment is by asking subjects to evaluate (amongst others) sacrificial dilemmas, where acting classifies as a utilitarian moral judgment and not acting classifies as a deontological moral judgment. Previous research uncovered many situational factors that alter subject’s moral judgments without affecting which type of action utilitarianism or deontology would recommend. This literature review provides a systematic analysis of the experimental literature on the influence of situational factors on moral judgments in (...) sacrificial dilemmas. It analyses 53 articles in detail and reports mean effect sizes, as well as operationalizations, for 36 situational factors that significantly influence moral judgment. Moreover, the review discusses how the impact of situational factors relates to a dual process theory of moral judgment. It supports the view that utilitarian judgments are driven by controlled cognitive processes and shows that the drivers of deontological judgments depend on valence. (shrink)

But it is argued that essence can be freed from these presuppositions and their problems. Even so, a puzzle still arises. In a Platonic spirit, essences in general seem detached from the world. In an Aristotelian spirit, social essences in particular seem embedded in the world. (...) The puzzle is that these inclinations are individually plausible but jointly incompatible. “Masturbation and the Problem of Irrational and Immoral Sexual Activity” by Michael Tooley -/- Tooley argues that aside from sex that aims at reproduction, most human sexual activity is both irrational and immoral, since it is dangerous, and equal or greater pleasure can be achieved by sex that is, truly, completely safe. Tooley then asks what must be done to arrive at a rational approach to human sexuality, and here he argues that it must be shown, first, that so-called (...) ‘safe sex’ is anything but. Second, the ‘no safe sex’ army needs to be challenged to say what is unsafe about masturbation, either mutual or do-it-yourself. Finally, irrational views of sexuality are frequently derived from the teachings of the so-called ‘great religions’, especially Judaism and Christianity, and the irrationality of those approaches to sex needs to be clearly demonstrated. In this paper I propose to shed new light on the role of feeling in Kant’s psychology of moral motivation by focusing on the concept of an incentive (Triebfeder), a term he borrowed from one of his most important rationalist predecessors, Alexander Gottlieb Baumgarten. I argue that, similar to Baumgarten, Kant understands an incentive to refer to the ground of desire and that feelings function as a specific kind of ground within Kant’s psychology of moral action, namely as the ‘impelling (...) cause’ of desire. I claim that this interpretation has several advantages over the alternatives currently on offer in the literature. (shrink)

America’s legal system harbors serious, widespread injustices. Many defendants are sent to prison for nonviolent offenses, including many victimless crimes. Convicts often serve draconian sentences in crowded prisons rife with abuse. Almost all defendants are convicted without trial because prosecutors threaten defendants with drastically higher sentences if they request a trial. Most Americans are terrified of encountering any kind of legal trouble, knowing that both civil and criminal courts are extremely slow, unreliable, and expensive to use. This book explores the (...) largest injustices in the legal system and what can be done about them. Besides proposing institutional reforms, the author argues that prosecutors, judges, lawyers, and jury members ought to place justice before the law – for example, by refusing to enforce unjust laws or impose unjust sentences. In this paper I argue that philosophers of sport should avoid value-laden definitions of sport; that is, they should avoid building into the definition of sport that they are inherently worthwhile activities. Sports may very well often be worthwhile as a contingent matter, but this should not be taken to be a core feature included in the definition of sport. I start by outlining what I call the ‘legitimacy-conferring’ element of the category ‘sport’. I then argue that we ought not (...) to include such a dimension in our definition of sport, on the grounds that it confuses issues of description with issues of definition: the issue of what sport does with what sport is. Following this, I consider a Wittgensteinian family resemblance approach to defining sport; Kevin Schieman’s argument that sports are necessarily good games; and the oft-cited wide-following and institutional criteria, as arguments for including an evaluative dimension in the definition of sport. I conclude that none succeed, for similar reasons: they either fail to track our common sense intuitions about what does or does not count as a sport; and/or they make it impossible for us to ever describe something a ‘bad’ sport (or instance of sport). Just as a good definition of, say, art, shouldn’t make it impossible for us to describe something as ‘bad art’, I argue that our definition of sport shouldn’t build in a necessarily positive evaluation. I conclude by discussing some of the practical reasons why supporters of activities about which there is currently debate as to their status as sports might want to see those activities included under the sports umbrella, but suggest that this on its own isn’t a good reason for modifying a philosophical definition of sport to include them.
